<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2469</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210726">July 26, 2021</action-date><action-desc><sponsor name-id="S397">Mr. Braun</sponsor> (for himself and <cosponsor name-id="S376">Ms. Ernst</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBU00">Committee on the Budget</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>Establishing appropriate thresholds for certain budget points of order in the Senate, and for other purposes. </official-title></form><legis-body><section id="id2A3DD01F0E7E4D91B541FDC0CE26C8FD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Make Rules Matter Act</short-title></quote>.</text></section><section id="idE765DD3238A14EFB85451BFBACBE5CFD" section-type="subsequent-section"><enum>2.</enum><header>Thresholds for budget points of order</header><subsection id="idB70BC936D544475BAD92A2BDF2E016E0"><enum>(a)</enum><header>Threshold for point of order against emergency designations</header><paragraph id="idDE24A03DA9ED43F395F57258985814C7"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>emergency designation point of order</term> means a point of order raised under—</text><subparagraph id="id39D67FB638964DAB92B3DD85D6E7BD8B"><enum>(A)</enum><text>section 314(e) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/645">2 U.S.C. 645(e)</external-xref>);</text></subparagraph><subparagraph id="id29BAA2D7AF804D138552931963F17FD4"><enum>(B)</enum><text>section 4(g)(3) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)(3)</external-xref>); or</text></subparagraph><subparagraph id="idA082824EA04C489890A9353D6FFF7107"><enum>(C)</enum><text>section 4112(e) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018.</text></subparagraph></paragraph><paragraph id="id40D53F7585CE4DFE918D555CB957202F"><enum>(2)</enum><header>Waiver</header><text>In the Senate, an emergency designation point of order may be waived or suspended only by the affirmative vote of two-thirds of the Members, duly chosen and sworn.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31AD94D100A14C97BDE7EE3D97BE927F"><enum>(3)</enum><header>Appeal</header><text>In the Senate, an affirmative vote of two-thirds of the Members, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on an emergency designation point of order.</text></paragraph></subsection><subsection id="id76ECBD3EFB7C43DA9D10DE3115E90285"><enum>(b)</enum><header>Threshold for large budget impact for certain Congressional Budget Act of 1974 points of order</header><paragraph id="id245DDA52E6C74514A5FD76C4B3594E15"><enum>(1)</enum><header>In general</header><text>A point of order described in paragraph (3) may be waived or suspended in the Senate only by an affirmative vote of two-thirds of the Members, duly chosen and sworn.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3A9366FB660A4DD5BDAAA82B91CD2389"><enum>(2)</enum><header display-inline="yes-display-inline">Appeal</header><text display-inline="yes-display-inline">In the Senate, an affirmative vote of two-thirds of the Members, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on a point of order described in paragraph (3).</text></paragraph><paragraph id="idCD1725C2E5DD4710801448E061750EF6"><enum>(3)</enum><header>Description of large budget impact</header><text>A point of order described in this paragraph is a point of order under section 302(f)(2) or 311(a)(2)(A) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/633">2 U.S.C. 633(f)(2)</external-xref>, 642(a)(2)(A)) against legislation that would, within the time periods applicable to the point of order, as determined by the Chairman of the Committee on the Budget of the Senate, cause budget authority or outlays to exceed the applicable allocation, suballocation, level, or aggregate by more than $5,000,000,000.</text></paragraph></subsection><subsection id="iddf18301ec9024b9696d1c0588278aab7"><enum>(c)</enum><header>De minimis budget impact</header><text>For a violation for which the absolute value of the violation is not more than $500,000, a point of order shall not lie—</text><paragraph id="idefd90acd015c45dcae54149b594ed985"><enum>(1)</enum><text>under the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/621">2 U.S.C. 621 et seq.</external-xref>) (except for a point of order under section 302 or 311 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/633">2 U.S.C. 633</external-xref>, 642)); or</text></paragraph><paragraph id="id3fed238b63ba426a92b9b3688d839451"><enum>(2)</enum><text>under any concurrent resolution on the budget.</text></paragraph></subsection><subsection id="idBB88795696E54B849016177865DD0BCC"><enum>(d)</enum><header>Threshold for increasing short-Term deficits</header><paragraph id="id5C56318FEDED457E9372A1C6439C4604"><enum>(1)</enum><header>Reduction in net increase in the deficit</header><text>In the Senate, section 404(a) of S. Con. Res. 13 (111th Congress), the concurrent resolution on the budget for fiscal year 2010, shall be applied by substituting <quote>$1,000,000,000</quote> for <quote>$10,000,000,000</quote>.</text></paragraph><paragraph id="iddaa0cdbb0cf7478cb073352163c2ebd5"><enum>(2)</enum><header>Waiver and appeal for large budget impact in the Senate</header><subparagraph id="idEEEADD03562345FAB3A066CFCAE6C697"><enum>(A)</enum><header>Waiver</header><text>In the Senate, section 404(a) of S. Con. Res. 13 (111th Congress), the concurrent resolution on the budget for fiscal year 2010, may be waived or suspended by the affirmative vote of two-thirds of the Members, duly chosen and sworn, if the net increase in the deficit in any fiscal year exceeds $10,000,000,000.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4F9DC687FD5B4B228456D66AF84DA6EB"><enum>(B)</enum><header>Appeal</header><text>In the Senate, an affirmative vote of two-thirds of the Members, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on a point of order raised under section 404(a) of S. Con. Res. 13 (111th Congress), the concurrent resolution on the budget for fiscal year 2010, if the net increase in the deficit in any fiscal year exceeds $10,000,000,000.</text></subparagraph></paragraph></subsection><subsection id="idC85D8E0E94A447259CE9CF8E57AA36F5"><enum>(e)</enum><header>Threshold for increasing long-Term deficits</header><paragraph id="id7BD242BA06E745C9BA724A147ED80EC9"><enum>(1)</enum><header>Reduction in net increase in the deficit</header><text>In the Senate, subsections (a) and (b)(1) of section 3101 of S. Con. Res. 11 (114th Congress), the concurrent resolution on the budget for fiscal year 2016, shall each be applied by substituting <quote>$1,000,000,000</quote> for <quote>$5,000,000,000</quote>.</text></paragraph><paragraph id="idFC89C2B80FD042A6A0A1AE9E8779A4B8"><enum>(2)</enum><header>Waiver and appeal for large budget impact in the Senate</header><subparagraph id="id50FE7CDC37B6412EAFBD2CF5A783EA90"><enum>(A)</enum><header>Waiver</header><text>In the Senate, section 3101(b)(1) of S. Con. Res. 11 (114th Congress), the concurrent resolution on the budget for fiscal year 2016, may be waived or suspended by the affirmative vote of two-thirds of the Members, duly chosen and sworn, if the net increase in on-budget deficits in any 10-fiscal-year period exceeds $10,000,000,000.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5C9E5D76A98C4A56BA02C90650D75CEC"><enum>(B)</enum><header>Appeal</header><text>In the Senate, an affirmative vote of two-thirds of the Members, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on a point of order raised under section 3101(b)(1) of S. Con. Res. 11 (114th Congress), the concurrent resolution on the budget for fiscal year 2016, if the net increase in on-budget deficits in any 10-fiscal-year period exceeds $10,000,000,000.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
