which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for a Public Health Emergency Fund, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H02B25EF912EF42A58893A5A9CB14AB52"><section section-type="section-one" id="H96C515168E8D4957BFEBAC0CD946F5F1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Health Emergency Response and Accountability Act</short-title></quote>.</text></section><section id="id0A97A447988347019EE621E35AC79EE4"><enum>2.</enum><header>Public health emergencies</header><subsection id="id3D0657FFF7844652A06C879EB6C659CE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) is amended—</text><paragraph id="idDCF4A24009034206AB86D9EC34C1227E"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>after consultation</quote> and inserting <quote>in consultation with the Assistant Secretary for Preparedness and Response and</quote>;</text></paragraph><paragraph id="id7D769547DAA643A795B6C6704DA43A64"><enum>(2)</enum><text>by redesignating subsections (b) through (f) as subsections (c) through (g), respectively;</text></paragraph><paragraph id="id60141B5637594B39B5DACE4783DBFB0A"><enum>(3)</enum><text>by inserting after subsection (a), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF3DF01A9ABF54336882A97A5D57B0FCF"><subsection id="id0601E123F4984FF9BDE1C14916A20FF8"><enum>(b)</enum><header>Reporting requirements</header><paragraph id="id03BE059478FF4AC9BB936C9B9243D1ED"><enum>(1)</enum><header>In general</header><text>Upon the determination of a public health emergency under subsection (a) that is an infectious disease outbreak, a bioterrorist attack, or a disaster, the Secretary shall request the Assistant Secretary for Preparedness and Response to convene a group of Federal public health and other Federal officials that shall prepare monthly reports related to such emergency for the period described in paragraph (3) and submit such reports to Congress.</text></paragraph><paragraph id="id7E3B7F7419C84551835AF76A7E7B5930"><enum>(2)</enum><header>Contents</header><text>The reports prepared under paragraph (1) shall include—</text><subparagraph id="id88D1861CF01E4ADCA1AEE12A2024363C"><enum>(A)</enum><text>in the first monthly report, the proposed budget of the response to the emergency, and, in each subsequent report, updates to such budget;</text></subparagraph><subparagraph id="id373641E703C14158AA3095FF2375AFD5"><enum>(B)</enum><text>a description of how the Secretary plans to use best practices and lessons learned from previous public health emergency responses;</text></subparagraph><subparagraph id="idECCF9BD63B8046C98B5EAA83EB68234F"><enum>(C)</enum><text>a description of how collaboration among public health agencies and departments will be achieved, strategies for public communication, and acquisition and distribution of supplies;</text></subparagraph><subparagraph id="idC95B239A33114C5A8B4FD1CD346EB0D4"><enum>(D)</enum><text>an identification of additional authorities needed, if any, to respond to the emergency; and</text></subparagraph><subparagraph id="id9CB3B3857DC748F79D8B9A77D3F2C289"><enum>(E)</enum><text>in the first monthly report, the justification for triggering the public health emergency response.</text></subparagraph></paragraph><paragraph id="id09726DED85CA4F50A4B8EB35239C8C8D"><enum>(3)</enum><header>Period</header><text>The period described in this paragraph is the period beginning not later than 30 days after the determination of a public health emergency under subsection (a) that is an infectious disease outbreak, a bioterrorist attack, or a disaster, and ending 30 days after the determination of such emergency terminates in accordance with such subsection.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idD28F9904DACB4C578A750B458AE2ACE9"><enum>(4)</enum><text>in subsection (c) (as so redesignated)—</text><subparagraph id="id577FE3C4509D41FC81A595F1E6C6A7EF"><enum>(A)</enum><text>in paragraph (3), by striking <quote>Committee on Commerce</quote> and inserting <quote>Committee on Energy and Commerce</quote>; and</text></subparagraph><subparagraph id="id70604663658346159F6D1C34C498861E"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6D504C8614144D1E8568ABA2C82BEB10"><paragraph id="id64D6742CD6FD4989A0EED4297F7BEE8B"><enum>(6)</enum><header>Funding</header><subparagraph id="idC368F364DD0F4FA3A26A3AE4C55DA007"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="id5FDA2AE712AF45ADAC7F4DBB7B6BBC1F"><enum>(i)</enum><header>Public health emergency relief</header><text>The term <term>public health emergency relief</term> means the expenditures to address a public health emergency determined under subsection (a) that is an infectious disease outbreak, a bioterrorist attack, or a disaster from—</text><subclause id="id2BBF04EDC3094111AB8391DDE1085545"><enum>(I)</enum><text>amounts made available by emergency supplemental appropriations to appropriations accounts of the Department of Health and Human Services to address a public health emergency that is an infectious disease outbreak, a bioterrorist attack, or a disaster (excluding funds transferred to the Department from the appropriations account for the <quote>Federal Emergency Management Agency, Disaster Relief Fund</quote> or pursuant to the Oil Pollution Act of 1990); and</text></subclause><subclause id="idE7DC3F7E0B1C42E985CF64DA73EFE00C"><enum>(II)</enum><text>any amounts expended from the Public Health Emergency Fund under this subsection.</text></subclause></clause><clause id="id962D986D989A414EA2D733D6CEE8C723"><enum>(ii)</enum><header>Target amount</header><text>The term <term>target amount</term> means the amount that is the rolling annual average of expenditures for public health emergency relief over the full 14 fiscal years immediately preceding the fiscal year for which the determination of a public health emergency is made under subsection (a) that is an infectious disease outbreak, a bioterrorist attack, or a disaster, excluding the highest and lowest years.</text></clause></subparagraph><subparagraph id="idAB11AF9C02CF4D77A4FEDB0FBF429EFA"><enum>(B)</enum><header>Appropriations</header><clause id="id5faa3b34a0a64165832382fe374c139a"><enum>(i)</enum><header>In general</header><text>Subject to clause (iv), upon the determination of each public health emergency under subsection (a) that is an infectious disease outbreak, a bioterrorist attack, or a disaster, there is appropriated to the Public Health Emergency Fund, out of any money in the Treasury not otherwise appropriated, for the fiscal year of the determination, an amount determined under subparagraph (C), to remain available until expended, which may be used in accordance with subparagraph (D).</text></clause><clause id="idFEADD4480C0547108DBAE280F67C05E2"><enum>(ii)</enum><header>Reporting</header><text>The reporting requirements contained in subsection (b) shall apply with respect to amounts appropriated under clause (i).</text></clause><clause commented="no" display-inline="no-display-inline" id="id2FB97AB1EEB0494AA921194A71BB95CA"><enum>(iii)</enum><header display-inline="yes-display-inline">Emergency designations</header><subclause commented="no" display-inline="no-display-inline" id="id3994FA3630C74000BE8340E509069502"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Amounts appropriated under clause (i) are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idF1F1CCC116F546F9B1502F0FEF3AB1CA"><enum>(II)</enum><header>Designation in the Senate</header><text>In the Senate, amounts appropriated under clause (i) are designated as an emergency requirement pursuant to section 403(a) of S. Con. Res. 13 (111th Congress), the concurrent resolution on the budget for fiscal year 2010.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id90AFB339A4654FB8936328E37977CA1C"><enum>(iv)</enum><header>Limitation</header><text>Clause (i) shall not apply if the amount available for expenditure in the Public Health Emergency Fund, as of the date of the determination as a public health emergency under subsection (a) that is an infectious disease outbreak, a bioterrorist attack, or a disaster, is equal to or greater than the target amount.</text></clause></subparagraph><subparagraph id="id1009ecf87ee241279c1435b385f7816a"><enum>(C)</enum><header>Formula</header><clause id="id6AF5417F6BD34E6CA6F43A346D54B528"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the amount determined under this subparagraph shall be equal to the difference between the target amount and the amount available for expenditure in the Public Health Emergency Fund, as of the date of the determination of the public health emergency under subsection (a).</text></clause><clause id="id3A5FC450C1BB4D368BB52AFDE9AF0DC6"><enum>(ii)</enum><header>Report by OMB</header><text>Not later than 30 days after the date of enactment of this paragraph, the Director of the Office of Management and Budget shall submit to the Committee on Appropriations and the Committee on the Budget of the Senate and the Committee on Appropriations and the Committee on the Budget of the House of Representatives, a report on the rolling average calculated for purposes of determining the target amount.</text></clause></subparagraph><subparagraph id="idE4859B1E3B8D4B0CA8CE1A8D6A748762"><enum>(D)</enum><header>Use of funds</header><clause id="id5C8E365724C24A12B43F4D5A7EF57221"><enum>(i)</enum><header>In general</header><text>Amounts appropriated to the Public Health Emergency Fund under subparagraph (B) shall be used by the Secretary in accordance with the proposed budget described in subsection (b)(2) for any public health emergency determined under subsection (a) that is an infectious disease outbreak, a bioterrorist attack, or a disaster that has not terminated under such subsection. Such funds shall be used—</text><subclause id="idb44b5c9fd1754bb0995e092b2c0c3c95"><enum>(I)</enum><text>to provide assistance for immediate Federal, State, local, or international response needs with respect to any public health emergency determined under subsection (a) that is an infectious disease outbreak, a bioterrorist attack, or a disaster; and</text></subclause><subclause id="idf1cff6b987174f7481ab963fe2e90308"><enum>(II)</enum><text>for activities determined appropriate by the Secretary to improve preparedness and response to protect human health for all populations in any public health emergency determined under subsection (a) that is an infectious disease outbreak, a bioterrorist attack, or a disaster.</text></subclause></clause><clause id="idF1EF47F6CCD84FA3A5422D00261C78F7"><enum>(ii)</enum><header>Availability</header><text>Amounts appropriated to the Public Health Emergency Fund under subparagraph (B) shall remain available for the uses described in this subparagraph so long as any public health emergency is determined under subsection (a) that is an infectious disease outbreak, a bioterrorist attack, or a disaster, and the determination for any such emergency has not terminated under such subsection.</text></clause><clause id="id31DF34A7FB3D4E41AF6E651F46001A41"><enum>(iii)</enum><header>Authority</header><text>In expending funds appropriated under subparagraph (B) and carrying out activities under this subparagraph, the Secretary shall have the authority to—</text><subclause id="idAF57E0BDED244937808836590CBA674F"><enum>(I)</enum><text>transfer funds and enter into contracts;</text></subclause><subclause id="id43A8040CCA814A3C92D79AB7280135D5"><enum>(II)</enum><text>utilize flexible hiring mechanisms, including direct hiring authority and personal service contracts; exemptions from certain administrative restrictions (such as travel, information technology, printing and supplies); motor vehicle authority; and flexible compensation for responders, including overtime and danger pay; and</text></subclause><subclause id="id7BE321DB6CF64BDCA5E3E5F0AF1CB1C0"><enum>(III)</enum><text>utilize flexible transaction mechanisms.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HA9AFF82C5ED8474A869346B798B71F11"><enum>(b)</enum><header>Exemption of the Public Health Emergency Fund from sequestration</header><paragraph commented="no" id="HE147CFA1B47A415CA20A73E674A48F50"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 255(g)(1)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985 is amended by inserting <quote>Public Health Emergency Fund (009–91–9913).</quote> after the item relating to <quote>Postal Service Fund (18–4020–0–3–372).</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC14953F350A2467189DF77DA45C3F288"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to any sequestration order issued under such Act on or after the date of enactment of this section.</text></paragraph></subsection><subsection id="idCB112E26096E467DB4780701752E4345"><enum>(c)</enum><header>GAO reports</header><paragraph id="id51F8DD78C9964B7D8B4DEC5EE84F711F"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States, in consultation with relevant Federal, State, and local government entities, shall prepare and submit to the appropriate committees of Congress, a report—</text><subparagraph id="idFCBDC56FCD6547D69BB0F82DCC980741"><enum>(A)</enum><text>reviewing the capacity of the United States public health system, including the public health workforce, to respond effectively to infectious disease outbreaks;</text></subparagraph><subparagraph id="idCA08AA0D5FE44A45A20FD427ADE1B395"><enum>(B)</enum><text>identifying areas of potential improvement in coordination between Federal, State, and local government entities to respond more effectively to infectious disease outbreaks;</text></subparagraph><subparagraph id="idB5981F0DC02B4B7B807BAA6253CC6FC7"><enum>(C)</enum><text>making recommendations on how to provide or allocate most effectively resources for public health emergency response, specifically considering how to utilize most effectively the emergency fund established under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>); and</text></subparagraph><subparagraph id="id4DD9D787CE8844039B1DD7D38DAF26F6"><enum>(D)</enum><text>containing an audit of how funds for public health emergencies have been expended within the 2 years preceding the date of the report.</text></subparagraph></paragraph><paragraph id="id80E0B7BB13EE45878F48C90ABBDE1DAE"><enum>(2)</enum><header>Post-emergency report</header><subparagraph id="idCE7F10C33B0C4FC3B09CB5F0AA21F848"><enum>(A)</enum><header>In general</header><text>Not later than 6 months after the termination of a determination of a public health emergency under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) that is an infectious disease outbreak, a bioterrorist attack, or a disaster, the Comptroller General of the United States shall review response efforts by Federal, State, and local government entities, as well as any other relevant entities engaged in response efforts, and submit a report to the appropriate committees of Congress to determine—</text><clause id="id1FC994E5F22642CE96C0821F908BBE1A"><enum>(i)</enum><text>the compliance of such efforts with best practices identified in the report under paragraph (1);</text></clause><clause id="id357726B5B0744895A955421750DF60A2"><enum>(ii)</enum><text>the effectiveness of such best practices;</text></clause><clause id="id3810C9E51A41476C93686C4FDFD0B628"><enum>(iii)</enum><text>the cost of such efforts;</text></clause><clause id="id91C6313FDD7F43DAA0218564F8D932CB"><enum>(iv)</enum><text>the areas of potential continued improvement in coordination between Federal, State, and local government entities to respond more effectively to infectious disease outbreaks; and</text></clause><clause id="id57A9DA715EA9426F97CDFE761E897EA6"><enum>(v)</enum><text>how to incorporate additional best practices which may be incorporated in future response efforts.</text></clause></subparagraph><subparagraph id="id1B378D82B45440B78925C34A6219E4A5"><enum>(B)</enum><header>Audit</header><text>The report under subparagraph (A) shall include an audit indicating how funds used for public health emergencies determined under section 319 of the Public Health Service Act have been expended during the 2 years preceding the submission of the report under such subparagraph.</text></subparagraph></paragraph></subsection></section><section id="idA6D7428047BC41608A02D70A77F8A706"><enum>3.</enum><header>Applicability</header><text display-inline="no-display-inline">Nothing in this Act, or an amendment made by this Act, shall affect the applicability of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) or the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2701">33 U.S.C. 2701 et seq.</external-xref>) in the case of a public health emergency.</text></section></legis-body></bill>
