which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Commerce, acting through the Assistant Secretary for Economic Development, to establish a RECOMPETE grant program to provide flexible, 10-year block grants for purposes of creating quality jobs, providing resources to help local residents access opportunities and attain and retain employment, increasing local per capita income and employment rates, and supporting long-term, sustained economic growth and opportunity in persistently distressed areas, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rebuilding Economies and Creating Opportunities for More People to Excel Act</short-title></quote> or the <quote><short-title>RECOMPETE Act</short-title></quote>.</text></section><section id="id179d8291ce8148a295bdefa86d50d0fc"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idb031b5ff89e74201ad5a48ad5218327b"><enum>(1)</enum><header>Applicable area</header><text>The term <term>applicable area</term>—</text><subparagraph id="id8A4BCD654D314799A3373D4623B7BEC7"><enum>(A)</enum><text>with respect to a local labor market, local community, or partial local labor market—</text><clause id="id1ACC730F79844A21BD3DF86B1BBD86DE"><enum>(i)</enum><text>means—</text><subclause id="id01C4BA52BFA34D6692F8E75F19AC4CE6"><enum>(I)</enum><text>the geographical area of the local labor market, local community, or partial local labor market; and</text></subclause><subclause id="idB456AF8975844C7F9B9F03F7960ED196"><enum>(II)</enum><text>each corresponding unit of local government in the geographical area described in subclause (I); and</text></subclause></clause><clause id="id15E3299C364A448F9530D348C540BDEE"><enum>(ii)</enum><text>does not include any Tribal land in the geographical area described in clause (i)(I), unless the Tribal government with jurisdiction over the Tribal land elects to participate in an applicable cooperation agreement under section 3(b)(2)(B); and</text></clause></subparagraph><subparagraph id="id71C21EFA96CD42AC95D2CD600667F8F4"><enum>(B)</enum><text>with respect to a Tribal government, means the Tribal land subject to the jurisdiction of the Tribal government.</text></subparagraph></paragraph><paragraph id="id968230e99c22427b987be243f9cb674d"><enum>(2)</enum><header>Applicant</header><text>The term <term>applicant</term> means—</text><subparagraph id="idd759d17d80bc4a19a260da4ad330f844"><enum>(A)</enum><text>a unit of general local government, such as a county or a county equivalent (including a borough in the State of Alaska and a parish in the State of Louisiana), city, town, village, or other general-purpose political subdivision of a State;</text></subparagraph><subparagraph id="idF5F2F7C56E30449CA67790C0982728CC"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="id481B444100E74D22AC3E78D2D1B1DCC5"><enum>(C)</enum><text>a territory or possession of the United States;</text></subparagraph><subparagraph id="id5A7AEF9741C74ECFA70BB5008F3CDDDE"><enum>(D)</enum><text>a Tribal government;</text></subparagraph><subparagraph id="id4028BF5EBCE34962B032F7E2488DA351"><enum>(E)</enum><text>a State-authorized political subdivision or other entity, such as a special-purpose entity engaged in economic development activities;</text></subparagraph><subparagraph id="id95b76c239df840fdaf8bda96f1839784" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text>a public or private nonprofit organization, acting in cooperation with the officials of a political subdivision or entity described in subparagraph (E);</text></subparagraph><subparagraph id="id7cb3934b0da14118b4efa6b3805325c0"><enum>(G)</enum><text>an economic development district (as defined in section 3 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3122">42 U.S.C. 3122</external-xref>)); and</text></subparagraph><subparagraph id="id96f42673d45740779acbee30b95c6963" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text>a consortium of units of general local government within an applicable area.</text></subparagraph></paragraph><paragraph id="id2db78cbf214c4c6a99e979e832dc8933"><enum>(3)</enum><header>Cooperation agreement</header><text>The term <term>cooperation agreement</term> means an agreement entered into under section 3(b) relating to the implementation of a RECOMPETE plan for an applicable area.</text></paragraph><paragraph id="id85DD3B7CBE1E4B57A070E501077AE871"><enum>(4)</enum><header>Eligible</header><text>The term <term>eligible</term> means—</text><subparagraph id="id9318468BD1B84E3DA8A2D6123B5EE775"><enum>(A)</enum><text>with respect to a local labor market, local community, partial local labor market, or Tribal government, that the local labor market, local community, partial local labor market, or Tribal government meets the applicable distress eligibility criteria described in section 3(a); and</text></subparagraph><subparagraph id="id039BD97B10C6409DA667F40C8BEB0F52" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>with respect to an applicant or lead entity, that the applicant or lead entity has submitted an application for a RECOMPETE grant under section 4(a)(2) relating to a local labor market, local community, partial local labor market, or Tribal government described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="ide20024a644a44ea0aa8f5234e373c35d"><enum>(5)</enum><header>Lead entity</header><text>The term <term>lead entity</term> means an applicant designated to act as a lead entity pursuant to an applicable cooperation agreement.</text></paragraph><paragraph id="iddd51cd7b605649d69c1ef86be672ae08"><enum>(6)</enum><header>Local community</header><subparagraph id="idA70615A5F4A548148A46380AD9F771DA"><enum>(A)</enum><header>In general</header><text>The term <term>local community</term> means the area served by an applicant described in paragraph (2)(A) that—</text><clause id="id3B2970BDC13F4572A9CB4B2659F0585A"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id7B3E189DD1994487BFA0C61281269C9C"><enum>(I)</enum><text>is located within a local labor market or partial local labor market that is not eligible; or</text></subclause><subclause id="id0FA5413BC14F42EB83FF1376394CBC8C" indent="up1"><enum>(II)</enum><text>is not coexistent with a local labor market; and</text></subclause></clause><clause id="id0DA7C9447C554390ACC14A5473A24F30"><enum>(ii)</enum><text>meets such additional criteria, including a minimum population requirement, as the Secretary may establish.</text></clause></subparagraph><subparagraph id="id0A6D81D0F4D6413AB1BE7F965252D523"><enum>(B)</enum><header>Inclusions</header><text>The term <term>local community</term> includes a consortium of 2 or more applicants described in subparagraph (A)—</text><clause id="idF36A0B683DBA4072A0F9B42B303EB3E5"><enum>(i)</enum><text>all of which are located within the same local labor market; or</text></clause><clause id="id058515A23EDF4725BC83C486DE28B862"><enum>(ii)</enum><text>each of which is directly adjacent to an area described in subparagraph (A).</text></clause></subparagraph></paragraph><paragraph id="id0a64577914ba42c0a42b12134b1707ab"><enum>(7)</enum><header>Local labor market</header><text>The term <term>local labor market</term> means any of the following areas that contains 1 or more applicants described in subparagraphs (A) through (C) of paragraph (2):</text><subparagraph id="id74413F5CA41B48A191F7F1AA29A27A2E"><enum>(A)</enum><text>A commuting zone, as defined by the Economic Research Service of the Department of Agriculture.</text></subparagraph><subparagraph id="idbeca3174811b4d459b08022eb238c28c"><enum>(B)</enum><text>Subject to subparagraph (C), if 1 or more discrete metropolitan statistical areas or micropolitan statistical areas, as defined by the Office of Management and Budget (collectively referred to as <quote>core-based statistical areas</quote>), exist within a commuting zone described in subparagraph (A), each such core-based statistical area.</text></subparagraph><subparagraph id="idda0224db80bd40e3b03fe2a4f92b354d"><enum>(C)</enum><text>If the remaining area of a commuting zone described in subparagraph (A), excluding all core-based statistical areas within the commuting zone described in subparagraph (B), contains 1 or fewer counties and has a population of 7,500 or fewer residents, that remaining area combined with an adjacent core-based statistical area within the commuting zone.</text></subparagraph></paragraph><paragraph id="id5dc2da35383e47148598e579071cd7b9"><enum>(8)</enum><header>Partial local labor market</header><text>The term <term>partial local labor market</term> means a geographical area that— </text><subparagraph id="id4220924A2D8946198C91D4416247A519"><enum>(A)</enum><text>is located within, but is not coextensive with, a local labor market; and</text></subparagraph><subparagraph id="id62E5DADDAD274532981C0EED9BCFC76D"><enum>(B)</enum><text>contains 1 or more applicants described in subparagraphs (A) through (C) of paragraph (2).</text></subparagraph></paragraph><paragraph id="ida7d4c64730c04a278932b56ded88f8d0"><enum>(9)</enum><header>Prime-age</header><text>The term <term>prime-age</term> means individuals between the ages of 25 years and 54 years.</text></paragraph><paragraph id="id25075c9e0b0947e89bba168a8a98d8c4"><enum>(10)</enum><header>Prime-age employment gap</header><subparagraph id="id7AE080BBD89B4F60853EE790683F3F73"><enum>(A)</enum><header>In general</header><text>The term <term>prime-age employment gap</term>, with respect to an applicable area, means the difference (expressed as a percentage), calculated in accordance with subparagraph (B), between—</text><clause id="id52BC1F4D12C04466B6D3661EE123B17E"><enum>(i)</enum><text>the national 5-year average prime-age employment rate; and</text></clause><clause id="id90FA9BA2C9594ABA89A89642923DFC0A"><enum>(ii)</enum><text>the 5-year average prime-age employment rate of the applicable area.</text></clause></subparagraph><subparagraph id="idCE8F7FAD4270446E86DCEB7403C22D1D"><enum>(B)</enum><header>Calculation</header><text>For purposes of calculating the prime-age employment gap under subparagraph (A), an applicant shall use data relating to the most recent 5-year period for which data are available preceding the first date of the application period established for the applicant under section 4(a)(2)(B).</text></subparagraph></paragraph><paragraph id="idd8962fba1f1c43b1895a8a5581220a7b"><enum>(11)</enum><header>Prime-age employment rate</header><subparagraph id="idA17B91ADFF374690BE9682C7B4808777"><enum>(A)</enum><header>In general</header><text>The term <term>prime-age employment rate</term>, with respect to an applicable area, means the quotient (expressed as a percentage), calculated in accordance with subparagraph (B), obtained by dividing—</text><clause id="id5C4EEF37B00F4A63814F796063A51880"><enum>(i)</enum><text>the 5-year average quantity of the prime-age population of the applicable area that is employed; by</text></clause><clause id="idCC668317F32D445085C91B8ADC0CB046"><enum>(ii)</enum><text>the total prime-age population of the applicable area.</text></clause></subparagraph><subparagraph id="idC639347830444629B5B95A75DCC29EA3"><enum>(B)</enum><header>Calculation</header><text>For purposes of calculating the prime-age employment rate under subparagraph (A), an applicant shall use data relating to the most recent 5-year period for which data are available preceding the first date of the application period established for the applicant under section 4(a)(2)(B).</text></subparagraph></paragraph><paragraph id="ida5222a1d540d4df5a4e0c4df3bcf2dc6"><enum>(12)</enum><header>Recipient</header><text>The term <term>recipient</term> means, as applicable—</text><subparagraph id="id596EBD26819F411FA30BE0FF751D65F7"><enum>(A)</enum><text>an applicant to which a RECOMPETE grant is provided; or</text></subparagraph><subparagraph id="id615B44916FC541598742FB25AA66D75D" commented="no"><enum>(B)</enum><text>a lead entity designated pursuant to a cooperation agreement entered into under section 3(b) for an applicable area for which a RECOMPETE grant is provided.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF6215FA95702492C9F946B11FA08AB05"><enum>(13)</enum><header>RECOMPETE grant</header><text>The term <term>RECOMPETE grant</term> means a grant provided to a recipient under section 4(a).</text></paragraph><paragraph id="idec5ad05f84364c4696339f7525186e6e" commented="no" display-inline="no-display-inline"><enum>(14)</enum><header>RECOMPETE plan</header><text>The term <term>RECOMPETE plan</term> means a plan developed by an applicant under section 4(b).</text></paragraph><paragraph id="id806F90385B914E5E9576900CFF296965"><enum>(15)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce, acting through the Assistant Secretary for Economic Development.</text></paragraph><paragraph id="id86110e1e68ca4a29847dfc5e41d391a7"><enum>(16)</enum><header>Subrecipient</header><text>The term <term>subrecipient</term> means an applicant located within an applicable area that—</text><subparagraph id="idC7F5CE92889A4FCC9ADB69BBDB539CF5"><enum>(A)</enum><text>is not a recipient; but</text></subparagraph><subparagraph id="idEFE61A11BD9F4395AEDC42A617E1BECD"><enum>(B)</enum><text>receives funds provided under a RECOMPETE grant in such manner and in such amounts as may be agreed to in the RECOMPETE plan for the applicable area.</text></subparagraph></paragraph><paragraph id="id263f947ad7f2485a98d36814c3a3e14c"><enum>(17)</enum><header>Tribal government</header><text>The term <term>Tribal government</term> means the recognized governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published by the Bureau of Indian Affairs on January 29, 2021, pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="id8BE1D8D167E8483886A920A710FFD2B5"><enum>(18)</enum><header>Tribal land</header><text>The term <term>Tribal land</term> means—</text><subparagraph id="id67d506364ab64136841706f1f3593646"><enum>(A)</enum><text>any land located within the boundaries of an Indian reservation, pueblo, or rancheria; and</text></subparagraph><subparagraph id="id3e789c7dc64348c29efbc5922b421e8e"><enum>(B)</enum><text>any land not located within the boundaries of an Indian reservation, pueblo, or rancheria, the title to which is held—</text><clause id="ideae7098a5e2e48f08e0e34835525061b"><enum>(i)</enum><text>in trust by the United States for the benefit of an Indian Tribe or an individual Indian;</text></clause><clause id="idfd60f5a4a59347c692f3fdb771ecf885"><enum>(ii)</enum><text>by an Indian Tribe or an individual Indian, subject to restriction against alienation under Federal law; or</text></clause><clause id="idd3a17c7f252f48e2926131eeb2ad9a0e"><enum>(iii)</enum><text>by a dependent Indian community.</text></clause></subparagraph></paragraph></section><section id="id1220fb0d93a145178096be87ce91c927"><enum>3.</enum><header>Distress eligibility criteria and cooperation agreements</header><subsection id="ida930cfad5e2e48339ceb3ca3b60bfc21"><enum>(a)</enum><header>Distress eligibility</header><paragraph id="idDD0CA98587574300B3C91E4EC562464A"><enum>(1)</enum><header>Criteria</header><text>To be eligible for a RECOMPETE grant, a local labor market, local community, partial local labor market, or Tribal government shall meet the following criteria, as applicable, as determined by the Secretary:</text><subparagraph id="id1f4d8182ef6d4c8bb5c61092a0660f29"><enum>(A)</enum><header>Local labor markets</header><text>A local labor market shall have a prime-age employment gap equal to not less than 2.5 percent.</text></subparagraph><subparagraph id="id15fa42f274b4402292c4c63339344656"><enum>(B)</enum><header>Local communities</header><text>A local community shall—</text><clause id="id4783C9A1478E4E99B7A25ED504EC1130"><enum>(i)</enum><text>meet the applicable requirements described in section 2(6); and</text></clause><clause id="id99E54F2998444AA5B83286E61F52CDD3"><enum>(ii)</enum><text>have—</text><subclause id="id7f42d87d0c3e49359d8bd56e4920ae58"><enum>(I)</enum><text>a median household income equal to not more than $75,000; and</text></subclause><subclause id="id2271079143f3480f8407c6bf61c5eda5"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id6CDEC430CD2B485D9BA21620A9D88AA2"><enum>(aa)</enum><text>a prime-age employment gap of not less than 5 percent; or</text></item><item id="id9fbfa9b7da14434397422b07c7a6445b" indent="up1"><enum>(bb)</enum><text>as determined by the Secretary, a special need arising from—</text><subitem id="idB8E796C61BA24B64B95A254830432A5C"><enum>(AA)</enum><text>a recent decrease in the applicable prime-age employment rate; or</text></subitem><subitem id="idDB0F0A3E9F264725A131CF5DBC053A07"><enum>(BB)</enum><text>another severe economic disruption that is likely to reduce the applicable prime-age employment rate.</text></subitem></item></subclause></clause></subparagraph><subparagraph id="idA83AE87F93AC45B7973602A36A52F8D2"><enum>(C)</enum><header>Partial local labor markets</header><text>A partial local labor market shall—</text><clause id="id861576E518094CE689A30265083971CC"><enum>(i)</enum><text>have a prime-age employment gap equal to not less than 2.5 percent; and </text></clause><clause id="idFC5E033D9D284E8B82C910DE9EE59E4B" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>receive a waiver under subsection (b)(3)(A).</text></clause></subparagraph><subparagraph id="id190631A045924F1EB4D70BF5B2E6B392"><enum>(D)</enum><header>Tribal governments</header><clause id="id36AD15C71DE34209AE1F0062AD367EA7"><enum>(i)</enum><header>In general</header><text>A Tribal government shall have a prime-age employment gap of not less than 2.5 percent, as calculated under clause (ii). </text></clause><clause display-inline="no-display-inline" commented="no" id="id1EC50107A7954B19B875013D8054A057"><enum>(ii)</enum><header>Calculation</header><text>For purposes of clause (i), the prime-age employment gap of a Tribal government shall be calculated, with respect to the most recent 5-year period for which data are available, for all individuals residing on the Tribal land of the Tribal government.</text></clause></subparagraph></paragraph><paragraph id="idBA4B7780DB2A40B18F34B68788F9FE29"><enum>(2)</enum><header>Limitations</header><subparagraph id="id1AFB4E418EF24AFCAC910C6915AFD664"><enum>(A)</enum><header>Applicable areas</header><text>A local labor market, local community, partial local labor market, or Tribal government shall not be eligible to receive more than 1 RECOMPETE grant.</text></subparagraph><subparagraph id="id6F6E247CFE1E40B8BDAE65B986811115"><enum>(B)</enum><header>Applicants</header><text>For purposes of the RECOMPETE grant program, an applicant may not be considered to be located in, or submit an application under section 4(a)(2) on behalf of, more than 1 eligible local labor market, local community, partial local labor market, or Tribal government.</text></subparagraph></paragraph></subsection><subsection id="id2f5937986ed04031af58a6ca5938f746"><enum>(b)</enum><header>Cooperation agreements</header><paragraph id="id56213FC55E68489F846C851AA7454947"><enum>(1)</enum><header>Requirement</header><subparagraph id="id387AC9A20C7A4E69814BB8A4728EE16C"><enum>(A)</enum><header>In general</header><text>Subject to paragraph (3), if an applicable area contains 2 or more applicants described in subparagraph (A), (B), or (C) of section 2(2), each such applicant shall, as a condition of receiving a RECOMPETE grant for the applicable area—</text><clause id="id8AAA4A736DF94E3B9696AD35DDCCBD6F"><enum>(i)</enum><text>enter into a legally binding cooperation agreement for the applicable area in accordance with subparagraph (C); and</text></clause><clause id="id35701D0CADCF4CBBBEC4A05F19A61CBF"><enum>(ii)</enum><text>designate 1 applicant as the lead entity to act in a representative capacity for purposes of assuming overall responsibility for carrying out the programs and activities, and achieving compliance with the applicable requirements, under the RECOMPETE grant.</text></clause></subparagraph><subparagraph id="idD97B44165C5043BD94B9E1890ECB78AC"><enum>(B)</enum><header>Participation by other applicants</header><text>An applicant described in subparagraph (E), (F), or (G) of section 2(2) that is located in an applicable area for which a cooperation agreement is entered into under subparagraph (A) may elect to join the cooperation agreement, at the discretion of the applicant.</text></subparagraph><subparagraph id="id937FBC72F4824971BAEE2C8BF03908C6"><enum>(C)</enum><header>Terms</header><text>A cooperation agreement under this subsection shall include—</text><clause id="id96247F451B114306841AB47EE94DED47"><enum>(i)</enum><text>a written statement that—</text><subclause id="id9C2659917EA941958D90A56BC2CD9529"><enum>(I)</enum><text>is executed by each applicant that is a party to the cooperation agreement; and</text></subclause><subclause id="id00FFA9F7A2BC4E5C8B2E10336731A4ED"><enum>(II)</enum><text>establishes the consent of the applicant to be bound by the terms of—</text><item id="id3F278FE25BD54FBD914D9BE42C54AD47"><enum>(aa)</enum><text>the cooperation agreement; and</text></item><item id="idA050A80620AB4D93955D0FA05BDAD42B"><enum>(bb)</enum><text>the RECOMPETE plan for the applicable area; and</text></item></subclause></clause><clause id="id1660FCDCCDE6416CB17BEEF55FCDE118"><enum>(ii)</enum><text>a process for redress of any action, or failure to act, by the lead entity that is detrimental to an applicant.</text></clause></subparagraph><subparagraph id="idC9BDC41A333141D6950D998707BB8B40"><enum>(D)</enum><header>Limitation</header><text>An applicable area may be the subject of only 1 cooperation agreement.</text></subparagraph></paragraph><paragraph commented="no" id="idE5BB7C5D1E8A4294A3A069A9FBE51586"><enum>(2)</enum><header>Election by local communities and Tribal governments</header><subparagraph commented="no" id="id17CD98BA86B84319BE86FFF128F0F12A"><enum>(A)</enum><header>Local communities</header><clause commented="no" id="idE1393132930545928572385AA831871E"><enum>(i)</enum><header>In general</header><text>A local community may enter into a cooperation agreement described in paragraph (1) with any other local communities located within the same local labor market, subject to the condition that 1 or more of those local communities shall be an eligible local community.</text></clause><clause id="id39a4efca55414458abe0e832ca477f9e"><enum>(ii)</enum><header>Parties</header><text>A cooperation agreement under clause (i) may be executed between or among—</text><subclause id="id11DB36FBB2EE4453B9DD4B32068EF1D0"><enum>(I)</enum><text>an eligible local community; and</text></subclause><subclause id="id97fb4c6886e8461baee0d18c82787c51"><enum>(II)</enum><text>1 or more—</text><item id="id522F968C347F46969644FA4E266E4BDE"><enum>(aa)</enum><text>other eligible local communities, or applicants within an eligible local community, located within the same local labor market; or</text></item><item id="id462f2243ddd142259ccbf0981eac4081"><enum>(bb)</enum><text>applicants that are not located within an eligible local community, but are located within the same local labor market as an eligible local community.</text></item></subclause></clause><clause id="idAB1C54AEAF4A49BF80D2CA1CDCDA196B" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><header>Additional amounts</header><text>On execution of a cooperation agreement under this subparagraph involving 1 or more applicants described in clause (ii)(II)(bb), the Secretary may award additional amounts in accordance with subsection (c)(6) of section 6, subject to the applicable cost-sharing requirements of subsection (e)(2) of that section.</text></clause></subparagraph><subparagraph id="id355F32B5CA2E4D66BE30032304866511"><enum>(B)</enum><header>Tribal governments</header><clause id="idAF828B31A7EB43B69729C0E47170C2C1"><enum>(i)</enum><header>In general</header><text>Regardless of whether the Tribal government is eligible, subject to clause (ii), a Tribal government may elect to enter into a cooperation agreement described in paragraph (1) with 1 or more applicants from an eligible local labor market, local community, or partial local labor market that is adjacent to the Tribal land of the Tribal government.</text></clause><clause id="idF8A697873FF6416D9DAE135CADDD21A8" commented="no"><enum>(ii)</enum><header>Deadline</header><text>An election by a Tribal government under clause (i) shall be made by not later than 45 days after the first date of the application period established for the Tribal government under section 4(a)(2)(B).</text></clause><clause id="id845CFC10FD9746818828BA1118A5AE96" commented="no"><enum>(iii)</enum><header>Treatment</header><text>If a Tribal government elects to enter into a cooperation agreement under clause (i)—</text><subclause commented="no" id="idADA88D6573A44EE1851F4E3A8472A573"><enum>(I)</enum><text>the Tribal land of the Tribal government shall be—</text><item id="idDF7BBF208F514F5692BEC9AB52B43328" commented="no"><enum>(aa)</enum><text>considered to be included in the applicable area of the eligible local labor market, local community, or partial local labor market that is the subject of the cooperation agreement; and</text></item><item id="idEBE6A08AEFFA451FAED182129761403A" commented="no"><enum>(bb)</enum><text>subject to the RECOMPETE plan for the applicable area described in item (aa); and</text></item></subclause><subclause commented="no" id="idA2A0AC1A3F2C450FB5FD6083CF0A6822"><enum>(II)</enum><text>the amount of the RECOMPETE grant to which the Tribal government is otherwise eligible to receive, if applicable—</text><item commented="no" id="idDAD9A8C723C94065AC1AFF43E6D42700"><enum>(aa)</enum><text>shall not be decreased; and</text></item><item commented="no" id="idD2E4C55222D946B684090E4983540147"><enum>(bb)</enum><text>shall be added to the amount provided to the applicable lead entity for use in accordance with the RECOMPETE plan.</text></item></subclause></clause><clause id="idAD176BC0E20B4BAF8D32739987A60817"><enum>(iv)</enum><header>Encouragement to collaborate</header><text>To the maximum extent practicable, the Secretary shall encourage Tribal governments to enter into cooperation agreements described in clause (i).</text></clause><clause id="id3C9ED4EF723C46E4B0F0BCBB678FE9E6"><enum>(v)</enum><header>Effect of subparagraph</header><text>Nothing in this subparagraph—</text><subclause id="idEFC2D8EE6E394D69A87158FD2AA49DBC" commented="no"><enum>(I)</enum><text>requires a Tribal government to enter into a cooperation agreement in order to receive a RECOMPETE grant;</text></subclause><subclause id="ida49a96906b5b43fe950cebf435793aa3"><enum>(II)</enum><text>penalizes a Tribal government that does not elect to participate in a cooperation agreement; or</text></subclause><subclause id="idF80D61CC0AEE4BEDA823D39971BA9BA0" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>otherwise affects the amount of a RECOMPETE grant to be provided to any Tribal government.</text></subclause></clause></subparagraph></paragraph><paragraph id="ide45fb8c1637947fb8a0809accabeef1d"><enum>(3)</enum><header>Waivers</header><subparagraph id="id9DD7FD905340417AB7FE0AE68632017C"><enum>(A)</enum><header>In general</header><text>The Secretary may waive the requirement under paragraph (1) with respect to an applicant acting on behalf of a partial local labor market that— </text><clause id="id332EE09B78CB41DB92D965EC42D10AC5"><enum>(i)</enum><text>meets the criterion described in subsection (a)(1)(C)(i);</text></clause><clause id="id7D0871D8022A45FD9D9646364A031A5F"><enum>(ii)</enum><text>is located within an eligible local labor market with respect to which a cooperation agreement is unable to be executed under paragraph (1), despite reasonable efforts; and</text></clause><clause id="id264aaa7790264c069a797a1e56f6d7f5"><enum>(iii)</enum><text>submits to the Secretary a request for a waiver under this paragraph demonstrating the ability to carry out the programs and activities, and achieve compliance with the applicable requirements, under sections 4 and 5 in the applicable area.</text></clause></subparagraph><subparagraph id="idDC35FA8220564C7CACDC284532A4F6AE"><enum>(B)</enum><header>Effect</header><text>On receipt of a waiver under subparagraph (A), a partial local labor market—</text><clause id="idE6566D7A7FCA473980F8CE27E9895A58"><enum>(i)</enum><text>shall be eligible to receive a RECOMPETE grant; and</text></clause><clause id="id70967481C7B04BDB984D1A3BD36D1DEE" commented="no"><enum>(ii)</enum><text>may elect to carry out the programs and activities, and achieve compliance with the applicable requirements, in the applicable area under the RECOMPETE grant—</text><subclause id="id5FD2E61CD44F40B7A9206E20B17203AD" commented="no"><enum>(I)</enum><text>independently; or</text></subclause><subclause id="id51960B0DE4454568894E9E15E84DA9C0" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>by designating from among applicants located within the applicable area a lead entity pursuant to a cooperation agreement described in paragraph (1), which shall submit to the Secretary a written notice in accordance with paragraph (4).</text></subclause></clause></subparagraph></paragraph><paragraph id="id8F12A764213446FBBA378F21C388785B"><enum>(4)</enum><header>Submission to Secretary</header><text>On execution of a cooperation agreement under paragraph (1), (2), or (3)(B)(ii)(II), the lead entity shall submit to the Secretary a written notice that—</text><subparagraph id="idD5B1E334A4B247649FFC55C2BA7F5C9D"><enum>(A)</enum><text>describes—</text><clause id="id77EE358B7BFD4C22842F9F85359C8C3D"><enum>(i)</enum><text>the cooperation agreement;</text></clause><clause id="id2A135CCBA9A14C2FA86C9C75E6198B33"><enum>(ii)</enum><text>the date of execution of the cooperation agreement;</text></clause><clause id="idA185824936754C09BE03299D88AA4AB8"><enum>(iii)</enum><text>the authorization of the lead entity under the cooperation agreement; and</text></clause><clause id="id876B3A435C9E487E94359D668407DF7F" commented="no"><enum>(iv)</enum><text>the formation of a consortium described in section 2(2)(H) under the cooperation agreement, if applicable; and</text></clause></subparagraph><subparagraph commented="no" id="id5EA1CDB5E60E428D9D3A78FA94CEB667"><enum>(B)</enum><text>includes—</text><clause commented="no" id="id83F96D5FB03C4CCAAB5AC4467D9FD249"><enum>(i)</enum><text>a copy of each written statement under paragraph (1)(C)(i) relating to the cooperation agreement; and</text></clause><clause commented="no" id="id95994F2F5ED14B0FB5704C001A15A249"><enum>(ii)</enum><text>any necessary certifications or other documentation relating to the cooperation agreement.</text></clause></subparagraph></paragraph></subsection></section><section id="id35ca4cddf78446018824ed0f00aa4da0"><enum>4.</enum><header>RECOMPETE grant program</header><subsection id="id57245ae9583a4b998b3093b5bbe8075b"><enum>(a)</enum><header>Establishment</header><paragraph id="id9F32643789E94FF193CC3E2A0D2225B2"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a formula grant program under which the Secretary shall provide to eligible applicants and lead entities block grants, to be known as <quote>RECOMPETE grants</quote>, to carry out programs and activities in the applicable areas served by the applicants and lead entities that—</text><subparagraph id="idB68F68B8C26F4A10B0660EAA9315E71E"><enum>(A)</enum><text>create quality jobs;</text></subparagraph><subparagraph id="idE8F89FE19A2B44D68201665BD59665BD"><enum>(B)</enum><text>provide resources to help local residents—</text><clause id="idA3D37162ED6B432990C5F56B4D5FBAAE"><enum>(i)</enum><text>access opportunities; and</text></clause><clause id="idF14C727AA3014D6EA21F7889BE6027B6"><enum>(ii)</enum><text>attain and retain employment;</text></clause></subparagraph><subparagraph id="id664BF215A22F446E888FF7DEBC7CB095"><enum>(C)</enum><text>increase local per capita income and prime-age employment rates; and</text></subparagraph><subparagraph id="idDB541D7D0FC54264806BA52D80D4E869"><enum>(D)</enum><text>support long-term, sustained economic growth and opportunity in persistently distressed areas.</text></subparagraph></paragraph><paragraph id="idA37CD6FC1B3F44DAB5CE8D0D4CF8A493"><enum>(2)</enum><header>Applications</header><subparagraph id="id5C44650E07D74FFEB159B3246C57E395"><enum>(A)</enum><header>In general</header><text>To be considered for the provision of a RECOMPETE grant, an eligible applicant or lead entity shall submit to the Secretary an application—</text><clause id="id7C5AACD6CB36405EBA3FAC0253143A6E"><enum>(i)</enum><text>at such time, in such manner, and containing such information as the Secretary determines to be appropriate; and</text></clause><clause id="id09004E3356ED4FB0A925013CEB9735A1"><enum>(ii)</enum><text>that includes a RECOMPETE plan for the applicable area served by the applicant or lead entity, in accordance with subsection (b).</text></clause></subparagraph><subparagraph id="id9F57BD826B7B42A581FE82D7689A765D"><enum>(B)</enum><header>Application windows</header><text>In carrying out the RECOMPETE grant program, the Secretary shall establish the periods during which applications may be submitted under subparagraph (A), subject to the conditions that—</text><clause id="id37BEABFE762A47DA8559BB15472426E4"><enum>(i)</enum><text>the initial application period established under this subparagraph shall be not less than 3 years; and</text></clause><clause id="id2F83C42B99154C6CB8DAC89E4194C6EB"><enum>(ii)</enum><text>for the second application period under this subparagraph and each period thereafter, the Secretary may, as the Secretary determines to be appropriate—</text><subclause id="id3812B42355D3422090452291B83F7D5F"><enum>(I)</enum><text>extend the period;</text></subclause><subclause id="id26A9B98C9CE04E4D93C2EDA87EA2AEDA"><enum>(II)</enum><text>accept late applications;</text></subclause><subclause id="id964164CB94F64561973089FD186A2C19"><enum>(III)</enum><text>initiate a new application cycle; and</text></subclause><subclause id="id5819EED97D63419FA80AD112E98EC1FC"><enum>(IV)</enum><text>establish additional rules and regulations under this subsection.</text></subclause></clause></subparagraph><subparagraph id="id7a5f1b5b2ff147fcb26cb2f6d0db307c"><enum>(C)</enum><header>Limitations</header><clause id="idCC710E1E67F2454D9F65628433EBA916"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the Secretary may establish a limitation on—</text><subclause id="id75BD0F75B96646429C52231F1D4ADDAC"><enum>(I)</enum><text>the number of applications to be accepted by the Secretary during each fiscal year from each type of applicant; and</text></subclause><subclause id="id388BB9D2954F4A8FBDBE87CE29FB20AC"><enum>(II)</enum><text>the total amount of each RECOMPETE grant payment provided for each fiscal year.</text></subclause></clause><clause id="id8BF97EC2198F41AF8A438BC8A4AF00BB"><enum>(ii)</enum><header>Requirements</header><text>In establishing any limitation under clause (i), the Secretary shall ensure that—</text><subclause id="id898665F4FA7443C685FE8070E334885A"><enum>(I)</enum><text>each applicant and lead entity that submits to the Secretary an application satisfactory to the Secretary for an application period established under subparagraph (B) shall be considered for receipt of a RECOMPETE grant during that application period; and</text></subclause><subclause id="id7ABD4EC31A124468A6BE65480D9C54CC"><enum>(II)</enum><text>the Secretary is able—</text><item id="idd92ef87ff2dc47049bb41f436c8d323e"><enum>(aa)</enum><text>to review applications and provide technical assistance and expertise to applicants in the development and implementation of RECOMPETE plans; and</text></item><item id="ida3dee69321ff42d7b92c5dfdd4c2bb17"><enum>(bb)</enum><text>to conduct benchmark evaluations and meet applicable reporting requirements in accordance with section 5.</text></item></subclause></clause></subparagraph><subparagraph id="id9493a067157d45ef8e8df136059b63c5"><enum>(D)</enum><header>Priority</header><text>In selecting recipients of RECOMPETE grants, the Secretary shall give priority consideration to severely distressed, eligible—</text><clause id="id0FE06DE5CCDE4289B6D1936C84CDBFD1"><enum>(i)</enum><text>local labor markets; and</text></clause><clause id="idFDB73BF827E1465394E821437B0A2B38"><enum>(ii)</enum><text>Tribal governments.</text></clause></subparagraph><subparagraph id="idECFCB48EF04F4D95ADF88ED2E24FFEB0"><enum>(E)</enum><header>Approval</header><text>The Secretary shall approve or disapprove each application submitted under this paragraph (including the RECOMPETE plan included in the application) as soon as practicable after the date of receipt of the application.</text></subparagraph></paragraph><paragraph id="id0E9520DF6ABB438193C4FE864A061A37"><enum>(3)</enum><header>Term</header><text>A RECOMPETE grant shall—</text><subparagraph id="id6D2402E2C703423796ABD7C445ABE326"><enum>(A)</enum><text>have a term of 10 fiscal years; and</text></subparagraph><subparagraph id="id79CBA772376B47F1A434667D6BB7F174"><enum>(B)</enum><text>be disbursed over that term in accordance with section 6(d).</text></subparagraph></paragraph></subsection><subsection id="id2d125b0118d14564b0f2c217cc57803c"><enum>(b)</enum><header>RECOMPETE plans</header><paragraph id="id5BDC674AD7B94874A8B8497AF984C5B3"><enum>(1)</enum><header>In general</header><text>As a condition of receipt of a RECOMPETE grant, the application of an applicant or lead entity under subsection (a)(2) shall include a RECOMPETE plan for the applicable area served by the applicant or lead entity in accordance with this subsection.</text></paragraph><paragraph id="id049AAF5BE72F492CBE6565FBE603CA64"><enum>(2)</enum><header>Requirements</header><text>A RECOMPETE plan shall include the following information with respect to the applicable area:</text><subparagraph id="id3e3bd47c3fa1467797ef5a247447a0b6"><enum>(A)</enum><text>An identification of—</text><clause id="idA9A6E2AB82794575942FD4DB373DE07F"><enum>(i)</enum><text>each economic development challenge proposed to be addressed using a RECOMPETE grant; and</text></clause><clause id="id08fe4af7b68f49f28e90d0620134380a"><enum>(ii)</enum><text>any past, present, or projected future economic development investments in the applicable area, including, with respect to the investment—</text><subclause id="id8A7A899F10104631BE15D97E8FDFFACB"><enum>(I)</enum><text>each public and private participant; and</text></subclause><subclause id="id1B14C39E2C6F4F238027DEC05D783B32"><enum>(II)</enum><text>each source of funding.</text></subclause></clause></subparagraph><subparagraph id="id02e633291c174488afa87090c3ec89e3"><enum>(B)</enum><text>A comprehensive strategy, for the 10-year period beginning on the proposed date of receipt of a RECOMPETE grant, to address the economic challenges identified under subparagraph (A)(i), in accordance with subsection (d), in a manner that—</text><clause id="id3fe05c7a503743dc9e74122e6100df62"><enum>(i)</enum><text>promotes long-term, sustained economic growth, opportunity, job creation, employment, and increased per capita income;</text></clause><clause id="idDA02F01A291B4B6CA98D2A25B3C3B46B"><enum>(ii)</enum><text>reduces the prime-age employment gap of the applicable area;</text></clause><clause id="id1c949427562a403b87ff906d7554d545"><enum>(iii)</enum><text>creates jobs and connects local workers to employment and other economic opportunities;</text></clause><clause id="ida112891b25914393a67b65f424fcffb2"><enum>(iv)</enum><text>maximizes the effective development and use of the local workforce; and</text></clause><clause id="id1DA69F3856FB4549A94BD79852A769D7" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text>provides accessible resources to support job attainment and retention. </text></clause></subparagraph><subparagraph id="id7cf175bdab5d4351bb6dc9415ebcb59d"><enum>(C)</enum><text>The total projected cost to carry out the RECOMPETE plan.</text></subparagraph><subparagraph id="id7B109C42C4C44B58907D68A5602BA1C5"><enum>(D)</enum><text>The total amount of the RECOMPETE grant requested, and the justification for that amount.</text></subparagraph><subparagraph id="id9fbe78febe934de2a1604fd329b6f1eb"><enum>(E)</enum><text>The roles and responsibilities of each recipient and subrecipient carrying out an activity under the RECOMPETE plan.</text></subparagraph><subparagraph id="id8f8e231ca127452895654e37b3a4757f" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text>The proposed allocation by the recipient to subrecipients of any RECOMPETE grant amounts. </text></subparagraph><subparagraph id="ide6fd55d2ded14cf4b31a2aa33ce15ad8"><enum>(G)</enum><text>An identification of certain benchmark criteria for use in benchmark evaluations under section 5(a), including reducing the prime-age employment gap of the applicable area by certain percentages at periodic intervals, with the goals of—</text><clause id="id015E1BD6AAF24F84B1E139F1104B73D8"><enum>(i)</enum><text>reducing the prime-age employment gap by not less than 50 percent on completion of the term of the RECOMPETE grant provided to the recipient; and</text></clause><clause id="id4134265990894F3695D890891AB97A1A"><enum>(ii)</enum><text>achieving compliance with such other criteria as the Secretary may establish.</text></clause></subparagraph></paragraph><paragraph id="idfa49ef59d6ae4a699aa2c8465110e8c7"><enum>(3)</enum><header>Optional inclusions</header><text>A RECOMPETE plan may include strategies—</text><subparagraph id="idd0e98d19b52c44149167890dd2bb0f34"><enum>(A)</enum><text>to address inequality in the applicable area, such as inequality with respect to income, opportunity, or employment on the basis of race, gender, religion, or sexual orientation;</text></subparagraph><subparagraph id="ida4b5709c9a2d478fa668b7a8379d0151"><enum>(B)</enum><text>to support business development and entrepreneurship; and</text></subparagraph><subparagraph id="id2b74c454482044629144f1462178b729"><enum>(C)</enum><text>to support innovation and businesses, job creation, and workforce development in industries expected to continue or increase in force in the applicable area.</text></subparagraph></paragraph><paragraph id="id6ead54fdd00f4d2c869975a4da188c48"><enum>(4)</enum><header>Consent of parties to cooperation agreement</header><text>If an applicable area is subject to a cooperation agreement under section 3(b), the RECOMPETE plan for the applicable area shall be—</text><subparagraph id="id678677BC4DB3405AA139F28D1F7120EA"><enum>(A)</enum><text>developed in accordance with that cooperation agreement; and</text></subparagraph><subparagraph id="idE1A503E7E48E4AD3BD8DB0EB24DEB2BF"><enum>(B)</enum><text>consented to by each applicant that is a party to the cooperation agreement.</text></subparagraph></paragraph><paragraph id="id7EBD7FDD177C40B29B215AAF78BA68D0"><enum>(5)</enum><header>Integration with comprehensive economic development strategy</header><text>If an applicable area is subject to a comprehensive economic development strategy approved by the Secretary under section 302 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3162">42 U.S.C. 3162</external-xref>), the RECOMPETE plan for the applicable area—</text><subparagraph id="id93C8B9607E67485384C05C6EC3E7218F"><enum>(A)</enum><text>shall be integrated with that strategy, to the maximum extent practicable; and</text></subparagraph><subparagraph id="idF93CA767BC6744D8B2474CADB2F3B651"><enum>(B)</enum><text>may be developed and included as a supplemental portion of that strategy, rather than as an independent plan.</text></subparagraph></paragraph><paragraph id="idB226D34A0578454085EC947B5DE97CFC"><enum>(6)</enum><header>Approval by Secretary</header><text>The Secretary shall approve a RECOMPETE plan that the Secretary determines meets the applicable requirements of this subsection.</text></paragraph></subsection><subsection id="idd33ecd235f2e45bf8d0e4dc8832d6283"><enum>(c)</enum><header>Planning and technical assistance</header><paragraph id="id0764C2CF74EA45AF8FA0DA0E0E232D5F"><enum>(1)</enum><header>Planning assistance</header><subparagraph id="id57851B6D999944B9AC9079DCBD6AD10D"><enum>(A)</enum><header>In general</header><text>For purposes of assisting a recipient in developing a RECOMPETE plan, the Secretary may make an advance payment of a RECOMPETE grant in accordance with subparagraph (B), if the Secretary determines that—</text><clause id="id61D93E00ABE94472A9361E7113D1B1C7"><enum>(i)</enum><text>the recipient requires such an advance; and</text></clause><clause id="id31BEA4A07FFE4E9795D399077531B080"><enum>(ii)</enum><text>the advance will be used—</text><subclause id="idE384D2F72C3147E3B61FB3EAA877A785"><enum>(I)</enum><text>effectively; and</text></subclause><subclause id="id438BFE584ACE40B5A6023F627411CCC1"><enum>(II)</enum><text>for planning purposes.</text></subclause></clause></subparagraph><subparagraph id="id61EABD6559EB48589020F6F6D3DBA1D7"><enum>(B)</enum><header>Maximum amount</header><text>The amount of an advance payment under subparagraph (A) shall be equal to not more than the lesser of—</text><clause id="id4C9C26F0D38C485CB0EDE2AA44C63F58"><enum>(i)</enum><text>an amount equal to 5 percent of the maximum RECOMPETE grant amount to be provided to the applicable recipient; and</text></clause><clause id="idB02C3B95ED1945FF9EC348A279534408"><enum>(ii)</enum><text>$300,000.</text></clause></subparagraph><subparagraph id="idc7353e63116c4d42ac09a11e12b39f19"><enum>(C)</enum><header>No cost share</header><text>An advance payment made under this paragraph shall not be subject to any cost-sharing requirement.</text></subparagraph></paragraph><paragraph id="id7c41ecb191b546ed9bc1ed17fd35ac78"><enum>(2)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance, if necessary, in each applicable area relating to—</text><subparagraph id="idef53e60460cf49199894d575da4ccbb3"><enum>(A)</enum><text>the development of a RECOMPETE plan that meets the applicable requirements of this subsection with respect to the applicable area; and</text></subparagraph><subparagraph id="id8fc324179c234813b4b04d606e39af3a" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>implementation of the programs and activities included in the RECOMPETE plan for the applicable area.</text></subparagraph></paragraph></subsection><subsection id="idb1999c2ad7384bc4aca22ff6b1255779"><enum>(d)</enum><header>Use of funds</header><paragraph id="id0B53AB5413B04C19B04BC3C76CA08070"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), a recipient or subrecipient may use a RECOMPETE grant to carry out programs and activities in the applicable area, in accordance with the RECOMPETE plan, including—</text><subparagraph id="idddf63646c93a4dadbb4dae99ef92701d"><enum>(A)</enum><text>the provision of business advice and assistance to small and medium-sized local businesses and entrepreneurs, including—</text><clause id="idF7A20144581C4DA595569FB936130832"><enum>(i)</enum><text>manufacturing extension services;</text></clause><clause id="idE7F0EDF86DAC4F36ABBC2BBA3E17C9DA"><enum>(ii)</enum><text>small business development centers;</text></clause><clause id="idF42EFB00EFD64C83B16A7D67D4C9A53F"><enum>(iii)</enum><text>centers to help businesses bid for Federal procurement contracts;</text></clause><clause id="idCBAF898394924B6EB65A8F5C07686168"><enum>(iv)</enum><text>entrepreneurial assistance programs that link entrepreneurs with available public and private resources;</text></clause><clause id="id0a4a51a572f847509fea878ce4642318"><enum>(v)</enum><text>legal advice and resources; and</text></clause><clause id="idce048e9689c34c4ba635fe0385e88af2"><enum>(vi)</enum><text>assistance in accessing capital;</text></clause></subparagraph><subparagraph id="idbcfa2d459576480d995ecb0c3d76152b"><enum>(B)</enum><text>land and site development programs, such as brownfield redevelopment, research and technology parks, business incubators, business corridor development, and Main Street redevelopment programs;</text></subparagraph><subparagraph id="ida79f50896b2a43f0a1db7586e9d48abf"><enum>(C)</enum><text>infrastructure and housing activities that are directly related to supporting job creation and employment for residents, such as— </text><clause id="idACF21C7508584915954AD274736FE69F"><enum>(i)</enum><text>improvements to transit, roads, and broadband access;</text></clause><clause id="id40D336E5A7144ECB890BA8DD22914FA7"><enum>(ii)</enum><text>affordable housing development;</text></clause><clause id="id8fba4bb390894fdca35dd37ef95eff06"><enum>(iii)</enum><text>land-use and zoning reforms; and</text></clause><clause id="idC01E1B60A8B54EB5B9C2D029FB0F8816"><enum>(iv)</enum><text>transit-oriented development activities;</text></clause></subparagraph><subparagraph id="id72d0b756354c4cccad2eae50c025f310"><enum>(D)</enum><text>job training oriented to local employer needs, such as customized job training programs carried out by local community colleges in partnership with local businesses;</text></subparagraph><subparagraph id="id927772dcb2474bcfb9d2e990f631e6f6"><enum>(E)</enum><text>workforce outreach programs, such as—</text><clause id="id6F2E78F47A3E45A9B6337A187A6168B6"><enum>(i)</enum><text>programs located in, and targeted to, lower-income and underemployed neighborhoods; and</text></clause><clause id="id523F3609DC5947279C7BB6D9C407E6B3"><enum>(ii)</enum><text>embedding job placement and training services in neighborhood institutions such as churches, housing projects, and community advocacy programs;</text></clause></subparagraph><subparagraph id="id8d445f4d70614a66b9d757bcec894727"><enum>(F)</enum><text>job retention programs and activities, such as the provision of—</text><clause id="id51DAB604C69649689158761850C0E287"><enum>(i)</enum><text>job coaches, including at locations of employment;</text></clause><clause id="id4E31176F5575411FB3805CCEB274D779"><enum>(ii)</enum><text>child care services, including subsidizing the construction, operation, maintenance, and labor costs of child care centers; and</text></clause><clause id="idBEF0CA7EFB784783BA430660892351D4"><enum>(iii)</enum><text>transportation support, such as support for vehicle repairs to assist in the transit of workers to jobs; and</text></clause></subparagraph><subparagraph id="id4DD0A0DC3853430C9EFE8DDA7B04B7B6"><enum>(G)</enum><text>such other programs and activities as the Secretary determines to be appropriate, including any proposed programs or activities that the recipient demonstrates clearly and substantially, to the satisfaction of the Secretary, will directly advance the goals of the RECOMPETE grant program.</text></subparagraph></paragraph><paragraph id="id0a58e0d677c94f5f9978e4b6ce8c4e63"><enum>(2)</enum><header>Method</header><text>In carrying out programs and activities described in paragraph (1), a recipient or subrecipient may—</text><subparagraph id="idAB8D320BEB744519828A203A5F6478FF"><enum>(A)</enum><text>use amounts provided under a RECOMPETE grant to carry out such a program or activity directly; or</text></subparagraph><subparagraph id="id1236D429957B40BB8332BB43FD4FFBE4"><enum>(B)</enum><text>enter into a contract or other agreement with a subcontractor or vendor (including nongovernmental, nonprofit organizations and for-profit entities) to carry out such a program or activity.</text></subparagraph></paragraph><paragraph id="id79ca7dbb90ac45a1a0e8f186783bfdce"><enum>(3)</enum><header>Outside programs and activities</header><text>A recipient acting on behalf of an eligible local community that enters into a cooperation agreement under section 3(b)(2)(A)(ii)(II) with a local community that is not eligible, but is located within the same local labor market, may use amounts provided under a RECOMPETE grant to carry out a program or activity described in paragraph (1) in the ineligible local community, if the program or activity would provide a benefit to residents of the eligible local community.</text></paragraph></subsection><subsection id="id34b90c15423644709b7207b6e1ad1a8d"><enum>(e)</enum><header>Regional Commissions</header><paragraph id="idc7747e24c47749f9a4cdfbd2d15b1575"><enum>(1)</enum><header>Definition of Regional Commission</header><text>In this subsection, the term <term>Regional Commission</term> means—</text><subparagraph id="id083CDCBFD8D34BFD801C0208C558B9F2"><enum>(A)</enum><text>any of the Regional Commissions (as defined in section 3 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3122">42 U.S.C. 3122</external-xref>));</text></subparagraph><subparagraph id="idF197812EB6754BF5BF558409461263E6"><enum>(B)</enum><text>the Northern Border Regional Commission;</text></subparagraph><subparagraph id="idD712F8FB9AC1429CA2B3C1C351F93E30"><enum>(C)</enum><text>the Southeast Crescent Regional Commission;</text></subparagraph><subparagraph id="id7A1EFB2EA6E14CACB3DEA7764E7FDBB5"><enum>(D)</enum><text>the Southwest Border Regional Commission; and</text></subparagraph><subparagraph id="idE166D775748F4DD3B224802B3C8449EB" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>any other regional commission established under Federal law, subject to the approval of the Secretary.</text></subparagraph></paragraph><paragraph id="id2CA4DE077868414BBA029A8FACD5E54C"><enum>(2)</enum><header>Technical assistance and support</header><text>If an applicant (or any portion of the service area of an applicant) is located in a region covered by a Regional Commission, the Regional Commission is encouraged to provide technical assistance and other support relating to applying for a RECOMPETE grant and developing and carrying out a RECOMPETE plan to—</text><subparagraph id="id25FC359320C64297BAD0279AD0B89631"><enum>(A)</enum><text>the applicant;</text></subparagraph><subparagraph id="idF90AC000C3164A9DB1722C8ECC19BF48"><enum>(B)</enum><text>the lead entity, if applicable; and</text></subparagraph><subparagraph id="idC23C3FB72EB64D70BDB6E380C68724D4"><enum>(C)</enum><text>any other relevant entities.</text></subparagraph></paragraph><paragraph id="idD03CC179A6974B7393874B5D989F9432"><enum>(3)</enum><header>Action by Secretary</header><text>The Secretary shall—</text><subparagraph id="id8809E90B4CBF478693683EE1DB375116"><enum>(A)</enum><text>encourage each recipient to coordinate the implementation of a RECOMPETE plan with the activities of each Regional Commission serving the region in which the applicable area is located; and</text></subparagraph><subparagraph id="idDAE9B12BDA7E40CD8A1AF5C473089D9D"><enum>(B)</enum><text>ensure that a copy of the RECOMPETE plan for each applicable area is provided to each affected Regional Commission.</text></subparagraph></paragraph></subsection></section><section id="id7701a51ab8724ca8abfda6f7591dc689"><enum>5.</enum><header>Administration, reporting, and oversight</header><subsection id="id83c0fbdfcc9e48b7be5827e136fd4e35"><enum>(a)</enum><header>Benchmark evaluations</header><paragraph id="id67E3C23BD0B54086AB000352DC095BD2"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a process under which the Secretary shall conduct periodic benchmark evaluations of each recipient to ensure that the recipient successfully carries out the programs and activities described in the RECOMPETE plan of the recipient.</text></paragraph><paragraph id="idD4C85623557E4B82A2D35C4001FCB79C"><enum>(2)</enum><header>Timing</header><text>The Secretary shall conduct a benchmark evaluation of a recipient under this subsection—</text><subparagraph id="id4926B98470AA403499596130789280B4"><enum>(A)</enum><text>for a recipient of a RECOMPETE grant provided during the initial application period under section 4(a)(2)(B)(i), by not later than 3 years after the date of the initial award of the RECOMPETE grant; and</text></subparagraph><subparagraph id="idA91FCBA1A0F042E59B2636AC3C3D4667"><enum>(B)</enum><text>not less frequently than once every 2 years thereafter during the term of the RECOMPETE grant provided to the recipient.</text></subparagraph></paragraph><paragraph id="ida1dd4a1ed4d84b05a32fdf7d13836428"><enum>(3)</enum><header>Criteria</header><text>In conducting a benchmark evaluation of a recipient under this subsection, the Secretary shall determine whether the recipient has—</text><subparagraph id="idaaf99f9c61094e459283e10ff6032888"><enum>(A)</enum><text>adhered to the timelines and requirements of the programs and activities identified in the RECOMPETE plan of the recipient;</text></subparagraph><subparagraph id="ide004226eae574191ae96d5e910841b45"><enum>(B)</enum><text>made sufficient progress toward achieving the benchmarks and objectives described in that RECOMPETE plan;</text></subparagraph><subparagraph id="idf287a43cc2114a6f805db5b3dbdaab55"><enum>(C)</enum><text>increased the overall employment rate, the prime-age employment rate, median household income, and per capita income in the applicable area; and</text></subparagraph><subparagraph id="id66d825a5d6b94dee86cddb02d6dc0b7a"><enum>(D)</enum><text>achieved compliance with such other criteria as the Secretary determines to be relevant.</text></subparagraph></paragraph></subsection><subsection id="id58010fb1526943b4890b000f163ed2ce"><enum>(b)</enum><header>Modification of plans</header><paragraph id="id5C67C507318445B1870709437081F015"><enum>(1)</enum><header>Requirement for recipients</header><text>A recipient shall modify the RECOMPETE plan of the recipient, or any program or activity conducted under that RECOMPETE plan, if the Secretary—</text><subparagraph id="idBCC0C2EC94DE468DA943F58FFCF4F402"><enum>(A)</enum><text>determines that—</text><clause id="id65750EFE20394D698E8D1710243CD42B"><enum>(i)</enum><text>such a program or activity is ineffective or underperforming; or</text></clause><clause id="id163E4B99797F41EEA229FB3D7D7CEB34"><enum>(ii)</enum><text>with respect to the RECOMPETE plan, program, or activity—</text><subclause id="idAA03B01DC5BF489AAAF3E6831503E6EB"><enum>(I)</enum><text>an applicable performance metric or criterion has not been met; or</text></subclause><subclause id="id3FEBCB30252243129184405B283622CD"><enum>(II)</enum><text>funds have been misused; and</text></subclause></clause></subparagraph><subparagraph id="idECA84A29097B453B897E16A85D2A1845"><enum>(B)</enum><text>directs the recipient to modify the RECOMPETE plan, program, or activity.</text></subparagraph></paragraph><paragraph id="id7CDF2936E69346758A63E045A206E506"><enum>(2)</enum><header>Authority of Secretary</header><subparagraph id="id2E8C9BABC3DF4888938C8FE5A6177A0E"><enum>(A)</enum><header>Adjustments and increases in funding</header><text>The Secretary may increase the amount of the RECOMPETE grant provided to the recipient as the Secretary determines to be appropriate, taking into consideration any modifications made to the RECOMPETE plan under paragraph (1), in an amount equal to not more than the maximum amount available on the date of approval of the RECOMPETE grant application for the applicable area and subject to the availability of funds, if the Secretary determines that—</text><clause id="id4a3306ce0df24ea4956f543c10dc794f"><enum>(i)</enum><text>events or other factors beyond the control of the recipient significantly—</text><subclause id="id11D82D473766483E9DD30DEF112BDB47"><enum>(I)</enum><text>altered applicable project circumstances; or</text></subclause><subclause id="idF54E5A8C7DEF460DA000BADD0A5AF059"><enum>(II)</enum><text>prevented the recipient from meeting the objectives and benchmarks of the RECOMPETE plan; or</text></subclause></clause><clause id="id4e9a79fb79ee4379b6173da3e66e7a2d"><enum>(ii)</enum><text>a labor market, economic, business, or technology shift, or any other major factor, warrants such a modification and increase in funding.</text></clause></subparagraph><subparagraph id="id890851880cf9433ea89edc9e9a6fd76f"><enum>(B)</enum><header>Withholding and terminating funding</header><text>The Secretary may temporarily withhold or terminate any amount scheduled to be provided under a RECOMPETE grant if the Secretary determines that—</text><clause id="id1e4109b56cc34042b57195f43c152b98"><enum>(i)</enum><text>after a reasonable effort, an agreement cannot be reached with respect to a modification to a RECOMPETE plan recommended or required by the Secretary under this subsection; or</text></clause><clause id="id49c6bae8fc634c83a310098c696222f4"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id47DBF97038BD4415B04BC0AEA22C832A"><enum>(I)</enum><text>a gross, intentional misuse of RECOMPETE grant funds (including any activity subject to a penalty under section 605 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3215">42 U.S.C. 3215</external-xref>)) has occurred; and</text></subclause><subclause id="id726294388CAD4EDCAF9867FEFE50A9B0" indent="up1"><enum>(II)</enum><text>the individual or entity responsible for the misuse is not removed from all programs and activities carried out under the RECOMPETE plan.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="idb51722fd280f4ed9bee4ed09fb5d4c5a"><enum>(c)</enum><header>Recipient reporting requirements</header><text>Each recipient shall be subject to—</text><paragraph id="idBB5CBFBA4B294F80BDC9D74C28215308"><enum>(1)</enum><text>the grant reporting requirements under part 200 of title 2, Code of Federal Regulations (or successor regulations); and</text></paragraph><paragraph id="idC3D79EAF4C084C298B2D19459CD5DC8C"><enum>(2)</enum><text>such additional, clear, annual reporting requirements as the Secretary may establish to gather any information necessary to conduct the benchmark and final evaluations under this section.</text></paragraph></subsection><subsection id="idabc10bd093b344d39e257ca019ea3e98"><enum>(d)</enum><header>Final evaluation</header><paragraph id="idE51FB36003834F0F8954462D885545C0"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the final disbursement of a RECOMPETE grant is provided to each recipient, the Secretary, in cooperation with the recipient and each applicable subrecipient, shall conduct a final evaluation of the success of the programs and activities carried out under the RECOMPETE plan of the recipient.</text></paragraph><paragraph id="idc7eb25d07a634e4b9b71d54542cae411"><enum>(2)</enum><header>Criteria</header><text>The Secretary shall establish criteria for use in conducting final evaluations under this subsection—</text><subparagraph id="idA37EFE21360A4E738426D76834496EAF"><enum>(A)</enum><text>in addition to the criteria established under subsection (a)(3); and</text></subparagraph><subparagraph id="idD7A6BF6E83DC41B2A39CC3F8485A89A7"><enum>(B)</enum><text>taking into consideration the goal of reducing the prime-age employment gap of each applicable area by 50 percent.</text></subparagraph></paragraph><paragraph id="id70452af87b4045199df54356e832d93b"><enum>(3)</enum><header>Requirements for recipients</header><text>Each recipient and subrecipient shall—</text><subparagraph id="id1BE2F2603D324F53B30031BBBF6EA81F"><enum>(A)</enum><text>cooperate with the Secretary in conducting a final evaluation under this subsection; and</text></subparagraph><subparagraph id="id399A95BC1CB0496CA461BBCCF09D26BF"><enum>(B)</enum><text>provide to the Secretary any information necessary for that evaluation.</text></subparagraph></paragraph></subsection><subsection id="id2a54dd63134049b29c8ae65f299abd41"><enum>(e)</enum><header>Report to Congress</header><text>The Secretary shall submit to Congress comprehensive and detailed annual reports describing the implementation of this Act, including, with respect to the period covered by the report—</text><paragraph id="id6b7f975492184b86878a757682c2d0ab"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idB5AC59B4DF9C401F9BE07EEA2C586D41"><enum>(A)</enum><text>a summary assessment of the overall progress of the RECOMPETE grant program; and</text></subparagraph><subparagraph id="id6A2980908FE44AFA9C59EA4922DEF5A6" indent="up1"><enum>(B)</enum><text>as data become available, an analysis of the effectiveness of that program;</text></subparagraph></paragraph><paragraph id="id1d911aee10c54b15bb5b915263031959"><enum>(2)</enum><text>labor market and economic metrics to describe the impact of the RECOMPETE grant program, including any progress made toward—</text><subparagraph id="id8C245D9F72EB4A699A1AA49F200AF8B6"><enum>(A)</enum><text>decreasing prime-age employment gaps; or</text></subparagraph><subparagraph id="id65E9312B906C4ACEA543D0A71E2E187C"><enum>(B)</enum><text>increasing local per capita income;</text></subparagraph></paragraph><paragraph id="idd7d4defc06534510a2c7f4e058f26dc5"><enum>(3)</enum><text>detailed demographic analyses of—</text><subparagraph id="idA720B2FC747D49CC911146FB7E74BF9F"><enum>(A)</enum><text>the populations served by recipients; and</text></subparagraph><subparagraph id="id446D90AED9314884867C64BBE079B796"><enum>(B)</enum><text>relevant labor market statistics;</text></subparagraph></paragraph><paragraph id="idc879403985cd4055b2ae4a5064725393"><enum>(4)</enum><text>a summary of the benchmark evaluations conducted under subsection (a), as available;</text></paragraph><paragraph id="id87660d1edeca4be993263c2340485aba"><enum>(5)</enum><text>an identification of, and reasons for rejecting or deferring, as applicable, each application submitted under section 4(a)(2), including the applicable annual RECOMPETE grant amount limitation established by the Secretary under subparagraph (C)(i)(II) of that section, if any; and</text></paragraph><paragraph id="ide363651e81854f809b1d89754f363892"><enum>(6)</enum><text>such other details as the Secretary determines to be appropriate.</text></paragraph></subsection><subsection id="id3d2a6a52b616429598b093546c753bb3"><enum>(f)</enum><header>Applicability of PWEDA</header><paragraph id="id3E173CD2EDA7490ABED83BDAF2820C5E"><enum>(1)</enum><header>In general</header><text>The following sections of the Public Works and Economic Development Act of 1965 shall apply to this Act (including the RECOMPETE grant program):</text><subparagraph id="id3ce9df4418e94365ba39438bf1019357"><enum>(A)</enum><text>Section 211 (<external-xref legal-doc="usc" parsable-cite="usc/42/3151">42 U.S.C. 3151</external-xref>).</text></subparagraph><subparagraph id="id40b0532433c14eaeae04406a7459b38a"><enum>(B)</enum><text>Section 503 (<external-xref legal-doc="usc" parsable-cite="usc/42/3193">42 U.S.C. 3193</external-xref>).</text></subparagraph><subparagraph id="idf7e430afe48d47119033f5f221cbb38a"><enum>(C)</enum><text>Section 504 (<external-xref legal-doc="usc" parsable-cite="usc/42/3194">42 U.S.C. 3194</external-xref>).</text></subparagraph><subparagraph id="id2a225e6e9374405ab42f4dc7d6f8f6b6"><enum>(D)</enum><text>Section 602 (<external-xref legal-doc="usc" parsable-cite="usc/42/3212">42 U.S.C. 3212</external-xref>).</text></subparagraph><subparagraph id="id940e49cf2d7843deac3b991e6f344384"><enum>(E)</enum><text>Section 604 (<external-xref legal-doc="usc" parsable-cite="usc/42/3214">42 U.S.C. 3214</external-xref>).</text></subparagraph><subparagraph id="id4c8e1f078d274a19827f74409a4fa8b2"><enum>(F)</enum><text>Section 605 (<external-xref legal-doc="usc" parsable-cite="usc/42/3215">42 U.S.C. 3215</external-xref>).</text></subparagraph><subparagraph id="id664779956f814c7eb303e4affd8f80f2"><enum>(G)</enum><text>Section 608 (<external-xref legal-doc="usc" parsable-cite="usc/42/3218">42 U.S.C. 3218</external-xref>).</text></subparagraph><subparagraph id="id12fef185917a466d974c17a429d0344a"><enum>(H)</enum><text>Section 610 (<external-xref legal-doc="usc" parsable-cite="usc/42/3220">42 U.S.C. 3220</external-xref>).</text></subparagraph></paragraph><paragraph id="id3CC01648E4D34D61B73AB1A41851D91F"><enum>(2)</enum><header>Authorities and duties of Secretary</header><text>The Secretary shall have the authorities and duties provided by the sections of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3121">42 U.S.C. 3121 et seq.</external-xref>) referred to in paragraph (1) in administering and enforcing this Act (including the RECOMPETE grant program).</text></paragraph></subsection></section><section id="idf9915d60911f48a7a9b98f9675ffe8fb"><enum>6.</enum><header>Funding</header><subsection id="idd5493556ef7d477c8f2c2ce2a9236d2c"><enum>(a)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this Act $175,000,000,000 for fiscal year 2022, to remain available until expended.</text></subsection><subsection id="idD6C97B201423431CA0E5CE7BB1C8D6BB"><enum>(b)</enum><header>Allocation</header><paragraph id="id5284125776154E77B058A857D5E4D069"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), of the amounts made available under subsection (a), the Secretary shall allocate—</text><subparagraph id="ida97d4eafb7354403a7edac2ad98b7320"><enum>(A)</enum><text>not less than 70 percent to recipients acting on behalf of local labor markets or partial local labor markets;</text></subparagraph><subparagraph id="idE2B90F9692A949E18D2560C5357F54C6"><enum>(B)</enum><text>not more than 20 percent to recipients acting on behalf of local communities; and</text></subparagraph><subparagraph id="idD51FB6D82A4948019A4F2FDA4CD1E118"><enum>(C)</enum><text>not less than 10 percent to eligible Tribal governments.</text></subparagraph></paragraph><paragraph id="idF779035B18A04E96AEB945ACBAE1910E"><enum>(2)</enum><header>Treatment of certain amounts</header><text>The amounts allocated pursuant to paragraphs (5) and (6)(B) of subsection (c) shall not be taken into consideration for purposes of calculations under paragraph (1).</text></paragraph><paragraph id="id5a5b1b1211eb41b6b0dc4b209f23de07"><enum>(3)</enum><header>Administrative costs and personnel</header><subparagraph id="id1926C300E44148A8A9A9CDAEA47378A4"><enum>(A)</enum><header>In general</header><text>Of any amounts made available to carry out this Act, the Secretary shall transfer not less than 1 percent to the Salary and Expenses Account of the Secretary for the costs of administration and oversight of this Act.</text></subparagraph><subparagraph id="id4750C9F774494DB485CA0153CE7C1094"><enum>(B)</enum><header>Personnel</header><text>The Secretary may—</text><clause id="id7DAF3380D6754CE48088184FE13E6A86"><enum>(i)</enum><text>appoint and fix the compensation of such temporary personnel as may be necessary to carry out this Act; and</text></clause><clause id="id2DDA7689CAB24B1A826506C4CCF2B366"><enum>(ii)</enum><text>effective beginning on the date on which an individual appointed under clause (i) has served continuously in that appointment for 2 years, appoint the individual to a position in the Economic Development Administration in the same manner in which competitive service employees with competitive status are considered for transfer, reassignment, or promotion to such a position, at which time the individual shall become a career-conditional employee, unless the individual has completed the service requirements for career tenure.</text></clause></subparagraph></paragraph></subsection><subsection id="idc181a4d3508b4ef1b1d13ff110acbaaf"><enum>(c)</enum><header>Grant formulas</header><paragraph id="id49DC0F3AEBE344AA83C5A7B279062EFD"><enum>(1)</enum><header>In general</header><text>Subject to subsection (e), based on the information relating to projected costs contained in applicable RECOMPETE plans under subparagraph (C) of section 4(b)(2), and the justifications described in subparagraph (D) of that section, the amount of a RECOMPETE grant provided to a recipient shall be determined in accordance with this subsection.</text></paragraph><paragraph id="idf62605c869874344a81ad8bf5a2d7b89"><enum>(2)</enum><header>Local labor markets</header><text>An eligible local labor market may receive not more than the amount equal to the product obtained by multiplying—</text><subparagraph id="id7a7c58af794d4528ab4bc1f074715acd"><enum>(A)</enum><text>the prime-age employment gap of the local labor market;</text></subparagraph><subparagraph id="id767341e4451641e5ac131abb071d6648"><enum>(B)</enum><text>the prime-age population of the local labor market; and</text></subparagraph><subparagraph id="idEFB1B0F4A9E94C08AE633F542CE78972"><enum>(C)</enum><text>$70,585.</text></subparagraph></paragraph><paragraph id="id6C7C2E02BA6C44F5A3A5C03C8878068F"><enum>(3)</enum><header>Local communities</header><text>Subject to paragraph (6), an eligible local community may receive not more than the amount equal to the product obtained by multiplying—</text><subparagraph id="id53CA341FDE1E4FC78D0474716779091E"><enum>(A)</enum><text>the prime-age employment gap of the local community;</text></subparagraph><subparagraph id="idEE7B13C2B1D4490782DD9F2A01AFF887"><enum>(B)</enum><text>the prime-age population of the local community; and</text></subparagraph><subparagraph id="id8E2D2119C0ED4D56A9159750793B29F7" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>$53,600. </text></subparagraph></paragraph><paragraph id="idB770363071164274AEDDD0FFB6A4DCEB"><enum>(4)</enum><header>Partial local labor markets</header><text>An eligible partial local labor market may receive not more than the amount equal to the product obtained by multiplying—</text><subparagraph id="id02237301637D49B09F55E230D2F6611A"><enum>(A)</enum><text>the population of the partial local labor market;</text></subparagraph><subparagraph id="idAA62269E8EA14625A38F4759A7EB1E64"><enum>(B)</enum><text>the lesser of—</text><clause id="idEA5C4946C155410493CA6CEC88BC42A0"><enum>(i)</enum><text>the prime-age employment gap of the local labor market within which the partial local labor market is located; and</text></clause><clause id="id01B7977145094FB097FF133ED845C582"><enum>(ii)</enum><text>the prime-age employment gap of the partial local labor market; and</text></clause></subparagraph><subparagraph id="idF1B641E5D6BC442681B198A709980A5D" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>$70,585.</text></subparagraph></paragraph><paragraph id="id4E976E21D3FF491F816E9D09AAE8C055"><enum>(5)</enum><header>Tribal governments</header><subparagraph id="idEF7FBDA3D46B4B39B75CE34E3A51EEE0"><enum>(A)</enum><header>In general</header><text>An eligible Tribal government may receive not more than the amount equal to the product obtained by multiplying, subject to subparagraph (B)—</text><clause id="id593627C8ADC14D1D844930CCFEDAB09B"><enum>(i)</enum><text>the prime-age employment gap of the Tribal government; </text></clause><clause id="idFA7CDAF5F0594378BA051FB204700027"><enum>(ii)</enum><text>the prime-age population of the Tribal government; and</text></clause><clause id="idA2902FF84D3F41ABAC178BE4F6EB020C" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>$70,585.</text></clause></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idABABF45E0FDB495C9C339019993604AD"><enum>(B)</enum><header>Calculation of population</header><clause display-inline="no-display-inline" commented="no" id="idFF08A9E4321041E495454087FE36FB79"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), for purposes of subparagraph (A), the population of a Tribal government shall be equal to the sum obtained by adding—</text><subclause display-inline="no-display-inline" commented="no" id="id33A7F9576A6A45A99FC54AE427DB0C56"><enum>(I)</enum><text>the product obtained by multiplying—</text><item display-inline="no-display-inline" commented="no" id="id909AE8B889F6478F9AE71DD7A131AB44"><enum>(aa)</enum><text>the total number of individuals residing on the Tribal land of the Tribal government; and</text></item><item commented="no" display-inline="no-display-inline" id="idC13F6147D4954721A42D1023A0378A5A"><enum>(bb)</enum><text>0.65; and</text></item></subclause><subclause display-inline="no-display-inline" commented="no" id="id0B4848032BDF408196D40451C722E449"><enum>(II)</enum><text>the product obtained by multiplying—</text><item display-inline="no-display-inline" commented="no" id="id36626504B8E64CDBBA475BD05B86774D"><enum>(aa)</enum><text>the total number of individuals included on the membership roll of the Tribal government; and</text></item><item display-inline="no-display-inline" commented="no" id="idB2CE6031AEED4140B0010680A6484372"><enum>(bb)</enum><text>0.35.</text></item></subclause></clause><clause display-inline="no-display-inline" commented="no" id="id7465302876D644DFA700D160125A2C27"><enum>(ii)</enum><header>Use of data</header><text>Each calculation under clause (i) shall be determined based on data provided by the applicable Tribal government to the Department of the Treasury under the Coronavirus State and Local Fiscal Recovery Fund programs under title VI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801 et seq.</external-xref>) (as amended by subtitle M of title IX of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>; 135 Stat. 4)).</text></clause></subparagraph></paragraph><paragraph id="id5d4c8f8739ec485294e33f1e5d25318d"><enum>(6)</enum><header>Local communities with cooperation agreements</header><text>If an eligible local community elects to enter into a cooperation agreement under section 3(b)(2)(A) with 1 or more local communities that are not eligible—</text><subparagraph id="idd477934935584804b0628bb6cd553932"><enum>(A)</enum><text>each eligible local community that is a party to the cooperation agreement may receive the maximum amount available to the eligible local community, as determined under paragraph (3); and</text></subparagraph><subparagraph id="idecb5909cb4b9499caf5ada05fe9e84bd"><enum>(B)</enum><text>the Secretary may award to the lead entity an additional amount equal to not more than 10 percent of the total amount provided under subparagraph (A), for distribution by the lead entity to any local community or other applicant that is a party to the cooperation agreement, regardless of whether the local community or other applicant is eligible, for use in accordance with the applicable RECOMPETE plan.</text></subparagraph></paragraph></subsection><subsection id="id707c5010f94a4b78b6ca7266bc660120"><enum>(d)</enum><header>Obligation and disbursement of funds</header><paragraph id="idE034D95FF0B442BB9BE20CAD2713E262"><enum>(1)</enum><header>In general</header><text>On approval by the Secretary of an application under section 4(a)(2)(E), the Secretary shall—</text><subparagraph id="id1336BA0627044DCAAE91F64CFF40CF78"><enum>(A)</enum><text>obligate the entire amount of the RECOMPETE grant for the applicable recipient; and</text></subparagraph><subparagraph id="id36C5CED794474CD5B6AF5E45BEC62500"><enum>(B)</enum><text>disburse that amount to the recipient annually for each of the 10 fiscal years beginning after the date of obligation, in accordance with this subsection.</text></subparagraph></paragraph><paragraph id="id56CB270C7B714722A1F0AB7F8C998A98"><enum>(2)</enum><header>Proposals</header><text>To receive an annual disbursement under paragraph (1), a recipient shall submit to the Secretary a proposal describing the intended use by the recipient of the disbursement during the applicable fiscal year (including the programs and activities proposed to be carried out and any subcontractor or vendor proposed to be used for those purposes), in accordance with the RECOMPETE plan of the recipient.</text></paragraph><paragraph id="idAB844278B516479BBC353F6D6A8F5A49"><enum>(3)</enum><header>Provision of funding</header><text>On approval by the Secretary of a proposal submitted by a recipient under paragraph (2), the Secretary shall disburse to the recipient the amount of the RECOMPETE grant due to the recipient for the fiscal year, for use in accordance with—</text><subparagraph id="id9C5164642349441DBF9D6205444178C7"><enum>(A)</enum><text>the proposal; and</text></subparagraph><subparagraph id="idA886650B75594E14AC061EE6060E8833" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the RECOMPETE plan of the recipient. </text></subparagraph></paragraph></subsection><subsection id="ide36b660bab8846bbb7bc1ee7e0f5462c"><enum>(e)</enum><header>Cost sharing</header><paragraph id="id3621766758df434da4b8e5a5451fb625"><enum>(1)</enum><header>Federal share</header><subparagraph id="idE5BCB59C214049D783D2FC9B03DEAE03"><enum>(A)</enum><header>In general</header><text>The Federal share of the cost of each program and activity carried out using a RECOMPETE grant shall be the cost share described in subparagraph (B) for the applicable recipient, subject to subparagraph (C) and paragraphs (2) through (4).</text></subparagraph><subparagraph id="idA91A88DF15664967BE4B129171C56949"><enum>(B)</enum><header>Descriptions of cost shares</header><clause id="id288e09009dce402e8818ef45d1c64265"><enum>(i)</enum><header>Local labor markets</header><text>For an eligible local labor market, the cost share referred to in subparagraph (A) shall be—</text><subclause id="id60edb50a49f8432cabeb362e3976eae2"><enum>(I)</enum><text>50 percent for an eligible local labor market with a prime-age employment gap equal to—</text><item id="idE6AC6AB157E540F8BF0847A4E1DB4D97"><enum>(aa)</enum><text>not less than 2.5 percent; and</text></subclause><subclause id="id46D4510EB14A49568CC8FDE3955E5215"><enum>(II)</enum><text>demonstrated severe economic need.</text></subclause></clause></subparagraph></paragraph><paragraph id="id539455bdc6304411a57cbdc7a60e8175"><enum>(2)</enum><header>Special rule</header><subparagraph id="id58D8D839561546778C0F64384841706C"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Federal share calculated for an eligible local community under paragraph (1) shall not be reduced due to an election by the eligible local community to enter into a cooperation agreement under section 3(b)(2)(A).</text></subparagraph><subparagraph id="idc712e418bd2a46f7ab9a38d517de254d"><enum>(B)</enum><header>Exception</header><text>If additional amounts are provided for an eligible local community for distribution to subrecipients under section 3(b)(2)(A)(iii), the Federal share calculated under paragraph (1) for the eligible local community shall be not more than 50 percent, subject to any increase in accordance with clause (i) or (ii) of paragraph (1)(C), as applicable.</text></subparagraph></paragraph><paragraph id="ide09158a31e614890b4043ee7a73f2246"><enum>(3)</enum><header>Non-Federal contributions</header><text>In calculating the non-Federal share of the cost of a program or activity carried out under a RECOMPETE plan, the Secretary may provide a credit toward the non-Federal share for any non-Federal contribution to the program or activity—</text><subparagraph id="id5951319EBEA64883A626CB45AD1583DC"><enum>(A)</enum><text>in cash or in-kind;</text></subparagraph><subparagraph id="id5E8B9E38F078465EA83061C6C6282A93"><enum>(B)</enum><text>fairly evaluated; and</text></subparagraph><subparagraph id="id9B40732C674F4AB8A4E4318482D115EF"><enum>(C)</enum><text>including any contribution of space, equipment, assumption of debt, or service.</text></subparagraph></paragraph><paragraph id="idec9a2bf9663a4937bc991f0a81cabecc"><enum>(4)</enum><header>Reassessment</header><subparagraph id="id2CD0C3157F38463486733D3BA8CC1925"><enum>(A)</enum><header>In general</header><text>The Federal share and non-Federal share determined for a recipient under paragraphs (1) and (2) shall apply during the period beginning on the date of enactment of this Act and ending on the date on which the initial benchmark evaluation relating to the recipient is conducted under section 5(a).</text></subparagraph><subparagraph id="id5E99A533AEC94A968A7229BFC3C9EEC6"><enum>(B)</enum><header>Periodic reevaluation</header><text>As soon as practicable after the date on which each benchmark evaluation relating to a recipient is conducted under section 5(a), the Secretary shall—</text><clause id="id2D8CA2F81F524A4A9334E1BB21BCE6EB"><enum>(i)</enum><text>reevaluate the Federal share and non-Federal share determined for the recipient under this subsection; and</text></clause><clause id="idB171E1D125A249DB8D0725FF88005B78"><enum>(ii)</enum><text>determine whether such a cost share should be adjusted, subject to subparagraph (C).</text></clause></subparagraph><subparagraph id="idD02DD9C022D14736AFB4551F47D53517"><enum>(C)</enum><header>Limitation on Federal share</header><text>The Federal share determined for a recipient under this subsection—</text><clause id="id8B225CC096B44B65B4F03B52694976CC"><enum>(i)</enum><text>shall not be decreased by more than—</text><subclause id="id87A1C8395F7242368E8A5051EDAF23E8"><enum>(I)</enum><text>10 percent, as compared to the Federal share determined for the recipient under this subsection for the preceding period; or</text></subclause><subclause id="id1BEC07D8EF444D1F9DF104BD1005461C"><enum>(II)</enum><text>30 percent, in total; and</text></subclause></clause><clause id="id2A286B3A91524FBEBAB468C785890A11"><enum>(ii)</enum><text>shall be not less than 50 percent.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
