<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2458</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210722">July 22, 2021</action-date><action-desc><sponsor name-id="S236">Mr. Inhofe</sponsor> (for himself, <cosponsor name-id="S343">Mr. Boozman</cosponsor>, and <cosponsor name-id="S363">Mr. King</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify that individuals engaged in aircraft flight instruction or testing, including phased testing of experimental aircraft, are not operating an aircraft carrying persons or property for compensation or hire.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Certainty for General Aviation Pilots Act of 2021</short-title></quote>.</text></section><section id="id4F0372AD8C9345E7961E2672FDA10362"><enum>2.</enum><header>Flight instruction or testing</header><subsection id="idE71295FDC2A94A9DA562B921E189AAF8"><enum>(a)</enum><header>In general</header><text>A certificated flight instructor providing student instruction, flight instruction, or flight training shall not be deemed to be operating an aircraft carrying persons or property for compensation or hire.</text></subsection><subsection id="ide62e39b97d8947d196e13ceb86d80d97"><enum>(b)</enum><header>Authorized additional pilots</header><text>An individual acting as an authorized additional pilot during Phase I flight testing of aircraft holding an experimental airworthiness certificate, in accordance with section 21.191 of title 14, Code of Federal Regulations, and meeting the requirements set forth by Federal Aviation Administration regulation and policy, shall not be deemed to be operating an aircraft carrying persons or property for compensation or hire.</text></subsection><subsection id="iddf1c32e96474404a897068b8afcc0da5"><enum>(c)</enum><header>Use of aircraft</header><text>An individual who uses, causes to use, or authorizes to use aircraft for flights conducted under subsection (a) or (b) shall not be deemed to be operating an aircraft carrying persons or property for compensation or hire. </text></subsection><subsection id="idf20be3b6ccde4b1283dc40ae41579493"><enum>(d)</enum><header>Revision of rules</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall issue, revise, or repeal the rules, regulations, guidance, or procedures of the Federal Aviation Administration to conform to the requirements of this section.</text></subsection></section></legis-body></bill>
