<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 244</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210204">February 4, 2021</action-date><action-desc><sponsor name-id="S331">Mrs. Gillibrand</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 242 of title 18, United States Code, to include the use of chokeholds and carotid holds as a deprivation of rights and as a punishment, pain, or penalty, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF329265CD6EA499BBCD40FAB7CE27B8C"><section section-type="section-one" id="H0BDC7A7493A548618A2C62B874F657C7"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eric Garner Excessive Force Prevention Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H8BA451989C8E4518B6CD2C28FF982701"><enum>2.</enum><header>Chokeholds as civil rights violations</header><subsection id="idDDF2CCC21E594361923B886983A23D85"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 242 of title 18, United States Code, is amended by adding at the end the following: <quote>For the purposes of this section, the application of any pressure to the throat or windpipe, the use of maneuvers that restrict blood or oxygen flow to the brain, or the use of carotid artery restraints which may prevent or hinder breathing or reduce intake of air is a deprivation of a right, privilege, or immunity and is a punishment, pain, or penalty.</quote>.</text></subsection><subsection id="id6A7568D7B0544FB0AB67B5DADF22260F"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in the amendment made by subsection (a) shall be construed to limit or exclude other claimed deprivations of rights, privileges, or immunities or punishments, pains, or penalties under section 242 of title 18, United States Code. </text></subsection></section></legis-body></bill>
