<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2423</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210721">July 21, 2021</action-date><action-desc><sponsor name-id="S247">Mr. Wyden</sponsor> (for himself and <cosponsor name-id="S322">Mr. Merkley</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize transitional sheltering assistance for individuals who live in areas with unhealthy air quality caused by wildfires, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildfire Smoke Relief Act</short-title></quote>.</text></section><section id="idE0BAF63CDDAC415B9373491FFE8CBC8D"><enum>2.</enum><header>Transitional sheltering assistance</header><subsection id="idB26D2435666C418B9A3E84B975AF9C55"><enum>(a)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="idEB2BDBC625274206BC32A301B20261F0"><enum>(1)</enum><header>Individual at risk of wildfire smoke related illness</header><text>The term <term>individual at risk of wildfire smoke related illness</term> means an individual, living in an area where the air quality index is determined to be unhealthy for not less than 3 consecutive days as a result of a wildfire, who is—</text><subparagraph id="id5596970E84054686B5F37A3AC26A0F0F"><enum>(A)</enum><text>a low-income individual;</text></subparagraph><subparagraph id="id43A7650B71F040F4892329CBBC6DB410"><enum>(B)</enum><text>a parent or guardian with a child who has not attained 19 years of age;</text></subparagraph><subparagraph id="idFFE828585B5A47CEA77BD8AF0B89B849"><enum>(C)</enum><text>a pregnant woman;</text></subparagraph><subparagraph id="id341D31C7AEF04FE2B25797E7811575DE"><enum>(D)</enum><text>an individual who is 65 years of age or older;</text></subparagraph><subparagraph id="id5D4DED9AD0C843728FA9C5DFFA8C3142"><enum>(E)</enum><text>an individual with chronic respiratory or cardiovascular illness; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDBF79A822EC64D7DBCEB609E9438B221"><enum>(F)</enum><text>an individual with a chronic disease that is exacerbated by smoke inhalation.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE702BF7647174124B9BE6040ECA64934"><enum>(2)</enum><header>Low-income individual</header><text>The term <term>low-income individual</term> means an individual from a family whose taxable income (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/63">section 63</external-xref> of the Internal Revenue Code of 1986) for the preceding year did not exceed 200 percent of an amount equal to the poverty level, as determined by using criteria of poverty established by the Bureau of Census.</text></paragraph><paragraph id="id945F223FC02F45C58E58C5EDA1785F08"><enum>(3)</enum><header>Qualified entity</header><text>The term <term>qualified entity</term> means—</text><subparagraph id="id2E54216B3F8A4CB4808BDF9AE4BD4BEB"><enum>(A)</enum><text>a State or unit of local government;</text></subparagraph><subparagraph id="id4567242EA86344F08F0D994C3A23F450"><enum>(B)</enum><text>a local public health authority; and</text></subparagraph><subparagraph id="id85AC1BE324184771A5EDB9EF1A4813F6"><enum>(C)</enum><text>a coordinated care organization.</text></subparagraph></paragraph></subsection><subsection id="id757958784CBD4D80B708B4E6393B2CAA"><enum>(b)</enum><header>Transitional sheltering assistance program</header><text>In carrying out the Transitional Sheltering Assistance Program of the Federal Emergency Management Agency under section 403 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b</external-xref>), the President shall—</text><paragraph id="id5986BEEAC0F54A64B1242538FA2C4DAA"><enum>(1)</enum><text>provide assistance to a qualified entity to purchase and provide, to an individual at risk of wildfire smoke related illness, smoke-inhalation prevention equipment, including—</text><subparagraph id="id43830BCEB14647EE9A0BF5E94D6B4D34"><enum>(A)</enum><text>a portable air filtration unit;</text></subparagraph><subparagraph id="id57529AA2D50844D38939E05CD46EB9A9"><enum>(B)</enum><text>an air filter;</text></subparagraph><subparagraph id="idB3B0E47997814CD2B7D7076C3B0851BC"><enum>(C)</enum><text>a face mask or respirator, such as—</text><clause id="idB26070C7CAF047FFB7D730D92CDECC78"><enum>(i)</enum><text>an N95 respirator;</text></clause><clause id="idDF2FB878FC5F4CBE9C13CAFA5BFB026A"><enum>(ii)</enum><text>a P100 respirator; or</text></clause><clause id="idFE260980CF714D61AE15C2BC614D104F"><enum>(iii)</enum><text>other equipment certified by the National Institute for Occupational Safety and Health to protect from airborne particle exposure;</text></clause></subparagraph><subparagraph id="idEE2A2F9180FB4A4C976E928C34AE1260"><enum>(D)</enum><text>low-cost equipment to keep smoke out of a house, such as:</text><clause id="id5FF58E443AB3477FADB151A031BC296B"><enum>(i)</enum><text>a weather strip;</text></clause><clause id="id32A5FF239D3A4EA9B1A55B5DCC4A8191"><enum>(ii)</enum><text>not more than 1 portable air-conditioning unit per household;</text></clause><clause id="id29D60577889A492BA43D4E862DCA9A13"><enum>(iii)</enum><text>ventilation equipment;</text></clause><clause id="id410634DA123A4F4EB2BC5BCDAA15CC84"><enum>(iv)</enum><text>a screening and shading device; or</text></clause><clause id="id3E81ED77B90B48149E3328EC9B85BF06"><enum>(v)</enum><text>a window covering; or</text></clause></subparagraph><subparagraph id="idF681E0A88D96461F9A055FC433DB0674"><enum>(E)</enum><text>other similarly effective devices; and</text></subparagraph></paragraph><paragraph id="id23EEA6E0F7FB44278B7742F96EA25B36"><enum>(2)</enum><text>in any case in which smoke-inhalation prevention equipment is not sufficient to mitigate the risk of illness, provide cost-efficient transitional shelter assistance to an individual at risk of wildfire smoke related illness.</text></paragraph></subsection></section></legis-body></bill>
