<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restore Environmental Vitality and Improve Volatile Economy by the Civilian Conservation Corps Act</short-title></quote> or the <quote><short-title>REVIVE the CCC Act</short-title></quote>.</text></section> <section section-type="subsequent-section" id="idEE8B79992A0C409880F95413C43F1BCE"><enum>2.</enum><header>Civilian Conservation Corps</header> <subsection id="id5B50CFA3FFFC4841B6E6313EE4EC2162"><enum>(a)</enum><header>In general</header><text>Subtitle E of title I of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12611">42 U.S.C. 12611 et seq.</external-xref>) is amended—</text>
<paragraph id="id9559CBFB88A84EC5B029A709FBE546A7"><enum>(1)</enum><text>by striking the heading for subtitle E and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idCE1E588E99484D21BCDC677387EADFAE"> <subtitle commented="no" id="idF1CE2E4626314A8895BBEE5CC3D720B2" style="OLC"><enum>E</enum><header>National Corps</header> <chapter commented="no" style="OLC" id="id4B03A4E514F740DFA4FA264F3F8801B2"><enum>1</enum><header>National Civilian Community Corps</header></chapter></subtitle><after-quoted-block>;</after-quoted-block></quoted-block><continuation-text continuation-text-level="paragraph">and</continuation-text></paragraph> <paragraph id="idCCB99532B4D64807A218158399FF7F7D"><enum>(2)</enum><text>by adding at the end the following:</text>

<chapter id="id4BCCF5D7FF244C45B41781E06E43CC56" style="OLC"><enum>2</enum><header>Civilian Conservation Corps</header>
<section id="idD5BFE76A1C8440C7AE8AA2008CAD1F95"><enum>166.</enum><header>Civilian Conservation program</header>
<subsection id="id7CA84FE054CC46598F219B39A2C94241"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this chapter are—</text> <paragraph id="id287555680FF8496FAFD6146B9BBF15DD"><enum>(1)</enum><text display-inline="yes-display-inline">to help relieve the widespread distress and unemployment in the United States;</text></paragraph>
<paragraph id="id0799AAA0221C4D7EAB77D3BE6D01568E"><enum>(2)</enum><text>to train and support career advancement, leading to long-term employment opportunities;</text></paragraph> <paragraph id="id2A4E207C3A84400D8C6239E73B22DC12"><enum>(3)</enum><text display-inline="yes-display-inline">to provide for the restoration of depleted natural resources in the United States;</text></paragraph>
<paragraph id="iddbb153c313be46bf96f7a041fdbe79b1"><enum>(4)</enum><text>to conserve and improve community natural resources;</text></paragraph> <paragraph id="id80638088694b4297a7cee8fb226b05bb"><enum>(5)</enum><text>to reduce greenhouse gas emissions and sequester carbon; and</text></paragraph>
<paragraph id="ide0303fa12bdd4580947043f11c1f7931"><enum>(6)</enum><text>to enhance climate change adaptation and resilience. </text></paragraph></subsection> <subsection id="id05AF7D6015B747D19658D64E8BD6C24B"><enum>(b)</enum><header>Definitions</header><text>In this chapter:</text>
<paragraph id="id47C447E23B8546C9AD48D7E468EE661D"><enum>(1)</enum><header>Corporation</header><text>The term <term>Corporation</term> means the Corporation (as defined in section 101), or a partner described in subsection (d), to the extent provided in the memorandum referred to in subsection (d).</text></paragraph> <paragraph id="id2C70B23259C045B4A08332DA82F4D08F"><enum>(2)</enum><header>Corps</header><text>The term <term>Corps</term> means the Civilian Conservation Corps established under subsection (c). </text></paragraph>
<paragraph id="id52C6279C5EE24E14B987D1BA109D75F3"><enum>(3)</enum><header>Eligible host entity</header><text display-inline="yes-display-inline">The term <term>eligible host entity</term> means an organization, entity, or individual that—</text> <subparagraph id="id97C7070BF13F414294528C2742F53248"><enum>(A)</enum><text display-inline="yes-display-inline">administers the program at the local level; and </text></subparagraph>
<subparagraph id="idBE283E8AD9ED49DFA8AE8AEB470D9839"><enum>(B)</enum><text display-inline="yes-display-inline">supervises Corps members in partnership and coordination with the Corporation, including the relevant partnering Federal agency specified in the memorandum for the issue area addressed by the program at the local level.</text></subparagraph></paragraph> <paragraph commented="no" id="id6549885B7D4941D2968FD3E32A2BDD87"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the same meaning given such term in sections 101(a) and 102(a)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>, 1002(a)(1)).</text></paragraph>
<paragraph id="id8656851B26BE43B38C55FD3DEB78F123"><enum>(5)</enum><header>Partnering Federal agency</header><text>The term <term>partnering Federal agency</term> means a Federal agency described in subsection (d)(1). </text></paragraph> <paragraph id="id2E4D5F152B5246458E0BDF6CAB077790"><enum>(6)</enum><header>Program</header><text>The term <term>program</term> means the Civilian Conservation program established under subsection (c). </text></paragraph>
<paragraph id="id261FEC8EF3194BEF99189E344D86D660"><enum>(7)</enum><header>State coordinating agency</header><text display-inline="yes-display-inline">The term <term>State coordinating agency</term> means an agency in a State—</text> <subparagraph id="id4a1cc9bb6b8049ce9b8bf92d9b838f4c"><enum>(A)</enum><text display-inline="yes-display-inline">that is selected by the State to coordinate, subject to the memorandum described in subsection (d), the implementation of activities under this chapter at eligible worksites in the State, including providing services through State agencies and coordinating access to training (including technical instruction) and educational resources for Corps members;</text></subparagraph>
<subparagraph id="id46dc2d28691749339faec395885dcf20"><enum>(B)</enum><text display-inline="yes-display-inline">may be a State department of environmental protection, natural resources, or agriculture, or other department or commission (as determined by the Corporation); and</text></subparagraph> <subparagraph id="idA6B37CAB638E4780881553AEF4DA08B9"><enum>(C)</enum><text>that coordinates and partners with Tribal agencies (such as Tribal departments of environmental protection, natural resources, or agriculture) regarding the implementation of activities under this chapter at eligible worksites associated with a Tribe (including for the provision of services through Tribal agencies), if the Corporation determines such coordination and partnership is relevant for the State.</text></subparagraph></paragraph></subsection>
<subsection id="id6F271A1C03BE4EB7B35CD3A18F4E2F21"><enum>(c)</enum><header>Establishment of civilian conservation corps and program</header>
<paragraph id="idB8253A82D96148D583F2ACF87006E4AF"><enum>(1)</enum><header>In general</header>
<subparagraph id="id186ACC56E5BE4CF4AD1FDBC71A796542"><enum>(A)</enum><header>Corps</header><text display-inline="yes-display-inline">The Corporation (as defined in section 101) may establish a Civilian Conservation Corps. </text></subparagraph> <subparagraph id="id599A5C6EE7C54B0A8738FF635CE9401D"><enum>(B)</enum><header>Program</header><text display-inline="yes-display-inline">The Corporation (as defined in subsection (b)) may establish and administer a Civilian Conservation program, to place unemployed and underemployed citizens of the United States in service positions related to conservation, including conservation of private and public lands. </text></subparagraph></paragraph>
<paragraph id="idCAE9701088AC495C9A6E6AC8FECAF6BD"><enum>(2)</enum><header>Conservation service positions</header><text display-inline="yes-display-inline">The program shall provide conservation service positions, and training (including technical instruction) and education related to such service positions, in order to support—</text> <subparagraph id="id6C74DF61DCF844B1AE5C3C698BA7FA0B"><enum>(A)</enum><text display-inline="yes-display-inline">the protection, enhancement, and restoration of natural resources;</text></subparagraph>
<subparagraph id="id1AF166FF95E74FE5BE1B87405BF74E07"><enum>(B)</enum><text display-inline="yes-display-inline">climate change mitigation and adaptation;</text></subparagraph> <subparagraph id="idE2287B19B347499089DCAB5EFD11D1C6"><enum>(C)</enum><text display-inline="yes-display-inline">investment in future generations of farmers, foresters, ranchers, conservationists, and other stewards of the Nation's shared natural resources;</text></subparagraph>
<subparagraph id="id67b67f7f7a1d49f294179abcc6fcd3dc"><enum>(D)</enum><text>the establishment, improvement, and rehabilitation of public outdoor recreation amenities and infrastructure; or</text></subparagraph> <subparagraph id="id60464619908749388C2BFD39FB0B9F6B"><enum>(E)</enum><text display-inline="yes-display-inline">the reduction of environmental health disparities in communities of color, low-income communities, and Tribal and indigenous communities, that are experiencing disproportionate exposure to environmental harms and risks. </text></subparagraph></paragraph></subsection>
<subsection id="id2FC26117518D4643A79F2F32C9C9D89C"><enum>(d)</enum><header>Administration</header><text display-inline="yes-display-inline">The program shall be administered, as specified in a memorandum of understanding, by the Corporation (as defined in section 101), in partnership with—</text> <paragraph id="idC378C763C8D94250963D68D9DF2CF1DB"><enum>(1)</enum><text display-inline="yes-display-inline">applicable Federal agencies with the relevant issue area expertise and standards, such as the Department of Agriculture and the Department of the Interior; and</text></paragraph>
<paragraph id="id3E3F4D16FD234C90B5935704686D9F5C"><enum>(2)</enum><text display-inline="yes-display-inline">applicable State or Tribal agencies with the relevant issue area expertise and standards, such as the State or Tribal agencies with jurisdiction over agriculture, natural resources, or environmental protection. </text></paragraph></subsection> <subsection id="idF7DFD336805C4D9EA3ADEBAFFDA12E5C"><enum>(e)</enum><header>Grants to eligible host entities</header> <paragraph id="idA3B6BADA26034F84AA2256E79A8DF929"><enum>(1)</enum><header>In general</header><text>In carrying out the program, the Corporation shall make grants to entities that own, operate, manage, or support work on eligible worksites, to serve as eligible host entities, and to administer the program at the local level.</text></paragraph>
<paragraph id="id3BA701BA533D4F47B344D7C84D5BA163"><enum>(2)</enum><header>Waiver of cost sharing requirement</header>
<subparagraph id="id18AD3C95751141C2AFC8F59DF7459D21"><enum>(A)</enum><header>In general</header><text>In the event of a covered project carried out by an eligible host entity to which the cost sharing requirement under section 212(a)(1) of the Public Land Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1729">16 U.S.C. 1729(a)(1)</external-xref>) would otherwise apply, notwithstanding that requirement, a grant under this subsection, combined with funds received under an Act described in subparagraph (B), may be used to fund costs of the project greater than 75 percent of the cost of such project.</text></subparagraph> <subparagraph id="id29851B466CD6485BA9074637414A7A39"><enum>(B)</enum><header>Covered project</header><text>In this paragraph, the term <term>covered project</term> means a project carried out pursuant to—</text>
<clause id="id5836CEB9BE604ACABDBA013471E667D3"><enum>(i)</enum><text>title I of the Act entitled <quote>An Act to establish a pilot program in the Departments of the Interior and Agriculture designated as the Youth Conservation Corps, and for other purposes</quote>, approved August 13, 1970 (commonly known as the <quote>Youth Conservation Corps Act of 1970</quote>; <external-xref legal-doc="usc" parsable-cite="usc/16/1701">16 U.S.C. 1701 et seq.</external-xref>); or </text></clause> <clause id="id58DE6EAF2EEC41D5AFA2780544A45A72"><enum>(ii)</enum><text>the Public Lands Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1721">16 U.S.C. 1721 et seq.</external-xref>). </text></clause></subparagraph></paragraph></subsection>
<subsection id="id088749ACA1364F3CB110512C8E9DD306"><enum>(f)</enum><header>Eligible host entities and worksites</header>
<paragraph id="id8E9F307DB3B84AD1A0C9E5B907C19BB8"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under subsection (e) and become an eligible host entity, an entity shall own, operate, manage, or support work on an eligible worksite for a Corps project.</text></paragraph> <paragraph id="idC857D121AE17469CA3440AF328F3C7F3"><enum>(2)</enum><header>Entities</header><text display-inline="yes-display-inline">Entities eligible to receive such a grant and become an eligible host entity may include—</text>
<subparagraph id="id174E82F7991A4FA4AA89A5480075228E"><enum>(A)</enum><text display-inline="yes-display-inline">the board in charge of a local conservation district;</text></subparagraph> <subparagraph id="id26F0E6B76CB64C719E93E4CAFFC12EC7"><enum>(B)</enum><text display-inline="yes-display-inline">a State or local office of the Cooperative Extension System or an equivalent Tribal office;</text></subparagraph>
<subparagraph id="idDF7D1B8982C240078EB3D4B85F4484E4"><enum>(C)</enum><text display-inline="yes-display-inline">an individual farmer;</text></subparagraph> <subparagraph id="id55CE039FE71A4B2E93146AD2CCBC6C39"><enum>(D)</enum><text>a nonprofit organization, farmer membership organization, or other agriculture group, with conservation expertise, that can place a Corps member on an individual farm; </text></subparagraph>
<subparagraph id="idA2F76B590932403A8A8BBB53795C347C"><enum>(E)</enum><text display-inline="yes-display-inline">a State or Tribal agency with jurisdiction over agriculture or natural resources;</text></subparagraph> <subparagraph id="id563A7C46646D4C8CB7E7F836B822CE4E"><enum>(F)</enum><text display-inline="yes-display-inline">the trustee of a land trust;</text></subparagraph>
<subparagraph id="id80AA66BF25804CCF8AF01957ECBED3B7"><enum>(G)</enum><text display-inline="yes-display-inline">a forest or environmental consultant;</text></subparagraph> <subparagraph id="id4A35EA41F5374CE29B29D9350D236812"><enum>(H)</enum><text display-inline="yes-display-inline">the sponsor of an apprenticeship program that has been registered by the Department of Labor, a State office of apprenticeship, or an equivalent Tribal office;</text></subparagraph>
<subparagraph id="id628F545632B944C5AC1737BE9ADC91E7"><enum>(I)</enum><text>an entity that hosts a Corps member under a service program, including—</text> <clause id="id6eaaa0b6374046bcb611db0cdb93a084"><enum>(i)</enum><text>a program authorized under—</text>
<subclause id="id2FFE89A0F2BB4BB38CA1C04F77409688"><enum>(I)</enum><text>this Act, including the Healthy Futures Corps described in section 122; </text></subclause> <subclause id="idEF313F1DFF07472686DCD52620433796"><enum>(II)</enum><text>title I of the Act entitled <quote>An Act to establish a pilot program in the Departments of the Interior and Agriculture designated as the Youth Conservation Corps, and for other purposes</quote>, approved August 13, 1970 (commonly known as the <quote>Youth Conservation Corps Act of 1970</quote>; <external-xref legal-doc="usc" parsable-cite="usc/16/1701">16 U.S.C. 1701 et seq.</external-xref>); or </text></subclause>
<subclause id="id3394772A629747CD942E73C0A778B942"><enum>(III)</enum><text>the Public Lands Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1721">16 U.S.C. 1721 et seq.</external-xref>); </text></subclause></clause> <clause id="id2ae5e1fc272f49a48687fc2a3caeec21"><enum>(ii)</enum><text>a program of the Indian Youth Service Corps authorized under section 210 of the Public Lands Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1727b">16 U.S.C. 1727b</external-xref>); and</text></clause>
<clause id="id75de08f580b74dffb7573521cba4b8b6"><enum>(iii)</enum><text>a program of the Urban Youth Corps authorized under section 106 of the National and Community Service Trust Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/12656">42 U.S.C. 12656</external-xref>); </text></clause></subparagraph> <subparagraph id="id6A6647826E654AC09619D4EB4200003B"><enum>(J)</enum><text display-inline="yes-display-inline">a local agriculture, conservation, watershed, or wildlife nonprofit organization;</text></subparagraph>
<subparagraph id="id87D30EE3D1264D2A95CF2917B3E2A35F"><enum>(K)</enum><text display-inline="yes-display-inline">a State or Tribal park or forest foundation; and</text></subparagraph> <subparagraph id="id9F5D31A4A6E24C4DB0CA01C3A3A7C0BF"><enum>(L)</enum><text display-inline="yes-display-inline">another appropriate entity, as determined by the Corporation.</text></subparagraph></paragraph>
<paragraph id="id2327597E1A6A4992B804E381CC3F0D93"><enum>(3)</enum><header>Worksites</header>
<subparagraph id="id09479E4E3DF845EE97501E980CCD54CB"><enum>(A)</enum><header>Public or certain private land</header>
<clause id="id42CFAEF83515465A9DBF822628FD0311"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible worksite shall be located on public land or on private land determined to be eligible under clause (ii).</text></clause> <clause id="id982E437118254DF8859D7234A5CA8F52"><enum>(ii)</enum><header>Eligibility on private lands</header><text display-inline="yes-display-inline">In the case of a proposed worksite located on private land, the Corporation, in consultation with the partnering Federal agencies described in subsection (d)(1), shall determine whether the site is an eligible worksite for purposes of this paragraph by determining the adequacy of the public conservation benefit of the related Corps project. In determining the adequacy of that benefit, the Corporation may consider, among other factors, the project’s ability to address core State, Tribal, or local conservation objectives such as addressing land conservation priorities, promoting climate resiliency, fulfilling watershed plans, establishing stream buffers, restoring critical wildlife habitat, or promoting agricultural best management practices.</text></clause>
<clause id="idB841A3B29BE647A5A3CCF5DB75551AAC"><enum>(iii)</enum><header>Worksite predominantly located on private land</header><text>A proposed worksite that is predominantly located on private land will be treated as a proposed worksite located on private land for purposes of clause (ii).</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id66c1ea5ab66e42e0b48d57aee4232ca5"><enum>(B)</enum><header>Eligibility of proposed worksite in environmental justice area</header><text>In the case of a proposed worksite located in an environmental justice area identified under subsection (j), the Corporation shall determine whether the site is an eligible worksite under this subsection by determining—</text>
<clause commented="no" display-inline="no-display-inline" id="idff5cf09569a2462998e50987deb9ce43"><enum>(i)</enum><text>the benefits of the related Corps project for the health of the community living in the environmental justice area, and whether those benefits are equitably distributed within such community, including the ability of the project to—</text> <subclause commented="no" display-inline="no-display-inline" id="idd80c4e991e3f48b681ac8670328d694b"><enum>(I)</enum><text>effect reductions in hazardous air pollutants;</text></subclause>
<subclause commented="no" id="idb31b971d143b4395b1eda0f3c2fdf32b"><enum>(II)</enum><text>improve water quality, access, and affordability;</text></subclause> <subclause commented="no" id="id850e4dd063724a08847a3be28a54f82a"><enum>(III)</enum><text>increase access to green space and outdoor recreation; or</text></subclause>
<subclause commented="no" id="iddd0fde67e8a3448080c22a332180c5e9"><enum>(IV)</enum><text>expand access to and affordability of healthy food; and</text></subclause></clause> <clause commented="no" id="id2f0f7d38ec4746519edaffcf004f76d6"><enum>(ii)</enum><text>whether the proposed host entity can demonstrate there was a meaningful public involvement process in the development of the proposed Corps project.</text></clause></subparagraph></paragraph></subsection>
<subsection id="id9159A69B94F240BBA14B985A2061FB8B"><enum>(g)</enum><header>Applications</header>
<paragraph id="id574E016744784827843893715A8C046B"><enum>(1)</enum><header>In general</header><text>In order for an entity described in subsection (f) to be eligible to receive a grant under subsection (e) for a Corps project, an entity shall submit an application to the Corporation at such time, in such manner, and containing such information as the Corporation may require, including—</text> <subparagraph id="id4717F160FC3B4A0799A6F9A78D5DFD8D"><enum>(A)</enum><text>information describing the Corps project to be carried out at the entity's eligible worksite;</text></subparagraph>
<subparagraph commented="no" id="idE4DC158DBE294B988B21A56DF2E91153"><enum>(B)</enum>
<clause commented="no" display-inline="yes-display-inline" id="id7B624751952440E986101CC013C935ED"><enum>(i)</enum><text>information describing any contracts or agreements, with the State in which the entity is located or Indian tribe with which the entity is associated, that will be necessary to enter into under paragraph (3), in conjunction with the project; and</text></clause> <clause commented="no" id="idAE88C508F7194035A4087D7C9BF29B06" indent="up1"><enum>(ii)</enum><text>an assurance that the entity will carry out the project in cooperation with agencies who receive such a contract or agreement;</text></clause></subparagraph>
<subparagraph id="idB248BDA3F48B4D0A9683156E07D24FD8"><enum>(C)</enum><text>whether such entity is seeking a waiver under subsection (e)(2)(B) of the cost sharing requirement under section 212 of the Public Land Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1729">16 U.S.C. 1729</external-xref>);</text></subparagraph> <subparagraph id="id23524985473C4AE09161FC893E0D995A"><enum>(D)</enum><text>certification by the relevant State coordinating agency that the State coordinating agency—</text>
<clause id="id3FEAF4F8226B44DBA67A4526EB186190"><enum>(i)</enum><text>will provide services through agencies, and other functions described in paragraph (3)(A), in accordance with a contract or agreement entered into under paragraph (3); and</text></clause> <clause id="id1E53D723325A4A38881DF3C8339082E7"><enum>(ii)</enum><text>will facilitate coordination between eligible host entities in the State for purpose of prioritizing participants as described in subsection (h)(4); </text></clause></subparagraph>
<subparagraph id="id5CD63A81FC07404C9243F136C48DE08D"><enum>(E)</enum><text>certification by the relevant State Commission that the State Commission has established an Environmental Equity Resource Center under subsection (j); and </text></subparagraph> <subparagraph id="id47276469205C40E39A96246151806F90"><enum>(F)</enum><text>as relevant, certification by the State or Tribal agency to provide the access and resources, described in paragraph (3)(B). </text></subparagraph></paragraph>
<paragraph id="id6D1060B6C6844893A0C96803D8465D87"><enum>(2)</enum><header>Geographic distribution of grants</header><text>The Corporation shall distribute grants in a geographically balanced manner across the country and regions of the country.</text></paragraph> <paragraph id="id48466FB1F1DC42199373574EC6796921"><enum>(3)</enum><header>Contracts and arrangements with States or Indian tribes</header> <subparagraph id="id662EAE6FAD9C4DB6884E8E147DF82A8C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">On the approval of an application for an eligible host entity, the eligible host entity shall enter into such contracts or agreements with the State coordinating agency as may be necessary to carry out this section, including to arrange for the provision of services through State or Tribal agencies (which may be through providing access and resources under subparagraph (B)).</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id6DFE3B77B6FF4A45B5E3D8E34B496BF1"><enum>(B)</enum><header>Farmer eligible host entity</header><text display-inline="yes-display-inline">On the approval of an application for an eligible host entity that is an individual farmer in a State or associated with an Indian tribe, the Corporation shall notify the State or Tribal agency with jurisdiction over agriculture, which shall provide access to and resources for training and apprenticeships, including from organizations and farmer groups in the State or associated with the Indian tribe, to support and provide coordination between such farmer host entities in the State or associated with an Indian tribe.</text></subparagraph></paragraph></subsection> <subsection id="id1B592B51D223470E80D8AB65668C698B"><enum>(h)</enum><header>Eligible Corps members</header> <paragraph id="idCE3DE48FA0F047229AD3D09CA6209E36"><enum>(1)</enum><header>Eligibility</header> <subparagraph id="id3445CCEF08EC4845AE5A39D270198658"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">To be eligible to participate in and hold a service position in the Corps, an individual shall be an unemployed or underemployed individual.</text></subparagraph>
<subparagraph id="id7920AAA4C4704EC2B65477B85B677999"><enum>(B)</enum><header>Eligibility for subprograms</header><text display-inline="yes-display-inline">Within the program, there shall be specific subprograms for—</text> <clause id="id7907480D5E1742D1AE5C7F04C256112A"><enum>(i)</enum><text display-inline="yes-display-inline">recent graduates, as described in paragraph (2); and</text></clause>
<clause id="idB79D6D920EDF4442B334AFC3765A5490"><enum>(ii)</enum><text display-inline="yes-display-inline">returning citizens, as described in paragraph (3). </text></clause></subparagraph></paragraph> <paragraph id="id60699278228A45AEB3D7452469666DAB"><enum>(2)</enum><header>Recent graduates</header> <subparagraph id="id5851C485A9CD4ECD82F8C6FE113CA921"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The program shall have subprograms targeted to support, through service positions and training (including technical instruction) and education related to the service positions in the program—</text>
<clause commented="no" id="id9ad50b0c8a614ec7bc53f5edf2ac0150"><enum>(i)</enum><text>individuals who have—</text> <subclause commented="no" id="id127DFEE9E2A34823A8E226E35FBE8A21"><enum>(I)</enum><text>graduated from an institution of higher education within the 4 months prior to beginning a term of service in the program; and </text></subclause>
<subclause commented="no" id="id2A5ED6F55D1E4A8B9EF3DBAACC0D9AAE"><enum>(II)</enum><text>have been unemployed or underemployed during that time; and</text></subclause></clause> <clause commented="no" id="id64DAEE27369E43F699C2999BA87DD512"><enum>(ii)</enum><text>individuals who have—</text>
<subclause commented="no" id="id79E84EEE53B84970BB65315D0C3225CB"><enum>(I)</enum><text>graduated high school within the 4 months prior to beginning a term of service in the program; and </text></subclause> <subclause commented="no" id="idEDFE45EDD8CD4E398B7B65B2310031C4"><enum>(II)</enum><text>have been unemployed or underemployed during that time.</text></subclause></clause></subparagraph></paragraph>
<paragraph id="idE02E23C65C17467FA0B59AFB66D54EFD"><enum>(3)</enum><header>Returning citizens (including justice-involved youth)</header>
<subparagraph id="idD74C0FC7E4C143B7B3B466EDF65775E2"><enum>(A)</enum><header>Returning citizen</header><text>The term <term>returning citizen</term> means a citizen who, within the 2 years prior to beginning a term of service in the program, returned from incarceration in a correctional institution or was subject to the juvenile or adult justice system. </text></subparagraph> <subparagraph id="idD85879FD13B743D19A73872544CFD874"><enum>(B)</enum><header>Subprogram</header><text display-inline="yes-display-inline">The program shall include an earn-while-you-learn career pathway subprogram for returning citizens (including justice-involved youth) to provide an accessible pathway into long-term careers in the conservation workforce. </text></subparagraph>
<subparagraph id="idF0751313B4D54A72AFB8555277592750"><enum>(C)</enum><header>Workforce preparation</header><text display-inline="yes-display-inline">The eligible host entity shall ensure that the subprogram described in subparagraph (B) includes—</text> <clause id="idC77AEA452B8F4A8CBFDFA48661C62FEE"><enum>(i)</enum><text display-inline="yes-display-inline">on-the-job-training and mentoring from expert practitioners in conservation;</text></clause>
<clause id="id37EF350293D24FF2BDBC325BE5D0325B"><enum>(ii)</enum><text display-inline="yes-display-inline">continuing education courses; and</text></clause> <clause id="id2FC14FA0A33345D89F559A89616518CD"><enum>(iii)</enum><text display-inline="yes-display-inline">credit towards a postsecondary degree or certificate granted by an institution of higher education.</text></clause></subparagraph></paragraph>
<paragraph id="id9D2D66DD57C241F3AE1F2473705CE374"><enum>(4)</enum><header>Underserved participants</header><text display-inline="yes-display-inline">Each eligible host entity that receives a grant under subsection (e) shall, through coordination with other eligible host entities in the State of such eligible host entity facilitated by the State coordinating agency—</text> <subparagraph id="id4E7B6CBE90EB4E9BAC1D42B8CE397EC7"><enum>(A)</enum><text display-inline="yes-display-inline">prioritize participants from underserved communities, including participants—</text>
<clause id="id12421ABB4E784961919A73734CC42227"><enum>(i)</enum><text display-inline="yes-display-inline">from communities of racial and ethnic minorities;</text></clause> <clause id="id409F1D8A9E1E4453AB4EF561D97AB7DD"><enum>(ii)</enum><text display-inline="yes-display-inline">from low-income communities; </text></clause>
<clause id="id6770418AF3E7443D8C808BC9D0B565B9"><enum>(iii)</enum><text display-inline="yes-display-inline">from Tribal and indigenous communities; and</text></clause> <clause id="id8949AF2EFFE545B48701E76741423627"><enum>(iv)</enum><text>who are individuals with disabilities; and</text></clause></subparagraph>
<subparagraph id="id674C011431BF4C39BE2FC9785273E79B"><enum>(B)</enum><text>prioritize participants residing in an environmental justice area (identified under subsection (j)) near a proposed worksite.</text></subparagraph></paragraph> <paragraph id="id22AF5B557D954019A50FB5328C5E38EC"><enum>(5)</enum><header>Service positions</header> <subparagraph id="id61E4F2857D6949ABB9FED20BBCDB3AA1"><enum>(A)</enum><header>Project objectives and service positions</header> <clause id="id26C22885B5974D28B49F1B00EDC93999"><enum>(i)</enum><header>Locally established objectives and service positions</header><text display-inline="yes-display-inline">Each eligible host entity that receives a grant under this section shall establish project objectives, position-specific criteria, and service position descriptions for a Corps project, in order to ensure that the project is locally led and addresses specific local needs.</text></clause>
<clause id="id76B77C7E511E4601AD956D6153AC9B54"><enum>(ii)</enum><header>Templates and materials</header><text>The Corporation shall provide project templates and materials to support the establishment of the objectives, criteria, and descriptions.</text></clause></subparagraph> <subparagraph id="id11B356F890304EF5BDA3040252A7E117"><enum>(B)</enum><header>Service position application process</header> <clause id="id7C40024121D244C38052D5DFAC336FCF"><enum>(i)</enum><header>Materials</header><text display-inline="yes-display-inline">The eligible host entity shall make the project objectives, position-specific criteria, and service position descriptions available to individuals seeking to apply for service positions in the Corps project at the entity's worksite. </text></clause>
<clause id="id2C34CCBE3ADE44B189305F4546B76552"><enum>(ii)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to obtain a service position at the worksite, an individual shall submit an application to the eligible host entity and obtain approval of the application. An individual with an approved application shall be considered to be a Corps member for purposes of this section.</text></clause></subparagraph> <subparagraph commented="no" id="idccfdaa3f574f45c18f322f55600d6c59"><enum>(C)</enum><header>Apprenticeships as service positions</header><text>Service positions under this section may include—</text>
<clause commented="no" id="idbdd9c927f67f47a8af297bea70075f45"><enum>(i)</enum><text>an apprenticeship registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>); and</text></clause> <clause commented="no" id="id5d688731c9774402956ec0a9d4be5fd1"><enum>(ii)</enum><text>a preapprenticeship designed to lead to an apprenticeship described in clause (i).</text></clause></subparagraph></paragraph></subsection>
<subsection id="idA187610786934C60A0C5D4C394861185"><enum>(i)</enum><header>Use of funds</header>
<paragraph id="idFAFF5D420A4D40E9AFF03A1C33A31DCC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible host entity that receives a grant under subsection (e) shall use the grant funds to provide, for each Corps member at the worksite—</text> <subparagraph id="id61808D0A216148E4B7392233D9CE9DFB"><enum>(A)</enum><text display-inline="yes-display-inline">a service position in which the Corps member will carry out a service activity described in paragraph (2), an allowance under paragraph (4) for such service, and (on approval of an application) an apprenticeship award under paragraph (5) at the successful completion of that service; and</text></subparagraph>
<subparagraph id="id0B13C20E6C9C43C8AB8F25C5AABAAD06"><enum>(B)</enum><text display-inline="yes-display-inline">training (including technical instruction) and education related to the service position and described in paragraph (3)(A), an allowance under paragraph (4) for such training, technical instruction, and education, and connections and educational opportunities described in paragraph (3)(B). </text></subparagraph></paragraph> <paragraph id="id015A2F2EE2AE47739D01137637E53AB3"><enum>(2)</enum><header>Service activities</header> <subparagraph id="id714004DB3D0E4304BA71E2E25091DDB9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The service activities referred to in paragraph (1)(A) shall include—</text>
<clause id="id458582FED8454A0B97C786D43744FE54"><enum>(i)</enum><text display-inline="yes-display-inline">for service positions with respect to preserving or restoring public land (whether Federal, State, Tribal, or local)— </text> <subclause id="idfd6ae7847dc34473a880cc8083fe2658"><enum>(I)</enum><text>restoration of forest ecosystems, and reforestation or tree planting;</text></subclause>
<subclause id="idAA8CA3229ABC471A878E21A4E0E0B758"><enum>(II)</enum><text>hazardous fuel treatments for the purpose of mitigating the risk of, or suppressing, wildfires in the western United States;</text></subclause> <subclause id="idCB2BA4D58EE54BF997EBED52F3077848"><enum>(III)</enum><text>management of terrestrial and aquatic invasive species;</text></subclause>
<subclause id="id2c275b2ff5ca4a70b60662d683526d0c"><enum>(IV)</enum><text>watershed restoration and wetlands management;</text></subclause> <subclause id="ideb8d53ea598b42388460325eb95594e4"><enum>(V)</enum><text>coastal and inland ecosystem restoration;</text></subclause>
<subclause id="idf32a81f9da6344d1be34bfdc6f284875"><enum>(VI)</enum><text>prescribed burning;</text></subclause> <subclause id="id7a8cb366c5b14a958d09bc708ebe3174"><enum>(VII)</enum><text>park and infrastructure maintenance;</text></subclause>
<subclause id="idf3522acb04fc4ce78b4a860a38f1d28e"><enum>(VIII)</enum><text>facility expansion;</text></subclause> <subclause id="id010fe03a96044741bf3f4850cd797ee3"><enum>(IX)</enum><text>recreation and trail work;</text></subclause>
<subclause id="id99290ad0e6d949fba34d44d0d670f595"><enum>(X)</enum><text>public outreach and education;</text></subclause> <subclause id="idd5c28b1263a644ae83960ce47103966f"><enum>(XI)</enum><text>pollinator habitat establishment and management;</text></subclause>
<subclause id="idC91D3CF2FA9A40F2B58286E25E1D848A"><enum>(XII)</enum><text>accessibility improvement;</text></subclause> <subclause id="id61718bd1d9e742b2827e6c1b2ba311c3"><enum>(XIII)</enum><text>flood hazard mitigation;</text></subclause>
<subclause id="id39f48781b21c4a5880c777a5aeb9b475"><enum>(XIV)</enum><text>road reconstruction and maintenance;</text></subclause> <subclause id="idbe9488d9ea5845b8a0b95a4bd4d08022"><enum>(XV)</enum><text>maintenance or restoration of the native habitats of species listed as endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) and other habitat restoration; and</text></subclause>
<subclause id="id291c5571962f4e8a8d145980a6795004"><enum>(XVI)</enum><text>provision of wildlife crossing programs;</text></subclause></clause> <clause id="idac3c7dc7bf8041a99be6747616f0867d"><enum>(ii)</enum><text>for service positions with respect to agriculture—</text>
<subclause id="id3f05b2d277d64112a89f3e715cb7ce9d"><enum>(I)</enum><text>riparian buffer establishment and maintenance;</text></subclause> <subclause id="id272247137c084d878a0bdb42f8354b9f"><enum>(II)</enum><text>grazing management;</text></subclause>
<subclause id="idd7bbc3871d084306b3ee42febb5cfe11"><enum>(III)</enum><text>pollinator habitat establishment and management;</text></subclause> <subclause id="id6e1b45bddbd84876b1fe7a2dedb95b92"><enum>(IV)</enum><text>integrated pest management;</text></subclause>
<subclause id="id31af2b77f92f4c53a47c9c2c7574a653"><enum>(V)</enum><text>prescribed burning;</text></subclause> <subclause id="id4d2e08f9fb7949ac8abd41ad14492d13"><enum>(VI)</enum><text>prairie strip establishment;</text></subclause>
<subclause id="idAFCE52995288402C9589D57B5E07CA28"><enum>(VII)</enum><text>grassland restoration;</text></subclause> <subclause id="id83ca5a8afe094733a1136e4de368ce71"><enum>(VIII)</enum><text>soil health management;</text></subclause>
<subclause id="id478D4171CB784DD79E41B95132C02805"><enum>(IX)</enum><text>silvopasture;</text></subclause> <subclause id="idbcddc9011cf4475daa6beadf46e7ba89"><enum>(X)</enum><text>on-farm infrastructure development, construction, or repair, that results in environmental benefits; and</text></subclause>
<subclause id="id658E019AA84D4E248CDB85FAE7B32797"><enum>(XI)</enum><text>other agricultural practices with significant environmental benefits; </text></subclause></clause> <clause id="ide8ffb4b6760544f4bc95935373be1ab1"><enum>(iii)</enum><text>for service positions with respect to restoration and remediation of natural resources—</text>
<subclause id="id6335825f2728423cb4afa6d9b15e5572"><enum>(I)</enum><text>abandoned mine land reclamation;</text></subclause> <subclause id="id0a71345e21df498a93ac348bedc19ca9"><enum>(II)</enum><text>land and water quality restoration; </text></subclause>
<subclause id="id323d8fc3888b4e89818ef5f4a1700d00"><enum>(III)</enum><text>tree planting and carrying out other low-tech treatments; and</text></subclause> <subclause id="id85F727476F154194B796C22DCEC285A2"><enum>(IV)</enum><text>plugging orphan oil and gas wells;</text></subclause></clause>
<clause id="id89f793aa3c5846d398e5a19d817a11af"><enum>(iv)</enum><text>for service positions with respect to urban and rural community resilience and sustainability—</text> <subclause id="id9cd65cec05c74db68b432749ad76c0e9"><enum>(I)</enum><text>community greening;</text></subclause>
<subclause id="ide3d6481f52e3406fa2caf82d72cfd429"><enum>(II)</enum><text>promoting urban agriculture;</text></subclause> <subclause id="id4146dd79fe1e45e9857694234a3fff11"><enum>(III)</enum><text>promoting community gardens;</text></subclause>
<subclause id="id67f34829aaf34e85b19ac334a67ca889"><enum>(IV)</enum><text>local food economy development;</text></subclause> <subclause id="id5d57383c50a94f59b1fc42d8dee17bd5"><enum>(V)</enum><text>heat island mitigation;</text></subclause>
<subclause id="id02af3673cf094a899640a8e8605dcb62"><enum>(VI)</enum><text>establishing and maintaining pedestrian pathways;</text></subclause> <subclause id="idec34b3eac97740f3bdda5c08273fa107"><enum>(VII)</enum><text>establishing and maintaining greenways and trails;</text></subclause>
<subclause id="id2175a72c970e444cb706ff74330936e2"><enum>(VIII)</enum><text>hazard mitigation;</text></subclause> <subclause id="idbaaf1170fb704cc69d50e54d5f4cf15f"><enum>(IX)</enum><text>water resources development;</text></subclause>
<subclause id="idaa30fe319611466fa4f17847917adb7c"><enum>(X)</enum><text>establishing and maintaining community solar projects; and</text></subclause> <subclause id="iddd2ec86ce21f4b54a3976b2e7a31b607"><enum>(XI)</enum><text>promoting energy efficiency through retrofitting; and</text></subclause></clause>
<clause id="idbd880ae29f6042e1a2d3628b1871745d"><enum>(v)</enum><text>for service positions with respect to administration and monitoring—</text> <subclause id="idd0d20e73eb7541a79bc1e25f1e64b060"><enum>(I)</enum><text>administrative activities to support the work at local conservation districts;</text></subclause>
<subclause id="id2ab51b121d914825b35300e4a50f0e34"><enum>(II)</enum><text>project coordination and management;</text></subclause> <subclause id="id3054fa1799bc48b2acdb87a79e2dd456"><enum>(III)</enum><text>water quality monitoring;</text></subclause>
<subclause id="id9bc42ef5463d421d85a8b99525a36a93"><enum>(IV)</enum><text>support of State or Tribal agencies; </text></subclause> <subclause id="idb965c28cfc92402c8b1ea51715f4b2b1"><enum>(V)</enum><text>support of land trusts and conservancies; </text></subclause>
<subclause id="idb8ef536198e342ceb725d85d4352006e"><enum>(VI)</enum><text>support of local park and recreation offices;</text></subclause> <subclause id="idA1F29C0DE338478490528535A9E95C43"><enum>(VII)</enum><text>support of community and environmental justice organizations; and</text></subclause>
<subclause id="id7cf997fc5d6a42b2a6979a158b24842f"><enum>(VIII)</enum><text>volunteer coordination.</text></subclause></clause></subparagraph> <subparagraph id="idE2EA640CB21D46E29DEDF1CBB8BCF84E"><enum>(B)</enum><header>Funding for agricultural conservation practices</header> <clause id="id95266EE228EB44C4AB2A0FC250046285"><enum>(i)</enum><header>In general</header><text>An eligible host entity that receives a grant under subsection (e) may use the funds to support the implementation of an agricultural conservation practice for which funding is provided through a program of the Department of Agriculture and that is carried out at the applicable worksite if the sum of the amount of funding received through that program and the amount of the grant under subsection (e) is not greater than the total cost of materials, labor, and income forgone from conservation practice adoption associated with the implementation of that practice.</text></clause>
<clause id="id75A20EFF62824976AD17119A127662BE"><enum>(ii)</enum><header>Priority</header><text>In providing grants under subsection (e) for projects that support the implementation of agricultural conservation practices described in clause (i), the Corporation shall give priority to projects carried out on farming operations managed by beginning farmers or ranchers or socially disadvantaged farmers or ranchers. </text></clause> <clause id="id34EA3CB325AF46C1988389B930F663CD"><enum>(iii)</enum><header>Specialized crews</header><text>A State, local, or Tribal agency may host a specialized conservation crew to support the implementation of agricultural conservation practices described in clause (i), including fencing, tree planting buffer installation, or other practices approved by the Natural Resources Conservation Service of the Department of Agriculture across multiple farming operations in a region.</text></clause></subparagraph>
<subparagraph id="id85B0FE66DDE9407CB9EAC542FAAD4965"><enum>(C)</enum><header>Nutrient reduction and agricultural conservation practices</header><text>Service activities described in subparagraph (A) relating to agriculture or forestry that are carried out using funds from a grant under subsection (e) may be used to support Federal, State, Tribal, and local efforts to achieve nutrient reduction in impaired waterways.</text></subparagraph></paragraph> <paragraph id="id8862402e31c640269343313c02514e57"><enum>(3)</enum><header>Training and education</header> <subparagraph id="idB2AF0893629346C2B558524F32759AE3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The eligible host entity shall arrange for the provision of training (including technical instruction and development of skills such as time management, conflict resolution, goal development, and resume writing) and education opportunities, including workforce investment activities as defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>), that are related to the service position, for each participant at the worksite and specific to the specific training needs of each participant. If the entity provides on-site training (including technical instruction or skills development) or education, the entity shall provide training (including technical instruction or skills development) or education, respectively, that utilizes the skills and expertise of experienced conservationists and professionals, including training (including technical instruction or skills development) or education by— </text>
<clause id="id7EE784FFF8E9496AB0AF4DBC445273E6"><enum>(i)</enum><text display-inline="yes-display-inline">established farmers; </text></clause> <clause id="id89DA6FA9D2C64379BE61CB2F33639ADF"><enum>(ii)</enum> <subclause commented="no" display-inline="yes-display-inline" id="id4BBE8D13FC544A4F8A51B9A8BF533688"><enum>(I)</enum><text>institutions of higher education;</text></subclause>
<subclause id="id8C059A6F292B4AD3A1BEAE6F7E2287B1" indent="up1"><enum>(II)</enum><text>the State system of higher education;</text></subclause> <subclause indent="up1" id="idBB335F66168B46C097990306CE416207"><enum>(III)</enum><text>land-grant colleges and universities (as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>));</text></subclause>
<subclause indent="up1" id="id83E43220A9B741EC94ACCCAB863C8E58"><enum>(IV)</enum><text>community colleges;</text></subclause> <subclause indent="up1" id="idEF5C0A15887749B59C9BC758B459F2C1"><enum>(V)</enum><text>Historically Black Colleges and Universities (as defined by the term <quote>part B institution</quote> under section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>));</text></subclause>
<subclause indent="up1" id="idCF89F67CAE14416390E26538EA40DED1"><enum>(VI)</enum><text>Hispanic-serving institutions (as defined in section 502(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a(a)</external-xref>));</text></subclause> <subclause indent="up1" id="idDE94A263173046E19B7E70A162DA4378"><enum>(VII)</enum><text>Tribal Colleges or Universities (as defined in section 316(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>));</text></subclause>
<subclause indent="up1" id="idB6E6C207FB474725AB7F47C8F58AD024"><enum>(VIII)</enum><text>Asian American and Native American Pacific Islander-serving institutions (as defined in section 320(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059g">20 U.S.C. 1059g(b)</external-xref>); and</text></subclause> <subclause indent="up1" id="id7B296B9E93694F09A5652A8808A7CE63"><enum>(IX)</enum><text>area career and technical education schools, as defined in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>);</text></subclause></clause>
<clause id="idF0B536B8B9914A66862C2C1E19C7BF9E"><enum>(iii)</enum><text display-inline="yes-display-inline">offices of the Cooperative Extension System;</text></clause> <clause id="idFCC7FF490EF240A18C3BBA4203A97666"><enum>(iv)</enum><text display-inline="yes-display-inline">State and Tribal agencies with jurisdiction over agriculture or natural resources; or</text></clause>
<clause id="id7F5B750C79ED45DBBD197524FB1A8F1B"><enum>(v)</enum><text>nonprofit organizations with conservation expertise and training capacity.</text></clause></subparagraph> <subparagraph id="id28FDE073512047E1AB226ED049D9A55B"><enum>(B)</enum><header>Post-participation opportunities</header><text display-inline="yes-display-inline">The eligible host entity shall ensure that each participant at the worksite receiving training (including technical instruction) and education is—</text>
<clause id="id022A1A17E9C24706B2B40DB4D1C5515D"><enum>(i)</enum><text display-inline="yes-display-inline">connected to labor organizations, nonprofit organizations, State and Tribal agencies, and small businesses, for future job opportunities following the term of service of the participant; and </text></clause> <clause id="id26EA20FCFAB34C8D8E9A0CDC377996B8"><enum>(ii)</enum><text display-inline="yes-display-inline">provided with further educational opportunities throughout the term of service of the participant, and after the term of service of the participant has concluded. </text></clause></subparagraph>
<subparagraph id="id9cae1ea524764879850fa8070c609fa9"><enum>(C)</enum><header>Corps member employment standard</header><text>A participant shall be considered to be a participant (as defined in section 101 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12511">42 U.S.C. 12511</external-xref>)) of the eligible host entity for which the participant serves. </text></subparagraph></paragraph> <paragraph id="idFB7E06B54582465099B5AF3A34F09220"><enum>(4)</enum><header>Corps member allowance and benefits</header> <subparagraph id="id751513562A3E42F2AAEB59F03FE30CB0"><enum>(A)</enum><header>Allowance</header><text display-inline="yes-display-inline">The eligible host entity shall provide to a participant, as an allowance, $15 for each hour of service in a service position and $15 for each hour of training (including technical instruction) and education under paragraph (3)(A).</text></subparagraph>
<subparagraph id="idBBB1313EC7C54EA0A4894AC2AF06083A"><enum>(B)</enum><header>Health insurance</header>
<clause id="id9340E450213B484EA9A4EE6A162173DA"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The eligible host entity shall provide or make available a basic health care policy for each full-time participant in a service position, if the participant is not otherwise covered by a health care policy. The Corporation shall establish minimum standards that all plans must meet in order to qualify for payment under this section, any circumstances in which an alternative health care policy may be substituted for the basic health care policy, and mechanisms to prohibit participants from dropping existing coverage. </text></clause> <clause id="id892FC5806D3D4D5BAE5176ADAA43D5A9"><enum>(ii)</enum><header>Option</header><text display-inline="yes-display-inline">The eligible host entity may elect to provide from its own funds or make available a health care policy for participants that does not meet all of the standards established by the Corporation if the fair market value of such policy is equal to or greater than the fair market value of a plan that meets the minimum standards established by the Corporation, and is consistent with other applicable laws.</text></clause></subparagraph>
<subparagraph id="id4ee831c986544cb882a3e350a87aa364"><enum>(C)</enum><header>Other benefits</header><text>An eligible host entity may provide to a participant funds to be used for transportation, child care, mental health services, and other support for such participants. <italic></italic></text></subparagraph></paragraph> <paragraph id="id9DDCC4F5CE7145588E3B3BFB441B78BD"><enum>(5)</enum><header>Apprenticeship award</header> <subparagraph id="id874FE2AC610040C49E580D5F28F70D0B"><enum>(A)</enum><header>Definition</header><text>In this paragraph, the term <quote>apprenticeship</quote> means—</text>
<clause id="idBF3957A599BE4C89ABCED165C0D0CD49"><enum>(i)</enum><text>an apprenticeship registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>); and</text></clause> <clause id="id76912A5D337541F39AAF759E667583AF"><enum>(ii)</enum><text>a preapprenticeship designed to lead to an apprenticeship described in clause (i).</text></clause></subparagraph>
<subparagraph id="id4960C6A799B240EDABE9C77D93D4450E"><enum>(B)</enum><header>Notification</header><text>Not later than 30 days after a participant completes a term of service in a service position under this subsection, the corresponding eligible host entity shall inform the Corporation. On determining that a participant has completed that term of service, the Corporation shall notify the participant of the determination, and the opportunity to apply for an apprenticeship award under this paragraph. </text></subparagraph> <subparagraph id="id28E5CDAB1E4A441C8085A0628944C9C4"><enum>(C)</enum><header>Application</header><text>Not later than 12 months after receiving that notification, a participant that seeks an apprenticeship award under this paragraph shall submit an application to the Corporation at such time, in such manner, and containing such information as the Corporation may require, including—</text>
<clause id="idD5166FCA571E44E7ACD26F4776A92904"><enum>(i)</enum><text>information demonstrating the goods or services to be acquired for the apprenticeship, and their cost; and</text></clause> <clause id="idF8AA4FE6113C43D4A9D2624CAC988815"><enum>(ii)</enum><text>information establishing that the goods or services are described in section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>).</text></clause></subparagraph>
<subparagraph id="idA118890821D04AAEBA51C508778CB180"><enum>(D)</enum><header>Award</header><text>On approving an application under subparagraph (C), the Corporation shall make an award, in an apprenticeship amount supported by the application but not more than $5,000, for the participant. The Corporation shall make the award to the participant.</text></subparagraph></paragraph> <paragraph id="id7F3EA3C6188148F1807844892B4A72C7"><enum>(6)</enum><header>Conservation technical assistance</header><text display-inline="yes-display-inline">Of the funds appropriated under subsection (l), the Corporation shall set aside 1 percent which shall be used for conservation technical assistance (as defined in section 10 of the Soil Conservation and Domestic Allotment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/590j">16 U.S.C. 590j</external-xref>)) to support the implementation of a Corps project on private land, and when relevant, adjacent public land related to the project.</text></paragraph>
<paragraph id="idCD0F254A7AF143698CAB3E5B2C191AF3" commented="no"><enum>(7)</enum><header>Administration</header><text display-inline="yes-display-inline">Not more than 10 percent of a grant awarded under this section may be used for costs of administration, including hiring and paying staff, purchasing and leasing vehicles, acquiring equipment, and carrying out other related activities to support the work of participants.</text></paragraph></subsection> <subsection id="id232D3F85142D481F896DBBB8B62FB222"><enum>(j)</enum><header>Environmental justice</header> <paragraph commented="no" display-inline="no-display-inline" id="id86429897FD2C4AD2BAFCFFA67A5373B6"><enum>(1)</enum><header>Environmental Equity Resource Center</header><text>A State Commission that wishes to allow eligible host entities in the State, or associated with a related Indian tribe, to receive grants under subsection (c) shall establish an Environmental Equity Resource Center for purposes of—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idE7D117027B824378BAC88EDE696BBE27"><enum>(A)</enum><text>screening for and identifying for purposes of this section environmental justice areas as described in paragraph (3);</text></subparagraph> <subparagraph display-inline="no-display-inline" commented="no" id="id010A2C72ADCB42A1828482A26101A975"><enum>(B)</enum><text>establishing a board as described in paragraph (2); and</text></subparagraph>
<subparagraph display-inline="no-display-inline" commented="no" id="idE9BA4CA47EEB4BF1AADBC79E40DF336C"><enum>(C)</enum><text>providing technical assistance for eligible host entities with worksites in environmental justice areas (as identified under this subsection), including by conducting outreach, providing coordination, building capacity, and supporting implementation of projects at such worksites. </text></subparagraph></paragraph> <paragraph display-inline="no-display-inline" commented="no" id="id41F4F7B178324EC6A84DC2A5E01630BB"><enum>(2)</enum><header>Community advisory board</header> <subparagraph display-inline="no-display-inline" commented="no" id="idE53AEB3AA188432A8FE28E85831A90D1"><enum>(A)</enum><header>In general</header><text>An Environmental Equity Resource Center established under paragraph (1) shall establish a community advisory board for an area in which a Corps project is occurring composed of representatives of—</text>
<clause display-inline="no-display-inline" commented="no" id="id29BCCEABC9C84E68AD8D6A72D8393E42"><enum>(i)</enum><text>relevant local public health organizations; </text></clause> <clause display-inline="no-display-inline" commented="no" id="id827989129B1F4660964E45A09BF4AC91"><enum>(ii)</enum><text>relevant local workforce development boards (defined individually as a local board in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)) within the State of the Environmental Equity Resource Center and the State workforce development board (defined individually as a State board in such section) of such State;</text></clause>
<clause display-inline="no-display-inline" commented="no" id="id9531379FC46B49A8B2794CC4D2089B19"><enum>(iii)</enum><text>relevant environmental and environmental justice organizations; </text></clause> <clause display-inline="no-display-inline" commented="no" id="idC064FDF9576841BF9688DF95A8F476F9"><enum>(iv)</enum><text>relevant labor organizations; </text></clause>
<clause display-inline="no-display-inline" commented="no" id="idCC5A2B5B82AB4B0183A5133752A29E24"><enum>(v)</enum><text>relevant Indian tribes;</text></clause> <clause display-inline="no-display-inline" commented="no" id="idA9A6BF735B1340F7B48E85FD43722BAE"><enum>(vi)</enum><text>community members in an area in which a Corps project is occurring; and</text></clause>
<clause display-inline="no-display-inline" commented="no" id="id68D92F23A47F4A1CA4FFB907A94EF92F"><enum>(vii)</enum><text>other organizations or individuals as determined relevant by the Environmental Equity Resource Center.</text></clause></subparagraph> <subparagraph display-inline="no-display-inline" commented="no" id="id8ED89567DC6F44D09F5FFA2659920EA9"><enum>(B)</enum><header>Duties</header><text>The community advisory board established under this paragraph shall—</text>
<clause id="id5cc83debd8764e57a6f03f4218a76444"><enum>(i)</enum><text>ensure community engagement, transparency, and accountability in carrying out each stage of a project receiving funds under this section; and</text></clause> <clause id="idc9867e2f919f4b72959f1ab08cadd7f8"><enum>(ii)</enum><text>track, evaluate, and report progress on clear and meaningful indicators related to the benefits of the project as described in subsection (f)(3)(B)(i) and other relevant factors.</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id9C6E0C73682C466BA66842C682FB8BC6"><enum>(3)</enum><header>Identification of environmental justice areas</header>
<subparagraph commented="no" display-inline="no-display-inline" id="id161B8C5453EB40858FF286722E969815"><enum>(A)</enum><header>In general</header><text>For purposes of this section, the Environmental Equity Resource Center established by the State Commission under paragraph (1) shall, in accordance with subparagraph (B) or (C), identify environmental justice areas.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id5FB22E11C1494805AD017F8D938A97A4"><enum>(B)</enum><header>Identification in States with environmental justice standards</header><text>For States with environmental justice standards under State law, the Environmental Equity Resource Center in such State shall identify environmental justice areas based on the State standards and the totality of the factors listed in subparagraph (C) (with the factor in each clause weighing in favor of the area being an environmental justice area).</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id6ACB9A553D57402A9D7AA0CB1AF32FB8"><enum>(C)</enum><header>Identification in States without environmental justice standards</header><text>For States without environmental justice standards under State law, the Environmental Equity Resource Center in such State shall identify environmental justice areas based on the totality of the following factors (with the factor in each clause weighing in favor of the area being an environmental justice area): </text> <clause commented="no" display-inline="no-display-inline" id="id8C45B868984648A0BA1F6E46B51E3D11"><enum>(i)</enum><text>An area in the State that has a predominately minority, low-income, or Tribal or indigenous population. </text></clause>
<clause display-inline="no-display-inline" commented="no" id="id2090B6817ADE498FB3FF7D2E6FC8E0DF"><enum>(ii)</enum><text>An area in the State that has a disproportionate exposure to an environmental hazard or the cumulative effect of environmental hazards, including hazards in the EJSCREEN environmental indicators (or any corresponding similar indicators) developed by the Environmental Protection Agency.</text></clause> <clause display-inline="no-display-inline" commented="no" id="id1D4179E2169048058C9401EC12E01E6E"><enum>(iii)</enum><text>An area in the State that has disproportionate vulnerability to an environmental hazard or the cumulative effect of environmental hazards, including an area that meets EJSCREEN demographic indicators (or any corresponding similar indicators) developed by the Environmental Protection Agency.</text></clause>
<clause commented="no" display-inline="no-display-inline" id="idA1275C2FEBF64B1BA869D955B67BF742"><enum>(iv)</enum><text>An area in the State with high rates of asthma prevalence and incidence.</text></clause> <clause display-inline="no-display-inline" commented="no" id="id8149E314E34D48D2B1B10AF807252820"><enum>(v)</enum><text>An area in the State within which drinking water has been contaminated with lead or perfluoroalkyl or polyfluoroalkyl substances.</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id629BAE9FF4634F06957EE33448D827C5"><enum>(vi)</enum><text>An area in the State with an additional demographic or environmental factor that the Environmental Equity Resource Center determines to be appropriate in identifying an area as an environmental justice area for the purpose of Corps projects. </text></clause></subparagraph> <subparagraph display-inline="no-display-inline" commented="no" id="id5382A80591F0487EA893E002422B5CEA"><enum>(D)</enum><header>Interference with State environmental justice areas</header><text>Nothing in this section shall be construed as limiting a State from identifying, using factors under this paragraph or otherwise, an area as an environmental justice area for purposes other than under this section. </text></subparagraph></paragraph></subsection>
<subsection commented="no" id="id5ED494E3B8C5476893C15BE5FF24E1F0"><enum>(k)</enum><header>Use of steel, iron, and manufactured goods produced in the United States</header>
<paragraph id="idf91954e48cc745c798dc7511cc97bf89"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), grant funds awarded under this section to an eligible host entity may be obligated for a project if the steel, iron, and manufactured goods used for such project are produced only in the United States.</text></paragraph> <paragraph id="id8ab674fe2102476b9fa19670611b31f7"><enum>(2)</enum><header>Exceptions</header> <subparagraph id="idE766B5EBA4DC417DABA51AFE736063FD"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), paragraph (1) shall not apply in any case, or category of cases, in which the eligible host entity overseeing a project finds that—</text>
<clause id="idc723ca4f0e2545c2b94e388fb75cc7b1"><enum>(i)</enum><text>applying paragraph (1) would be inconsistent with the public interest;</text></clause> <clause id="id3547b485dcd84337b5f582f3f9e5f780"><enum>(ii)</enum><text>the steel, iron, or manufactured goods needed for such project are not produced in the United States in sufficient and reasonably available quantities or in a satisfactory quality; or</text></clause>
<clause id="id5737b53e309c45a1835192de85e046ec"><enum>(iii)</enum><text>use of steel, iron, or manufactured goods produced in the United States will increase the cost of the overall project by more than 25 percent.</text></clause></subparagraph> <subparagraph id="id7e1551f82c6943b4a767c61292e657ca" commented="no"><enum>(B)</enum><header>Waiver request</header><text>If the Corporation or a partnering Federal agency receives a request by an eligible host entity for a waiver under this section for an exception listed in subparagraph (A), the head of the Corporation or partnering Federal agency (referred to in this subparagraph as the <quote>agency head</quote>) shall make available to the public a copy of the request and information available to the head of such Federal agency concerning the request, and shall allow for public input on the request for at least 15 days prior to making a finding based on the request. The agency head shall make the request and accompanying information available by electronic means, including on the official public internet site of the Federal agency involved.</text></subparagraph></paragraph>
<paragraph id="id124d369b5a7248c2a3b491892e25b05d"><enum>(3)</enum><header>International agreements</header><text>The requirements under this subsection shall be applied in a manner consistent with the obligations of the United States under international agreements. </text></paragraph> <paragraph id="id263d21f741d546d1a73a697635bcb660"><enum>(4)</enum><header>Applicability</header><text>Nothing in this subsection shall supersede or preempt any existing (as of the date of enactment of this section) requirement to buy or use goods produced only in the United States, to the extent such requirement is more strict than this subsection. </text></paragraph></subsection>
<subsection id="id30415d9567b94530874275c952a70d44"><enum>(l)</enum><header>Authorization of appropriations</header>
<paragraph id="id27b5c8cea74e487fa966d4bb4f8b34f5"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section for each of fiscal years 2022 through 2025.</text></paragraph> <paragraph id="id68457ef9ac2a49fd84fcc5f740d41f64"><enum>(2)</enum><header>Duration of availability</header><text>Amounts appropriated pursuant to paragraph (1) shall remain available until expended.</text></paragraph></subsection></section>
<section id="IDBBA2C91E11814C6DBBF099095D4BE403"><enum>167.</enum><header>Corporation advisory council</header>
<subsection id="id069BC001C5D243F7B0598EAD0C17943A"><enum>(a)</enum><header>Establishment</header><text>There is established in the Corporation (as defined in section 101) the Corporation Advisory Council (referred to in this section as the <quote>Council</quote>).</text></subsection> <subsection id="ID86790BD09DDE425381754AE3857803C6"><enum>(b)</enum><header>Membership</header> <paragraph id="id13F5925677EE4637BD19C6262817D0D6"><enum>(1)</enum><header>Appointment</header><text>The Chief Executive Officer shall appoint members of the Council from the groups described in paragraph (2). </text></paragraph>
<paragraph id="idC7A7F2BCA8F040C3BF6E641BA31F593F"><enum>(2)</enum><header>Composition</header><text>The Council shall be composed of representatives from—</text> <subparagraph id="IDC18D183F3F774F5BBE2E41FC3E5BB19B"><enum>(A)</enum><text>eligible host entities (as defined in section 166); and</text></subparagraph>
<subparagraph id="ID63EC05AC033E4D6CB214D1FDCD986CE4"><enum>(B)</enum><text>labor organizations.</text></subparagraph></paragraph></subsection> <subsection id="ID550C5D824FDB4DC2ADDE2CB60178051F"><enum>(c)</enum><header>Period of appointment; vacancies</header><text>Members shall be appointed for the life of the Council. Any vacancy in the Council shall not affect the powers of the Council, but shall be filled in the same manner as the original appointment was made.</text></subsection>
<subsection id="ID8CC1AD0BFB1C4DE9A0D32138BFEA234B"><enum>(d)</enum><header>Duties</header>
<paragraph id="ID6889F3B986F249118E995A359272FB6E"><enum>(1)</enum><header>Study</header><text>The Council shall study—</text> <subparagraph id="idFA110058281C4CF799A37DD0FA6C53E2"><enum>(A)</enum><text>the operation of the Corporation (as defined in section 166);</text></subparagraph>
<subparagraph id="idC5209A082880441FA15C27EF0FE352DC"><enum>(B)</enum><text>the impact of grants awarded under section 166; and</text></subparagraph> <subparagraph id="id32D83622C0F149E29634DDC388C7A8AB"><enum>(C)</enum><text>the outcome of participants in the program created under section 166.</text></subparagraph></paragraph>
<paragraph id="idF3CE6620826745A0B8235979DDB0A704"><enum>(2)</enum><header>Report</header><text>The Council shall prepare annual reports on the issues considered under paragraph (1) and submit such reports to the Corporation (as defined in section 101).</text></paragraph></subsection> <subsection id="IDA098BFCAA835459B87870CB7B7D67EAA"><enum>(e)</enum><header>Personnel</header> <paragraph id="ID727E11A29415415D888DBF1631255C36"><enum>(1)</enum><header>Travel expenses</header><text>The members of the Council shall not receive compensation for the performance of services for the Council, but shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Council. Notwithstanding section 1342 of title 31, United States Code, the Secretary may accept the voluntary and uncompensated services of members of the Council.</text></paragraph>
<paragraph id="IDBAC2C5C0AAD2408E94A784B2175CDBC5"><enum>(2)</enum><header>Detail of government employees</header><text>Any Federal Government employee may be detailed to the Council without reimbursement, and such detail shall be without interruption or loss of civil service status or privilege.</text></paragraph></subsection> <subsection id="ID89C539BE742D40AF879A6D559AD27380"><enum>(f)</enum><header>Permanent council</header><text>Section 14 of the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.) shall not apply to the Council.</text></subsection>
<subsection id="ID4DDDA8C5B66C44759DF95BF4A79698E1"><enum>(g)</enum><header>Authorization of appropriations</header>
<paragraph id="IDF626FF7AA01B4A6196E129ABAB28F1CF"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to the Council for each fiscal year such sums as may be necessary to carry out this section.</text></paragraph> <paragraph id="IDF1AB59BB095D447DA9D0FF420FEF5E04"><enum>(2)</enum><header>Availability</header><text>Any sums appropriated under the authorization contained in this subsection shall remain available, without fiscal year limitation, until expended.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id86FBB1783E0E43699BA8E8D5C417AA12"><enum>(b)</enum><header>Excluding corps member allowance and awards from gross income</header>
<paragraph id="id317D1FD3EE0F405B85F2793E96C5E1C7"><enum>(1)</enum><header>In general</header><text>Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 112 the following new section:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id465F7B15182B48A5AC63BA0350F957D2"> <section id="idA7E09DF7DFF04B7A8DF4A2CBA9CB01D7"><enum>113.</enum><header>Amounts received from Civilian Conservation Corps</header><text display-inline="no-display-inline">In the case of an individual, gross income shall not include any amount received under a civilian conservation corps allowance or award under paragraphs (4) and (5) of section 166(i) of the National and Community Service Act of 1990.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<section id="idD5FE3D93AFB2437A842780D54393DA3C"><enum>3.</enum><header>On-farm apprenticeship program</header>
<subsection id="id39DB94E3BC254F768166E11E30AE8461"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id72384CD1625F4467B05A75655B203762"><enum>(1)</enum><header>Apprentice</header><text>The term <term>apprentice</term> means an individual in an apprenticeship registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>).</text></paragraph>
<paragraph id="idE88AFB3C856141749B35BDC408F29C8C"><enum>(2)</enum><header>Apprenticeship costs</header><text>The term <term>apprenticeship costs</term> means the actual costs incurred by an agricultural business in employing an apprentice through the program, including—</text> <subparagraph id="idc3bb842714284106ad388f57f75789e4"><enum>(A)</enum><text>wages paid to the apprentice (not including allowances that are funded through the Civilian Conservation Corps established under section 166 of the National and Community Service Act of 1990, as added by section 2 of this Act); </text></subparagraph>
<subparagraph id="id69C3E2665B304A3F993B1AA69020717A"><enum>(B)</enum><text>a reasonable allocation of fixed overhead expenses relating to the apprenticeship under the program; and </text></subparagraph> <subparagraph id="id8EA94822A6AC481890FDDB9E3254A127"><enum>(C)</enum><text>incidental costs directly relating to the apprenticeship under the program. </text></subparagraph></paragraph>
<paragraph id="id1664DA97FF9E40F78B14C50B6AAFCEFC"><enum>(3)</enum><header>Program</header><text>The term <term>program</term> means the agricultural workforce development program established under subsection (b).</text></paragraph> <paragraph id="id32A9ECBB94F8415586B445757CD2F2C5"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection>
<subsection id="idDB8207CB5C25480BAC0566146129C6D3"><enum>(b)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall promulgate regulations to establish an agricultural workforce development program to provide incentives for agricultural businesses to employ apprentices, including employing participants in or applicants for the Civilian Conservation Corps established under section 166 of the National and Community Service Act of 1990, through partial reimbursement of the apprenticeship costs. </text></subsection> <subsection id="id4F42C2A75EEB4992924DFC0CCB67A10B"><enum>(c)</enum><header>Requirements</header><text>In the regulations promulgated under subsection (b), the Secretary shall specify, at a minimum—</text>
<paragraph id="id4193c9bfd1dc4acc8b7c64771b61f784"><enum>(1)</enum><text>the criteria for selecting an agricultural business for participation in the program, which shall include—</text> <subparagraph id="id96D6E2740A6445ACB4A42F45E0799816"><enum>(A)</enum><text>the ability of the agricultural business to effectively supervise an apprentice; and </text></subparagraph>
<subparagraph id="id4348300BDA47472B90FE468A43FF4306"><enum>(B)</enum><text>the opportunity for an apprentice to obtain meaningful work experience through the apprenticeship;</text></subparagraph></paragraph> <paragraph id="id2ef2feefc3dd49779d165dee63a41571"><enum>(2)</enum><text>the process and timeline for selecting agricultural businesses and apprentices that are qualified to participate in the program;</text></paragraph>
<paragraph id="idbe578d51cf0e49978b1917713a8a7c9f"><enum>(3)</enum><text>the accounting requirements for tracking apprenticeship costs under the program; and</text></paragraph> <paragraph id="idb442175bac9c49d5b946d6a9b739db6a"><enum>(4)</enum><text>the process for an agricultural business to seek reimbursements for apprenticeship costs under the program.</text></paragraph></subsection>
<subsection id="idF8C4F623A64F41B0ACFDB180F7D2E906"><enum>(d)</enum><header>Reimbursements</header><text>Under the program, the Secretary shall reimburse an agricultural business in an amount equal to not more than 50 percent of apprenticeship costs.</text></subsection> <subsection id="idB2E4F74F8C5349E39B2CD1DCA626E1F2"><enum>(e)</enum><header>Limitation</header><text>An agricultural business may not be reimbursed under the program for the apprenticeship costs of more than 3 apprentices for any 1 fiscal year. </text></subsection>
<subsection id="idFADFB231FA6C48DC98706261338CB1C5"><enum>(f)</enum><header>Construction</header><text>Nothing in this section shall be construed to change the status of an individual participating in the Civilian Conservation Corps established under section 101(30)(B) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12511">42 U.S.C. 12511(30)(B)</external-xref>) for purposes of chapter 2 of subtitle E of title I of that Act, as added by section 2 of this Act. </text></subsection></section> <section id="id99A6261050DA4B45B3977AD25ADA7663"><enum>4.</enum><header>Skilled trade nondisplacement</header><text display-inline="no-display-inline">Section 177(b)(3)(A) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12637">42 U.S.C. 12637(b)(3)(A)</external-xref>) is amended by striking <quote>employee.</quote> and inserting <quote>employee, including any employee whose duties require that employee to have passed a trade examination in the skilled trades.</quote>.</text></section>
