<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 240</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210204">February 4, 2021</action-date><action-desc><sponsor name-id="S364">Mr. Murphy</sponsor> (for himself, <cosponsor name-id="S388">Ms. Hassan</cosponsor>, and <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To support children with disabilities during the COVID–19 pandemic.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Children with Disabilities During COVID–19 Act</short-title></quote>.</text></section><section id="idd4299058122849ee808178507e171583"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id5f2101406edb4227b1f0f75fe7426c04"><enum>(1)</enum><text>A free appropriate public education is a fundamental educational right of all children with disabilities, guaranteed by the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. 701</external-xref> et seq.) and the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400</external-xref> et seq.).</text></paragraph><paragraph id="id57ea913bcbfb401a8442ecc83925ada4"><enum>(2)</enum><text>More than 7,000,000 school-aged children with disabilities, approximately 13 percent of the total student enrollment, are currently entitled to individualized education and related services mandated by the Individuals with Disabilities Education Act. </text></paragraph><paragraph id="id028d903bdfe74707b75cfefa003e32a5"><enum>(3)</enum><text>Nearly 500,000 infants and toddlers, as well as their families, receive supports and services under the Individuals with Disabilities Education Act and these early interventions have been proven to improve education outcomes. </text></paragraph><paragraph id="idef7d8a4bc8704de3a839550db2b3e6e6"><enum>(4)</enum><text>Under the Individuals with Disabilities Education Act, schools and lead agencies responsible for the administration of funds under part C of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1431">20 U.S.C. 1431</external-xref> et seq.) (referred to in this Act as <quote>lead agencies</quote>) are required to provide early intervention, special education, and related services to children with disabilities, an obligation that requires services outlined in a child’s individualized family service plan (referred to as an <quote>IFSP</quote>) or individualized education program (referred to as an <quote>IEP</quote>).</text></paragraph><paragraph id="idf942b8d5fa0445d38680cdb284c13324"><enum>(5)</enum><text>Children with disabilities have been disproportionately impacted by the disruptions to education resulting from the COVID–19 pandemic, with many children with disabilities needing additional supports and services to meet their IEP and IFSP goals as the delivery of education and services has shifted from in-person to remote formats.</text></paragraph><paragraph id="id2f2c875cdf484b3288891cdc353c080a"><enum>(6)</enum><text>Local educational agencies and lead agencies face extra costs associated with adjusting services and continuing to provide a free, appropriate public education while children with disabilities are receiving services through distance learning and remote service delivery. </text></paragraph><paragraph id="idf94c6fab34934a6d916adf8f500edc85"><enum>(7)</enum><text>Schools are facing unprecedented budget challenges due to the rising costs of responding to COVID–19, coupled with State and local revenue shortfalls, as well as the severe and persistent underfunding of the Individuals with Disabilities Education Act.</text></paragraph><paragraph id="id792354d9c326467ba4f4c8b5bca6b713"><enum>(8)</enum><text>To ensure that schools and lead agencies continue to meet the needs of children with disabilities and their families, including providing trained and certified special educators and education support specialists, emergency supplemental funding is needed under the Individuals with Disabilities Education Act. </text></paragraph><paragraph id="idEFDDB9CF863049998DF049DF836D4BEE"><enum>(9)</enum><text>Emergency supplemental funding is also needed under the Assistive Technology Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/3001">29 U.S.C. 3001</external-xref> et seq.) because services provided under that Act help ensure that students with disabilities have the technology devices and services they need to access equal educational opportunities. </text></paragraph></section><section id="id7c6e097ad580488398788364b1d2d3b8"><enum>3.</enum><header>Supplemental appropriations</header><subsection id="idF698806A38244A0FBD278645166AEFD9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The following sums are appropriated, out of any money in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2021:</text><paragraph id="id21ffac9f18a14a5f9a5f67df6ed82343"><enum>(1)</enum><text>$11,000,000,000 for grants to States under section 611 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1411">20 U.S.C. 1411</external-xref> et seq.). </text></paragraph><paragraph id="idb37be23eb8d44c1b854477e4b4853902"><enum>(2)</enum><text>For early childhood education programs—</text><subparagraph id="id739a191f121d48d9be89c1b2600872b9"><enum>(A)</enum><text>$400,000,000 for preschool grants under section 619 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1419">20 U.S.C. 1419</external-xref>); and</text></subparagraph><subparagraph id="idd841124a103743a3b63488142881122c"><enum>(B)</enum><text>$500,000,000 for programs for infants and toddlers under part C of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1431">20 U.S.C. 1431</external-xref> et seq.).</text></subparagraph></paragraph><paragraph id="idbda4418e16484a1fa3d20aa6e8b54c40"><enum>(3)</enum><text>$300,000,000 for personnel development under section 662 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1462">20 U.S.C. 1462</external-xref>).</text></paragraph><paragraph id="id9c2cbc0c47944671a37f9be901b12c4c"><enum>(4)</enum><text>$55,000,000 for the Assistive Technology Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/3001">29 U.S.C. 3001</external-xref> et seq.).</text></paragraph></subsection><subsection commented="no" id="id8843B454F88B4AB0906A823A7EE66763"><enum>(b)</enum><header>Emergency designation</header><paragraph id="idfe74eb89dd8a4cf2990462641928a996"><enum>(1)</enum><header>In general</header><text>The amounts provided by this section are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></paragraph><paragraph id="ida06eef4956754d8892fb7f6b770c70aa"><enum>(2)</enum><header>Designation in Senate</header><text>In the Senate, this Act is designated as an emergency requirement pursuant to section 4112(a) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018.</text></paragraph></subsection><subsection id="idbdf7760af33c456b8a484e5357230458"><enum>(c)</enum><header>Applicability of all terms and conditions</header><text>All terms and conditions that apply to a program under the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400</external-xref> et seq.) or the Assistive Technology Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/3001">29 U.S.C. 3001</external-xref> et seq.), as the case may be, shall apply with respect to support provided for the program through funds made available under subsection (a).</text></subsection><subsection id="iddc1eb4876e114db8810c7e41d33c2998"><enum>(d)</enum><header>General provisions</header><text>Any amount appropriated under this section is in addition to other amounts appropriated or made available for the applicable purpose. </text></subsection></section><section id="id5efcea4c058d47039344ca5504ddc892"><enum>4.</enum><header>Reporting</header><subsection id="id9a8fd59549684c828af2b3bf5866c842"><enum>(a)</enum><header>IDEA funds</header><paragraph id="id63542D8E530C40349D4BC24C02AEE499"><enum>(1)</enum><header>In general</header><text>Recipients of funds made available under this Act for activities authorized under the Individuals with Disabilities Education Act shall separately account for, and report on, how such funds are spent in accordance with this section.</text></paragraph><paragraph id="id72EBA0708824411784CD4EF04643DAE9"><enum>(2)</enum><header>L<enum-in-header>EA</enum-in-header>s</header><text>Not later than 1 year after the distribution of funds under this Act, local educational agencies shall report the use of funds appropriated in this Act to their respective State educational agencies. </text></paragraph><paragraph id="id81874BB227EA4139AF178F8C67F7D097"><enum>(3)</enum><header>S<enum-in-header>EA</enum-in-header>s</header><text>Not later than 1 year after the distribution of funds under this Act, State educational agencies shall produce a publicly available report that contains information about such spending by each local educational agency in the State and aggregate spending of local educational agencies in the State by allowable uses under Individuals with Disabilities Education Act. Each State educational agency shall make that report available in an accessible manner on the website of the State educational agency and submit the report to the Secretary of Education.</text></paragraph><paragraph id="id14FED131EBD1408A817C414E2A5C8B19"><enum>(4)</enum><header>Lead agency</header><text>Not later than 1 year after the distribution of funds under this Act, each lead agency responsible for the administration of funds provided under part C of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1431">20 U.S.C. 1431</external-xref> et seq.) shall prepare and submit to the Secretary of Education a report that contains information about how the lead agency spent funds appropriated under this Act.</text></paragraph><paragraph id="idF7A037453189453A9659661B83A09D11"><enum>(5)</enum><header>Secretary of Education</header><text>The Secretary of Education shall release a nationally representative report on expenditures under this Act and send such report to the Committee on Appropriations and the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Appropriations and the Committee on Education and Labor of the House of Representatives. Not later than 1 year after the distribution of funds under this Act, the Secretary of Education’s report shall be placed on the Department of Education’s website in an accessible format.</text></paragraph></subsection><subsection id="ide445a31ea6094ce48678a129d3389cc5"><enum>(b)</enum><header>Assistive Technology Act of 1998</header><paragraph id="id3336B0BF20B947B680796729749734E9"><enum>(1)</enum><header>In general</header><text>Recipients of funds made available under this Act for activities authorized under the Assistive Technology Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/3001">29 U.S.C. 3001</external-xref> et seq.) shall separately account for, and report on, how such funds are spent in accordance with this subsection.</text></paragraph><paragraph id="id84E8567343294C5ABD8C5D6C637892ED"><enum>(2)</enum><header>Secretary of Health and Human Services</header><text>Not later than 1 year after the distribution of funds under this Act, the Secretary of Health and Human Services shall release a nationally representative report on expenditures made available under this Act for activities authorized under the Assistive Technology Act of 1998.</text></paragraph></subsection></section></legis-body></bill>
