which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Safe Drinking Water Act to require the Administrator of the Environmental Protection Agency to set maximum contaminant levels for certain chemicals, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Drinking Water from PFAS Act of 2021</short-title></quote>.</text></section><section id="id035DCC1EB39041629E032D0BA4C8ABB8"><enum>2.</enum><header>Maximum contaminant levels</header><text display-inline="no-display-inline">Section 1412(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="idD63C17D57A984FB283BA9B2CD16196BF" style="OLC" act-name=""><paragraph id="id3F962864A9874B84844EAB1DDE5752B3"><enum>(16)</enum><header>Perfluoroalkyl and polyfluoroalkyl substances</header><subparagraph id="id9FB8B47C7E9846A1AF142DE068F40BEF"><enum>(A)</enum><header>Required regulations</header><text>Not later than 2 years after the date of enactment of the <short-title>Protect Drinking Water from PFAS Act of 2021</short-title>, the Administrator shall publish a maximum contaminant level and promulgate a national primary drinking water regulation for perfluoroalkyl and polyfluoroalkyl substances, including, at a minimum—</text><clause id="id857AD15624244D04874FD2FA9B8C72F5"><enum>(i)</enum><text>perfluorooctanoic acid (commonly referred to as <quote>PFOA</quote>); and</text></clause><clause id="id6E7AA8CAD09D4782BD69CAB623A501E6"><enum>(ii)</enum><text>perfluorooctane sulfonic acid (commonly referred to as <quote>PFOS</quote>).</text></clause></subparagraph><subparagraph id="id2CC1B0980AF74F4A929156EDE0C1BFD1"><enum>(B)</enum><header>Monitoring</header><text>In establishing monitoring requirements under the national primary drinking water regulation for perfluoroalkyl and polyfluoroalkyl substances under subparagraph (A), the Administrator shall—</text><clause id="idC1772A0728EC43A9AFEC5C35F7A31545"><enum>(i)</enum><text>consider options for tailoring monitoring requirements for public water systems that do not detect, or are reliably and consistently below the maximum contaminant level for, those substances; and</text></clause><clause id="idf0d03c22b394434f9b6e53b1c0b18c53"><enum>(ii)</enum><text>prioritize the use of existing authorities to provide technical assistance and funding to help small, rural, or disadvantaged public water systems to comply with the national primary drinking water regulation.</text></clause></subparagraph><subparagraph id="id7D37409139A74661ADC3497A70370348"><enum>(C)</enum><header>Health protection</header><text>The national primary drinking water regulation for perfluoroalkyl and polyfluoroalkyl substances under subparagraph (A) shall be protective of the health of subpopulations at greater risk, as described in section 1458.</text></subparagraph><subparagraph id="id639D4FB13462451882C98B73B3E1EAD2"><enum>(D)</enum><header>Health risk reduction and cost analysis</header><text>In meeting the requirements of paragraph (3)(C) with respect to the national primary drinking water regulation for perfluoroalkyl and polyfluoroalkyl substances under subparagraph (A), the Administrator may rely on information available to the Administrator with respect to 1 or more specific perfluoroalkyl or polyfluoroalkyl substances to extrapolate reasoned conclusions with respect to the health risks and effects of a class of perfluoroalkyl or polyfluoroalkyl substances of which the specific perfluoroalkyl or polyfluoroalkyl substances are a part, including by using techniques described in—</text><clause id="idC9F0EAA661F842BEB8DAC0673486562E"><enum>(i)</enum><text>the document of the Environmental Protection Agency entitled <quote>Generalized Read-Across (GenRA)</quote> (or a successor document); and</text></clause><clause id="id91932CB9CE48460589CCD9061019CDE4"><enum>(ii)</enum><text>the Toxicity Estimation Software Tool of the Environmental Protection Agency (or a successor tool).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
