which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to accommodate certain facilities within rights-of-way on Federal-aid highways.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5058B558D73F44D6BCAF15EAC3C8E4F2"><section section-type="section-one" id="H7D5F29EC46BF4092A70D3729CF0CE9B5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sustainable Highways Innovation Act</short-title></quote>.</text></section><section id="HF3217F02873343FF8ACACA9841ED72FF"><enum>2.</enum><header>Accommodation of certain facilities within any right-of-way on a Federal-aid highway</header><text display-inline="no-display-inline">Section 109 of title 23, United States Code, is amended—</text><paragraph id="id18AF2A7933134105AB0823C03C4AA707"><enum>(1)</enum><text>in subsection (l)—</text><subparagraph id="idFABE1A5F41B04781ABE501F683709508"><enum>(A)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph id="idE14CEE4518D8435A96F016BBD9140651"><enum>(B)</enum><text>by striking the subsection designation and all that follows through <quote>In determining</quote> in paragraph (1) in the matter preceding subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id683455E04CF24B2DA982B5AF2C78EA19"><subsection id="id36CCA99D5D71437499E1DDE6C3A9CBE2"><enum>(l)</enum><header>Accommodating utility facilities in the right-of-Way</header><paragraph id="id85DEA29F118E415CA36272D4ACC465A5"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id1323A5C64C8F45C6B37ACC094886FC46"><enum>(A)</enum><header>Right-of-way</header><text>The term <term>right-of-way</term> means any real property, or interest therein, acquired, dedicated, or reserved for the construction, operation, and maintenance of a highway.</text></subparagraph><subparagraph id="idAD57F457013443D0BC032077BF04FE17"><enum>(B)</enum><header>Utility facility</header><clause id="idE9207289D8274E628A5A6C921F56C8ED"><enum>(i)</enum><header>In general</header><text>The term <term>utility facility</term> means any privately, publicly, or cooperatively owned line, facility, or system for producing, transmitting, or distributing communications, power, electricity, light, heat, gas, oil, crude products, water, steam, waste, storm water not connected with highway drainage, or any other similar commodity, including any fire or police signal system or street lighting system, that directly or indirectly serves the public.</text></clause><clause id="id7CF8A5FA78CE4CCCB62F47A9D41F02DD"><enum>(ii)</enum><header>Inclusions</header><text>The term <term>utility facility</term> includes—</text><subclause id="id7B60C5F380634C2AA49226B7A21E6918"><enum>(I)</enum><text>alternative fueling infrastructure;</text></subclause><subclause id="id8A4C5A928AAD42B7A4D036C26F96C503"><enum>(II)</enum><text>a renewable energy generation facility;</text></subclause><subclause id="id8C8ABBEAE78040C785C656142410F6F4"><enum>(III)</enum><text>electrical transmission and distribution infrastructure; and</text></subclause><subclause id="idF515CB158F4A4EF296448D6BCE976D06"><enum>(IV)</enum><text>broadband infrastructure and conduit.</text></subclause></clause></subparagraph></paragraph><paragraph id="idBB676C0D6300400E9220E2481A1F8D2B"><enum>(2)</enum><header>Accommodation</header><text>In determining </text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idD2D388BE8A5E4723B2DE4A7799D9F7BF"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0B544E424C564D2A8426D6CFF1BB9294"><paragraph id="id1B0BAA6907DE4B02AB2D22818B0F8733"><enum>(3)</enum><header>State approval</header><text display-inline="yes-display-inline">A State, on behalf of the Secretary, may approve accommodating a utility facility described in paragraph (1)(B)(ii) within a right-of-way on a Federal-aid highway.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idBD028363B5A849649C39392F83721FE2"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3CDA8E9ED73B4DB681D73503E3154F7E"><subsection id="id6A53429201B84D5AA80DE37D83F648BA"><enum>(s)</enum><header>Vegetation management</header><text>Notwithstanding any other provision of law, States are encouraged to implement, or to enter into partnerships to implement, vegetation management practices, such as increased mowing heights and planting native grasses and pollinator-friendly habitats, along a right-of-way on a Federal-aid highway, if the implementation of those practices—</text><paragraph id="id5A4E0DFC1C9C472985BA7D52533E3F5D"><enum>(1)</enum><text>is in the public interest; and</text></paragraph><paragraph id="id1E84C110C3694C6DB244DB8F1BBF8317"><enum>(2)</enum><text>will not impair the highway or interfere with the free and safe flow of traffic.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
