which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to improve the safety of children purchasing food items from frozen dessert trucks.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tristan's Law</short-title></quote>.</text></section><section id="ida939a3e522e940728d985985155dfca8"><enum>2.</enum><header>Reservation of funds to increase safety of frozen dessert truck patrons</header><subsection id="idE0E266D292484FA38E6377F9C0832AB5"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text><paragraph id="id746023901e1f462596b097c15f36d8a1"><enum>(1)</enum><text>in 2016, more than 20 percent of the 1,233 children killed in traffic crashes were pedestrians;</text></paragraph><paragraph id="id60ac245d4fb0407eb7f6b48f36903449"><enum>(2)</enum><text>frozen dessert trucks present a very specific hazard for children;</text></paragraph><paragraph id="id1d4b347656f048c4912031b3d89b32c5"><enum>(3)</enum><text>in approaching, or departing from, a frozen dessert truck—</text><subparagraph id="id37BE79230EB6492785768D51935292E3"><enum>(A)</enum><text>children may pay little attention to traffic; and</text></subparagraph><subparagraph id="idF3CD0AE6AF144499B35D67F2E4CB0E4A"><enum>(B)</enum><text>the truck may screen the children from driver visibility;</text></subparagraph></paragraph><paragraph id="id5bae5794ecad4e06a588dc873bb07e0e"><enum>(4)</enum><text>States and units of local government have issued ordinances to modify the behavior of drivers in the vicinity of frozen dessert trucks to reduce speeds and improve the safety of children approaching, or departing from, the trucks;</text></paragraph><paragraph id="idb8ee8e52a2c74547a7c7b103e3579115"><enum>(5)</enum><text>requiring drivers to come to a complete stop before passing a frozen dessert truck that is stopped to vend can reduce safety threats posed to children;</text></paragraph><paragraph id="ideb9abc4fe58a4f70be17a360e3633a24"><enum>(6)</enum><text>requiring frozen dessert trucks to be equipped with flashing signal lamps, a stop signal arm, a convex mirror, and a front crossing arm can reduce safety threats posed to children visiting the trucks; and</text></paragraph><paragraph id="id31ff15166fc646bdb6b883315424b46b"><enum>(7)</enum><text>the Federal Government can play a role in reducing pedestrian injuries associated with frozen dessert truck operations.</text></paragraph></subsection><subsection id="idBA2AF0F98CD3420E989ADF88CB15A89F"><enum>(b)</enum><header>National priority safety programs reservation of funds</header><text display-inline="yes-display-inline">Section 405 of title 23, United States Code, is amended—</text><paragraph id="id430ACDDC9449448E81C059C9B2184699"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id3774D64A1F95435C8E8111568DF37B25"><enum>(A)</enum><text>in paragraph (7), by striking <quote>5 percent</quote> and inserting <quote>4 percent</quote>;</text></subparagraph><subparagraph id="id930BE2F6C88A4FD4832A54169B9D6D67"><enum>(B)</enum><text>in paragraph (8)—</text><clause id="id4DF3CF8359974A1BAF1F501A06077621"><enum>(i)</enum><text>by striking <quote>through (7)</quote> and inserting <quote>through (8)</quote>; and</text></clause><clause id="id03FA8991B4BC40FEB175F61AEA43DA99"><enum>(ii)</enum><text>by striking <quote>through (h)</quote> and inserting <quote>through (i)</quote>;</text></clause></subparagraph><subparagraph id="id9868184EAB6148659CAE2310F1A9D2CB"><enum>(C)</enum><text>by redesignating paragraphs (8) through (10) as paragraphs (9) through (11), respectively; and</text></subparagraph><subparagraph id="idE09BD02F84344352B7604AB6FD95C260"><enum>(D)</enum><text>by inserting after paragraph (7) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id05F6C4F08DC444879C6FF8B88682F144"><paragraph id="id3BD93EAA096740C48C83819EE356E78B"><enum>(8)</enum><header>Safety of frozen dessert truck patrons</header><text>In each fiscal year, 1 percent of the funds provided under this section shall be allocated among States that adopt and implement laws to increase the safety of frozen dessert truck patrons (as described in subsection (i)).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id0812A84684D046A6B717F0038540EDA4"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2200D6B5902D423C861EC062717ED0AE"><subsection id="id499F805D06404ABD83F2D47A520F7AC5"><enum>(i)</enum><header>Safety of frozen dessert truck patrons</header><paragraph id="ida2e6bb77ddd343af8920aeffbd18d66c"><enum>(1)</enum><header>Definition of frozen dessert truck</header><text display-inline="yes-display-inline">In this subsection, the term <term>frozen dessert truck</term> means a motor vehicle in which 1 or more frozen desserts (within the meaning of part 135 of title 21, Code of Federal Regulations (or successor regulations)) are carried on the highway for purposes of retail sale from a door or window of the motor vehicle to an individual consumer at any location.</text></paragraph><paragraph id="id58c72011bbd347cf831317f84a224395"><enum>(2)</enum><header>General authority</header><text>Subject to the requirements of this subsection, the Secretary shall award grants to States for the purpose of establishing and implementing laws (including regulations) that require frozen dessert trucks to be equipped as described in paragraph (3).</text></paragraph><paragraph id="id3410753c13a44f5eae75254619291c14"><enum>(3)</enum><header>Frozen dessert truck equipment</header><text>For purposes of paragraph (2), a frozen dessert truck shall be equipped with each of the following:</text><subparagraph id="id20e62bfd95c14cf5b8678861c2a813a4"><enum>(A)</enum><header>Signal lamps</header><text>1 or more signal lamps that—</text><clause id="id9691C608051348CDA1A0E86E92C7EE05"><enum>(i)</enum><text>are mounted—</text><subclause id="id5A2531870DE54F74BC37D344B321B14E"><enum>(I)</enum><text>at the same level; and</text></subclause><subclause id="id5B96D478EE2F4D089B59514A0DD48A09"><enum>(II)</enum><text>as high on the frozen dessert truck, and as widely spaced laterally, as is practicable;</text></subclause></clause><clause id="idDD5A2E17A9F744CA96F8C9E88399C414"><enum>(ii)</enum><text>are not less than 5, and not more than 7, inches in diameter; and</text></clause><clause id="id67492D2A8812460885A1DEC90C9A001F"><enum>(iii)</enum><text>display 2 alternately flashing red lights visible at a distance of not less than 500 feet, to the front and rear of the frozen dessert truck, in normal sunlight on a straight, level highway.</text></clause></subparagraph><subparagraph id="id0cf99ed2088548e5a58a6af288ca18a7"><enum>(B)</enum><header>Stop signal arm</header><clause id="idE4B79E0026364AAAB6ABFBBD6AC5CE68"><enum>(i)</enum><header>In general</header><text>A stop signal arm—</text><subclause id="idEA8711013B6D4536A4CACC26E974F1C6"><enum>(I)</enum><text>that can be extended horizontally from the left side of the frozen dessert truck;</text></subclause><subclause id="id6C8660108AB643BD98F3491F63AA2D3D"><enum>(II)</enum><text>when extended—</text><item id="idB0CFFB75BB0441D1A4C3A4EC4EDB8A8E"><enum>(aa)</enum><text>the side nearest the frozen dessert truck of which shall be—</text><subitem id="id2A977AF195534408856B6CEC7B965078"><enum>(AA)</enum><text>7.25 inches long; and</text></subitem><subitem id="id4272934060A24705BA7E9417DEA281A1"><enum>(BB)</enum><text>parallel to the side of the frozen dessert truck;</text></subitem></item><item id="id3BF0F22C7DD942C2BCBDC04106FD4DC9"><enum>(bb)</enum><text>the side farthest from the frozen dessert truck of which shall be—</text><subitem id="id52A29A2FAD1F4C31A7E127968D5225AE"><enum>(AA)</enum><text>18 inches long; and</text></subitem><subitem id="id252DBEC0466544E1B344C1B98D0A610E"><enum>(BB)</enum><text>parallel to the side nearest the frozen dessert truck;</text></subitem></item><item id="id5093431D1F8B4FB8BA7381B9896B2F59"><enum>(cc)</enum><text>the 2 sides of which shall be 18 inches apart, creating a symmetrical, trapezoidal shape; and</text></item><item id="id46C146AFB1F7413A81309855045939E0"><enum>(dd)</enum><text>the bottom of which shall be approximately 42 inches above the street;</text></item></subclause><subclause id="id30F9724AA2714D57B2282D549182B26E"><enum>(III)</enum><text>the outside corners of which—</text><item id="id5868232868EA4492BD55D5FE2C15D8BE"><enum>(aa)</enum><text>when extended, feature 2 alternately flashing red lights, each of which shall be—</text><subitem id="id762A90EE4A514FA4AE135BDD8FB79A91"><enum>(AA)</enum><text>not less than 3, and not more than 5, inches in diameter; and</text></subitem><subitem id="idF6820D537AAF4F00BF7B2A29FE1C230F"><enum>(BB)</enum><text>visible at a distance of not less than 300 feet, to the front and rear of the frozen dessert truck, in normal sunlight on a straight, level highway; and</text></subitem></item><item id="idB19259847B494B8184631561DA7A1E85"><enum>(bb)</enum><text>are rounded to conform to the shape of the lights described in item (aa); and</text></item></subclause><subclause id="id35B4749FBF424BC3920CE5B181ED3EA9"><enum>(IV)</enum><text>both sides of which shall feature—</text><item id="idF09C04ED4D75423BB7DF37E396516F58"><enum>(aa)</enum><text>a red, reflectorized background; and</text></item><item id="id44FB4987B2244B5A8869FEC83FD698A5"><enum>(bb)</enum><text>a legend described in clause (ii).</text></item></subclause></clause><clause id="idDAD12F6FA6964F72B1639CB975BD8893" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header>Description of legend</header><text>A legend referred to in clause (i)(IV)(bb) is a legend in which—</text><subclause commented="no" display-inline="no-display-inline" id="id0AD0F177E49B46D38F58BE000C073016"><enum>(I)</enum><text>the word <quote>STOP</quote> appears in 6-inch-high white letters, not to exceed 4 inches in length, in the middle of the stop signal arm;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id264F3B43BB8341E08B1AEF1E2D9F6D06"><enum>(II)</enum><text>above the word <quote>STOP</quote>, the phrase <quote>IF SAFE</quote> appears in 2-inch-high white letters, not to exceed 1.75 inches in length;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id383CCD731B7540E68428687316581852"><enum>(III)</enum><text>below the word <quote>STOP</quote>, the phrase <quote>THEN GO</quote> appears in 2-inch-high white letters, not to exceed 1.75 inches in length; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idC7BA59C91C8F4602AE22F3525663C0E6"><enum>(IV)</enum><text>the colors (including the colors of the background) conform to the requirements described in the Manual on Uniform Traffic Control Devices for Streets and Highways published by the Federal Highway Administration.</text></subclause></clause></subparagraph><subparagraph id="id7c0d0743c76d459fb1b850853c77ae85"><enum>(C)</enum><header>Mirror</header><text>A convex mirror mounted on the front of the frozen dessert truck in a manner that ensures that the operator of the frozen dessert truck, when sitting in a normal operating seating position, is capable of seeing the area in front of the frozen dessert truck that, absent the mirror, would be obscured by the hood of the frozen dessert truck.</text></subparagraph><subparagraph id="idC94ED50643434C2DBAAE205E356C88AA" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header>Front crossing arm</header><text display-inline="yes-display-inline">A front crossing arm—</text><clause commented="no" display-inline="no-display-inline" id="id0F1303BD95AF4C1F91B290225FB8F499"><enum>(i)</enum><text display-inline="yes-display-inline">that is—</text><subclause commented="no" display-inline="no-display-inline" id="idDF80FBFAC848453A9D51CC44364CA614"><enum>(I)</enum><text display-inline="yes-display-inline">attached to the front bumper of the frozen dessert truck; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id28B130F6584B4ABE9F87BE233C1A2D89"><enum>(II)</enum><text display-inline="yes-display-inline">hinged from the right side of the frozen dessert truck;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idE0624BEFF0A145CBB57CF8A88D1284B5"><enum>(ii)</enum><text display-inline="yes-display-inline">the bottom of which shall be not less than 16, and not more than 20, inches above the street;</text></clause><clause commented="no" display-inline="no-display-inline" id="idF7AD096CA6D4436C9CEAB8AF0C713EF6"><enum>(iii)</enum><text display-inline="yes-display-inline">that is—</text><subclause commented="no" display-inline="no-display-inline" id="idDD8AAC42913341298150F84570FC261B"><enum>(I)</enum><text display-inline="yes-display-inline">made of any durable material; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3F7EC1CF9F7242F79F67FD27F4E6B712"><enum>(II)</enum><text display-inline="yes-display-inline">covered with yellow or white reflective material; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idCEC16B97FA83432A92C32304C67C4567"><enum>(iv)</enum><text display-inline="yes-display-inline">that extends—</text><subclause commented="no" display-inline="no-display-inline" id="idB15CE260AF5E404FA9AAA5B12F18077B"><enum>(I)</enum><text display-inline="yes-display-inline">in conjunction with the stop signal arm described in subparagraph (B);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4D96EE177D7645419E4BDEBAF6CB534F"><enum>(II)</enum><text display-inline="yes-display-inline">when extended outward in front of the frozen dessert truck, not less than 4, and not more than 6, feet parallel to the street; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id92ADB19CBF864AC888A513F31571A71E"><enum>(III)</enum><text display-inline="yes-display-inline">when retracted against the front of the frozen dessert truck, not past the width of the frozen dessert truck on the left side of the frozen dessert truck operator.</text></subclause></clause></subparagraph></paragraph><paragraph id="idb397f021021841cd92276a2e87c65124" commented="no"><enum>(4)</enum><header>Grant amount</header><text>The allocation of grant funds to a State under this subsection for a fiscal year shall be in proportion to the apportionment of the State under section 402 for fiscal year 2009.</text></paragraph><paragraph id="id87d8b2ad914542cc87faf68b723c82d0"><enum>(5)</enum><header>Study</header><subparagraph id="idC75B9CD98AFD4F3B9E6829537BC566CF"><enum>(A)</enum><header>In general</header><text>The Secretary shall conduct a study of—</text><clause id="id419216c924084f5c8efc0aabf991fe07"><enum>(i)</enum><text>the extent of pedestrian injuries and fatalities relating to frozen dessert trucks, including the percentage of those injuries and fatalities experienced by children;</text></clause><clause id="id4747089647224e9f90140dfbb33eb0fa"><enum>(ii)</enum><text>potential countermeasures to modify the behavior of drivers in the vicinity of frozen dessert trucks to reduce speeds and improve safety when children approach the frozen dessert trucks; and</text></clause><clause id="id4fadd6e10de94c0d833a0dcaf7772592"><enum>(iii)</enum><text>the feasibility of requiring operators of frozen dessert trucks not to stop or park the frozen dessert trucks to vend to a child in any location at which the child would be required to cross a highway to approach the frozen dessert truck.</text></clause></subparagraph><subparagraph id="id0162e1d0f3dc45358ea8ba31199e48a8"><enum>(B)</enum><header>Countermeasures for States</header><text>Based on the results of the study under subparagraph (A), the Secretary, acting through the Administrator of the National Highway Traffic Safety Administration, shall issue guidance for State highway safety officers relating to methods of improving the safety of frozen dessert trucks and frozen dessert truck patrons.</text></subparagraph><subparagraph id="id8b2e35d48b524b9a9bf83e8f244a018e" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Report</header><text>The Secretary shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report describing the results of the study under subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
