U.S.C. 2215</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>). </text></paragraph><paragraph id="idb515a45f-3359-4483-867c-9050012bea6d" changed="not-changed"><enum>(5)</enum><header>Appropriate committees of <enum-in-header>C</enum-in-header>ongress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="iddd72829f-eeb1-45f3-bf9c-c756078bcca6" changed="not-changed"><enum>(A)</enum><text>the Committee on Environment and Public Works of the Representatives.</text></subparagraph></paragraph><paragraph id="idf7ebf71a-d80b-4853-960e-967f65903cea" changed="not-changed"><enum>(6)</enum><header>Chairman</header><text>The term <term>Chairman</term> means the Chairman of the Nuclear Regulatory Commission.</text></paragraph><paragraph id="id4895ed9e-d24f-4b72-81f6-22197ff30d30" changed="not-changed"><enum>(7)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory Commission.</text></paragraph><paragraph permit</term> has the meaning given the term in section 52.1 of title 10, Code of Federal Regulations (or a successor regulation). </text></paragraph><paragraph id="idf3dcf0f0-7c6f-47b1-9fe3-734bad85e962" changed="not-changed"><enum>(10)</enum><header>High-assay, low-enriched uranium</header><text>The term <term>high-assay, low-enriched uranium</term> means uranium with an assay greater than 5 weight percent, but less than 20 weight percent, of the uranium-235 isotope.</text></paragraph><paragraph id="idc9850662-d4d4-4443-bfe9-84f189a738cf" changed="not-changed"><enum>(11)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph><paragraph id="idc6e477b4-3549-4565-86c7-ebeb1e79a32f" changed="not-changed"><enum>(12)</enum><header>National Laboratory</header><text>The term <term>National Laboratory</term> has the meaning given the term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>).</text></paragraph><paragraph id="idcb68b1ee-5763-4df8-8d7d-542583bd75f7" changed="not-changed"><enum>(13)</enum><header>Removal; remedial action</header><text>The terms <term>removal</term> and <term>remedial action</term> have the meanings given those terms in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>). </text></paragraph><paragraph id="id3fead174-2818-48f7-a45b-0b82ef8171fd" changed="not-changed"><enum>(14)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="id6719f74f-457f-46fb-aa86-a08b13b91629" changed="not-changed"><enum>(15)</enum><header>Tribal land</header><text>The term <term>Tribal land</term> has the meaning given the term <term>Indian country</term> in section 1151 of title 18, United States Code.</text></paragraph></section><title id="idac3403f8-d2da-4137-81ab-80b699936008" style="OLC" changed="not-changed"><enum>I</enum><header>Reestablishing American international competitiveness and global leadership</header><section id="id10055e2c-9f62-4c61-b83d-526affba2d0f" changed="not-changed"><enum>101.</enum><header>International nuclear reactor export and innovation activities</header><subsection id="idb5d51dd8-61f3-4ae8-a761-c907e99d25b3" changed="not-changed"><enum>(a)</enum><header>Coordination</header><paragraph id="id236ccac6-b283-4b5c-b4d8-f2c0e2035bd4" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The Commission shall—</text><subparagraph id="id87bdf553-a13a-40c6-85f9-ee5e07e7550b" changed="not-changed"><enum>(A)</enum><text>coordinate all work of the Commission relating to—</text><clause id="id8e282cc7-69e2-43d0-9a13-f17dbb825a92" changed="not-changed"><enum>(i)</enum><text>nuclear reactor import and export licensing; and </text></clause><clause id="ida183a939-f4a8-474b-8242-17e1d8b4962d" changed="not-changed"><enum>(ii)</enum><text>international regulatory cooperation and assistance relating to nuclear reactors, including with countries that are members of the Organisation for Economic Co-operation and Development; and</text></clause></subparagraph><subparagraph id="id9cfe2724-0383-4428-8c56-fdd3b5ae4995" changed="not-changed"><enum>(B)</enum><text>support interagency and international coordination with respect to—</text><clause id="id35d71bb1-120c-48a5-b213-f28061eb9d63" changed="not-changed"><enum>(i)</enum><text>the consideration of international technical standards to establish the licensing and regulatory basis to assist the design, construction, and operation of nuclear systems; </text></clause><clause id="id91de5581-d810-4fa3-b445-393336525620" changed="not-changed"><enum>(ii)</enum><text>efforts to help build competent nuclear regulatory organizations and legal frameworks in countries seeking to develop nuclear power; and</text></clause><clause id="ida2cda0a0-5a37-41ab-971d-70ccf0c13d27" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(iii)</enum><text>exchange programs and training provided to other countries relating to nuclear regulation and oversight to improve nuclear technology licensing, in accordance with paragraph (2).</text></clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id4ecf8834-6497-4e50-8907-786dbc31917f" changed="not-changed"><enum>(2)</enum><header>Exchange programs and training</header><text>With respect to the exchange programs and training described in paragraph (1)(B)(iii), the Commission shall coordinate, as applicable, with—</text><subparagraph display-inline="no-display-inline" commented="no" id="id7a2b448b-20a2-476b-a29f-4ded80fab82a" changed="not-changed"><enum>(A)</enum><text>the Secretary; </text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idd031df24-094a-473c-ad7b-545f98671582" changed="not-changed"><enum>(B)</enum><text>National Laboratories;</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idd4efddf3-12d2-4ee7-8ea0-7a91b0aebf48" changed="not-changed"><enum>(C)</enum><text>the private sector; and </text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id7e86d64f-9c05-47a4-8d0d-a06e81bdfb48" changed="not-changed"><enum>(D)</enum><text>institutions of higher education.</text></subparagraph></paragraph></subsection><subsection id="id9e112edb-3ff0-4272-8c24-8a6794aaa1e2" changed="not-changed"><enum>(b)</enum><header>Authority To establish branch</header><text>The Commission may establish within the Office of International Programs a branch, to be known as the <quote>International Nuclear Reactor Export and Innovation Branch</quote>, to carry out such international nuclear reactor export and innovation activities as the Commission determines to be appropriate and within the mission of the Commission.</text></subsection><subsection id="id448d6320-c662-4911-80a1-c89c0d510f67" changed="not-changed"><enum>(c)</enum><header>Exclusion of international activities from the fee base</header><paragraph id="ide2559b14-5b6d-42ee-8bf8-54a463c1a9a9" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Section 102 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215</external-xref>) is amended—</text><subparagraph id="idac4d4d94-d36c-4780-a831-d3b409f54893" changed="not-changed"><enum>(A)</enum><text>in subsection (a), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id77d2c9d9-ca07-49ea-bd8d-825d08792259" changed="not-changed"><paragraph id="ide13f21d4-7dc6-4a6e-86e7-08d7816c0039" changed="not-changed"><enum>(4)</enum><header>International nuclear reactor export and innovation activities</header><text>The Commission shall identify in the annual budget justification international nuclear reactor export and innovation activities described in section 101(a) of the <short-title>American Nuclear Infrastructure Act of 2021</short-title>.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id4e7bfbdc-87fe-4bb1-9cae-575de68b8ac1" changed="not-changed"><enum>(B)</enum><text>in subsection (b)(1)(B), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5e2bfcfb-3a9c-4711-b385-21bf6be9dec5" changed="not-changed"><clause id="idac61f8a0-4428-4434-aaf5-ab6069ab4936" changed="not-changed"><enum>(iv)</enum><text>Costs for international nuclear reactor export and innovation activities described in section 101(a) of the <short-title>American Nuclear Infrastructure Act of 2021</short-title>.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ida3dafe3a-5127-4872-a4c8-088d5a87be9a" changed="not-changed"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall take effect on October 1, 2022.</text></paragraph></subsection><subsection id="idc3f833d9-2984-4bfb-8ced-b80ea0e33087" changed="not-changed"><enum>(d)</enum><header>Savings clause</header><text>Nothing in this section alters the authority of the Commission to license and regulate the civilian use of radioactive materials.</text></subsection></section><section id="id539d80ca-e1e8-4fbb-afd8-62cbf28f51ea" changed="not-changed"><enum>102.</enum><header>Denial of certain domestic licenses for national security purposes</header><subsection id="id0b215431-b3cc-4715-8d72-306d5971c019" changed="not-changed"><enum>(a)</enum><header>Definition of covered fuel</header><text>In this section, the term <term>covered fuel</term> means enriched uranium that is fabricated into fuel assemblies for nuclear reactors by an entity that—</text><paragraph id="id4f8e00ee-04cc-4ac1-a6c9-9332a4c0c2b6" changed="not-changed"><enum>(1)</enum><text>is owned or controlled by the Government of the Russian Federation or the Government of the People’s Republic of China; or</text></paragraph><paragraph id="idbbf2bca5-2db8-4a32-8f8f-4791e5fa6627" changed="not-changed"><enum>(2)</enum><text>is organized under the laws of, or otherwise subject to the jurisdiction of, the Russian Federation or the People’s Republic of China.</text></paragraph></subsection><subsection id="id4f1d46df-5014-4de7-b5b6-758d212715b3" changed="not-changed"><enum>(b)</enum><header>Prohibition on unlicensed possession or ownership of covered fuel</header><text>Unless specifically authorized by the Commission in a license issued under section 53 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2073">42 U.S.C. 2073</external-xref>) and part 70 of title 10, Code of Federal Regulations (or successor regulations), no person subject to the jurisdiction of the Commission may possess or own covered fuel.</text></subsection><subsection id="id1b711abd-01e6-4ce7-92d5-ecc348a6794d" changed="not-changed"><enum>(c)</enum><header>License To possess or own covered fuel</header><paragraph id="id1ce80830-5203-4aa4-8963-5d42745e6c53" changed="not-changed"><enum>(1)</enum><header>Consultation required prior to issuance</header><text>The Commission shall not issue a license to possess or own covered fuel under section 53 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2073">42 U.S.C. 2073</external-xref>) and part 70 of title 10, Code of Federal Regulations (or successor regulations), unless the Commission has first consulted with the Secretary and the Secretary of State before issuing the license.</text></paragraph><paragraph id="id26906b6f-79b9-43e1-b52e-ed02dddcc66b" changed="not-changed"><enum>(2)</enum><header>Prohibition on issuance of license</header><subparagraph id="id7abcfbd3-26f4-45b8-8034-bc321ee62e83" changed="not-changed"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (C), a license to possess or own covered fuel shall not be issued if the Secretary and the Secretary of State make the determination described in subparagraph (B).</text></subparagraph><subparagraph id="idac42e661-7b1f-49b0-b968-a31b1278b66f" changed="not-changed"><enum>(B)</enum><header>Determination</header><clause id="ide70610a4-4afb-4d63-b7aa-a90918d3f5ea" changed="not-changed"><enum>(i)</enum><header>In general</header><text>The determination referred to in subparagraph (A) is a determination that possession or ownership, as applicable, of covered fuel poses a threat to the national security of the United States that adversely impacts the physical and economic security of the United States.</text></clause><clause id="idc520d6f2-a92b-4ab5-8215-e043ff54102b" changed="not-changed"><enum>(ii)</enum><header>Joint determination</header><text>A determination described in clause (i) shall be jointly made by the Secretary and the Secretary of State.</text></clause><clause id="id74f974ba-1c0a-430f-be03-1109bccd4dfa" changed="not-changed"><enum>(iii)</enum><header>Timeline</header><subclause id="id3bcf7139-970b-49e9-87d5-c5bec048bf7d" changed="not-changed"><enum>(I)</enum><header>Notice of application</header><text>Not later than 30 days after the date on which the Commission receives an application for a license to possess or own covered fuel, the Commission shall notify the Secretary and the Secretary of State of the application. </text></subclause><subclause id="idafdad259-9ed5-4407-802c-c87aaa391886" changed="not-changed"><enum>(II)</enum><header>Determination</header><text>The Secretary and the Secretary of State shall have a period of 180 days, beginning on the date on which the Commission notifies the Secretary and the Secretary of State under subclause (I) of an application for a license to possess or own covered fuel, in which to make the determination described in clause (i).</text></subclause><subclause id="id81c88f9c-3811-4e56-806b-75aad639b2cf" changed="not-changed"><enum>(III)</enum><header>Commission notification</header><text>On making the determination described in clause (i), the Secretary and the Secretary of State shall immediately notify the Commission. </text></subclause><subclause id="id4debbe14-38a2-46b2-8b06-9532f1b947cc" changed="not-changed"><enum>(IV)</enum><header>Congressional notification</header><text>Not later than 30 days after the date on which the Secretary and the Secretary of State notify the Commission under subclause (III), the Commission shall notify the appropriate committees of Congress of the determination.</text></subclause><subclause id="id4c61c894-1433-4ab0-bbd3-008e038eff0a" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(V)</enum><header>Public notice</header><text>Not later than 15 days after the date on which the Commission notifies Congress under subclause (IV) of a determination made under clause (i), the Commission shall make that determination publicly available. </text></subclause></clause></subparagraph><subparagraph id="id2bb8c153-334d-4431-901e-6a66fb858386" changed="not-changed"><enum>(C)</enum><header>Effect of no determination</header><text>The prohibition described in subparagraph (A) shall not apply if the Secretary and the Secretary of State do not make the determination described in subparagraph (B) by the date described in clause (iii)(II) of that subparagraph.</text></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id46f97b60-49dd-4ca3-981c-6586b6e9b8a2" changed="not-changed"><enum>(d)</enum><header>Savings clause</header><text>Nothing in this section alters any treaty or international agreement in effect on the date of enactment of this Act.</text></subsection></section><section id="id450529E3CCDC4C4FA257D1376AD220CE" changed="not-changed"><enum>103.</enum><header>Export license requirements</header><subsection id="id96b8491adf03445baebc6773bdb235ea" changed="not-changed"><enum>(a)</enum><header>Definition of low-Enriched uranium</header><text>In this section, the term <term>low-enriched uranium</term> means uranium enriched to less than 20 percent of the uranium-235 isotope.</text></subsection><subsection id="idFF4A7A5B3BE641C4B8A3B3BD16EEB2DE" changed="not-changed"><enum>(b)</enum><header>Requirement</header><text>The Commission shall not issue an export license for the transfer of any item described in subsection (d) to a country described in subsection (c) unless the Commission makes a determination that such transfer will not be inimical to the interests of the United States.</text></subsection><subsection id="id118f9e57b499495d82f6b9588e55a2da" changed="not-changed"><enum>(c)</enum><header>Countries described</header><text>A country referred to in subsection (b) is a country that—</text><paragraph id="idc9b65cddf59440b1843d0af32a1ec38b" changed="not-changed"><enum>(1)</enum><text>has not concluded and ratified an Additional Protocol to its safeguards agreement with the International Atomic Energy Agency; or</text></paragraph><paragraph id="idcd93040d9f334701812c141f7d4b0230" changed="not-changed"><enum>(2)</enum><text>has not ratified or acceded to the amendment to the Convention on the Physical Protection of Nuclear Material, signed at Vienna and New York March 3, 1980, described in the information circular of the International Atomic Energy Agency numbered INFCIRC/274/Rev.1/Mod.1 and dated May 9, 2016.</text></paragraph></subsection><subsection id="id06865bb0a99e478d8f61e5c98865eff9" changed="not-changed"><enum>(d)</enum><header>Items described</header><text>An item referred to in subsection (b) includes—</text><paragraph id="id7b1666c945e44735849620a64fbfa135" changed="not-changed"><enum>(1)</enum><text>unirradiated nuclear fuel containing special nuclear material (as defined in section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>)), excluding low-enriched uranium;</text></paragraph><paragraph id="id11ce676f191641cf8f2afda2ffa59c98" changed="not-changed"><enum>(2)</enum><text>a nuclear reactor that uses nuclear fuel described in paragraph (1); and</text></paragraph><paragraph id="ida8a3d4a324ae4d96805714a2cb383c8c" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text>any plant or component listed in Appendix I to part 110 of title 10, Code of Federal Regulations (or successor regulations), that is involved in—</text><subparagraph commented="no" display-inline="no-display-inline" id="idEC5D79E6DAD24493B646DD929245F591" changed="not-changed"><enum>(A)</enum><text>the reprocessing of irradiated nuclear reactor fuel elements; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE8E3015E54FF4A4EA9F49F9053FDAAC5" changed="not-changed"><enum>(B)</enum><text>the separation of plutonium; or</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id2052A7673D8442CBBBE00592CDCDBBE2" changed="not-changed"><enum>(C)</enum><text>the separation of the uranium-233 isotope.</text></subparagraph></paragraph></subsection><subsection id="idb8b2e5dd59914dcabbd396d3600869c7" changed="not-changed"><enum>(e)</enum><header>Notification</header><text>If the Commission makes a determination under subsection (b) that the transfer of any item described in subsection (d) to a country described in subsection (c) will not be inimical to the interests of the United States, the Commission shall notify the appropriate committees of Congress.</text></subsection></section></title><title id="ide2a6f748-be74-4c5c-b76e-48bfe8309556" style="OLC" changed="not-changed"><enum>II</enum><header>Expanding nuclear energy through advanced nuclear technologies</header><section id="id32d66d3a-6ad0-4c1a-943a-ea11f0e78481" changed="not-changed"><enum>201.</enum><header>Advanced nuclear reactor prizes</header><text display-inline="no-display-inline">Section 103 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>; 132 Stat. 5571) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida3402aa5-33ab-4938-9e58-dd5a69bef6b0" changed="not-changed"><subsection id="id05ddcdf4-4738-4426-9abe-5df09c62f877" changed="not-changed"><enum>(f)</enum><header>Prizes for advanced nuclear reactor licensing</header><paragraph id="id0c6d8662-898a-44ab-8626-a2f94327ce8d" changed="not-changed"><enum>(1)</enum><header>Prize for advanced nuclear reactor licensing</header><subparagraph id="id32e04311-5cb8-456d-971e-9bff21d8bea0" changed="not-changed"><enum>(A)</enum><header>In general</header><text>Subject to the availability of appropriations, the Secretary is authorized to make, with respect to each award category described in subparagraph (C), an award in an amount described in subparagraph (B) to the first non-Federal entity to which the Commission issues—</text><clause id="id3d40a16f-3de4-4dd5-960c-c5fed1903d0a" changed="not-changed"><enum>(i)</enum><text>an operating license for an advanced nuclear reactor under part 50 of title 10, Code of Federal Regulations (or successor regulations), for which an application has not been approved by the Commission as of the date of enactment of this subsection; or</text></clause><clause id="id17350c6f-5041-4325-b425-e0d1b2c1ea65" changed="not-changed"><enum>(ii)</enum><text>a finding required under section 52.103(g) of title 10, Code of Federal Regulations (or successor regulations), for a combined license for an advanced nuclear reactor—</text><subclause id="id04fb80a1-5623-4992-afaa-c005ea2dea02" changed="not-changed"><enum>(I)</enum><text>that is issued under subpart C of part 52 of that title (or successor regulations); and </text></subclause><subclause id="id87b3a7f1-2e57-457c-9fd9-c1e824f81b5b" changed="not-changed"><enum>(II)</enum><text>for which an application has not been approved by the Commission as of the date of enactment of this subsection.</text></subclause></clause></subparagraph><subparagraph id="id18f87305-2939-4f93-a23c-15032a797866" changed="not-changed"><enum>(B)</enum><header>Amount of award</header><text>An award under subparagraph (A) shall be in an amount equal to the total amount assessed by the Commission and collected under section 102(b)(2) from the entity receiving the award for costs relating to the issuance of the license described in that subparagraph, including, as applicable, costs relating to the issuance of an associated construction permit described in section 50.23 of title 10, Code of Federal Regulations (or successor regulations), or early site permit (as defined in section 52.1 of that title (or successor regulations)).</text></subparagraph><subparagraph id="id07ca9bfd-fc67-46ed-81b5-0fb73c91102b" changed="not-changed"><enum>(C)</enum><header>Award categories</header><text>An award under subparagraph (A) may be made for—</text><clause id="id6dbe96a9-cb43-4742-90a3-16f9fbe1a8b6" changed="not-changed"><enum>(i)</enum><text>the first advanced nuclear reactor for which the Commission issues—</text><subclause id="id846423b5-f345-480e-a475-afd4fc62da78" changed="not-changed"><enum>(I)</enum><text>a license in accordance with clause (i) of subparagraph (A); or</text></subclause><subclause id="id5767cc6b-47d4-43a3-9ac5-20eb1ce97c57" changed="not-changed"><enum>(II)</enum><text>a finding in accordance with clause (ii) of that subparagraph;</text></subclause></clause><clause id="ide42d93cd-189b-459d-be56-5c2f0f143a3d" changed="not-changed"><enum>(ii)</enum><text>an advanced nuclear reactor that—</text><subclause id="id3cde3eaa-4f53-4fa0-be26-82b9aba1c8ef" changed="not-changed"><enum>(I)</enum><text>uses isotopes derived from spent nuclear fuel (as defined in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>)) or depleted uranium as fuel for the advanced nuclear reactor; and</text></subclause><subclause id="id0ec5f146-c444-4d80-a823-a5459367bd47" changed="not-changed"><enum>(II)</enum><text>is the first advanced nuclear reactor described in subclause (I) for which the Commission issues—</text><item id="id09869c68-1dd5-412c-980e-e2d630a58ff0" changed="not-changed"><enum>(aa)</enum><text>a license in accordance with clause (i) of subparagraph (A); or</text></item><item id="id3af51605-fe79-44f4-84d1-2470980a5547" changed="not-changed"><enum>(bb)</enum><text>a finding in accordance with clause (ii) of that subparagraph; and</text></item></subclause></clause><clause id="ida73b97c2-440c-4987-8c42-be656addf82a" changed="not-changed"><enum>(iii)</enum><text>an advanced nuclear reactor that—</text><subclause id="id918bac2c-c318-4526-9300-e9e7079d5af5" changed="not-changed"><enum>(I)</enum><text>operates flexibly to generate electricity or high temperature process heat for nonelectric applications; and</text></subclause><subclause id="idd3c99b59-b669-40dc-b424-ff7a838477c2" changed="not-changed"><enum>(II)</enum><text>is the first advanced nuclear reactor described in subclause (I) for which the Commission issues—</text><item id="idc13bbb4c-8412-4e5a-b4c1-4a35a4f217f3" changed="not-changed"><enum>(aa)</enum><text>a license in accordance with clause (i) of subparagraph (A); or</text></item><item id="idd5430497-6049-41dc-ba10-b5ea601df011" changed="not-changed"><enum>(bb)</enum><text>a finding in accordance with clause (ii) of that subparagraph.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="id8bd7a438-0b18-4db4-acaa-82427044bab1" changed="not-changed"><enum>(2)</enum><header>Federal funding limitation</header><text>An award under this subsection shall not exceed the total amount expended (excluding any expenditures made with Federal funds received for the applicable project and an amount equal to the minimum cost-share required under section 988 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352</external-xref>)) by the entity receiving the award for licensing costs relating to the project for which the award is made.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id11177823-fa43-45d6-a950-3db8a33eeec7" changed="not-changed"><enum>202.</enum><header>Report on unique licensing considerations relating to the use of nuclear energy for nonelectric applications</header><subsection id="id5bdd8db0-3153-4bfa-a27b-b6e6c669d223" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall submit to the appropriate committees of Congress a report (referred to in this section as the <term>report</term>) addressing any unique licensing issues or requirements relating to—</text><paragraph id="ide36f99ee-45aa-426d-9357-a41d05bdc49c" changed="not-changed"><enum>(1)</enum><text>the flexible operation of nuclear reactors, such as ramping power output and switching between electricity generation and nonelectric applications;</text></paragraph><paragraph id="id3f863a3b-dd81-4b00-bf70-e90a301d384d" changed="not-changed"><enum>(2)</enum><text>the use of advanced nuclear reactors exclusively for nonelectric applications; and</text></paragraph><paragraph id="idd79c44b6-d576-466c-a142-227a5f5b9cd7" changed="not-changed"><enum>(3)</enum><text>the colocation of nuclear reactors with industrial plants or other facilities.</text></paragraph></subsection><subsection id="ide78f71d8-ddff-45e4-9804-733dfe340f26" changed="not-changed"><enum>(b)</enum><header>Stakeholder input</header><text>In developing the report, the Commission shall seek input from—</text><paragraph id="id6115e90d-868a-4c9d-8a54-8426d8f0cc29" changed="not-changed"><enum>(1)</enum><text>the Secretary; </text></paragraph><paragraph id="ida4a0cb76-378c-4fa8-9770-ce2a7d8b8d79" changed="not-changed"><enum>(2)</enum><text>the nuclear energy industry; </text></paragraph><paragraph id="ida67542fd-86f3-45e2-bec4-ff27d2013275" changed="not-changed"><enum>(3)</enum><text>technology developers; </text></paragraph><paragraph id="id04ad6005-c8df-4d2b-92ca-c814f532f283" changed="not-changed"><enum>(4)</enum><text>the industrial, chemical, and medical sectors;</text></paragraph><paragraph id="idfbf7efbe-209d-4b95-b5f1-ee6294352154" changed="not-changed"><enum>(5)</enum><text>nongovernmental organizations; and</text></paragraph><paragraph id="id2c3425a0-8f8f-4e73-89ad-8e681a78ece5" changed="not-changed"><enum>(6)</enum><text>other public stakeholders.</text></paragraph></subsection><subsection id="id653c5030-e007-4bb9-80e8-465c57fdae38" changed="not-changed"><enum>(c)</enum><header>Contents</header><paragraph id="id8ca5beee-c306-4237-a9a3-976afd9f5f6e" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The report shall describe—</text><subparagraph id="id00408093-4e3d-4e11-8498-949643fbcae7" changed="not-changed"><enum>(A)</enum><text>any unique licensing issues or requirements relating to the matters described in paragraphs (1) through (3) of subsection (a), including, with respect to the nonelectric applications referred to in paragraphs (1) and (2) of that subsection, any licensing issues or requirements relating to the use of nuclear energy in—</text><clause id="idffec5065-a357-43f7-b4e6-389ada98e538" changed="not-changed"><enum>(i)</enum><text>hydrogen or other liquid and gaseous fuel or chemical production;</text></clause><clause id="id2742385a-8088-46fc-bc93-e11f900e7cb4" changed="not-changed"><enum>(ii)</enum><text>water desalination and wastewater treatment;</text></clause><clause id="id344472eb-2712-4809-baef-4316f8bbe17e" changed="not-changed"><enum>(iii)</enum><text>heat for industrial processes;</text></clause><clause id="id84a77453-d63f-4197-abb4-d2053ef0a5b5" changed="not-changed"><enum>(iv)</enum><text>district heating;</text></clause><clause id="idaa5780c8-5f72-4335-b9dc-e6dac6656028" changed="not-changed"><enum>(v)</enum><text>energy storage;</text></clause><clause id="id4fcae89c-ad3a-498a-a15f-4168d2163507" changed="not-changed"><enum>(vi)</enum><text>industrial or medical isotope production; and</text></clause><clause id="id6f453970-d1ed-493d-a6d7-4d22a5a06688" changed="not-changed"><enum>(vii)</enum><text>other applications, as identified by the Commission;</text></clause></subparagraph><subparagraph id="id2222fe93-a172-4415-8b93-a1c1c1d14a8f" changed="not-changed"><enum>(B)</enum><text>options for addressing those issues or requirements—</text><clause id="id7dd5c34f-70a5-4006-991d-75c189144369" changed="not-changed"><enum>(i)</enum><text>within the existing regulatory framework;</text></clause><clause id="id6ee60306-9d4d-4edc-84d8-c2ca777fbfcb" changed="not-changed"><enum>(ii)</enum><text>as part of the technology-inclusive regulatory framework required under subsection (a)(4) of section 103 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>) or described in the report required under subsection (e) of that section (<external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>; 132 Stat. 5575); or</text></clause><clause id="ida0f9cbca-9b21-442d-850b-6618562243f3" changed="not-changed"><enum>(iii)</enum><text>through a new rulemaking; and</text></clause></subparagraph><subparagraph id="id7156b8d0-9d35-4c2a-96be-8935eca514eb" changed="not-changed"><enum>(C)</enum><text>the extent to which Commission action is needed to implement any matter described in the report.</text></subparagraph></paragraph><paragraph id="idbd9ac517-2469-451a-8545-7e3067ffc77f" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header>Cost estimates, budgets, and timeframes</header><text>The report shall include cost estimates, proposed budgets, and proposed timeframes for implementing risk-informed and performance-based regulatory guidance in the licensing of nuclear reactors for nonelectric applications. </text></paragraph></subsection></section><section id="id3a67647d-3601-47a0-baa6-a396eb9148e3" changed="not-changed"><enum>203.</enum><header>Enabling preparations for the demonstration of advanced nuclear reactors on Department sites</header><subsection id="ide2140081-28db-451c-a954-d0e0f7501c64" changed="not-changed"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 102(b)(1)(B) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215(b)(1)(B)</external-xref>) (as amended by section 101(c)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id05065d67-27b1-462e-942d-7fdcff025b69" changed="not-changed"><clause id="id8a0bfdb5-f348-4723-be29-3a32d6054810" changed="not-changed"><enum>(v)</enum><text>Costs for—</text><subclause id="ide0f9738c-cdf3-42c2-9de6-b2bf878d17ef" changed="not-changed"><enum>(I)</enum><text>activities to review and approve or disapprove an application for an early site permit (as defined in section 52.1 of title 10, Code of Federal Regulations (or a successor regulation)) to demonstrate an advanced nuclear reactor on a Department of Energy site; and </text></subclause><subclause id="id2efdc6bc-7b48-40e9-a513-771bccd94db4" changed="not-changed"><enum>(II)</enum><text>pre-application activities relating to an early site permit (as so defined) to demonstrate an advanced nuclear reactor on a Department of Energy site.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ide3671aeb-7cf6-48e4-a5e0-18676e991185" changed="not-changed"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2022.</text></subsection></section></title><title id="id8b3b14e9-3fe6-40de-8c79-504ad3ae399c" style="OLC" changed="not-changed"><enum>III</enum><header>Preserving existing nuclear energy generation</header><section id="id14AFB7DFD6274871B442CF9DAF92E21B" section-type="subsequent-section" changed="not-changed"><enum>301.</enum><header>Nuclear reactor incentives</header><subsection id="id755B7C288346442DB00A4387668AB294" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id279D325758A646B28359372C74965AF6" changed="not-changed"><enum>(1)</enum><header>Certified nuclear reactor</header><text>The term <term>certified nuclear reactor</term> means a nuclear reactor that—</text><subparagraph id="idB8916ABCEAD949E88D3FC1A482A6D840" changed="not-changed"><enum>(A)</enum><text>operates in a competitive electricity market; and</text></subparagraph><subparagraph id="id7598EEEAE37749EF961AEEB069DE5D05" changed="not-changed"><enum>(B)</enum><text>is certified under subsection (c)(2)(A)(i) to submit a sealed bid in accordance with subsection (d).</text></subparagraph></paragraph><paragraph id="id0109A73553D34188AEF7BC001130640C" commented="no" changed="not-changed"><enum>(2)</enum><header>Credit</header><text>The term <term>credit</term> means a credit allocated to a certified nuclear reactor under subsection (e)(2).</text></paragraph></subsection><subsection id="idCF4C4B70A8A54D42B092F8422DE6A6C0" changed="not-changed"><enum>(b)</enum><header>Establishment of program</header><text>Subject to the availability of appropriations, the Administrator, in consultation with the Secretary, shall establish an emissions avoidance program—</text><paragraph id="idE4967324B84F41BCBE486D0400C08122" changed="not-changed"><enum>(1)</enum><text>to evaluate nuclear reactors that are projected to cease operations due to economic factors; and</text></paragraph><paragraph id="id4787AD8AE3904BDD81D95E88A0E8F13D" changed="not-changed"><enum>(2)</enum><text>to allocate credits to certified nuclear reactors that are selected under paragraph (1)(B) of subsection (e) to receive credits under paragraph (2) of that subsection.</text></paragraph></subsection><subsection id="idF07AAEFD602C42FD9288707A5E6A691E" changed="not-changed"><enum>(c)</enum><header>Certification</header><paragraph id="idF694F8AE7F3942A7B0C3DA9D1F7DA097" commented="no" changed="not-changed"><enum>(1)</enum><header>Application</header><subparagraph commented="no" id="idB632DB2A538F4F97AB0009D8872E6DD4" changed="not-changed"><enum>(A)</enum><header>In general</header><text>In order to be certified under paragraph (2)(A)(i), the owner or operator of a nuclear reactor that is projected to cease operations due to economic factors shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator determines to be appropriate, including—</text><clause commented="no" id="idD343C35135B345C8BA10363DE390840E" changed="not-changed"><enum>(i)</enum><text>information on the operating costs necessary to make the examination described in paragraph (2)(A)(ii)(II), including—</text><subclause commented="no" id="id335BDA1F26E042249C22D468652315FC" changed="not-changed"><enum>(I)</enum><text>the average annual operating loss per megawatt-hour expected to be incurred by the nuclear reactor over the 4-year period for which credits would be allocated; </text></subclause><subclause commented="no" id="id3B7831826F97440CAF8B985588FFC603" changed="not-changed"><enum>(II)</enum><text>any private or publicly available data with respect to current or projected bulk power market prices; </text></subclause><subclause commented="no" id="idFC13FCDE96A34D5398463817FFC97E8D" changed="not-changed"><enum>(III)</enum><text>out-of-market revenue streams;</text></subclause><subclause commented="no" id="idC2CB0D36FFA0440F938E285739534581" changed="not-changed"><enum>(IV)</enum><text>operations and maintenance costs;</text></subclause><subclause commented="no" id="id35E63CB3CBD3403FA7C2AA88DDDC00FD" changed="not-changed"><enum>(V)</enum><text>capital costs, including fuel; and</text></subclause><subclause commented="no" id="idCCA5A17CEA8248CF830AE8F0C35CC2A0" changed="not-changed"><enum>(VI)</enum><text>operational and market risks;</text></subclause></clause><clause commented="no" id="id089C055DCC814BAF9ECD663EEA2C8347" changed="not-changed"><enum>(ii)</enum><text>an estimate of the potential incremental emissions of carbon dioxide, nitrogen oxides, sulfur oxides, particulate matter, and hazardous air pollutants that would result if the nuclear reactor were to cease operations;</text></clause><clause commented="no" id="id70568DDED66B487B8B485A10A0A4B350" changed="not-changed"><enum>(iii)</enum><text>information on the source of recovered uranium and the location where the uranium is converted, enriched, and fabricated into fuel assemblies for the nuclear reactor for the 4-year period for which credits would be allocated; and</text></clause><clause commented="no" id="id87A4BF84EDDD4A2DAB34D9F9A69B4168" changed="not-changed"><enum>(iv)</enum><text>a detailed plan to sustain operations at the conclusion of the applicable 4-year period for which credits would be allocated—</text><subclause id="idD3C5CA120A5D447381C4D25EC4E7955B" changed="not-changed"><enum>(I)</enum><text>without receiving additional credits; or </text></subclause><subclause id="id9B30E98E1F6B4916985FFB94D549E668" changed="not-changed"><enum>(II)</enum><text>with the receipt of additional credits of a lower amount than the credits allocated during that 4-year credit period. </text></subclause></clause></subparagraph><subparagraph commented="no" id="id4C25926F6E2A4A04AEEEF4D05593E0E1" changed="not-changed"><enum>(B)</enum><header>Timeline</header><text>The Administrator shall accept applications described in subparagraph (A)—</text><clause commented="no" id="idB4E860EA5C724AF88C397A9F5CA1FFFB" changed="not-changed"><enum>(i)</enum><text>until the date that is 120 days after the date of enactment of this Act; and</text></clause><clause commented="no" id="id2A7B29C14E774B88B29C90E143440357" changed="not-changed"><enum>(ii)</enum><text>not less frequently than every year thereafter.</text></clause></subparagraph></paragraph><paragraph id="idE6C668B05E864C34A18E7E0472BEEF7B" changed="not-changed"><enum>(2)</enum><header>Determination to certify</header><subparagraph id="idA346C7F87ED54F298C7E296B31AAC736" changed="not-changed"><enum>(A)</enum><header>Determination</header><clause id="id1B8FEEF269D24E4F8BDC058AC0060643" changed="not-changed"><enum>(i)</enum><header>In general</header><text>Not later than 60 days after the applicable date under subparagraph (B) of paragraph (1), the Administrator, in consultation with the Secretary, shall determine whether to certify, in accordance with clauses (ii) and (iii), each nuclear reactor for which an application is submitted under subparagraph (A) of that paragraph.</text></clause><clause id="id1B0DDD7B4B62473E86DDBC9691FB862D" changed="not-changed"><enum>(ii)</enum><header>Minimum requirements</header><text>To the maximum extent practicable, the Administrator, in consultation with the Secretary, shall only certify a nuclear reactor under clause (i) if—</text><subclause id="id10839F636A544AAC9A505D642B752FA9" changed="not-changed"><enum>(I)</enum><text>the nuclear reactor has a good safety record, as determined by the Action Matrix of the Commission or the Performance Indicators of the Reactor Oversight Process, such that the nuclear reactor falls under the <quote>licensee response</quote> column indicating no current significant safety issues;</text></subclause><subclause id="idF245204A16AC4644939078A882496907" changed="not-changed"><enum>(II)</enum><text>after considering the information submitted under paragraph (1)(A)(i), the Administrator determines that the nuclear reactor is projected to cease operations due to economic factors; and</text></subclause><subclause id="id38D4F2FD6E46491CB5C972C8955839B2" changed="not-changed"><enum>(III)</enum><text>after considering the estimate submitted under paragraph (1)(A)(ii), the Administrator determines that emissions of carbon dioxide, nitrogen oxides, sulfur oxides, particulate matter, and hazardous air pollutants would increase if the nuclear reactor were to cease operations and be replaced with other types of power generation.</text></subclause></clause><clause id="idCFB3655ED17F465FBD4B3C0C76D4C97C" changed="not-changed"><enum>(iii)</enum><header>Priority</header><text>In determining whether to certify a nuclear reactor under clause (i), the Administrator, in consultation with the Secretary, shall give priority to a nuclear reactor that uses uranium that is recovered, converted, enriched, and fabricated into fuel assemblies in the United States. </text></clause></subparagraph><subparagraph id="id8CEA2C487D324099B763675E116F9619" changed="not-changed"><enum>(B)</enum><header>Notice</header><text>For each application received under paragraph (1)(A), the Administrator, in consultation with the Secretary, shall provide to the applicable owner or operator, as applicable—</text><clause id="idA5530B8DA08D447798EE485A0EA52ADE" changed="not-changed"><enum>(i)</enum><text>a notice of the certification of the applicable nuclear reactor; or</text></clause><clause id="id83908364358F49B5B258D21FE5B2875D" changed="not-changed"><enum>(ii)</enum><text>a notice that describes the reasons why the certification of the applicable nuclear reactor was denied.</text></clause></subparagraph></paragraph></subsection><subsection id="id4ECCBEB0514A4088918C179E51308E1A" changed="not-changed"><enum>(d)</enum><header>Bidding process</header><paragraph id="id899DF9F2DB14438AA8CB64D0C04F480D" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Administrator shall establish a deadline by which each certified nuclear reactor shall submit to the Administrator a sealed bid that—</text><subparagraph id="id813DC3C7B5EB416086B01F29F8BE15D7" changed="not-changed"><enum>(A)</enum><text>describes the price per megawatt-hour required to maintain operations of the certified nuclear reactor during the 4-year period for which the certified nuclear reactor would receive credits; and</text></subparagraph><subparagraph id="id17E9DE80F18045D0BE0D196AAE1335CE" changed="not-changed"><enum>(B)</enum><text>includes a commitment, subject to the receipt of credits, to provide a specific number of megawatt-hours of generation during the 4-year period for which credits would be allocated. </text></subparagraph></paragraph><paragraph id="idAE4E1274C6B74366AB9C93828A89D300" changed="not-changed"><enum>(2)</enum><header>Requirement</header><text>The deadline established under paragraph (1) shall be not later than 30 days after the first date on which the Administrator has made the determination described in paragraph (2)(A)(i) of subsection (c) with respect to each application submitted under paragraph (1)(A) of that subsection.</text></paragraph></subsection><subsection id="idE50968F359FD4DBC8E4C863BEB721296" changed="not-changed"><enum>(e)</enum><header>Allocation</header><paragraph id="id935A3E6A5FFF40FF8DFDB2A81DAAF8FE" changed="not-changed"><enum>(1)</enum><header>Auction</header><text>The Administrator, in consultation with the Secretary, shall—</text><subparagraph id="id998C8B9191C24310AEE035B794D0F6D4" changed="not-changed"><enum>(A)</enum><text>in consultation with the heads of applicable Federal agencies, establish a process for evaluating bids submitted under subsection (d)(1) through an auction process; and</text></subparagraph><subparagraph id="id15A36871CAB441CE9AFFD5B675889AD9" changed="not-changed"><enum>(B)</enum><text>select certified nuclear reactors to be allocated credits.</text></subparagraph></paragraph><paragraph id="id1790B341A8B54E55BBEC24EAC0DC986C" commented="no" changed="not-changed"><enum>(2)</enum><header>Credits</header><text>Subject to subsection (f)(2), on selection under paragraph (1), a certified nuclear reactor shall be allocated credits for a 4-year period beginning on the date of the selection.</text></paragraph><paragraph id="idA0DD003E5D044293AE9B57DD105DAE71" changed="not-changed"><enum>(3)</enum><header>Requirement</header><text>To the maximum extent practicable, the Administrator shall use the amounts made available for credits under this section to allocate credits to as many certified nuclear reactors as possible.</text></paragraph></subsection><subsection id="idB7AB280972D848E0998D139FCA8E315E" changed="not-changed"><enum>(f)</enum><header>Renewal</header><paragraph id="id49BBD057EDD0444EACD6B49193E476B4" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The owner or operator of a certified nuclear reactor may seek to recertify the nuclear reactor in accordance with this section.</text></paragraph><paragraph id="idE5FCCAB9EE4C4831B9EF2FDD9676B0CB" changed="not-changed"><enum>(2)</enum><header>Limitation</header><text>Notwithstanding any other provision of this section, the Administrator may not allocate any credits after September 30, 2027.</text></paragraph></subsection><subsection id="idA3BEF8C8F2B94549AD5187571AF30474" changed="not-changed"><enum>(g)</enum><header>Additional requirements</header><paragraph id="idEE72E29F34034EB3AAD977EDAE3D0E54" changed="not-changed"><enum>(1)</enum><header>Audit</header><text>During the 4-year period beginning on the date on which a certified nuclear reactor first receives a credit, the Administrator, in consultation with the Secretary, shall periodically audit the certified nuclear reactor.</text></paragraph><paragraph id="idAA81D8FE82934AF1BBA2D0F81808ED0A" changed="not-changed"><enum>(2)</enum><header>Recapture</header><text>The Administrator shall, by regulation, provide for the recapture of the allocation of any credit to a certified nuclear reactor that, during the period described in paragraph (1)—</text><subparagraph id="id220E32FE0AA14CB5B1406C97BB4C0B43" changed="not-changed"><enum>(A)</enum><text>terminates operations; or</text></subparagraph><subparagraph id="id8330B78F76FF4E4C9B21E92EE2C22FC1" changed="not-changed"><enum>(B)</enum><text>does not operate at an annual loss in the absence of an allocation of credits to the certified nuclear reactor.</text></subparagraph></paragraph><paragraph id="id548F31B9276B425A8541D368774B7E3D" changed="not-changed"><enum>(3)</enum><header>Confidentiality</header><text>The Administrator, in consultation with the Secretary, shall establish procedures to ensure that any confidential, private, proprietary, or privileged information that is included in a sealed bid submitted under this section is not publicly disclosed or otherwise improperly used.</text></paragraph></subsection><subsection id="id84B04ABE7748477F8888CAA4D31514C1" changed="not-changed"><enum>(h)</enum><header>Report</header><text>Not later than January 1, 2025, the Comptroller General of the United States shall submit to Congress a report with respect to the credits allocated to certified nuclear reactors, which shall include—</text><paragraph id="idC3009B9B12BA4E9D99D5FC2695985844" changed="not-changed"><enum>(1)</enum><text>an evaluation of the effectiveness of the credits in avoiding emissions of carbon dioxide, nitrogen oxides, sulfur oxides, particulate matter, and hazardous air pollutants while ensuring grid reliability;</text></paragraph><paragraph id="id783DC720B41D4E81B4FA3748A7D7B4EA" changed="not-changed"><enum>(2)</enum><text>a quantification of the ratepayer savings achieved under this section; and</text></paragraph><paragraph id="id4043C82ACCA14B518B46CC574DA2537C" changed="not-changed"><enum>(3)</enum><text>any recommendations to renew or expand the credits.</text></paragraph></subsection><subsection id="idF74495957DE0494B9F9E56DE78357150" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section for each of fiscal years 2022 through 2027. </text></subsection></section><section id="idacf3ea3b-7db8-43ce-9b03-eafd45085f1e" changed="not-changed"><enum>302.</enum><header>Report on lessons learned during the COVID–19 public health emergency</header><subsection id="idd2a4fdde-1bff-4598-8a8c-648da12c31c2" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall submit to the appropriate committees of Congress and make publicly available a report on actions taken by the Commission during the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, with respect to COVID–19.</text></subsection><subsection id="id98aef227-272b-4ff9-8e48-4810bf2441b3" changed="not-changed"><enum>(b)</enum><header>Contents</header><text>The report under subsection (a) shall include—</text><paragraph id="idc5b06295-c730-458a-83a1-e8847125efcd" changed="not-changed"><enum>(1)</enum><text>an identification of the processes, procedures, and other regulatory policies that were revised or temporarily suspended during the public health emergency described in subsection (a);</text></paragraph><paragraph id="id55c87f8c-7b67-4f6d-99ff-f908ecf92c9e" changed="not-changed"><enum>(2)</enum><text>a review of actions, if any, taken by the Commission that examines how any revision or temporary suspension of a process, procedure, or other regulatory policy identified under paragraph (1) may or may not have compromised the ability of the Commission to license and regulate the civilian use of radioactive materials in the United States to protect public health and safety, promote the common defense and security, and protect the environment; </text></paragraph><paragraph id="id984e3bd5-2a1e-4737-98f6-131796bcd9c3" changed="not-changed"><enum>(3)</enum><text>a description of any process efficiencies or challenges that resulted from the matters identified under paragraph (1);</text></paragraph><paragraph id="idcc6443ec-bdec-42a5-b7d5-cdcdf2d1e474" changed="not-changed"><enum>(4)</enum><text>a discussion of lessons learned from the matters described in paragraphs (1), (2), and (3);</text></paragraph><paragraph id="id40072fdd-3594-4d0e-89dc-33412caf756a" changed="not-changed"><enum>(5)</enum><text>a list of actions that the Commission may take to incorporate into the licensing activities and regulations of the Commission, without compromising the mission of the Commission—</text><subparagraph id="id8cc42529-6a50-48ce-a4c1-754b9ac0f39a" changed="not-changed"><enum>(A)</enum><text>the lessons described in paragraph (4); and </text></subparagraph><subparagraph id="id0c559526-ce3c-445e-a6d1-27f3c06ebe98" changed="not-changed"><enum>(B)</enum><text>the information provided under paragraphs (2) and (3); and</text></subparagraph></paragraph><paragraph id="id7ad6d3c2-401d-48e8-9a59-304ededa8fe1" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(6)</enum><text>a description of when the actions described in paragraph (5) may be implemented.</text></paragraph></subsection></section><section id="idf855ee66-8497-4417-b90f-977949c532b0" changed="not-changed"><enum>303.</enum><header>Investment by allies</header><subsection id="ida2c4964c-d0d5-49d6-9724-68effeebf393" changed="not-changed"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The prohibitions against issuing certain licenses for utilization facilities to certain corporations and other entities described in the second sentence of section 103 d. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133(d)</external-xref>) and the second sentence of section 104 d. of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2134">42 U.S.C. 2134(d)</external-xref>) shall not apply to an entity described in subsection (b) if the Commission determines that issuance of the applicable license to that entity is not inimical to—</text><paragraph id="idb086db22-306f-43ee-b81e-cd5d39e7643f" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the common defense and security; or </text></paragraph><paragraph id="id2341a262-5bcc-45b3-a61f-d64d7e165077" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the health and safety of the public.</text></paragraph></subsection><subsection id="id6bf0afd8-a6c7-4c17-b262-f5d7e042306d" changed="not-changed"><enum>(b)</enum><header>Entities described</header><text display-inline="yes-display-inline">An entity referred to in subsection (a) is a corporation or other entity that is owned, controlled, or dominated by—</text><paragraph id="id96e504e4-2f58-4063-8987-4960bd5a7de9" changed="not-changed"><enum>(1)</enum><text>the government of—</text><subparagraph id="id6d721f5d-858e-46a7-9c96-2937d4121848" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a country that is a member of the Group of Seven as of November 25, 2020, which includes the United Kingdom, Germany, Canada, Japan, France, and Italy; or</text></subparagraph><subparagraph id="idbefdd2ff-a5a4-429f-98d4-de779fe22e20" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the Republic of Korea;</text></subparagraph></paragraph><paragraph id="id6fb07c7f-000a-4060-9989-75aebf8c7992" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">a corporation that is incorporated in a country described in subparagraph (A) or (B) of paragraph (1); or</text></paragraph><paragraph id="iddacea2e2-2b06-461f-8fbd-bc40368f2aed" changed="not-changed"><enum>(3)</enum><text>an alien who is a national of a country described in subparagraph (A) or (B) of paragraph (1). </text></paragraph></subsection><subsection id="idb43dff74-809a-4f9d-9391-b2aa8a7073d4" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(c)</enum><header>Technical amendment</header><text>Section 103 d. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133(d)</external-xref>) is amended, in the second sentence, by striking <quote>any any</quote> and inserting <quote>any</quote>. </text></subsection><subsection display-inline="no-display-inline" commented="no" id="idA66973D1985042559955AACC4B5A83DD" changed="not-changed"><enum>(d)</enum><header>Savings clause</header><text>Nothing in this section affects the requirements of section 721 of the Defense Production Act of 1950 (<external-xref changed="not-changed"><enum>IV</enum><header>Revitalizing America's nuclear supply chain infrastructure and workforce</header><section id="id0f044b04-3097-46d6-bd7d-3fbc765c7c27" changed="not-changed"><enum>401.</enum><header>Report on advanced methods of manufacturing and construction for nuclear energy applications</header><subsection id="id2f625a1c-b4ae-40d0-a98a-0ce77dca1ce8" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall submit to the appropriate committees of Congress a report (referred to in this section as the <term>report</term>) on manufacturing and construction for nuclear energy applications.</text></subsection><subsection id="idaea7b2ad-d9e8-4af6-aea2-efe8089e7be5" changed="not-changed"><enum>(b)</enum><header>Stakeholder input</header><text>In developing the report, the Commission shall seek input from—</text><paragraph id="id5f11609f-fb28-40f9-b7cf-2785ad6a5755" changed="not-changed"><enum>(1)</enum><text>the Secretary; </text></paragraph><paragraph id="id5295cf77-8520-498a-b519-35364e00d7c0" changed="not-changed"><enum>(2)</enum><text>the nuclear energy industry;</text></paragraph><paragraph id="idc6f83c70-cdfd-4298-b256-a4ae45270f93" changed="not-changed"><enum>(3)</enum><text>National Laboratories;</text></paragraph><paragraph id="id5909b76c-3489-4f00-8883-318afd3d691d" changed="not-changed"><enum>(4)</enum><text>institutions of higher education;</text></paragraph><paragraph id="id42cdd3f3-c404-4632-b823-96677a619b40" changed="not-changed"><enum>(5)</enum><text>nuclear and manufacturing technology developers;</text></paragraph><paragraph id="idbfd546ca-9d83-4246-9ccd-598daab21cae" changed="not-changed"><enum>(6)</enum><text>the manufacturing and construction industries;</text></paragraph><paragraph id="idbedb96a9-75df-43fa-8905-a3b887c211db" changed="not-changed"><enum>(7)</enum><text>standards development organizations;</text></paragraph><paragraph id="id3e4c27d3-6949-4e50-a2aa-8ae3c8c1d66c" changed="not-changed"><enum>(8)</enum><text>labor unions;</text></paragraph><paragraph id="idc86c2944-a237-4df8-85f2-0c4902d2ba69" changed="not-changed"><enum>(9)</enum><text>nongovernmental organizations; and</text></paragraph><paragraph id="id8bddeae9-04b3-49b6-9175-ebdf260eb95b" changed="not-changed"><enum>(10)</enum><text>other public stakeholders.</text></paragraph></subsection><subsection id="idfd0b06dd-d154-4e76-9448-a426edbda077" changed="not-changed"><enum>(c)</enum><header>Contents</header><paragraph id="id93b5764c-30d4-4b72-a655-12807a76f77d" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The report shall—</text><subparagraph id="id59ed532b-28f4-4702-81e2-51b420b90b00" changed="not-changed"><enum>(A)</enum><text>examine any unique licensing issues or requirements relating to the use of innovative—</text><clause id="id5b2ef184-e05f-41d4-9516-8d432705e6a2" changed="not-changed"><enum>(i)</enum><text>advanced manufacturing processes; and</text></clause><clause id="idba61b5c7-58a5-4369-87b0-f00950376ef2" changed="not-changed"><enum>(ii)</enum><text>advanced construction techniques;</text></clause></subparagraph><subparagraph id="idfa5463c4-e966-48ab-9714-72deb23103dd" changed="not-changed"><enum>(B)</enum><text>examine—</text><clause id="id99d7158c-de73-406d-b4d2-d275ac978d52" changed="not-changed"><enum>(i)</enum><text>the requirements for nuclear-grade components in manufacturing and construction for nuclear energy applications;</text></clause><clause id="id7065f636-d897-4982-9bad-c0afcafe25cc" changed="not-changed"><enum>(ii)</enum><text>opportunities to use standard materials, parts, or components in manufacturing and construction for nuclear energy applications; and</text></clause><clause id="idbaa4b9fa-e625-476c-bd69-6a65c917f138" changed="not-changed"><enum>(iii)</enum><text>opportunities to use standard materials that are in compliance with existing codes to provide acceptable approaches to support or encapsulate new materials that do not yet have applicable codes; </text></clause></subparagraph><subparagraph id="id8b036ed2-9f3d-4c83-9880-79a8d2f80bad" changed="not-changed"><enum>(C)</enum><text>identify any safety aspects of innovative advanced manufacturing processes and advanced construction techniques that are not addressed by existing codes and standards, so that generic guidance may be updated or created, as necessary;</text></subparagraph><subparagraph id="idf39fdb3b-325a-440b-aa0a-34ecc5e2c386" changed="not-changed"><enum>(D)</enum><text>identify options for addressing the issues, requirements, and opportunities examined under subparagraphs (A) and (B)—</text><clause id="id3d49a3b8-87fd-408f-bacb-69e4dc884bca" changed="not-changed"><enum>(i)</enum><text>within the existing regulatory framework; or</text></clause><clause id="id0fc9afb1-5bff-4b65-9d3f-3438f70660be" changed="not-changed"><enum>(ii)</enum><text>through a new rulemaking; and</text></clause></subparagraph><subparagraph id="id3868cb89-b88c-4638-8030-0837aab83244" changed="not-changed"><enum>(E)</enum><text>describe the extent to which Commission action is needed to implement any matter described in the report.</text></subparagraph></paragraph><paragraph id="id6ca054cd-a690-4292-913e-34909caf64db" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header>Cost estimates, budgets, and timeframes</header><text>The report shall include cost estimates, proposed budgets, and proposed timeframes for implementing risk-informed and performance-based regulatory guidance for manufacturing and construction for nuclear energy applications.</text></paragraph></subsection></section><section id="idfdd482bc-2532-4f9a-9cad-289f539bab6a" changed="not-changed"><enum>402.</enum><header>Nuclear energy traineeship</header><text display-inline="no-display-inline">Section 313 of division C of the Omnibus Appropriations Act, 2009 (<external-xref legal-doc="usc" parsable-cite="usc/42/16274a">42 U.S.C. 16274a</external-xref>), is amended—</text><paragraph changed="not-changed" id="id44E9C12BA38B4D55905E863560CBADC2"><enum>(1)</enum><text>in subsection (a), by striking <quote>Nuclear 16271(b)</external-xref>).</text></paragraph><paragraph changed="not-changed" id="id715DCA4ED6174A54AC6BC9563797E621"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> subprogram</header><paragraph changed="not-changed" id="idBC8B2EFC3E194D9FB0DFAB31A51D52C6"><enum>(1)</enum><header>In general</header><text>The Commission shall establish, as a subprogram of the Program, a nuclear energy traineeship subprogram under which the Commission, in coordination with institutions of higher education and trade schools, shall competitively award traineeships that provide focused training to meet critical mission needs of the Commission and nuclear workforce needs, including needs relating to—</text><subparagraph id="idfb394f08-fb61-4295-a726-add8c9a86855" changed="not-changed"><enum>(A)</enum><text>nuclear criticality safety; and</text></subparagraph><subparagraph id="idb873f309-7763-4c91-85bb-c92417672237" changed="not-changed"><enum>(B)</enum><text>the nuclear tradecraft workforce. </text></subparagraph></paragraph><paragraph id="id39f7ae30-ef16-457b-aa5e-df6aa383a799" changed="not-changed"><enum>(2)</enum><header>Requirements</header><text>In carrying out the nuclear energy traineeship subprogram described in paragraph (1), the Commission shall—</text><subparagraph id="id583abd52-02b8-4431-8220-c6375a8c7aa3" changed="not-changed"><enum>(A)</enum><text>coordinate with the Secretary of Energy to prioritize the funding of traineeships that focus on—</text><clause id="id2748da4d-ccd0-46c6-95f9-a66683332c4c" commented="no" changed="not-changed"><enum>(i)</enum><text>nuclear workforce needs; and</text></clause><clause id="id13d48c54-bd80-4116-a79f-33e34d335477" commented="no" changed="not-changed"><enum>(ii)</enum><text>critical mission needs of the Commission;</text></clause></subparagraph><subparagraph id="id46234d9d-4c7c-4f9d-bf69-5502a478f643" changed="not-changed"><enum>(B)</enum><text>encourage appropriate partnerships among—</text><clause id="id6f8a785d-62ac-4f0e-a8a3-6fae9ab53327" changed="not-changed"><enum>(i)</enum><text>National Laboratories;</text></clause><clause id="ide2fe6e50-1e51-41b9-a986-cdef79403dba" changed="not-changed"><enum>(ii)</enum><text>institutions of higher education;</text></clause><clause id="iddb048140-e066-488c-940d-3bbe37e59bd2" changed="not-changed"><enum>(iii)</enum><text>trade schools; and </text></clause><clause id="id9fd4e84f-e7c0-4ec1-bb01-352380f9f7a6" changed="not-changed"><enum>(iv)</enum><text>the nuclear energy industry; and</text></clause></subparagraph><subparagraph id="ida41cd6fc-4bc3-4b55-b291-9c2e02a4bb8c" changed="not-changed"><enum>(C)</enum><text>on an annual basis, evaluate nuclear workforce needs for the purpose of implementing traineeships in focused topical areas that—</text><clause id="idae88cdfb-ccce-4ddb-a70e-aa0799ed0ea8" changed="not-changed"><enum>(i)</enum><text>address the workforce needs of the nuclear energy community; and</text></clause><clause id="id55520991-cb88-4d94-9453-10d4c29e7adb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>support critical mission needs of the Commission.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="id92a06352-e76e-4a51-8d4d-8c1b9c6e1ae0" style="OLC" changed="not-changed"><enum>V</enum><header>Miscellaneous</header><section id="id05fff4d5-bbcf-4d0c-9c79-f327cfb22d08" changed="not-changed"><enum>501.</enum><header>Annual report on the spent nuclear fuel and high-level radioactive waste inventory in the United States</header><subsection id="id515bb0e9-13c6-4030-befa-17e6a0306d50" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id38724143-dc56-4d7c-b56c-f3ab27d02aa3" commented="no" changed="not-changed"><enum>(1)</enum><header>High-level radioactive waste</header><text>The term <term>high-level radioactive waste</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text></paragraph><paragraph id="ide3e1b449-52a5-4694-9758-6892934ad3eb" commented="no" changed="not-changed"><enum>(2)</enum><header>Spent nuclear fuel</header><text>The term <term>spent nuclear fuel</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text></paragraph><paragraph id="id6d589c9a-1997-45a6-88e5-f4808927e839" commented="no" changed="not-changed"><enum>(3)</enum><header>Standard contract</header><text>The term <term>standard contract</term> has the meaning given the term <term>contract</term> in section 961.3 of title 10, Code of Federal Regulations (or a successor regulation).</text></paragraph></subsection><subsection id="id1a8dd28d-6923-41fe-92fe-b4da031286e3" changed="not-changed"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than January 1, 2023, and annually thereafter, the Secretary shall submit to Congress a report that describes—</text><paragraph id="idf9698ee7-44bb-4a81-85f4-02481133968f" changed="not-changed"><enum>(1)</enum><text>the annual and cumulative amount of payments made by the United States to the holder of a standard contract due to a partial breach of contract under the <act-name parsable-cite="NWPA">Nuclear Waste Policy Act of 1982</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101 et seq.</external-xref>) resulting in financial damages to the holder;</text></paragraph><paragraph id="id93993783-9c4b-47cb-8420-a023fbe167c7" changed="not-changed"><enum>(2)</enum><text>the amount spent by the Department to reduce future payments projected to be made by the United States to any holder of a standard contract due to a partial breach of contract under the <act-name parsable-cite="NWPA">Nuclear Waste Policy Act of 1982</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101 et seq.</external-xref>);</text></paragraph><paragraph id="id52472872-2e7f-4882-a5c0-6fffd154fec2" changed="not-changed"><enum>(3)</enum><text>the cumulative amount spent by the Department to store, manage, and dispose of spent nuclear fuel and high-level radioactive waste in the United States as of the date of the report;</text></paragraph><paragraph id="id8f55802c-9f4c-4078-b84f-3df02a871040" changed="not-changed"><enum>(4)</enum><text>the projected lifecycle costs to store, manage, transport, and dispose of the projected inventory of spent nuclear fuel and high-level radioactive waste in the United States, including spent nuclear fuel and high-level radioactive waste expected to be generated from existing reactors through 2050;</text></paragraph><paragraph id="id5fafe558-96e0-4b28-82e2-1e61d342ec9d" changed="not-changed"><enum>(5)</enum><text>any mechanisms for better accounting of liabilities for the lifecycle costs of the spent nuclear fuel and high-level radioactive waste inventory in the United States; and</text></paragraph><paragraph id="id026f9c5b-3853-4ee9-ac24-94cb101cd25f" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(6)</enum><text>any recommendations for improving the methods used by the Department for the accounting of spent nuclear fuel and high-level radioactive waste costs and liabilities. </text></paragraph></subsection></section><section id="idadb04530-acb3-46b6-a108-81de2972c1c6" changed="not-changed"><enum>502.</enum><header>Authorization of appropriations for superfund actions at abandoned mining sites on Tribal land</header><subsection id="id91efbece-2925-4923-a892-519b0de29196" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idd7729c08-90e8-4fd3-9f41-61ac2c79fe23" changed="not-changed"><enum>(1)</enum><header>Eligible non-NPL site</header><text>The term <term>eligible non-NPL site</term> means a site that—</text><subparagraph id="id4a27c160-8fa8-47c0-bfde-1a7999ceeab6" changed="not-changed"><enum/></subparagraph><subparagraph commented="no" display-inline="yes-display-inline" id="id46f05377-86a0-4de8-9093-0d72826eb71f" changed="not-changed"><enum>(A)</enum><text>is not on the National Priorities List; but</text></subparagraph><subparagraph id="idc3ef78d3-fea1-402b-ad57-7369e5139887" changed="not-changed"><enum>(B)</enum><text>the Administrator determines would be eligible for listing on the National Priorities List based on the presence of hazards from contamination at the site, applying the hazard ranking system described in section 105(c) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605(c)</external-xref>).</text></subparagraph></paragraph><paragraph id="idefb49436-ae87-4bbd-9417-4a8e706600e0" changed="not-changed"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph><paragraph id="idd7051df8-7d6f-4651-b414-3eb7fe51ae01" changed="not-changed"><enum>(3)</enum><header>National Priorities List</header><text>The term <term>National Priorities List</term> means the National Priorities List developed by the President in accordance with section 105(a)(8)(B) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605(a)(8)(B)</external-xref>).</text></paragraph></subsection><subsection id="idE123C8392BC944FEA9039702575400A8" changed="not-changed"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for each of fiscal years 2022 through 2031, to remain available until expended—</text><paragraph id="id51037CFCC5474D77822AD69F374565CF" changed="not-changed"><enum>(1)</enum><text>$97,000,000 to the Administrator to carry out this section (except for subsection (d)); and</text></paragraph><paragraph id="id9849F52BFC3046CB9AC45ED167BBF872" changed="not-changed"><enum>(2)</enum><text>$3,000,000 to the Administrator of the Agency for Toxic Substances and Disease Registry to carry out subsection (d).</text></paragraph></subsection><subsection id="id64beefa8-63f8-4218-a8a3-3ae2522f3181" changed="not-changed"><enum>(c)</enum><header>Uses of amounts</header><text>Amounts appropriated under subsection (b)(1) shall be used by the Administrator—</text><paragraph id="id70d158d2-e82a-4f5b-b9f8-a472d162bb41" changed="not-changed"><enum>(1)</enum><text>to carry out removal actions on abandoned mine land located on Tribal land;</text></paragraph><paragraph id="idf9170ac0-ba69-439f-8a45-e3169163107e" changed="not-changed"><enum>(2)</enum><text>to carry out remedial actions on abandoned mine land located on Tribal land at—</text><subparagraph id="idd880e211-08c3-48ad-877f-bf6979b95ba5" changed="not-changed"><enum>(A)</enum><text>eligible non-NPL sites; and </text></subparagraph><subparagraph id="id0ff1c36f-2901-470b-a31d-5a1ee8bdb7c2" changed="not-changed"><enum>(B)</enum><text>sites listed on the National Priorities List; and</text></subparagraph></paragraph><paragraph id="idbca2b2de-d184-4a64-b956-6f5932b00459" changed="not-changed"><enum>(3)</enum><text>to make grants under subsection (e).</text></paragraph></subsection><subsection id="id4ad2c7e6-cd86-4e6d-9ed7-8e985feea74b" changed="not-changed"><enum>(d)</enum><header>Health assessments</header><text>Subject to the availability of appropriations, the Agency for Toxic Substances and Disease Registry, in coordination with Tribal health authorities, shall perform 1 or more health assessments at each eligible non-NPL site that is located on Tribal land.</text></subsection><subsection id="id1deb089d-2f2a-4cdf-b20d-5cac857d99bc" commented="no" changed="not-changed"><enum>(e)</enum><header>Grants for technical assistance</header><paragraph id="ide3c38822-798b-4ca9-b6ee-14c8a2b14eab" commented="no" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The Administrator may use amounts appropriated under subsection (b)(1) to make grants to Indian Tribes on whose land is located an eligible non-NPL site.</text></paragraph><paragraph id="idbbc50b27-1a39-481f-b318-a796272b516d" commented="no" changed="not-changed"><enum>(2)</enum><header>Use of grant funds</header><text>A grant under paragraph (1) shall be used in accordance with the second sentence of section 117(e)(1) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9617">42 U.S.C. 9617(e)(1)</external-xref>).</text></paragraph><paragraph id="id52aed3b7-d55e-451a-9e6a-cff51fc59db9" commented="no" changed="not-changed"><enum>(3)</enum><header>Limitations</header><text>A grant under paragraph (1) shall be governed by the rules, procedures, and limitations described in section 117(e)(2) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9617">42 U.S.C. 9617(e)(2)</external-xref>), except that—</text><subparagraph id="id9ad32a25-cba0-47b6-9ca0-5fd290590bc9" commented="no" changed="not-changed"><enum>(A)</enum><text><quote>Administrator of the Environmental Protection Agency</quote> shall be substituted for <quote>President</quote> each place it appears in that section; and</text></subparagraph><subparagraph id="idbac79c2d-7230-431a-b3a7-3338219b825f" commented="no" changed="not-changed"><enum>(B)</enum><text>in the first sentence of that section, <quote>under section 502 of the <short-title>American Nuclear Infrastructure Act of 2021</short-title></quote> shall be substituted for <quote>under this subsection</quote>.</text></subparagraph></paragraph></subsection><subsection id="id88c8c560-ecb8-4080-a26f-eb55c2501580" changed="not-changed"><enum>(f)</enum><header>Statute of limitations</header><text>If a remedial action described in subsection (c)(2) is scheduled at an eligible non-NPL site, no action may be commenced for damages (as defined in section 101 of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)) with respect to that eligible non-NPL site unless the action is commenced within the timeframe provided for such actions with respect to facilities on the National Priorities List in the first sentence of the matter following subparagraph (B) of section 113(g)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9613">42 U.S.C. 9613(g)(1)</external-xref>). </text></subsection><subsection id="id870aa44c-9587-48ef-9248-54fc1864b667" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(g)</enum><header>Coordination</header><text>The Administrator shall coordinate with the Indian Tribe on whose land the applicable site is located in—</text><paragraph commented="no" display-inline="no-display-inline" id="id613d3bb3-ab2b-4588-afb4-320e1fa20523" changed="not-changed"><enum>(1)</enum><text>selecting and prioritizing sites for removal actions and remedial actions under paragraphs (1) and (2) of subsection (c); and </text></paragraph><paragraph id="id82bfea7b-5164-4d03-847e-84829e0cde84" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text>carrying out those removal actions and remedial actions.</text></paragraph></subsection></section><section id="idDD86B15D208B4FA6B2BDD4A81D6C1F64" changed="not-changed"><enum>503.</enum><header>Nuclear closure communities</header><subsection id="id73cbadc8414c43dfa6718ef0cdea748d" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idc90d1513a0e242ff98756c47c7ea3634" changed="not-changed"><enum>(1)</enum><header>Community advisory board</header><text>The term <term>community advisory board</term> means a community committee or other advisory organization that aims to foster communication and information exchange between a licensee planning for and involved in decommissioning activities and members of the community that decommissioning activities may affect.</text></paragraph><paragraph id="id7f5a34ddbd0f4c1baaba9dba2402b8a0" changed="not-changed"><enum>(2)</enum><header>Decommission</header><text>The term <term>decommission</term> has the meaning given the term in section 50.2 of title 10, Code of Federal Regulations (or successor regulations).</text></paragraph><paragraph id="id844f15e136d2471898a54a6cb3cd0e2e" changed="not-changed"><enum>(3)</enum><header>Eligible recipient</header><text>The term <term>eligible recipient</term> has the meaning given the term in section 3 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3122">42 U.S.C. 3122</external-xref>).</text></paragraph><paragraph id="idc0ba9722925342f68bb8911f2c540f0a" changed="not-changed"><enum>(4)</enum><header>Licensee</header><text>The term <term>licensee</term> has the meaning given the term in section 50.2 of title 10, Code of Federal Regulations (or successor regulations).</text></paragraph><paragraph id="idee8c1c33c69e458bb8e456c78690654e" changed="not-changed"><enum>(5)</enum><header>Nuclear closure community</header><text>The term <term>nuclear closure community</term> means a unit of local government, including a county, city, town, village, school district, or special district that has been impacted, or reasonably demonstrates to the satisfaction of the Secretary, that it will be impacted, by a nuclear power plant licensed by the Commission that has ceased operation or has provided a written notification to the Commission that it will cease operations as of the date of enactment of this Act.</text></paragraph><paragraph id="id24e8a8d16560467697568e96bae8ae09" changed="not-changed"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce, acting through the Assistant Secretary of Commerce for Economic Development.</text></paragraph></subsection><subsection id="id9046ded852154b7d87fe7bcf1bd57e2c" changed="not-changed"><enum>(b)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a grant program to provide grants to eligible recipients—</text><paragraph id="id98e18d39f78c4cc5b27aa10a3536df9c" changed="not-changed"><enum>(1)</enum><text>to assist with economic development in nuclear closure communities; and</text></paragraph><paragraph id="ide20fda449ea0484eb4c4ff0ede4b59c9" changed="not-changed"><enum>(2)</enum><text>to fund community advisory boards in nuclear closure communities.</text></paragraph></subsection><subsection id="ide7c3ca8b0cad44c1aeac552c235af893" changed="not-changed"><enum>(c)</enum><header>Requirement</header><text>In carrying out this section, to the maximum extent practicable, the Secretary shall implement the recommendations described in the report submitted to Congress under section 108 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>; 132 Stat. 5577) entitled <quote>Best Practices for Establishment and Operation of Local Community Advisory Boards Associated with Decommissioning Activities at Nuclear Power Plants</quote>.</text></subsection><subsection id="id9d9266563c6e4bb0bd2d49f8c6714481" changed="not-changed"><enum>(d)</enum><header>Distribution of funds</header><text>The Secretary shall establish a formula to ensure, to the maximum extent practicable, geographic diversity among grant recipients under this section.</text></subsection><subsection id="id75b1d425fd104f2789fa8f0268df6474" changed="not-changed"><enum>(e)</enum><header>Authorization of appropriations</header><paragraph id="ide6ae437fc8fc48928ddac1d5f16724b1" changed="not-changed"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary—</text><subparagraph id="idcdb1c0535bac4dc2adc7b71d30e6adc7" changed="not-changed"><enum>(A)</enum><text>to carry out subsection (b)(1), $30,000,000 for each of fiscal years 2022 through 2027; and</text></subparagraph><subparagraph id="id46b2684f61844954a1b5240e9464aedf" changed="not-changed"><enum>(B)</enum><text>to carry out subsection (b)(2), $5,000,000 for each of fiscal years 2022 through 2024.</text></subparagraph></paragraph><paragraph id="idC3F7D6775DC74A46B7566D68808C53F8" changed="not-changed"><enum>(2)</enum><header>Availability</header><text>Amounts made available under this section shall remain available for a period of 5 years beginning on the date on which the amounts are made available.</text></paragraph><paragraph id="id19e6220a6cd448019aca3b5eaa5554a0" changed="not-changed"><enum>(3)</enum><header>No offset</header><text>None of the funds made available under this section may be used to offset the funding for any other Federal program. </text></paragraph></subsection></section><section id="idC5E0E335FDCB4618BD81CF4F3E10F7F8" changed="not-changed"><enum>504.</enum><header>Report on corporate support</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Commission shall submit to the appropriate committees of Congress and make publicly available a report that describes—</text><paragraph id="idA6C99E978BBF4830BD386CF766F2E9AE" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the progress on the implementation of section 102(a)(3) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215(a)(3)</external-xref>); and</text></paragraph><paragraph id="id2681AE77D8D3423CAD6B2F571BE97733"
