which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Defense to enhance the readiness of the Department of Defense to challenges relating to climate change and to improve the energy and resource efficiency of the Department, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Defense Climate Resiliency and Readiness Act</short-title></quote>.</text></section><section id="id1F01B813037E4EE8956051A61AFEB404"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idad35feeaf758452e8d4f2a5be2c15116"><enum>(1)</enum><header>Climate change</header><text>The term <term>climate change</term> means a change of climate that is—</text><subparagraph id="id749943717bba455b9875e25be065acd2"><enum>(A)</enum><text>attributed directly or indirectly to human activity that alters the composition of the global atmosphere; and</text></subparagraph><subparagraph id="idedd910642a994b99a1c7d0f93ad77446"><enum>(B)</enum><text>in addition to natural climate variability observed over comparable time periods.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF0441E42E334496B1EAEEBE2E8DDC4E"><enum>(2)</enum><header display-inline="yes-display-inline">Congressional defense committees</header><text display-inline="yes-display-inline">The term <term>congressional defense committees</term> has the meaning given that term in section 101(a)(16) of title 10, United States Code.</text></paragraph><paragraph id="id1a7d4e26047845f882aa0e15e78df88a"><enum>(3)</enum><header>Green manufacturing technology</header><text>The term <term>green manufacturing technology</term> means manufacturing processes that—</text><subparagraph id="ida29dfc8b1e14402ea94a5eaa848f0133"><enum>(A)</enum><text>use low carbon materials;</text></subparagraph><subparagraph id="id9c0074bd1d9847b38ad161f1e3a57ae3"><enum>(B)</enum><text>reduce carbon emissions or have low global warming potential during the production of the material or product; and</text></subparagraph><subparagraph id="id1cd63b9a4fbe45119a07d952f9f21d4f"><enum>(C)</enum><text>use renewable resources to create the material or product.</text></subparagraph></paragraph><paragraph id="id3D142A6DFD364796A0EA149B2B8BF5EE" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Net zero energy</header><text>The term <term>net zero energy</term> means a reduction by an entity in overall energy use, maximization of energy efficiency, and implementation and use of energy recovery and cogeneration capabilities, and an offset of the remaining demand for energy with production of energy from onsite renewable energy sources, such that as much energy is produced by the entity as the entity uses over the course of a year.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0FD30EF74B074677BCAC905F1373C091"><enum>(5)</enum><header display-inline="yes-display-inline">Resiliency</header><text display-inline="yes-display-inline">The term <term>resiliency</term> means, with respect to each installation of the Department of Defense, an anticipation, preparation for, and adaptation of each installation to utility disruptions and changing environmental conditions, and the achievement and maintenance by such installation of the capability to withstand, respond to, and recover rapidly from utility disruptions while ensuring the sustainment of mission-critical operations.</text></paragraph><paragraph id="id5a4fc6a8a2af43dab29e4a30aa83defb"><enum>(6)</enum><header>Non-operational sources</header><text>The term <term>non-operational sources</term>—</text><subparagraph id="idB80E580E09084297B813A3439C8F85C4"><enum>(A)</enum><text>means fixed installations, enduring locations, and non-tactical vehicles of the Department of Defense; and</text></subparagraph><subparagraph id="idCB20C8337A784CA88B5917C9D7B89F83"><enum>(B)</enum><text>does not include sources in connection with the training, moving, and sustaining of the Armed Forces and weapons platforms for military operations and training, including tactical power systems and generators at non-enduring locations of the Department of Defense.</text></subparagraph></paragraph><paragraph id="id188004eb865b439592c12eb672333259"><enum>(7)</enum><header>Renewable energy source</header><text>The term <term>renewable energy source</term> has the meaning given that term in section 2924(6) of title 10, United States Code.</text></paragraph><paragraph id="id40aa4fb88f144a5c9976657322d59e60"><enum>(8)</enum><header>United States</header><text>The term <term>United States</term> means the several States, the District of Columbia, and any territory or possession of the United States.</text></paragraph></section><section id="id07dbbd69984241a3bc59cd31f9ebf4a2"><enum>3.</enum><header>Net zero energy by non-operational sources of the Department of Defense</header><subsection id="id92f1502326ed4f01a6d4cf1b58c26f8b"><enum>(a)</enum><header>In general</header><text>The Department of Defense shall achieve aggregate net zero energy in use of energy by non-operational sources by not later than December 31, 2031.</text></subsection><subsection id="id39D9AE2D649F4D38B7DCA69708B5EA1E"><enum>(b)</enum><header>Strategy</header><paragraph id="idA4E89FA7FC8048049445651717BB2E14"><enum>(1)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Defense shall submit to Congress a report setting forth the strategy of the Department of Defense to achieve the requirement under subsection (a).</text></paragraph><paragraph id="idBB33CA69DF144CF38213D5ABF309AB95"><enum>(2)</enum><header>Elements</header><text>The report required by paragraph (1) shall set forth the following:</text><subparagraph id="id62FEF25A2A1F4E2495756D6B505C0803"><enum>(A)</enum><text>The strategy of the Department of Defense to achieve the requirement under subsection (a) for all installations under the jurisdiction of the Department (other than the military departments).</text></subparagraph><subparagraph id="idbc3107c765894a6caf0427fa3378974e"><enum>(B)</enum><text>The strategy of each military department to achieve the requirement under subsection (a) for all installations under the jurisdiction of such department.</text></subparagraph><subparagraph id="id6E92AAE1E71F4F34A4B1854A1F7C440A"><enum>(C)</enum><text>An assessment of the manner in which the achievement by the Department of Defense of the requirement under subsection (a) will enhance the readiness of the Armed Forces to address threats posed by Russia, China, Iran, North Korea, and violent extremism.</text></subparagraph></paragraph><paragraph id="idF8CBE38977CF4128974232F9E02F2974"><enum>(3)</enum><header>Biennial update</header><text>Not later than two years after the submittal of the report required by paragraph (1), and every two years thereafter through December 31, 2031, the Secretary shall submit to Congress a report setting forth the following:</text><subparagraph id="idD5EC0B491765495B835597ADC6E965D6"><enum>(A)</enum><text>A current assessment of the progress of the Department of Defense in implementing the strategy described in paragraph (1), set forth by military department, Defense Agency, and other component or element of the Department.</text></subparagraph><subparagraph id="idDE84FCD2F591451C85235BE07959B82D"><enum>(B)</enum><text>Any updates to the strategy.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCF7EDADC3EF04DC6929F1D23FA1AD4E3"><enum>(4)</enum><header>Consultation</header><text>The Secretary shall consult with the National Academy of Sciences and a federally funded research and development center in developing the report required by paragraph (1) and any update to that report under paragraph (3).</text></paragraph></subsection><subsection id="ide0b99d396c4d40cc96929ff59c06cc6a"><enum>(c)</enum><header>Waiver</header><paragraph id="idC0C2C861C1C146EF8F8A7E9CD3349A82"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense may waive the requirement in subsection (a) if the Secretary—</text><subparagraph id="id8b2100ee04c147ed96738c8c6bf5a8ff"><enum>(A)</enum><text>determines that achievement of such requirement would adversely affect operational safety, force protection, or the national security interests of the United States; and</text></subparagraph><subparagraph id="id19ceb84c8791474bbc4752d04b0d240b"><enum>(B)</enum><text>submits to the congressional defense committees a written notification of the waiver, together with a justification for the waiver.</text></subparagraph></paragraph><paragraph id="idD921EC4EBD244A28B98D838F5C6B7ACC"><enum>(2)</enum><header>Period</header><text>The period of any waiver under paragraph (1) may not exceed 30 days.</text></paragraph><paragraph id="id49A2B129FD82410CA05BC61CCBF06238"><enum>(3)</enum><header>Renewal</header><text>Any waiver under this subsection may be renewed one or more times, in the manner provided for the initial such waiver under paragraph (1) and for the period provided for in paragraph (2).</text></paragraph></subsection></section><section id="id624b8e3e6f12431cbb54762985023ba9"><enum>4.</enum><header>Inclusion in Annual Energy Management and Resilience Report of Department of Defense of list of military installations that emit the most carbon and estimate of energy consumption by Department</header><subsection id="idA0544349E9624ABBAB39DA5BA1F50BBA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For every fiscal year beginning after the date of the enactment of this Act, the Secretary of Defense shall include in the Annual Energy Management and Resilience Report for that fiscal year—</text><paragraph id="idC5E625E51C034B77AC3316DF350A197B"><enum>(1)</enum><text display-inline="yes-display-inline">a list of the ten installations within each military department that emit the most carbon;</text></paragraph><paragraph id="id8bf4f34b543e4b32b6a09bf5a2d90fd8"><enum>(2)</enum><text>an estimate of all energy consumption by the Department of Defense, including greenhouse gas emissions; and</text></paragraph><paragraph id="id8758D27341FC4B609995D826BA7EC49A"><enum>(3)</enum><text>an assessment of greenhouse gas emissions at all installations of the Department, disaggregated by operational and non-operational sources.</text></paragraph></subsection><subsection id="id3520FC25EF304D4D9A34EE56B6BBE409"><enum>(b)</enum><header>Metrics</header><text>In determining energy consumption and greenhouse gas emissions under paragraphs (2) and (3) of subsection (a), the Secretary shall use metrics established by the Under Secretary of Defense for Acquisition and Sustainment, in consultation with the National Academy of Sciences and a federally funded research and development center.</text></subsection></section><section id="idC1660B92E6C44D88B612BD4E8D244889"><enum>5.</enum><header>Climate-conscious contracting of Department of Defense</header><subsection id="id3D699111794C4BEF9E45030C46403DCB"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/137">Chapter 137</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" act-name="" id="id4EBB2B0AD7E24935B050423113C11103"><section id="id3314A3074C554400A7FEB596155B8876"><enum>2339d.</enum><header>Requirements relating to energy consumption and climate change</header><subsection id="idF3F7ED23E5E04132A9F6A324C1A3D5A4"><enum>(a)</enum><header>Projected energy consumption</header><text display-inline="yes-display-inline">Each Department of Defense contract for the procurement of property or services entered into on or after October 1, 2021, shall include a written estimate by the Department of the total projected energy consumption of all work to be performed under the contract, and a statement of whether the contract will include investments by the contractor or the Department in renewable energy or energy-efficient sources.</text></subsection><subsection id="id0cf7d7f8f133443eab5b8d4b815f3fe9"><enum>(b)</enum><header>Policy on consideration of certain factors in determinations To award contracts</header><text>In making any determination to enter into a contract described in subsection (a), the Secretary of Defense shall take into account—</text><paragraph id="id7b043317b9f94806a729ccfd83453178"><enum>(1)</enum><text>whether the contractor verifiably produces as much renewable energy as the total energy it consumes; and</text></paragraph><paragraph id="id262f0f2924ed4f59af6749d079dc714f"><enum>(2)</enum><text>whether there is any order against the contractor by the Environmental Protection Agency, the Department of Justice, or a State attorney general to pay a fine or take remedial action for a violation of an environmental law or regulation of the United States.</text></paragraph></subsection><subsection id="id393e0655397746279f50f14a4e1cd654"><enum>(c)</enum><header>Disclosure of climate-Related risks</header><text>Each prospective contractor with the Department of Defense shall, as a prerequisite of bidding for a contract with the Department, submit a detailed statement to the Department that includes information regarding—</text><paragraph id="idfbeceeff4c3f49b4b058c828acc161e6"><enum>(1)</enum><text>the identification of, the evaluation of potential financial impacts of, and any risk-management strategies relating to—</text><subparagraph id="id7caf061616de4427bd575e89c5b83989"><enum>(A)</enum><text>physical risks posed to the contractor by climate change; and</text></subparagraph><subparagraph id="idb36c1a60c32847df841fc26abdc71114"><enum>(B)</enum><text>transition risks posed to the contractor by climate change; and</text></subparagraph></paragraph><paragraph id="id26786263ac264aa6abc9e531fb968077"><enum>(2)</enum><text>a description of any established corporate governance processes and structures to identify, assess, and manage climate-related risks.</text></paragraph></subsection><subsection id="id8652D924F13743BFA1FF835E8D4A2C6F"><enum>(d)</enum><header>Assessment of fees To combat climate change</header><paragraph commented="no" display-inline="yes-display-inline" id="id846F5DAB694F4FAD99B5B0E61DE5C8E9"><enum>(1)</enum><text>Each Department of Defense contract for the procurement of property or services entered into on or after October 1, 2021, shall include a requirement that the contractor pay to the Department of Defense a fee equal to one percent of the value of the contract in the case of a contractor that is not, at the time of the Department’s solicitation of the contract, verifiably producing as much renewable energy as the total energy it consumes.</text></paragraph><paragraph id="id70C70854F9394A01883ACA7AAA3A53B6" indent="up1"><enum>(2)</enum><text>Any contractor required to pay a fee under paragraph (1) with respect to a contract may not offset the cost of such fee by increasing the amount of the proposal for such contract.</text></paragraph></subsection><subsection id="id6826CB44B33544A38A84121A8743DEB2"><enum>(e)</enum><header>Waiver</header><paragraph commented="no" display-inline="yes-display-inline" id="idA6E11F99E7704AC49FE8F74554EA5C19"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of Defense may waive the requirements in subsections (a) and (b) if the Secretary—</text><subparagraph id="idE8E31196824A400CA3C72EFAA3EF30D9" indent="up1"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id048FC503D1274241A4600450D8095878"><enum>(i)</enum><text>determines that such requirements would adversely affect operational safety, force protection, or the national security interests of the United States; or</text></clause><clause id="ide865588828764df6b04c1a68d4b56745" indent="up1"><enum>(ii)</enum><text>with respect to particular property or services, determines that—</text><subclause id="idDBE3918399DA41C7995946F527B4E127"><enum>(I)</enum><text>market conditions for the property or services have adversely affected (or will in the near future adversely affect) the acquisition of the property or services by the Department of Defense; and</text></subclause><subclause id="id9C53AC28010D49159D7C3577A668950F"><enum>(II)</enum><text>the waiver will expedite or facilitate the acquisition of the property or services; and</text></subclause></clause></subparagraph><subparagraph id="id20FFC79DB70B41A6B9C03320296E0B1B" indent="up1"><enum>(B)</enum><text>submits to the congressional defense committees a written notification of the waiver, together with a justification for the waiver.</text></subparagraph></paragraph><paragraph id="id506A3A87BB4B4E72BFF203D76CF7206D" indent="up1"><enum>(2)</enum><text>The period of any waiver under paragraph (1) may not exceed 30 days.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3B18AABFC25447B4959D9714D2278414" indent="up1"><enum>(3)</enum><text>Any waiver under this subsection may be renewed one or more times, in the manner provided for the initial such waiver under paragraph (1) and for the period provided for in paragraph (2).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id7bd0fb12d4184e2db929d393f7cad976"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/137">chapter 137</external-xref> of title 10, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/10/2339c">section 2339c</external-xref> the following new item:</text><quoted-block style="USC" id="id1c76b04c-7114-452e-8c74-73ad598f277e"><toc><toc-entry level="section">2339d. Requirements relating to energy consumption and climate change.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idE774C125CE5B4956A33594CACB7AB921"><enum>(c)</enum><header>Energy and Climate Resiliency Fund</header><paragraph id="idF7EEE3B1F66F415C8E6A0FF0D1A95448"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Energy and Climate Resiliency Fund</quote> (in this subsection referred to as the <quote>Fund</quote>), to be administered by the Secretary of Defense.</text></paragraph><paragraph id="idE5A9CC8CBD4C482BA231B7C8BC64D7D7"><enum>(2)</enum><header>Use of amounts</header><text>Amounts deposited in the Fund shall be used only for climate-related improvements that contribute to the continued operational viability and the resiliency of the networks, systems, installations, facilities, and other assets and capabilities of the Department of Defense.</text></paragraph><paragraph id="id6731942ad2904278b30f6c8fa57b4fbc"><enum>(3)</enum><header>Deposit and availability of amounts</header><text>Notwithstanding section 3302 of title 31, United States Code, fees collected under section 2339d(d) of title 10, United States Code, as added by subsection (a)—</text><subparagraph id="idA0F3BD1D4B5E4FB89196D0D453001772"><enum>(A)</enum><text>shall be deposited into the Fund to carry out the activities described in paragraph (2);</text></subparagraph><subparagraph id="idC73144CEB77B45619343700872F60F94"><enum>(B)</enum><text>to the extent and in the amounts provided in advance in appropriations Acts, shall be available to the Secretary of Defense; and</text></subparagraph><subparagraph id="idF9E9DF61E40D4FA7A41823897E94C62E"><enum>(C)</enum><text>shall remain available until expended.</text></subparagraph></paragraph><paragraph id="id9c0c9d34db594bb288f47faa708f844f"><enum>(4)</enum><header>Climate-related improvements defined</header><text>In this subsection, the term <term>climate-related improvements</term> means efforts by the Department of Defense to prepare for, or mitigate the effects of, the following:</text><subparagraph id="idbed013bf58c848b29ad79e7cb1587bce"><enum>(A)</enum><text>Extreme weather.</text></subparagraph><subparagraph id="id60cd6a3321a74dca882ad73bc725fcc7"><enum>(B)</enum><text>Rising sea tides.</text></subparagraph><subparagraph id="idca4e291bf1c74fc4a9a9e999be3c1067"><enum>(C)</enum><text>Increased flooding.</text></subparagraph><subparagraph id="id07fd27b725784f15a16f0e657f32d0a7"><enum>(D)</enum><text>Drought.</text></subparagraph><subparagraph id="id2519b8562872472082940efc129cfc1d"><enum>(E)</enum><text>Desertification.</text></subparagraph><subparagraph id="ida51140a7845c41b49bd4c5a78cdd933d"><enum>(F)</enum><text>Wildfires.</text></subparagraph><subparagraph id="ided651ad27dab4666ae9a5828e349c68d"><enum>(G)</enum><text>Thawing permafrost.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5533239208AB477DB24B3C4D6F33876E"><enum>(H)</enum><text>Such other conditions as the Secretary determines necessary.</text></subparagraph></paragraph></subsection><subsection id="id890EA5CDE37C423E99DC616E7EDC05A9"><enum>(d)</enum><header>Contracting preference for green manufacturing technology</header><paragraph id="idAD0F6F6B3E02478888E39DEA9EB1DAD6"><enum>(1)</enum><header>Contracts for green manufacturing technology</header><text>With respect to contracts awarded by the Department of Defense, the Department shall give a preference to qualified contractors. </text></paragraph><paragraph id="ida7e599a0d17b4927b27a7fc779cb19ef"><enum>(2)</enum><header>Policy on consideration of certain factors in determinations to award contracts</header><text>In making any determination to enter into a contract described in paragraph (1), the Secretary of Defense shall take into account—</text><subparagraph id="id09cf9464cb214f16a74413d8726a4350"><enum>(A)</enum><text>whether the qualified contractor verifiably produces as much renewable energy as the total energy it consumes;</text></subparagraph><subparagraph id="id16987251b2b74a039aa2a96ac0b947f6"><enum>(B)</enum><text>whether the qualified contractor verifiably uses green manufacturing technology; and</text></subparagraph><subparagraph id="id7a5aa2407ce54d6f89ec68d2e3e72d15"><enum>(C)</enum><text>whether there is any order against the qualified contractor by the Environmental Protection Agency, the Department of Justice, or a State attorney general to pay a fine or take remedial action for a violation of an environmental law or regulation of the United States.</text></subparagraph></paragraph><paragraph id="id096d0dfb9a494f89af3da4f8e32a98da"><enum>(3)</enum><header>Verification and reporting of qualified contractors</header><text>The Secretary of Defense shall prescribe such procedures as may be necessary for—</text><subparagraph id="idb4d88e735e6f4122837be876079be718"><enum>(A)</enum><text>contractors to verify that they are qualified contractors;</text></subparagraph><subparagraph id="idcf16f528a21a415fb857255711dc20fa"><enum>(B)</enum><text>qualified contractors meeting the requirements of paragraph (2) to certify that not more than 25 percent of the amount paid under the contract will be expended on a subcontract to a contractor that is not verifiably meeting those requirements, subject to such necessary and reasonable waivers as the Secretary may prescribe; and</text></subparagraph><subparagraph id="idc2bc7fba7215439c9016f6dcbec2612e"><enum>(C)</enum><text>recording information on each use of the authority under paragraph (1), including details relevant to the nature of the contract and the qualified contractor, and providing that information to the Comptroller General of the United States.</text></subparagraph></paragraph><paragraph id="id18cb68b74ad243f98cdb2b0931eaaeac"><enum>(4)</enum><header>Comptroller General of the United States report</header><subparagraph id="id758e2f689da6482998ba5cff1830a813"><enum>(A)</enum><header>In general</header><text>Not later than five years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the congressional defense committees a report on the individual and aggregate uses of the authority under paragraph (1), using such data as may be available up to that time.</text></subparagraph><subparagraph id="iddd766339d6a346c3b33f421b565882fd"><enum>(B)</enum><header>Elements</header><text>The report under subparagraph (A) shall include—</text><clause id="id5a6be6f7573149189daeb28f3ba6a55e"><enum>(i)</enum><text>an assessment of the frequency and nature of the use of the authority under paragraph (1); and</text></clause><clause id="id40cd956d2c4e45b0a9f3f0fd56539f7e"><enum>(ii)</enum><text>the tendency of contractors to become qualified contractors in order to qualify for the authority under paragraph (1). </text></clause></subparagraph></paragraph><paragraph id="id227B9BCD70064796ACA2357AAA8E30FE"><enum>(5)</enum><header>Qualified contractor defined</header><text>In this subsection, the term <term>qualified contractor</term> means a contractor that uses green manufacturing technology. </text></paragraph></subsection><subsection id="idfc8eaec8a7f541aaba7a71b1d765541b"><enum>(e)</enum><header>Set aside contracts for small businesses that use green manufacturing technology</header><paragraph id="id7aee2743751045dd9ec09ba8a0fb6077"><enum>(1)</enum><header>Contracts for green manufacturing technology</header><text>With respect to contracts awarded by the Department of Defense, the Department shall award—</text><subparagraph id="id45f03fa9dae442fb9ac1affd6d5f167f"><enum>(A)</enum><text>in fiscal year 2022, not fewer than five percent of contracts to qualified small businesses;</text></subparagraph><subparagraph id="id5503502a01e4472db75b5314b0e25c6c"><enum>(B)</enum><text>by fiscal year 2027, not fewer than 20 percent of contracts to qualified small businesses; and</text></subparagraph><subparagraph id="id0461bc0bd2cb4a7cac6625ec770e86a0"><enum>(C)</enum><text>by fiscal year 2030, not fewer than 50 percent of contracts to qualified small businesses.</text></subparagraph></paragraph><paragraph id="id29cf27751cdf4e788fcd36857afbadbb"><enum>(2)</enum><header>Policy on consideration of certain factors in determinations to award contracts</header><text>In making any determination to enter into a contract described in paragraph (1), the Secretary of Defense shall take into account—</text><subparagraph id="iddee4b30302004a378be9a422257c45ff"><enum>(A)</enum><text>whether the qualified small business verifiably produces as much renewable energy as the total energy it consumes;</text></subparagraph><subparagraph id="id7382cf80cad6481caafdef3a83e1a591"><enum>(B)</enum><text>whether the qualified small business verifiably uses green manufacturing technology or operates with net zero energy; and</text></subparagraph><subparagraph id="id2dd8bed997f84367b3f6933aee5f2b4c"><enum>(C)</enum><text>whether there is any order against the qualified small business by the Environmental Protection Agency, the Department of Justice, or a State attorney general to pay a fine or take remedial action for a violation of an environmental law or regulation of the United States.</text></subparagraph></paragraph><paragraph id="idba1e843b946845958719c5ac1adac898"><enum>(3)</enum><header>Verification and reporting of qualified small businesses</header><text>The Secretary of Defense shall prescribe such procedures as may be necessary for—</text><subparagraph id="idbd4c85d8520442d48f92a9db51ff95ae"><enum>(A)</enum><text>contractors to verify that they are qualified small businesses;</text></subparagraph><subparagraph id="id52efe7a1f8124cdc86aa71f6e82ea9fd"><enum>(B)</enum><text>qualified small businesses meeting the requirements of paragraph (2) to certify that not more than 25 percent of the amount paid under the contract will be expended on a subcontract to a contractor that is not verifiably meeting those requirements, subject to such necessary and reasonable waivers as the Secretary may prescribe; and</text></subparagraph><subparagraph id="id8f2236a823f64c588627337d254d8cca"><enum>(C)</enum><text>recording information on awards under paragraph (1), including details relevant to the nature of the contract and the qualified small business, and providing that information to the Comptroller General of the United States.</text></subparagraph></paragraph><paragraph id="ide747df3327594b0aac6e5dd643177918"><enum>(4)</enum><header>Comptroller General of the United States report</header><subparagraph id="id7fc065e269d24a719b0d051ebc735715"><enum>(A)</enum><header>In general</header><text>Not later than five years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the congressional defense committees a report on the individual and aggregate awards under paragraph (2), using such data as may be available up to that time.</text></subparagraph><subparagraph id="idb4a41bded2ea48ef8f9f19d22edd1672"><enum>(B)</enum><header>Elements</header><text>The report under subparagraph (A) shall include—</text><clause id="ida449d34d277645d29d7e727af1814f09"><enum>(i)</enum><text>an assessment of the frequency and nature of awards under paragraph (1); and</text></clause><clause id="ida515b0d5289240baafbac15ae025fd98"><enum>(ii)</enum><text>the tendency of small business concerns to become qualified small businesses in order to qualify for awards under paragraph (1). </text></clause></subparagraph></paragraph><paragraph id="idd8933cfb31f24437ba8a7303e3ef943f"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="idfb040447bdaa49da876dd23330d1222c"><enum>(A)</enum><header>Qualified small business</header><text>The term <term>qualified small business</term> means a small business concern that verifiably uses green manufacturing technology or operates with net zero energy.</text></subparagraph><subparagraph id="id54cc9ae4f2384d24bf916ff1a0df451f" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Small business concern</header><text>The term <term>small business concern</term> has the meaning given that term in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>). </text></subparagraph></paragraph></subsection></section><section id="id87A7C18BAB814C84A331E080C4ACCE1F"><enum>6.</enum><header>Annual report on effects of climate change on Department of Defense</header><subsection id="id25D6B179BEFC4DBE8CEB119C91752895"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Secretary of Defense shall submit to the congressional defense committees a report on vulnerabilities to military installations and combatant commander requirements resulting from climate change that builds upon the report submitted under section 335(c) of the National Defense Authorization Act for Fiscal Year 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/91">Public Law 115–91</external-xref>; 131 Stat. 1358).</text></subsection><subsection id="idBBCE7748EB864DF7B5B235C14269E44E"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall include the following:</text><paragraph id="idbbcae8a744a5466585c8e2a7826d291f"><enum>(1)</enum><text>An explanation of the underlying methodology behind the climate vulnerability analysis conducted in preparing the report under section 335(c) of the National Defense Authorization Act for Fiscal Year 2018.</text></paragraph><paragraph id="idf02690c84cb4431695378f1fdd54318b"><enum>(2)</enum><text>An assessment of how climate change affects low-lying military installations, military installations of the Navy and the Marine Corps, and military installations outside the United States.</text></paragraph><paragraph id="id6B2BF67BA0254601837915C9E1D8144C"><enum>(3)</enum><text>An assessment of how climate change affects access of members of the Armed Forces to training ranges.</text></paragraph><paragraph id="id41e0600b31ed4e4f859f13cea3f224e3"><enum>(4)</enum><text>With respect to a military installation in a country outside the United States, an assessment of the collaboration between the Department of Defense and the military or civilian agencies of the government of that country or nongovernmental organizations operating in that country to adapt to risks from climate change.</text></paragraph><paragraph id="id3fcf3441e5fc4179b36991b570334a6c"><enum>(5)</enum><text>An assessment of how climate change affects housing safety and food security on military installations.</text></paragraph><paragraph id="id96af9809c1244e15a9b13abff9cc5892"><enum>(6)</enum><text>An assessment of the strategic benefits derived from isolating infrastructure of the Department of Defense in the United States from the national electric grid and the use of energy-efficient, distributed, and smart power grids by the Armed Forces in the United States and overseas to ensure affordable access to electricity.</text></paragraph><paragraph id="id8496d6f6b4d040b0b252d3bf23b8d13b"><enum>(7)</enum><text>A list of the ten military installations within each military department that are most vulnerable to climate change based on the effects of the following:</text><subparagraph id="idAC68D18EE1194BCDAA30174D96EB11E2"><enum>(A)</enum><text>Geographic location.</text></subparagraph><subparagraph id="id75C31608FBA2447E8FFDB58AFF7E9773"><enum>(B)</enum><text>Extreme weather.</text></subparagraph><subparagraph id="idF6BA7A7BA374429F8CC8A53783BDB4CF"><enum>(C)</enum><text>Rising sea tides.</text></subparagraph><subparagraph id="idC60943CDFF00474A8707436FB2C8D54E"><enum>(D)</enum><text>Increased flooding.</text></subparagraph><subparagraph id="idD6B849BF7EDC4F5189948A971856CFEA"><enum>(E)</enum><text>Drought.</text></subparagraph><subparagraph id="idC2FB6E44A6F747F3AC9598C929B64065"><enum>(F)</enum><text>Desertification.</text></subparagraph><subparagraph id="id6F5B77C0677A432E9DDD212CCFFEF010"><enum>(G)</enum><text>Wildfires.</text></subparagraph><subparagraph id="id62BBEF6B1BB74D6BB14901B7798E1FDB"><enum>(H)</enum><text>Thawing permafrost.</text></subparagraph><subparagraph id="id86F2DF8D67E146D5A3C2EEDF25DC2D28"><enum>(I)</enum><text>Such other categories as the Secretary determines necessary.</text></subparagraph></paragraph><paragraph id="id8994A61966AF485091E28BEB1910BD6C"><enum>(8)</enum><text>A climate vulnerability score, determined by the Secretary, for each military installation of the Department.</text></paragraph><paragraph id="idd6760e0564ba48eaba1aeb986d038d0c"><enum>(9)</enum><text>An overview of mitigations, in addition to current efforts undertaken by the Department, that may be necessary to ensure the continued operational viability and to increase the resiliency of the vulnerable military installations identified under paragraph (7), and the estimated costs of those mitigations.</text></paragraph><paragraph id="id06023f719b214243ae2e3051f3a251d1"><enum>(10)</enum><text>An assessment of how adapting to climate change impacts the readiness of the Armed Forces to address the threats posed by Russia, China, Iran, North Korea, and violent extremism.</text></paragraph></subsection><subsection id="idc023728efd8a48008e362c60e7ecda8f"><enum>(c)</enum><header>Consultation</header><text>In developing each report under subsection (a), the Secretary of Defense shall consult with the Administrator of the Environmental Protection Agency, the Secretary of Energy, the Administrator of the National Oceanic and Atmospheric Administration, the Administrator of the Federal Emergency Management Agency, the Commander of the Army Corps of Engineers, the Administrator of the National Aeronautics and Space Administration, a federally funded research and development center, and the heads of such other relevant Federal agencies as the Secretary of Defense determines appropriate.</text></subsection><subsection id="idea8a52393f114554a9cbfbb9bc302f6d"><enum>(d)</enum><header>Form of report</header><text>The report required by subsection (a) shall be submitted in unclassified form but may contain a classified annex if necessary.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1358830E15F9461C90B2C54CE85F4AF9"><enum>(e)</enum><header>Publication</header><text>Upon submittal of the report required by subsection (a), the Secretary of Defense shall publish the unclassified portion of the report on an internet website of the Department of Defense that is available to the public.</text></subsection></section><section id="ide65ad2a062b843cdae868c93e56bce93"><enum>7.</enum><header>Incorporation of climate resiliency into existing strategies of the Department of Defense</header><subsection id="id89ed8338fcbf4dbfb84e9010d06ba1e3"><enum>(a)</enum><header>Consideration of risks of climate change in making strategic decisions relating to military installations</header><text>The Secretary of each military department, with respect to any installation under the jurisdiction of that Secretary, and the Secretary of Defense, with respect to any installation of the Department of Defense that is not under the jurisdiction of the Secretary of a military department, shall consider the risks associated with climate change when making any strategic decision relating to such installation, including where to locate such installation and where to position equipment, infrastructure, and other military assets.</text></subsection><subsection id="idb16551e57d1d40e4a932632969e3b811"><enum>(b)</enum><header>Codification of directive on climate change</header><paragraph id="id048b262d97a944648e05272cc4adfd37"><enum>(1)</enum><header>In general</header><text>Directive 4715.21 of the Department of Defense, dated January 14, 2016, and entitled <quote>Climate Change Adaptation and Resilience</quote>, shall remain in effect.</text></paragraph><paragraph id="id17f788d7628040ffab012a9eb0a03d21"><enum>(2)</enum><header>Reports on implementation of directive</header><text>Each posture statement submitted to Congress by the Secretary of a military department, the Chairman of the Joint Chiefs of Staff, or the commander of a combatant command shall include a description of the implementation and discharge by such official of the Directive referred to in paragraph (1), including the personnel assigned to implement and discharge the Directive and the progress achieved in such implementation and discharge.</text></paragraph></subsection><subsection id="ida9798029878e4264a92e04980122812a"><enum>(c)</enum><header>Incorporation of climate change into certain defense strategies</header><paragraph id="id851f9a11968f4e4e8529c22b02fe8b68"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense, in coordination with the heads of other elements of the intelligence community, the Administrator of the Environmental Protection Agency, the Secretary of Energy, the Administrator of the National Oceanic and Atmospheric Administration, the Administrator of the Federal Emergency Management Agency, the Commander of the Army Corps of Engineers, the Administrator of the National Aeronautics and Space Administration, and the heads of such other relevant Federal agencies as the Secretary of Defense determines appropriate, shall incorporate climate change into the National Defense Strategy, the National Military Strategy, and operational plans of the Department of Defense.</text></paragraph><paragraph id="id2ccec86797ad4a269daac40bd733162e"><enum>(2)</enum><header>Intelligence community defined</header><text>In this subsection, the term <term>intelligence community</term> has the meaning given that term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text></paragraph></subsection><subsection id="id3d0791fe193846748a805672396544c5"><enum>(d)</enum><header>Implementation and discharge of requirements</header><paragraph id="id38bf35216856434cbdd8feb14de363ee"><enum>(1)</enum><header>Cross-functional team on incorporation of climate resiliency into defense strategies</header><text>Among the cross-functional teams established by the Secretary of Defense pursuant to subsection (c) of section 911 of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; 130 Stat. 2345; <external-xref legal-doc="usc" parsable-cite="usc/10/111">10 U.S.C. 111</external-xref> note) in support of the organizational strategy for the Department of Defense required by subsection (a) of that section, the Secretary shall establish a cross-functional team on the implementation and discharge of the requirements under this section.</text></paragraph><paragraph id="id0a1cdad0b5624a4cb12b39f9f85b9425"><enum>(2)</enum><header>Establishment and activities</header><text>The cross-functional team required by paragraph (1) shall be established in accordance with subsection (c) of section 911 of the National Defense Authorization Act for Fiscal Year 2017, and shall be governed in its activities in accordance with the provisions of such subsection (c).</text></paragraph><paragraph id="iddbcc380b80b2499f84ad5be73c84283b"><enum>(3)</enum><header>Deadline for establishment</header><text>The cross-functional team required by paragraph (1) shall be established by not later than 90 days after the date of the enactment of this Act.</text></paragraph></subsection></section><section id="id23cc3c6257a74b26ae435c1c5a82b2a2"><enum>8.</enum><header>Research, development, and demonstration program on energy storage, hybrid microgrid, and energy resiliency</header><subsection id="idb7b884713f6c4443b48e98209f4f4da1"><enum>(a)</enum><header>Program required</header><text>The Secretary of Defense, in consultation with the Secretary of Energy, shall conduct a program of research, development, and demonstration of hybrid microgrid systems and electric grid energy storage.</text></subsection><subsection id="id9EFE8BFF1BA944A4BD20AFBD92FC8320"><enum>(b)</enum><header>Multidisciplinary teams</header><paragraph id="idCCD98FA94F764618A02BF8D780E84A5E"><enum>(1)</enum><header>In general</header><text>In carrying out the program under subsection (a), the Secretary of Defense shall organize activities among multidisciplinary teams to leverage, to the maximum extent practicable, expertise from the Department of Energy, the National Laboratories, institutions of higher education, and the private sector.</text></paragraph><paragraph id="id69bbc959305a4bbaad974753a9d6928b"><enum>(2)</enum><header>Goals</header><text>The multidisciplinary teams organized under paragraph (1) shall pursue aggressive, milestone-driven, and basic research, development, and demonstration goals to carry out the program under subsection (a).</text></paragraph><paragraph id="idb78a09284b7747e69019d66a5d931caf"><enum>(3)</enum><header>Resources</header><text>The Secretary of Defense shall provide sufficient resources to the multidisciplinary teams organized under paragraph (1) to achieve the goals described in paragraph (2) over a ten-year period.</text></paragraph></subsection><subsection id="idf1a0e66e98d74c29b4ca167d4ed337fa"><enum>(c)</enum><header>Areas of focus</header><text>The program under subsection (a) shall focus on—</text><paragraph id="id8fe3193786f44b5aa98305266abca9cb"><enum>(1)</enum><text>addressing electrical power intermittency;</text></paragraph><paragraph id="idb7d86545311840f3b50a446201e98fe5"><enum>(2)</enum><text>integrating renewable energy sources into microgrid systems, hybrid microgrid systems, energy storage, grid security, and local generation of zero-carbon fuels;</text></paragraph><paragraph id="id2781e82844404a0d87f4cb3725a11a1c"><enum>(3)</enum><text>the inspection and structural health monitoring of critical energy infrastructure;</text></paragraph><paragraph id="id577499d135be4a228fed20f69bf5a3ee"><enum>(4)</enum><text>materials, electric thermal, electromechanical, and electrochemical systems research;</text></paragraph><paragraph id="id112a78320e304d6c970898cc21005b9a"><enum>(5)</enum><text>power conversion technologies research;</text></paragraph><paragraph id="id25E4E9D700EA49F3862A7DE11FCE01C8"><enum>(6)</enum><text>developing and using fuel-efficient engines;</text></paragraph><paragraph id="idfb3159882b8f47fd9b4738167edcee1f"><enum>(7)</enum><text>additive manufacturing;</text></paragraph><paragraph id="id02970f91c9644d7f9bf815eeb1f40ac6"><enum>(8)</enum><text>developing—</text><subparagraph id="id93b72022b68244daa5a9fa33a0982cad"><enum>(A)</enum><text>empirical and science-based industry standards to compare the storage capacity, cycle length and capabilities, and reliability of different types of electricity storage; and</text></subparagraph><subparagraph id="id11743d14c6f242f98522d9ec1b5fb3ef"><enum>(B)</enum><text>validation and testing techniques;</text></subparagraph></paragraph><paragraph id="ida33d7a6c196942af994bf65153227573"><enum>(9)</enum><text>other fundamental and applied research critical to widespread deployment of electricity storage;</text></paragraph><paragraph id="id28de7cc859e64ad9b58ac324351ada06"><enum>(10)</enum><text>device development that builds on results from research described in paragraphs (4), (5), and (9), including combinations of power electronics, advanced optimizing controls, and energy storage as a general purpose element of the electric grid;</text></paragraph><paragraph id="idecabdd482d774ec29247ff2bc54afca1"><enum>(11)</enum><text>micro-scale testing and analysis of storage devices, including test-beds and field trials;</text></paragraph><paragraph id="idfe9541c810144ea59f8a66fddbda64ed"><enum>(12)</enum><text>microgrid systems and hybrid microgrid systems to increase the resilience of critical infrastructure of the Department of Defense;</text></paragraph><paragraph id="id51573646b9b4447c81b3371e3c88696a"><enum>(13)</enum><text>the potential for energy storage and renewable resources, including wind, solar, and hydropower, to be integrated into microgrid systems or hybrid microgrid systems of installations of the Department of Defense;</text></paragraph><paragraph id="id582545e77f87418cb014955c14900e35"><enum>(14)</enum><text>the capacity of the workforce of the Department of Defense to operate, maintain, and repair a microgrid system or hybrid microgrid system;</text></paragraph><paragraph id="id28c591b75797412e8130f73e3cbdc1f9"><enum>(15)</enum><text>opportunities to develop the capacity to operate, maintain, and repair a hybrid microgrid system;</text></paragraph><paragraph id="id3e7185c48b7c4950ad3a03927cd6aa00"><enum>(16)</enum><text>leveraging existing capacity within local or regional research organizations, such as organizations based at institutions of higher education, to support development of hybrid microgrid systems, including by testing novel components and systems prior to field deployment;</text></paragraph><paragraph id="id41a875fd2fe94de3895b07ef1aa334c4"><enum>(17)</enum><text>electricity storage device safety and reliability, including potential failure modes, mitigation measures, and operational guidelines;</text></paragraph><paragraph id="id159a54b300814dc6844536b960050474"><enum>(18)</enum><text>standards for performance, control interface, grid interconnection, and interoperability of electricity storage devices;</text></paragraph><paragraph id="id1e81e3be8df54fe2bfc728e8ea51d6db"><enum>(19)</enum><text>maintaining a public database of energy storage projects, policies, codes, standards, and regulations; and</text></paragraph><paragraph id="idcb58cd7a44dd45acb0f4f500dd854100"><enum>(20)</enum><text>such other criteria as the Secretary of Defense, in consultation with the Secretary of Energy, determines appropriate.</text></paragraph></subsection><subsection id="id5d1b5e9e22c246c9916ce37bd3ecc936"><enum>(d)</enum><header>Collaboration</header><text>The program under subsection (a) shall be carried out in collaboration with relevant stakeholders, including, as appropriate—</text><paragraph id="idedfb58e19a01483c86d563ab40683e56"><enum>(1)</enum><text>States;</text></paragraph><paragraph id="idde6dcba4a29b488ead60d4ca96a62e99"><enum>(2)</enum><text>Indian tribes;</text></paragraph><paragraph id="idb5dc10b8dcc14c37a342e1d25f12fa9e"><enum>(3)</enum><text>regional entities and regulators;</text></paragraph><paragraph id="id987c3ac608114677892b3abacda099b1"><enum>(4)</enum><text>units of local government;</text></paragraph><paragraph id="id915da53b35b140ebbb9fcb4b3bb098d2"><enum>(5)</enum><text>institutions of higher education, including historically Black colleges or universities and other minority-serving institutions; and</text></paragraph><paragraph id="id47e3780acc874801b9a575fe87c93ed3"><enum>(6)</enum><text>private sector entities.</text></paragraph></subsection><subsection id="idad4374e2c6d744a685120a61e19fdc71"><enum>(e)</enum><header>Report</header><paragraph id="id08ea75ab590b400994e2988ba5cc9592"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter until 2031, the Secretary of Defense shall submit to the congressional defense committees a report on the efforts to implement the program under subsection (a), including any strategy developed to implement such program.</text></paragraph><paragraph id="id1b68d4be0c1b49be9cf63fcdffc2a543"><enum>(2)</enum><header>Classified annex</header><text>The report under paragraph (1) shall be submitted in unclassified form but may contain a classified annex if necessary.</text></paragraph><paragraph id="id60e58d404367495ea982137111138112"><enum>(3)</enum><header>Publication</header><text>Upon submittal of the report under paragraph (1), the Secretary shall publish the unclassified portion of the report on an internet website of the Department that is available to the public.</text></paragraph></subsection><subsection id="id86ec4081636e407fbc4c59d496462c74"><enum>(f)</enum><header>Assistance to States</header><text>The Secretary of Defense may provide technical and financial assistance to States, Indian tribes, units of local government, institutions of higher education, or private sector entities to participate in or use research, development, or demonstration of technology developed under this section.</text></subsection><subsection id="idf3755349f40640829da5e899139f7de2"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Defense to carry out this section the following:</text><paragraph id="idA36A3A49348E4426BE0EDE9BDD21DCBA"><enum>(1)</enum><text>For fiscal year 2022, $10,000,000.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD3BFC0A3AAB04F7396C2F0AFC4419D3D"><enum>(2)</enum><text display-inline="yes-display-inline">For fiscal year 2023, $25,000,000.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF5EF3EE2BC45482A89AA3BE44DA7B43D"><enum>(3)</enum><text display-inline="yes-display-inline">For fiscal year 2024, funds</header><text>To the maximum extent practicable, in carrying out this section, the Secretary of Defense shall ensure that the use of funds to carry out this section is coordinated with the Secretary of Energy and among different offices within the Grid Modernization Initiative of the Department of Energy and other programs conducting energy storage research.</text></subsection><subsection id="idbb6fbdbb463a4c09b30e9ac771aac33b"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id60C697A7DEFB4C1981A8F4B8BCA988FD"><enum>(1)</enum><header>Historically Black college or university</header><text>The term <term>historically Black college or university</term> has the meaning given the term <term>part B institution</term> in section 322(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061(2)</external-xref>).</text></paragraph><paragraph id="id18f25cd2276d4dc4bed50fe7f7132efa"><enum>(2)</enum><header>Hybrid microgrid system</header><text>The term <term>hybrid microgrid system</term> means a stand-alone electrical system that—</text><subparagraph id="idb057a29be72446d985d81861578858bf"><enum>(A)</enum><text>is comprised of conventional generation and at least one alternative energy resource; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2ca4d1e7fc5f4d59acfc02c1074bf38f"><enum>(B)</enum><text>may use grid-scale energy storage.</text></subparagraph></paragraph><paragraph id="id9226461978954ff9a5b49f98c3c68af3"><enum>(3)</enum><header>Microgrid system</header><text>The term <term>microgrid system</term> means a standalone electrical system that uses grid-scale energy storage.</text></paragraph><paragraph id="ide6d998c8ab72405ba04609cf009e2902"><enum>(4)</enum><header>National laboratory</header><text>The term <term>National Laboratory</term> has the meaning given that term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>).</text></paragraph></subsection></section><section id="idb1ffd23b66f54df0922fc3701513c913"><enum>9.</enum><header>Conditions on base realignment and closure activities funded through base closure account of Department of Defense</header><subsection id="ida1e7826cb1814cb99352d77ef2879e32"><enum>(a)</enum><header>Consideration of factors required</header><text>With respect to any Base Realignment and Closure round begun by the Department of Defense after the date of the enactment of this Act, the Department shall consider current and potential vulnerabilities to installations and operations of the Department of Defense resulting from climate change and the resiliency of installations of the Department.</text></subsection><subsection id="ide6ea0b21946140e08a95e58f79fb8d3b"><enum>(b)</enum><header>Base Realignment and Closure round defined</header><text>In this section, the term <term>Base Realignment and Closure round</term> means base realignment and closure activities, including real property acquisition and military construction projects, as authorized by the Defense Base Closure and Realignment Act of 1990 (part A of title XXIX of <external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law 101–510</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2687">10 U.S.C. 2687</external-xref> note) and funded through the Department of Defense Base Closure Account established by section 2906 of such Act (as amended by section 2711 of the Military Construction Authorization Act for Fiscal Year 2013 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/112/239">Public Law 112–239</external-xref>; 126 Stat. 2140)).</text></subsection></section></legis-body></bill>
