which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Energy to provide rebates for the installation of zero-emission technologies in single-family homes and multifamily buildings, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Zero-Emission Homes Act of 2021</short-title></quote>.</text></section><section id="id9367984FD5DE4690A10D91159E3E3F5B"><enum>2.</enum><header>Zero-emission home program</header><subsection id="idc7f4671a711e4a49afc61581c7035f60"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id3cb2508eb421499fadbf8f704182b2b5"><enum>(1)</enum><header>Certified contractor</header><text>The term <term>certified contractor</term> means a contractor with an industry-recognized certification reflecting training, education, or other technical expertise relating to qualified electrification projects for residential buildings, as identified by the Secretary.</text></paragraph><paragraph id="id9247cb713c1a464db5787dfc2ca001dd" commented="no"><enum>(2)</enum><header>Contractor company</header><text>The term <term>contractor company</term> means a company—</text><subparagraph id="id2f883ba533184c5fa7111400d7d2c07c" commented="no"><enum>(A)</enum><text>the business of which is to provide services—</text><clause commented="no" id="idA660FE094F7846509005C2F2B309F34A"><enum>(i)</enum><text>to residential building owners; and</text></clause><clause commented="no" id="id64FAB0C227664B32BB52ACF88EEC8596"><enum>(ii)</enum><text>for which a rebate may be provided pursuant to the Program; and</text></clause></subparagraph><subparagraph id="id028e47b2fad0463bb4d8048d73385b5e" commented="no"><enum>(B)</enum><text>that holds the licenses and insurance required by the State in which the company provides services.</text></subparagraph></paragraph><paragraph id="idEFB0831D03E647E2BD3628856D6C2A55"><enum>(3)</enum><header>Electric load or service center upgrade</header><text>The term <term>electric load or service center upgrade</term> means an improvement to a circuit breaker panel that enables the installation and use of—</text><subparagraph id="id7786ACFAA4D9485EB73AFD866B0FD4BE"><enum>(A)</enum><text>a QEP described in any of subclauses (II) through (IV) of paragraph (10)(A)(i); or</text></subparagraph><subparagraph id="id52FA90D44C6E4A82AB9B0A9BC7043794"><enum>(B)</enum><text>if determined to be appropriate by the Secretary, a QEP described in any of subclauses (I) through (III) of paragraph (10)(A)(ii). </text></subparagraph></paragraph><paragraph id="idCE91641D4AF64CB2A506912EFDAAEF7E"><enum>(4)</enum><header>Heat pump</header><text>The term <term>heat pump</term> means a heat pump used for water heating, space heating, or space cooling that—</text><subparagraph id="id04F276A38B5347379FD1926A177C15A1"><enum>(A)</enum><text>relies solely on electricity for its source of power; and </text></subparagraph><subparagraph id="id9B8C04F1D15541AEB541119211BCC40E"><enum>(B)</enum><text>is air-sourced, geothermal- or ground-sourced, or water-sourced.</text></subparagraph></paragraph><paragraph id="idb93051e1f1fc4353b7b2ce3817ae9533"><enum>(5)</enum><header>Home</header><text>The term <term>home</term> means each of—</text><subparagraph id="idD093DB62575F48499F6B61AB700FA403"><enum>(A)</enum><text>a building with not more than 1 dwelling unit, an individual condominium unit, or a manufactured housing unit, that—</text><clause id="id7f1dc19795ad4e30880b2052c9f94441"><enum>(i)</enum><text>is located in a State; and</text></clause><clause id="idbd29b3e9f51045ca946c927b7b67e55f"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id91D7B43B387144EBB8F654210FA367F4"><enum>(I)</enum><text>is the primary residence of—</text><item id="id79B20AEC122042E58051FB2700DB7DEE" indent="up1"><enum>(aa)</enum><text>the owner of that building, condominium unit, or manufactured housing unit, as applicable; or </text></item><item indent="up1" id="idA17B56DA9A6B45F99A643FC6D9BD815A"><enum>(bb)</enum><text>a renter; or</text></item></subclause><subclause indent="up1" id="idFBB98F51B4F24D1C91D5813152F494E0"><enum>(II)</enum><text>is a new-construction single-family residential home; and</text></subclause></clause></subparagraph><subparagraph id="id87D8EB10F2E44D43810B7A8B26C0DE87"><enum>(B)</enum><text>a unit of a multifamily building that—</text><clause id="id5C4494283C2E48AD9CD291BAC56100F0"><enum>(i)</enum><text>is owned by an individual who is not the owner of the multifamily building;</text></clause><clause id="idD5D77453AD1E4497A5F9D0BFB9E53994"><enum>(ii)</enum><text>is located in a State; and</text></clause><clause id="idF4E4A5DF22E34C0C98EFF7F77B4BC8AB"><enum>(iii)</enum><text>is the primary residence of—</text><subclause id="idF649E3C67FBF47ED9CF9CA8C3DA37C48"><enum>(I)</enum><text>the owner of that unit; or</text></subclause><subclause id="id1AC6C1C6D7C04742B61F6F315F2EF4E4"><enum>(II)</enum><text>a renter.</text></subclause></clause></subparagraph></paragraph><paragraph id="id003E6FA9EBCA492DA558E762ED93A619"><enum>(6)</enum><header>HVAC</header><text>The term <term>HVAC</term> means heating, ventilation, and air conditioning. </text></paragraph><paragraph id="id773299d20fed4480a933a6b0a4557c9e" commented="no"><enum>(7)</enum><header>Low- or moderate-income</header><text>The term <term>low- or moderate-income</term>, with respect to a household, means a household—</text><subparagraph commented="no" id="id564DF6434020435B9D9C8B3B26650E8F"><enum>(A)</enum><text>with an annual income that is less than 80 percent of the annual median income of the area in which the household is located; or</text></subparagraph><subparagraph commented="no" id="id674F1BEDE1E1457DAC3B79D8BC695648"><enum>(B)</enum><text>that is low-income (as defined in section 412 of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6862">42 U.S.C. 6862</external-xref>)).</text></subparagraph></paragraph><paragraph id="id1e79aebbef914a3cb4d8c9732d5c6ccf"><enum>(8)</enum><header>Multifamily building</header><text>The term <term>multifamily building</term> means any building—</text><subparagraph id="idAF6893FEA1DE40399B4AF530BB518E46"><enum>(A)</enum><text>with 2 or more dwelling units that—</text><clause id="id27A2D2DBFAD3426EB24E067D3BE6149D"><enum>(i)</enum><text>are built on top of one another or side-by-side; and</text></clause><clause id="id1547712D519542AF9C0A90F63E9C9F97"><enum>(ii)</enum><text>may share common facilities; and</text></clause></subparagraph><subparagraph id="id9F91A2A271DB414180495667DB0D2ED9"><enum>(B)</enum><text>that is not a home.</text></subparagraph></paragraph><paragraph id="id78ce91ead9cd460582dfffd8cfbeaa25" commented="no"><enum>(9)</enum><header>Program</header><text>The term <term>Program</term> means the Zero-Emission Home Program established under subsection (b).</text></paragraph><paragraph id="id33335868c6e8496e80228a0f49e780ed" commented="no"><enum>(10)</enum><header>Qualified electrification project; QEP</header><subparagraph commented="no" id="idF1738418D314454B9F192C78BD73F128"><enum>(A)</enum><header>In general</header><text>The terms <term>qualified electrification project</term> and <term>QEP</term> mean a project that, as applicable—</text><clause commented="no" id="id0A3E8D6A23BA44EBAD242D86A2C169D7"><enum>(i)</enum><text>installs, or enables the installation and use of, in a home or multifamily building—</text><subclause id="idc1cbfe9803b04eb7aba127246eaff999" commented="no"><enum>(I)</enum><text>an electric load or service center upgrade;</text></subclause><subclause id="id357211f078cc4c878a75679b5c57fad9" commented="no"><enum>(II)</enum><text>an electric heat pump;</text></subclause><subclause id="id8e3d2fa887e041669bd41421e76abe69" commented="no"><enum>(III)</enum><text>an induction or noninduction electric stove, cooktop, range, or oven that has received an Energy Star Emerging Technology Award (or meets a more stringent standard, as determined by the Secretary, if the Secretary determines a more stringent standard to be appropriate); or</text></subclause><subclause id="id3f68f267fbac41a5959f227fb75cd530" commented="no"><enum>(IV)</enum><text>an electric heat pump clothes dryer that is Energy Star Most Efficient certified (or meets a more stringent standard, as determined by the Secretary, if the Secretary determines a more stringent standard to be appropriate); or</text></subclause></clause><clause commented="no" id="idA45F42CD37FB441094463F1CF8DC9E2C"><enum>(ii)</enum><text>if determined to be appropriate by the Secretary, installs, or enables the installation and use of, in a home or multifamily building described in subparagraph (B)—</text><subclause id="id7cd66ea10c6b419c99f3f0efb7fdf9c0" commented="no"><enum>(I)</enum><text>a solar photovoltaic system, including any electrical equipment, wiring, or other components necessary for the installation and use of the solar photovoltaic system, including a battery storage system;</text></subclause><subclause id="id5317447a4b2c498aa775f261e1e40d58" commented="no"><enum>(II)</enum><text>electric vehicle charging infrastructure or electric vehicle support equipment necessary to recharge an electric vehicle on-site; or</text></subclause><subclause id="ida744006892394a67821f283f2a90e587" commented="no"><enum>(III)</enum><text>electrical rewiring, power sharing plugs, or other installation tasks directly related to and necessary for the safe and effective functioning of a QEP in a home or multifamily building.</text></subclause></clause></subparagraph><subparagraph commented="no" id="id689A4D60A3ED429EB279C573811161D9"><enum>(B)</enum><header>Home or multifamily building described</header><text>A home or multifamily building referred to in subparagraph (A)(ii) is a home or multifamily building that is certified, or the household of the homeowner of which is certified, as applicable, as low- or moderate-income pursuant to the procedures established under subsection (d)(1). </text></subparagraph><subparagraph commented="no" id="id0FB889EF27DE4BE58BC9632D235D8CB4"><enum>(C)</enum><header>Exclusions</header><text>The terms <term>qualified electrification project</term> and <term>QEP</term> do not include any project with respect to which the appliance, system, equipment, infrastructure, component, or other item described in clause (i) or (ii) of subparagraph (A) is not certified under the Energy Star program established by section 324A of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>) if, as of the date on which the project is carried out, the item is of a category for which a certification is provided under that program.</text></subparagraph></paragraph><paragraph id="iddb44e0689e734383a5025dde68abe4ea"><enum>(11)</enum><header>Qualified provider</header><text>The term <term>qualified provider</term> means an electric utility, Tribal-owned entity or Tribally Designated Housing Entity (TDHE), or commercial, nonprofit, or government entity, including a retailer and a contractor company, that provides services for which a rebate may be provided pursuant to the Program for 1 or more portfolios that consist of 1 or more qualified electrification projects. </text></paragraph><paragraph id="ida526476d584449d3a1644595f2ac35a9"><enum>(12)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="id8D430EB072AA45A38250F576C1B9B9AB"><enum>(13)</enum><header>Solar photovoltaic system</header><text>The term <term>solar photovoltaic system</term> means a system—</text><subparagraph id="id3F2A2A4A1A814E348FDBFF7A2F80A639"><enum>(A)</enum><text>placed on-site at a home or multifamily building, or as part of the community of the home or multifamily building; and</text></subparagraph><subparagraph id="id52C01DEAA67A4D4CAA4313743388C1FC"><enum>(B)</enum><text>that generates electricity from the sun specifically for the home, multifamily building, or community.</text></subparagraph></paragraph><paragraph id="id42A4B3E2AB0D4CF8838DF74A41BFCE6C"><enum>(14)</enum><header>Tribal community</header><text>The term <term>Tribal community</term> means a Tribal tract or Tribal block group.</text></paragraph><paragraph id="id4f3dde73418943f99226b8752b16c7bb"><enum>(15)</enum><header>Underserved community</header><text>The term <term>underserved community</term> means a community located in a census tract that is identified by the Secretary as—</text><subparagraph id="idfc0337a51f5441bb8ae75218f3fc4ccb"><enum>(A)</enum><text>a low- or moderate-income community; or</text></subparagraph><subparagraph id="id45297e96d3d74b23bcff49775bd275c8"><enum>(B)</enum><text>a community of racial or ethnic minority concentration.</text></subparagraph></paragraph><paragraph id="idb976714e915c432fb0a5348e4e91991c" commented="no" display-inline="no-display-inline"><enum>(16)</enum><header>Zero-emission home rebate</header><text>The term <term>zero-emission home rebate</term> means a rebate provided in accordance with subsection (c).</text></paragraph></subsection><subsection id="idf780f8a2093947bc81630ed7e7ff8a53"><enum>(b)</enum><header>Establishment of Program</header><text display-inline="yes-display-inline">The Secretary shall establish a program, to be known as the <quote>Zero-Emission Home Program</quote>, to provide zero-emission home rebates in accordance with subsection (c).</text></subsection><subsection id="id530FEEF13852441DAB9CBFB2486D26FE"><enum>(c)</enum><header>Zero-Emission home rebates for qualified electrification projects</header><paragraph id="id0cca1d6f258649e68154bc47a0820818"><enum>(1)</enum><header>Zero-emission home rebates</header><subparagraph id="id65D6D450EDA74E549B1A8A577AA0DFD2"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), in carrying out the Program, the Secretary shall provide to homeowners and owners of multifamily buildings zero-emission home rebates, in accordance with this subsection, for qualified electrification projects carried out at, or relating to, the homes or multifamily buildings, as applicable.</text></subparagraph><subparagraph id="id8F7C1B5ED1C64F69A827E43901345B0C"><enum>(B)</enum><header>Requirement</header><text>The provision of a zero-emission home rebate under this paragraph shall be subject to the availability of appropriations for that purpose. </text></subparagraph></paragraph><paragraph id="id78840920D780483DB00EA3DBFD455641"><enum>(2)</enum><header>Amount of rebate</header><subparagraph id="idE7194762354C44369905E733BBE718D3"><enum>(A)</enum><header>In general</header><text>Subject to subsection (d)(2)(A)(i), a zero-emission home rebate under paragraph (1) shall be equal to—</text><clause id="idfe2a5d578bfd4458ba6383d9d426f8ea"><enum>(i)</enum><text>in the case of a qualified electrification project described in subsection (a)(10)(A)(i)(II) that installs a heat pump used for water heating, not more than $1,250;</text></clause><clause id="idf1912ac2932449e0bdca2549e8d7eabd"><enum>(ii)</enum><text>in the case of a qualified electrification project described in subsection (a)(10)(A)(i)(II) that installs a heat pump HVAC system—</text><subclause id="id9A9621EA90E84D75AC3A3051C7C832BA"><enum>(I)</enum><text>not more than $3,000 if the heat pump HVAC system has a heating capacity of not less than 27,500 Btu per hour; and</text></subclause><subclause id="id1A5E5778CC60475C97438BC8539817AC"><enum>(II)</enum><text>not more than $1,500 if the heat pump HVAC system has a heating capacity of less than 27,500 Btu per hour;</text></subclause></clause><clause id="id66aae173a10e4a53b10397fa2846edae"><enum>(iii)</enum><text>in the case of a qualified electrification project described in subclause (III) or (IV) of subsection (a)(10)(A)(i), not more than $600; </text></clause><clause id="idc1137157fd8e4f8290279aca6745d196"><enum>(iv)</enum><text>in the case of a qualified electrification project described in subsection (a)(10)(A)(i)(I) that installs an electric load or service center panel that enables the installation and use of any upgrade, appliance, system, equipment, infrastructure, component, or other item installed pursuant to any other qualified electrification project, not more than $3,000; and</text></clause><clause id="id74b60c555cd040cbb9b7541e6ab33a58"><enum>(v)</enum><text>in the case of any other qualified electrification project, including a qualified electrification project described in any of subclauses (I) through (III) of subsection (a)(10)(A)(ii), for which the Secretary provides a zero-emission home rebate, not more than an amount determined by the Secretary for that qualified electrification project, subject to subparagraph (B).</text></clause></subparagraph><subparagraph id="idBF3D141AB2654412838E9445A9D090A5"><enum>(B)</enum><header>Limitations on amount of rebate</header><clause id="idDFA22E91AA9C475CB783BED0BDC881F2"><enum>(i)</enum><header>Maximum total amount</header><text>Subject to subsection (d)(2)(A)(ii), the maximum total amount that may be awarded as zero-emission home rebates under this subsection shall be $10,000 with respect to each home for which a zero-emission home rebate is provided.</text></clause><clause id="iddb32b01587324b4e866580433538754c"><enum>(ii)</enum><header>Costs</header><subclause id="id7ADF996EB43948BFB4C12AF52A6AA2D9"><enum>(I)</enum><header>In general</header><text>Subject to subsection (d)(2)(A)(iii), the amount of a zero-emission home rebate provided to a homeowner under this subsection shall not exceed 50 percent of the total cost of the applicable qualified electrification project.</text></subclause><subclause id="id5615A2D6CF484F16A6E8CDE2407C26DB"><enum>(II)</enum><header>Labor costs</header><text>Subject to subsection (d)(2)(A)(iii), not more than 50 percent of the labor costs associated with a qualified electrification project may be included in the 50 percent of total costs for which a zero-emission home rebate is provided under this subsection, as described in subclause (I), subject to the condition that labor costs account for not more than 50 percent of the amount of the zero-emission home rebate.</text></subclause></clause></subparagraph></paragraph><paragraph id="idda5b25647bef4facbb18e3b4a5d72eb5"><enum>(3)</enum><header>Limitations on QEPs</header><subparagraph id="idB0DA5B77406F401894340E085719A65F"><enum>(A)</enum><header>Contractors</header><text>A zero-emission home rebate may be provided for a qualified electrification project carried out by a contractor only if that contractor is a certified contractor.</text></subparagraph><subparagraph id="id44699D3D4DE749F897CB9594AF964CE0"><enum>(B)</enum><header>Heat pump HVAC systems</header><text>A zero-emission home rebate may be provided for a qualified electrification project that installs or enables the installation of a heat pump HVAC system only if the heat pump HVAC system—</text><clause id="id5E8F210B42F04C71B38990584BA49C3B"><enum>(i)</enum><text>replaces—</text><subclause id="id0E734F675D684687B6C65BFA86AD179E"><enum>(I)</enum><text>a nonelectric HVAC system; or</text></subclause><subclause id="idA84AFD9DF76A4C01BB1B4852D927BD66"><enum>(II)</enum><text>an electric resistance HVAC system; or</text></subclause></clause><clause id="id165B7464C2F6465A82E40D1F29295081"><enum>(ii)</enum><text>is part of new construction, as determined by the Secretary.</text></clause></subparagraph><subparagraph id="idF2E990E1A585493F87483C3884AC9675"><enum>(C)</enum><header>Heat pumps for water heating</header><text>A zero-emission home rebate may be provided for a qualified electrification project that installs or enables the installation of a heat pump used for water heating only if the heat pump—</text><clause id="idBCD72FFE79CC459894499C031D532C46"><enum>(i)</enum><text>replaces—</text><subclause id="id2B49635FACB74CDB92EC9FC86BC1782A"><enum>(I)</enum><text>a nonelectric heat pump water heater;</text></subclause><subclause id="idBCF41651BA0A44E4864154629477081D"><enum>(II)</enum><text>a nonelectric water heater; or</text></subclause><subclause id="idF6651EB518E543A48F8B60E1BFB85066"><enum>(III)</enum><text>an electric resistance water heater; or</text></subclause></clause><clause id="id8E4D74966A22421A960463F06BDCECBA"><enum>(ii)</enum><text>is part of new construction, as determined by the Secretary.</text></clause></subparagraph><subparagraph id="idFF96D0FFCDF44208BC27C4C1574D7570"><enum>(D)</enum><header>Electric stoves, cooktops, ranges, and ovens</header><text>A zero-emission home rebate may be provided for a qualified electrification project described in subsection (a)(10)(A)(i)(III) only if the applicable electric stove, cooktop, range, or oven—</text><clause id="id077A531CE4FA4E189EE6D372CEA56333"><enum>(i)</enum><text>replaces a nonelectric stove, cooktop, range, or oven; or</text></clause><clause id="id4B218C0435314674B2DB77DB62B1A852"><enum>(ii)</enum><text>is part of new construction, as determined by the Secretary.</text></clause></subparagraph><subparagraph id="idE791282F1F3F4E7381D0BA98861A8922"><enum>(E)</enum><header>Electric heat pump clothes dryers</header><text>A zero-emission home rebate may be provided for a qualified electrification project described in subsection (a)(10)(A)(i)(IV) only if the applicable electric heat pump clothes dryer—</text><clause id="idF9F50D083F734D1796975F1ED8983B6E"><enum>(i)</enum><text>replaces a nonelectric clothes dryer; or</text></clause><clause id="id888FF4FB00B34C84B597CE1C07E00880"><enum>(ii)</enum><text>is part of new construction.</text></clause></subparagraph></paragraph><paragraph id="idecc59ad54bd24579b79a2e98c90fe09b"><enum>(4)</enum><header>Additional incentives for contractors and qualified providers</header><subparagraph id="id795D7C45362F4304A5C2F29B487736B9"><enum>(A)</enum><header>General incentive</header><clause id="id4FED480375984C05873B37FEBEB284B4"><enum>(i)</enum><header>In general</header><text>With respect to each qualified electrification project described in clause (ii), the Secretary shall provide a payment of $100 to the certified contractor or qualified provider carrying out the qualified electrification project.</text></clause><clause id="id63B6BF74EB1249AFA000DFEDBD2C6AD7"><enum>(ii)</enum><header>Qualified electrification project described</header><text>A qualified electrification project referred to in clause (i) is a qualified electrification project—</text><subclause id="idA9351086568940419777E2927CA5E7F9"><enum>(I)</enum><text>that is carried out at a home or multifamily building;</text></subclause><subclause id="id15AAD5BC8FBD4EB79F5A584C4F8CAEF4"><enum>(II)</enum><text>for which a rebate is provided under this subsection; and</text></subclause><subclause id="idA059B3E8EB104705B546C959E34634C2"><enum>(III)</enum><text>with respect to which the certified contractor or qualified provider is not eligible for a higher payment under any of subparagraphs (B) through (D).</text></subclause></clause></subparagraph><subparagraph id="id9308B56AB2AF45F8B606CC7C118E8DFA"><enum>(B)</enum><header>Incentive for QEPs in certain communities and households</header><clause id="id1F2CD522053246D2B7D4FA3497C736A4"><enum>(i)</enum><header>In general</header><text>With respect to each qualified electrification project described in clause (ii), the Secretary shall provide a payment of $200 to the certified contractor or qualified provider carrying out the qualified electrification project.</text></clause><clause id="id26B5FF7321EA410F97D3535C7378A41F"><enum>(ii)</enum><header>Qualified electrification project described</header><text>A qualified electrification project referred to in clause (i) is a qualified electrification project—</text><subclause id="idFA590437B5F74DF899963508D3A95863"><enum>(I)</enum><text>that is carried out at a home or multifamily building that—</text><item id="id38E55B6F2B7A417295667DE819EC6D24"><enum>(aa)</enum><text>is located in an underserved community or a Tribal community; or</text></item><item id="id097F5DED06834E8596659C1AE5302D7F"><enum>(bb)</enum><text>is certified, or the household of the homeowner of which is certified, as applicable, as low- or moderate-income pursuant to the procedures established under subsection (d)(1);</text></item></subclause><subclause id="id69402EFB808A45188E6D92642E22F5DE"><enum>(II)</enum><text>for which a rebate is provided under this subsection; and</text></subclause><subclause id="id7C9085F084914A888C16AC544CA2FAFA"><enum>(III)</enum><text>with respect to which the certified contractor or qualified provider is not eligible for a higher payment under subparagraph (C) or (D).</text></subclause></clause></subparagraph><subparagraph id="id22A24409D60F4218AD8B035B4831C5F9"><enum>(C)</enum><header>Incentive for certain labor practices</header><clause id="id462E152F2D394D97AEB4DA02C3CFB493"><enum>(i)</enum><header>In general</header><text>With respect to each qualified electrification project described in clause (ii), the Secretary shall provide a payment of $250 to the certified contractor or qualified provider carrying out the qualified electrification project.</text></clause><clause id="id7BC8BCD3A06B4AC289D8294994A8271A"><enum>(ii)</enum><header>Qualified electrification project described</header><text>A qualified electrification project referred to in clause (i) is a qualified electrification project—</text><subclause id="id2E50399D44DB47C48CF6BC48AB9EF7FA"><enum>(I)</enum><text>that is carried out—</text><item id="id3202977D63164FCEB79D924D80AD16E8"><enum>(aa)</enum><text>at a home or multifamily building; and</text></item><item id="id2F299717D2C649E5AFDE09F3588005A7"><enum>(bb)</enum><text>by a certified contractor or qualified provider that allows for the use of collective bargaining agreements;</text></item></subclause><subclause id="id01C94EF0CE8E4B8C810A74ED2C4D8E27"><enum>(II)</enum><text>for which a rebate is provided under this subsection; and</text></subclause><subclause id="id1D3E8238BCDE4DEA86ED4D8CE431C749"><enum>(III)</enum><text>with respect to which—</text><item id="id2B5F65803372417486BF992080F8382A"><enum>(aa)</enum><text>all laborers and mechanics employed on the qualified electrification project are paid wages at rates not less than those prevailing on projects of a character similar in the locality, as determined by the Secretary of Labor in accordance with subchapter IV of chapter 31 of part A of subtitle II of title 40, United States Code (commonly referred to as the <quote>Davis-Bacon Act</quote>); and</text></item><item id="idD8994489872B40F59BB62773D22D0C3E"><enum>(bb)</enum><text>the certified contractor or qualified provider is not eligible for a higher payment under subparagraph (D).</text></item></subclause></clause></subparagraph><subparagraph id="id40484fe36ee047e5b5024d0b4937ee5b"><enum>(D)</enum><header>Maximum incentive</header><clause id="id8684B644725A4533B3012E496DCA7B9A"><enum>(i)</enum><header>In general</header><text>With respect to each qualified electrification project described in clause (ii), the Secretary shall provide a payment of $500 to the certified contractor or qualified provider carrying out the qualified electrification project.</text></clause><clause id="id27E3E68235DE4562AB402B4C5AA235A6"><enum>(ii)</enum><header>Qualified electrification project described</header><text>A qualified electrification project referred to in clause (i) is a qualified electrification project—</text><subclause id="idA91AF554BD564CEEA3751BFCE8D69FEF"><enum>(I)</enum><text>that is carried out—</text><item id="idE616AD4F849B478D8444501BA03CB9DF"><enum>(aa)</enum><text>at a home or multifamily building that—</text><subitem id="idA4DB8AA036B94ABDB55253EA38B345FB"><enum>(AA)</enum><text>is located in an underserved community or a Tribal community; or</text></subitem><subitem id="id3E66534E9F80431DA7B5128CB686A664"><enum>(BB)</enum><text>is certified, or the household of the homeowner of which is certified, as applicable, as low- or moderate-income pursuant to the procedures established under subsection (d)(1); and</text></subitem></item><item id="id26BBEE73BA674A22ADCE475B42122F69"><enum>(bb)</enum><text>by a certified contractor or qualified provider that allows for the use of collective bargaining agreements;</text></item></subclause><subclause id="id5B504AFCB331422C95A818FCBD28C359"><enum>(II)</enum><text>for which a rebate is provided under this subsection; and</text></subclause><subclause id="idC1FBE3787CBA469EB2E389017FDB9BD3"><enum>(III)</enum><text>with respect to which all laborers and mechanics employed on the qualified electrification project are paid wages at rates not less than those prevailing on projects of a character similar in the locality, as determined by the Secretary of Labor in accordance with subchapter IV of chapter 31 of part A of subtitle II of title 40, United States Code (commonly referred to as the <quote>Davis-Bacon Act</quote>). </text></subclause></clause></subparagraph><subparagraph id="id00C71E5F0ADA4CEA9D075967989DC537"><enum>(E)</enum><header>Clarification</header><text>An amount provided to a contractor or qualified provider under any of subparagraphs (A) through (D) shall be in addition to the amount of any zero-emission home rebate received by the contractor or qualified provider.</text></subparagraph></paragraph><paragraph id="idf04359b2e76a4599b708b4ca07ee0fcf"><enum>(5)</enum><header>Claim</header><subparagraph id="idE7A2C2255D6B4AA59DFFD2884D0E8C56"><enum>(A)</enum><header>In general</header><text>Subject to paragraph (2)(B), a homeowner, a certified contractor, or a qualified provider may claim a separate zero-emission home rebate under this subsection for each qualified electrification project carried out at a home.</text></subparagraph><subparagraph id="id431B2BDB29724C0CA9F753994BB205EE" commented="no"><enum>(B)</enum><header>Transfer</header><text>The Secretary shall establish and publish procedures pursuant to which a homeowner or owner of a multifamily building may transfer the right to claim a rebate under this subsection to the certified contractor or qualified provider carrying out the applicable qualified electrification project.</text></subparagraph></paragraph><paragraph id="id0ABBCA04E289458CA3576A1EE2DBE9F3"><enum>(6)</enum><header>Multifamily buildings</header><subparagraph id="id940FC46DCF5A4954851516D9D39A729A"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the owner of a multifamily building may combine the amounts of zero-emission home rebates for each dwelling unit in the multifamily building into a single rebate, subject to—</text><clause id="id65C26EBC385F416C934D7ADB8BAA7873"><enum>(i)</enum><text>the condition that the applicable qualified electrification projects benefit each dwelling unit with respect to which the rebate is claimed; and</text></clause><clause id="idA3762A8AFACE4FC98EBD15777E8F4F1E"><enum>(ii)</enum><text>any maximum per-dwelling unit rate established by the Secretary.</text></clause></subparagraph><subparagraph id="id3F292C5573834EF4B0CFFFD5674574CF"><enum>(B)</enum><header>Costs</header><clause id="idC96D3509240F4322908EF451C57F5560"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the amount of a rebate under subparagraph (A) shall not exceed 50 percent of the total cost, including labor costs, of the applicable qualified electrification projects.</text></clause><clause id="id6144FA2AD608434F8C8FF3359BB881D7"><enum>(ii)</enum><header>Low- or moderate-income buildings</header><text>In the case of a multifamily building that is certified by the Secretary as low- or moderate-income in accordance with subsection (d)(1)(B), the amount of a rebate under subparagraph (A) shall not exceed 100 percent of the total cost of the applicable qualified electrification projects.</text></clause></subparagraph><subparagraph id="idec50cc5bd4e1465e820d07f5d06d2dcf"><enum>(C)</enum><header>Procedures</header><text>The Secretary shall establish and publish procedures— </text><clause id="id286693AB51EE4C3EBA010273B85DEDC6"><enum>(i)</enum><text>pursuant to which the owner of a multifamily building may combine rebate amounts in accordance with this subsection; and</text></clause><clause id="id8FB6E4422EB0447BAF06B109CEB5CFFB"><enum>(ii)</enum><text>for the enforcement of any limitations under this subsection.</text></clause></subparagraph></paragraph><paragraph id="id59098918d06b477c8df071c70992b483" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header>Process</header><subparagraph commented="no" display-inline="no-display-inline" id="id38189CE760434400A3BDFC1803FE8526"><enum>(A)</enum><header>Rebate process</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall develop and publish a rebate processing system that results in immediate price relief for consumers who purchase and have installed qualified electrification projects, in accordance with this section.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id056D744B75E64A0FBA5E14EA0108BF74"><enum>(B)</enum><header>Qualified electrification project list</header><clause display-inline="no-display-inline" commented="no" id="idD3A2EC136C7B4E5196B16B9D95852698"><enum>(i)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall publish a list of qualified electrification projects for which a zero-emission home rebate may be provided under this subsection that includes, at a minimum, the qualified electrification projects described in subsection (a)(10)(A).</text></clause><clause display-inline="no-display-inline" commented="no" id="idF0F4093DE0B34BC98E921DC58F94E37D"><enum>(ii)</enum><header>Updates</header><text>Not less frequently than once every 3 years, the Secretary shall publish an updated list of qualified electrification projects for which a zero-emission home rebate may be provided under this subsection.</text></clause></subparagraph></paragraph></subsection><subsection id="id8A06C7241E77480987670081B73C92E7"><enum>(d)</enum><header>Special provisions for low- and moderate-Income households and multifamily buildings</header><paragraph id="ida3f1be92c8b74091964b7688e714d498"><enum>(1)</enum><header>Certifications</header><text>The Secretary shall establish procedures for certifying as low- or moderate-income each of—</text><subparagraph id="id2ce3bbffb9574f32a178ef9714414c6a"><enum>(A)</enum><text>the household of a homeowner; and</text></subparagraph><subparagraph id="idd94e8023b1964edc91572fd1f3de0c22"><enum>(B)</enum><text>a multifamily building.</text></subparagraph></paragraph><paragraph id="id201d41e7bc424599ac6e75c6556162a3"><enum>(2)</enum><header>Maximum amounts</header><subparagraph id="id3E4139BB61A84EE8A10EA5A75A9E7481"><enum>(A)</enum><header>In general</header><text>With respect to a qualified electrification project carried out at a location described in subparagraph (B)—</text><clause id="id4E76C04824464C11B7BE5697A1EC433F"><enum>(i)</enum><text>a zero-emission home rebate shall be equal to—</text><subclause id="id7B3EB7E201C8481E848F4D0EEDB8CBE4"><enum>(I)</enum><text>in the case of a qualified electrification project described in subsection (c)(2)(A)(i), not more than $1,750;</text></subclause><subclause id="id1FCD4D6C23C542C09ADE6259E2525ECB"><enum>(II)</enum><text>in the case of a qualified electrification project described in subsection (c)(2)(A)(ii)—</text><item id="idE917053050BD4CE7997AD5AA85F939DA"><enum>(aa)</enum><text>not more than $6,000 if the applicable heat pump HVAC system has a heating capacity of not less than 27,500 Btu per hour; and</text></item><item id="id9CA2B14A7AFD41558BD59871CEF481B9"><enum>(bb)</enum><text>not more than $3,000 if the applicable heat pump HVAC system has a heating capacity of less than 27,500 Btu per hour;</text></item></subclause><subclause id="id6BD4E12E51D84604979CBAE4F1C38454"><enum>(III)</enum><text>in the case of a qualified electrification project described in subsection (c)(2)(A)(iii), not more than $840; </text></subclause><subclause id="idCBF86D7CABAD4DE9BF3D2F68DB00CABE"><enum>(IV)</enum><text>in the case of a qualified electrification project described in subsection (c)(2)(A)(iv), not more than $4,000; and</text></subclause><subclause id="id631C1058E6E24306A63E00A223222E49"><enum>(V)</enum><text>in the case of a qualified electrification project described in subsection (c)(2)(A)(v), not more than an amount determined by the Secretary for that qualified electrification project, subject to clause (ii);</text></subclause></clause><clause id="idA57A896590F2497390277C412E54D533"><enum>(ii)</enum><text>the maximum total amount of zero-emission home rebates that may be awarded with respect to each home of a homeowner shall be $14,000; and</text></clause><clause id="idBDAA1F736BBE4442B0AAFF61E2D4DBFA"><enum>(iii)</enum><text>the amount of a zero-emission home rebate may be used to cover not more than 100 percent of the costs, including labor costs, of the applicable qualified electrification project.</text></clause></subparagraph><subparagraph id="idDD78C9FD14BD4DF88414CB161837ADC7"><enum>(B)</enum><header>Location described</header><text>A location referred to in subparagraph (A) is—</text><clause id="idD0FB9098C2CF4D91A7B38C79F62F6EE3"><enum>(i)</enum><text>a home—</text><subclause id="idB9BE38A38838468C9C075A2CC78D6C97"><enum>(I)</enum><text>with respect to which the household of the homeowner is certified as low- or moderate-income pursuant to the procedures established under paragraph (1)(A); or</text></subclause><subclause id="idC1FEC60209474C2DAF0D76BEE61FF31F"><enum>(II)</enum><text>that is located in a Tribal community; or</text></subclause></clause><clause id="idE743DFE03EC14A419EA1D2C6DA5BCDE1"><enum>(ii)</enum><text>a multifamily building—</text><subclause id="idC0FF97E6AC5F4B1FAADBFBC5FB5E7114"><enum>(I)</enum><text>that—</text><item id="idDAF3EFF9B120441BA900C8972A8D3C01"><enum>(aa)</enum><text>is certified as low- or moderate-income pursuant to the procedures established under paragraph (1)(B); or</text></item><item id="id5C7C291BCA684C559E24980FA73F5422"><enum>(bb)</enum><text>is located in a Tribal community; and</text></item></subclause><subclause id="id1D030BA2941A4053B66D46D1337BF3FD"><enum>(II)</enum><text>with respect to which more than more than ½ of the dwelling units in the multifamily building—</text><item id="id63de1aa7dcd241fdbe08fdc8ba73722f"><enum>(aa)</enum><text>are occupied by households the annual household incomes of which do not exceed 80 percent of the median annual household income for the area in which the multifamily building is located; and</text></item><item id="idfe58ae9550f6436c902451ed1758144c"><enum>(bb)</enum><text>have average monthly rental prices that are equal to, or less than, an amount that is equal to 30 percent of the average monthly household income for the area in which the multifamily building is located.</text></item></subclause></clause></subparagraph><subparagraph id="id3FD40F02D996400EA466D3A4BFB8728E"><enum>(C)</enum><header>Requirement</header><text>The Secretary may provide a rebate to the owner of a multifamily building in an amount described in subparagraph (A) only if the owner agrees in writing to provide commensurate benefits to the renters in that multifamily building.</text></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="idB20C79FD1F81415AA3FC50A83D51A7E4"><enum>(e)</enum><header>Education and outreach</header><text>Of the total amount appropriated by subsection (g)(1), the Secretary may use not more than $5,000,000 for community and consumer education and outreach related to the Program. </text></subsection><subsection id="idd41272ee1b35404299941d21e19df970"><enum>(f)</enum><header>Administration</header><text display-inline="yes-display-inline">The Secretary shall use not more than 1 percent of the amounts appropriated by subsection (g)(1)—</text><paragraph id="id03F9D4C80A91459DB53C82905B98B9EC"><enum>(1)</enum><text display-inline="yes-display-inline">to administer this section; and</text></paragraph><paragraph id="id6B9B9ABC54DA43589C4FEFC04AB3EEE4"><enum>(2)</enum><text display-inline="yes-display-inline">to provide administrative and technical support to certified contractors, qualified providers, States, and Indian Tribes. </text></paragraph></subsection><subsection id="id4539fae6892f47bf87af5723964a02a2"><enum>(g)</enum><header>Appropriations</header><paragraph id="ide945bb0d5b8e4a74aaf7f78f310124a4"><enum>(1)</enum><header>In general</header><text>In addition to amounts otherwise made available, there are appropriated to the Secretary for the 10-year period beginning on the date of enactment of this Act, out of any amounts in the Treasury not otherwise appropriated, such sums as are necessary to carry out this section, including to provide rebates under this section with respect to homes and multifamily buildings at which qualified electrification projects are carried out during that 10-year period.</text></paragraph><paragraph id="id905f1ffc49224381999c8a17011784c6"><enum>(2)</enum><header>Allocation for low- or moderate-Income households</header><subparagraph id="idFB080428B35B4889A8E2F242285F6437"><enum>(A)</enum><header>In general</header><text>Of the amounts appropriated by paragraph (1), the Secretary shall reserve 50 percent for—</text><clause id="id0968E3CB3A4D4A06AFEB120CA6D50CC0"><enum>(i)</enum><text>rebates relating to qualified electrification projects carried out for low- or moderate-income households; and</text></clause><clause id="id517ACE1CA9DF4F07AAEB6739B7289D68"><enum>(ii)</enum><text>any necessary administrative or technical support for those qualified electrification projects.</text></clause></subparagraph><subparagraph id="id5DFF4CCE83A14631B1743D1EBE799C0A"><enum>(B)</enum><header>Availability of reserved amounts</header><text>Amounts reserved under subparagraph (A) shall remain available until expended in accordance with that subparagraph.</text></subparagraph></paragraph><paragraph id="id634db17e4d5b4af9b33af3337d6b3351" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Allocation for Tribal communities</header><subparagraph commented="no" display-inline="no-display-inline" id="idAEF9861550B345A4A89CCCE17D066F8E"><enum>(A)</enum><header>In general</header><text>Of the amounts appropriated by paragraph (1), the Secretary shall reserve 11 percent for—</text><clause commented="no" display-inline="no-display-inline" id="idA8ED726F77F7475AA3E29781C0A93D0B"><enum>(i)</enum><text>rebates relating to qualified electrification projects carried out in Tribal communities; and</text></clause><clause display-inline="no-display-inline" commented="no" id="idD3A37CBDC5ED4E348805F346FA9F1065"><enum>(ii)</enum><text>any necessary administrative or technical support for those qualified electrification projects.</text></clause></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idA3105B488EF146FC927D3CFEB22748E2"><enum>(B)</enum><header>Availability of reserved amounts</header><text>Amounts reserved under subparagraph (A) shall remain available until expended in accordance with that subparagraph.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idAEBDD776350F402C8F8C01CADA76F584"><enum>(4)</enum><header>Use of reserved amounts for certain QEPs</header><text>With respect to a qualified electrification project carried out for a low- or moderate-income household that is located in a Tribal community, the Secretary may—</text><subparagraph display-inline="no-display-inline" commented="no" id="idACAD886FBC7A4B81B9EEFECE2290FB5D"><enum>(A)</enum><text>use amounts reserved under paragraph (2) or (3) for any rebate or necessary administrative or technical support for that qualified electrification project; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id58DE6AA9034D43739011ADB370813FCC"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idE98982A72E68464D848C4A1957FA6D09"><enum>(i)</enum><text>if the Secretary uses amounts reserved under paragraph (2) as described in subparagraph (A), consider a corresponding amount reserved under paragraph (3) to be unreserved and eligible for use for any purpose authorized under this section; or</text></clause><clause display-inline="no-display-inline" commented="no" indent="up1" id="idDD6D26F0CFFB4CCBA39AA5F8E8F361B9"><enum>(ii)</enum><text>if the Secretary uses amounts reserved under paragraph (3) as described in subparagraph (A), consider a corresponding amount reserved under paragraph (2) to be unreserved and eligible for use for any purpose authorized under this section.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
