which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve activities for the gathering of data on, and the tracking of, new variants of COVID–19. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6EA5FC43920B45BBAE86E603DBFF175A"><section section-type="section-one" id="H6F32A4DB8F6E4E68BD7B79E002CB1E4A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tracking COVID–19 Variants Act</short-title></quote>.</text></section><section id="H905D742153F346679E7DE3491BB74621"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="H06E62663B79A471FB29309FB13BF3700"><enum>(1)</enum><text>new variants of SARS–CoV–2 are being identified around the world and in the United States;</text></paragraph><paragraph id="HBDB06ACBA5CE494EA6F2022503094DB1"><enum>(2)</enum><text>identifying new variants of SARS–CoV–2 and analyzing the epidemiology of variants are critical to the continued response to the COVID–19 pandemic and efforts to prepare for future pandemics;</text></paragraph><paragraph id="HD8F64B72C4BC4C43861A558B598FF8BE"><enum>(3)</enum><text>national sequence-based surveillance will enable the United States to best identify new variants; and</text></paragraph><paragraph id="H312A463A3F394FD3AD14E1A74888D464"><enum>(4)</enum><text>the United States is conducting sequence-based surveillance of approximately 0.3 percent of COVID–19 cases, lagging far behind other nations.</text></paragraph></section><section id="HFD1A6A0CD6194187AE56745924E8B79B"><enum>3.</enum><header>Guidance</header><text display-inline="no-display-inline">The Secretary of Health and Human Services (referred to in this Act as the <quote>Secretary</quote>), acting through the Director of the Centers for Disease Control and Prevention, shall issue national guidance to support scientific collaboration relating to viral sequencing as a key strategy to the COVID–19 response activities of the United States, including guidance related to the sharing of specimens obtained from patients, the secure sharing of information about such specimens necessary for an effective public health response to COVID–19, and the appropriate use of viral sequence data derived from such specimens.</text></section><section id="H7F4D32C2195E455A89CFB9B6C31735A5"><enum>4.</enum><header>Funding for genomic sequencing, analytics, and disease surveillance</header><subsection id="HA4D6B4DFFAEE46B5830523081670B2C1"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall establish and implement a program to strengthen and expand activities related to genomic sequencing, analytics, and disease surveillance.</text></subsection><subsection id="HFA8D7A6D283448FDA39D19FE1CD17B60"><enum>(b)</enum><header>Use of funds</header><text>In implementing the program under subsection (a), the Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall—</text><paragraph id="HC472926D545C40D89F3DD8E5991B2769"><enum>(1)</enum><text>conduct and expand activities, including supporting the Advanced Molecular Detection Program, to sequence the genome of circulating strains of the SARS–CoV–2 virus, to identify mutations in the SARS–CoV–2 virus, and to survey the circulation and transmission of variant strains of the SARS–CoV–2 virus;</text></paragraph><paragraph id="HD2828486F8804A0E94EB1EA32E59FC44"><enum>(2)</enum><text>provide technical assistance and guidance and award grants or cooperative agreements to State, local, Tribal, or territorial public health departments to increase the capacity of such departments to sequence the genome of circulating strains of the SARS–CoV–2 virus, to identify mutations in the SARS–CoV–2 virus, to use genomic sequencing to identify outbreaks and clusters of COVID–19 infections caused by specific variants of SARS–CoV–2, and to develop effective COVID–19 response strategies based on genetic sequencing and surveillance data; and</text></paragraph><paragraph id="H2B032FF11FEB481085198D6F090B63B4"><enum>(3)</enum><text>carry out activities to both enhance the informatics capabilities of the public health workforce and expand the numbers of qualified public health informaticians available to analyze and interpret data produced through advanced molecular detection and genomic sequencing to establish, expand, or enhance capacity for conducting statistical public health research.</text></paragraph></subsection><subsection id="H7DEF558A059B471DA679653918B0F999"><enum>(c)</enum><header>Implementation</header><paragraph id="H2F9B326E318F402085738F013026309A"><enum>(1)</enum><header>Cooperative agreements for technical assistance</header><text>Cooperative agreements described in subsection (b)(2) may include partnerships with academic research institutions.</text></paragraph><paragraph id="HEC0A550573334C52B57A44E0C06D98FB"><enum>(2)</enum><header>Capacity for sharing and linking</header><text>The capacity referred to in subsection (b)(3) may include sharing and linking information and accessing and utilizing linked health data files in accordance with established data use agreements with data holders (including electronic case reporting, electronic health records, and electronic test orders and results) with public health agencies and related systems, including the National Death Index, immunization information systems, syndromic surveillance systems, laboratory information management systems, electronic case reporting systems, medical examiner case management systems, and Patient Unified Look-up Systems for Emergencies.</text></paragraph></subsection><subsection id="H1F9CBFA74D0C49ECB7AA60694CB3010F"><enum>(d)</enum><header>Facilities</header><text>Funds appropriated under subsection (f) may be used for grants for the construction, alteration, or renovation of non-federally owned facilities to improve genetic sequencing and surveillance capabilities at the State and local level.</text></subsection><subsection id="H23A74EA33AB94E6F862AA63CECC16250"><enum>(e)</enum><header>Expansion of ongoing activities</header><text>Funds appropriated under subsection (f) may be used for grants for the maintenance and expansion of current and ongoing activities to analyze and interpret data produced through advanced molecular detection and genomic sequencing, including for emerging public health threats.</text></subsection><subsection id="H3F67C3DCEB674F2DA02AEC7F74A7DB66"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated, $2,000,000,000 for fiscal year 2021 to carry out this section, to remain available until expended.</text></subsection></section><section id="H9FA6A3F9A5C646729D1D333C7735C154"><enum>5.</enum><header>Evidence-building demonstration program</header><subsection id="H7A7A97058828467585AC9F01B456E97E"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Director of the National Center for Health Statistics, shall carry out a demonstration program to expand the data linkage program of the Department of Health and Human Services, consisting of Federal statistical and programmatic datasets from specified Federal entities, as authorized by subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, for the purpose of facilitating statistical public health research on trends and patterns across specifically defined, statistically relevant populations, with a particular focus on linking social determinants of health data, including with respect to—</text><paragraph id="H66C514F215DB42628F2CA25607DAFD38"><enum>(1)</enum><text>food insecurity;</text></paragraph><paragraph id="HD0525F51D3744384AFE2FA1D45D13991"><enum>(2)</enum><text>housing instability;</text></paragraph><paragraph id="H422DABC9C0EC4C7E86BAA6B3BC1DD213"><enum>(3)</enum><text>transportation access;</text></paragraph><paragraph id="H39B458F3BD9B493B828B0F5437696B24"><enum>(4)</enum><text>safety;</text></paragraph><paragraph id="HE7B2DFCB49F34EB796FC2287F495571F"><enum>(5)</enum><text>social connection and isolation;</text></paragraph><paragraph id="HF5863808F39B43A9B890140504306363"><enum>(6)</enum><text>financial resource strain;</text></paragraph><paragraph id="HA37B7178A7FF4D7083A44257DDC447EA"><enum>(7)</enum><text>stress;</text></paragraph><paragraph id="HF1CF8167025D4AD98DD0EBBADF81C029"><enum>(8)</enum><text>race and ethnicity; and</text></paragraph><paragraph id="HBAD16039D8EF42F385C0AF198218FF2D"><enum>(9)</enum><text>sexual orientation and gender identity.</text></paragraph></subsection><subsection id="H3D17328B58B046C5B26665674F09179F"><enum>(b)</enum><header>Activities</header><text>Activities carried out under the demonstration program under this section shall include—</text><paragraph id="H9190DEAC43864328A12C0A7ED727084F"><enum>(1)</enum><text>assessing the availability of identified and deidentified data sets held by Federal, State, local, and non-Federal entities that may be useful for research described in subsection (a); and</text></paragraph><paragraph id="HE3D4F908FB784CDF9158350E1E2A3B05"><enum>(2)</enum><text>using existing authorities and linkages of data in accordance with subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, when relevant to request the submission of datasets to the National Center for Health Statistics for linking.</text></paragraph></subsection><subsection id="HEA1ED5982F924BCBA64708E5955B1C5F"><enum>(c)</enum><header>Limitation</header><text>The Secretary shall limit access to data under the demonstration program under this section—</text><paragraph id="H196ECCFA728B466092FA02E78A1E2AF9"><enum>(1)</enum><text>to Federal statistical agencies and qualified public and private researchers, as determined by the Director of the National Center for Health Statistics;</text></paragraph><paragraph id="H34514F0B6D4C4E7BB7B2760EADAFEEE3"><enum>(2)</enum><text>for a period to be specified by the Secretary; and</text></paragraph><paragraph id="H0947ACBB3B9C463695B1532DE0BBDDCC"><enum>(3)</enum><text>exclusively for the purpose described in subsection (a).</text></paragraph></subsection><subsection id="H47B167B6423D4E57B242C481D8E6A068"><enum>(d)</enum><header>Process for making data available</header><paragraph id="H4C9F6DB402A148F8A65E13D220FD777B"><enum>(1)</enum><header>In general</header><text>Consistent with paragraph (2), the Secretary shall establish a rigorous process for making data available and usable under the demonstration program under this section.</text></paragraph><paragraph id="HEE11BE94D9CC47CFAA41DE372C438BEA"><enum>(2)</enum><header>Requirements</header><text>Prior to making any data available under the demonstration program under this section, by an entity described in subsection (b)(1) to another entity described in subsection (b)(1)—</text><subparagraph id="H5E8AC8E35EF54802B110AACE05E162E3"><enum>(A)</enum><text>the receiving entity shall submit to the Director of the National Center for Health Statistics an application for data for the purpose described in subsection (a); and</text></subparagraph><subparagraph id="HDDA34B587A524949B220CEED158FAE66"><enum>(B)</enum><text>the Director shall approve or deny such request in writing, including in the case of a denial an explanation of the reasons for the denial.</text></subparagraph></paragraph></subsection><subsection id="HD6BEDD0E812E4905BC99FE9A70D80309"><enum>(e)</enum><header>Rulemaking</header><paragraph id="H5F446CBA0F644A8587A8A92D6C2E45F3"><enum>(1)</enum><header>No delay on implementation</header><text>The Secretary—</text><subparagraph id="HD74DF2BC03A04A5DAADCC82DB15AED04"><enum>(A)</enum><text>shall begin the implementation of the demonstration program under this section upon the date of enactment of this Act; and</text></subparagraph><subparagraph id="H2E581A91F1734C269B8F74B48F474CF4"><enum>(B)</enum><text>shall not delay such implementation for purposes of promulgating the regulations required by paragraph (2).</text></subparagraph></paragraph><paragraph id="H2706BFF2B0784FD8A7B3080DD54098C3"><enum>(2)</enum><header>Promulgation</header><text>The Secretary shall—</text><subparagraph id="H44A6482E037C4F29ABCB0FFA95B96A15"><enum>(A)</enum><text>promulgate regulations for carrying out this section; and</text></subparagraph><subparagraph id="H839EFBFA01254890A5901744C1E6CF32"><enum>(B)</enum><text>specify in such regulations the allowed and disallowed purposes for sharing and linking data through the program, including areas of potential research.</text></subparagraph></paragraph></subsection><subsection id="H448FF1BD0F42402392A88D6D1F041643"><enum>(f)</enum><header>Website</header><text>The Secretary shall maintain a publicly accessible website—</text><paragraph id="H54BE0FFDE41143C48E1C6DE7AEAEBC65"><enum>(1)</enum><text>providing information about the demonstration program under this section;</text></paragraph><paragraph id="HCA77B38B77A94D7E822FA53273C6B591"><enum>(2)</enum><text>facilitating stakeholder participation in such demonstration program;</text></paragraph><paragraph id="HA3A41FF9E2044B68BCDD484E9B1B97EA"><enum>(3)</enum><text>facilitating oversight of such demonstration program;</text></paragraph><paragraph id="HA56E8E892A10433C802E2F8A41D7A96A"><enum>(4)</enum><text>providing lists of datasets from Federal and non-Federal entities;</text></paragraph><paragraph id="H6F4A06D1DCCA4E778DF08A7687DA556B"><enum>(5)</enum><text>providing lists of identified and deidentified datasets;</text></paragraph><paragraph id="H3A55FF07BDC647329F4BB775B1B61C1F"><enum>(6)</enum><text>identifying linked datasets;</text></paragraph><paragraph id="H328A8532A2D74779B7C66ADD17FFDC32"><enum>(7)</enum><text>delineating a process to protect privacy and confidentiality;</text></paragraph><paragraph id="HF25A586ED9F244C9ADFA38CAB9372AE2"><enum>(8)</enum><text>identifying sources of the datasets; and</text></paragraph><paragraph id="H798A41AB31DD4AFF824ACAB966F84BB0"><enum>(9)</enum><text>delineating categories of personal data.</text></paragraph></subsection><subsection id="H031A11FD5F6E4D41A11E6550F412835B"><enum>(g)</enum><header>Program requirements</header><text>The demonstration program under this section shall be designed to—</text><paragraph id="H3416F43B6E174950832B1263BED2A994"><enum>(1)</enum><text>support data matching services for agencies and researchers using the National Death Index; and</text></paragraph><paragraph id="HF16CF95A5B83418DA336EB7FC61B91C7"><enum>(2)</enum><text>facilitate collaboration with States and private entities to examine, update, and modernize the fee structure of the National Death Index to support a broad range of data queries.</text></paragraph></subsection><subsection id="HEA672D84B9D64D7797AEE9D117B2DC6D"><enum>(h)</enum><header>Contracted entities</header><paragraph id="H95D7F27EDD1E46BC88B793E7D003D83D"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations, the Secretary may enter into contracts with eligible entities, as appropriate, for infrastructure and support services in carrying out the demonstration program under this section.</text></paragraph><paragraph id="H3DC2B8DB8165403787BFF19FD18D6822"><enum>(2)</enum><header>Eligibility</header><text>To be eligible for a contract under paragraph (1), an entity shall—</text><subparagraph id="H5AB205D2AA734C0C918045C5F47E9888"><enum>(A)</enum><text>demonstrate core capabilities for data sharing, data linkage, and compliance with subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code; and</text></subparagraph><subparagraph id="H414EF747A9514F3E98B0D9A469346377"><enum>(B)</enum><text>adhere to security standards in accordance with the Federal Risk and Authorization Management Program (or any successor program).</text></subparagraph></paragraph></subsection><subsection id="HF0439307FC6545EAB55EF83B31FB9380"><enum>(i)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to authorize the availability or use of data for—</text><paragraph id="H0B423416C5394E30A8D03786EC4D22AD"><enum>(1)</enum><text>law enforcement; or</text></paragraph><paragraph id="HC78654018714495BA5C45517D8A957B6"><enum>(2)</enum><text>any determination of the eligibility of an individual for any direct or indirect payment, benefit, or service.</text></paragraph></subsection><subsection id="HB08512E4CB454BF28F292D49335E664C"><enum>(j)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary shall submit a report to the Congress on the implementation of this section, including—</text><paragraph id="H9702C0C3524B441D835BC198F7058F17"><enum>(1)</enum><text>identification of best State practices for—</text><subparagraph id="H3C2FBD7EB73343D5BB768AD08B06D3E0"><enum>(A)</enum><text>sharing data with, and reporting data to, the National Death Index; and</text></subparagraph><subparagraph id="H4110BD47FF9A4C6B869C8827BE9DE179"><enum>(B)</enum><text>ensuring the quality of such data; and</text></subparagraph></paragraph><paragraph id="HFDA109F48FE247B098F3C988C6832D2C"><enum>(2)</enum><text>recommendations to improve—</text><subparagraph id="H0BAB085D7D4944BBABE91D83AD1969C2"><enum>(A)</enum><text>such sharing and reporting; and</text></subparagraph><subparagraph id="H52FC22CB64D2441C8BF4DEEB8FC14AD4"><enum>(B)</enum><text>access to the National Death Index by researchers.</text></subparagraph></paragraph></subsection><subsection id="HB4A695505AEE4EF9A583C42A18FAD284"><enum>(k)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section, $10,000,000 for fiscal year 2021, to remain available until expended. </text></subsection></section></legis-body></bill>
