which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize the budget-neutral demonstration program for energy and water conservation at multifamily residential units, to establish a green retrofit program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Green Retrofits Act</short-title></quote>.</text></section><section id="id363820159032494ab5dae4fbfbbd1b39"><enum>2.</enum><header>Reauthorization of budget-neutral demonstration program</header><text display-inline="no-display-inline">Section 81001 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12712">42 U.S.C. 12712</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>) is amended—</text><paragraph id="id94A3F471F8444C238959FB376CACDAF2"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1)—</text><subparagraph id="id0485F4DE09914D4EA0FCCB474E7A9920"><enum>(A)</enum><text>by striking <quote>2016 through 2019</quote> and inserting <quote>2022 through 2027</quote>;</text></subparagraph><subparagraph id="id47609BB1BB424306AE13D8885C2DF367"><enum>(B)</enum><text>by striking <quote>costs</quote> and inserting <quote>burdens and greenhouse gas emissions</quote>; and</text></subparagraph><subparagraph id="idCCF4E78049A549C6BBD5D1EF54B12EBD"><enum>(C)</enum><text>by striking <quote>20,000</quote> and inserting <quote>35,000</quote>;</text></subparagraph></paragraph><paragraph id="id9BCA3DB59ED049598CF11AC09DD487A8"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id99720A15EBE84EEBBF9C75DBF2D78210"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="idD57C534E50A34C7D8766CBCD9DC546E7"><enum>(i)</enum><text>by striking <quote>an energy or water cost savings is</quote> and inserting <quote>energy or water costs savings are</quote>;</text></clause><clause id="id103AF32CF72B457EA3D2A9C5F064599F"><enum>(ii)</enum><text>in subparagraph (C)(iv), by striking <quote>determination of savings to the Secretary</quote> and inserting <quote>validation of subsidy amounts from the Department of Housing and Urban Development required to support actual utility costs</quote>; and</text></clause><clause id="id6DF85FDEE2DC4B0188DB17698E17486A"><enum>(iii)</enum><text>by striking the undesignated matter following subparagraph (C); and</text></clause></subparagraph><subparagraph id="id6CEAA1E5E6BB4ADFBC291B458AB21920"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="id4568518A0CD5426296C8C182DC5FA5E8"><enum>(i)</enum><text>by redesignating subparagraphs (B), (C), (D), and (E) as subparagraphs (C), (D), (E), and (G), respectively;</text></clause><clause id="id256DA43BD7A14ECB829B83CC43040D53"><enum>(ii)</enum><text>in subparagraph (A), by striking <quote>effect and during</quote> and inserting “effect;</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3E0209717E9A4F7B8000E32D2D862470"><subparagraph id="id0BBA9ACFB67140D0871C565825130893"><enum>(B)</enum><text>the period during</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="id5F3AC4C6F79248AE8A36A29405B6C58A"><enum>(iii)</enum><text>in subparagraph (B), as so designated, by striking <quote>12 years</quote> and inserting <quote>15 years</quote>;</text></clause><clause id="id944B81B3248E475CB7668FAB89017DDE"><enum>(iv)</enum><text>in subparagraph (D), as so redesignated, by inserting <quote>property or</quote> before <quote>properties</quote>;</text></clause><clause id="idE3EB5F3C789849DFAB1A8811EA7E8ADA"><enum>(v)</enum><text>in subparagraph (E), as so redesignated, by striking <quote>and</quote> at the end; and</text></clause><clause id="idB933CB19F0E3476D8076208A68DA607B"><enum>(vi)</enum><text>by inserting after subparagraph (E), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id98446D7990FC4660AC3951E1ABA5EB6E"><subparagraph id="idDC7B4653C7C4485089CFDD76A3E34EB3"><enum>(F)</enum><text>a requirement that the costs associated with third-party verification under paragraph (1)(C) shall be covered by the entity; and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id55FF8D8FA1404B53AED888F8BADFEB8E"><enum>(3)</enum><text>in subsection (c)(2), in the matter preceding subparagraph (A), by striking <quote>annually thereafter</quote> and inserting <quote>biennially thereafter until the date on which the final performance-based agreement under this section ends</quote>; and</text></paragraph><paragraph id="id5E5467F71AD448618F90425A3CE19BB7"><enum>(4)</enum><text>by striking subsection (d) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA2ED1400E64D4898AA368621091C143A"><subsection id="id6054d7f9d3d541669e1118bd12106bc7"><enum>(d)</enum><header>Funding</header><paragraph id="id5b791f95c8234829af60e112748aadb7"><enum>(1)</enum><header>In general</header><text>For each fiscal year during which an agreement under this section is in effect, the Secretary may make payments under this section from funds appropriated to the Secretary for the renewal of contracts under the program established under subsection (a).</text></paragraph><paragraph id="idA48F4C89475B4EB2ABB583B7CCBECD3B"><enum>(2)</enum><header>Evaluation and reports</header><text>The Secretary may use amounts appropriated to carry out this section to contract for services to perform the program evaluations and produce the reports required under subsection (c).</text></paragraph><paragraph id="idc0723d548d034d96a5fdc3316ac33d68"><enum>(3)</enum><header>Approval of utility savings</header><text>Obligations of amounts available for payments pursuant to this subsection shall not arise until the Secretary has approved the documented utility savings submitted by the entity and verified by the third party for that annual increment and determined that actual savings did occur and payments may be made.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idEFB45E28B84A445B82AF11ED96E73C25"><enum>3.</enum><header>Green retrofit program</header><subsection id="idB61773824DE24DBABF1EC70E0725BE30"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idD5EB4C619BF146B69EB3A3D6B89A0362"><enum>(1)</enum><header>Covered property</header><text>The term <term>covered property</term> means a multifamily residential property receiving project-based assistance under—</text><subparagraph id="id527477F93D77463CA855C5A6BCC74638" commented="no"><enum>(A)</enum><text>section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q</external-xref>);</text></subparagraph><subparagraph id="idE92B350BD1EB45C8B69623EFD13E1747" commented="no"><enum>(B)</enum><text>section 811 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>); or</text></subparagraph><subparagraph id="idB61281B205134DEA82807891E7361CA5" commented="no"><enum>(C)</enum><text>section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>).</text></subparagraph></paragraph><paragraph id="idBB5CDC93CC4B4ECF99C49698F5F74859"><enum>(2)</enum><header>Eligible entity</header><text>the term <term>eligible entity</term> means the owner of a covered property.</text></paragraph><paragraph id="id322CAB72B2F64BCAA833035882C8FB0C"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></subsection><subsection id="idA966EB885F2843B88E81D699CA17F5CC"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a program to provide grants or loans to eligible entities for the purpose of performing in-home health and green retrofits to covered properties.</text></subsection><subsection id="id4FF20BCC2F7541D9A918BEF4F9853D27"><enum>(c)</enum><header>Purpose</header><text>The purpose of the program established under subsection (b) shall be to, with respect to a covered property—</text><paragraph id="id71B448480A05453A9BD469C243D2C8AE"><enum>(1)</enum><text>reduce the energy demand, water consumption, or greenhouse gas emissions of the covered property;</text></paragraph><paragraph id="id220FF94D953D4DDB8E8E121914C38F83"><enum>(2)</enum><text>increase the adoption of renewable energy technologies, including energy storage and demand response capable technology, and energy efficiency measures in the covered property;</text></paragraph><paragraph id="id26869E00944D4B6695F71DE0CE91E98A"><enum>(3)</enum><text>lower the operating costs of the covered property;</text></paragraph><paragraph id="id41510776C0984691B8CA846659AACF01"><enum>(4)</enum><text>improve the quality of life of residents of the covered property;</text></paragraph><paragraph id="id70428319ED5542AEAFF71DB13AE7E553"><enum>(5)</enum><text>reduce risks to the health and safety of residents of the covered property; and</text></paragraph><paragraph id="idC2E0CB07D674490CB5325CAA11E6664F"><enum>(6)</enum><text>reduce the overall impact on the environment of the covered property.</text></paragraph></subsection><subsection id="id76feba36bb2a4e9588b8cd2b3ee58f2c"><enum>(d)</enum><header>Equitable distribution</header><text>In awarding grants or loans under this section, the Secretary shall ensure the equitable geographic distribution of awards. </text></subsection><subsection id="idbc765ab63fa84d2da6e1265c973e794c"><enum>(e)</enum><header>Regulations</header><paragraph id="id05AF932331734641BC5C74F789E842CD"><enum>(1)</enum><header>In general</header><text>The Secretary may promulgate regulations to carry out the program established under subsection (b).</text></paragraph><paragraph id="idEF56D566FDB841A598BF31927F95F950"><enum>(2)</enum><header>Consultation</header><text>In carrying out paragraph (1), the Secretary shall consult with the Secretary of Energy, the Administrator of the Environmental Protection Agency, and the Director of the Centers for Disease Control and Prevention to the maximum extent practicable.</text></paragraph></subsection></section></legis-body></bill>
