All non-Federal dams in the United States that are not under the regulatory inspection authority of a State or Federal entity shall be inspected by the Secretary, except dams which the Secretary of the Army determines do not pose any threat to human life or property. The inspection will include an assessment of downstream hazard and development of a dam failure inundation map and a non-failure residual risk inundation map that can be incorporated in an emergency action plan for the dam.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H4CBE262CC90B421DAAF7511190C292D2"><enum>(3)</enum><header>Assistance for State dam safety programs</header><text display-inline="yes-display-inline">Section 8(e)(1) of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467f">33 U.S.C. 467f(e)(1)</external-xref>) is amended by inserting <quote>including the development of emergency action plans</quote> after <quote>improving dam safety programs</quote>.</text></paragraph><paragraph commented="no" id="H4537E6046C2A4949957CE79E07F30BF3"><enum>(4)</enum><header>Priority System</header><text display-inline="yes-display-inline">Section 8A(f) of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467f-2">33 U.S.C. 467f–2(f)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H290B323813AE4FE8BAB688A32CFD5974"><subsection commented="no" id="H10D5197092964D31AEC6C83D6A906D52"><enum>(f)</enum><header>Priority System</header><text display-inline="yes-display-inline">The Administrator, in consultation with the Board, shall develop a risk-based priority system for States to use as a factor in prioritizing multiple applications in a single year of eligible high hazard potential dams for which grants may be made under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HF0C1B7A7C32944EF9604851237ABF90C"><enum>(5)</enum><header>Rehabilitation of high hazard potential dams</header><text display-inline="yes-display-inline">Section 8A(j) of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467f-2">33 U.S.C. 467f–2(j)</external-xref>) is amended—</text><subparagraph id="H642EA11D0FA249E88CBD473665E565BA"><enum>(A)</enum><text>in paragraph (3), by striking <quote>; and</quote> and inserting a semicolon; </text></subparagraph><subparagraph id="HDC3407E0D27E47DEA11DA607706A5854"><enum>(B)</enum><text>in paragraph (4), by striking <quote>each of fiscal years 2021 through 2026.</quote> and inserting <quote>fiscal year 2021; and</quote>; and</text></subparagraph><subparagraph id="H48AF796ACB8B4E74A34E8F6F7CFB7A2A"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9A33482DB117462396F07794F62764C4"><paragraph id="H5B5CAE1A47294B18854E8CECBC4262AD"><enum>(5)</enum><text display-inline="yes-display-inline">$200,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HBB46C6091005486FB58CE8B685795F36"><enum>(6)</enum><header>National dam safety program</header><text>Section 14(a)(1) of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467j">33 U.S.C. 467j(a)(1)</external-xref>) is amended by striking <quote>$9,200,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$92,000,000 for each of fiscal years 2022 through 2026</quote>.</text></paragraph><paragraph id="HD6C6D4FE030A4DC2B486ABB04268DAD0"><enum>(7)</enum><header>Inspection of dams</header><text display-inline="yes-display-inline">Section 14 of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467j">33 U.S.C. 467j</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HBEF1ADE74E8846C295A5B78027385019"><subsection id="H13FACD7A1C5B45F08890D5C95AA76618"><enum>(h)</enum><header>Inspection of dams</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out section 3 $35,000,000 for each of fiscal years 2022 through 2026.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H77336322F9D24DE79EA88E1D32E3D615"><enum>(8)</enum><header>Allocation</header><text display-inline="yes-display-inline">Section 14(a)(2) of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467j">33 U.S.C. 467j(a)(2)</external-xref>) is amended—</text><subparagraph commented="no" id="id9EE8B381A113451AB75C1E9D0E5A5A73"><enum>(A)</enum><text>by striking subparagraphs (B) and (C);</text></subparagraph><subparagraph commented="no" id="id859AB3D341D340ADBAD150732D6BF513"><enum>(B)</enum><text>by striking the paragraph designation and heading and all that follows through <quote>Subject to subparagraphs (B) and (C), for</quote> in subparagraph (A) in the matter preceding clause (i) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id66718BEAEBD74EBA905F4FB026A69B71"><paragraph commented="no" id="idA6A85A6B21DF4493B279D2E3D36A2202"><enum>(2)</enum><header>Allocation</header><text>For</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="idF2C5BF8F231040DA909A8A57D9E2FF32"><enum>(C)</enum><text>by redesignating clauses (i) and (ii) as subparagraphs (A) and (B), respectively, and indenting appropriately;</text></subparagraph><subparagraph commented="no" id="idD12595D267684BF38912D6B33C884E9E"><enum>(D)</enum><text>in subparagraph (A) (as so redesignated), by inserting <quote>of the remaining</quote> after <quote>One-third</quote>;</text></subparagraph><subparagraph commented="no" id="id61A0D13561BF41F5B77AB4A47B5D779C"><enum>(E)</enum><text>in subparagraph (B) (as so redesignated)—</text><clause commented="no" id="id6AB908D541444E4B8F066CCEC196AD04"><enum>(i)</enum><text>in the matter preceding subclause (I), by inserting <quote>of the remaining</quote> after <quote>Two-thirds</quote>; and</quote> and inserting a semicolon; </text></paragraph><paragraph id="H6D5A14B4FAC64954A8A5313864DC0859"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking <quote>through 2023.</quote> and inserting <quote>through 2021; and</quote>; and</text></paragraph><paragraph commented="no" id="HA4CC0F602956454DAA9B5ECBD614DFE6"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCB75747F6BD04A7B84821B89CFEF4E26"><subparagraph commented="no" id="H9FB57BF7EE06455C8DA9095C32D2401F"><enum>(F)</enum><text display-inline="yes-display-inline">$50,000,000 for each of fiscal years 2022 through 2026.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></title><title id="HACD1B6A2F0FC4241AE6CAFD1AA44F1BF" style="OLC"><enum>II</enum><header>Restore River Ecosystems through Dam Abatements</header><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H5E844380B2C24B1CB2AEC86AB15ED31B"><enum>201.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purposes of this title are to establish an interagency advisory council, a Tribal and stakeholder advisory board, and to provide funding to remove publicly owned and privately owned dams with the consent of dam owners—</text><paragraph commented="no" display-inline="no-display-inline" id="H77D0A869BA914C678E975873EDAA97E5"><enum>(1)</enum><text display-inline="yes-display-inline">to reduce public safety risks associated with aging dams;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H21F04B7CEB2F4E6DA86550B6D69CEE9A"><enum>(2)</enum><text display-inline="yes-display-inline">to promote the restoration of riverine habitat for native species of fish and wildlife;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8C9933EB830944D4A35EEC6DE2EF0B66"><enum>(3)</enum><text display-inline="yes-display-inline">to provide for the movement of aquatic species and restoration of migratory fish populations;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4858C90DC69D471887D6AFB25C54CB8B"><enum>(4)</enum><text display-inline="yes-display-inline">to improve water quality; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4DDB51EB72D14AEE99D44E6A92A23FAB"><enum>(5)</enum><text display-inline="yes-display-inline">to increase climate resilience. </text></paragraph></section><section id="H7ADD12931B0A4F989FAB944DBE2330E0"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H9D88529CC57B4E938E1ED44C2E016F11"><enum>(1)</enum><header>Advisory Board</header><text>The term <term>Advisory Board</term> means the Dam Removal Advisory Board established under section 205.</text></paragraph><paragraph id="HB88AD328D33A4259972DBF454E3AFBE7"><enum>(2)</enum><header>Aquatic habitat</header><text>The term <term>aquatic habitat</term> means the preferred in-stream, floodplain, or riparian wetland habitat of all life stages of native aquatic species.</text></paragraph><paragraph id="H193CC4D01EAF41AF827B9B405BD609D6"><enum>(3)</enum><header>Aquatic species passage</header><text>The term <term>aquatic species passage</term> means the ability of all species endemic to a watershed, and all life stages of those species, to freely access upstream and downstream aquatic habitat for the purposes of spawning, rearing, or other life cycle needs.</text></paragraph><paragraph id="H3FFB21DA14B046A492E128A5EBE301DA"><enum>(4)</enum><header>Climate resilience</header><text>The term <term>climate resilience</term> means the ability for humans, ecosystems, and all species to adapt to and recover from disturbances related to climate change, including increased severity and frequency of floods, droughts, and changes to thermal regimes.</text></paragraph><paragraph id="H041B1E5CF1BD41ED82DD5F9FDC377B2E"><enum>(5)</enum><header>Council</header><text>The term <term>Council</term> means the Dam Removal Council established under section 204. </text></paragraph><paragraph id="HB83D9F3D82634C77A23DC71B2122E19D"><enum>(6)</enum><header>Dam</header><text>The term <term>dam</term> means a human-made structure that—</text><subparagraph id="H93B4F5BF1F464D35A05617786943B497"><enum>(A)</enum><text>spans the width of a river or stream (or does not currently span the width of a river or stream due to damage or intentional breach, but was originally constructed to do so); and </text></subparagraph><subparagraph id="H826236019F94403388692A66DD472680"><enum>(B)</enum><text>was constructed to raise the water level, divert water, or store water for a variety of purposes. </text></subparagraph></paragraph><paragraph id="HF5B738BBB7094CD88CDB22386AA12607"><enum>(7)</enum><header>Dam removal project</header><subparagraph id="H007B0A2EC07644B6B1543091FF2529EF"><enum>(A)</enum><header>In general</header><text>The term <term>dam removal project</term> means a project to permanently remove the full vertical extent of a dam structure of a dam described in subparagraph (B) to a minimum horizontal width needed to protect public safety, restore natural river function, and reconnect aquatic species passage, unless site conditions prevent that removal width.</text></subparagraph><subparagraph id="HC88BD4C028D94349B0DC9E9F51A4B192"><enum>(B)</enum><header>Dams described</header><text>A dam referred to in subparagraph (A) is—</text><clause id="H01E3C3982AED4ACCB2D388B9C9B8EC15"><enum>(i)</enum><text>a non-federally owned powered dam;</text></clause><clause id="H3B1B9558A1BD449D9C4E8A8A168E3382"><enum>(ii)</enum><text>a non-federally owned non-powered dam; or </text></clause><clause id="H6FCA91BA49DB44C3B1AF9568F2996E8B"><enum>(iii)</enum><text>a Federal non-powered dam the removal of which is authorized by Congress, if applicable. </text></clause></subparagraph></paragraph><paragraph id="H1FA2547F4BD14F5AAE32BCC47A470F93"><enum>(8)</enum><header>Funding allocation</header><text>The term <term>funding allocation</term> means amounts provided, out of amounts made available to carry out this title, by the Secretary to a participating agency to carry out the purposes of this title.</text></paragraph><paragraph id="H0F211658AFAF425AA304E2075CC70C24"><enum>(9)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="HE05FA44B433941318B6322C2EAA6479F"><enum>(10)</enum><header>Non-Federal interest</header><text>The term <term>non-Federal interest</term> means—</text><subparagraph id="HEC1ACBC49B8F4E128F1BEFEBA18CEDFB"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="HCA98037F5AFB4F1E9E6D68FF9514B397"><enum>(B)</enum><text>a political subdivision of a State;</text></subparagraph><subparagraph id="H9EA447F9351A47638C14AAAAF470C6DE"><enum>(C)</enum><text>an Indian Tribe;</text></subparagraph><subparagraph id="H408BC0FA792C486395F2FE6B41323AA3"><enum>(D)</enum><text>a non-Federal dam owner, or a representative;</text></subparagraph><subparagraph id="H076D1E44EB904FB58D3419E090E29E3F"><enum>(E)</enum><text>a regional or interstate agency; and</text></subparagraph><subparagraph id="H121BB929E9614460942850676A3D0E41"><enum>(F)</enum><text>as provided in section 203(d)(2), a nongovernmental organization.</text></subparagraph></paragraph><paragraph commented="no" id="HF140CE3AE9E74FA085C74D75F7455D46"><enum>(11)</enum><header>Participating agency</header><subparagraph commented="no" id="HDFF386C222284C8588ED8042A8E0427F"><enum>(A)</enum><header>In general</header><text>The term <term>participating agency</term> means a Federal agency—</text><clause commented="no" id="H1456DEA6FBFF40E19E004E239DA4A82B"><enum>(i)</enum><text>that owns 1 or more dams or has jurisdiction over a grant program under which dam removal is an eligible activity; and</text></clause><clause commented="no" id="HD291E3B8F52B48C5AD47F5A4F9EBA775"><enum>(ii)</enum><text>that has authority—</text><subclause commented="no" id="HFF561464F6D648A69D9DACA6ADA47C77"><enum>(I)</enum><text>to conduct dam removal projects; or</text></subclause><subclause commented="no" id="HA219B88B3BB0488280C14C7127DA21A1"><enum>(II)</enum><text>to provide technical assistance and grants for development, planning, and implementation of dam removal projects. </text></subclause></clause></subparagraph><subparagraph commented="no" id="H030D978EB19046ABBCD28FDF6C1CE844"><enum>(B)</enum><header>Inclusion</header><text>The term <term>participating agency</term> includes the Department of the Army.</text></subparagraph></paragraph><paragraph id="HF57CDF6193C04432B61B56C3C709A69D"><enum>(12)</enum><header>Privately owned dam</header><text>The term <term>privately owned dam</term> means a dam that is owned by 1 or more non-governmental entities.</text></paragraph><paragraph id="HA414E3C7CF554FD0BB7A69133E3EB2EE"><enum>(13)</enum><header>Public safety hazard</header><text>The term <term>public safety hazard</term> means the risk to individuals pertaining to a dam, including loss of life or destruction of private or public property, as a result of the structural failure or misoperation of a dam, or by a person who accesses the dam by foot or in a boat. </text></paragraph><paragraph id="H05D1852D24EB47FBBE7F33D1C70FF022"><enum>(14)</enum><header>Publicly owned dam</header><subparagraph id="H18EDCEDDF2464E8791EF742C0B89A2A0"><enum>(A)</enum><header>In general</header><text>The term <term>publicly owned dam</term> means a dam that is owned by a public entity such as a government agency, political subdivision, special purpose district, or other public entity established under Federal or State law.</text></subparagraph><subparagraph id="H12F4462988904492B3140ABEC79FFF82"><enum>(B)</enum><header>Exclusion</header><text>The term <term>publicly owned dam</term> does not include a Federal powered dam. </text></subparagraph></paragraph><paragraph id="H8B9DB8E7FCA1425C959E78C4B2A3461B"><enum>(15)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Army.</text></paragraph><paragraph id="HCC452E93139F48BB965BD911F84DDC57"><enum>(16)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="H332FAB7E61814B3184A3577E7DB00EB4"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="H8179756C3DF74A32A5D413A0FDC824EC"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="H75ACA07422EC4973B3CAE41FE8805093"><enum>(C)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph id="H7ADBBDCC89304B2BB6D6E5AA813FFFD5"><enum>(D)</enum><text>the Commonwealth of the Northern Mariana Islands;</text></subparagraph><subparagraph id="HB13F868B720841B797FB507337FD4265"><enum>(E)</enum><text>the United States Virgin Islands;</text></subparagraph><subparagraph id="HE1536865FFF6462CBB5388015F4637AB"><enum>(F)</enum><text>American Samoa; and</text></subparagraph><subparagraph id="H4FDA90E0D25147CB9F0047C931572EA8"><enum>(G)</enum><text>Guam.</text></subparagraph></paragraph></section><section commented="no" id="H8B00235A953A4B8990C564D3AF6DC21E"><enum>203.</enum><header>Dam removal program</header><subsection commented="no" id="H73B16CD9A7054625BD8C0F21BEC90746"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a dam removal program to carry out dam removal projects and provide technical assistance through the award of contracts and cooperative agreements in accordance with this title.</text></subsection><subsection commented="no" id="H9B5FD3C966644445B3E379EB066FF5D2"><enum>(b)</enum><header>Eligible activities</header><text>An activity eligible to be carried out with a funding allocation is—</text><paragraph commented="no" id="H5A7C31BDDBAC4168BB305E5E94321400"><enum>(1)</enum><text>a dam removal project; and</text></paragraph><paragraph commented="no" id="H0D63CD94938F4E44A62A9694056F969A"><enum>(2)</enum><text>a Federal or non-Federal technical assistance program.</text></paragraph></subsection><subsection commented="no" id="H069557C6F7D04F1D86D8874B4A4454B7"><enum>(c)</enum><header>Selection of projects</header><paragraph commented="no" id="H6DF55F6CBC634F1E815412AEE4B0A2D3"><enum>(1)</enum><header>Identification of eligible projects</header><subparagraph commented="no" id="H47D8D37DEE24479DB852341C8E9877E4"><enum>(A)</enum><header>In general</header><text>Each participating agency shall—</text><clause commented="no" id="H50E0BBF094DA417E921E6738A7DA93F5"><enum>(i)</enum><text>review proposed dam removal projects and technical assistance programs, including—</text><subclause commented="no" id="H176C515FDB124751ACF506CA55E277DC"><enum>(I)</enum><text>projects proposed by a dam owner (or a designee, with the written consent of the dam owner); </text></subclause><subclause commented="no" id="H718919BE552E4D72B2D3B4B359BB4244"><enum>(II)</enum><text>dam removal projects for Federal non-powered dams owned by the participating agency that—</text><item commented="no" id="H48EF4E7BDE5744B989BA1A3050203219"><enum>(aa)</enum><text>are no longer providing a critical purpose in the Federal interest; and </text></item><item commented="no" id="HD9EE986B64B3461CAF8DE199715C8687"><enum>(bb)</enum><text>have received Congressional authorization, if applicable; </text></item></subclause><subclause commented="no" id="H73EF378CF016440C80B6399A528F9677"><enum>(III)</enum><text>non-Federal dam removal technical assistance programs; and</text></subclause><subclause commented="no" id="H47C7F4A0E0AD47B7AC03E822C42B3B74"><enum>(IV)</enum><text>a proposed funding allocation for those projects and programs; and</text></subclause></clause><clause commented="no" id="HB53B2F6A7AE54B2790866B0E896B7F2E"><enum>(ii)</enum><text>submit the recommended projects, programs, and funding allocation to the Council. </text></clause></subparagraph><subparagraph commented="no" id="HE7FFAE30B7424DD9B946F2599E8D7F8A"><enum>(B)</enum><header>Council review</header><text>The Council shall—</text><clause commented="no" id="HB1E6F6DE4831449CAA9F5BB368B150B8"><enum>(i)</enum><text>review the projects, programs, and funding allocations submitted under subparagraph (A)(ii); </text></clause><clause commented="no" id="HFC3D9FBBA09A4A2F9E1E42362DF494FF"><enum>(ii)</enum><text>develop recommendations of projects and programs that meet the criteria described in paragraph (3) and proposed funding allocations for each participating agency; and</text></clause><clause commented="no" id="HA44E675F5CBC43D3BC75C6BA370E9B9F"><enum>(iii)</enum><text>submit the projects, programs, and funding allocations recommended under clause (ii) to the Secretary.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H881B8452B37C455D8F649E3A8D6E0BFC"><enum>(2)</enum><header>Selection</header><text>The Secretary shall—</text><subparagraph id="H26AD0FC9C41E45729531854281D9C5B2"><enum>(A)</enum><text>select projects and activities under this section taking into consideration the projects and programs submitted by the Council under paragraph (1)(B)(iii); and </text></subparagraph><subparagraph commented="no" id="HD2CC4D889B964896B9D076C219CC35FD"><enum>(B)</enum><text>provide to each participating agency a funding allocation pursuant to a cooperative agreement under subsection (f).</text></subparagraph></paragraph><paragraph commented="no" id="H3933BD04361C419C959E1458C13C7AFD"><enum>(3)</enum><header>Required elements</header><text>Each dam removal project recommended to the Secretary by the Council shall—</text><subparagraph commented="no" id="H41A46EB38B71472B93DC843F22D6A8D5"><enum>(A)</enum><text>include written consent of the dam owner for the dam removal project, if ownership is established;</text></subparagraph><subparagraph commented="no" id="HD9975249F8D84D849457DE3CCF5BD507"><enum>(B)</enum><text>meet 1 or more of the project purposes of—</text><clause commented="no" id="HA99BB357E67E4414BDE22C89D8674352"><enum>(i)</enum><text>protecting human health and safety;</text></clause><clause commented="no" id="H13E01827E4B84F2D8E666E2826BA4573"><enum>(ii)</enum><text>restoring aquatic habitat and riverine processes;</text></clause><clause commented="no" id="HB18A604901C349FA809E8D1E43C68789"><enum>(iii)</enum><text>increasing river connectivity and species access to aquatic habitat;</text></clause><clause commented="no" id="HE61C482491234811B53A0011972B825D"><enum>(iv)</enum><text>improving water quality; </text></clause><clause commented="no" id="H126947F09C854513856C110794BCEE30"><enum>(v)</enum><text>enhancing commercial and recreational fishing;</text></clause><clause commented="no" id="HB015505910B04C5F9EA1F4ABA2FB8E68"><enum>(vi)</enum><text>enhancing river-based recreation;</text></clause><clause commented="no" id="H2DAA6C92D4A341C1B861E47C9EFD4C8F"><enum>(vii)</enum><text>restoring nature-based infrastructure; and </text></clause><clause commented="no" id="H16DBCD0DF40B403AB3B6B53038A08330"><enum>(viii)</enum><text>improving climate resilience;</text></clause></subparagraph><subparagraph commented="no" id="HE708BD10A8C24AB7822CB09AF4DB8C94"><enum>(C)</enum><text>include satisfactory assurance from any non-Federal interests proposing projects that the non-Federal interests will have or can reasonably acquire personnel and authority to adequately manage the project; and</text></subparagraph><subparagraph commented="no" id="H32D2E7DBB5B54DDABF71E00AC513ED0E"><enum>(D)</enum><text>demonstrate a commitment to obtain all required regulatory approvals and permits from all pertinent jurisdictions prior to project implementation.</text></subparagraph></paragraph><paragraph commented="no" id="H07C5911BBC124E6AA49D558D8BB4344F"><enum>(4)</enum><header>Factors for selection of projects</header><text>In selecting a dam removal project, the Secretary and participating agencies shall consider the following:</text><subparagraph id="H493C7FD2C39341FE954CED7212D88420"><enum>(A)</enum><text>The capability of the non-Federal interest to carry out the project in a technically feasible manner.</text></subparagraph><subparagraph id="H3120040A578A4541B3ABB4C84322EBA9"><enum>(B)</enum><text>The extent to which the dam poses a significant public safety hazard.</text></subparagraph><subparagraph id="H8095F02225C848A7BC530DF7E4FA8584"><enum>(C)</enum><text>The extent to which the dam provides critical beneficial uses.</text></subparagraph><subparagraph commented="no" id="HF801F01B533B4C3C83D72D12A75B5395"><enum>(D)</enum><text>The extent to which the project provides multiple environmental and public benefits, with priority given to a project that meets 2 or more of the project purposes described in paragraph (3)(B).</text></subparagraph><subparagraph commented="no" id="HD7B8F1246534456082C71BEE1D69BFDB"><enum>(E)</enum><text>The extent to which the project will be carried out in a cost-effective manner.</text></subparagraph><subparagraph commented="no" id="H6803542598824AB69D28368AB5F15327"><enum>(F)</enum><text>Any other factors that the Secretary and participating agencies determine to be reasonable and necessary for consideration. </text></subparagraph></paragraph><paragraph id="H57A7172A86024CD3A806BEB538182BA7"><enum>(5)</enum><header>Prioritization for selection of projects</header><text>In selecting a dam removal project, the Secretary and participating agencies shall prioritize—</text><subparagraph id="H15983BBA8AD0491C81E673D2E25A0157"><enum>(A)</enum><text>removal of dams that pose a significant public safety hazard; and </text></subparagraph><subparagraph id="H1DDAD1912470420B9269A7BBBB864D33"><enum>(B)</enum><text>non-powered dams the removal of which will provide significant ecological value. </text></subparagraph></paragraph></subsection><subsection commented="no" id="H48A506BD069D4E6A8256361B8A8AD1A5"><enum>(d)</enum><header>Execution of projects and activities</header><paragraph commented="no" id="HE34FB85F41D64C708F9EC0CDB25DF737"><enum>(1)</enum><header>In general</header><text>A participating agency that receives assistance under this section may enter into cooperative agreements with non-Federal interests—</text><subparagraph commented="no" id="HA18FDA87EEA6412591A7D2FDEC1480EC"><enum>(A)</enum><text>to carry out dam removal projects;</text></subparagraph><subparagraph commented="no" id="HE0155CF7B18D42968E66F8D4C932E187"><enum>(B)</enum><text>to provide technical assistance; or</text></subparagraph><subparagraph id="H6B51BB3CBCAD4DD08D05FB0297AFFE7E"><enum>(C)</enum><text>to provide assistance to a non-Federal technical assistance program.</text></subparagraph></paragraph><paragraph commented="no" id="HCA4532D758964A0C926927D61B2D5ABA"><enum>(2)</enum><header>Nongovernmental organizations</header><text>Notwithstanding section 221(b) of the Flood Control Act of 1970 (42 U.S.C. 1962d–5b(b)), for any dam removal project, the Secretary, in consultation and coordination with appropriate State and local governmental agencies, Indian Tribes, and any impacted stakeholders, may allow a nongovernmental organization to serve as the non-Federal interest for the project.</text></paragraph><paragraph commented="no" id="H5D0E45CA16454FEDB94D681DC80EC5BF"><enum>(3)</enum><header>Public notice</header><text>For any dam removal activity carried out with a funding allocation, the participating agency shall provide public notice in accordance with applicable regulations and requirements of the participating agency.</text></paragraph><paragraph commented="no" id="H8C81F8E5A1724D6E86E764DFEE98F809"><enum>(4)</enum><header>Geographic equity</header><text>To the maximum extent practicable, in carrying out activities under this title, participating agencies shall allocate amounts from the funding allocation of the agency equitably among regions of the United States.</text></paragraph></subsection><subsection commented="no" id="H489AAF718EE74DBB9676477549C22356"><enum>(e)</enum><header>Eligible costs</header><text>A funding allocation may be used for all dam removal and related project needs, including—</text><paragraph commented="no" id="HBC3A6215C7D64D1FAFED9C87D2604FA2"><enum>(1)</enum><text>engineering, scientific assessment, economic analysis, construction, project management, technical assistance, acquisition, liability insurance, monitoring, regulatory compliance, updating flood hazard mapping as needed for project implementation, project administration, infrastructure protection, and sediment management;</text></paragraph><paragraph commented="no" id="HA30F72A491CB44198BC1BCC3CF156B9A"><enum>(2)</enum><text>all stages of project planning and design;</text></paragraph><paragraph commented="no" id="HC4F82F1F8D514DE0AF4F808E9153A73A"><enum>(3)</enum><text>Federal, State, Tribal, and non-Federal dam removal technical assistance programs to identify projects, complete initial project stages, train project managers and others involved in dam removal projects, and provide technical assistance; </text></paragraph><paragraph commented="no" id="H4A848AE550C3419A87F2DE331CCA6879"><enum>(4)</enum><text>establishment of collaborative Federal teams to increase efficiency of evaluation and removal of federally owned dams; and</text></paragraph><paragraph commented="no" id="H083ABE634EA04243B2829F962CAF35E4"><enum>(5)</enum><text>monitoring under subsection (h). </text></paragraph></subsection><subsection commented="no" id="H0FF1AB2615BA46FCA39B5024B2BA4B28"><enum>(f)</enum><header>Cooperative agreement</header><paragraph commented="no" id="H990C174618464497871A7BBAD94E2698"><enum>(1)</enum><header>In general</header><text>The Secretary shall enter into a cooperative agreement with each participating agency to provide the funding allocation determined by the Secretary for the participating agency. </text></paragraph><paragraph commented="no" id="H37F2358DCE394C739080921016CB4CA6"><enum>(2)</enum><header>Supplement, not supplant</header><text>A funding allocation provided under this title shall supplement and not supplant amounts otherwise made available to the participating agency. </text></paragraph></subsection><subsection id="H2C28B79E22434F029B1D48EFFA192E2D"><enum>(g)</enum><header>Federal share</header><text>The Federal share of the cost of a dam removal project carried out under this title shall be 100 percent, unless a different Federal share is required by the program of the participating agency under which the project is being carried out.</text></subsection><subsection commented="no" id="H290874663B7D401BA4F57C35D5B87C76"><enum>(h)</enum><header>Monitoring</header><paragraph commented="no" id="H7CAE1615026940FA8F2D9356941DC6C1"><enum>(1)</enum><header>Costs</header><text>The costs of monitoring a dam removal project—</text><subparagraph commented="no" id="H2B48FAD52876450EBC1AE342D11BAAC3"><enum>(A)</enum><text>shall be an eligible use of a funding allocation; and </text></subparagraph><subparagraph commented="no" id="H67B3F2398A8A4B85A8FE958C3A3C799D"><enum>(B)</enum><text>may be included in the total cost of the dam removal project.</text></subparagraph></paragraph><paragraph commented="no" id="HA13E1DE9E84643EF9359079C32740B1D"><enum>(2)</enum><header>Goals</header><text>The goals of monitoring referred to paragraph (1) shall be—</text><subparagraph commented="no" id="H3E3509851AD240D2929AE6A04E65E04A"><enum>(A)</enum><text>to measure the safety and effectiveness of the project; and</text></subparagraph><subparagraph commented="no" id="HE1B2A7F1284446DF9AA8B705CF35D389"><enum>(B)</enum><text>to allow adaptive management to ensure project success.</text></subparagraph></paragraph></subsection></section><section id="H413AD88097E34F66BDBC94441661713A"><enum>204.</enum><header>Establishment of Dam Removal Council</header><subsection id="HD1590679DACE4BB4823C336698B6DA06"><enum>(a)</enum><header>Council</header><text>There is established a council to be known as the <quote>Dam Removal Council</quote>.</text></subsection><subsection id="H9D0F10DB3F2D445A997BCEC07F994B55"><enum>(b)</enum><header>Duties</header><text>The Council shall be responsible for—</text><paragraph commented="no" id="HEBA17E428E614D77B6DAED1F1CE4B009"><enum>(1)</enum><text>coordinating participating agencies to annually (or as otherwise determined by the Council)—</text><subparagraph commented="no" id="HBD65AA9585E446B0870417B2AEE1F993"><enum>(A)</enum><text>notify all known dam owners of the availability of dam removal funding, application procedures, and options for technical assistance; and </text></subparagraph><subparagraph commented="no" id="HE74FE7B0403B49B7AA99C910D5F51789"><enum>(B)</enum><text>provide guidance on the existing programs of participating agencies;</text></subparagraph></paragraph><paragraph id="HAB8E175AD01543008F3840B7716A6EE7"><enum>(2)</enum><text>evaluating the proposed dam removal projects, technical assistance programs, and funding allocations submitted by participating agencies under section 203(c)(1)(A)(ii);</text></paragraph><paragraph id="H13532806B10647B68C3E1877EF805FF6"><enum>(3)</enum><text>submitting to the Secretary recommended dam removal projects, technical assistance programs, and funding allocations for participating agencies as described in section 203(c)(1)(B)(ii);</text></paragraph><paragraph id="H83E175CEE6534C9297DB18F23742865C"><enum>(4)</enum><text>serving as a forum—</text><subparagraph id="H86297F6493E74701A244BFD04BD351D7"><enum>(A)</enum><text>to identify and address limiting factors to removing dams; and </text></subparagraph><subparagraph id="H51DE1D69CBAC4911A062611477A19E69"><enum>(B)</enum><text>to address programmatic challenges;</text></subparagraph></paragraph><paragraph id="HCC13A3284EAF457CB85AA876A7D0B3C1"><enum>(5)</enum><text>providing advice on the development of the database and report required under section 207; and</text></clause><clause id="H8C52AE1EA5C6404B9555B5817C737009"><enum>(ii)</enum><text>to simplify and clarify the dam removal process.</text></clause></subparagraph></paragraph></subsection><subsection id="H67744314725946E689FDDCE157AB97A9"><enum>(d)</enum><header>Meetings</header><paragraph id="H7049BB14DCD145F396D30354469DD6E0"><enum>(1)</enum><header>First meeting</header><text>The Chair shall convene the first meeting of the Council not later than 60 days after the date of enactment of this Act.</text></paragraph><paragraph id="HA3CCDA29B82C43B9B2BDC20583E18A05"><enum>(2)</enum><header>Additional meetings</header><text>The Chair shall convene additional meetings of the Council as appropriate to ensure that this title is fully carried out, but not less often than annually.</text></paragraph></subsection><subsection id="HB25E8841CEB74AE19BEA1101DD03B4C0"><enum>(e)</enum><header>Council procedures</header><text>The Council shall establish procedures for voting, the conduct of meetings, and other matters as appropriate.</text></subsection><subsection id="H292F8447A8784C3A90FE4560ED5F6EF0"><enum>(f)</enum><header>Public participation</header><paragraph id="HDDE7E069FC394C8AAAA1BE8C489F457D"><enum>(1)</enum><header>In general</header><text>Meetings of the Council shall be open to the public. </text></paragraph><paragraph id="H0AE5B7958D82433BB5B461CE95F71B46"><enum>(2)</enum><header>Notice</header><text>The Council shall provide notice to the public of a meeting of the Council.</text></paragraph></subsection><subsection id="H6FA1ADB4F5A847A8A79D7E07C9EA3388"><enum>(g)</enum><header>Advice</header><text>The Council shall consult with the Advisory Board—</text><paragraph id="H5E524EEF5A924622A6CC60AE0B2AEBA2"><enum>(1)</enum><text>to assist the Council in the development of the dam removal strategy to be developed under section 206;</text></paragraph><paragraph id="HF0DB9E6999A64A12A3C58A6C86757E20"><enum>(2)</enum><text>to provide input on project identification criteria; and</text></paragraph><paragraph id="HB9C591D0EF234F4D957DAF972EACACF7"><enum>(3)</enum><text>to provide input on proportional distribution of funds to participating agencies.</text></paragraph></subsection></section><section id="H83A89AD0C0694B2EBE7B1033DE42142B"><enum>205.</enum><header>Establishment of Dam Removal Advisory Board</header><subsection id="HE96612CBAEAF419F9505B99798487154"><enum>(a)</enum><header>Advisory board</header><text>The Chair of the Council shall establish a Dam Removal Advisory Board to provide advice and recommendations on the implementation of this title.</text></subsection><subsection id="HC1BCEA0D7A4D443E80530FEF32DD211F"><enum>(b)</enum><header>Membership</header><text>The Advisory Board shall include 12 members appointed by the Chair, of whom—</text><paragraph id="H4212E4B057514A6D82AC271FFA9DFC21"><enum>(1)</enum><text>2 members shall be representatives of Indian Tribes;</text></paragraph><paragraph id="HF80571026F064AC59A29DE9E13588198"><enum>(2)</enum><text>2 members shall be representatives of State government agencies that manage or provide funds for dam removal projects or regulate dam safety; </text></paragraph><paragraph id="H85F3F848979D4F968DFC9F4FDC14E192"><enum>(3)</enum><text>3 members shall be representatives of nongovernmental organizations that manage or provide technical assistance for dam removal projects; </text></paragraph><paragraph id="HF6C253135C274C7F9A5B5E7A88908838"><enum>(4)</enum><text>2 members shall be representatives of nongovernmental organizations that work to improve dam safety practices; and</text></paragraph><paragraph id="HDDB8C2662DBE466883596E5591475F73"><enum>(5)</enum><text>3 members shall be representatives of organizations representing dam owners.</text></paragraph></subsection><subsection id="HEF9968AC655747278CF18D8505995FBE"><enum>(c)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Board. </text></subsection></section><section id="H6207381839DC44199052D695C82827A6"><enum>206.</enum><header>Dam removal strategy</header><subsection id="H80F416AA5536420680F13A94F645CB9E"><enum>(a)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the Council shall develop a dam removal strategy—</text><paragraph id="H4A9FCB9E69044FB487D676D26947B1E8"><enum>(1)</enum><text>to ensure a comprehensive approach to remove dams that—</text><subparagraph id="H4F72E23829BC45B7937E3FBD4D3E1206"><enum>(A)</enum><text>pose the greatest threat to public safety;</text></subparagraph><subparagraph id="H8E348F9CC82A4B78AB490607B410845A"><enum>(B)</enum><text>provide the greatest opportunity for environmental restoration; and </text></subparagraph><subparagraph id="H80D680E90C6B4C7BA53ADA449A8FDECB"><enum>(C)</enum><text>are consistent with efforts to address climate change and adaptation;</text></subparagraph></paragraph><paragraph id="HC26FE8E8CAC74E72842F021BA9C8C8DF"><enum>(2)</enum><text>to maximize benefits derived from dam removal projects; and</text></paragraph><paragraph id="H8CD92590BAF74FA3B47F079B8E9027F6"><enum>(3)</enum><text>to foster the coordination of Federal and non-Federal activities related to dam removal. </text></paragraph></subsection><subsection id="HAFBE1666E060476EA8B8A570302DD1B7"><enum>(b)</enum><header>Goal</header><text>The goal of the dam removal strategy under subsection (a) shall be to improve public safety and restore healthy rivers by reconnecting at least 10,000 miles of river by 2026.</text></subsection><subsection id="HC4DC41DAFC7A4A62BCAD0B00246D8C5A"><enum>(c)</enum><header>Elements of strategy</header><text>The dam removal strategy under subsection (a) shall—</text><paragraph id="HFC3CB74D550B451BA6A63A57DA76679F"><enum>(1)</enum><text>identify limiting factors to completing dam removal projects and strategies for overcoming those limiting factors;</text></paragraph><paragraph commented="no" id="H3A91C30F0E9F49CA88ED65F5C517DC74"><enum>(2)</enum><text>utilize the selection factors and priorities described in section 203(c);</text></paragraph><paragraph id="H0A2B3E8F4734427EA784EE5BE1DB2D92"><enum>(3)</enum><text>optimize the benefits of dam removal activities, including basin-scale fish passage planning;</text></paragraph><paragraph id="H97F7670313BE4A17BC6774F0BF82955B"><enum>(4)</enum><text>maximize the incentives for the creation of new public-private partnerships to carry out dam removal projects and the use of Federal resources to encourage increased private sector involvement in dam removal projects;</text></paragraph><paragraph id="H246E368B6D644C3C84DBE4A74B991BAA"><enum>(5)</enum><text>identify opportunities for Federal agency collaboration to remove dams that are no longer needed from Federal land;</text></paragraph><paragraph id="H41BB83FF454547D2A58F87CA8F7AD8CB"><enum>(6)</enum><text>be consistent with dam removal, habitat restoration, and public safety plans;</text></paragraph><paragraph commented="no" id="H4054005CB1334DA78BA87EC3CFAD263A"><enum>(7)</enum><text>promote dam removal projects—</text><subparagraph commented="no" id="H57613F81248C4B4B808D96A8BE091253"><enum>(A)</enum><text>to meet the criteria in section 203(c)(3); and</text></subparagraph><subparagraph commented="no" id="HEF696F47433D45BD8D44B255C6EBCF64"><enum>(B)</enum><text>to address other areas of concern that the Council determines to be appropriate for consideration; and</text></subparagraph></paragraph><paragraph id="H33FFE7CC5115419E88D5A04371816B8D"><enum>(8)</enum><text>provide recommendations for broad and equitable geographic distribution of projects funded under this title.</text></paragraph></subsection><subsection id="H4170B27DF8AE4A70AF3502FD941E3B3F"><enum>(d)</enum><header>Public review and comment</header><text>Before the Council adopts a dam removal strategy under subsection (a), the Council shall—</text><paragraph id="H4D6D1CC8D70040D1BA35427ABD4BCA4F"><enum>(1)</enum><text>publish in the Federal Register a draft of the dam removal strategy; and </text></paragraph><paragraph id="H9203AD24300A4740B4188249D9ABB048"><enum>(2)</enum><text>provide an opportunity for public review and comment.</text></paragraph></subsection><subsection id="H81832B9BC296409CAFB6B60F6C65E378"><enum>(e)</enum><header>No delay of dam removal projects</header><text>Development of the dam removal strategy under subsection (a)—</text><paragraph id="HF723EF675B4544928AF5001B7728D20F"><enum>(1)</enum><text>shall occur concurrently with implementation of dam removal projects and technical assistance under this Act; and</text></paragraph><paragraph id="H571E3A5CC891426399495C042B80A245"><enum>(2)</enum><text>shall not delay progress of those projects and activities.</text></paragraph></subsection><subsection id="HB98D4F65898149A597018DEFC4427975"><enum>(f)</enum><header>Periodic revision</header><text>Using data and information developed through project monitoring and management, and other relevant information, the Council may periodically review and update, as necessary, the dam removal strategy under subsection (a).</text></subsection></section><section id="H6E161F628DCC48BF92773AD1C0C7D8B3"><enum>207.</enum><header>Reporting</header><subsection id="H87933746BCA840FFBA810DA9DE4CEA67"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the Secretary, after considering the advice and recommendations of the Council and Advisory Board, shall submit to Congress a report on the activities carried out under this title.</text></subsection><subsection id="H81D5B4AF5CF64848BAD3FCBA8F5325E8"><enum>(b)</enum><header>Contents of report</header><text>A report under subsection (a) shall include—</text><paragraph id="H265CAC9185164106924F39FFE446AFB9"><enum>(1)</enum><text>data on—</text><subparagraph id="H7B9702B8807649C1A3714F0ED1330C3F"><enum>(A)</enum><text>the number of dams removed, river miles opened, public safety benefits, and aquatic ecosystem benefits achieved through projects under this title; and</text></subparagraph><subparagraph id="HF268E497969B4C3DA2366433182AE939"><enum>(B)</enum><text>participating agency expenditures, project costs, and descriptions of projects selected, in progress, and completed under this title;</text></subparagraph></paragraph><paragraph id="H220B0B3A0CFF4780B9DCB51A6C625CC0"><enum>(2)</enum><text>a review of project expenses, identifying areas of opportunity for reducing future project expenses;</text></paragraph><paragraph id="H33A5DC74EB134FD6A6261129F2A612B4"><enum>(3)</enum><text>a review of how the information described in paragraphs (1) and (2) will be incorporated into the selection and implementation of new dam removal projects;</text></paragraph><paragraph id="H227B4246EDFC4F52B11EA1CA323344F1"><enum>(4)</enum><text>a review of efforts made to maintain an appropriate database of dam removal projects carried out under this title; and</text></paragraph><paragraph id="H41DE6BBC206742B882DCC8EB41C1EA81"><enum>(5)</enum><text>a review of the measures taken to provide the information described in paragraphs (1) through (3) to Federal agencies with responsibility for assisting in the dam removals.</text></paragraph></subsection></section><section id="H84723F9AE78D4BDEBBA3366F3578566F"><enum>208.</enum><header>Funding</header><subsection id="HA26D7684798D47C5AFB666858CCC3AFE"><enum>(a)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this title $7,500,000,000, to remain available until expended.</text></subsection><subsection id="HB3CD07984EBA45A99EDB1B03DF409929"><enum>(b)</enum><header>Technical assistance funding allocations</header><text>Of the amounts made available under subsection (a)—</text><paragraph commented="no" id="H77ED833E3BB343EA90494E4AEEFE8E02"><enum>(1)</enum><text>not less than $50,000,000 shall be allocated for the costs of administration, environmental compliance, and technical assistance to carry out this title; and</text></paragraph><paragraph commented="no" id="H2E2E76900A0D477EB9A81DE51EB7AE3E"><enum>(2)</enum><text>not less than $30,000,000 shall be allocated to non-Federal dam removal technical assistance programs.</text></paragraph></subsection><subsection commented="no" id="H0938511EDCD548ABAB6A5EF9DC3EC54F"><enum>(c)</enum><header>Set-Aside for administrative expenses of the Council</header><text>Of the amounts made available under subsection (a) for each fiscal year, the Secretary shall use for administration and operating costs of the Council and for development of the report under section 207, including the collection and maintenance of dam removal project data, the lesser of—</text><paragraph commented="no" id="HACDFCAD43153479286DC646D2E9D5CF2"><enum>(1)</enum><text>3 percent; and</text></paragraph><paragraph commented="no" id="H0412B39A085244BEBA5D0CB53B575F54"><enum>(2)</enum><text>$1,500,000.</text></paragraph></subsection></section><section id="H386D615F59904CBC8E32DF49E1B761A3"><enum>209.</enum><header>General provisions</header><subsection id="H943C4B8A899A4EF7A518F9F5C8890C4F"><enum>(a)</enum><header>Agency consultation and coordination</header><text>In carrying out this title, the Secretary shall, as necessary, consult with, cooperate with, and coordinate activities with the activities of other Federal agencies.</text></subsection><subsection id="H4133B48E58234260AF3F400CA3D33DA4"><enum>(b)</enum><header>Cooperative agreements; memoranda of understanding</header><text>In carrying out this title, the Secretary and other Federal agencies, as appropriate, may—</text><paragraph id="H6D8C59D93DC4421EB087326A31B4961E"><enum>(1)</enum><text>enter into cooperative agreements or contracts with Federal, State, and local government agencies, nongovernmental organizations, and other entities; and</text></paragraph><paragraph id="H1C2BB56C1B384EAA920B86F6FAD74029"><enum>(2)</enum><text>execute such memoranda of understanding as are necessary to reflect the agreements.</text></paragraph></subsection><subsection id="H95057738337B4196AFFE780FA2557406"><enum>(c)</enum><header>Federal agency facilities and personnel</header><text>Federal agencies may—</text><paragraph id="H25FDD3B0B86F42B98291ECC2E87CB12D"><enum>(1)</enum><text>cooperate in carrying out scientific and other programs necessary to carry out this title; and</text></paragraph><paragraph id="H0B98EF9DD2FD4A739E83CE2BBC1D96CD"><enum>(2)</enum><text>provide facilities and personnel for the purpose of assisting the Council in carrying out the duties of the Council under this title.</text></paragraph></subsection></section></title><title id="H3E02E897E28E4DBD9213079489BD38F0"><enum>III</enum><header>Reimagined Federal Dams</header><section id="H21CB0D8135984502A0B8387D32A72470"><enum>301.</enum><header>National dam assessment</header><subsection id="HFFC54DFD3B9B4161A33CEE87B552734E"><enum>(a)</enum><header>In general</header><text>The National dam assessment will assimilate data to provide for stakeholders to determine whether a dam may be an appropriate candidate to remove, upgrade, enhance environmental performance, or retrofit for hydropower production. The assessment is intended for data gathering and analysis tools and will not make recommendations on individual dams.</text></subsection><subsection id="H0B417C1587104353A2A76A9ABD3F256D"><enum>(b)</enum><header>Dam assessments and data gathering</header><paragraph id="H63647BC3D47A41EA991B2D001FC9747A"><enum>(1)</enum><header>In general</header><text>The United States Geological Survey and the Department of Energy (Lead agencies) shall jointly conduct an assessment of the nation’s dam infrastructure, including government and privately owned powered and non-powered dams. In conducting its assessment, the Lead agencies shall consult with other Federal and State government agencies, including the Corps of Engineers, the Bureau of Reclamation, the Federal Energy Regulatory Commission, the Federal Emergency Management Agency, the United States Fish and Wildlife Service, the National Oceanic Atmospheric Administration, State dam safety officials, and other stakeholders.</text></paragraph><paragraph id="H131709BA1E4B4335919EB968391A0822"><enum>(2)</enum><header>Purpose</header><text>The purpose of the assessment is to integrate existing data to help stakeholders identify—</text><subparagraph id="H29BD39CED2124ECCBF497A28E6E9C1F7"><enum>(A)</enum><text>dams that continue to serve vital roles and may be priorities for upgrades, environmental performance enhancements, or retrofits to add or replace generation at powered and non-powered facilities; and</text></subparagraph><subparagraph id="H3068E7C23BFB47F0BD282C0257855930"><enum>(B)</enum><text>dams that may have been abandoned, have reached the end of their useful life, or otherwise may be candidates for removal and river restoration.</text></subparagraph></paragraph><paragraph id="H7F82D442FFBC4678A224BC30FBC89ECD"><enum>(3)</enum><header>Content</header><subparagraph id="HC169C74C03E64601B6F5C4EE8C92D307"><enum>(A)</enum><text>The Lead agencies shall, in consultation with the other Federal and State agencies, the Dam Removal Council established under section 304, as well as other stakeholders, develop a set of data and other factors relevant to dam upgrades, retrofit and removal, including but not limited to age, height, water flow, hazard classifications, condition assessment, environmental improvement opportunities, climate change risks, known functions and other factors determined by the Lead agencies to meet the goals of the assessment.</text></subparagraph><subparagraph id="HA5462C72499B4DC1A0E3FB3D9622590E"><enum>(B)</enum><text>At the time of submission of the report to Congress, the Lead agencies shall make the assessment publicly available in a written and an electronically searchable format.</text></subparagraph><subparagraph id="HD29173A9E0B9480A94BE4FD304727DA3"><enum>(C)</enum><text>The Lead agencies shall, to the extent possible, compile pre-existing information from Federal and State government sources and avoid duplicating existing assessments of any particular dam, facility, or project.</text></subparagraph></paragraph></subsection></section><section id="HCB6ACED94B044870BB829E3DAA8F8C96"><enum>302.</enum><header>Federal dam assessments</header><subsection id="HAC82EC52EB7B4BB199BA53483E517C39"><enum>(a)</enum><header>In general</header><text>Federal agencies that own dams shall assess their dams to identify which should be removed, upgraded, enhanced for environmental performance, or retrofitted for hydropower production.</text></subsection><subsection id="H8588FFA46A7D4086A94D2D5BB084BDFE"><enum>(b)</enum><header>Criteria</header><text>The lead agencies under section 301(b) will work with dam-owning Federal agencies and the Dam Removal Council to develop criteria for agencies to use to complete the assessments.</text></subsection><subsection display-inline="no-display-inline" id="HD5534784948943DBAA0F00504B5BEF12"><enum>(c)</enum><header>Assessment</header><text>Using the criteria from subsection (b), Federal agencies that own dams shall assess their dams to identify those appropriate for the outcomes in subsection (a) or other outcomes determined by the lead agencies.</text></subsection><subsection id="HD38F92DD88134AF28BE4B86694CFE216"><enum>(d)</enum><header>Outcomes</header><text>Those outcomes identified by the assessment should not be compelled, but should inform future action by the agencies.</text></subsection></section><section id="H9BA432460DC84AC8B6C169AC698EC378"><enum>303.</enum><header>Report</header><text display-inline="no-display-inline">The Secretary shall submit to the Committees on Energy and Commerce, Resources, and Transportation and Infrastructure of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report on the findings and conclusions of the assessments under this section by not later than 18 months after the date of the enactment of this Act. The assessment and report to Congress shall be updated every 3 years thereafter.</text></section><section id="HED0F41A506214149A3939B1F1CFB3B9E"><enum>304.</enum><header>Investing in Federal dam infrastructure</header><subsection id="H116E9A6430DA4997BE28D518891F300B"><enum>(a)</enum><header>Corps of Engineers</header><paragraph id="id441B491A5FB749EB9F1B609FB271163B"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Corps of Engineers $1,600,000,000 for fiscal years 2022 through 2026 for the following dam-related activities:</text><subparagraph id="HC33733D27C414A808AE6C8DCC1607EE3"><enum>(A)</enum><text>Safety improvements, including concrete repair, tunnel work, and gate repair and replacement.</text></subparagraph><subparagraph display-inline="no-display-inline" id="H7BD98FACC9544533BC44FC5DC94BC99D"><enum>(B)</enum><text>Environmental improvements, including fish id="id14B5ED8DB68249668BF1D9F71B4B1B2F"><enum>(A)</enum><text>innovative waterpower technologies; </text></subparagraph><subparagraph id="id5178E244CDEC49879C3184534E592EE8"><enum>(B)</enum><text>technologies to improve retrofitting and rehabilitating hydropower dams; and</text></subparagraph><subparagraph
