which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish within the Office of Entrepreneurial Development of the Small Business Administration a training curriculum relating to businesses owned by older individuals, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Golden-preneurship Act</short-title></quote>.</text></section><section id="id81F555157E644492AF9CA14CFD930376"><enum>2.</enum><header>Definitions</header><subsection id="id5E46E3F595704F31AA83B54308A0B78F"><enum/><text>In this Act—</text><paragraph id="idA8925C2E61F8423AAAF675213156C451"><enum>(1)</enum><text>the term <term>Administrator</term> means the Administrator of the Small Business Administration;</text></paragraph><paragraph id="id46CD52D7739945D980BE0697CD391E48"><enum>(2)</enum><text>the term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id740C193AABF743079770024358B7B1B4"><enum>(A)</enum><text>the Committee on Small Business and Entrepreneurship of the Senate;</text></subparagraph><subparagraph id="id7C308B73A23A4FC290AC5C76F728C139"><enum>(B)</enum><text>the Special Committee on Aging of the Senate; and</text></subparagraph><subparagraph id="id63A7B8EA50054B2DB0F694F1FCC66571"><enum>(C)</enum><text>the Committee on Small Business of the House of Representatives;</text></subparagraph></paragraph><paragraph id="id69DBAD08A0AE4A0AB64B19C77C0155A3"><enum>(3)</enum><text>the term <term>eligible entity</term> means an operating business that is owned by an older individual;</text></paragraph><paragraph id="id24B6E39D5F7F45178721A5592E159E00"><enum>(4)</enum><text>the terms <term>Federal agency</term>, <term>Small Business Innovation Research Program</term>, and <term>Small Business Technology Transfer Program</term> have the meanings given the terms in section 9(e) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(e)</external-xref>);</text></paragraph><paragraph id="id5DA5933AE50D48BF982C4590EAB8CE8E"><enum>(5)</enum><text>the term <term>older individual</term> has the meaning given the term in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>); </text></paragraph><paragraph id="idCBF944D8267F4DC8B0324F1F13134B7A"><enum>(6)</enum><text>the term <term>operating business</term> means a small business concern that, as of the date on which the small business concern seeks to enroll in the Program—</text><subparagraph id="id155261D2984A40478106828134FAE30F"><enum>(A)</enum><text>has been in operation for not less than 3 years; and</text></subparagraph><subparagraph id="id4F0B56B189C742B49BDC6C4C08AEF397"><enum>(B)</enum><text>for the most recently completed taxable year, had revenue of not less than $150,000;</text></subparagraph></paragraph><paragraph id="idFF4001D25C324A7C9288815C485293B6"><enum>(7)</enum><text>the term <term>Program</term> means the Golden Entrepreneurs Training and Demonstration Curriculum established under section 4;</text></paragraph><paragraph id="idCF102079570642F39184CFC9C8101DE8"><enum>(8)</enum><text>the term <term>resource partner</term> means—</text><subparagraph id="id3623F983C60B475D86CBA9AA88778C9E"><enum>(A)</enum><text>a small business development center described in section 21 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648</external-xref>);</text></subparagraph><subparagraph id="id5E8D875A3F524D32BE163FA8F48BD713"><enum>(B)</enum><text>the Service Corps of Retired Executives described in section 8(b)(1)(B) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(b)(1)(B)</external-xref>);</text></subparagraph><subparagraph id="id34B35A640C0C48B082804B58C15B78A2"><enum>(C)</enum><text>a women’s business center described in section 29 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C. 656</external-xref>); or</text></subparagraph><subparagraph id="id2216AB1F1CAD46228FC527A02C0D0E0D"><enum>(D)</enum><text>a Veteran Business Outreach Center;</text></subparagraph></paragraph><paragraph id="idEB578B6495CD427CAC1F69F6BC49AA55"><enum>(9)</enum><text>the term <term>selected entity</term> means an entity selected by the Administrator to carry out the Program, as described in section 4(a)(3); and</text></paragraph><paragraph id="id6AF9435891B841F69A7839E8B9E9BEBD" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text>the term <term>small business concern</term> has the meaning given the term in section 3(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>).</text></paragraph></subsection></section><section id="id77C0BF0F689842CA94C88A527AFFDC82"><enum>3.</enum><header>Findings</header><subsection id="idF831566307804B47BFA65A645884308B"><enum/><text>Congress finds the following:</text><paragraph id="id2C07F22337C24BC5AD51EFEA9A2A74CF"><enum>(1)</enum><text>In 2018— </text><subparagraph id="id11C285F2CEFF4626BD2FDFAE1252043A"><enum>(A)</enum><text><fraction>1/2</fraction> of all new successful entrepreneurs in the United States were older than 45 years of age; and</text></subparagraph><subparagraph id="idB74E909D1FB04A30B7A0900E428428C4"><enum>(B)</enum><text>3 out of 10 entrepreneurs in the United States were older than 50 years of age, a 50 percent increase since 2007.</text></subparagraph></paragraph><paragraph id="id9725AB5735484EFD9321CCAFFC909981"><enum>(2)</enum><text>As of the date of enactment of this Act, entrepreneurs who are older than 55 years of age represent 55 percent of all small business employers in the United States. </text></paragraph><paragraph id="id287E81326D0B446D8AFE881F4F85B0F7"><enum>(3)</enum><text>Businesses started by older entrepreneurs— </text><subparagraph id="id77B3F8B9479C489DA11C349E3B9A4046"><enum>(A)</enum><text>represent some of the highest growth businesses in the United States; and </text></subparagraph><subparagraph id="id03458060E62745C09D1EC015BC08EBB5"><enum>(B)</enum><text>rank among the top 0.1 percent of startups, based on growth in the first 5 years of business.</text></subparagraph></paragraph></subsection></section><section id="id661F4854F69C4C4D98954E9BDF1B5AF8"><enum>4.</enum><header>Golden entrepreneurs curriculum</header><subsection id="idFD1A2ED046F7408CA5B067ABD91CBCA2"><enum>(a)</enum><header>Establishment</header><text>There is established within the Office of Entrepreneurial Development of the Small Business Administration the Golden Entrepreneurs Training and Demonstration Curriculum— </text><paragraph id="idAA889CEBE267456FB7079FA0F37F3051"><enum>(1)</enum><text>the purpose of which shall be to provide eligible entities with tools to accelerate the growth of those entities; </text></paragraph><paragraph id="id4B79982FBD47460F9A615034D9F503D5"><enum>(2)</enum><text>which shall be a 210-day, comprehensive curriculum—</text><subparagraph id="id7F9D6DB9AFF445D98E6EA145EE35935B"><enum>(A)</enum><text>to effectuate the purpose described in paragraph (1); </text></subparagraph><subparagraph id="id998C2A12EB694C76997E83D47AF0B314"><enum>(B)</enum><text>that provides to eligible entities the resources described in subsection (b); </text></subparagraph><subparagraph id="id107D46C636A944ECB33A6707E9619452"><enum>(C)</enum><text>which shall be customizable by an eligible entity enrolled in the curriculum; and</text></subparagraph><subparagraph id="id1F93ADE8C4BA447EB35954A53DCA66D3"><enum>(D)</enum><text>that has the capability for both in-person and virtual enrollment and participation; </text></subparagraph></paragraph><paragraph id="id474FE770A5DF49CB99C4A69C7D2AEC21"><enum>(3)</enum><text>that shall be carried out by an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code, or by a resource partner, which the Administrator shall select after submitting a request for proposal with respect to that responsibility; and</text></paragraph><paragraph id="id60C5B5FF7C3A4B2CA465047779F7CA0C"><enum>(4)</enum><text>that includes specific outreach, training, and engagement directed towards eligible entities that are located in, or that serve, rural areas.</text></paragraph></subsection><subsection id="id8BC79489E2E244C1B83137E24FA35E84"><enum>(b)</enum><header>Resources</header><text>Under the Program, the Administrator, acting through a selected entity, shall provide to eligible entities the following:</text><paragraph id="idA6B90CE0A27942E1AC68B3D202BA8E1D"><enum>(1)</enum><text>Resources and training relating to— </text><subparagraph id="id182C7C88B4594B799563F33384C95D35"><enum>(A)</enum><text>technology and digitization of business operations; </text></subparagraph><subparagraph id="id43AD563EFDC64C4B95C2E835240057F1"><enum>(B)</enum><text>business expansion and hiring; </text></subparagraph><subparagraph id="id06C62376CBC74D4189700A6ADA84FF5A"><enum>(C)</enum><text>estate management and retirement strategies; and</text></subparagraph><subparagraph id="id10F8AADF759249F385823BB9AC9CFBB8"><enum>(D)</enum><text>the winding down of business operations, including training relating to—</text><clause id="idA99BFAEEBE53418C8385106F38331D2B"><enum>(i)</enum><text>the sale of an eligible entity; </text></clause><clause id="id15C83AEAC78F4D389649695D4400BD7C"><enum>(ii)</enum><text>the formation or transfer of assets to an employee stock ownership plan, as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/26/4975">section 4975(e)(7)</external-xref> of the Internal Revenue Code of 1986; and</text></clause><clause id="id2B74CD1C5BAE497A88B4E819732076B5"><enum>(iii)</enum><text>the transfer of the management functions of an eligible entity.</text></clause></subparagraph></paragraph><paragraph id="idF8A5A6C5705240489F2C5B1182B212D8"><enum>(2)</enum><text>Access to capital resources and training.</text></paragraph><paragraph id="idF947F041F8FD48029337C399D3D18FFB"><enum>(3)</enum><text>Mentorship and networking opportunities.</text></paragraph><paragraph id="id4F8C0545246648BBAAD861E5B623FD0F"><enum>(4)</enum><text>Information regarding Federal and State government contracting opportunities.</text></paragraph><paragraph id="id4B17BE9D579A42D5B9EF9D4C4FE6EB8F"><enum>(5)</enum><text>With respect to the 2-year period after the date on which an eligible entity completes the Program—</text><subparagraph id="id3F98042BF21647AEA6E34DCE30872827"><enum>(A)</enum><text>the establishment of benchmarks for the eligible entity with respect to the performance and growth of the eligible entity; and</text></subparagraph><subparagraph id="idFCE64F83650D42689E12BB5BD3C59654"><enum>(B)</enum><text>feedback with respect to the benchmarks established under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id9A16B20675EF48C8B1B316E32626889A"><enum>(c)</enum><header>Locations</header><text>A training module under the Program shall be located in—</text><paragraph id="id63D4F9F1554543C09E3074A20139A622"><enum>(1)</enum><text>a district office of the Small Business Administration; </text></paragraph><paragraph id="idE721BEBDA04B472ABF13510BDEA8C9DE"><enum>(2)</enum><text>a facility provided by a nonprofit organization that partners with the Small Business Administration; or</text></paragraph><paragraph id="id686B6ACAAE4A4969AA47573F11274426"><enum>(3)</enum><text>a facility provided by a resource partner.</text></paragraph></subsection><subsection id="id0CB78F5489BE45E892A7221A498B9CB2"><enum>(d)</enum><header>Goal</header><text>In carrying out the Program, the Administrator, acting through a selected entity, shall establish the goal of providing training to 1,000 eligible entities per year.</text></subsection><subsection id="idDC0AF5FAD84240519C8DE89A3E643FCB"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to prevent the Administrator from selecting multiple entities under subsection (a)(3) to carry out the responsibilities described in that provision.</text></subsection></section><section id="idAAB19817863347E3B01D66DFDF93403A"><enum>5.</enum><header>Data collection</header><subsection id="id75F2BD39143E4D9CB80B7E09FB56DF43"><enum>(a)</enum><header>In general</header><text>Beginning on the date that is 90 days after the date of enactment of this Act, the Administrator, in consultation with the head of any other Federal agency as may be necessary, shall track the number and dollar amount of— </text><paragraph id="id8CFB5A56F7C44C009C4D39C1CEED4F3A"><enum>(1)</enum><text>loans and grants made to older individuals, and to small business concerns owned by older individuals, under all of the programs of the Small Business Administration, including under—</text><subparagraph id="id49289F9889134B4085CCEBBB6D235D3F"><enum>(A)</enum><text>section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>);</text></subparagraph><subparagraph id="idFBDAAD97E6C941FA83DC562B4539DB8B"><enum>(B)</enum><text>section 7(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)</external-xref>); and</text></subparagraph><subparagraph id="id260EF270C90E4A2D84B94B37EA2D7C00"><enum>(C)</enum><text>title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>); and</text></subparagraph></paragraph><paragraph id="idE14857C7D0DF4D4C8925C3A0706FB01A"><enum>(2)</enum><text>awards to small business concerns owned by older individuals under the Small Business Innovation Research Programs and Small Business Technology Transfer Programs.</text></paragraph></subsection><subsection id="idFF3C47919B094F308C5D819AC0FB09E2"><enum>(b)</enum><header>Reporting requirement</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administrator shall submit to the appropriate committees of Congress a report regarding the data collected under subsection (a) for the period covered by the report.</text></subsection><subsection id="idDE36D23B19334D53A8A686867A30B79A"><enum>(c)</enum><header>Continuation of requirements</header><text>The requirements under subsections (a) and (b) shall continue in effect without regard to whether the Program, or the authorization to carry out the Program, is repealed.</text></subsection></section><section id="id7B608DE079D34D1F9777801BFF14DB1B"><enum>6.</enum><header>Rescission of appropriations for community navigator pilot program</header><subsection id="id40B4575AD8AA43D08A4482FE459CFBBA"><enum/><text>Of the unobligated balances of amounts appropriated under section 5004(b)(2) of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>) on the date of enactment of this Act, $6,000,000 is rescinded.</text></subsection></section><section id="id7C987218803D4BC29834A6D6B3BDF2EA"><enum>7.</enum><header>Authorization of appropriations</header><subsection id="idFC0FF2472B6C4C40A90BFD5B5CD613E2"><enum/><text>There are authorized to be appropriated to the Administrator $3,000,000 for each of fiscal years 2022 and 2023 to carry out this Act.</text></subsection></section></legis-body></bill>
