<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2342</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210714">July 14, 2021</action-date><action-desc><sponsor name-id="S331">Mrs. Gillibrand</sponsor> (for herself, <cosponsor name-id="S293">Mr. Graham</cosponsor>, and <cosponsor name-id="S253">Mr. Durbin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 9 of the United States Code with respect to arbitration of disputes involving sexual assault and sexual harassment.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021</short-title></quote>.</text></section><section id="ide8764adf4e4247a299159020b55fa0da"><enum>2.</enum><header>Predispute arbitration of disputes involving sexual assault and sexual harassment</header><subsection id="id9547713071534bc982a212eb2edb02f1"><enum>(a)</enum><header>In general</header><text>Title 9 of the United States Code is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id1d86141809b740a69ebbd125c7b0f7de"><chapter id="idc4efa00169204b5ca9e2ad833e5d8193"><enum>4</enum><header>Arbitration of disputes involving sexual assault and sexual harassment</header><toc><toc-entry level="section">Sec. </toc-entry><toc-entry level="section">401. Definitions. </toc-entry><toc-entry level="section">402. No validity or enforceability. </toc-entry></toc><section id="id2b52ef54aa8b4a4299016db1e048f36f"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text><paragraph id="id082fce57ab404e69977c0f945dc33ed2"><enum>(1)</enum><header>Predispute arbitration agreement</header><text>The term <term>predispute arbitration agreement</term> means any agreement to arbitrate a dispute that had not yet arisen at the time of the making of the agreement.</text></paragraph><paragraph id="id4f44555a5a0e43fab005e41d3ca26c21"><enum>(2)</enum><header>Predispute joint-action waiver</header><text>The term <term>predispute joint-action waiver</term> means an agreement, whether or not part of a predispute arbitration agreement, that would prohibit, or waive the right of, one of the parties to the agreement to participate in a joint, class, or collective action in a judicial, arbitral, administrative, or other forum, concerning a dispute that has not yet arisen at the time of the making of the agreement.</text></paragraph><paragraph id="id1990f30f1e2c42fd967c393a39168d73"><enum>(3)</enum><header>Sexual assault dispute</header><text>The term <term>sexual assault dispute</term> means a dispute involving a nonconsensual sexual act or sexual contact, as such terms are defined in section 2246 of title 18 or similar applicable Tribal or State law, including when the victim lacks capacity to consent.</text></paragraph><paragraph id="id94588a619ec94c208d9440ed824d1454"><enum>(4)</enum><header>Sexual harassment dispute</header><text>The term <term>sexual harassment dispute</term> means a dispute relating to the any of the following conduct directed at an individual or a group of individuals:</text><subparagraph id="idf9d68647580e44d0936a4fe5abdfaf3a"><enum>(A)</enum><text>Unwelcome sexual advances.</text></subparagraph><subparagraph id="id3c3e3643732c4ff195e26c61e5697b6a"><enum>(B)</enum><text>Unwanted physical contact that is sexual in nature, including assault.</text></subparagraph><subparagraph id="id4cc0d7d0eb6c416390699146e162f6a6"><enum>(C)</enum><text>Unwanted sexual attention, including unwanted sexual comments and propositions for sexual activity.</text></subparagraph><subparagraph id="id87d6fc118da04aada43555dd97d72de5"><enum>(D)</enum><text>Conditioning professional, educational, consumer, health care or long-term care benefits on sexual activity.</text></subparagraph><subparagraph id="id99528a14cc4848f7937e95a64b84052f"><enum>(E)</enum><text>Retaliation for rejecting unwanted sexual attention.</text></subparagraph></paragraph></section><section id="id11b230a89c514abeb49a9ec524cf44b0"><enum>402.</enum><header>No validity or enforceability</header><subsection id="idd9da268b6624413781d1e18ba448a0d2"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (c), and notwithstanding any other provision of this title, no predispute arbitration agreement or predispute joint-action waiver shall be valid or enforceable with respect to a case which is filed under Federal, Tribal, or State law and relates to a sexual assault dispute or a sexual harassment dispute.</text></subsection><subsection id="idfb1f077c49304779a968197f2e09b856"><enum>(b)</enum><header>Determination of applicability</header><text>An issue as to whether this chapter applies with respect to a dispute shall be determined under Federal law. The applicability of this chapter to an agreement to arbitrate and the validity and enforceability of an agreement to which this chapter applies shall be determined by a court, rather than an arbitrator, irrespective of whether the party resisting arbitration challenges the arbitration agreement specifically or in conjunction with other terms of the contract containing such agreement, and irrespective of whether the agreement purports to delegate such determinations to an arbitrator.</text></subsection><subsection id="idb1e1a310c530466ea836526ea90f2a3d"><enum>(c)</enum><header>Exception for collective bargaining agreements</header><text>Nothing in this chapter shall apply to any arbitration provision in a contract between an employer and a labor organization or between labor organizations, except that no such arbitration provision shall have the effect of waiving the right of an employee to seek judicial enforcement of a right arising under provision of the Constitution of the United States, a State constitution, or a Federal or State statute, or public policy arising therefrom.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idafeae62c768d46debae608a8d0793395"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="id77a6ffbb87844f5fa2b602bc9625d738"><enum>(1)</enum><header>In general</header><text>Title 9 of the United States Code is amended—</text><subparagraph id="idd8207e612d5b4caebb0524c59ee39799"><enum>(A)</enum><text>in section 2, by inserting <quote>or as otherwise provided in chapter 4</quote> before the period at the end;</text></subparagraph><subparagraph id="idf8632583b8db4bc6be45eeb28af58a0d"><enum>(B)</enum><text>in section 208—</text><clause id="id91f3af8e20604b7ea8b6c0a288857d75"><enum>(i)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">Chapter 1; residual application</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Application</header-in-text></quote>; and</text></clause><clause id="id6460af3a967e42b091a4245693e8a875"><enum>(ii)</enum><text>by adding at the end the following: <quote>This chapter applies to the extent that this chapter is not in conflict with chapter 4.</quote>; and</text></clause></subparagraph><subparagraph id="id3895396f1188418284a1e851653b7a7f"><enum>(C)</enum><text>in section 307—</text><clause id="id003e53df015143e79884568ece623a16"><enum>(i)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">Chapter 1; residual application</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Application</header-in-text></quote>; and</text></clause><clause id="id012195b247fd49eea34974dda423bc7d"><enum>(ii)</enum><text>by adding at the end the following: <quote>This chapter applies to the extent that this chapter is not in conflict with chapter 4.</quote>.</text></clause></subparagraph></paragraph><paragraph id="idbf378083dc9a4a7aabca35e152e3e385"><enum>(2)</enum><header>Table of sections</header><subparagraph id="ida4460234c44e46d4b4ca1d83185abb25"><enum>(A)</enum><header>Chapter 2</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/2">chapter 2</external-xref> of title 9, United States Code, is amended by striking the item relating to section 208 and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id6433EFF5300D4CF19E026B4EC65EF986" style="OLC"><toc><toc-entry bold="off" level="section">208. Application.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="idbfff179ff4b8404fa6d41ff64f27b19f"><enum>(B)</enum><header>Chapter 3</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/3">chapter 3</external-xref> of title 9, United States Code, is amended by striking the item relating to section 307 and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idCCC01BD441E84D1897226B912213C85D" style="OLC"><toc><toc-entry bold="off" level="section">307. Application.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id1DE60D22D5F04FFBA25B1E75DA5F2964"><enum>(3)</enum><header>Table of chapters</header><text>The table of chapters for title 9, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFC0585A44E034A6D98C53255BA01DA1F"><toc><multi-column-toc-entry level="chapter" bold="on"><toc-enum>4.</toc-enum><level-header level="chapter"> Arbitration of disputes involving sexual assault and sexual harassment</level-header><target>401</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id669692f23e3547a4bb1af88227fd3870"><enum>3.</enum><header>Applicability</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall apply with respect to any dispute or claim that arises or accrues on or after the date of enactment of this Act. </text></section></legis-body></bill>
