<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2339</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210714">July 14, 2021</action-date><action-desc><sponsor name-id="S357">Mrs. Fischer</sponsor> (for herself, <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>, <cosponsor name-id="S153">Mr. Grassley</cosponsor>, <cosponsor name-id="S386">Ms. Duckworth</cosponsor>, <cosponsor name-id="S303">Mr. Thune</cosponsor>, <cosponsor name-id="S394">Ms. Smith</cosponsor>, <cosponsor name-id="S376">Ms. Ernst</cosponsor>, <cosponsor name-id="S354">Ms. Baldwin</cosponsor>, <cosponsor name-id="S381">Mr. Rounds</cosponsor>, <cosponsor name-id="S253">Mr. Durbin</cosponsor>, <cosponsor name-id="S347">Mr. Moran</cosponsor>, and <cosponsor name-id="S411">Mr. Marshall</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act with respect to the ethanol waiver for Reid vapor pressure limitations under such Act. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5C43B2A7709641148B405681BB70AB7E"><section section-type="section-one" id="idA79E5250A05A4FACAD082732FE7A869D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer and Fuel Retailer Choice Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H6E2035D3E3B94D9FAADC9351E6F2D03E"><enum>2.</enum><header>Ethanol waiver</header><subsection id="H40EB087CFB09415D8E73AD1277B0F4D1"><enum>(a)</enum><header>Reid vapor pressure limitation</header><text display-inline="yes-display-inline">Section 211(h) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(h)</external-xref>) is amended—</text><paragraph id="H51828943B53246589FEC02C5733AED45"><enum>(1)</enum><text>in paragraph (4)—</text><subparagraph id="id23CEA6DEA0F745C4958A5552061587D1"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>or more</quote> after <quote>10 percent</quote>; and</text></subparagraph><subparagraph id="HF683F019821B4834B584D61666C01BAD"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>additional alcohol or</quote>; and</text></subparagraph></paragraph><paragraph id="id77F68CD341E9403DBEBFEAC54C785F17"><enum>(2)</enum><text>in paragraph (5)(A), by inserting <quote>or more</quote> after <quote>10 percent</quote>.</text></paragraph></subsection><subsection id="HDC5A9528AAAD453281246319A1A9BBFC"><enum>(b)</enum><header>Existing waivers</header><text>Section 211(f)(4) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(f)(4)</external-xref>) is amended—</text><paragraph id="HE566030582CC474E86E8E7FAA48AF251"><enum>(1)</enum><text>by striking <quote>The Administrator, upon</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H79A5BE3483FD4DABB39D0921B8697DE6"><subparagraph id="HB23A1D75C4874A90AB1E59D23D8BD183"><enum>(A)</enum><text display-inline="yes-display-inline">The Administrator, upon</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H1BEEB39223114F00992E655C5C250008"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8EA7A96B870443C0ACDA4A939A62A5A8"><subparagraph id="HB542C8ADFA3D4CEBB2264D5250BED904"><enum>(B)</enum><text display-inline="yes-display-inline">A fuel or fuel additive that has been granted a waiver under subparagraph (A) prior to January 1, 2017, and meets all of the conditions of that waiver, other than the waiver’s limits for Reid Vapor Pressure, may be introduced into commerce if the fuel or fuel additive meets all other applicable Reid Vapor Pressure requirements.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
