<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2335</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210713">July 13, 2021</action-date><action-desc><sponsor name-id="S389">Mr. Kennedy</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Communications Act of 1934 to narrow the scope of the limitation on liability provided under section 230 of that Act, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Don’t Push My Buttons Act</short-title></quote>.</text></section><section id="idF594A85DDD9A42EC9119FEF3E0352269"><enum>2.</enum><header>Limitation on immunity</header><text display-inline="no-display-inline">Section 230(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="id353BA92DE6DA41FD8196412CF3CF3521" act-name=""><paragraph id="idD14FB7E83F1949DF9E7B16EFC846C397"><enum>(3)</enum><header>Exception</header><subparagraph id="id982189FF34364E078D5A34C924170F85"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of this subsection, and subject to subparagraph (B) of this paragraph, the protection provided under paragraph (1) or (2) shall not apply with respect to a provider of an interactive computer service that—</text><clause id="id6D6FC229218F4FEF802422876D41E8B1"><enum>(i)</enum><text>collects information regarding the habits, preferences, or beliefs of a user of the service; and</text></clause><clause id="id44B22DCA93F64D599A0817155AA9160E"><enum>(ii)</enum><text>uses an automated function to deliver content to the user described in clause (i) that corresponds with the habits, preferences, or beliefs identified as a result of the action taken under that clause with respect to that user.</text></clause></subparagraph><subparagraph id="id356B2B4E60B049BE84130A1E7D6AD6A1"><enum>(B)</enum><header>Applicability</header><text>Subparagraph (A) shall not apply to a situation in which—</text><clause id="id07531E7D37B44E5EACC3C5633715AF60"><enum>(i)</enum><text>a user of an interactive computer service uses an automated function to deliver content to that user; or</text></clause><clause id="id9A8A921A26A7499DBFDF771C1FE883D5"><enum>(ii)</enum><text>subject to subparagraph (C), a user of an interactive computer service knowingly and intentionally elects to receive the content described in subparagraph (A)(ii).</text></clause></subparagraph><subparagraph id="idB644D6F36F7740C7B9ED4A33F1D5D4C9"><enum>(C)</enum><header>Burden of proof</header><text>A provider of an interactive computer service shall have the burden of proving by clear and convincing evidence under subparagraph (B)(ii) that a user of the interactive computer service knowingly and intentionally elected to receive the content described in subparagraph (A)(ii).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
