<congress>One Hundred Seventeenth Congress of the United States of America</congress><session display="yes">2d Session</session><enrolled-dateline display="yes">Begun and held at the City of Washington on Monday, the third day of January, two thousand and twenty two</enrolled-dateline><legis-num display="yes">S. 2333</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/2205">chapter 2205</external-xref> of title 36, United States Code, to ensure equal treatment of athletes, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="ide3978c65-16cf-4f17-b6c7-78846081b0f5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Equal Pay for Team USA Act of 2022</short-title></quote>.</text></section><section id="ided9f01516d5f49d9ae9b89db830090f2" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Modifications to United States Olympic and Paralympic Committee and national governing bodies</header><subsection id="id1ff51e2f9a7b4baa9e94486e94643ba8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">United States Olympic and Paralympic Committee</header><paragraph id="idA9B2D82AF09543BE917EBF9866DF9A85" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">Section 220505(d) of title 36, United States Code, is amended—</text><subparagraph id="id5C864646BCCD4144830099FF41D09350" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><clause id="id05a767a08d0a4bedab97223db34bda0a" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (B)(ii), by striking <quote>; and</quote> and inserting a semicolon; </text></clause><clause id="id5ddbb5099dcd4e77a8cccc954e3123ab" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="id52445a2f046c4806be056fe876881462" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4da4aee5a427499ea44f4c5a05d04537" changed="not-changed"><subparagraph id="id4fa7303c1c1f4fc1bb11d67cd925e574" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">with respect to a sport for which the corporation conducts separate programs for female and male athletes, to ensure that female and male athletes who represent the United States in international amateur athletic events receive, from funds directly provided by the corporation to the athlete (excluding any prize or award based on the athlete's performance in an international amateur athletic competition), equivalent and nondiscriminatory compensation, wages, benefits, medical care, travel arrangements, and payment or reimbursement for expenses, all insofar as these are implemented in connection with such amateur athletic events, where <quote>equivalent</quote> means <quote>equal</quote> except that it shall be permissible—</text><clause id="idac08f59225bd47f7893cc47130bd8c5c" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">to consider merit, performance, seniority, or quantity of play in determining contract or other terms of participation; and</text></clause><clause id="ide921f63bbaf64faeaaab1bf876817a46" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">to provide more beneficial terms of participation to athletes representing the United States in international events to address disparities in outside income, including in compensation made available by international sports federations and other event organizers, or the need to foster underdeveloped programs or address documented and justifiable personal need on the part of specific athletes or teams.</text></clause></subparagraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idEDB991EBBCA147A39A06A347BCC61708" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph (3); and </text></subparagraph><subparagraph id="id7B396D6C9A5646A3BB7D39D8C84A4443" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2878F641CAEA4211AF4A1EF95B017705" changed="not-changed"><paragraph id="id10F7375CC9D34F6F8826C26B9EA61964" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Advocacy</header><text display-inline="yes-display-inline">The corporation shall take all reasonable steps, in collaboration with affected athletes, to advocate to international sports federations and other event organizers to equalize prizes, compensation, funding, and other support provided to athletes by such federations and organizers.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idC386BCB5F7D844E7B992F5BB6E024F0B" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Annual report on equal treatment of athletes</header><subparagraph id="id34ACE58AAF3C4D7EB36778FB19B52681" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter I of title 36, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idDEB9B25BCAC3426D9D0BAC90009637BF" changed="not-changed"><section id="id122B6B6B0FD345EFB64826A8D390E087" commented="no" display-inline="no-display-inline" section-type="subsequent-section" changed="not-changed"><enum>220514.</enum><header display-inline="yes-display-inline">Annual report on equal treatment of athletes</header><subsection id="id86D2635130AB48578F93E749101FD7EA" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not less frequently than annually, the corporation shall submit to Congress a report on the compliance of the corporation with paragraphs (1)(D) and (2) of section 220505(d). </text></subsection><subsection id="id81800A86392440A0801A27C85F462EEE" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Matters To be included</header><text display-inline="yes-display-inline">Each report required by subsection (a) shall include detailed information on the median, minimum, and maximum stipends and bonuses provided to athletes, disaggregated by gender, race, and, as applicable, status of participation on a professional sports team.</text></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph><subparagraph id="id71E3E943AF8841EDBC6B20F0FCE449E0" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of sections for subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/2205">chapter 2205</external-xref> of title 36, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBF08DD95EB664790A2DD9E37D9C07380" changed="not-changed"><toc changed="not-changed"><toc-entry bold="off" level="section" changed="not-changed">220514. Annual report on equal treatment of athletes.</toc-entry></toc><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="ida759611578ee409ba8b4b3601b893c42" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">National governing bodies</header><paragraph id="id69E0AEE1190840B3A79A7578B0D1DE05" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">Section 220524(a) of title 36, United States Code, is amended—</text><subparagraph id="idc786c84a11124f1e8f2ce0a7f9ef88a7" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (7) through (14) as paragraphs (9) through (16), respectively; and</text></subparagraph><subparagraph id="id4050db626d7a4e57bb4bfccfcb32f88a" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after paragraph (6) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3BDB82AD59644D66941358A8C7C1D6EE" changed="not-changed"><paragraph id="id95ef49406d994b4094af976d6ba604aa" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(7)</enum><text display-inline="yes-display-inline">with respect to a sport for which a national governing body conducts separate programs for female and male athletes, ensure that female and male athletes who represent the United States in international amateur athletic events receive, from funds directly provided by the national governing body to the athlete (excluding any prize or award based on the athlete's performance in an international amateur athletic competition), equivalent and nondiscriminatory compensation, wages, benefits, medical care, travel arrangements, and payment or reimbursement for expenses, all insofar as these are implemented in connection with such amateur athletic events, where <quote>equivalent</quote> means <quote>equal</quote> except that it shall be permissible—</text><subparagraph id="id2f7e0dc808b84c07b89f3162a2b40575" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">to consider merit, performance, seniority, or quantity of play in determining contract or other terms of participation; and</text></subparagraph><subparagraph id="id7de68cb4a5764159bbf5653bf45a706a" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">to provide more beneficial terms of participation to athletes representing the United States in international events to address disparities in outside income, including in compensation made available by international sports federations and other event organizers, or the need to foster underdeveloped programs or address documented and justifiable personal need on the part of specific athletes or teams;</text></subparagraph></paragraph><paragraph id="ida5ce9d8b5dd4405c9d1362c1397ee3f7" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(8)</enum><text display-inline="yes-display-inline">take all reasonable steps, in collaboration with affected athletes, to advocate to international sports federations and other event organizers to equalize prizes, compensation, funding, and other support provided to athletes by such federations and organizers;</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id1a839f22-cb36-489c-a18a-6ab2cb4003e4" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Annual report on equal treatment of athletes</header><subparagraph id="id8a43c2c4-3756-47df-b4d1-9a7060249d5a" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/2205">chapter 2205</external-xref> of title 36, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idac1e0cdc-3825-4efc-9b85-d88dc461e8d4" changed="not-changed"><section id="idde7316b0-ee47-4231-bd7f-c661caca521d" commented="no" display-inline="no-display-inline" section-type="subsequent-section" changed="not-changed"><enum>220530A.</enum><header display-inline="yes-display-inline">Annual report on equal treatment of athletes</header><subsection id="idB23CA19800B643BBACB62B8249142046" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not less frequently than annually, each national governing body shall submit to the corporation and Congress a report on the compliance of the national governing body with paragraphs (7) and (8) of section 220524(a). </text></subsection><subsection id="id3B1237ECD1344019A660DC455975F421" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Matters To be included</header><text display-inline="yes-display-inline">Each report required by subsection (a) shall include detailed information on the median, minimum, and maximum stipends and bonuses provided to athletes, disaggregated by gender, race, and, as applicable, status of participation on a professional sports team.</text></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph><subparagraph id="id6fb83253-5f26-4aa2-a296-ae37f48e25b9" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of sections for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/2205">chapter 2205</external-xref> of title 36, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0e4f823a-f23d-4a2f-b100-e09ea1f3d670" changed="not-changed"><toc changed="not-changed"><toc-entry bold="off" level="section" changed="not-changed">220530A. Annual report on equal treatment of athletes.</toc-entry></toc><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id55e88fb7796d4b9092219ad115663797" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Implementation period and reports to Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act—</text><paragraph id="id0a088c77b309473ba99648f05b83390b" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the corporation shall—</text><subparagraph id="id02083af4f1bf46729a9e4667ac6af5a4" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">attain full compliance, and require as a condition of continued certification that each national governing body attains and maintains full compliance, with the applicable amendments made by this Act; and</text></subparagraph><subparagraph id="ide809dbdaeb0843578efae8b568ff430b" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">submit to Congress a report describing such compliance of the corporation and each national governing body; and</text></subparagraph></paragraph><paragraph id="id4fb7e429a7fe4a7186453122a5257345" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">each national governing body shall—</text><subparagraph id="idefac38356cd94f579c0890c448639698" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">attain full compliance with the applicable amendments made by this Act; and</text></subparagraph><subparagraph id="idfb719ac206a24da0a9ae57734bf11daf" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">submit to Congress a report describing such compliance.</text></subparagraph></paragraph></subsection><subsection id="idF8AA7AF52C5042FDBD8B43449FBD7632" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed—</text><paragraph id="id7F7DA73908BA48DEB2C31595C0AF2AED" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">to supersede, nullify, or diminish the rights of any individual under any Federal law or the law of any State or political subdivision of any State or jurisdiction;</text></paragraph><paragraph id="id151026AF251146C1A2BFEEE33C609CBD" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">to prohibit an individual athlete or a group of athletes from receiving compensation from an individual or entity other than a national governing body or the corporation for the use of, as applicable, the name, image, or likeness of the individual athlete or the names, images, or likenesses of the group of athletes; or </text></paragraph><paragraph id="idE8CE0783AEBE4ED598834C7A7D657E9A" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">to prohibit a team or group of athletes from accepting outside sponsorships or endorsements, or from participating in outside promotional events or marketing campaigns, even if a team or group of athletes of another gender are not offered equivalent sponsorships, endorsements, or participation in outside promotional events or marketing campaigns. </text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
