which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Indian Child Protection and Family Violence Prevention Act to reauthorize programs under that Act, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6C69431616B343919517FD7C2EC64ED2"><section section-type="section-one" id="H46C0C6583DDF423D9EDD52BD8AFD8370"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American Child Protection Act of 2021</short-title></quote>.</text></section><section id="H87BDADAD601746A39E9CE22200CBEEC7"><enum>2.</enum><header>Indian Child Protection and Family Violence Prevention Act Amendments</header><subsection id="id6EE48C323D5A429985D9C36D42DA78FB"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 403 of the Indian Child Protection and Family Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3202">25 U.S.C. 3202</external-xref>) is amended—</text><paragraph id="idE3618DABFB1D4E4F905ECADEDA48FFE6"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1D692130542F41E3A917B4CF672DC6CA"><paragraph id="id3ECC64164F67495C88EB9063C4F4EA80"><enum>(3)</enum><text><term>child abuse</term> includes any case in which—</text><subparagraph id="id3E882F63D5AC485FB3C5638D1EB881B0"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id0DF8E7787C7B471F828091290D3C7E16"><enum>(i)</enum><text>a child is dead or exhibits evidence of skin bruising, bleeding, malnutrition, failure to thrive, burns, fracture of any bone, subdural hematoma, or soft tissue swelling; and</text></clause><clause id="idB084040428F44EF4A1B9DB9703CA711F" indent="up1"><enum>(ii)</enum><text>the applicable condition under clause (i) is not justifiably explained or may not be the product of an accidental occurrence; or</text></clause></subparagraph><subparagraph id="id2881B1FB3B3E48E69B0DC7D25F6EC486"><enum>(B)</enum><text>a child is subjected to sexual assault, sexual molestation, sexual exploitation, sexual contact, or prostitution;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id99A7A63F321546568B85B3A19CCB1B29"><enum>(2)</enum><text>by striking paragraph (10) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2F9B68C8303E48839B9DED21B415086A"><paragraph id="id7F93CE5552F040CBA6877C127B859BF2"><enum>(10)</enum><text><term>Indian tribe</term>, <term>Indian Tribe</term>, <term>tribal organization</term>, and <term>Tribal organization</term> have the meanings given those terms in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idE259B7A434754141A4F800832B7921BF" commented="no"><enum>(3)</enum><text>in paragraph (17), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="idC3C8ACDF75A44ED7AEB827F44B56F64B" commented="no"><enum>(4)</enum><text>in paragraph (18), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id9B380BA0267F463DB93E2860BECA1EA6" commented="no"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id14FC4023769B4D3EA067F7555CF3324C"><paragraph id="id1A91756200264384B29E859DF1EC03B1" commented="no"><enum>(19)</enum><text><term>urban Indian organization</term> has the meaning given the term in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>).</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4927A6AC18544F93B7C1F9C6CAFA61FF"><enum>(b)</enum><header>Indian child abuse treatment grant program</header><text>Section 409 of the Indian Child Protection and Family Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3208">25 U.S.C. 3208</external-xref>) is amended—</text><paragraph commented="no" id="H50C859344ABB4D3AB1F82DB6C3076FBD"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H491AFD940481491E9F81CBACDECAAE10"><enum>(A)</enum><text>by striking <quote>The Secretary of Health and Human Services, acting through the Service and</quote> and inserting <quote>The Service,</quote>;</text></subparagraph><subparagraph id="idD340D6D4D4C644EBAB00ABB7D2015A8A"><enum>(B)</enum><text>by striking <quote>intertribal</quote> and inserting <quote>inter-tribal</quote>; and</text></subparagraph><subparagraph id="H70850023D42442BF8529171EDBBC5221"><enum>(C)</enum><text>by striking <quote>sexual abuse</quote> and inserting <quote>abuse or child neglect</quote>;</text></subparagraph></paragraph><paragraph id="H80FB733B9A9143C380C74F1DC6806F3F"><enum>(2)</enum><text>by striking subsections (b) and (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9F812BB333F448AFB30EBAF18C716FF8"><subsection id="id0BFE324ABC504C4DBF5669E4B5F68F29"><enum>(b)</enum><header>Grant applications</header><paragraph id="idE44FDAD5E00F4F5DBA82230A49573F35"><enum>(1)</enum><header>In general</header><text>Any Indian Tribe or inter-tribal consortium, including an Indian Tribe or inter-tribal consortium in partnership with an urban Indian organization, may submit to the Service an application for a grant under subsection (a).</text></paragraph><paragraph id="id862294CD3C524D3BA9B0DE79AB2E1763"><enum>(2)</enum><header>Requirements</header><text>An application submitted under paragraph (1) shall—</text><subparagraph id="id1FE9B627141A42BA8A298295A4DFF76D"><enum>(A)</enum><text>be in such form as the Service may prescribe;</text></subparagraph><subparagraph id="id50F1349068194C31AE3A53C507CA8DE3"><enum>(B)</enum><text>be submitted to the Service on or before a date designated by the Service; and</text></subparagraph><subparagraph id="idFF92912D478D44EA9433CCB81BD298AE"><enum>(C)</enum><text>specify—</text><clause id="id2A2D6895766440CF99A2263F43A7F952"><enum>(i)</enum><text>the nature of the program proposed by the applicant;</text></clause><clause id="id83AA2F9195E34BE0A9BBB5CED16371D9"><enum>(ii)</enum><text>the data and information on which the program is based;</text></clause><clause id="id9E4183C74C8F4F819E31E07FC8021677"><enum>(iii)</enum><text>the extent to which the program plans to use or incorporate existing services available on a reservation; and</text></clause><clause id="id69397A2B6D134F3DA23B33A86CA03020"><enum>(iv)</enum><text>the specific treatment concepts to be used under the program.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H245177543CD74391BD1623494B717DC0"><enum>(c)</enum><header>Culturally appropriate treatment</header><text display-inline="yes-display-inline">In awarding grants under subsection (a), the Service shall encourage the use of culturally appropriate treatment services and programs that respond to the unique cultural values, customs, and traditions of the applicant Indian Tribes.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="id5882A824C74F4D24B969EF5994D1732A"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph commented="no" id="id4ED761C183F34757BEB9A5C613A8A10D"><enum>(A)</enum><text>by striking <quote>such Secretary</quote> each place it appears and inserting <quote>the Service</quote>;</text></subparagraph><subparagraph commented="no" id="idFD80505085044828AB35318A65AD2590"><enum>(B)</enum><text>by striking <quote>, and</quote> each place it appears and inserting <quote>; and</quote>;</text></subparagraph><subparagraph commented="no" id="id82232FB621854BC18F320AEB2BA00146"><enum>(C)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>Secretary of Health and Human Services</quote> and inserting <quote>Service</quote>; and</text></subparagraph><subparagraph commented="no" id="id3A495B9620DC4282B6C3A57F503F58AD"><enum>(D)</enum><text>in paragraph (2), by striking <quote>the Secretary</quote> and inserting <quote>the Service</quote>; and</text></subparagraph></paragraph><paragraph commented="no" id="id3E5B75B85E1F44EAA3CFA18AE9C39775"><enum>(4)</enum><text>by striking subsection (e) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id82BFEDD185FF4813BA1953B7B780DD60"><subsection commented="no" id="H163377D0A97248D99E164C41DF304148"><enum>(e)</enum><header>Report</header><paragraph commented="no" id="id8BD70D4B79AA449CA2260F875D1CD00F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the <short-title>Native American Child Protection Act of 2021</short-title>, the Service shall submit to Congress a report on grants awarded under subsection (a).</text></paragraph><paragraph commented="no" id="idE9466302F9D544CCBFB42B57D5B49DD1"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The report required under paragraph (1) shall include—</text><subparagraph commented="no" id="HB77DA15D2197470D88F8F2F295C1C71B"><enum>(A)</enum><text>a description of treatment and services for which recipients of grants awarded under this section have used the grant funds; and</text></subparagraph><subparagraph commented="no" id="HFA1F44B4588944B4B8626FB850E7558E"><enum>(B)</enum><text>any other information that the Service may require.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HF3DB9A2D8D504989936C5095AC2ACA7D"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $30,000,000 for each of fiscal years 2022 through 2027.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="id91F1105AC1A94A2A9809B86418BC067A"><enum>(c)</enum><header>National Indian Child Resource and Family Services Center</header><text>Section 410 of the Indian Child Protection and Family Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3209">25 U.S.C. 3209</external-xref>) is amended—</text><paragraph id="H257162F3FD2543ED922625712CBD5102"><enum>(1)</enum><text>in the section heading—</text><subparagraph id="H1853DD8F075E4DC0AB65B36EBBFBAB3B"><enum>(A)</enum><text>by inserting <quote><header-in-text level="section" style="OLC">National</header-in-text></quote> before <quote><header-in-text level="section" style="OLC">Indian</header-in-text></quote>; and</text></subparagraph><subparagraph id="H4DCAF46CFC144892A750EB3FDB69FFC2"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="section" style="OLC">Centers</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Center</header-in-text></quote>;</text></subparagraph></paragraph><paragraph id="H61FDC556B9BA4DB49EE11B0DE4784F14"><enum>(2)</enum><text>by striking subsections (a) and (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3B21BA9FE80B4B208AA88F07EDA43807"><subsection id="HAC3141A1D8D84C889326C519B983C859"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Native American Child Protection Act of 2021</short-title>, the Secretary shall establish a center, to be known as the <quote>National Indian Child Resource and Family Services Center</quote> (referred to in this section as the <quote>Center</quote>).</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id4390EDA05BF846F29AD809886C96168A"><enum>(3)</enum><text>by redesignating subsections (c) through (e) as subsections (b) through (d), respectively; </text></paragraph><paragraph id="HEF6FC39FE1BE467B810E2D2C8A059D6E"><enum>(4)</enum><text>in subsection (b) (as so redesignated), by striking <quote>Each Center</quote> and all that follows through <quote>multidisciplinary team</quote> and inserting <quote>The Center shall be staffed by a team</quote>;</text></paragraph><paragraph id="H5542E466EE8541E9B170C297D93770A7"><enum>(5)</enum><text>in subsection (c) (as so redesignated)—</text><subparagraph id="HD36DC5E624B54FE9B5AC5CEA6E5BA790"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>Each Center established under subsection (a)</quote> and inserting <quote>The Center</quote>;</text></subparagraph><subparagraph id="HBB377E2B6E4042FBACD36D2972E7FE30"><enum>(B)</enum><text>in paragraph (1), by striking <quote>and inter-tribal consortia upon request</quote> and inserting <quote>inter-tribal consortia, and urban Indian organizations on request</quote>;</text></subparagraph><subparagraph id="H79D04D00B9954816BE4D05F09AA26714"><enum>(C)</enum><text>in paragraph (2), by striking <quote>Indian tribes, tribal organizations, the Bureau and the Service</quote> and inserting <quote>Indian Tribes, Tribal organizations, urban Indian organizations, the Bureau, and the Service</quote>;</text></subparagraph><subparagraph id="H914AF8F90AF446D1A376493D6A96AC57"><enum>(D)</enum><text>in paragraph (3)—</text><clause id="H145E119CB0DF41C98859CF01C3CBC96E"><enum>(i)</enum><text>by inserting <quote>and technical assistance</quote> after <quote>training materials</quote>; and</text></clause><clause id="H75464630AB014C7883DD941054358CB7"><enum>(ii)</enum><text>by striking <quote>and to tribal organizations</quote> and inserting <quote>, Tribal organizations, and urban Indian organizations</quote>;</text></clause></subparagraph><subparagraph id="H0A9B0EEFB2794290A216C5E7CD2E8F94"><enum>(E)</enum><text display-inline="yes-display-inline">in paragraph (4)—</text><clause id="idB89D1AF7DF084088B438571A9780CD00"><enum>(i)</enum><text>by inserting <quote>, State,</quote> after <quote>Federal</quote>; and</text></clause><clause id="idFEA9DE7DBB2247AFB932F260B91B5C19" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>by inserting <quote>and personnel of urban Indian organizations</quote> after <quote>tribal personnel</quote>; and</text></clause></subparagraph><subparagraph id="H219ECB0AF44046E19BC56BE6F4E20C60"><enum>(F)</enum><text>by striking paragraph (5) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFEB4B3CE41994505A6DC11E79825D17C"><paragraph id="H67ADFDA9A0C547C084D060C23658160A"><enum>(5)</enum><text display-inline="yes-display-inline">develop model intergovernmental agreements between Indian Tribes and States and other materials that provide examples of how Federal, State, and Tribal governments can develop effective relationships and provide for maximum cooperation in the furtherance of the prevention, investigation, treatment, and prosecution of incidents of family violence, child abuse, and child neglect involving Indian children and Indian families.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB2F6FAD0F2BD4D11AAE2AB4300F304E5"><enum>(6)</enum><text>in subsection (d) (as so redesignated)—</text><subparagraph id="H95C17FD720C24E2A9D4622BAA988927E"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Multidisciplinary</header-in-text></quote>;</text></subparagraph><subparagraph id="id7BAE83BFD5C3456C8700680992A9C1F9"><enum>(B)</enum><text>in the matter preceding paragraph (1), by striking <quote>Each multidisciplinary</quote> and all that follows through <quote>personnel</quote> and inserting <quote>The team required under subsection (b) shall include personnel</quote>; and</text></subparagraph><subparagraph id="id67D90D07A3CB4CABA995BCB0677D8427"><enum>(C)</enum><text>in paragraphs (1) through (3), by striking the comma each place it appears and inserting a semicolon; and</text></subparagraph></paragraph><paragraph id="HBF3C90B5936A43C7963BD68500CFD901"><enum>(7)</enum><text>by striking subsections (f) through (h) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H153BA7513886425AAA309BD29A5D9CAF"><subsection id="HB8EFFAE4946D441B9126412736767EB5"><enum>(e)</enum><header>Center advisory board</header><paragraph id="idE42BAFD10975410082AF87409C2A439C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish an advisory board to advise and assist the Center in carrying out the activities of the Center under this section (referred to in this subsection as the <quote>advisory board</quote>).</text></paragraph><paragraph id="idF4783A03BA62429B92DBEC1E86EC6EA4"><enum>(2)</enum><header>Membership</header><subparagraph id="idA1CEA9537D2547E3AB02A7F39B4C2F94"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The advisory board shall consist of 12 members appointed by the Secretary from Indian Tribes, Tribal organizations, and urban Indian organizations.</text></subparagraph><subparagraph id="idE04CB805632C4900A5FF4BE9A4AEDBD9"><enum>(B)</enum><header>Requirement</header><text>Each member of the advisory board shall have expertise in child abuse or child neglect. </text></subparagraph><subparagraph id="id46B490474C5F41BC98A66F88CFEEE36F"><enum>(C)</enum><header>No compensation</header><text display-inline="yes-display-inline">A member of the advisory board shall serve without compensation, but may be reimbursed for travel and other expenses while carrying out the duties of the advisory board. </text></subparagraph></paragraph><paragraph id="idA82E0615CC3E4E0B9C4A005102F741DD"><enum>(3)</enum><header>Duties</header><text display-inline="yes-display-inline">The advisory board shall assist the Center with—</text><subparagraph id="id457C6159578F4E1EA44AA796F65B5FA1"><enum>(A)</enum><text display-inline="yes-display-inline">coordinating programs of the Center;</text></subparagraph><subparagraph id="id46302890C76844AAAE35CA480DFD1240"><enum>(B)</enum><text display-inline="yes-display-inline">identifying training and technical assistance materials that may be of use to the Center; and </text></subparagraph><subparagraph id="id65A42FCAE8B94CA4B94AABE1E24C861E"><enum>(C)</enum><text display-inline="yes-display-inline">developing intergovernmental agreements relating to family violence, child abuse, and child neglect.</text></subparagraph></paragraph></subsection><subsection id="H6A9D2BCC02FC4FDF922A2F76883602E2"><enum>(f)</enum><header>Application of Indian Self-Determination and Education Assistance Act to the Center</header><paragraph id="id6A31C33675274471A1288862F22974E2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Center shall be subject to title I of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5321">25 U.S.C. 5321 et seq.</external-xref>).</text></paragraph><paragraph id="id0147933C82A34F0181572E168E9BBC51"><enum>(2)</enum><header>Operation of Center</header><text display-inline="yes-display-inline">The Secretary may enter into a contract under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>) for the operation of the Center with a nonprofit Indian organization governed by an Indian-controlled board of directors that has substantial experience in child abuse, child neglect, and family violence involving Indian children and Indian families.</text></paragraph></subsection><subsection id="id0DA1359CEA9A4706824AA2315AAF06F9"><enum>(g)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of the <short-title>Native American Child Protection Act of 2021</short-title>, the Secretary, acting through the Director of the Bureau, shall submit to Congress a report on the status of the Center.</text></subsection><subsection id="H28D2AB7AACCA496D883391718BAB642E"><enum>(h)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $3,000,000 for each of fiscal years 2022 through 2027.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idA1944B54A1FE47219C18480A88102CAA"><enum>(d)</enum><header>Indian child protection and family violence prevention program</header><text>Section 411 of the Indian Child Protection and Family Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3210">25 U.S.C. 3210</external-xref>) is amended—</text><paragraph id="H3A1C2A0183994927BF21F052D54434EB"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="H98C7382207E54D318BF694B45B80597B"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H8F15A8FBCFC947F98BDC72AA1C5F292F"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>child abuse and child neglect,</quote> and inserting <quote>child abuse, child neglect, or both;</quote>;</text></clause><clause id="HEF26AB1DED8C486FA940B9D2978C9A51"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>, and</quote> at the end and inserting a semicolon; and</text></clause><clause id="H081337FA5295420B9C10FFCE54C92406"><enum>(iii)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE96BC3A233C4439BAA2E0AA96413B2B7"><subparagraph id="HBDD6302B80484B4EBE09CB622E0FD873"><enum>(D)</enum><text display-inline="yes-display-inline">the development of agreements between Indian Tribes, States, or private agencies for the coordination of child abuse and child neglect prevention, investigation, and treatment services;</text></subparagraph><subparagraph id="H2889C03350A84798A358511E68613D44"><enum>(E)</enum><text>child protective services operational costs, including transportation, risk and protective factors assessments, family engagement and kinship navigator services, and relative searches, criminal background checks for prospective placements, and home studies; and </text></subclause></clause></subparagraph><subparagraph id="idB8FEDCEBA1A440BEA917055B9406E767"><enum>(E)</enum><text>in paragraph (7)—</text><clause id="id9f0c4aa1e1d84e4a9538fdf784595e92"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>that show promise of successfully preventing and treating cases of family violence, child abuse, and child neglect</quote> before <quote>as the Secretary</quote>; staffing requirements</header><subparagraph id="id397D3740B57744AFB2462602C99EF061"><enum>(A)</enum><header>In general</header><text>In the development of regulations for base support funding for the programs described in paragraph (1), the Secretary, in consultation with Indian Tribes, shall develop, not later than 1 year after the date of enactment of the <short-title>Native American Child Protection Act of 2021</short-title>, appropriate caseload standards and staffing requirements.</text></subparagraph><subparagraph id="id48428407157D418FB2EF5C3BE174A16D"><enum>(B)</enum><header>Staffing requirements</header><text>Each level of funding assistance shall correspond to the staffing requirements established by the Secretary under subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id862DD9182C0E4391B7EF8D5E7C03E62E"><enum>(C)</enum><text>in paragraph (3)—</text><clause id="id54C51F36F599450B83085F1675EAFB53"><enum>(i)</enum><text>by striking <quote>(3) Factors to be</quote> and all that follows through <quote>limited to—</quote> in the matter preceding subparagraph (A) and inserting the following:</text><quoted-block id="id11EE323AD4944D2EB32F8983C0A44E70" style="OLC" act-name=""><paragraph id="idADCE15A67ED144F4B192F2C1D3E838B1"><enum>(3)</enum><header>Factors</header><text>In the development of the base support funding formula under paragraph (1), the Secretary shall take into consideration factors including—</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="id0762BE5AC10E4B429E692E0A56358C6F"><enum>(ii)</enum><text>by indenting subparagraphs (A) through (D) appropriately; and</text></clause><clause id="idA99B51836277430A80F75FCC07A6F84D"><enum>(iii)</enum><text>in subparagraph (D), by striking <quote>sexual abuse</quote> and inserting <quote>abuse and child neglect, high incidence of family violence,</quote>;</text></clause></subparagraph><subparagraph id="id3876EDCC7A734A5D8BE72AC5A4FE3D38"><enum>(D)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9069960262F44E21A7B56F78D8FD796C"><paragraph id="idDF8A8F047CCC40A782B7ABD307BAD7DD"><enum>(4)</enum><header>Requirement</header><text>The formula established pursuant to this subsection shall provide funding necessary to support not less than 1 child protective services or family violence caseworker, including fringe benefits and support costs, for each Indian Tribe.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idC74EB7F8B34647D3B08D15B51FEEA869"><enum>(E)</enum><text>in paragraph (5)—</text><clause id="idBEF05B10F41A4C119E8675135E41CC61"><enum>(i)</enum><text>by striking <quote>(5) In any</quote> and inserting the following:</text><quoted-block id="idF207E814A43245FEB6CC372F25DA5C4E" style="OLC" act-name=""><paragraph id="idC116F8D0F28F43FD9B03308712C71EB0"><enum>(5)</enum><header>Insufficient funding</header><text>In any</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idC378F1DD098941ECA2595D07EFD81CD3"><enum>(ii)</enum><text>by striking <quote>tribes</quote> and inserting <quote>Indian Tribes</quote>;</text></clause></subparagraph></paragraph><paragraph id="id025A98F3DCD1498EA595E1810493CF94"><enum>(5)</enum><text>by inserting after subsection (e) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFFF5723DBCB74E4D9F410B897DDA8827"><subsection id="HB5A8671EC0D74A1CA5983A50802F9B3E"><enum>(f)</enum><header>Report</header><paragraph id="id7B6E14AA170149DDB197F6E63E89C372"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the <short-title>Native American Child Protection Act of 2021</short-title>, the Secretary, acting through the Bureau, shall submit to Congress a report on the use of funds provided pursuant to this section.</text></paragraph><paragraph id="id45A3D52125C248A68373171889BF3EA8"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The report required under paragraph (1) shall include—</text><subparagraph id="H176A63C70055478FA75D6150A36B5C41"><enum>(A)</enum><text>a description of the treatments and services for which recipients of the grants have used the funds; and</text></subparagraph><subparagraph id="H9422371AD3AE4EBF85083BC7C1860B61"><enum>(B)</enum><text>any other information that the Secretary, acting through the Bureau, may require.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8438865482654023B88FD2CAB15619A8"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8D9CC278FB7A4C9F81A111EF71A181B8"><subsection id="HA855E1EE3AA742CF9E14C82710A8C8A3"><enum>(h)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $60,000,000 for each of fiscal years 2022 through 2027.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ida74a6de48a994bbbb6a6cc1b63ee2dff"><enum>(e)</enum><header>Technical and conforming amendments</header><paragraph id="id831048dc1f984d6486ed4b331f5b8cb6"><enum>(1)</enum><text>Section 404(c)(2)(A) of the Indian Child Protection and Family Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3203">25 U.S.C. 3203(c)(2)(A)</external-xref>) is amended by striking <quote>abuse described in section 503(3)</quote> and inserting <quote>child abuse</quote>.</text></paragraph><paragraph id="ida0545bb863eb477da717ee4ef2e1683e"><enum>(2)</enum><text>Section 407(c) of the Indian Child Protection and Family Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3206">25 U.S.C. 3206(c)</external-xref>) is amended—</text><subparagraph id="id538cf24da6384e93826576a6d7341aa3"><enum>(A)</enum><text>by striking <quote>advise</quote> and inserting <quote>advice</quote>; and</text></subparagraph><subparagraph id="idb4a1707d00ec43ce9872d6211f52e1d6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>by striking <quote>a multidisciplinary team established pursuant to section 410</quote> and inserting <quote>the team described in section 410(b)</quote>.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
