<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2322</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210713">July 13, 2021</action-date><action-desc><sponsor name-id="S287">Mr. Cornyn</sponsor> (for himself, <cosponsor name-id="S306">Mr. Menendez</cosponsor>, <cosponsor name-id="S277">Mr. Carper</cosponsor>, and <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a pilot program on the participation of non-asset-based third-party logistics providers in the Customs-Trade Partnership Against Terrorism.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Customs-Trade Partnership Against Terrorism Pilot Program Act of 2021</short-title></quote> or the <quote><short-title>CTPAT Pilot Program Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="id8F36D9DC4D2A44B0AD9099934B00E8F3"><enum>2.</enum><header>Pilot program on participation of non-asset-based third-party logistics providers in Customs-Trade Partnership Against Terrorism</header><subsection id="idb86689c4fff24761943e5268a780e91a"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Homeland Security shall issue a final rule to carry out a pilot program to assess whether allowing entities described in subsection (b) to participate in the Customs-Trade Partnership Against Terrorism under subtitle B of title I of the SAFE Port Act (<external-xref legal-doc="usc" parsable-cite="usc/6/961">6 U.S.C. 961 et seq.</external-xref>) would enhance port security, combat terrorism, prevent supply chain security breaches, or otherwise meet the goals of the Customs-Trade Partnership Against Terrorism.</text></subsection><subsection id="idBC42C4E4FAEA4B44A694B970AC38E4E2"><enum>(b)</enum><header>Entities described</header><text>An entity described in this subsection is a non-asset-based third-party logistics provider that—</text><paragraph id="id3D78F6C06CB242AEA6A26DF803D5DBDE"><enum>(1)</enum><text>arranges international transportation of freight and is licensed by the Department of Transportation; and</text></paragraph><paragraph id="id8FB480811EB3444882C5681316ECD174"><enum>(2)</enum><text>meets such other requirements as the Secretary establishes in the rule required by subsection (a).</text></paragraph></subsection><subsection id="idf3d3954c0a9c45e68977cae86082eeb7"><enum>(c)</enum><header>Requirements</header><text>In carrying out the pilot program required by subsection (a), the Secretary shall—</text><paragraph id="idEEC2531D72AC4B9DA1A9DD51F7F244F0"><enum>(1)</enum><text>ensure that not more than 10 entities described in subsection (b) participate in the pilot program;</text></paragraph><paragraph id="id594058AA147B42F3A458C273E870B54F"><enum>(2)</enum><text>provide for the participation of those entities on a voluntary basis; </text></paragraph><paragraph id="id9b335429fc3041d7bc0df203c0d25d9e"><enum>(3)</enum><text>continue the program for a period of not less than one year after the date on which the Secretary issues the final rule required by subsection (a); and</text></paragraph><paragraph id="id33AE9D16CABC4F9AAA0F3C043FD193C8"><enum>(4)</enum><text>terminate the pilot program not more than 5 years after that date. </text></paragraph></subsection><subsection id="id50010db91f26425abb7a2e8b2680707d"><enum>(d)</enum><header>Report required</header><text>Not later than 180 days after the termination of the pilot program under subsection (c)(4), the Secretary shall submit to Congress a report on the findings of, and any recommendations arising from, the pilot program concerning the participation in the Customs-Trade Partnership Against Terrorism of entities described in subsection (b). </text></subsection></section></legis-body></bill>
