<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 2322</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To require a pilot program on the participation of non-asset-based third-party logistics providers in the Customs-Trade Partnership Against Terrorism.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="id6d2e51e3-9054-43f2-aa67-c6994ee87805" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Customs Trade Partnership Against Terrorism Pilot Program Act of 2021</short-title></quote> or the <quote><short-title>CTPAT Pilot Program Act of 2021</short-title></quote>.</text></section><section id="id0262A8927F9C48978F7144A2F6F316C8" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph display-inline="no-display-inline" commented="no" id="idB06B0652EB1341D588EAAAE5BEBC89FC" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text><subparagraph display-inline="no-display-inline" commented="no" id="id3C3971ED66AE4504990AA11134968F5B" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs and the Committee on Finance of the Senate; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id712335A202F141FD9D16C67E0460EC79" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and the Committee on Ways and Means of the House of Representatives. </text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idE591A9255A1047379D519A45D14ABECE" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">CTPAT</header><text display-inline="yes-display-inline">The term <term>CTPAT</term> means the Customs Trade Partnership Against Terrorism established under subtitle B of title II of the Security and Accountability for Every Port Act (<external-xref legal-doc="usc" parsable-cite="usc/6/961">6 U.S.C. 961 et seq.</external-xref>).</text></paragraph></section><section section-type="subsequent-section" id="ida6c3c467-c378-4885-9ad9-74e1090364f1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>3.</enum><header display-inline="yes-display-inline">Pilot program on participation of third-party logistics providers in CTPAT</header><subsection id="id97A158216CB74639A8EBDF5F3018EFB8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph id="id282d9efc-681b-42eb-9f60-24376bbaf744" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall carry out a pilot program to assess whether allowing entities described in subsection (b) to participate in CTPAT would enhance port security, combat terrorism, prevent supply chain security breaches, or otherwise meet the goals of CTPAT.</text></paragraph><paragraph id="idE50F2E7770834EEE8EDCA7CDA7E0F9AC" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Federal Register notice</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary shall publish in the Federal Register a notice specifying the requirements for the pilot program required by paragraph (1).</text></paragraph></subsection><subsection id="idc1947055-f9d1-41c6-98fe-304c6f8c1e71" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Entities described</header><text display-inline="yes-display-inline">An entity described in this subsection is—</text><paragraph id="id708A9C8328384BD29D0D5BA9CEB2EC5E" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">a non-asset-based third-party logistics provider that—</text><subparagraph id="id4b9f1ed1-c0f6-4540-837b-046897dd75ff" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">arranges international transportation of freight and is licensed by the Department of Transportation; and</text></subparagraph><subparagraph id="id4db34aa9-b6e6-49d1-81ee-3ca37d7b6d07" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">meets such other requirements as the Secretary specifies in the Federal Register notice required by subsection (a)(2); or</text></subparagraph></paragraph><paragraph id="idE1CE0542B6584953B22DD8123743B936" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">an asset-based third-party logistics provider that—</text><subparagraph id="id381d0c5c9b0641a698b93f89d4c46368" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">facilitates cross border activity and is licensed or bonded by the Federal Maritime Commission, the Transportation Security Administration, U.S. Customs and Border Protection, or the Department of Transportation;</text></subparagraph><subparagraph id="idf16b2f4a4a31444aa4fbf5d9c9eae7a3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">manages and executes logistics services using its own warehousing assets and resources on behalf of its customers; and</text></subparagraph><subparagraph id="id68A647FC966E43D98BC660761646FDB2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">meets such other requirements as the Secretary specifies in the Federal Register notice required by subsection (a)(2).</text></subparagraph></paragraph></subsection><subsection id="id5bf25e40-ddc2-417b-92cb-efff92ac4a52" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In carrying out the pilot program required by subsection (a)(1), the Secretary shall—</text><paragraph id="id7b914380-a3e5-406b-ab07-ed3d84f096b1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that—</text><subparagraph id="idE7794B7276F948EBBD4B5536ED9579C8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">not more than 10 entities described in paragraph (1) of subsection (b) participate in the pilot program; and</text></subparagraph><subparagraph id="idB36672FF29AA4D5495BB4CE9EC2B3A74" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">not more than 10 entities described in paragraph (2) of that subsection participate in the program;</text></subparagraph></paragraph><paragraph id="id99cdd4c2-0a33-4c82-a5bf-6a19d683d98b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">provide for the participation of those entities on a voluntary basis; </text></paragraph><paragraph id="id26108261-77ab-4c7e-9d62-c5686368cbc6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">continue the program for a period of not less than one year after the date on which the Secretary publishes the Federal Register notice required by subsection (a)(2); and</text></paragraph><paragraph id="id3592bb62-c902-4656-a6c0-77b2ea54f512" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">terminate the pilot program not more than 5 years after that date. </text></paragraph></subsection><subsection id="idf561786e-2fa8-4ac7-afca-4134402dc103" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Report required</header><text display-inline="yes-display-inline">Not later than 180 days after the termination of the pilot program under subsection (c)(4), the Secretary shall submit to the appropriate congressional committees a report on the findings of, and any recommendations arising from, the pilot program concerning the participation in CTPAT of entities described in subsection (b), including an assessment of participation by those entities. </text></subsection></section><section id="id6554f51525c34072bed18eaf9f3036c7" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Report on effectiveness of CTPAT</header><subsection id="idf32ead6dce16480da43527b28d0ce3f8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the appropriate congressional committees a report assessing the effectiveness of CTPAT.</text></subsection><subsection id="idca07afac8eb94c9eb1c36a4d06b505f2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The report required by subsection (a) shall include the following:</text><paragraph id="id2f4bd3d12a1b422797da8d4a19c33153" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">An analysis of—</text><subparagraph id="id75B048A93D1642238B7F689ED37B121E" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">security incidents in the cargo supply chain during the 5-year period preceding submission of the report that involved criminal activity, including drug trafficking, human smuggling, commercial fraud, or terrorist activity; and </text></subparagraph><subparagraph id="id594D7EDDC6924F28B5D1313FF4828F18" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">whether those incidents involved participants in CTPAT or entities not participating in CTPAT.</text></subparagraph></paragraph><paragraph id="id2e025158dd2e4e6cad02597147fdb320" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">An analysis of causes for the suspension or removal of entities from participating in CTPAT as a result of security incidents during that 5-year period.</text></paragraph><paragraph id="idb58d1e7dc6d24e83a8923097d14e31e6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">An analysis of the number of active CTPAT participants involved in one or more security incidents while maintaining their status as participants.</text></paragraph><paragraph id="id6c7b75d501b549898403f62a34ed7c46" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">Recommendations to the Commissioner of U.S. Customs and Border Protection for improvements to CTPAT to improve prevention of security incidents in the cargo supply chain involving participants in CTPAT. </text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20220526" chamber="Senate">Passed the Senate May 26, 2022.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
