<congress display="yes">117th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 231</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To direct the Administrator of the Federal Emergency Management Agency to develop guidance for firefighters and other emergency response personnel on best practices to protect them from exposure to PFAS and to limit and prevent the release of PFAS into the environment, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="idba446341-7fc4-4c88-bc5f-6de4b33b79b8" changed="not-changed"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Firefighters from Adverse Substances Act </short-title></quote> or the <quote><short-title>PFAS Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id919f3cb5-4124-4ce7-9091-231fe722a42f" changed="not-changed"><enum>2.</enum><header display-inline="yes-display-inline">Guidance on how to prevent exposure to and release of PFAS</header><subsection commented="no" display-inline="no-display-inline" id="idac3dbd84-be95-4992-b6ea-1c71c7228a56" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Homeland Security, in consultation with the Administrator of the United States Fire Administration, the Administrator of the Environmental Protection Agency, the Director of the National Institute for Occupational Safety and Health, and the heads of any other relevant agencies, shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id2d47bf92-fe35-4dff-b2d0-d0e508d1bce9" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">develop and publish guidance for firefighters and other emergency response personnel on training, education programs, and best practices; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" changed="not-changed" id="idB92ABF6723104E0A8438306D2FDC0FCA"><enum>(2)</enum><text display-inline="yes-display-inline">make available a curriculum designed to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd7b8b0e0-3837-4f7a-9863-994918ee0bc1" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">reduce and eliminate exposure to per- and polyfluoroalkyl substances (commonly referred to as <quote>PFAS</quote>) from firefighting foam and personal protective equipment; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2e6c0b65-7d2e-4489-ba2e-3784b9b268f8" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">prevent the release of PFAS from firefighting foam into the environment; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3d2f402b-21c4-480d-91dd-44c916e4af35" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">educate firefighters and other emergency response personnel on foams and non-foam alternatives, personal protective equipment, and other firefighting tools and equipment that do not contain PFAS; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4a1a96c6-a004-4a5c-b973-d3723d391fc2" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">create an online public repository, which shall be updated on a regular basis, on tools and best practices for firefighters and other emergency response personnel to reduce, limit, and prevent the release of and exposure to PFAS.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf2fc9eaf-fbec-45aa-9728-57bd3d13178a" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Curriculum</header><paragraph commented="no" display-inline="no-display-inline" changed="not-changed" id="id2BD7D10982E34CDAAE1D2FBCA9D0CB9E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For the purpose of developing the curriculum required under subsection (a)(2), the Administrator of the United States Fire Administration shall make recommendations to the Secretary of Homeland Security as to the content of the curriculum.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" changed="not-changed" id="idE0A560086AB34B48AB5F458D415EC522"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">For the purpose of making recommendations under paragraph (1), the Administrator of the United States Fire Administration shall consult with interested entities, as appropriate, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id38b7bb44-2a66-4b05-ad14-7a067983bd65" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">firefighters and other emergency response personnel, including national fire service and emergency response organizations;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide2080805-84c4-4ad5-b797-60720afd8c3a" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">impacted communities dealing with PFAS contamination;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc319db9f-2bb9-4ac8-ba1a-74f77efb4fce" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">scientists, including public and occupational health and safety experts, who are studying PFAS and PFAS alternatives in firefighting foam;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b0b58f5-045d-4b08-899e-d6cdb0e9d741" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">voluntary standards organizations engaged in developing standards for firefighter and firefighting equipment;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idffbf9ed1-5323-4915-9ee9-0c63d35973b6" changed="not-changed"><enum>(E)</enum><text display-inline="yes-display-inline">State fire training academies;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ided706e3c-b4e9-476f-98ac-67f5038136a5" changed="not-changed"><enum>(F)</enum><text display-inline="yes-display-inline">State fire marshals;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4586900c-8eee-467b-b0a0-242ebb8181de" changed="not-changed"><enum>(G)</enum><text display-inline="yes-display-inline">manufacturers of firefighting tools and equipment; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11142801-e686-4a44-a265-1198c44941c2" changed="not-changed"><enum>(H)</enum><text display-inline="yes-display-inline">any other relevant entities, as determined by the Secretary of Homeland Security and the Administrator of the United States Fire Administration.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9770f77a-cbff-4b7b-906f-c1f2865a245a" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which the guidance and curriculum required under subsection (a) is issued, and not less frequently than once every 3 years thereafter, the Secretary of Homeland Security, in consultation with the Administrator of the United States Fire Administration, the Administrator of the Environmental Protection Agency, and the Director of the National Institute for Occupational Safety and Health, shall review the guidance and curriculum and, as appropriate, issue updates to the guidance and curriculum.</text></subsection><subsection id="id6bf3b00f-8fdd-4506-919d-85dd80f03c93" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Applicability of FACA</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to this Act.</text></subsection><subsection display-inline="no-display-inline" changed="not-changed" commented="no" id="id58F35BCC4D114DC5BA92F68270B07F12"><enum>(e)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to require the Secretary of Homeland Security to promulgate or enforce regulations under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>). </text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20210729" chamber="Senate">Passed the Senate July 29, 2021.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
