Public Utility Regulatory Policies Act of 1978 to require the consideration of a standard for promoting the use of demand-response technology and practices, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Demand-Response Management Act of 2021</short-title></quote>.</text></section><section id="id54B5ACFFCEE846E798538E443107E931"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to promote the use of demand-response technology and practices that support grid resiliency and reliability during extreme weather events.</text></section><section id="id204AC46393E444D696FB66CDD7BCD108"><enum>3.</enum><header>Promotion of demand-response practices</header><subsection id="H34A3D300DF9F4216A1941BF86FDEE2D9"><enum>(a)</enum><header>Consideration of demand-Response standard</header><paragraph id="HC27BAA9EE435463D961F9F218E9A4045"><enum>(1)</enum><header>In general</header><text>Section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HF0A0528756DA4FC3A207316F1B7843F0" style="OLC"><paragraph id="HFA8CE19786504C75A3C5866CDFB50E03"><enum>(20)</enum><header>Demand-response practices</header><subparagraph id="id363DEB2DAC9943BABA3FE903423BF3D1"><enum>(A)</enum><header>In general</header><text>Each electric utility shall promote the use of demand-response practices by commercial, residential, and industrial consumers to reduce electricity consumption during periods of unusually high demand.</text></subparagraph><subparagraph id="idB90A9337CB1841B3B114E4FC76023723"><enum>(B)</enum><header>Rate recovery</header><clause id="idA4A9B21025A247CB92724FC8ECD4B36C"><enum>(i)</enum><header>In general</header><text>Each State regulatory authority shall consider establishing rate mechanisms allowing an electric utility with respect to which the State regulatory authority has ratemaking authority to timely recover the costs of promoting demand-response practices in accordance with subparagraph (A).</text></clause><clause id="id336E7E0FED5E4E58887AC0B3425A598C" commented="no"><enum>(ii)</enum><header>Nonregulated electric utilities</header><text>A nonregulated electric utility may establish rate mechanisms for the timely recovery of the costs of promoting demand-response practices in accordance with subparagraph (A).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H501D8BFCEF334C22AC4F235FB1C32B6B" commented="no"><enum>(2)</enum><header>Compliance</header><subparagraph id="H08BF7DBE9979441A9DED6EDBFFFC24B8" commented="no"><enum>(A)</enum><header>Time limitations</header><text>Section 112(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H3DB67F02603946A5B51416974D1F36FA" style="OLC"><paragraph id="H326048E1539547A481D8BA6D83BD809F" commented="no"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5AF83CCB76D44D8AB7DD96DF2500B542"><enum>(A)</enum><text>Not later than 1 year after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority) and each nonregulated electric utility shall commence consideration under section 111, or set a hearing date for consideration, with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph><subparagraph id="H06D5360ADA2B4C8F8C32774524C106E8" indent="up1" commented="no"><enum>(B)</enum><text>Not later than 2 years after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority), and each nonregulated electric utility shall complete the consideration and make the determination under section 111 with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="H2BC47AA3FFD14CF8B0B64C9717713408" commented="no"><enum>(B)</enum><header>Failure to comply</header><clause id="H8C08753F47A340F294CA62BB5A177FBE" commented="no"><enum>(i)</enum><header>In general</header><text>Section 112(c) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(c)</external-xref>) is amended—</text><subclause id="HED9A39A04B244CBABDB64B38656D0C36" commented="no"><enum>(I)</enum><text>by striking <quote>such paragraph (14)</quote> and all that follows through <quote>paragraphs (16)</quote> and inserting <quote>such paragraph (14). In the case of the standard established by paragraph (15) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (15). In the case of the standards established by paragraphs (16)</quote>; and</text></subclause><subclause id="HFB3749E754A3424187104ACBF046C0E8" commented="no"><enum>(II)</enum><text>by adding at the end the following: <quote>In the case of the standard established by paragraph (20) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (20).</quote>.</text></subclause></clause><clause id="HE9D8FE72BCB6403F993B4C5F1C9BBED7" commented="no"><enum>(ii)</enum><header>Technical correction</header><text>Paragraph (2) of section 1254(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 971) is repealed and the amendment made by that paragraph (as in effect on the day before the date of enactment of this Act) is void, and section 112(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(d)</external-xref>) shall be in effect as if that amendment had not been enacted.</text></clause></subparagraph><subparagraph id="HD49F6587244843ADB2C328AF3562611D" commented="no"><enum>(C)</enum><header>Prior State actions</header><clause id="HA88709842DDA457D9726DE56453B91E9" commented="no"><enum>(i)</enum><header>In general</header><text>Section 112 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H168974EC0AB844D9BB2C69BE9EE218C4" style="OLC"><subsection id="H9A6DAE2C440945E2A8392E88BF268C88" commented="no"><enum>(g)</enum><header>Prior State actions</header><text>Subsections (b) and (c) shall not apply to the standard established by paragraph (20) of section 111(d) in the case of any electric utility in a State if, before the date of enactment of this subsection—</text><paragraph id="H14D04F9258834D4296359B5A0D981801" commented="no"><enum>(1)</enum><text>the State has implemented for the electric utility the standard (or a comparable standard);</text></paragraph><paragraph id="H77856BAA17E24D118EF3E997E1921A09" commented="no"><enum>(2)</enum><text>the State regulatory authority for the State or the relevant nonregulated electric utility has conducted a proceeding to consider implementation of the standard (or a comparable standard) for the electric utility; or</text></paragraph><paragraph id="HA5613928D96F4955A9B888168D4AD235" commented="no"><enum>(3)</enum><text>the State legislature has voted on the implementation of the standard (or a comparable standard) for the electric utility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></clause><clause id="H5468CF1C50A640FCB5DF1B2A3917C8EE" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header>Cross-reference</header><text>Section 124 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2634">16 U.S.C. 2634</external-xref>) is amended—</text><subclause display-inline="no-display-inline" commented="no" id="idCFC9DA7C0F7E4A1AB619ED9F0588A0A4"><enum>(I)</enum><text>by striking <quote>this subsection</quote> each place it appears and inserting <quote>this section</quote>; and</text></subclause><subclause id="id63E3AF28E06D471E9B17D9CD0E4F1D55" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>by adding at the end the following: <quote>In the case of the standard established by paragraph (20) of section 111(d), the reference contained in this section to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (20).</quote>.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="idAAF292D6219B41E6BB220E9F8A61980F"><enum>(b)</enum><header>Optional features of State energy conservation plans</header><text>Section 362(d) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322(d)</external-xref>) is amended—</text><paragraph id="id92C2520BEF78434285D3A2B4B300A874"><enum>(1)</enum><text>in paragraph (16), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id1213FD3259BB4E9FA467538DF090EDA3"><enum>(2)</enum><text>by redesignating paragraph (17) as paragraph (18); and</text></paragraph><paragraph id="id9FA8B5FB86D340A6BAAB5418C9EE4C34"><enum>(3)</enum><text>by inserting after paragraph (16) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id06BDFC28AE3C4F238FDF0F8098F649D7"><paragraph id="id04B73EE89D5F4ED6AC0B4FFA412F7285"><enum>(17)</enum><text>programs that promote the installation and use of demand-response technology and demand-response practices; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idE296AED0588D4258906245A712727662"><enum>(c)</enum><header>Federal Energy Management Program</header><text display-inline="yes-display-inline">Section 543(i) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8253">42 U.S.C. 8253(i)</external-xref>) is amended—</text><paragraph id="id2214DC49A46D4A04885F790C063B242C"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="idF54B615BC1A044E9A9D5BCA12DB64BD2"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idE459DB2B1A4F42A2B85A4BC276ACB33C"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idABE1FCD9942B4FA1B76EEEA92B1F66E3"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2C55BC3F548A48BFB99F7E4582708410"><subparagraph id="idB75B653BE89243048927979C8F701183"><enum>(C)</enum><text>to reduce energy consumption during periods of unusually high electricity or natural gas demand.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id78187555ACB44D028A4C9F1C3AA840E2"><enum>(2)</enum><text>in paragraph (3)(A)—</text><subparagraph id="id03E93D9A18834CC2BB5E260B3B738818"><enum>(A)</enum><text>in clause (v), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idDA60DD7F519F4828AF04B485FDAE13E9"><enum>(B)</enum><text>in clause (vi), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id5FB2B4EC80A44E37BD4667355D0A48B7"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE39B1517786D4AEFB870007FBDCED17B"><clause id="id83AD2FDC0D474E6D816A9D63F2EA899D"><enum>(vii)</enum><text>promote the installation of demand-response technology and the use of demand-response practices in Federal buildings.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id7D2DB2EA047143F2B93508B11D6C3784"><enum>(d)</enum><header>Components of Zero-Net-Energy Commercial Buildings Initiative</header><text>Section 422(d)(3) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17082">42 U.S.C. 17082(d)</external-xref>) is amended by inserting <quote>(including demand-response technologies, practices, and policies)</quote> after <quote>policies</quote>.</text></subsection></section></legis-body></bill>
