<section id="id54598FE034A44D729CE142FF1151C8FF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Worker Safety in Contracting Act of 2021</short-title></quote>.</text></section> <section id="id2002BBB689804AD887962BA6AB59C27A"><enum>2.</enum><header>Department of Defense contractor workplace safety and accountability</header> <subsection id="id5082BAAFDC504671940318B141F1CE8B"><enum>(a)</enum><header>Training and guidance</header><text>The Secretary of Defense shall develop and provide clear training and guidance to acquisition officials, contracting officers, and current and potential contractors on an annual basis regarding—</text>
<paragraph id="id97677f6f82d846959de282b40f7b0ed2"><enum>(1)</enum><text> the authorities and requirements of Department of Defense officials to consider workplace safety and health information in the pre-award, award, and contract performance phases of the contracting process; and</text></paragraph> <paragraph id="id41fca069a58844e6891963199182023f"><enum>(2)</enum><text>the availability of relevant contractor safety information on the Occupational Health and Safety Administration (OSHA) website.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id03A7D6D7DF3945568FD217039DF8022D"><enum>(b)</enum><header>Comptroller General report</header>
<paragraph commented="no" display-inline="no-display-inline" id="id0ED021B7EC184E1883EDFD174A1B17EE"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Department of Defense and the congressional defense committees a report on the health and safety records of Department of Defense contractors.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idA1D98C80B6EB4DF9A8F3C35587DA6F20"><enum>(2)</enum><header>Elements</header><text>The report required under paragraph (1) shall include the following elements:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idDEC29D0F48C8468EAD9164D48AC6149D"><enum>(A)</enum><text>A description of the Department of Defense's existing procedures to evaluate the safety and health records of current and prospective contractors.</text></subparagraph> <subparagraph id="id7b81701e13e6450187763dbd065892a3"><enum>(B)</enum><text>An evaluation of the Department's adherence to those procedures.</text></subparagraph>
<subparagraph id="id7379aafb764643d9b03ffd61e8275d6e"><enum>(C)</enum><text>An assessment of the current incidence of health and safety violations by Department contractors.</text></subparagraph> <subparagraph id="id900ea5d75eb74a15b30ceddff5d91be8"><enum>(D)</enum><text>An assessment of whether the Department of Labor has the resources to investigate and identify safety and health violations by Department of Defense contractors.</text></subparagraph>
<subparagraph id="id5b536e05c99940f29a67b2f0e097a2aa"><enum>(E)</enum><text>An assessment of whether the Department of Labor should consider assuming an expanded investigatory role or a targeted enforcement program for ensuring the safety and health of workers under Department of Defense contracts.</text></subparagraph> <subparagraph id="id76fcd16908904457a107cdefd2ffee6b"><enum>(F)</enum><text>An evaluation of the training and guidance developed under subsection (a). </text></subparagraph></paragraph></subsection>
<subsection id="id593BAD57447241E39A453A7AA1694D17"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id9310C98DB9EE4FE5A81F735B3E15FABD"><enum>(1)</enum><header>Covered contract</header><text>The term <term>covered contract</term> means a Department of Defense contract for the procurement of property or services, including construction, valued in excess of $1,000,000.</text></paragraph>
<paragraph id="idD7A4EDA9AC3A47469E3355E6EFC95E4F"><enum>(2)</enum><header>Covered subcontractor</header><text>The term <term>covered subcontractor</term> means a subcontractor listed in the bid for a covered contract or known by the Department of Defense to be a subcontractor of the offeror.</text></paragraph></subsection> <subsection id="idED52368C529B410EA50BEB98725364E4" commented="no"><enum>(d)</enum><header>Consideration of safety performance in contracts</header> <paragraph commented="no" id="id236899287CE34B93A2357712E5F3AD6B"><enum>(1)</enum><header>System for assigning safety performance ratings for certain contracts</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall develop a system for assigning safety performance ratings for Department of Defense contracts in industries that have relatively high rates of occupational injuries, including manufacturing, construction, and ship building and repairing.</text></paragraph>
<paragraph commented="no" id="id29DA9610A9804DAB8A6871CDF4C1D6CE"><enum>(2)</enum><header>Ratings for completed contracts</header><text>Beginning in fiscal year 2023, Department of Defense contracting officials shall assess contractor safety performance at the time of contract completion in industries that have relatively high rates of occupational injuries.</text></paragraph> <paragraph commented="no" id="id7CBF8D3ACB99498897DDFCFF6A8C9433"><enum>(3)</enum><header>Evaluation of safety performance records</header><text>Beginning in fiscal year 2023, Department of Defense contracting officials shall consider information about prospective contractors’ records of safety performance as a factor in awarding contracts in industries that have relatively high rates of occupational injuries.</text></paragraph></subsection></section>
