<section display-inline="yes-display-inline" id="S1" section-type="undesignated-section"><text display-inline="yes-display-inline">The following sums are hereby are appropriated, out of any money in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2021, and for other purposes, namely:</text></section> <title id="id3656BA622CED4AF6B7ECB84896A2BD48" style="appropriations"><enum>I</enum><header display-inline="no-display-inline">DEPARTMENT OF DEFENSE</header><appropriations-major id="idD3DE76F49A5E4952BD3EF38F8F01515B"><header>MILITARY PERSONNEL</header></appropriations-major><appropriations-intermediate id="idFBDD0D8F87DB4C13A594244E974157C6"><header>National Guard Personnel, Army</header><text display-inline="no-display-inline">For an additional amount for <quote>National Guard Personnel, Army</quote>, $231,000,000, to respond to the events at the United States Capitol Complex on January 6, 2021, and for related purposes: <proviso><italic>Provided</italic></proviso>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</text></appropriations-intermediate><appropriations-intermediate id="idFC6F19EC281445EB9F904999DDB2F826"><header>National Guard Personnel, Air Force</header><text display-inline="no-display-inline">For an additional amount for <quote>National Guard Personnel, Air Force</quote>, $28,900,000, to respond to the events at the United States Capitol Complex on January 6, 2021, and for related purposes: <proviso><italic>Provided</italic></proviso>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</text></appropriations-intermediate><appropriations-intermediate id="id7FC6D9DFDA7C42168F4472FC9A66DAFC"><header>Operation and Maintenance, Army National Guard</header><text display-inline="no-display-inline">For an additional amount for <quote>Operation and Maintenance, Army National Guard</quote>, $218,500,000 to respond to the events at the United States Capitol Complex on January 6, 2021, and for related purposes: <proviso><italic>Provided</italic></proviso>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</text></appropriations-intermediate><appropriations-intermediate id="idE87F2D26D23749AAA11BA0A8992C9A61"><header>Operation and Maintenance, Air National Guard</header><text display-inline="no-display-inline">For an additional amount for <quote>Operation and Maintenance, Air National Guard</quote>, $42,500,000 to respond to the events at the United States Capitol Complex on January 6, 2021, and for related purposes: <proviso><italic>Provided</italic></proviso>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</text></appropriations-intermediate></title>
<title id="id1BA958CCEC6B430B8D47CA982F878284" style="appropriations"><enum>II</enum><header display-inline="no-display-inline">LEGISLATIVE BRANCH </header><appropriations-major id="id840F7B70637F493AA34CE924E8BF95DA"><header>CAPITOL POLICE</header></appropriations-major><appropriations-intermediate id="id6E7125D162DB4315AE8199062CB671DA"><header>Salaries</header><text display-inline="no-display-inline">For an additional amount for <quote>Salaries</quote>, $37,495,000, to remain available until September 30, 2022, to respond to the events at the United States Capitol on January 6, 2021, and for related purposes: <proviso><italic>Provided</italic></proviso>, That of such amount, $3,600,000 may remain available until expended for retention bonuses: <proviso><italic>Provided further</italic></proviso>, That of such amount, up to $6,900,000 shall be made available for hazard pay for employees of the Capitol Police: <proviso><italic>Provided further</italic></proviso>, That of such amount, $1,361,300 shall be made available for the wellness program for the United States Capitol Police: <proviso><italic>Provided further</italic></proviso>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</text></appropriations-intermediate><appropriations-intermediate id="idB248B15155D24C529D2ABFD11893C6D9"><header>General Expenses</header></appropriations-intermediate><appropriations-small id="idD964D3E099644EC3BAE3BDECC929E7F6"><header>(INCLUDING TRANSFER OF FUNDS)</header><text display-inline="no-display-inline">For an additional amount for <quote>General Expenses</quote>, $33,169,000, to remain available until September 30, 2022, to respond to the events at the United States Capitol on January 6, 2021, and for related purposes: <proviso><italic>Provided</italic></proviso>, That of such amount, $2,628,000 shall remain available until expended for physical protection barriers and various civil disturbance unit equipment: <proviso><italic>Provided further</italic></proviso>, That amounts provided under this heading in this chapter for physical protection barriers may be transferred to and merged with the Capitol Police Building and Grounds Account of the Architect of the Capitol: <proviso><italic>Provided further</italic></proviso>, That of such amount, not less than $5,000,000 shall be made available for reimbursable agreements with State and local law enforcement agencies and not less than $4,800,000 shall be available for protective details for Members of Congress, including Delegates and the Resident Commissioner to the Congress: <proviso><italic>Provided further</italic></proviso>, That of such amount, up to $2,500,000 may be transferred to <quote>Department of Justice—United States Marshals Service—Salaries and Expenses</quote> for the purpose of reimbursements for providing peer-to-peer and group counseling services to the Capitol Police and training and technical and related assistance necessary to establish a peer-to-peer and group counseling program within the Capitol Police: <proviso><italic>Provided further</italic></proviso>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</text></appropriations-small><appropriations-small id="id7A3013A2411941CBA29A54D006100F4D"><header>United states capitol police mutual aid reimbursements</header><text display-inline="no-display-inline">For an additional amount for United States Capitol Police <quote>General Expenses</quote>, $26,300,000, to remain available until September 30, 2026, for reimbursements for mutual aid and related training, including mutual aid and training provided under the agreements described in section 7302 of <external-xref legal-doc="public-law" parsable-cite="pl/108/458">Public Law 108–458</external-xref>: <proviso><italic>Provided</italic></proviso>, That obligation of the funds made available in the preceding proviso be subject to notification to the Chairmen and Ranking Members of Committees on Appropriations of both Houses of Congress, the Senate Committee on Rules and Administration, and the Committee on House Administration of the amount and purpose of the expense within 15 days of obligation: <proviso><italic>Provided further</italic></proviso>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985. </text></appropriations-small><appropriations-intermediate id="id09949EA215C64EE9B3C90C25B43D0072"><header>Administrative provisions</header></appropriations-intermediate><appropriations-small id="id79E4CBFDEB7445AEAC32ABA711999573"><header>CAPITOL POLICE SALARY CAP ADJUSTMENT</header></appropriations-small>
<section id="idBBC47A87F3884D0CB17D4EE21ECAB669" section-type="subsequent-section"><enum>201.</enum><text display-inline="yes-display-inline">For the purposes of administering pay during calendar year 2021, the limitation on the maximum rate of gross compensation for any member or civilian employee of the Capitol Police whose compensation includes overtime pay under the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) shall be limited to Executive Schedule II at $199,300. Excluded from this limitation for calendar year 2021 shall be retention bonuses and hazard bonuses related to the events of January 6th.</text></section><appropriations-small id="id26C3D6A9BA0947B6B48E5BE2248F4FDB"><header>Emergency assistance for the Capitol Police</header></appropriations-small> <section id="idDECAC2EEED2E47929C222C5B0D0F09E0"><enum>202.</enum> <subsection commented="no" display-inline="yes-display-inline" id="idd9d4433526f046ddbbf73451f44f53dd"><enum>(a)</enum><header>Assistance by executive departments and agencies</header><text>Section 911(a) of division B of the Department of Defense and Emergency Supplemental Appropriations for Recovery from and Response to Terrorist Attacks on the United States Act, 2002 (<external-xref legal-doc="usc" parsable-cite="usc/2/1970">2 U.S.C. 1970(a)</external-xref>) is amended—</text>
<paragraph id="idBA49AD54DC534C12AAEFE4D90CA4354A"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>or in accordance with paragraph (4)</quote> before <quote>and on a permanent</quote>;</text></paragraph> <paragraph id="id05B26061512E4B93A00F9FB7B5C4526C"><enum>(2)</enum><text>in paragraph (4)(B)—</text>
<subparagraph id="id2D6BF1DFC40E42178C0689680F11C69A"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>advance</quote>; and</text></subparagraph> <subparagraph id="idEAC3F30E214B4E1481617053026FD0E1"><enum>(B)</enum><text>in clause (ii)—</text>
<clause id="id7948453B2E45483A88336489BD306A70"><enum>(i)</enum><text>in subclause (I), by striking <quote>or</quote> after the semicolon;</text></clause> <clause id="idF69E6EC939E74D2E865CB7DFA044B61E"><enum>(ii)</enum><text>in subclause (II), by striking <quote>and</quote> after the semicolon and inserting <quote>or</quote>; and</text></clause>
<clause id="id8A67DBE6BB3E47FFABC38B638E8FC895"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id1623D638D10142D5BB8DEBDBCF9ADA52"> <subclause id="id067f6cf8e2034e0cace80fdc1090a2ce"><enum>(III)</enum><text>the Chief of the Capitol Police, if the Chief of the Capitol Police has determined that the provision of assistance is necessary to prevent the significant disruption of governmental function and public order within the United States Capitol Buildings and Grounds, as described in section 9 of the Act entitled <quote>An Act to define the area of the United States Capitol Grounds, to regulate the use thereof, and for other purposes</quote>, approved July 31, 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/1961">2 U.S.C. 1961</external-xref>); and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph>
<paragraph id="id788F388D6FB64B54B26B5BF072EBAC21"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idE01E38A2E7204F0A99A051AEC069F817"> <paragraph id="id73ff0abb1aef406fb94fbe115bd636d6"><enum>(5)</enum><header>Revocation</header><text>The Capitol Police Board may revoke a request for assistance provided under paragraph (4)(B)(ii)(III) upon consultation with appropriate Members of the Senate and House of Representatives in leadership positions.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id5015325630cb408ebd53f7c9c5fb0f3e"><enum>(b)</enum><header>Capitol police special officers</header><text>Section 1017 of division H of the Consolidated Appropriations Resolution, 2003 (<external-xref legal-doc="usc" parsable-cite="usc/2/1974">2 U.S.C. 1974</external-xref>) is amended—</text> <paragraph id="ide5289bfe0ad049ca8074bad02c612952"><enum>(1)</enum><text>in subsection (a)—</text>
<subparagraph id="id26BFEFB5DFC546D4ABAD4B5F12F9B8B5"><enum>(A)</enum><text>in the matter preceding paragraph (1), by inserting <quote>or as determined by the Chief of the Capitol Police in accordance with section 911(a)(4)(B)(ii)(III) of division B of the Department of Defense and Emergency Supplemental Appropriations for Recovery from and Response to Terrorist Attacks on the United States Act, 2002 (<external-xref legal-doc="usc" parsable-cite="usc/2/1970">2 U.S.C. 1970(a)(4)(B)(ii)(III)</external-xref>),</quote> after <quote>Congress,</quote>; and</text></subparagraph> <subparagraph id="idF915E110BD66434DB60F5A8B048616FE"><enum>(B)</enum><text>by adding at the end the following: </text>
<quoted-block style="OLC" display-inline="no-display-inline" id="idCF190C57067D4157A7653706282542C6">
<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">An appointment under this section due to an emergency determined by the Chief of the Capitol Police under paragraph (4)(B)(ii)(III) of section 911(a) of division B of the Department of Defense and Emergency Supplemental Appropriations for Recovery from and Response to Terrorist Attacks on the United States Act, 2002 (<external-xref legal-doc="usc" parsable-cite="usc/2/1970">2 U.S.C. 1970(a)</external-xref>) shall be in effect for the period of the emergency, unless and until the Capitol Police Board revokes the request for assistance under paragraph (5) of such section.</quoted-block-continuation-text><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="id1d4c9a22946f4d1d9d05c4bb6dcbcbb0"><enum>(2)</enum><text>by striking subsections (c) and (e); </text></paragraph> <paragraph id="id05C0D367F2024E1EB24099E8BD77120E"><enum>(3)</enum><text>by redesignating subsections (d), (f), and (g) as subsections (c), (d), and (e), respectively; and</text></paragraph>
<paragraph id="idE8C36CBC8F2C4ABCB2134ED026F745E9"><enum>(4)</enum><text>in subsection (d), as redesignated by paragraph (3) of this subsection, by striking <quote>President pro tempore</quote> and inserting <quote>Majority Leader</quote>.</text></paragraph></subsection> <subsection id="idFC515C9210C742A1B578CC69EB9AAABE"><enum>(c)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="id5698f8a70ef5493c81216d407391ea78"><enum>(1)</enum><header>Joint oversight hearings</header><text>The Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives (referred to in this section as the <term>Committees</term>) are authorized to jointly conduct oversight hearings regarding the Capitol Police Board and may request the attendance of all members of the Capitol Police Board at any such hearing. Members of the Capitol Police Board shall attend a joint hearing under this section, as requested and under such rules or procedures as may be adopted by the Committees.</text></paragraph>
<paragraph id="id52291DF3F69E457C93075B5E0FF7E57B" indent="up1"><enum>(2)</enum><header>Timing</header><text>The Committees may conduct oversight hearings under this section as determined appropriate by the Committees, but shall conduct not less than one oversight hearing under this section during each Congress.</text></paragraph></subsection> <subsection id="id173127AE652344E6BD72A5B059F2A79F"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on October 1, 2021. </text></subsection></section><appropriations-major id="id09C192C4D53D48B69F1289AA2921E5AD"><header>ARCHITECT OF THE CAPITOL</header></appropriations-major><appropriations-intermediate id="id5C0E6FCB4C8F4356A102EF09682C5C06"><header>Capital construction and operations</header><text display-inline="no-display-inline">For an additional amount for <quote>Capital Construction and Operations</quote>, $15,000,000, to remain available until September 30, 2022, to respond to the events at the United States Capitol on January 6, 2021, by securing vulnerabilities of windows and doors in the United States Capitol Building: <proviso><italic>Provided</italic></proviso>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985. </text></appropriations-intermediate></title>
<title id="idFCD25F2905DE4712B4DB485E48DDC28C" style="appropriations"><enum>III</enum><header display-inline="no-display-inline">GENERAL PROVISIONS—THIS ACT</header>
<section id="idF22B3D77C6304078886B08A9A2360229" section-type="subsequent-section"><enum>301.</enum><text display-inline="yes-display-inline">Each amount appropriated or made available by this Act is in addition to amounts otherwise appropriated for the fiscal year involved. </text></section> <section id="id176D033D83ED4E4A945095ECCB5208DF"><enum>302.</enum><text>No part of any appropriation contained in this Act shall remain available for obligation beyond the current fiscal year unless expressly so provided herein.</text></section>
<section id="idFD1545EEC0CD4936A48AB9307319604B"><enum>303.</enum><text display-inline="yes-display-inline">Unless otherwise provided for by this Act, the additional amounts appropriated by this Act to appropriations accounts shall be available under the authorities and conditions applicable to such appropriations accounts for fiscal year 2021. </text></section> <section id="id703258DB5843431482B65F34998370D3"><enum>304.</enum><text display-inline="yes-display-inline">Each amount appropriated in this Act may be made available to restore amounts, either directly or through reimbursement, for obligations incurred for the purposes provided herein for such appropriation prior to the date of the enactment of this Act. </text></section>
<section id="id2CBF9D2F97AA4C788E7795DB1A201910"><enum>305.</enum><text display-inline="yes-display-inline">Each amount designated in this Act by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 shall be available (or rescinded or transferred, if applicable) only if the President subsequently so designates all such amounts and transmits such designations to the Congress. </text></section> <section id="id4F72133D74D6476C93580866A6440B08"><enum>306.</enum><text display-inline="yes-display-inline">Any amount appropriated by this Act, designated by the Congress as an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 and subsequently so designated by the President, and transferred pursuant to transfer authorities provided by this Act shall retain such designation.</text></section></title>
