Expenses, General Legal Activities</quote>, $2,000,000, to remain available until September 30, 2022, for necessary expenses of the Criminal Division to respond to the attack on the United States Capitol Complex that occurred on January 6, 2021, and for related purposes: <proviso><italic>Provided</italic></proviso>, That the amount provided under this heading in this Act may not be used to increase the number of permanent positions: <proviso><italic>Provided further</italic></proviso>, That such amount is designated by the Congress as being for an emergency requirement pursuant to display-inline="yes-display-inline">Notwithstanding section 2208(l)(3) of title 10, United States Code, during fiscal year 2021, the total amount of the advance billings rendered or imposed for all working-capital funds of the Department of Defense may exceed the amount otherwise specified in such section.</text></subsection><subsection CAPITOL POLICE OFFICERS TO UTILIZE BODY-WORN CAMERAS WHILE ON DUTY</header></appropriations-small><section id="idA2C3A5054D6640ABB2C187C3EE95F17C"><enum>703.</enum><subsection commented="no" display-inline="yes-display-inline" id="iddf4a6b236b7945f6a0bec6209ad6635e"><enum>(a)</enum><header>Requirement</header><text>Each uniformed officer of the United States Capitol Police whose job duties include interacting with the general public shall utilize a body-worn camera and ensure that the body-worn camera is activated while on duty.</text></subsection><subsection id="id84038fe7dfa74ce8853848542e8e712d"><enum>(b)</enum><header>Exception for officers on personal protection detail</header><text>Subsection (a) does not apply to an officer during any time in which section.</text></paragraph><paragraph id="idb89cebba4c474b93af0bd240cc996320"><enum>(2)</enum><header>Body camera footage</header><text>The regulations promulgated under paragraph (1) shall include guidance on the retention and deletion of video footage recorded by a body-worn camera utilized by an officer of the United States Capitol Police.</text></paragraph><paragraph id="id96513fb23b694eb7833d635ff733f835"><enum>(3)</enum><header>Requiring notification prior to disclosure of certain recorded information</header><text>The regulations promulgated under paragraph (1) shall include a requirement that the United States Capitol Police shall not make any disclosure to any third party (including a law enforcement agency), including any disclosure pursuant to a request by compulsory process, of any video or audio information relating to the House of Representatives or the Senate which is recorded by a body-worn camera utilized by an officer of the United States Capitol Police until the United States Capitol Police provides notice of the request to, and consults regarding the disclosure with—</text><subparagraph id="id283a72e86a454485ba47334b43df84fb"><enum>(A)</enum><text>in the case of information relating to the House of Representatives, the Office of the General Counsel of the House of Representatives and any Member (including a Delegate or Resident Commissioner), officer, or employee of the House involved; or</text></subparagraph><subparagraph id="iddc6f617849324e729f58397af408ef93"><enum>(B)</enum><text>in the case of information relating to the Senate, any Senator, officer, or employee of the Senate involved.</text></subparagraph></paragraph></subsection><subsection id="id6572dc611b5441cdb7ee6a814938bd09"><enum>(d)</enum><header>Effective date</header><text>This section shall apply with respect to fiscal year 2021 and each succeeding fiscal year. </text></subsection></section><appropriations-small id="idD9837EFDF3F349F0B86CA7D05BFF6F56"><header>UNITED STATES CAPITOL PROTECTION TASK FORCE</header></appropriations-small><section id="id1574B661D8434AA4AAD1919E14E2F7AF"><enum>704.</enum><subsection commented="no" display-inline="yes-display-inline" id="id1c1d37cd1885424280779ab20e1df465"><enum>(a)</enum><header>Short Title</header><text>This section may be cited as the <quote><short-title>United States Capitol Protection Task Force Act</short-title></quote>.</text></subsection><subsection id="id5f08cef414504019b659d54f7d206812"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idd971148ba5d3431d93df7390a9a7a41e"><enum>(1)</enum><header>Activate</header><text>The term <term>activate</term>, with respect to a partner agency, means that the partner agency has been directed to perform activities in preparation for or response to an event, or as part of a training activity, under the Task Force agreement with the partner agency.</text></paragraph><paragraph id="id15912530fbca44da94f7f86efe6e61b8"><enum>(2)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idd5b77a4eac9a474dbbeb45a7dac43829"><enum>(A)</enum><text>the Committee on Rules and Administration and the Committee on Appropriations of the Senate; and</text></subparagraph><subparagraph id="id79a192b493c44e33b4bd12fc7908bb03"><enum>(B)</enum><text>the Committee on House Administration and the Committee on Appropriations of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id5573ac99d3714336b75acba1192c68bc"><enum>(3)</enum><header>Capitol complex</header><text>The term <term>Capitol complex</term> means the United States Capitol Grounds described in section 5102 of title 40, United States Code, and the Capitol Buildings described in section 5101 of title 40, United States Code.</text></paragraph><paragraph id="idb8db50de5a5440879681e47d21755498"><enum>(4)</enum><header>Capital region</header><text>The term <term>Capital region</term> means—</text><subparagraph id="id8472e313b8ee4d6a87b05f9cbedeb23f"><enum>(A)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="id3a22c82ef3ca46a08b80c8c84993760b"><enum>(B)</enum><text>Anne Arundel, Baltimore, Charles, Frederick, Howard, Montgomery, and Prince Georges Counties in Maryland;</text></subparagraph><subparagraph id="id9015dda49e6a4fa8aa4578c0a899bb82"><enum>(C)</enum><text>Arlington, Fairfax, Loudoun, and Prince William Counties in Virginia; and</text></subparagraph><subparagraph id="id367ef852543f43908ea855b89be7434f"><enum>(D)</enum><text>all cities in Maryland or Virginia in the geographic area bounded by the outer boundaries of the combined area of the counties listed in subparagraphs (B) and (C).</text></subparagraph></paragraph><paragraph id="id4a7631faf9e3459e87dceabe9da5926f"><enum>(5)</enum><header>Chief</header><text>The term <term>Chief</term> means the Chief of the United States Capitol Police.</text></paragraph><paragraph id="ided89cae6fd9e4538a030cf1e438ca017"><enum>(6)</enum><header>Fund</header><text>The term <term>Fund</term> means the United States Capitol Protection Task Force Fund established under subsection (l)(1).</text></paragraph><paragraph id="id3377d735e27f4980a2fa3cb8f3453ffd"><enum>(7)</enum><header>Incident command system organizational roster</header><text>The term <term>Incident Command System organizational roster</term> means the list of assignments under the Incident Command System to be used for rostering personnel of partner agencies developed under subsection (d)(7)(A).</text></paragraph><paragraph id="id0ed1e38e3cf6453ca9a837a61fc6b842"><enum>(8)</enum><header>National incident management system</header><text>The term <term>National Incident Management System</term> has the meaning given that term in section 501 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/311">6 U.S.C. 311</external-xref>).</text></paragraph><paragraph id="id3e807cbbd63640ddb2c23c11de8642dd"><enum>(9)</enum><header>Partner agency</header><text>The term <term>partner agency</term>—</text><subparagraph id="id2f59128d5d8a4e3dbd0bf1d954d38911"><enum>(A)</enum><text>means a law enforcement agency entering into a Task Force agreement; and</text></subparagraph><subparagraph id="ide98ad4c387af4627ac1fd0ff422eec5e"><enum>(B)</enum><text>may include—</text><clause id="idb1bad2edc045442b9af40e559a887832"><enum>(i)</enum><text>Federal law enforcement agencies, including—</text><subclause id="idc29ef6acee064464a13e808e634d8f85"><enum>(I)</enum><text>the Federal Bureau of Investigation;</text></subclause><subclause id="id10003dc7159749729d16e3a5c9c1cfa7"><enum>(II)</enum><text>the United States Marshals Service;</text></subclause><subclause id="id41f1a275fe2c473ebcbd864bf9bf57b5"><enum>(III)</enum><text>the United States Park Police;</text></subclause><subclause id="id385cf930262f4b688c7d22b1b66063fc"><enum>(IV)</enum><text>the United States Secret Service;</text></subclause><subclause id="id1090558e1a0d42cfb71da0ca34601e23"><enum>(V)</enum><text>the United States Coast Guard;</text></subclause><subclause id="id770061098f794b7e87dde560d136946e"><enum>(VI)</enum><text>the Federal Protective Service;</text></subclause><subclause id="id3e7817a10665481aa0f5c1abda3a347a"><enum>(VII)</enum><text>the Amtrak Police Department;</text></subclause><subclause id="id752069e4765f4bd6833a21a7d311e654"><enum>(VIII)</enum><text>the United States Supreme Court Police;</text></subclause><subclause id="id08272b7d6e8d4cc997f185ba8786c644"><enum>(IX)</enum><text>the Pentagon Force Protection Agency; and</text></subclause><subclause id="id016ab62e2799495cacddc264330bc968"><enum>(X)</enum><text>the Government Publishing Office Police;</text></subclause></clause><clause id="idd623a8b566f34383b2a0ec8856b4850a"><enum>(ii)</enum><text>any State or local law enforcement agency operating in the Capital region; and</text></clause><clause id="id33a8da3b0b7b43abb90399a859cc2e51"><enum>(iii)</enum><text>the National Guard of the District of Columbia for the purposes of obtaining specialized capabilities for use within the mission of the Task Force.</text></clause></subparagraph></paragraph><paragraph id="id47ec77a0394547f69df7f81224478f24"><enum>(10)</enum><header>Task force</header><text>The term <term>Task Force</term> means the United States Capitol Protection Task Force established under the agreements entered into or modified under subsection (c)(1).</text></paragraph><paragraph id="id68fb3c537b4649ea84257db7f68a1644"><enum>(11)</enum><header>Task force agreement</header><text>The term <term>Task Force agreement</term> means a memorandum of understanding or other agreement between the Chief and a partner entity establishing the terms and conditions of the participation of the partner entity in the Task Force.</text></paragraph></subsection><subsection id="id11277ea0f97244319fc3f2be258d3845"><enum>(c)</enum><header>Establishment of task force</header><paragraph id="id53b1b6a0384b407fbbf884f345bfe03b"><enum>(1)</enum><header>In general</header><text>The Chief shall enter into new memorandums of understanding, or modify existing agreements, with law enforcement agencies operating in the Capital region to establish the United States Capitol Protection Task Force as a ready response capability, to assist the United States Capitol Police in protecting and providing security at the Capitol complex, in accordance with this section.</text></paragraph><paragraph id="idba4a0ca3f8964644928e538a12a16c7f"><enum>(2)</enum><header>Construction with other authority</header><text>The authority under this section is in addition to any authority under section 911 of division B of the Department of Defense and Emergency Supplemental Appropriations for Recovery from and Response to Terrorist Attacks on the United States Act, 2002 (<external-xref legal-doc="usc" parsable-cite="usc/2/1970">2 U.S.C. 1970</external-xref>), relating to assistance by executive departments and agencies.</text></paragraph></subsection><subsection id="id545670e398134bf49e1b8606d59dc93c"><enum>(d)</enum><header>Task force administration</header><paragraph id="id0b311392a4c64e38a2e78392bb6561f6"><enum>(1)</enum><header>Head</header><text>The head of the Task Force shall be the Chief, who shall have the authority to activate partner agencies in accordance with the Task Force agreements with the partner agencies.</text></paragraph><paragraph id="idefe274b6ec6d4696880a7535c25d9a4b"><enum>(2)</enum><header>Operation</header><text>The rules, processes, procedures, and expectations for the Task Force shall be established and carried out in accordance with the National Incident Management System and the Incident Command System.</text></paragraph><paragraph id="id106c042973084c4ab609bee310efb3f9"><enum>(3)</enum><header>Command staff meetings</header><text>The Chief and commanders from each partner agency shall meet not less frequently than quarterly to discuss the operation of the Task Force, including intra-agency training goals, Task Force joint training exercises, communications, Incident Command Systems, equipment, and any other issue required to ensure the success of the Task Force.</text></paragraph><paragraph id="id664f0849ec914dae98c3dd2fc6c34884"><enum>(4)</enum><header>Communications</header><text>The Chief shall ensure consistent and appropriate communication is provided regarding the activities of the Task Force to—</text><subparagraph id="id8dbc8908444642da81f1b0df1ccb1ee6"><enum>(A)</enum><text>the Capitol Police Board, the Speaker of the House of Representatives, the Minority Leader of the House of Representatives, the Majority Leader of the Senate, and the Minority Leader of the Senate;</text></subparagraph><subparagraph id="id759abf3cc69e437b874682d70c9c72aa"><enum>(B)</enum><text>the appropriate committees of Congress;</text></subparagraph><subparagraph id="id8d5b6c0d4e2e4feca8a71b798ca6883c"><enum>(C)</enum><text>partner agencies, for dissemination to executives overseeing the partner agencies and other significant stakeholders; and</text></subparagraph><subparagraph id="idd761128aa06447778eb93ceeb0d5b1da"><enum>(D)</enum><text>the public.</text></subparagraph></paragraph><paragraph id="id9fd42824072145fb9c0680cd96d98139"><enum>(5)</enum><header>Training</header><text>Under a Task Force agreement, a partner agency shall participate in joint training with the Task Force in accordance with subsection (i)(2).</text></paragraph><paragraph id="id6f5f3c3552a541efa2c8d7a7b74c4310"><enum>(6)</enum><header>Staging and response operations</header><text>The Chief shall designate 1 or more locations in the Capitol complex, which shall be coordinated with the various entities with jurisdiction of the areas of the Capitol complex, that will be used for staging and response operations by the Task Force.</text></paragraph><paragraph id="id85c5e3d5a90544af912bed59a29c4c21"><enum>(7)</enum><header>Assignment of duties</header><subparagraph id="id978377df18414fb4b0f14b8f00953580"><enum>(A)</enum><header>List</header><text>Not later than 90 days after the date of enactment of this Act, the Chief shall develop a list of assignments under the Incident Command System to be used for rostering personnel of partner agencies during an activation.</text></subparagraph><subparagraph id="idd0b2a5d8621941248c0ed12bb3fdec1c"><enum>(B)</enum><header>Contents and review</header><text>The Chief and partner agencies shall—</text><clause id="id004a1bf21a694b85ac2535e7d108ea2c"><enum>(i)</enum><text>ensure that the assignments of personnel under the Incident Command System organizational roster comport with the personnel that partner agencies will provide under the Task Force agreements; and</text></clause><clause id="id88a457bb7f674a49a37360bb4cc85635"><enum>(ii)</enum><text>review and, if necessary, revise the Incident Command System organizational roster on a quarterly basis.</text></clause></subparagraph><subparagraph id="id736e08dd4f234f0badf586ca54499f32"><enum>(C)</enum><header>Training and exercise</header><text>The Incident Command System organizational roster and related protocols shall be trained and exercised in accordance with subsection (i)(2).</text></subparagraph></paragraph></subsection><subsection id="idb843adf627c543ed86aa9cc50eec0df7"><enum>(e)</enum><header>Task force activation</header><paragraph id="idc213535c53484ba58ee659ce61283226"><enum>(1)</enum><header>In general</header><text>Except for an activation for training or exercising activities relating to the Task Force, the Chief may not activate the personnel, assets, capabilities, or equipment of a partner agency, unless the Chief submits to the Capitol Police Board a certification that intelligence and threat identification related to 1 or more events indicates that the necessary response will exceed the capacity of the United States Capitol Police in carrying out its mission.</text></paragraph><paragraph id="idab8ea526f0804e6bb415701ec0eabb50"><enum>(2)</enum><header>First amendment considerations</header><text>A certification by the Chief under paragraph (1) shall include consideration of the impacts on rights under the First Amendment to the Constitution of the United States related to operational activities resulting from the activation of 1 or more partner agencies.</text></paragraph><paragraph id="id1b447cb294464ef6bc8c7ef1d2cabdd1"><enum>(3)</enum><header>Certification of continued operational requirement</header><text>During a period during which 1 or more partner agencies are activated, the Chief shall—</text><subparagraph id="ide16c57f7941847e5b12bcefd99fd777d"><enum>(A)</enum><text>not less frequently than every 30 days, submit to the Capitol Police Board a certification described in paragraph (1); and</text></subparagraph><subparagraph id="id2d71b914a3ff4a5ba46d8306b39cc916"><enum>(B)</enum><text>in preparing the certification submitted under subparagraph (A), consult with—</text><clause id="id70f44ad57d6e4944b3d78514ea4caa9e"><enum>(i)</enum><text>the Capitol Police Board; and</text></clause><clause id="id6d6c111e9ab84c0b971ee91c7f15f348"><enum>(ii)</enum><text>the appropriate committees of Congress.</text></clause></subparagraph></paragraph></subsection><subsection id="idb3472a34050d44dd8dc319e74611e807"><enum>(f)</enum><header>Task force agreements generally</header><text>A Task Force agreement shall—</text><paragraph id="id11125824cb064eac88be2f9997693ce3"><enum>(1)</enum><text>establish—</text><subparagraph id="id6ac9e4e7f9c04bf38a0838c4e7b7d376"><enum>(A)</enum><text>the personnel, assets, capabilities, equipment, and reimbursement to be provided from, or to, a partner agency;</text></subparagraph><subparagraph id="ide77eeed6d20d41e8a09e1cbc25b27e27"><enum>(B)</enum><text>the response time for a partner agency if the Chief activates the partner agency; and</text></subparagraph><subparagraph id="id32bfe705319f44e3a194e4c0907af42b"><enum>(C)</enum><text>that, upon activation, the personnel, assets, capabilities, and equipment provided to the Task Force by a partner agency shall operate under the authority and direction of the Chief;</text></subparagraph></paragraph><paragraph id="id4f0f42c7504844c782ce364f180a225d"><enum>(2)</enum><text>provide that, when activated, the personnel of a partner agency shall operate within the primary jurisdiction of the United States Capitol Police under section 9B(b) of the Act entitled <quote>An Act to define the area of the United States Capitol Grounds, to regulate the use thereof, and for other purposes</quote>, approved July 31, 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/1967">2 U.S.C. 1967(b)</external-xref>); and</text></paragraph><paragraph id="ide56d203e3ca4479f938f906d92835b6f"><enum>(3)</enum><text>ensure consistency with the operational and jurisdictional relationship between the United States Capitol Police and the United States Supreme Court Police during activations of the Task Force.</text></paragraph></subsection><subsection id="id3e95c1b3d4ac4c1c83134d35df19e67e"><enum>(g)</enum><header>Personnel</header><paragraph id="id5057ae0f604347359e5b5d9a95dffded"><enum>(1)</enum><header>In general</header><text>Under a Task Force agreement, a partner agency shall agree to make available, when activated, law enforcement officers that have had significant training and experience in handling demonstrations, riots, or other large scale events requiring the deployment of civil disturbance units.</text></paragraph><paragraph id="id8f94093d7382480b803bc11defbe1592"><enum>(2)</enum><header>Size of dedicated personnel</header><text>A partner agency shall agree, under a Task Force agreement, on the number of personnel to be provided during a period of activation, which—</text><subparagraph id="id7bea7fab28a840a9a34c65cad8135f1e"><enum>(A)</enum><text>shall include identifying a sufficient number of primary personnel and alternate personnel to ensure the partner agency can provide the agreed upon number of personnel;</text></subparagraph><subparagraph id="iddcaf61c548db4ddfbbbc549368daea96"><enum>(B)</enum><text>for a partner agency with a sworn workforce of less than 200 officers, shall require that the partner agency provide not less than 1 unit, which shall consist of not less than 10 law enforcement officers;</text></subparagraph><subparagraph id="idce316cbdc06b4f5da85cc34ecac02aaa"><enum>(C)</enum><text>for a partner agency with a sworn workforce of not less than 200 officers and less than 500 officers—</text><clause id="idcd8539293ec14a33be442d5c62f49bfe"><enum>(i)</enum><text>shall require that the partner agency provide not less than 1 unit, which shall consist of not less than 20 law enforcement officers; and</text></clause><clause id="id3c1395ed33754653bcf1e5e7fd88aa4e"><enum>(ii)</enum><text>may provide that the partner agency shall provide supervisory officers, a commander, or mission support personnel;</text></clause></subparagraph><subparagraph id="ida898c2bee75648b18d49add0a22b7311"><enum>(D)</enum><text>for a partner agency with a sworn workforce of not less than 500 officers, shall require the partner agency provide not less than 1 unit, which shall consist of not less than 40 law enforcement officers, an appropriate number of supervisory officers, a commander, and not less than 5 mission support personnel; and</text></subparagraph><subparagraph id="id3010d2691ca04c23b19a625483c4016a"><enum>(E)</enum><text>may provide that a partner agency shall provide more than 1 unit described in sub-paragraph (B), (C), or (D), as applicable.</text></subparagraph></paragraph><paragraph id="id9ecf09590de64728a6c1034b79d3d4e5"><enum>(3)</enum><header>Capabilities</header><subparagraph id="ide3c31ddd3353479a849c142c2b5ee3d7"><enum>(A)</enum><header>In general</header><text>The Chief shall ensure that the Task Force agreements provide for a range of personnel to be provided by partner agencies, with a range of capabilities, as necessary for an effective rapid response capability.</text></subparagraph><subparagraph id="ida8ed62bfaf894bf1a4caa9bb1085b253"><enum>(B)</enum><header>Incident response capabilities</header><text>The Chief shall ensure that the Task Force has adequate incident response capabilities—</text><clause id="id78b54f80cf6a4181956c4856dfcba449"><enum>(i)</enum><text>which shall include Incident Command System supervisory positions and civil disturbance commanders, supervisors, and officers; and</text></clause><clause id="id01c3be0c43bc4f479cbd953aa74d5866"><enum>(ii)</enum><text>may include Special Weapons And Tactics officers, bomb and hazardous devices technicians, hazardous materials response technicians, canine teams, threats officers or agents, intelligence agents or analysts, command center operations technicians, and communications or dispatch technicians.</text></clause></subparagraph><subparagraph id="idead7c084ec0c48688b8355bd540bc8e8"><enum>(C)</enum><header>Mission response capabilities</header><text>The Chief shall ensure that the Task Force has adequate mission response capabilities, including radio and information technology specialists, training instructors, asset management or logistics technicians, financial management personnel, and public affairs officers or specialists.</text></subparagraph></paragraph></subsection><subsection id="idae7450844ff74689beeb8523971df5d3"><enum>(h)</enum><header>Equipment</header><paragraph id="id50420edb19ac41938d9a66e496cf5813"><enum>(1)</enum><header>Specialized equipment</header><subparagraph id="id3590452cf78b41099dc97262314a0b23"><enum>(A)</enum><header>In general</header><text>A Task Force agreement shall specify specialized equipment that will be provided by the Chief to the partner agency.</text></subparagraph><subparagraph id="idd83a0e9a5d244aaaa4ad1983aaac8a74"><enum>(B)</enum><header>Use outside activation</header><text>A partner agency—</text><clause id="id0c7df8949aab4d36aed8362dc7d6c7dc"><enum>(i)</enum><text>may use equipment described in subparagraph (A) that is provided by the Chief during the normal operations of the partner agency; and</text></clause><clause id="ida0f8901e093044e59373146f205ffda6"><enum>(ii)</enum><text>shall—</text><subclause id="id6dabbb907c3442558181e0d41ff3d8ee"><enum>(I)</enum><text>maintain any such equipment; and</text></subclause><subclause id="id0c4347d37ac046ed918fe4f9de1cfd01"><enum>(II)</enum><text>if any such equipment is damaged or destroyed during activities that are not part of an activation of the partner agency, bear the cost of repairing or replacing the equipment, in accordance with established standards of the United States Capitol Police.</text></subclause></clause></subparagraph></paragraph><paragraph id="id0bf1a88011984c179c1b25b4159f7cca"><enum>(2)</enum><header>Communications</header><text>Under a Task Force agreement, the Chief shall be responsible for, and bear the cost of, activities and equipment necessary to ensure the interoperability of communications.</text></paragraph><paragraph id="id7e4fbcd4a33e4535970984b18fb15e27"><enum>(3)</enum><header>Vehicles</header><text>A Task Force agreement may specify the response or specialized vehicles, including land and air vehicles, that will be provided by a partner agency during a period of activation.</text></paragraph></subsection><subsection id="idde2006cce2414d579b6e01f70fd89cba"><enum>(i)</enum><header>Training</header><paragraph id="id323d89ca6f83455d9ac0c490762b724b"><enum>(1)</enum><header>In general</header><text>Under a Task Force agreement, the Chief shall procure and provide training, including exercises, relating to the activities of the Task Force, to ensure consistent capabilities across the partner agencies.</text></paragraph><paragraph id="idc4bcbb0703b449beb246ae0605d8465d"><enum>(2)</enum><header>Frequency of joint training</header><text>Under a Task Force agreement, a partner agency shall participate in joint training with the Task Force, to be conducted in the Capitol complex or another appropriate training venue—</text><subparagraph id="id2752880772fc4707ab03cb858589de7c"><enum>(A)</enum><text>not less than 4 times during the 1-year period beginning on the date of enactment of this Act; and</text></subparagraph><subparagraph id="id450d07d09e804038b5fc22b9d284ebb4"><enum>(B)</enum><text>not less than 2 times per year thereafter.</text></subparagraph></paragraph><paragraph id="idfc0e40d5fd0043f1be84907337e55215"><enum>(3)</enum><header>Goals</header><text>The joint training by the partner agencies and the United States Capitol Police shall be designed to enhance interoperability and reinforce the requirements under the National Incident Management System, including implementation of a unified command structure for command and control of major events.</text></paragraph></subsection><subsection id="id0233df5405214cdcb6f4f61d9070ac0d"><enum>(j)</enum><header>Reimbursement</header><paragraph id="id8671064c781c46e3900ddf3c333c8ff6"><enum>(1)</enum><header>Reimbursable expenses</header><text>A Task Force agreement shall provide that the Chief shall reimburse a partner agency for the cost—</text><subparagraph id="idd2316ba0669e4fc6aab09947c1f58f7c"><enum>(A)</enum><text>of overtime pay, hazardous duty pay, additional pay required during training, and pay during response or recovery time that is payable to personnel of the partner agency in connection with activities of the Task Force, which shall be determined based on standard calculation rates contained in the Task Force agreement;</text></subparagraph><subparagraph id="id5c2a47b8e85347269e14bf8cbbb19507"><enum>(B)</enum><text>to the partner agency of stand-by capabilities;</text></subparagraph><subparagraph id="idbfa26ad9d32c4fbfb2343529b60d0963"><enum>(C)</enum><text>of the use of vehicles of the partner agency in connection with activities of the Task Force;</text></subparagraph><subparagraph id="ida79d22f71735482e9aa06cb50cfc0b1f"><enum>(D)</enum><text>of administrative costs for maintaining the personnel, assets, capabilities, equipment, and vehicles provided to the Task Force by the partner agency; and</text></subparagraph><subparagraph id="idd4efaa09ca64489a938558d9f0495fe0"><enum>(E)</enum><text>of damage to or the destruction of a vehicle provided by the partner agency under the Task Force agreement which occurs during a period of activation.</text></subparagraph></paragraph><paragraph id="id67d678cade864fb29203b157668a33b8"><enum>(2)</enum><header>No reimbursement of base salary</header><text>A Task Force agreement may not provide for the reimbursement of the basic pay of personnel of a partner agency.</text></paragraph></subsection><subsection id="id8518a011f6b04108bb8a4042a92b1890"><enum>(k)</enum><header>Intelligence</header><text>Not later than 90 days after the date of enactment of this Act, the Chief shall submit to the Capitol Police Board and the appropriate committees of Congress a plan to enhance the intelligence and threat detection capabilities of the United States Capitol Police, in order to ensure the effective operation and activation of the Task Force.</text></subsection><subsection id="idd567c1c31ebb46b8b463366565f4c239"><enum>(l)</enum><header>Funding</header><paragraph id="id45f9412ce3a4443e8bfa61cd86e87960"><enum>(1)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund to be known as the United States Capitol Protection Task Force Fund.</text></paragraph><paragraph id="id47df5b3a1b254bbabe7ac0cce6d37036"><enum>(2)</enum><header>Availability</header><text>Amounts in the Fund shall be available to the Chief for the cost of addressing significant response requirements by partner agencies, including reimbursements in accordance with this section, as determined by the Chief.</text></paragraph><paragraph id="id9d44901cdaf74dc09a764de7bfb48d52"><enum>(3)</enum><header>Amounts deposited</header><text>The Fund shall consist of any amounts appropriated by law for the purposes of the Fund.</text></paragraph><paragraph id="id0b46648a0b564cc3b770c196f2357fd5"><enum>(4)</enum><header>Reporting</header><subparagraph id="id833c3435db1e48f38691997efba617dd"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Chief shall submit to the Capitol Police Board and the appropriate committees of Congress for review and approval an internal controls plan for reporting on spending of amounts appropriated to the Fund.</text></subparagraph><subparagraph id="idfad3b19ac41b419f9259f47cc8bc548a"><enum>(B)</enum><header>Limitation</header><text>The Chief may not obligate or expend amounts in the Fund until the date on which the Chief submits the internal controls plan in accordance with subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="iddbd67f0de23e4c4ba39341b2d0383e3c"><enum>(m)</enum><header>Workers’ compensation</header><paragraph id="idcb5b4c52dc034461bd0ef8120590d05e"><enum>(1)</enum><header>Compensation</header><text>Each partner agency shall provide for the payment of compensation and death benefits to injured members of the emergency forces of that partner agency and representatives of deceased members of such forces if the members sustain injuries or are killed while activated under a Task Force agreement, including while engaged in training activities under the Task Force agreement, in the same manner and on the same terms as if the injury or death were sustained within the jurisdiction of the partner agency.</text></paragraph><paragraph id="id613dd840888d4c249c1eaa409677e550"><enum>(2)</enum><header>Other state law</header><text>No partner agency shall be liable under the law of any State other than its own for providing for the payment of compensation or death benefits to injured members of the emergency forces of the partner agency or representatives of deceased members of such forces if the members sustain injuries or are killed while activated under a Task Force agreement, including while engaged in training activities under the Task Force agreement, in the same manner and on the same terms as if the injury or death were sustained within the jurisdiction of the partner agency.</text></paragraph></subsection><subsection id="id5fa4d4d8aacf4b1bbc1ccb41f7fb544d"><enum>(n)</enum><header>Use of force and other purposes</header><text>While activated, personnel of a partner agency are designated as special officers within the United States Capitol Police, in accordance with paragraph (2) of section 1017(a) of division H of the Consolidated Appropriations Resolution, 2003 (<external-xref legal-doc="usc" parsable-cite="usc/2/1974">2 U.S.C. 1974(a)</external-xref>), as added by this section, and, as such, shall conduct law enforcement and security functions under agreed upon use of force and other operational purposes, as determined by the Chief, in accordance with the Task Force agreements.</text></subsection><subsection id="id74ead1f2d32046448a0051db3278320c"><enum>(o)</enum><header>Annual reporting</header><text>The Chief shall submit with the annual budget justification of the United States Capitol Police a report documenting the activities of the Task Force from the prior year, which shall include—</text><paragraph id="ideb211b5bd23d4760b39f1fb8c39cc6d4"><enum>(1)</enum><text>the number and status of Task Force agreements;</text></paragraph><paragraph id="id56585b6976c444cbb0a08abb041a271d"><enum>(2)</enum><text>the number and type of training and exercises conducted in support of the Task Force capabilities;</text></paragraph><paragraph id="idaa0dace1d44e4b1e9b72c11fb817c5bf"><enum>(3)</enum><text>a summary of the command staff meetings relating to Task Force capabilities conducted during the reporting period;</text></paragraph><paragraph id="id5ef7479b84ad4d7ba4c253cdd4f7e262"><enum>(4)</enum><text>a summary of the types and scope of operational activations of the Task Force during the reporting period;</text></paragraph><paragraph id="idfc26cc98b62b45ed8c743cae2f5a6e49"><enum>(5)</enum><text>a summary of the after-action reports following operational activations of the Task Force during the reporting period; and</text></paragraph><paragraph id="idb66f7bfcd4e540aaae4a6a23f68874b7"><enum>(6)</enum><text>a summary of the expenditures from the Fund to support the Task Force.</text></paragraph></subsection><subsection id="idb1b0143dccea4d26a59ed6807c7efe33"><enum>(p)</enum><header>Auditing</header><paragraph id="id01bbb4a6d7734db090cf14ee3998a2f2"><enum>(1)</enum><text>The Inspector General of the United States Capitol Police shall conduct an annual audit of the operation of the United States Capitol Protection Task Force, concurrently with the audit of the annual financial statements of the United States Capitol Police required under section 108(b)(2)(D) of the Legislative Branch Appropriations Act, 2001 (<external-xref legal-doc="usc" parsable-cite="usc/2/1903">2 U.S.C. 1903(b)(2)(D)</external-xref>).</text></paragraph><paragraph id="id264cb1e7945945cb8736a822d76bda4d"><enum>(2)</enum><text>The Government Accountability Office shall conduct periodic reviews of the activities and operations of the United States Capitol Protection Task Force and report to the Congress, and have access to, and the right to make and retain copies of, the records of the Task Force and its component organizations pertinent to its activities and operations.</text></paragraph></subsection><subsection id="id2a07f19d82064470ac2a973297746567"><enum>(q)</enum><header>Capitol police special officers</header><text>Section 1017(a) of division H of the Consolidated Appropriations Resolution, 2003 (<external-xref legal-doc="usc" parsable-cite="usc/2/1974">2 U.S.C. 1974(a)</external-xref>) is amended—</text><paragraph id="id8d75677341df46989a42b4c9a86ef7f0"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and adjusting the margin accordingly;</text></paragraph><paragraph id="id6fdc9912eb9d4c4bae650aa1f6e1d6ea"><enum>(2)</enum><text>by striking <quote>In the event of an emergency,</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1a50bf4cb0cb4b32afca5135ca66349d"><paragraph id="id969aae087c634d22a6c86fb211c57cfb"><enum>(1)</enum><header>Authority generally</header><text>In the event of an emergency,</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id6244503fba494a14b70d3bafb165b790"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id20f0c11ba508463cb817dadd553682b8"><paragraph id="idb05b36ef69bc40f9a228a24a5cb03816"><enum>(2)</enum><header>Automatic designation of united states capitol protection task force</header><subparagraph id="id279e88d5ec824bc0a25dec013d3bb8ec"><enum>(A)</enum><header>Definitions</header><text>In this paragraph, the terms <quote>activate</quote> and <quote>partner agency</quote> have the meanings give such terms in the United States Capitol Protection Task Force Act.</text></subparagraph><subparagraph id="id2f7bc1d00d47410d828710d41ef2af27"><enum>(B)</enum><header>Automatic designation</header><text>Any law enforcement officer of a partner agency that is activated under the United States Capitol Protection Task Force Act shall be deemed to have been appointed to serve as a special officer of the Capitol Police within the authorities of the Capitol Police in policing the Capitol buildings and grounds.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><appropriations-small id="idC592E50324D54F00B9022F1D7AC65649"><header>CAPITOL POLICE SALARY CAP ADJUSTMENT</header></appropriations-small><section id="id2E8301E3171844709A258746663258F1"><enum>705.</enum><text display-inline="yes-display-inline">For the purposes of administering pay during calendar year 2021, the limitation on the maximum rate of gross compensation under this subsection for any member or civilian employee of the Capitol Police whose compensation includes overtime pay under the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) shall be limited to Executive Schedule II at $199,300. Excluded from this limitation for calendar year 2021 shall be retention bonuses and hazard bonuses related to the events of January 6th. </text></section><appropriations-major id="idCAA01FBB3E5A450FB5BB619079A65075"><header>ARCHITECT OF THE CAPITOL</header></appropriations-major><appropriations-intermediate id="idA8627B4952D5464DA7182F8BA4E4DECB"><header>Capital construction and operations</header></appropriations-intermediate><appropriations-small id="idA45F31EFC9154351806DEA1ADA2BA71D"><header>(INCLUDING TRANSFER OF FUNDS)</header><text display-inline="no-display-inline">For an additional amount for <quote>Capital Construction and Operations</quote>, $525,000,000, to remain available until expended, to respond to the attack on the United States Capitol Complex that occurred on January 6, 2021, and for related purposes, including for Capitol Complex emergency response and infrastructure security costs of: (1) providing support for the Architect of the Capitol, the Sergeants at Arms of the House of Representatives and the Senate, the United States Capitol Police, and the Library of Congress in responding to the attack and in preparing for and mitigating the effects of similar attacks in the future; (2) repairing public facilities damaged by the attack; (3) securing vulnerabilities of buildings and infrastructure in the Complex; and (4) updating and enhancing physical security in the Complex, including making revisions to the landscape design infrastructure of the Complex and operational readiness:<proviso><italic> Provided</italic></proviso>, That of such amount, $100,000,000 shall be immediately transferred to <quote>Capitol Police Buildings, Grounds and Security</quote>, for construction of security screening vestibules at the Capitol Building, and design and construction of security screening vestibules at the House of Representatives and Senate office buildings: <proviso><italic>Provided further</italic></proviso>, That of such amount, $40,000,000 may be used to restore amounts, either directly or through reimbursement, for obligations incurred for the same purposes by the Architect of the Capitol prior to the date of the enactment of this Act: <proviso><italic>Provided further</italic></proviso>, That any funds transferred by the Architect pursuant to the authority in the preceding proviso shall be merged with and made available for the same purposes, and period of availability, as the appropriations to which the funds are transferred: <proviso><italic>Provided further</italic></proviso>, That of such amount, $300,582,000 is available for the replacement of existing windows and doors in the Capitol Building and shall include necessary related hardening work on the House of Representatives and Senate office buildings: <proviso><italic>Provided further</italic></proviso>, That of such amount, $2,000,000 is available for preliminary planning, study, and design of additional sensitive compartmented information facility space for the Senate, in coordination with the Office of the Secretary of the Senate: <proviso><italic>Provided further</italic></proviso>, That funds made available under this heading in this chapter may be used for design, installation, landscape architecture, and to maintain a retractable security system as part of an interconnected security of the United States Capitol Grounds: <proviso><italic>Provided further</italic></proviso>, That amounts made available under this heading in this chapter for the purposes specified in the preceding proviso shall be in addition to amounts otherwise available for such purposes: <proviso><italic>Provided further</italic></proviso>, That none of the funds made available in this or any other Act in prior fiscal years, this fiscal year, or any fiscal year thereafter may be used to install permanent, above-ground fencing around the perimeter, or any portion thereof, of the United States Capitol Grounds, as described in section 5102 of title 40, United States Code: <proviso><italic>Provided further</italic></proviso>, That as soon as practicable after the date of the enactment of this Act, a signed, detailed spending plan for the use of the amount provided under this heading in this chapter, other than the amount transferred pursuant to the first id="id6DE96A133F4F45E0936A7D745D919C3B"><header>POSTPONEMENT OF MEDICAL EXAM FOR AFGHAN ALLIES WHO ARE ELIGIBLE FOR SPECIAL IMMIGRANT VISAS</header></appropriations-small><section id="idFE630971458B4DFB9247A66CE0749E49"><enum>802.</enum><subsection commented="no" display-inline="yes-display-inline" id="id3acfb33ff4ed4dd3959efd262057ab34"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Secretary of State or the Secretary of Homeland Security may waive any requirement to undergo a medical exam under section 232 of the Immigration and Nationality (<external-xref legal-doc="usc" parsable-cite="usc/8/1222">8 U.S.C. 1222</external-xref>), or any other applicable requirement to undergo a medical exam prior to admission to the United States, for aliens described in section 602(b)(2) of the Afghan Allies Protection Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note).</text></subsection><subsection id="id13bc86e2af6f4e44862778e62c074c82"><enum>(b)</enum><header>Duration</header><text>A waiver under subsection (a) shall be for a period of 1 year, which may be extended for additional 1-year periods.</text></subsection><subsection id="idd795d55c4e794fda9599bb6ef8e1e8e6"><enum>(c)</enum><header>Requirement for medical exam after admission</header><paragraph id="id25cfee56ad714caf89a35364c4e0080b"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security, in consultation with the Secretary of Health and Human Services, shall ensure that an alien who does not undergo a medical exam prior to admission to the United States pursuant to this section receives such an exam not later than 45 days after the date on which the alien is admitted to the United States.</text></paragraph><paragraph id="idb2ca1b87ed2b43f393aa08575f6811d8"><enum>(2)</enum><header>Report</header><text>With respect to each such alien, not later than 1 year after the date on which the waiver authority under subsection (a) is exercised, and not later than the date that is 1 year after the date on which any extension under subsection (b) is granted, the Secretary of Homeland Security, in consultation with the Secretary of Health and Human Services, shall submit to the appropriate committees of Congress a report on the medical exams undertaken by the alien under paragraph (1).</text></paragraph></subsection><subsection id="idf39542da79234eb1a72eeb256220200c"><enum>(d)</enum><header>Notification</header><text>With respect to each alien for whom the Secretary of State or the Secretary of Homeland Security exercises the waiver authority under subsection (a) or extends such a waiver under subsection (b), the Secretary of State or the Secretary of Homeland Security, as applicable, shall notify the appropriate committees of Congress as soon as practicable thereafter.</text></subsection><subsection id="idbe914e59195b402489d863b3bac56335"><enum>(e)</enum><header>Appropriate committees of congress</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph id="id65b7cc1e92e9487f944439597308b742"><enum>(1)</enum><text>the Committee on Armed Services, the Committee on the Judiciary, the Committee on Foreign Relations, and the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></paragraph><paragraph id="id74d4caa3af9049269ae652b5dc359706"><enum>(2)</enum><text>the Committee on Armed Services, the Committee on the Judiciary, the Committee on Foreign Affairs, and the Committee on Homeland Security of the House of Representatives. </text></paragraph></subsection><subsection id="id2E9B8C767659455A81B3D27A76B78C9B"><enum>(f)</enum><header>Emergency requirement</header><text>The amount provided by this section is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</text></subsection></section><appropriations-small id="idB1A3F4EACA69483E938A91E56A795D76"><header>SPECIAL IMMIGRANT STATUS FOR CERTAIN SURVIVING SPOUSES AND CHILDREN</header></appropriations-small><section id="idCC7477442B8C4166B2B23AEB33DA0375"><enum>803.</enum><subsection commented="no" display-inline="yes-display-inline" id="id7fc25ebfaf37408f89dc3ff537349157"><enum>(a)</enum><header>Immigration and Nationality Act</header><text>Section 101(a)(27)(D) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)(D)</external-xref>) is items 2 ems to the right;</text></paragraph><paragraph id="idc557e5bfa10b4cce99fbce6ab33bc946"><enum>(2)</enum><text>by redesignating clauses (i) and (ii) as subclauses (I) and (II), respectively, and moving such subclauses 2 ems to the right;</text></paragraph><paragraph id="ida195f1d876304f8ca8295fa8f07190a9"><enum>(3)</enum><text>in the matter preceding subclause (I), as redesignated, by striking <quote>An alien is described</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id45ffa6965f264877aba29faeed794fc3"><subclause id="id1c85105df02741d192cef3db51f7e712"><enum>(I)</enum><header>In general</header><text>An alien is appropriations accounts shall be available under the authorities and conditions applicable to such appropriations accounts for fiscal year 2021.</text></section><section section-type="subsequent-section" id="id840AD6AB3A1F4621AA8CEE986E29134B"><enum>904.</enum><text display-inline="yes-display-inline">Each amount appropriated in this Act may be made available to restore amounts, either directly or through reimbursement, for obligations incurred for the purposes provided herein for such appropriation prior to the date of the enactment of this Act.</text></section><section section-type="subsequent-section" id="id3F430614F36841299DCE522EDD3B05ED"><enum>905.</enum><text display-inline="yes-display-inline">In this Act, the term <term>coronavirus</term> means SARS–CoV–2 or another coronavirus with pandemic potential. </text></section><section section-type="subsequent-section" id="idD89C360FFC42412D80338B281C05BC66"><enum>906.</enum><text display-inline="yes-display-inline">Each amount designated in this Act by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 shall be available (or rescinded or transferred, if applicable) only if the President subsequently so designates all such amounts and transmits such designations to the Congress.</text></section><section section-type="subsequent-section" id="id39EF483D08044E36AF727D2811263608"><enum>907.</enum><text display-inline="yes-display-inline">Any amount appropriated by this Act, designated by the Congress as an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 and subsequently so designated by the President, and transferred pursuant to transfer authorities provided by this Act shall retain such designation.</text></section><section display-inline="no-display-inline" id="H04ED21D38F4F4CB58B44F5AD3A77F561" section-type="undesignated-section"><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Emergency Security Supplemental to Respond to January 6th Appropriations Act,
