which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the Consolidated Rail Infrastructure and Safety Improvements Program, and for other purposes.</official-title></form><legis-body><section id="idFD3221EA3BE74016B7BD0DF85D2E0224" section-type="section-one"><enum>1.</enum><header>Consolidated rail infrastructure and safety improvements</header><subsection id="idE5FD7249633E40F3ACD6FF28D656BA3B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 22907 of title 49, United States Code, is amended—</text><paragraph id="id0B1DA7167313417E8A106644D407D24E"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id99af781fe6694ae3bebff7f55e9e740e"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>(including the District of Columbia)</quote> after <quote>State</quote>;</text></subparagraph><subparagraph id="idc013773538d045a998251641ab6196ac"><enum>(B)</enum><text>by redesignating paragraphs (8) through (11) as paragraphs (10) through (13), respectively; and</text></subparagraph><subparagraph id="id5e8ad1b1456847beb648d374ebbd0235"><enum>(C)</enum><text>by inserting after paragraph (7), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida3b3b24b9be04a4cae9371f936ef40c8"><paragraph id="id88f874b452844f92be0ea3e8ad0a36cd"><enum>(8)</enum><text>An association representing 1 or more railroads described in paragraph (7).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block><quoted-block style="OLC" display-inline="no-display-inline" id="idcbe2cf53d2af418c924041323c8dbdfc"><paragraph id="ida6a109bdff684fdba7ebc3588fe9e2dc"><enum>(9)</enum><text>A federally recognized Indian tribe.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id4cd0d61e4a874925ab62c9551a42b406"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id796b58fa89fe40c4894cdfab61477f9b"><enum>(A)</enum><text>by redesignating paragraphs (11) and (12) as paragraphs (13) and (14), respectively;</text></subparagraph><subparagraph id="id3e4d8021b7794981920c6175fbe955c6"><enum>(B)</enum><text>by inserting after paragraph (10) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1d0fbde7051c48aca37fd9e25d824cfc"><paragraph id="idc0c6454d021348e3ae2662bae6aeb9f5"><enum>(11)</enum><text>The development and implementation of measures to prevent trespassing and reduce associated injuries and fatalities.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block><quoted-block style="OLC" display-inline="no-display-inline" id="id24b9f5b835fe4621aa98322698f7f45e"><paragraph id="id056da8bdf33741c08db837fdc0ac7136"><enum>(12)</enum><text>Rehabilitating, remanufacturing, procuring, or overhauling one or more rail locomotives, provided that such activities result in a significant reduction of emissions.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idf395bafff7c74777a92827c7d7ae5a8e"><enum>(C)</enum><text>by inserting after paragraph (14), as redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id57152cf28a6f42488a3189f6e73bb9c9"><paragraph id="id57c4c6a62779454890c428840ecc7d44"><enum>(15)</enum><text>Research, development, and testing to advance and facilitate innovative rail projects, including projects using electromagnetic guideways in an enclosure in a very low-pressure environment.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idDB04FF1371DA48268A23020779555AAC"><enum>(3)</enum><text>in subsection (e)—</text><subparagraph id="idBE8DDB56683546FB850F7EA1905C9F9D"><enum>(A)</enum><text>in paragraph (1), by striking <quote>shall—</quote> and all that follows and inserting <quote>shall select projects that will maximize the net benefits of the funds appropriated for use under this section, considering the cost-benefit analysis of the proposed project, including anticipated private and public benefits relative to the costs of the proposed project and factoring in the other considerations described in paragraph (2).</quote>; and</text></subparagraph><subparagraph id="id9A61859317C34636916E95D59E416E7D"><enum>(B)</enum><text>in paragraph (3), by striking <quote>(B)</quote>; and</text></subparagraph></paragraph><paragraph id="id2583ad61ecb9484bb06d4996d624f7a4"><enum>(4)</enum><text>in subsection (h), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8d1717cf2cfe4d04ae436b4f337a66cb"><paragraph id="ided79d636a5df4b3b967943368e42bfd2"><enum>(4)</enum><header>Grade crossing and trespassing projects</header><text>Applicants may use costs incurred for preliminary engineering associated with highway-rail grade crossing improvement projects under subsection (c)(5) and trespassing prevention projects under subsection (c)(11) to satisfy the non-Federal share requirements.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id00d361ec8b5347618108ac77b6d473cd"><enum>(b)</enum><header>Rule of construction</header><text>The amendments made by subsection (a) may not be construed to affect any grant, including any application for a grant, made under section 22907 of title 49, United States Code, before the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
