which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 49, United States Code, to modify the threshold for small start projects under the fixed guideway capital investment grant program, to allow certain environmental review expenditures to count for purposes of non-Federal matches, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Fixed guideway capital investment grants</header><text display-inline="no-display-inline">Section 5309 of title 49, United States Code, is amended—</text><paragraph id="idF1225649173E4EEAAE1D041CB0288919"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idd631c94a006b4c7db1fa217613b7f072"><enum>(A)</enum><text>by redesignating paragraphs (2) through (7) as paragraphs (3) through (8), respectively;</text></subparagraph><subparagraph id="idcbc406bd1dba459a8fa24211e4e9abae"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide8651163a2004353b410f65b31b8067c"><paragraph id="idecda633be1d045b49dca0342c60c6578"><enum>(2)</enum><header>Commuter or destination-based bus rapid transit project</header><text>The term <term>commuter or destination-based bus rapid transit project</term> means a small start project utilizing buses—</text><subparagraph id="idd127c5eb93ac40c1b0c01de180447437"><enum>(A)</enum><text>in which the project represents a substantial investment in a defined corridor, as demonstrated by features that emulate the services provided by commuter rail or other rail fixed guideway public transportation systems, including—</text><clause id="id2d55efe54df74cfba47d3eb2cc931d66"><enum>(i)</enum><text>defined stations;</text></clause><clause id="id67b28453fd8d4528a187475ba79c70a9"><enum>(ii)</enum><text>traffic signal or access to managed lanes for public transportation vehicles;</text></clause><clause id="idc877825c3c2d4a07ad5d9e52843108e7"><enum>(iii)</enum><text>short headway services for a substantial part of weekdays; and</text></clause><clause id="id014887766cd143ab85f83ec6fe5e9585"><enum>(iv)</enum><text>any other features the Secretary may determine support a long-term corridor investment; and</text></clause></subparagraph><subparagraph id="id5da2c6bfb9964bc4877c72343a4d575f"><enum>(B)</enum><text>in which—</text><clause id="idedd6ac56b29d4512a7358efbb5b819b5"><enum>(i)</enum><text>the majority of the project does not operate in a separated right-of-way dedicated for public transportation use during peak periods; and</text></clause><clause id="ide2d0591cbb1949b8a80bb8b4fee93c84"><enum>(ii)</enum><text>a substantial portion of the project operates in a highway right-of-way.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idDDCE502350134D4E80E009F561183C60"><enum>(C)</enum><text>in paragraph (8) (as so redesignated)—</text><clause id="idF8DBBF937E294FB2861C1F46CB7D3596"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>$100,000,000</quote> and inserting <quote>$320,000,000</quote>; and</text></clause><clause id="idB80F6F28A56E4DD9A31AE9C9EA87C612"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>$300,000,000</quote> and inserting <quote>$400,000,000</quote>; </text></clause></subparagraph></paragraph><paragraph id="id1E71C5311C2B4953BB6E1515526A99BF"><enum>(2)</enum><text>in subsection (h), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id548ca9db320a437b9efe5efa15a2cd56"><paragraph id="idd6370752f22a4adaaa7bfcd854eab2b1"><enum>(8)</enum><header>Commuter or destination-based bus rapid transit project ratings</header><text>In issuing policy guidance under subsection (g)(5), the Secretary may establish alternative evaluation criteria for commuter or destination-based bus rapid transit projects for—</text><subparagraph id="idb3dbc7b46f7249c58e7fdc16c7cf3b0e"><enum>(A)</enum><text>economic development effects associated with those projects; or</text></subparagraph><subparagraph id="id40ab45322f0f43369c102a4a59abb784"><enum>(B)</enum><text>policies and land use patterns that support public transportation.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idFC81A4BCEBBF408CA3D46AC09C51DC91"><enum>(3)</enum><text>in subsection (k)(2), by striking subparagraphs (E) and (F);</text></paragraph><paragraph id="idAD9FD13E47F74EA8B3D229F0917DDC06"><enum>(4)</enum><text>in subsection (l), by adding at the end the following:</text><quoted-block id="id990FD29994004DD5898FAB21BECBE52B" style="USC" act-name=""><paragraph id="id78E6EA3AB4E641DFA1855BD1CA865708"><enum>(9)</enum><header>Environmental review expenditures</header><text>Notwithstanding any other provision of law, with respect to a project that receives a grant under this section, an expenditure made to comply with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) before the project enters project development may be considered as an expenditure that helps meet the non-Federal financial commitment required for that project under this section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id738BF9E33F944035B43D21EDD5B0CABA"><enum>(5)</enum><text>in subsection (o)—</text><subparagraph id="idEFF9ACAF8D6E4EA69D1EA80C52A1113A"><enum>(A)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph id="id6AAC0884E7F64F698B4F6FB3DA8DBD7C"><enum>(B)</enum><text>by redesignating paragraph (3) as paragraph (2); and</text></subparagraph><subparagraph id="idFC7D66607F394D63A8DC4A5A46358513"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="id7F9F17544FCA41B4BB287C2C9EABA942" style="USC" act-name=""><paragraph id="id2AC38634C48047C3AA8959C52427321D"><enum>(3)</enum><header>Program dashboard</header><subparagraph id="id5adf5421c17c4ca4a8314ad1cb6cdfe8"><enum>(A)</enum><header>Establishment</header><text>The Secretary shall establish and maintain on a publicly available website a fixed guideway capital investment grant program dashboard.</text></subparagraph><subparagraph id="idecd820065ef84e7bbb1e0e22c86ced47"><enum>(B)</enum><header>Requirements</header><text>The dashboard established under subparagraph (A) shall contain—</text><clause id="ide795a774ca7f4cda9da9171b23c54737"><enum>(i)</enum><text>the amount of funding appropriated to the program under this section for each fiscal year for each program component, including funding for core capacity improvement projects, small start projects, and new fixed guideway capital projects, if specific amounts are appropriated for each program component;</text></clause><clause id="ide87cce11227a4d09b714021a2792dcbe"><enum>(ii)</enum><text>the amount of funding allocated from the program under this section for each fiscal year to each program component, including core capacity improvement projects, small start projects, and new fixed guideway capital projects; and</text></clause><clause id="idaef0033976254d82b929adf95912edd0"><enum>(iii)</enum><text>the amount of funding obligated from the program under this section to each program component, including core capacity improvement projects, small start projects, and new fixed guideway capital projects.</text></clause></subparagraph><subparagraph id="id7517cc7839184c35a00d075a4b33660a"><enum>(C)</enum><header>Project tracker</header><text>The dashboard established under subparagraph (A) shall, to the extent practicable, include a comprehensive tracker of the status of each project for which funding under this section is sought for the duration during which the project participates in the program under this section, which shall include—</text><clause id="id6607c83f0fd644fe99e27f2c53556006" commented="no"><enum>(i)</enum><text>the status of the project in the approval process, including—</text><subclause id="id2327b44f49ee43a3a702d8107cb3332e"><enum>(I)</enum><text>the date on which the project entered into each phase of the approval process, including, as applicable, the date on which project development, engineering, and construction begins and the date on which a grant agreement is executed; and</text></subclause><subclause id="idFE42D62EB3A941FDA022F57FA39636F0"><enum>(II)</enum><text>the status of a request for approval of entry into each phase of the approval process, including—</text><item id="id775B153799F9494CAA3D81AEE9EC3E12"><enum>(aa)</enum><text>whether the Federal Transit Administration, the Office of the Secretary, the Office of Management and Budget, or another Federal agency is reviewing the request for approval;</text></item><item id="idE170F9FC56A44B6DAAAB69A512BBCD2E"><enum>(bb)</enum><text>the date on which the project sponsor requested approval for entry into a new phase; and</text></item><item id="idAE3A654766F84A10B67E76F4FF8EA70C"><enum>(cc)</enum><text>whether the Federal Transit Administration, the Office of the Secretary, the Office of Management and Budget, or any other Federal agency, as applicable, has completed the review of the request for approval;</text></item></subclause></clause><clause id="id72C915F5A15D4523B511A5B2B7A7D982"><enum>(ii)</enum><text>the status of the environmental review process for the project through a link to the relevant information with respect to the project on the Permitting Dashboard required under section 41003(b) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-2">42 U.S.C. 4370m–2(b)</external-xref>);</text></clause><clause id="idF5950A801C164CB3A9FD1A284C3A0326"><enum>(iii)</enum><text>the status of each project for which an early systems work agreement is requested, including—</text><subclause id="id1FD2B4C773AF4B66B33CDBC470048863"><enum>(I)</enum><text>whether the Federal Transit Administration, the Office of the Secretary, or the Office of Management and Budget is reviewing the request for the early systems work agreement;</text></subclause><subclause id="idD2A25127DF9749748176E668907E435F"><enum>(II)</enum><text>the status of the review under that office; and</text></subclause><subclause id="id125801112B8942EA826FAFC32B420A06"><enum>(III)</enum><text>the date on which—</text><item id="id351434CD4D3F4A1C854CDE0C2AE0A8C3"><enum>(aa)</enum><text>the request was received;</text></item><item id="id76E946C24F00427AB394EC22F4347EBB"><enum>(bb)</enum><text>the request was approved or denied; and</text></item><item id="id422311864F8141DEB0E88C70640999BB"><enum>(cc)</enum><text>if the request was approved, the early systems work agreement was issued;</text></item></subclause></clause><clause id="idB524223390684014A3FC23F0AB594CA6"><enum>(iv)</enum><text>based on information from the project sponsor, the locally proposed financial plan for the project, which shall include the estimated breakdown of—</text><subclause id="id0F94297745BC44208D3DD01EBDD271FF"><enum>(I)</enum><text>Federal funds anticipated from sources other than the funding provided under this section; and</text></subclause><subclause id="id08A993ED74254862884F228BE9EF949F"><enum>(II)</enum><text>State and local funds; and</text></subclause></clause><clause id="idd75fe1f0eae4475ea5c4c5f384bcb0d6"><enum>(v)</enum><text>based on information provided by the project sponsor, the status of the project sponsor in securing the required non-Federal cost share.</text></clause></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
