which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>January 20, 2022</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To enhance cybersecurity education.</official-title></form><legis-body><section id="idDA15C182E4274E7EBD04002C356E1048" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cybersecurity Opportunity Act</short-title></quote>.</text></section><section id="id9B43CA59689C43AAA06924E6C30D5636" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Dr. David Satcher cybersecurity education grant program</header><subsection id="idFC98E526457C45CCB6302DF3FBC365BC"><enum>(a)</enum><header>Authorization of grants</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall—</text><paragraph id="idB19347EDEF2947FBBD3247E4E71A5712"><enum>(1)</enum><text>award grants to assist public institutions of higher education that have an enrollment of needy students (as defined in section 312(d) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058(d)</external-xref>)), Historically Black Colleges and Universities, and minority-serving institutions, to establish or expand cybersecurity programs, to build and upgrade institutional capacity to better support new or existing cybersecurity programs, including cybersecurity partnerships with public and private entities, and to support such institutions on the path to producing qualified entrants in the cybersecurity workforce or becoming a National Center of Academic Excellence in Cybersecurity through the program carried out by the National Security Agency and the Department of Homeland Security; and</text></paragraph><paragraph id="id443A0AE77E1042F39D6A5E26058D4AF1"><enum>(2)</enum><text>award grants for a 5-year pilot period to build capacity to public institutions of higher education that have an enrollment of needy students (as defined in section 312(d) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058(d)</external-xref>)), Historically Black Colleges and Universities, and minority-serving institutions, to expand cybersecurity education opportunities, cybersecurity technology and programs, cybersecurity research, and cybersecurity partnerships with public and private entities. </text></paragraph></subsection><subsection id="idcd36ae0c9b63474ebe731b4da33315b9"><enum>(b)</enum><header>Applications</header><text>An eligible institution seeking a grant under subsection (a) shall submit an application to the Secretary of Homeland Security at such time, in such manner, and containing such information as the Secretary may reasonably require, including a statement of how the institution will use the funds awarded through the grant to expand cybersecurity education opportunities at the eligible institution.</text></subsection><subsection id="id689f87acf85e4111ac84c6effd8a53b1"><enum>(c)</enum><header>Activities</header><text>An eligible institution that receives a grant under this section may use the funds awarded through such grant for increasing research, education, technical, partnership, and innovation capacity, including for—</text><paragraph id="id287b7f8697db4c0f9fab91fa9ce25c2a"><enum>(1)</enum><text>building and upgrading institutional capacity to better support new or existing cybersecurity programs, including cybersecurity partnerships with public and private entities; and </text></paragraph><paragraph id="id91e72ae1a6a440aa82a027d3e04f8f5c"><enum>(2)</enum><text>building and upgrading institutional capacity to provide hands-on research and training experiences for undergraduate and graduate students. </text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id6a5c7da2-679d-407a-8f66-f4dbf05dc7d1" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cybersecurity Opportunity Act</short-title></quote>.</text></section><section id="id738ae340-b784-42ba-9cb3-3b06a117c37e" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Dr. David Satcher cybersecurity education grant program</header><subsection id="idb134c9ee0f6345cc8788c8dea21dc8ff"><enum>(a)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="id3346dbb3999b4c5b9726a9039552446c"><enum>(1)</enum><header>Enrollment of needy students</header><text>The term <term>enrollment of needy students</term> has the meaning given the term in section 312(d) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058(d)</external-xref>).</text></paragraph><paragraph id="id7e4c304be57e45c79ec8ba2c482571da"><enum>(2)</enum><header>Historically black college or university</header><text>The term <term>historically Black college or university</term> has the meaning given the term <term>part B institution</term> as defined in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>). </text></paragraph><paragraph id="ida9c4823f57df43b09e0c32d9af8afb7f"><enum>(3)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph><paragraph id="id41006da5eb654e28922f3b0f6b57981a"><enum>(4)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means an institution listed in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></paragraph><paragraph id="id72596731C6B34E908834FFE78BE958B0"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security. </text></paragraph></subsection><subsection id="id172b16c1-291c-4c61-96cf-c56629ddb4a0"><enum>(b)</enum><header>Authorization of grants</header><paragraph id="id90E5582655CE442DAEBA1E3164A90831"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall—</text><subparagraph id="id8351ec66-036a-4460-9213-dd4424a2f891"><enum>(A)</enum><text>award grants to assist institutions of higher education that have an enrollment of needy students, historically Black colleges and universities, and minority-serving institutions, to establish or expand cybersecurity programs, to build and upgrade institutional capacity to better support new or existing cybersecurity programs, including cybersecurity partnerships with public and private entities, and to support such institutions on the path to producing qualified entrants in the cybersecurity workforce or becoming a National Center of Academic Excellence in Cybersecurity; and</text></subparagraph><subparagraph id="id1b2357ad-bcbe-4495-bde1-8e53e8aa7ee7"><enum>(B)</enum><text>award grants to build capacity at institutions of higher education that have an enrollment of needy students, historically Black colleges and universities, and minority-serving institutions, to expand cybersecurity education opportunities, cybersecurity technology and programs, cybersecurity research, and cybersecurity partnerships with public and private entities. </text></subparagraph></paragraph><paragraph id="id6D3D4C98AE4A46D1ABBAC1230D55469D"><enum>(2)</enum><header>Reservation</header><text>The Secretary shall award not less than 50 percent of the amount available for grants under this Act to historically Black colleges and universities and minority-serving institutions.</text></paragraph><paragraph id="id37F20AD767BC4F00BD2EC9C3A925D959"><enum>(3)</enum><header>Coordination</header><text>The Secretary shall carry out this section in coordination with the National Initiative for Cybersecurity Education at the National Institute of Standards and Technology. </text></paragraph><paragraph id="id6D93AD7216ED48C3AB9386C8096D4B8B"><enum>(4)</enum><header>Sunset</header><text>The Secretary's authority to award grants under paragraph (1) shall terminate on the date that is 5 years after the date the Secretary first awards a grant under paragraph (1). </text></paragraph><paragraph id="id330777B4DB7C495BA32D523BE19B971E"><enum>(5)</enum><header>Amounts to remain available</header><text>Notwithstanding section 1552 of title 31, United States Code, or any other provision of law, funds available to the Secretary for obligation for a grant under this section shall remain available for expenditure for 100 days after the last day of the performance period of such grant. </text></paragraph></subsection><subsection id="id42e84f8c-0edc-4ac8-a598-529d94b9674c"><enum>(c)</enum><header>Applications</header><text>An eligible institution seeking a grant under subsection (a) shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require, including a statement of how the institution will use the funds awarded through the grant to expand cybersecurity education opportunities at the eligible institution.</text></subsection><subsection id="idb9b4a9ae-2b44-4bb9-8e80-9d93a7e8c2bb"><enum>(d)</enum><header>Activities</header><text>An eligible institution that receives a grant under this section may use the funds awarded through such grant for increasing research, education, technical, partnership, and innovation capacity, including for—</text><paragraph id="idd31b4d30-f204-4388-ab1c-5285d19b70ea"><enum>(1)</enum><text>building and upgrading institutional capacity to better support new or existing cybersecurity programs, including cybersecurity partnerships with public and private entities; </text></paragraph><paragraph id="id9d65d7dd-64cb-41e7-a072-990f25fb1fed"><enum>(2)</enum><text>building and upgrading institutional capacity to provide hands-on research and training experiences for undergraduate and graduate students; and</text></paragraph><paragraph id="id2B8369819D684D2C88455CCDC3BE4F0F"><enum>(3)</enum><text>outreach and recruitment to ensure students are aware of such new or existing cybersecurity programs, including cybersecurity partnerships with public and private entities. </text></paragraph></subsection><subsection id="id476c851597b245e88b9a07c7ea1c9245"><enum>(e)</enum><header>Reporting requirements</header><text>Not later than—</text><paragraph id="idFA9BF10DC0D64BA5B2B815D4AE5F1A3A"><enum>(1)</enum><text>1 year after the date of enactment of this Act, and annually thereafter until the Secretary submits the report under paragraph (2), the Secretary shall prepare and submit to Congress a report on the status and progress of implementation of the grant program under this Act, including on the number and nature of institutions participating, the number and nature of students served by institutions receiving grants, the level of funding provided to grant recipients, the types of activities being funded by the grants program, and plans for future implementation and development; and</text></paragraph><paragraph id="id2de72a975eef47fa8c155cf6271e319d"><enum>(2)</enum><text>5 years after the date of enactment of this Act, the Secretary shall prepare and submit to Congress a report on the status of cybersecurity education programming and capacity-building at institutions receiving grants under this Act, including changes in the scale and scope of these programs, associated facilities, or in accreditation status, and on the educational and employment outcomes of students participating in cybersecurity programs that have received support under this Act.</text></paragraph></subsection><subsection id="idB5FD7D343F3D42609E30AEA96795713B"><enum><added-phrase reported-display-style="italic">(f)</added-phrase></enum><header>Performance metrics</header><text>The Secretary of Homeland Security shall establish performance metrics for grants awarded under this section.</text></subsection></section></legis-body><endorsement><action-date>January 20, 2022</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
