Stafford Disaster Relief and Emergency Assistance Act to provide certain employment rights to reservists of the Federal Emergency Management Agency, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civilian Reservist Emergency Workforce Act of 2021</short-title></quote> or the <quote><short-title>CREW Act</short-title></quote>.</text></section><section id="idF801155DF8644F14B8310B5C9B9AA0EC" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Personnel performing service responding to presidentially declared major disasters and emergencies</header><text display-inline="no-display-inline">Section 306 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5149">42 U.S.C. 5149</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2054CBDF59F74283B62345CFA68BF651" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subsection id="id2E68D980C02F4341929E10F71F315EA8"><enum>(d)</enum><header>Personnel performing service responding to disasters and emergencies</header><paragraph id="idB9B02896ACDF44A3914D5C643F96372E"><enum>(1)</enum><header>USERRA Employment and Reemployment Rights</header><text>The Administrator shall, in a manner similar to the program described in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38, United States Code, afford protections, rights, benefits, and obligations to intermittent personnel appointed pursuant to subsection (b)(1) to perform service to the Federal Emergency Management Agency under sections 401 and 501 or to train for such service.</text></paragraph><paragraph id="idBD72E95E759842E4B5290AF439DB0FF1"><enum>(2)</enum><header>Notice of absence from position of employment</header><text>Preclusion of giving notice of service by necessity of service under subsection (b)(1) to perform service to the Federal Emergency Management Agency under sections 401 and 501 or to train for such service shall be considered preclusion by <quote>military necessity</quote> for purposes the protections, rights, benefits, and obligations afforded under paragraph (1) pertaining to giving notice of absence from a position of employment. A determination of such necessity shall be made by the Administrator and shall not be subject to review in any judicial or administrative proceeding. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="idc960f749-ae8d-43da-9532-09eb3e99cfe5" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civilian Reservist Emergency Workforce Act of 2021</short-title></quote> or the <quote>CREW Act</quote>.</text></section><section id="ide4028214-5852-4fe3-bb81-fc6d5aa1de05" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Personnel performing service responding to presidentially declared major disasters and emergencies</header><text display-inline="no-display-inline">Section 306 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5149">42 U.S.C. 5149</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4420a8aa-94c5-4ff0-a8db-51fa0426c97c" changed="added" reported-display-style="italic" committee-id="SSGA00"><subsection id="id7a18ddd9-5772-4f39-b74c-1453ca580119"><enum>(d)</enum><header>Personnel performing service responding to disasters and emergencies</header><paragraph id="id6c859bdc-d314-4f40-9e2a-152411badd36"><enum>(1)</enum><header>USERRA Employment and Reemployment Rights</header><text>The protections, rights, benefits, and obligations provided under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38, United States Code, shall apply to intermittent personnel appointed pursuant to subsection (b)(1) to perform service to the Federal Emergency Management Agency under sections 401 and 501 or to train for such service. </text></paragraph><paragraph id="id16b7d6a6-d4fc-4e73-b347-cd87321be0ce"><enum>(2)</enum><header>Notice of absence from position of employment</header><text>Preclusion of giving notice of service by necessity of service under subsection (b)(1) to perform service to the Federal Emergency Management Agency under sections 401 and 501 or to train for such service shall be considered preclusion by <quote>military necessity</quote> for purposes of section 4312(b) of title 38, United States Code, pertaining to giving notice of absence from a position of employment. A determination of such necessity shall be made by the Administrator and shall not be subject to review in any judicial or administrative proceeding.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id85D50BCCD85F4EDC98DAF7CCD3A8A9C0" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>3.</enum><header>Extension of certain employment and reemployment rights to FEMA reservists</header><subsection id="id613D21676A2B4AEB831C213EC2C5954B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4303 of title 38, United States Code, is amended—</text><paragraph id="id6746325107B041988BA22F9E3A33582F"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (13), by inserting before <quote>, and a period</quote> the following: <quote>, a period for which a person is absent from a position of employment due to an appointment into service in the Federal Emergency Management Agency as intermittent personnel under section 306(b)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5149">42 U.S.C. 5149(b)(1)</external-xref>)</quote>; </text></paragraph><paragraph id="idDCEC0F21A97A4C9E8120BDC4C45FC12D"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating the second paragraph (16) (relating to uniformed services) as paragraph (17); and</text></paragraph><paragraph id="id28A0C5C08FFE45FEB3775DED2C0AF26A"><enum>(3)</enum><text>in paragraph (17), as so redesignated, by inserting before <quote>and any other category</quote> the following: <quote>intermittent personnel who are appointed into Federal Emergency Management Agency service under section 306(b)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5149">42 U.S.C. 5149(b)(1)</external-xref>) or to train for such service,</quote>. </text></paragraph></subsection><subsection id="id4E5ADB2F0E714BEC935FD2474E290AC9"><enum>(b)</enum><header>Modification of exception for requirement for members of uniformed services to provide notice to employers to obtain certain employment and reemployment rights</header><text>Section 4312(b) of title 38, United States Code, is amended—</text><paragraph id="id57F9578311D94C8EBCE0CC29FDFC53F3"><enum>(1)</enum><text>by striking the second sentence;</text></paragraph><paragraph id="id1646F54BAD0B44489E7D2218D1EB29FB"><enum>(2)</enum><text>by inserting <quote>(1)</quote> before <quote>No notice</quote>; and</text></paragraph><paragraph id="id2B08989756DE4BFBABE911CA5BE92391"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC84D1CB479314EB4947874392D9314EA" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="id8868EE056A794D09BA7185723207A86F" indent="up1"><enum>(2)</enum><text>A determination of military necessity for purposes of paragraph (1) shall be made—</text><subparagraph id="id42BA7DDB666E4B0987B871A55CA07F6E"><enum>(A)</enum><text>except as provided in subparagraphs (B) and (C), pursuant to regulations prescribed by the Secretary of Defense;</text></subparagraph><subparagraph id="idE38B2264B9344838B5D1D62EAFBEF5B7"><enum>(B)</enum><text>for persons performing service to the Federal Emergency Management Agency under section 327 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5165f">42 U.S.C. 5165f</external-xref>) and as intermittent personnel under section 306(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5149">42 U.S.C. 5149(b)(1)</external-xref>), by the Administrator of the Federal Emergency Management Agency as described in sections 327(j)(2) and 306(d)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5165f">42 U.S.C. 5165f(j)(2)</external-xref> and 5149(d)(2)), respectively; or</text></subparagraph><subparagraph id="id00AB9C67153D4F02A6F8DC10A2A9106B"><enum>(C)</enum><text>for intermittent disaster-response appointees of the National Disaster Medical System, by the Secretary of Health and Human Services as described in section 2812(d)(3)(B) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300hh-11">42 U.S.C. 300hh–11(d)(3)(B)</external-xref>).</text></subparagraph></paragraph><paragraph indent="up1" id="id556695216A2F4262827BAF7765C45E8F"><enum>(3)</enum><text>A determination of military necessity under paragraph (1) shall not be subject to judicial review.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body><endorsement><action-date>October 26, 2021</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
