<official-title>To amend the Internal Revenue Code of 1986 to provide for direct-pay credit bonds in the case of certain bonds the proceeds of which are used for the replacement of lead drinking water service lines.</official-title>

<section section-type="section-one" id="H8ACDB8A86DC44F038CC115675064A6DD"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lead-Free America Bonds Act of 2021</short-title></quote>. </text></section> <section id="H1AEAFDA995904E898616414D3635E59D"><enum>2.</enum><header>Credit to issuer for lead drinking water service line bonds</header> <subsection id="HD1F29CAD01A74BF386F82E194AACBCDD"><enum>(a)</enum><header>In general</header><text>Subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/65">chapter 65</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text>

<section id="HC60AEF12A49A469D9570A18811457281"><enum>6431.</enum><header>Credit allowed to issuer for lead drinking water service line bonds</header>
<subsection id="H3D30F1C70B094CA0B96B10724DA5EE0F"><enum>(a)</enum><header>In general</header><text>In the case of a qualified lead drinking water service line bond, the issuer of such bond shall be allowed a credit with respect to each interest payment under such bond which shall be payable by the Secretary as provided in subsection (b).</text></subsection> <subsection id="H1F8CD50D339440D882788E9D0DA13765"><enum>(b)</enum><header>Payment of credit</header> <paragraph id="HF251D72ECA22400BA620EF3A305EDCE0"><enum>(1)</enum><header>In general</header><text>The Secretary shall pay (contemporaneously with each date on which interest is so payable) to the issuer of such bond (or to any person who makes such interest payments on behalf of such issuer) an amount equal to so much of such interest that is payable at a rate not in excess of the applicable interest rate determined under paragraph (2).</text></paragraph>
<paragraph id="H45B59F7950B94ADCB1AC168C45866073"><enum>(2)</enum><header>Applicable interest rate</header>
<subparagraph id="H27F05100B35C4E7B90EF00B42E8DFBA7"><enum>(A)</enum><header>In general</header><text>The applicable interest rate determined under this paragraph for any qualified lead drinking water service line bond shall be the rate which the Secretary estimates will permit the issuance of qualified lead drinking water service line bonds with a specified maturity or redemption date without discount and without additional interest cost.</text></subparagraph> <subparagraph id="H6C25C4C3ACBB4D0490D16B5B97042BCB"><enum>(B)</enum><header>Procedure for rate determinations</header> <clause id="HEC6E69F1CCED4FC996EA86EDD7EF71DA"><enum>(i)</enum><header>In general</header><text>Such rate with respect to any qualified lead drinking water service line bond shall be determined as of the first day on which there is a binding, written contract for the sale or exchange of the bond.</text></clause>
<clause id="H7E6AFB3167D5471ABF811519E4591247"><enum>(ii)</enum><header>Method and frequency</header><text display-inline="yes-display-inline">For purposes of this paragraph, the Secretary will determine and announce credit rates daily for qualified lead drinking water service line bonds based on the Secretary’s estimate of the yields on outstanding bonds from market sectors selected at the discretion of the Secretary that, for the business day immediately preceding the sale date of the bonds, have an investment grade rating of between A and BBB for bonds of a similar maturity and for which the interest would be included in gross income. </text></clause></subparagraph></paragraph></subsection> <subsection id="H1F4A6771183B4461B06C0B3B82F6FA17"><enum>(c)</enum><header>Qualified lead drinking water service line bond</header> <paragraph id="H0D66012F90B8473194308CA959AFFB00"><enum>(1)</enum><header>In general</header><text>For purposes of this section, the term <quote>qualified lead drinking water service line bond</quote> means any bond (other than a private activity bond) issued as part of an issue if—</text>
<subparagraph id="H767DC39BCD6443B89983A06AEF8747BC"><enum>(A)</enum><text display-inline="yes-display-inline">100 percent of the available project proceeds of such issue are to be used for replacing lead components of 1 or more eligible public water systems that are not lead free, including any publicly or privately owned portion of a lead service line of the eligible public water system,</text></subparagraph> <subparagraph id="H119D410453F84ACAA9E7224A2B621016"><enum>(B)</enum><text>the interest on such bond would (but for this section) be excludable from gross income under section 103,</text></subparagraph>
<subparagraph id="HB439522D967E49EEBC309581379AC545"><enum>(C)</enum><text>the issue price has not more than a de minimis amount (determined under rules similar to the rules of section 1273(a)(3)) of premium over the stated principal amount of the bond, and</text></subparagraph> <subparagraph id="HC1A84B6CF5E242D7B6CA1E379C088F4E"><enum>(D)</enum><text>prior to the issuance of such bond, the issuer makes an irrevocable election to have this section apply.</text></subparagraph><continuation-text continuation-text-level="paragraph">Except upon approval by the Environmental Protection Agency for circumstances in which there are emergent public health risks, none of the available project proceeds of such issue shall be used for a partial lead service line replacement.</continuation-text></paragraph>
<paragraph id="H753F392D1B7A4C44B387ED5C28B4823E"><enum>(2)</enum><header>Applicable rules</header><text>For purposes of applying paragraph (1)—</text> <subparagraph id="H2A5A562F95814497A6A18A1243C63A7E"><enum>(A)</enum><header>Not treated as federally guaranteed</header><text>For purposes of section 149(b), a qualified lead drinking water service line bond shall not be treated as federally guaranteed by reason of the credit allowed under this section.</text></subparagraph>
<subparagraph id="HDF29D86E012F4A79A178753CEA216715"><enum>(B)</enum><header>Application of arbitrage rules</header><text>For purposes of section 148, the yield on a qualified lead drinking water service line bond shall be reduced by the credit allowed under this section.</text></subparagraph></paragraph></subsection> <subsection id="H9B46AA99603F4D949F93C7B4F21BE196"><enum>(d)</enum><header>Definition and special rules</header><text>For purposes of this section—</text>
<paragraph id="H51E5711283B94A4981189E3F26D9DA23"><enum>(1)</enum><header>Interest includible in gross income</header><text>For purposes of this title, interest on any qualified lead drinking water service line bond shall be includible in gross income.</text></paragraph> <paragraph id="H62011CF3C6214EE58F0001A1BF087BB0"><enum>(2)</enum><header>Eligible public water system</header> <subparagraph id="H599FCCB149114E3BA275601960E817ED"><enum>(A)</enum><header>In general</header><text>The term <quote>eligible public water system</quote> means, with respect to any bond—</text>
<clause id="HE149041B78084F9C9D787AE617A6E034"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a public water system with respect to which the owner or operator was, during the 6-year period preceding the date of enactment of the <short-title>Lead-Free America Bonds Act of 2021</short-title>, required to give lead action level notice, such bond was issued during the 3-year period subsequent to the date of enactment of such Act, or</text></clause> <clause id="H12773D0426B345BE92CC2F93688D0385"><enum>(ii)</enum><text>in the case of a public water system with respect to which the owner or operator was, at any time subsequent to the date of enactment of the <short-title>Lead-Free America Bonds Act of 2021</short-title>, required to give lead action level notice, such bond was issued during the 3-year period subsequent to such notice.</text></clause></subparagraph>
<subparagraph id="H5EF081044A5F46A4BDDA92DFA5426C2A"><enum>(B)</enum><header>Public water system</header><text display-inline="yes-display-inline">The term <quote>public water system</quote> has the meaning given such term in section 1401(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f(4)</external-xref>).</text></subparagraph> <subparagraph id="HF4FB154248FE41348AE0C1E0E70B388C"><enum>(C)</enum><header>Lead free</header><text display-inline="yes-display-inline">The term <quote>lead free</quote> has the meaning given such term in section 1417(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-6">42 U.S.C. 300g-6(d)</external-xref>).</text></subparagraph>
<subparagraph id="HFC6AA2D0CC604914AD526A7E18E19A91"><enum>(D)</enum><header>Lead service line</header><text display-inline="yes-display-inline">The term <quote>lead service line</quote> has the meaning given such term in section 1459B(a)(4) of such Act (42 U.S.C. 300j-19b(a)(4)).</text></subparagraph> <subparagraph id="HDE813EF78BB0416EBE51C75DDD6BC6D5"><enum>(E)</enum><header>Lead action level notice</header><text display-inline="yes-display-inline">The term <quote>lead action level notice</quote> means notice under section 1414(c)(1)(D) of the Safe Water Drinking Act (42 U.S.C. 300g- 3(c)(1)(D)) that the public water system exceeded the lead action level. </text></subparagraph></paragraph>
<paragraph id="H15D72CDD2B814975A54F701BF056A5BD"><enum>(3)</enum><header>Failure to spend required amount of bond proceeds within 5 years</header>
<subparagraph id="H1C7F44824967459CBFEF0BCBCD99582E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If at the close of the 5-year period beginning on the date of issuance less than 100 percent of the available project proceeds of the issue are expended for the purposes specified in subsection (c)(1)(A), the issuer shall redeem all of the nonqualified bonds within 90 days after the end of such period. For purposes of this paragraph, the amount of the nonqualified bonds required to be redeemed shall be determined in the same manner as under section 142.</text></subparagraph> <subparagraph id="HF002BB9FA5FF4A0A8F3E3C1CBD1C9062"><enum>(B)</enum><header>Extension of period</header><text display-inline="yes-display-inline">Upon submission of a request prior to the expiration of the 5-year period under subparagraph (A), the Secretary may extend such period if the issuer establishes that the failure to expend the proceeds within such period is due to reasonable cause and the expenditures for the purposes described in subsection (c)(1)(A) will continue to proceed with due diligence.</text></subparagraph></paragraph>
<paragraph id="HB5C0813A257840C9BB8354DE1DE2B7A3"><enum>(4)</enum><header>Available project proceeds</header><text>The term <quote>available project proceeds</quote> means—</text> <subparagraph id="H515D117B27644B7D8E73C9F50647711B"><enum>(A)</enum><text>the excess of—</text>
<clause id="H05624F76817E4382B88A044952A2F2AA"><enum>(i)</enum><text>the proceeds from the sale of an issue, over</text></clause> <clause id="H8DD688B266D644F58C00027AE5D630B5"><enum>(ii)</enum><text>the sum of—</text>
<subclause id="H40EE10C816224E2DB73F85AEE7E01D23"><enum>(I)</enum><text>issuance costs financed by the issue (the extent that such costs do not exceed 2 percent of such proceeds), and</text></subclause> <subclause id="H45A0AABC4AE343F49F7EC851EBD0CF7F"><enum>(II)</enum><text>amounts in a reasonably required reserve (within the meaning of section 150(a)(3)) with respect to such issue), and</text></subclause></clause></subparagraph>
<subparagraph id="HF73AF0CBFFFD43D7A5997C8B4809ACE3"><enum>(B)</enum><text>the proceeds from any investment of the excess described in clause (i).</text></subparagraph></paragraph> <paragraph id="HDDD6A0E78D4A4275A1AA544263DCFD4E"><enum>(5)</enum><header>Current refundings allowed</header> <subparagraph id="HC4A9A74FFD4E4CE99D1D5722E30C0415"><enum>(A)</enum><header>In general</header><text>In the case of a bond issued to refund a qualified lead drinking water service line bond, such refunding bond shall be treated as a qualified lead drinking water service line bond for purposes of this section if—</text>
<clause id="H569D653B7B9A4DB7AD0DA04CC298E51A"><enum>(i)</enum><text>the average maturity date of the issue of which the refunding bond is a part is not later than the average maturity date of the bonds to be refunded by such issue,</text></clause> <clause id="HB7D0331397204B4BBCA9A5D580E347DC"><enum>(ii)</enum><text>the amount of the refunding bond does not exceed the outstanding amount of the refunded bond, and</text></clause>
<clause id="HB77EC5C0FF3F45F3ADDFE4A0CB85607C"><enum>(iii)</enum><text>the refunded bond is redeemed not later than 90 days after the date of the issuance of the refunding bond.</text></clause></subparagraph> <subparagraph id="HD96D08EB6D7C48D5AF1470A37913D9F2"><enum>(B)</enum><header>Determination of average maturity</header><text>For purposes of subparagraph (A)(i), average maturity shall be determined in accordance with section 147(b)(2)(A).</text></subparagraph></paragraph>
<paragraph id="HF402FE8FA9C24E1B963830EBFA851CEB"><enum>(6)</enum><header>Application of Davis-Bacon act requirements with respect to qualified lead drinking water service line bonds</header><text>Subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code, shall apply to projects financed with the proceeds of qualified lead drinking water service line bonds (other than bonds issued to refund a bond originally issued before the date of the enactment of this Act).</text></paragraph></subsection> <subsection id="HB35927451F5C41C389E6C51A0C40931D"><enum>(e)</enum><header>Regulations</header><text>The Secretary may prescribe such regulations and other guidance as may be necessary or appropriate to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H1325A5F783AA46E4915D1B8A742C5A0D"><enum>(b)</enum><header>Payments made under <external-xref legal-doc="usc" parsable-cite="usc/26/6431">section 6431</external-xref> of the Internal Revenue Code of 1986</header><text>Section 255(g)(1)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/905">2 U.S.C. 905(g)(1)(A)</external-xref>) is amended by inserting: <quote>Payments made under <external-xref legal-doc="usc" parsable-cite="usc/26/6431">section 6431</external-xref> of the Internal Revenue Code of 1986</quote> after the item related to Payment to Radiation Exposure Compensation Trust Fund.</text></subsection> <subsection id="H341E24CB336F4F2695BCDF06012BCC57"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/65">chapter 65</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new item:</text>

<subsection id="H2372BA87919F40B0AD88477AD27A1973"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to bonds issued more than 30 days after the date of the enactment of this Act.</text></subsection></section> </legis-body> </bill>
