which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Ted Stevens Olympic and Amateur Sports Act to provide pay equity for amateur athletes and other personnel, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HDC4B15212A204B3D98BCC8B1B7D4BD8A"><section section-type="section-one" id="H105D2B6D83F44221914231AFE92CDDB7"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Even Playing Field Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HCAD7EB1CA547470E9FDB58D6FBAF1A78"><enum>2.</enum><header>Pay equity for amateur athletes and other personnel</header><subsection id="H8C68F491D9CC4C288131CF50555F455A"><enum>(a)</enum><header>Purposes of the United States Olympic and Paralympic Committee</header><paragraph id="idC82D1FDB199A4A8E93E5D01B6535BEF3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 220503(12) of title 36, United States Code, is amended by inserting <quote>, including by providing investment, promotional support, working conditions (including staff support and facilities and equipment for training and competition) and wages, stipends, and other compensation that are equal to that provided to amateur athletic activities for men</quote> before the semicolon. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFC9F47D09C784406B1777B197FE3FBD6"><enum>(2)</enum><header display-inline="yes-display-inline">Retroactive effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall take effect on the date that is 2 years before the date of the enactment of this Act. </text></paragraph></subsection><subsection id="HBB0428688EA64D7183F8BF9474F9CDE3"><enum>(b)</enum><header>Eligibility requirements for amateur sports organizations as national governing bodies</header><text display-inline="yes-display-inline">Section 220522(8) of title 36, United States Code, is amended—</text><paragraph id="H44926CE02E9145AB8EC853F0BB10A80D"><enum>(1)</enum><text>by striking <quote>an equal opportunity</quote> and inserting <quote>and demonstrates equal opportunity, including in investment, promotional support, working conditions (including staff support and facilities and equipment for training and competition) and wages, stipends, and other compensation,</quote>; and </text></paragraph><paragraph id="H9DDE7465C408427BA6D6D518C5CF1C1B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>and other activities</quote> after <quote>athletic competition</quote>.</text></paragraph></subsection><subsection id="HCCBD5E5E2DD5429DAF118455D52FE0FF"><enum>(c)</enum><header>General duties of national governing bodies</header><text display-inline="yes-display-inline">Section 220524(a)(6) of title 36, United States Code, is amended by inserting <quote>, including in investment, promotional support, working conditions (including staff support and facilities and equipment for training and competition, and wages, stipends, and other compensation)</quote> before the semicolon. </text></subsection><subsection id="H330325AB1BCD4F87ABC16A1B6DBF0C42"><enum>(d)</enum><header>Reports on pay equity</header><paragraph id="HE63F4814F034407F84C1F8394B0D6F52"><enum>(1)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/2205">chapter 2205</external-xref> of title 36, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" act-name="" id="H1BEDD8059FBA4D1B92647C16E3B0916B"><section id="H4AE895E40CA3400AB2C17DF5EF9FC883"><enum>220530A.</enum><header>Reports on pay equity</header><subsection id="H340643A2E39146C88522B4E721AC44D8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each national governing body shall submit to Congress a report on the compensation of amateur athletes, coaches, trainers, managers, administrators, and officials in the sport governed by the national governing body for—</text><paragraph id="HDBA3C94174604F9BAB20BD7DD19A6E43"><enum>(1)</enum><text>each of the 2 consecutive calendar years ending immediately before the date of the enactment of this section; and</text></paragraph><paragraph id="HEB038C9A3793479FBAAC1B1CC269FB60"><enum>(2)</enum><text display-inline="yes-display-inline">each calendar year beginning after the date of the enactment of this section.</text></paragraph></subsection><subsection id="HFE21F324CD254AFEB3AFC04A0F66571D"><enum>(b)</enum><header>Matters To be included</header><text display-inline="yes-display-inline">Each report required by subsection (a) shall include, with respect to the applicable sport, for the calendar year covered by the report—</text><paragraph id="H1FACFE87DB4442BFBBD72071B35A0984"><enum>(1)</enum><text display-inline="yes-display-inline">the median compensation for amateur athletes, coaches, trainers, managers, administrators, and officials disaggregated by race, gender, and employment category; and</text></paragraph><paragraph id="HBACE9DF6ED9A4B26B3DFB1C394CE7D73"><enum>(2)</enum><text display-inline="yes-display-inline">the minimum and maximum compensation paid to amateur athletes, coaches, trainers, managers, administrators, and officials, disaggregated by race, gender, and employment category.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HDCDFEA1F1857472AB2848DF5CABF2743"><enum>(2)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/2205">chapter 2205</external-xref> of title 36, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H961293131BE74286ABC7146526E4AC8B"><toc><toc-entry bold="off" level="section">220530A. Reports on pay equity.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H73C32FC0BBCF48A28A6E3E9A80F6A2EC"><enum>(e)</enum><header>Severability</header><text>If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this Act and the amendments made by this Act, and the application of the provision or amendment to any other person or circumstance, shall not be affected.</text></subsection></section></legis-body></bill>
