which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve Federal population surveys by requiring the collection of voluntary, self-disclosed information on sexual orientation and gender identity in certain surveys, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H03FA006455324D3AA39DC1A58DFA53A0"><section section-type="section-one" id="H6768C47DEFB74F41A69BEF68855C7056"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>LGBTQ Data Inclusion Act</short-title></quote>.</text></section><section id="H4534CE7D2D434092A3673073C8E05063"><enum>2.</enum><header>Requirement to collect data on sexual orientation and gender identity</header><subsection id="HA18D1ECC3C5448BD965BBB09BA817179"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HBE764D338ED24207A4F6BEFD7A420700"><enum>(1)</enum><header>Agency</header><text>The term <quote>agency</quote> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="H4ECF254A6F2D49D3902575D9670B6D78"><enum>(2)</enum><header>Demographic data</header><text>The term <quote>demographic data</quote> means information about the race or ethnicity, sex, and age of a survey participant or population.</text></paragraph><paragraph id="H0CE9A0D4D86249F3BBC843137787C36D"><enum>(3)</enum><header>Gender identity</header><text>The term <quote>gender identity</quote> means an individual’s sense of being male, female, transgender, or another gender, as distinct from the individual’s sex assigned at birth.</text></paragraph><paragraph id="H4D4DC6B888FB435083C01754B60170D8"><enum>(4)</enum><header>Sexual orientation</header><text>The term <quote>sexual orientation</quote>—</text><subparagraph id="id7B5D52AC683F4EE589E14AA197C17E36"><enum>(A)</enum><text>means how a person identifies in terms of their emotional, romantic, or sexual attractions; and </text></subparagraph><subparagraph id="idCB1144001405481BBBD0C2264FFB41FB"><enum>(B)</enum><text>includes identification as straight, heterosexual, gay, lesbian, or bisexual, among other terms.</text></subparagraph></paragraph><paragraph id="H2951295CED1F43BC97CE59A0B08493A5" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Survey</header><text>The term <quote>survey</quote>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3A85BA678C7E4F2C8FCAE612803FE0E8"><enum>(A)</enum><text>means a data collection activity involving observation or questionnaires for a sample of a population; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0F5BDCA508614C4E92181CC8F66051CD"><enum>(B)</enum><text>includes the decennial census.</text></subparagraph></paragraph></subsection><subsection id="HAC7C0C2C397A475AB4246431A8C86EFE"><enum>(b)</enum><header>Survey requirement</header><text>Any agency that collects information through a survey that includes demographic data where subjects either self-report information or a knowledgeable proxy provides information about the subject or responds for all persons in a household shall, not later than 180 days after the date of enactment of this Act, establish data standards that require, with regard to such a survey, the following:</text><paragraph id="H0C7B6C26A26D422FB08573A124CDB250"><enum>(1)</enum><header>Review</header><text>The review of existing data sets to determine in which data sets information about sexual orientation and gender identity is not included.</text></paragraph><paragraph id="H2F008BE60FAC478295B3E142C6BA8B63"><enum>(2)</enum><header>Methods</header><text>An identification of appropriate methods to include questions on sexual orientation and gender identity in surveys that facilitate categorization, voluntary participation, and preserve privacy and confidentiality.</text></paragraph><paragraph id="H4F813C78216C42B5AB1FC5A542530264"><enum>(3)</enum><header>Data collection</header><text>The use of the appropriate methods identified in paragraph (2) to gather data on sexual orientation and gender identity.</text></paragraph><paragraph id="HD0F0592AE3894F1482464DB527DB8C61"><enum>(4)</enum><header>Assessment</header><text>The implementation of a process to routinely assess needed changes in survey methods related to asking questions on sexual orientation and gender identity.</text></paragraph></subsection><subsection id="HE9213507A41041C7886817FA90A9AFA9"><enum>(c)</enum><header>Data reports</header><text>Any report published by an agency that relies on survey demographic data shall include information on sexual orientation and gender identity.</text></subsection><subsection id="HDD2F9526E4274F2AB6D13D8AF1654658"><enum>(d)</enum><header>Confidentiality</header><text>Any information collected relating to the sexual orientation or gender identity of a survey participant shall be maintained in accordance with the confidentiality and privacy standards and policies for the protection of individuals applicable to that survey.</text></subsection><subsection id="HA8B13B45A8C846EAA6D482AB24805176"><enum>(e)</enum><header>Applicability</header><paragraph id="H5B090AA5976A458A82058300CF45E1EC"><enum>(1)</enum><header>Construction</header><text>Nothing in this Act shall be construed to require an individual to disclose their sexual orientation or gender identity to an agency.</text></paragraph><paragraph id="H0390261081D7468B9740C39084D5E1F0"><enum>(2)</enum><header>Exemption from penalty</header><text>An individual shall not be subject to any fine or other penalty for refusing to answer, or providing a false answer to, any survey question regarding gender identity or sexual orientation, including any fine or penalty under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/13/7">chapter 7</external-xref> of title 13, United States Code.</text></paragraph></subsection><subsection id="H050EBD685AF1414F8B0052160EEFFF83"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to permit the use of information collected under this section in a manner that would adversely affect any individual.</text></subsection></section></legis-body></bill>
