which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Administrator of the Environmental Protection Agency, the Secretary of the Interior, and the Secretary of Agriculture to maintain the Urban Waters Federal Partnership Program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Urban Waters Federal Partnership Act of 2021</short-title></quote>.</text></section><section id="idBAA6EC2FC7B14DACBA29FA0580FAEB7C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idFD89487C1D7943A5AE7C686BC819CCFE"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="id4B18B5F1228946D38860395CEC61ABF1"><enum>(2)</enum><header>Member agencies</header><text>The term <term>member agencies</term> means each of—</text><subparagraph id="id066527D15C784740910941C1B514D2E9"><enum>(A)</enum><text>the Environmental Protection Agency;</text></subparagraph><subparagraph id="id40D348B8C3774D2FB3A51049C72E35B0"><enum>(B)</enum><text>the Department of the Interior;</text></subparagraph><subparagraph id="id663C0564560B45F9B711E25BA9069D28"><enum>(C)</enum><text>the Department of Agriculture;</text></subparagraph><subparagraph id="id33C9BD23ED634AD3AAE845F300D0FB6F"><enum>(D)</enum><text>the Corps of Engineers;</text></subparagraph><subparagraph id="id32A375592EF74A4F940F7A5BB3D18FA9"><enum>(E)</enum><text>the National Oceanic and Atmospheric Administration;</text></subparagraph><subparagraph id="id1080FCD719F942F38D9E2EA88B13E3C5"><enum>(F)</enum><text>the Economic Development Administration;</text></subparagraph><subparagraph id="idF27043C6FEA542C68F69C28137566910"><enum>(G)</enum><text>the Department of Housing and Urban Development;</text></subparagraph><subparagraph id="id061D150A2BB847E78967C5E70C6B7DB0"><enum>(H)</enum><text>the Department of Transportation;</text></subparagraph><subparagraph id="idDE5A45F0C591450BADA3CE94705FF72E"><enum>(I)</enum><text>the Department of Energy;</text></subparagraph><subparagraph id="id3FC74FACE51D4625B26024F82D2EB26C"><enum>(J)</enum><text>the Department of Education;</text></subparagraph><subparagraph id="id952DB228624A4591A4B7EC360E0EA552"><enum>(K)</enum><text>the National Institute for Environmental Health Sciences;</text></subparagraph><subparagraph id="id8684F7CCE94C4148BBF7DB7FC8915FA1"><enum>(L)</enum><text>the Community Development Financial Institutions Fund;</text></subparagraph><subparagraph id="idB74837D4E0084B16BB8D96E5B6B9F6CA"><enum>(M)</enum><text>the Federal Emergency Management Agency; </text></subparagraph><subparagraph id="idD719C52E4C7F40DCB7B0DC34B5552BF3"><enum>(N)</enum><text>the Corporation for National and Community Service; and</text></subparagraph><subparagraph id="id06C3529A2702477F9C60EAE63F5E70F2" commented="no" display-inline="no-display-inline"><enum>(O)</enum><text>such other agencies, departments, and bureaus that elect to participate in the Urban Waters program as the missions, authorities, and appropriated funding of those agencies, departments, and bureaus allow. </text></subparagraph></paragraph><paragraph id="idA9E80E53EEAE4447AF6DBF627DD4D399"><enum>(3)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means the Secretary of the Interior and the Secretary of Agriculture.</text></paragraph><paragraph id="idD7352B007A19449ABB326C2A78609C28"><enum>(4)</enum><header>Urban Waters ambassador</header><text>The term <term>Urban Waters ambassador</term> means a person who—</text><subparagraph id="idEA09DF1F5E484366A0D8708CC3B2120F"><enum>(A)</enum><text>is locally based near the applicable Urban Waters partnership location; and</text></subparagraph><subparagraph id="id0824CBC417334B33BE1FC78FBAF2D5DC"><enum>(B)</enum><text>serves in a central coordinating role for the work carried out in the applicable Urban Waters partnership location with respect to the Urban Waters program.</text></subparagraph></paragraph><paragraph id="id0403B451E4464AC39B57A2AF860EBB62"><enum>(5)</enum><header>Urban Waters nonpartnership location</header><text>The term <term>Urban Waters nonpartnership location</term> means an urban or municipal site and the associated watershed or waterbody of the site—</text><subparagraph id="id69B5359F63354F46860D2CEC428C4E3E"><enum>(A)</enum><text>that receives Federal support for activities that advance the purpose of the Urban Waters program; but</text></subparagraph><subparagraph id="id1BE28809EF104D1AA47D3A46562CE8F1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id13FE3282B1DD43BCAD7E303C16941B8E"><enum>(i)</enum><text>that is not formally designated as an Urban Waters partnership location; and</text></clause><clause indent="up1" id="id73D84A976D464629BAD2F2F9258A105D"><enum>(ii)</enum><text>for which is not maintained—</text><subclause id="idF8433D0905D04299A89066BEE50A08B6"><enum>(I)</enum><text>an active partnership with an Urban Waters ambassador; or</text></subclause><subclause id="id49BD27DC4C4B4B68AFFBA50221FE0565"><enum>(II)</enum><text>an Urban Waters partnership location workplan.</text></subclause></clause></subparagraph></paragraph><paragraph id="idD09B759151114B41887ABCCE58231B8B"><enum>(6)</enum><header>Urban Waters partnership location</header><text>The term <term>Urban Waters partnership location</term> means an urban or municipal site and the associated watershed or waterbody of the site for which—</text><subparagraph id="id37163305DE964909ACD1BC9218E232F8"><enum>(A)</enum><text>the Administrator, in collaboration with the heads of the other member agencies, has formally designated as a partnership location under the Urban Waters program; and</text></subparagraph><subparagraph id="id24009AE8A2F84AE3BAD51F61A46BFF2F"><enum>(B)</enum><text>an active partnership with an Urban Waters ambassador is maintained.</text></subparagraph></paragraph><paragraph id="idE474D78E68C240D3BF74CB3E0B85ADE4"><enum>(7)</enum><header>Urban Waters partnership location workplan</header><text>The term <term>Urban Waters partnership location workplan</term> means the plan for projects and actions that is coordinated across an Urban Waters partnership location.</text></paragraph><paragraph id="id2A3735E295A347478D37A86300343105"><enum>(8)</enum><header>Urban Waters program</header><text>The term <term>Urban Waters program</term> means the program established under section 3(a). </text></paragraph></section><section id="idD02E8AB7019644E089CB713B9FC0104B"><enum>3.</enum><header>Urban Waters Federal Partnership program</header><subsection id="idB4EE677D93214164B28BD561F3441D4E"><enum>(a)</enum><header>Authorization</header><text>There is authorized a program, to be known as the <quote>Urban Waters Federal Partnership Program</quote>, administered by the partnership of the member agencies—</text><paragraph id="id17FC20090F1A48ABBDF5701064919F83"><enum>(1)</enum><text>to jointly support and execute the goals of the Urban Waters program through the independent authorities and appropriated funding of the member agencies; and</text></paragraph><paragraph id="id5A0E838B563C4EB4BCDDC8844A7A2BE8"><enum>(2)</enum><text>to advance the purpose described in subsection (b) within designated Urban Waters partnership locations and other urban and suburban communities in the United States.</text></paragraph></subsection><subsection id="id766AAD34866241DB88D5D92D51C6DC66"><enum>(b)</enum><header>Program purpose</header><text>The purpose of the Urban Waters program is to reconnect urban communities, particularly urban communities that are overburdened or economically distressed, with associated waterways by improving coordination among Federal agencies.</text></subsection><subsection id="idA71057AD58A24C32808666B3E7A73513"><enum>(c)</enum><header>Program requirements</header><paragraph id="id1D8254A3ED42498A900468EE1E790914"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations, the Administrator, in coordination with the Secretaries and, as appropriate, the heads of the other member agencies, shall maintain the Urban Waters program in accordance with this subsection.</text></paragraph><paragraph id="id195331D43BCA45388A4EB92EAFF3752A"><enum>(2)</enum><header>Urban Waters Federal Partnership Steering Committee</header><subparagraph id="id6B031B0B8C1949C6947EBA0222F4ACB3"><enum>(A)</enum><header>Establishment</header><clause id="id43EC66CD0EAA4C44A7A2DA209D767D67"><enum>(i)</enum><header>In general</header><text>The Administrator shall establish a steering committee for the Urban Waters program (referred to in this paragraph as the <quote>steering committee</quote>).</text></clause><clause id="id3DB048D5DDFA4F96B77D1A1AFE140315"><enum>(ii)</enum><header>Chair</header><text>The Administrator shall serve as chairperson of the steering committee.</text></clause><clause id="idEF5444B3AE0C4C02A94E8F02925004E2"><enum>(iii)</enum><header>Vice-chairs</header><text>The Secretaries shall serve as vice-chairpersons of the steering committee. </text></clause><clause id="id3B25A8B50DC14FAFABED451CFA942A5D"><enum>(iv)</enum><header>Membership</header><text>In addition to the Administrator and the Secretaries, the members of the steering committee shall be the senior officials (or their designees) from such member agencies as the Administrator shall designate.</text></clause></subparagraph><subparagraph id="idEAF43B60D5EA4789AE53BB9676FE03A1"><enum>(B)</enum><header>Duties</header><text>The steering committee shall provide general guidance to the member agencies with respect to the Urban Waters program, including guidance with respect to—</text><clause id="idB764AA77FA9141AC9BF620E242D812B7"><enum>(i)</enum><text>the identification of annual priority issues for special emphasis within Urban Waters partnership locations; and</text></clause><clause id="id3908B8E6FF974B2DAED820C31628ECCA"><enum>(ii)</enum><text>the identification of funding opportunities, which shall be communicated to all Urban Waters partnership locations.</text></clause></subparagraph><subparagraph id="idB169BE3750C242BBB8D6BC41396EDE2B"><enum>(C)</enum><header>Interagency financing</header><text>Notwithstanding section 1346 of title 31, United States Code, section 708 of division E of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), or any other similar provision of law, member agencies may—</text><clause id="id7FDDC1721ED145F3B727150102D80325"><enum>(i)</enum><text>provide interagency financing to the steering committee; and</text></clause><clause id="id1CE419B024644FC6A5008F6EC3FE35F3"><enum>(ii)</enum><text>directly transfer such amounts as are necessary to support the activities of the steering committee.</text></clause></subparagraph></paragraph><paragraph id="idC8A5174C6CD946D7B364A1B03E2617C1"><enum>(3)</enum><header>Authority</header><subparagraph id="id17F3742C1F94439A84A2FDE285472275"><enum>(A)</enum><header>Partnership locations</header><clause id="idBF25DA42C0A343A79B40F22F1AB743AC"><enum>(i)</enum><header>Partnership locations</header><text>The Administrator and the Secretaries shall maintain an active partnership program under the Urban Waters program at each Urban Waters partnership location, including each Urban Waters partnership location in existence on the date of enactment of this Act, by providing—</text><subclause id="idA41BA558C48146629BCE3D9A2857FD8B"><enum>(I)</enum><text>technical assistance for projects to be carried out within the Urban Waters partnership location;</text></subclause><subclause id="idD2077C8D613842809F7962A8401DFA1C"><enum>(II)</enum><text>funding for projects to be carried out within the Urban Waters partnership location;</text></subclause><subclause id="id16CA2E59C4AE4C008D07EBC3E8AA663B"><enum>(III)</enum><text>funding for an Urban Waters ambassador for the Urban Waters partnership location; and</text></subclause><subclause id="id77B2D0F214C8466499135D90CDD7D91C"><enum>(IV)</enum><text>coordination support with other member agencies with respect to activities carried out at the Urban Waters partnership location.</text></subclause></clause><clause id="id983CF009C5B143F7839708A846CE1CC4"><enum>(ii)</enum><header>New partnership locations</header><subclause id="idEDA58B3D753A4805A05A5AB09CD8326C"><enum>(I)</enum><header>In general</header><text>The Administrator and the Secretaries may, in consultation with the heads of other member agencies, establish new Urban Waters partnership locations. </text></subclause><subclause id="idE8FE68C9696E43A7AAACCD12C1859E45"><enum>(II)</enum><header>Nonpartnership locations</header><text>A community with an Urban Waters nonpartnership location may, at the discretion of the community, seek to have the Urban Waters nonpartnership location designated as an Urban Waters partnership location.</text></subclause></clause></subparagraph><subparagraph id="idCADC3600B98147E99D6ACEC12752D5CC"><enum>(B)</enum><header>Authorized activities</header><clause id="idE68FD70522594B6E9626F10A9893BAEA"><enum>(i)</enum><header>Definition of eligible entity</header><text>In this subparagraph, the term <term>eligible entity</term> means— </text><subclause id="id42F24CA44A4A48349C43DF828469B7A4"><enum>(I)</enum><text>a State;</text></subclause><subclause id="id257DBCFE78DB494D8BCDC300AD4CE08A"><enum>(II)</enum><text>a territory or possession of the United States;</text></subclause><subclause id="id4FED2A3144C241518E3B75BBAB5C88DF"><enum>(III)</enum><text>the District of Columbia;</text></subclause><subclause id="id85F1F1231D074A238E99F188E3CE299D"><enum>(IV)</enum><text>an Indian Tribe;</text></subclause><subclause id="id8E2E8AE77B60443A8CF94442B21AA67E"><enum>(V)</enum><text>a unit of local government;</text></subclause><subclause id="idA656DD5DA8684E1CB9C16D49E09428BA"><enum>(VI)</enum><text>a public or private institution of higher education;</text></subclause><subclause id="id7F643B029C8548AAB8E73CA647875AD9"><enum>(VII)</enum><text>a public or private nonprofit institution;</text></subclause><subclause id="id38E1B641DDB44126912159D867F553C2"><enum>(VIII)</enum><text>an intertribal consortium;</text></subclause><subclause id="id63B04C570EF240708F4B6BCABF97A37C"><enum>(IX)</enum><text>an interstate agency; and</text></subclause><subclause id="id3DB7AF3FAF8C40E3A5CD4CC1B49A4974"><enum>(X)</enum><text>any other entity determined to be appropriate by the Administrator.</text></subclause></clause><clause id="id4F75AD6AB73A42B795198DBF7C4149F3"><enum>(ii)</enum><header>Activities</header><text>In carrying out the Urban Waters program, a member agency may—</text><subclause id="id6B2478245B5B4F6B8DCD9D92B0BAEAD8"><enum>(I)</enum><text>encourage, cooperate with, and render technical services to and provide financial assistance to support—</text><item id="idF4EB8C704CB248C58B7C77324C5C5A07"><enum>(aa)</enum><text>Urban Water ambassadors to conduct activities with respect to the applicable Urban Waters partnership location, including—</text><subitem id="id683036F2774E41919D12F5742DA5AB45"><enum>(AA)</enum><text>convening the appropriate Federal and non-Federal partners for the Urban Waters partnership location;</text></subitem><subitem id="idFF917DB21BD84BE8B8ADD63B2D6D9FAB"><enum>(BB)</enum><text>developing and carrying out an Urban Waters partnership location workplan; </text></subitem><subitem id="idAA52FDE1228C4664858AF7A601573D3F"><enum>(CC)</enum><text>leveraging available Federal and non-Federal resources for projects within the Urban Waters partnership location; and</text></subitem><subitem id="idD56D1A7C18744BD5B0AD5792840772B5"><enum>(DD)</enum><text>sharing information and best practices with the Urban Waters Learning Network established under subparagraph (C); and</text></subitem></item><item id="id3E4F66710EF74CD78786AD313A201D7E"><enum>(bb)</enum><text>an eligible entity in carrying out—</text><subitem id="id1870771376E743178883B048F2864BBF"><enum>(AA)</enum><text>projects at Urban Water partnership locations that provide habitat or water quality improvements, increase river recreation, enhance community resiliency, install infrastructure, strengthen community engagement with and education with respect to water resources, or support planning, coordination, and execution of projects identified in the applicable Urban Waters partnership location workplan; and</text></subitem><subitem id="id8615778199844219BE8306614BC38603"><enum>(BB)</enum><text>planning, research, experiments, demonstrations, surveys, studies, monitoring, training, and outreach to advance the purpose described in subsection (b) within Urban Waters partnership locations and in Urban Waters nonpartnership locations; and</text></subitem></item></subclause><subclause id="id768A3FE8A7534304A1245DBB7660347B"><enum>(II)</enum><text>transfer funds to or enter into interagency agreements with other member agencies as necessary to carry out the Urban Waters program.</text></subclause></clause></subparagraph><subparagraph id="idD4027B18A11C41BE9494078592EA77A7"><enum>(C)</enum><header>Urban Waters learning network</header><text>The Administrator and the Secretaries shall maintain an Urban Waters Learning Network—</text><clause id="idAA3C92F99F8A43619F6E90EBCFA0544D"><enum>(i)</enum><text>to share information, resources, and tools between Urban Waters partnership locations and with other interested communities; and</text></clause><clause id="id3FE7265BA5174C6ABBDA3FD706862007"><enum>(ii)</enum><text>to carry out community-based capacity building that advances the goals of the Urban Waters program.</text></clause></subparagraph><subparagraph id="idecb480043d6a4e95838d32776605398a"><enum>(D)</enum><header>Workplan progress</header><text>Progress in addressing the goals of the Urban Waters partnership location workplan of an Urban Waters partnership location shall be shared with the Urban Waters program at regular intervals, as determined by the Administrator and the Secretaries. </text></subparagraph></paragraph></subsection><subsection id="idBDA4020E196C4C468D616ECC3DABCA39"><enum>(d)</enum><header>Reports to Congress</header><text>The Administrator and the Secretaries shall annually submit to the appropriate committees of Congress a report describing the progress in carrying out the Urban Waters program, which shall include—</text><paragraph id="id32E9F4895FC14FAFAAF130EC1BAA2BA3"><enum>(1)</enum><text>a description of the use of funds under the Urban Waters program;</text></paragraph><paragraph id="id954F4366085E4957B1B936601ED6E7E2"><enum>(2)</enum><text>a description of the progress made in carrying out Urban Waters partnership location workplans; and</text></paragraph><paragraph id="idC562AE639D884FC98E046C9A46C29F85"><enum>(3)</enum><text>any additional information that the Administrator and the Secretaries determine to be appropriate.</text></paragraph></subsection><subsection id="idE19DF537E56649AD8C0EEF13D23022B4"><enum>(e)</enum><header>Authorization of appropriations</header><paragraph id="id4D0A1C107F2F4A22A283DA38BCEE474A"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Administrator to carry out the Urban Waters program $10,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><paragraph id="id5EEDB42FA8AE4DDE9A7C594F1362C6F1"><enum>(2)</enum><header>Use of funds</header><text>Notwithstanding any other provision of law, activities carried out using amounts made available to the Administrator under paragraph (1) may be used in conjunction with amounts made available from—</text><subparagraph id="idAEF4E9884E1847558C372DE5D0398C62"><enum>(A)</enum><text>other member agencies; and</text></subparagraph><subparagraph id="idAE25FBC9C19D48F58B05E1A75FAADFDF"><enum>(B)</enum><text>non-Federal entities that participate in the Urban Waters program.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
