which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Safe Drinking Water Act to increase funding for lead reduction projects, and for other purposes.</official-title></form><legis-body><section id="id93E4C649C8694D3DB3D6B68FE622A1D3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lead-Free Drinking Water for All Act of 2021</short-title></quote>.</text></section><section id="id7FB5607BAF6B4565AA647E24A740C9E3"><enum>2.</enum><header>Reducing lead in drinking water</header><text display-inline="no-display-inline">Section 1459B of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-19b">42 U.S.C. 300j–19b</external-xref>) is amended—</text><paragraph id="id3b61616f68554a4db75e61b752d52297"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="ideb0cd8590b614d779b9f39a031693f68"><enum>(A)</enum><text>in paragraph (1), by striking subparagraph (D) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id880890acc7484fbcbd61d7ac42f89c00"><subparagraph id="ida191bc4ce8494cafb0e9dc555e5aaa93"><enum>(D)</enum><text>a qualified nonprofit organization with experience in lead reduction, as determined by the Administrator; and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="ida0f6bd00310847519090db0020804149"><enum>(B)</enum><text>in paragraph (2)(A)—</text><clause id="id098fed6615a84ba4ae826c2b94669e33"><enum>(i)</enum><text>in clause (i), by striking <quote>publicly owned</quote>; and</text></clause><clause id="idfa29df9c824b4999b8580f5db142f7a0"><enum>(ii)</enum><text>by striking clause (iii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf6ff5cc04dea4a8192e86aff61d66883"><clause id="idabbe859343534676b32b018f3bfecc93"><enum>(iii)</enum><text>providing assistance to eligible entities to inventory and replace lead service lines, with priority for disadvantaged communities based on the affordability criteria established by the applicable State under section 1452(d)(3), low-income homeowners, and landlords or property owners providing housing to low-income renters.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idffe8d9c15ee44d7c97f97a06d04a6340"><enum>(C)</enum><text>in paragraph (3), by striking <quote>an individual provided</quote>;</text></subparagraph></paragraph><paragraph id="iddf2b2b3f2d19426aad4cdd3923e37098"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id5cbb41b0d3074773ad73afb2bd90c255"><enum>(A)</enum><text>in paragraph (5)—</text><clause id="id16d54bb757454cec921abdffb1ae6095"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>to provide assistance</quote> and all that follows through the period at the end and inserting <quote>to inventory and replace lead service lines, with first priority given to assisting disadvantaged communities based on the affordability criteria established by the applicable State under section 1452(d)(3), low-income homeowners, and landlords or property owners providing housing to low-income renters.</quote>; and</text></clause><clause id="id5c62e64433ab4f218f50e05fe35ab209"><enum>(ii)</enum><text>in subparagraph (B)—</text><subclause id="id09F8D521D0C64743BE19221F42E05EA8"><enum>(I)</enum><text>by striking <quote>to a low-income homeowner</quote>;</text></subclause><subclause id="id3E7F349AC7904F57AEA0D67D5BD91E69"><enum>(II)</enum><text>by striking <quote>privately owned portion of the</quote>; and</text></subclause><subclause id="id38089452264D48E984A9B4E756133991"><enum>(III)</enum><text>by striking <quote>line</quote> and inserting <quote>lines</quote>;</text></subclause></clause></subparagraph><subparagraph id="id0cfea5bee812470d88437656bec159d0"><enum>(B)</enum><text>in paragraph (6)—</text><clause id="id88288fe7082a4c85859dc9d460c69c2e"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>any publicly owned portion of</quote>; and</text></clause><clause id="id9c948b851ddb433db80b1e7a97a5f73a"><enum>(ii)</enum><text>by striking subparagraphs (B) through (E) and inserting the following:</text><quoted-block id="id38D60BD0CF7C402F8538FD1F35456A09" style="OLC" act-name=""><subparagraph id="id095189AB0A70478D886D29747CF2CFB2"><enum>(B)</enum><text>shall offer to replace the full lead service line at no cost to the property owner; and</text></subparagraph><subparagraph id="id60114E63DDE649A3B30D10038D47212B" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">shall notify relevant State and local authorities of any planned replacement of lead service lines under this subsection and coordinate, where practicable, with other relevant infrastructure projects. </text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id1CE9C8D5748542DEBA19AEAE6B182C5B"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="id94F22C7C265845A0BDA110FB1F7612BC" style="OLC" act-name=""><paragraph id="id682E9F22D87C4554A10F77F87C4DCC91"><enum>(7)</enum><header>Prevailing wages</header><text>In carrying out lead service line replacement using amounts made available under this section, section 1452(a)(5) shall apply.</text></paragraph><paragraph id="id66AA0B9D326E4A7FB9ADD9CCCCB95768"><enum>(8)</enum><header>Timely completion of projects</header><subparagraph id="id3FF31A4D50F0456583F86213A110A710"><enum>(A)</enum><header>In general</header><text>An eligible entity that receives assistance under this section shall ensure that all lead service lines being serviced by the eligible entity are fully replaced not later than the date that is 10 years after the date on which the eligible entity first receives funding for a lead reduction project for which assistance is provided under this section after the date of enactment of this paragraph.</text></subparagraph><subparagraph id="id054BAA1CF0CF4BD0A33004AA4913A5B4"><enum>(B)</enum><header>Plan required</header><text>An eligible entity that receives assistance under this section shall submit to the Administrator a plan that describes how the eligible entity intends to meet the requirement under subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idfd195a8fc60248c09a8fb3152184e5bb"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph id="id909003ad85ca49f2b2923dab95140569"><enum>(A)</enum><text>by inserting <quote>(except for subsection (e))</quote> after <quote>this section</quote>; and</text></subparagraph><subparagraph id="idc20899685b164b638235df67b2ec1409"><enum>(B)</enum><text>by striking <quote>$60,000,000 for each of fiscal years 2017 through 2021</quote> and inserting <quote>$4,500,000,000 for each of fiscal years 2022 through 2031</quote>;</text></subparagraph></paragraph><paragraph id="id5fb04bb209cf46cab174bc628669e0a6"><enum>(4)</enum><text>by redesignating subsections (d) and (e) as subsections (f) and (g), respectively; and</text></paragraph><paragraph id="idee023600db0248549775e885953c2c32"><enum>(5)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida3a08d9e999349a9a84a825b05da6a76"><subsection id="idee7cc8f8d2ef476092276a77f76a06bb"><enum>(d)</enum><header>Delegation to and coordination with States</header><paragraph id="id98cf9af5a1b7400e9bb4cf5b58734ddd"><enum>(1)</enum><header>In general</header><text>The Administrator—</text><subparagraph id="idEEE6BC72EBE548CBA5BE7E8E6EE86BB8"><enum>(A)</enum><text>shall, in carrying out this section, coordinate with each State that has established a State drinking water treatment revolving loan fund under section 1452; and</text></subparagraph><subparagraph id="idC97A5D51CAC741BC9CA14B475DA09A09"><enum>(B)</enum><text>may delegate the implementation of this section to any State described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="idE7F56D756C954BBDA1367170548738D4"><enum>(2)</enum><header>Allotment of funds to delegated States</header><subparagraph id="id971E55F3CCAE454FBD953ED938F453FB"><enum>(A)</enum><header>In general</header><text>If the Administrator delegates implementation of this section to a State under paragraph (1)(B), the Administrator shall, for each fiscal year, allot to the State an amount equal to the product obtained by multiplying—</text><clause id="idBC809E80056E435382157F31A10CB33B"><enum>(i)</enum><text>the total amount made available to carry out this section (except for subsection (e)) for the fiscal year; by</text></clause><clause id="id251B39F648D8418CBB6BE60CA2323C43"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id868166AA319C4584AD985987E528369F"><enum>(I)</enum><text>for fiscal years 2022 and 2023, the proportion that—</text><item id="id9489031F9F534C12B7B143CDB817C2E7" indent="up1"><enum>(aa)</enum><text>the amount allotted to the State under section 1452(a)(1)(D) for the fiscal year; bears to</text></item><item indent="up1" id="idB82F83DD317B433F8A41045ECB13CEC8"><enum>(bb)</enum><text>the amount allotted to all States under section 1452(a)(1)(D) for the fiscal year; and</text></item></subclause><subclause indent="up1" id="id62931F18D3244F3E992D9257C5B1F1D9"><enum>(II)</enum><text>for each of fiscal years 2024 through 2031, the proportion that—</text><item id="id5AFB91CEB608496D9AA2EA2F59554092"><enum>(aa)</enum><text>the need for lead service line replacement within the State, as documented in the most recent needs assessment under section 1452(h)(2); bears to</text></item><item id="id5983000CB8404FECB7D69599538BC3C7"><enum>(bb)</enum><text>the need for lead service line replacement within all States, as documented in the most recent needs assessment under section 1452(h)(2).</text></item></subclause></clause></subparagraph><subparagraph id="id6246EC5D2E324DA4AC8EDFC0D2E141AB"><enum>(B)</enum><header>Use of funds</header><clause id="id5DF348248E3841ABADD4D5EC4DF0AFA4"><enum>(i)</enum><header>In general</header><text>Amounts allotted to a State under subparagraph (A) shall be used by the State only to make grants for inventorying or replacing lead service lines in accordance with this section.</text></clause><clause id="idE087ED42A72A499C8549304885017A55"><enum>(ii)</enum><header>Limitation</header><text>Of the amounts allotted to a State under subparagraph (A), not more than 4 percent may be used to pay the administrative costs of the State.</text></clause><clause id="idA46C12C44F844E9DA9E63BC255BE1B7F"><enum>(iii)</enum><header>No State contribution</header><text>Notwithstanding any other provision of law, including section 1452(e), no State contribution requirement may be imposed on amounts allotted to a State under subparagraph (A).</text></clause></subparagraph></paragraph></subsection><subsection id="id1457ae2243054de9970d56ae6b9fdeb1"><enum>(e)</enum><header>Lead inventorying utilization grant pilot program</header><paragraph id="id0f5f1ec5bc914589bbff03d48328a675"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="idbe1c865ad32a41b5bbb43d7e161bbc5c"><enum>(A)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a municipality that is served by a community water system or a nontransient noncommunity water system in which not less than 30 percent of the service lines are known, or suspected, to contain lead, based on available data, information, or resources, including existing lead inventorying.</text></subparagraph><subparagraph id="id65469839522645219cfaa5f9d59aa6b5"><enum>(B)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the pilot program established under paragraph (2).</text></subparagraph></paragraph><paragraph id="id3ec00e9ea896489ca5395a9372b612a0"><enum>(2)</enum><header>Establishment</header><text>The Administrator shall establish a pilot program under which the Administrator shall provide grants to eligible entities to carry out lead reduction projects that are demonstrated to exist or are suspected to exist, based on available data, information, or resources, including existing lead inventorying of those eligible entities.</text></paragraph><paragraph id="id9ea00da6f44a4da8b28a1bc1d3d54662"><enum>(3)</enum><header>Selection</header><subparagraph id="id6df5ef3e898c44f59f3987c1e051b0db"><enum>(A)</enum><header>Application</header><text>To be eligible to receive a grant under the pilot program, an eligible entity shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></subparagraph><subparagraph id="id42a5a1525506407ba03d73ff8c7d6f6c"><enum>(B)</enum><header>Prioritization</header><text>In selecting recipients under the pilot program, the Administrator shall give priority to—</text><clause id="id31169a52beb94e71af61c4aa17ae2034"><enum>(i)</enum><text>an eligible entity that meets the affordability criteria of the applicable State established under section 1452(d)(3); and</text></clause><clause id="id5ff395cba7424bb48a35c31cd3faf8c6"><enum>(ii)</enum><text>an eligible entity that is located in an area other than a State that has established affordability criteria under section 1452(d)(3).</text></clause></subparagraph></paragraph><paragraph id="id362bd62e6e77447e8b2316e768751e49"><enum>(4)</enum><header>Report</header><text>Not later 2 years after the Administrator first awards a grant under the pilot program, the Administrator shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report describing—</text><subparagraph id="ide98db8a1e19749a28e5bdc25eaddf835"><enum>(A)</enum><text>the recipients of grants under the pilot program;</text></subparagraph><subparagraph id="id61d51b99d8124764929c0b7768e9f638"><enum>(B)</enum><text>the existing lead inventorying that was available to recipients of grants under the pilot program; and</text></subparagraph><subparagraph id="id7dc8be3a14cc4a5bb3e398447cbc077c"><enum>(C)</enum><text>how useful and accurate the lead inventorying described in subparagraph (B) was in locating lead service lines of the eligible entity.</text></subparagraph></paragraph><paragraph id="id03b9b3cbb9f34cada1c3d5ca0de496b9"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the pilot program $10,000,000, to remain available until expended.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
