<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2270</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210624">June 24, 2021</action-date><action-desc><sponsor name-id="S396">Mrs. Blackburn</sponsor> (for herself, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S375">Mr. Daines</cosponsor>, <cosponsor name-id="S318">Mr. Wicker</cosponsor>, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, <cosponsor name-id="S376">Ms. Ernst</cosponsor>, <cosponsor name-id="S381">Mr. Rounds</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S412">Mr. Tuberville</cosponsor>, <cosponsor name-id="S236">Mr. Inhofe</cosponsor>, <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>, and <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit Federal funding to entities that do not certify the entities will not perform, or provide any funding to any other entity that performs, an abortion.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE41F3082A3C940ABACF9D94F91C9C9BE"><section section-type="section-one" id="H054EAF79F37941E18D6364FAE138DB7B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Life and Taxpayers Act of 2021</short-title></quote>.</text></section><section id="HAB84F094BD0847A79C4970BB574274DB"><enum>2.</enum><header>Prohibition on abortion</header><subsection id="HAB1C86B0F3CE494C80310E10D80764C6"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No Federal funds may be provided (directly or indirectly, including through contract or subcontract) to an entity unless the entity certifies that, during the period for which such funds are provided, the entity will not perform, and will not provide any funds to any other entity that performs, an abortion.</text></subsection><subsection id="HFFB00B797EBD42F5855CC0301980CBC9"><enum>(b)</enum><header>Exception</header><text>Subsection (a) does not apply with respect to an abortion where—</text><paragraph id="H0B1EF158A4544EADB1A74CAD04ED6C76"><enum>(1)</enum><text>the pregnancy is the result of rape or incest; or</text></paragraph><paragraph id="H89CCCF660D974A6980FB58B6380330FB"><enum>(2)</enum><text>a physician certifies that the woman suffers from a physical disorder, physical injury, or physical illness that would place the woman in danger of death unless an abortion is performed, including a life-threatening physical condition caused by, or arising from, the pregnancy itself.</text></paragraph></subsection><subsection commented="no" id="H35905136D8784EDE9BD23D3957E05EFE"><enum>(c)</enum><header>Hospitals</header><text>Subsection (a) does not apply with respect to a hospital, so long as such hospital does not, during the period for which funds described in subsection (a) are provided to such hospital, provide funds to any non-hospital entity that performs an abortion (other than an abortion described in subsection (b)).</text></subsection><subsection id="H6A87630A4AEE47FCAD0594D858D70199"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H208D87D8872048E5B65E0D64702B967D"><enum>(1)</enum><text>The term <term>entity</term> means the entire legal entity, including any entity that controls, is controlled by, or is under common control with, such entity.</text></paragraph><paragraph id="H274FD09B75AA49339B2D3B5A2F581CF1"><enum>(2)</enum><text>The term <term>hospital</term> has the meaning given such term in section 1861(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(e)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
