which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To secure the bulk-power system in the United States.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect American Power Infrastructure Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id72EF60BF27A9456484CBEED9DD44202E"><enum>2.</enum><header>Securing the bulk-power system</header><subsection id="idcf86dfa84bc64498873135819de02b35"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id0dc3e5570a0a47a599f3d39dd160cd55"><enum>(1)</enum><header>Bulk-power system</header><subparagraph id="id1A19D316C5EB4E87B9EA9CDD12D6AA8A"><enum>(A)</enum><header>In general</header><text>The term <term>bulk-power system</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></subparagraph><subparagraph id="id73CF14B64CD74BAD9A6DA81A9DC0A126"><enum>(B)</enum><header>Inclusion</header><text>The term <term>bulk-power system</term> includes transmission lines rated at 69,000 volts (69 kV) or higher.</text></subparagraph></paragraph><paragraph id="id7f46e6d8f7c541cdbd9017fef25311a9"><enum>(2)</enum><header>Covered equipment</header><text>The term <term>covered equipment</term> means items used in bulk-power system substations, control rooms, or power generating stations, including—</text><subparagraph id="id7DABDA07473C4E76B32784628BBFDC9C"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idE64DE638F12E4127BDFCBD240A53847C"><enum>(i)</enum><text>power transformers with a low-side voltage rating of 69,000 volts (69 kV) or higher; and </text></clause><clause id="id91AC92393D2D4A7A83040B3511CE61EC" indent="up1"><enum>(ii)</enum><text>associated control and protection systems, such as load tap changers, cooling systems, and sudden pressure relays;</text></clause></subparagraph><subparagraph id="id3DCD0B53DBDF486D914ACF437EA138A2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id1837FAB0DA7B45B58C81E9F879E3175E"><enum>(i)</enum><text>generator step-up (GSU) transformers with a high-side voltage rating of 69,000 volts (69 kV) or higher; and</text></clause><clause indent="up1" id="id5C53B92767E84828A4CF29643A904E80"><enum>(ii)</enum><text>associated control and protection systems, such as load tap changers, cooling systems, and sudden pressure relays;</text></clause></subparagraph><subparagraph id="idBFED53247EF84BB1BA47990DDDB9B539"><enum>(C)</enum><text>circuit breakers operating at 69,000 volts (69 kV) or higher;</text></subparagraph><subparagraph id="idDBD318464EF24BA98EBB6F3259D81AE7"><enum>(D)</enum><text>reactive power equipment rated at 69,000 volts (69 kV) or higher; and</text></subparagraph><subparagraph id="id1745F5CB6B70404B82AC1ECB4CDFA445"><enum>(E)</enum><text>microprocessing software and firmware that—</text><clause id="id70BD6EA8090346DF8E6485373D4209BF"><enum>(i)</enum><text>is installed in any equipment described in subparagraphs (A) through (D); or </text></clause><clause id="idFA962D27699741DB9C03BB8EA2E79E42"><enum>(ii)</enum><text>is used in the operation of any of the items described in those subparagraphs.</text></clause></subparagraph></paragraph><paragraph id="id3829645CB01C44209C55F39DB61E8324"><enum>(3)</enum><header>Critical defense facility</header><subparagraph id="idF23C8CFB83D44F2BBF04DB2D30B4D4DE"><enum>(A)</enum><header>In general</header><text>The term <term>critical defense facility</term> means a facility that—</text><clause id="id1C68CA90D77B4AFEBCF62827ED097E5A"><enum>(i)</enum><text>is critical to the defense of the United States; and</text></clause><clause id="idD34E723676FF4FD7BBF9E47BD04BEA06"><enum>(ii)</enum><text>is vulnerable to a disruption of the supply of electric energy provided to that facility by an external provider.</text></clause></subparagraph><subparagraph id="id15D8AC7B81D24A4792CCB8D18BFE1721" commented="no"><enum>(B)</enum><header>Inclusion</header><text>The term <term>critical defense facility</term> includes a facility designated as a critical defense facility by the Secretary of Energy under section 215A(c) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o-1">16 U.S.C. 824o–1(c)</external-xref>).</text></subparagraph></paragraph><paragraph id="id05A3B4DAD14F4B42974A6E1095788FB0"><enum>(4)</enum><header>Critical electric infrastructure</header><text>The term <term>critical electric infrastructure</term> has the meaning given the term in section 215A(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o-1">16 U.S.C. 824o–1(a)</external-xref>).</text></paragraph><paragraph id="idEE88128025BA41FB89725E819BB153EC"><enum>(5)</enum><header>Defense critical electric infrastructure</header><text>The term <term>defense critical electric infrastructure</term> has the meaning given the term in section 215A(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o-1">16 U.S.C. 824o–1(a)</external-xref>).</text></paragraph><paragraph id="idf3082b8842c346d094360f2d2dbe10c5"><enum>(6)</enum><header>Entity</header><text>The term <term>entity</term> means a partnership, association, trust, joint venture, corporation, group, subgroup, or other organization.</text></paragraph><paragraph id="id10cfa7a1810b4221b5dfed5f70837fa8"><enum>(7)</enum><header>Foreign adversary</header><text>The term <term>foreign adversary</term> means any foreign government or foreign nongovernment person engaged in a long‑term pattern or serious instances of conduct significantly adverse to—</text><subparagraph id="id6FA7ABE563B14292942BD5D719C22059"><enum>(A)</enum><text>the national security of—</text><clause id="id3C49C585C9174D9E8FC829167E3C629D"><enum>(i)</enum><text>the United States; or</text></clause><clause id="id71128C8B91A04EF5861D713913C364BD"><enum>(ii)</enum><text>allies of the United States; or </text></clause></subparagraph><subparagraph id="id5BB22E339CAC4E2FB717C24EE6ECE49F"><enum>(B)</enum><text>the security and safety of United States persons.</text></subparagraph></paragraph><paragraph id="idaffb154183d347eb8bc64edf82c9fcbd"><enum>(8)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text></paragraph><paragraph id="id1571da5fa1d7404fa27116f3e0a36cc1"><enum>(9)</enum><header>Procurement</header><text>The term <term>procurement</term> means the process of acquiring, through purchase, by contract and through the use of appropriated funds, supplies or services, including installation services, by and for the use of the Federal Government.</text></paragraph><paragraph id="id999F58362B9B4AABA1E982FCD13EB49B"><enum>(10)</enum><header>Transaction</header><text>The term <term>transaction</term> means the acquisition, importation, transfer, or installation of any bulk-power system electric equipment by any person, or with respect to any property, subject to the jurisdiction of the United States.</text></paragraph><paragraph id="idcbadc19c2f91447f8daf6fd0aae74a0a"><enum>(11)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text><subparagraph id="idFF4EEEA4B4564AB4991F64416C928D54"><enum>(A)</enum><text>an individual who is—</text><clause id="id8FE8E11B3D734D108C3C2D92F6749FC3"><enum>(i)</enum><text>a citizen of the United States; or</text></clause><clause id="id29DF0D377D5D410C8C50EBCD5FF6F743"><enum>(ii)</enum><text>an alien lawfully admitted for permanent residence in the United States; </text></clause></subparagraph><subparagraph id="id7173AAFF919F43D19857043C91AF906D"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity; and</text></subparagraph><subparagraph id="id9B79AB5F6D9A45D793B780DB9F74C645"><enum>(C)</enum><text>any person in the United States. </text></subparagraph></paragraph></subsection><subsection id="id9deb19f9efe448e7b0ba05ca66a48c91"><enum>(b)</enum><header>Prohibition</header><paragraph id="id59303D3AC347490BB33145E35B4E2DD7"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this subsection, no person that is the owner or operator of defense critical electric infrastructure may engage in any transaction relating to that defense critical electric infrastructure that involves any covered equipment in which a foreign adversary has an ownership or any other interest, including through an interest in a contract for the provision of the covered equipment, over which a foreign adversary has control, or with respect to which a foreign adversary exercises influence, including any transaction that—</text><subparagraph id="idBD8265858AB5451CA001C346478D1E12"><enum>(A)</enum><text>is initiated after the date of enactment of this Act; and</text></subparagraph><subparagraph id="idD5E4AF84E89E44E9831BF7E0B7269F28"><enum>(B)</enum><text>the Secretary of Energy, in coordination with the Director of the Office of Management and Budget and in consultation with the Secretary of Defense, the Secretary of Homeland Security, the Director of National Intelligence, and the heads of other appropriate Federal agencies, as determined by the Secretary of Energy, determines—</text><clause id="id8ba79f0b7b17481a9e646a1e83846826"><enum>(i)</enum><text>involves covered equipment designed, developed, manufactured, or supplied by persons owned by, controlled by, or subject to the jurisdiction or direction of a foreign adversary; and</text></clause><clause id="id2ED1FC07011E43179019BE02BD732CCE"><enum>(ii)</enum><text>poses an undue risk of catastrophic effects on the security or resiliency of defense critical electric infrastructure in the United States.</text></clause></subparagraph></paragraph><paragraph id="id1f941f8323864507923ae6eaf218f533"><enum>(2)</enum><header>Mitigation measures</header><subparagraph id="id0F68E97CD1C14B6DAF5707EB9DC71371"><enum>(A)</enum><header>In general</header><text>The Secretary of Energy, in consultation with the heads of other Federal agencies, as appropriate, may—</text><clause id="idE91EABA2CA29462786F0C5E7BB46DD84"><enum>(i)</enum><text>in accordance with subparagraph (B), approve a transaction or class of transactions prohibited under paragraph (1); and</text></clause><clause id="id96ED601889B64586AA7A653D7D3EC8AF"><enum>(ii)</enum><text>design or negotiate measures to mitigate any concerns identified in making determinations under paragraph (1)(B) with respect to that transaction or class of transactions. </text></clause></subparagraph><subparagraph id="id0399E8EB51BD44908D99048D79427934"><enum>(B)</enum><header>Precondition to approval of otherwise prohibited transaction</header><text>The Secretary of Energy shall implement the measures described in subparagraph (A)(ii) before approving a transaction or class of transactions that would otherwise be prohibited under paragraph (1).</text></subparagraph></paragraph><paragraph id="id23619ecfe1bf4370ab505f7c84c609b6"><enum>(3)</enum><header>Application</header><subparagraph id="id660F6559D8EE4C86866B0A4747FE9DF3"><enum>(A)</enum><header>In general</header><text>The prohibition described in paragraph (1) shall apply to a transaction described in that paragraph regardless of whether—</text><clause id="idDD878940CD1A4E999E2EE8F54E713A59"><enum>(i)</enum><text>a contract has been entered into with respect to that transaction before the date of enactment of this Act; or</text></clause><clause id="idF2FBE8745B31423EA3790DDF40BC8F91"><enum>(ii)</enum><text>a license or permit has been issued or granted with respect to that transaction before the date of enactment of this Act.</text></clause></subparagraph><subparagraph id="idC584FC28A2404F83A5A03902CDF7DD35"><enum>(B)</enum><header>Contrary law</header><text>The prohibition described in paragraph (1) shall apply to each transaction described in that paragraph only to the extent not otherwise provided by—</text><clause id="idC134B65D954A48B289C77A3C29803376"><enum>(i)</enum><text>another statute; or</text></clause><clause id="id3C966733B0AA488DAA0C89D01D95FA54"><enum>(ii)</enum><text>a regulation, order, directive, or license issued pursuant to this section.</text></clause></subparagraph></paragraph><paragraph id="id8ab183c33eb84845a331562c4b058cc5"><enum>(4)</enum><header>Prequalification</header><subparagraph id="idF6D96A79A0A94B1AB58516BF5C2A8DCB"><enum>(A)</enum><header>In general</header><text>The Secretary of Energy, in consultation with the heads of other Federal agencies, as appropriate, may—</text><clause id="id9339CF531C3C4839B3CCF9C8E0E676DD"><enum>(i)</enum><text>establish and publish criteria for recognizing particular covered equipment and particular vendors in the market for covered equipment as prequalified for future transactions; and </text></clause><clause id="id78E3CAF63F104E1B92333EC6B6EBD7EE"><enum>(ii)</enum><text>apply those criteria to establish and publish, and update, as necessary, a list of prequalified equipment and vendors. </text></clause></subparagraph><subparagraph id="idF191C6D78C594397BE6A23592EDC4170"><enum>(B)</enum><header>Savings provision</header><text>Nothing in this paragraph limits the authority of the Secretary of Energy under this subsection to prohibit or otherwise regulate any transaction involving prequalified equipment or vendors.</text></subparagraph></paragraph></subsection><subsection id="idb0f8cd96d89d480fb52bcfe0049b412a"><enum>(c)</enum><header>Implementation</header><paragraph id="idF655D1F915C14F3BAC32748B6E420CF6"><enum>(1)</enum><header>Implementation by the Secretary of Energy</header><text display-inline="yes-display-inline">The Secretary of Energy shall take such actions as the Secretary determines to be necessary to implement this section, including—</text><subparagraph id="idB6889F1AE9394C55BE86DB92BF0780DD"><enum>(A)</enum><text display-inline="yes-display-inline">directing the timing and manner of the cessation of pending and future transactions prohibited under subsection (b)(1); </text></subparagraph><subparagraph id="id873C4384F6C5416B98015AC693D429EE"><enum>(B)</enum><text display-inline="yes-display-inline">adopting appropriate rules and regulations; and </text></subparagraph><subparagraph id="id62C066FA6D2A4F1684475CC9DDF35607"><enum>(C)</enum><text display-inline="yes-display-inline">exercising any applicable power granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) and delegated to the Secretary. </text></subparagraph></paragraph><paragraph id="id8be68901b75e484b9b7708a2605cb427"><enum>(2)</enum><header>Required rulemaking</header><subparagraph id="idA5A4ABCA414245E8A8BF6F3120D62D96"><enum>(A)</enum><header>In general</header><text>Not later than 150 days after the date of enactment of this Act, the Secretary of Energy, in consultation with the Secretary of Defense, the Secretary of Homeland Security, the Director of National Intelligence, and the heads of other appropriate Federal agencies, as determined by the Secretary of Energy, shall issue rules or regulations to implement this section.</text></subparagraph><subparagraph id="id2E08F7F56FC64355ABDD26D0972A3D09"><enum>(B)</enum><header>Authority</header><text>A rule or regulation issued under subparagraph (A) may—</text><clause id="id9D23156DA5874E10A73D0F7D2D99B022"><enum>(i)</enum><text>determine that particular countries or persons are foreign adversaries exclusively for the purposes of this section; </text></clause><clause id="id5230DB96EDB54AF1972286D6E9D94099"><enum>(ii)</enum><text>identify persons owned by, controlled by, or subject to the jurisdiction or direction of, foreign adversaries exclusively for the purposes of this section; </text></clause><clause id="idFE0DAC47EF9343FC849A71D686EE2FEE"><enum>(iii)</enum><text>identify particular equipment or countries with respect to which transactions involving covered equipment warrant particular scrutiny under this section; and</text></clause><clause id="idD166B1B983CE4185A0D6F85E31FD218A"><enum>(iv)</enum><text>identify a mechanism and relevant factors for the negotiation of agreements to mitigate concerns identified in making determinations under subsection (b)(1)(B).</text></clause></subparagraph></paragraph><paragraph id="idc4cb8e7c770e40a9bde23c3ecd3ff2ef"><enum>(3)</enum><header>Identification of certain equipment</header><text>As soon as practicable after the date of enactment of this Act, the Secretary of Energy, in consultation with the Secretary of Defense, the Secretary of the Interior, the Secretary of Homeland Security, the Director of National Intelligence, the Board of Directors of the Tennessee Valley Authority, and the heads of other appropriate Federal agencies, as determined by the Secretary of Energy, shall—</text><subparagraph id="id60994e4ec8cb4a4bb3d818d1059a10a1"><enum>(A)</enum><text>identify existing covered equipment that—</text><clause id="idDE117371372841E49A30827402C6D25A"><enum>(i)</enum><text>is designed, developed, manufactured, or supplied by persons owned by, controlled by, or subject to the jurisdiction or direction of a foreign adversary; and </text></clause><clause id="idD6042EF6440A4EC784BDA486787BDB0E"><enum>(ii)</enum><text>poses an undue risk of catastrophic effects on the security or resiliency of critical electric infrastructure in the United States; and</text></clause></subparagraph><subparagraph id="idcf9948da2ff14df197bae02551b8dda5"><enum>(B)</enum><text>develop recommendations on ways to identify, isolate, monitor, or replace any covered equipment identified under subparagraph (A) as soon as practicable.</text></subparagraph></paragraph><paragraph id="idCBFB2A4F6E364164874D439600508C8B"><enum>(4)</enum><header>Coordination and information sharing</header><text>The Secretary of Energy shall work with the Secretary of Defense, the Secretary of the Interior, the Secretary of Homeland Security, the Director of National Intelligence, the Board of Directors of the Tennessee Valley Authority, and the heads of other appropriate Federal agencies, as determined by the Secretary of Energy, to protect critical defense facilities from national security threats through—</text><subparagraph id="id354F0D6999F84D978C38607C77B2E7BF"><enum>(A)</enum><text display-inline="yes-display-inline">the coordination of the procurement of energy infrastructure by the Federal Government; and </text></subparagraph><subparagraph id="id0907C1AEC71B4FC19737DDE5849311C6"><enum>(B)</enum><text display-inline="yes-display-inline">the sharing of risk information and risk management practices to inform that procurement.</text></subparagraph></paragraph><paragraph id="id8fead6170d97457ab78b761f61753a12"><enum>(5)</enum><header>Requirement</header><text display-inline="yes-display-inline">This section shall be implemented—</text><subparagraph id="id501C2140B1FB4411BAB7193AD4BCB89E"><enum>(A)</enum><text display-inline="yes-display-inline">in a manner that is consistent with all other applicable laws; and </text></subparagraph><subparagraph id="idC7586A0BDE194B81B2B4E0338A618DA2" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">subject to the availability of appropriations. </text></subparagraph></paragraph></subsection><subsection id="id091b42f05dbf4e5491fe93e3fb84cc3b" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Reports to Congress</header><text display-inline="yes-display-inline">The Secretary of Energy shall submit to Congress periodic reports describing any progress made in implementing, or otherwise relating to the implementation of, this section.</text></subsection></section></legis-body></bill>
