which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Homeland Security to establish a veterans visa program to permit veterans who have been removed from the United States to return as immigrants, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HDC2AED8A2A3C435D92869C4CA0ECF46E"><section section-type="section-one" id="HBFADCCBD7A644476BD55D8911A436237"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Visa and Protection Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="H64EE8074F75B4C88B3EAEEC6F6EDDEBA"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H2D60A5CE873141E5881931971328C69A"><enum>(1)</enum><header>Armed Forces</header><text>The term <term>Armed Forces</term> has the meaning given the term <quote>armed forces</quote> in section 101 of title 10, United States Code.</text></paragraph><paragraph id="idAA1903F5249548E28BFC2CD09791BA0C"><enum>(2)</enum><header>Crime of violence</header><text display-inline="yes-display-inline">The term <term>crime of violence</term> means an offense defined in section 16(a) of title 18, United States Code—</text><subparagraph id="id4F813ABE53CA4D45BF5D987EC2030D24"><enum>(A)</enum><text display-inline="yes-display-inline">that is not a purely political offense; and</text></subparagraph><subparagraph id="id09C7BF03C25D49FC80F5B6531C802ABD"><enum>(B)</enum><text display-inline="yes-display-inline">for which a noncitizen has served a term of imprisonment of at least 5 years.</text></subparagraph></paragraph><paragraph id="idDACBA189992F444BBE4D5308F5FF0751"><enum>(3)</enum><header>Eligible veteran</header><subparagraph id="id10DC6E0D39CD4A71880A0573ECCDD230"><enum>(A)</enum><header>In general</header><text>The term <term>eligible veteran</term> means a veteran who—</text><clause id="idBDB0CB26939049979862219BD7FA4F14"><enum>(i)</enum><text>is a noncitizen; and</text></clause><clause id="id30399E364688483F9F3665740E6C1E1D"><enum>(ii)</enum><text>meets the criteria described in section 3(e).</text></clause></subparagraph><subparagraph id="idD8DA1006D0034CB49D29E0A346D33F99"><enum>(B)</enum><header>Inclusion</header><text>The term <term>eligible veteran</term> includes a veteran who—</text><clause id="id15A0DFD121CE4515BCD409F0CF1C856D"><enum>(i)</enum><text>was removed from the United States; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idA3E92B32F5354917AF20649C35638BCB"><enum>(ii)</enum><text>is abroad and is inadmissible under section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="HD96D2E0024FF4887B93F3E167A3FD98C"><enum>(4)</enum><header>Noncitizen</header><text display-inline="yes-display-inline">The term <term>noncitizen</term> means an individual who is not a citizen or national of the United States.</text></paragraph><paragraph id="HC6A5E09F504C4C3DA41D1B2BEC2AA3E3"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph><paragraph id="HAB85121F98BC47FD96E02CFAFE3BCAB2"><enum>(6)</enum><header>Service member</header><text display-inline="yes-display-inline">The term <term>service member</term> means an individual who is serving as a member of—</text><subparagraph id="id11B935A4365D493AA3E3AAFD1FBE6EF9"><enum>(A)</enum><text display-inline="yes-display-inline">a regular or reserve component of the Armed Forces on active duty; or</text></subparagraph><subparagraph id="id76CF9B553956470F8C1F32FCA14075EF"><enum>(B)</enum><text display-inline="yes-display-inline">a reserve component of the Armed Forces in an active status.</text></subparagraph></paragraph><paragraph id="H51635A6689C94CAF836A7C204F0716FF"><enum>(7)</enum><header>Veteran</header><text>The term <term>veteran</term> has the meaning given the term in section 101 of title 38, United States Code.</text></paragraph></section><section id="H2705DE89DCBA4C7EA6677740942BB24F"><enum>3.</enum><header>Return of eligible veterans removed from the United States; adjustment of status</header><subsection id="H0E08F36387BB4D69995F88A36A81E695"><enum>(a)</enum><header>Program for admission and adjustment of status</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall establish a program and an application procedure that allows—</text><paragraph id="HA713229AA7A648B699EC1DE01C00CA43"><enum>(1)</enum><text>eligible veterans outside the United States to be admitted to the United States as aliens lawfully admitted for permanent residence (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)); and</text></paragraph><paragraph id="H419970FF52AE4845A1628A39BE637842"><enum>(2)</enum><text display-inline="yes-display-inline">eligible veterans in the United States to adjust status to that of aliens lawfully admitted for permanent residence.</text></paragraph></subsection><subsection id="id6ED0022B07894AFD8F2043BC51248749"><enum>(b)</enum><header>Veterans ordered removed</header><paragraph id="id22B0C65F84C54B16BA8EE8A8A0CAF7A1"><enum>(1)</enum><header>In general</header><text>With respect to noncitizen veterans who are the subjects of final orders of removal, including noncitizen veterans who are outside the United States, not later than 180 days after the date of the enactment of this Act, the Attorney General shall—</text><subparagraph id="id13B2ECDFE547430694BA284BF97AEF25"><enum>(A)</enum><text>reopen the removal proceedings of each such noncitizen veteran; and</text></subparagraph><subparagraph id="id1A4229FB199F4D7D8C33C0418B4134E7"><enum>(B)</enum><text>make a determination with respect to whether each such noncitizen veteran is an eligible veteran.</text></subparagraph></paragraph><paragraph id="idAD389D6079A54631BC38DFC4D52DAC8E"><enum>(2)</enum><header>Rescission of removal order</header><text>In the case of a determination under paragraph (1)(B) that a noncitizen veteran is an eligible veteran, the Attorney General shall—</text><subparagraph id="id7ED7ED85FCBC4D488D46C27918D49D01"><enum>(A)</enum><text>rescind the order of removal;</text></subparagraph><subparagraph id="id4C4938DCB93E4DBE9194E46E9E6EADEF"><enum>(B)</enum><text>adjust the status of the eligible veteran to that of an alien lawfully admitted for permanent residence; and</text></subparagraph><subparagraph id="idB7B0B33CEBAA4C73B259ECC7F4BCF645"><enum>(C)</enum><text>terminate removal proceedings.</text></subparagraph></paragraph></subsection><subsection id="id5A99300C8E66412F9905D2F0297C9C39"><enum>(c)</enum><header>Veterans in removal proceedings</header><paragraph id="id2ABAF053F382445EB0EA46069F279A7E"><enum>(1)</enum><header>In general</header><text>With respect to noncitizen veterans the removal proceedings of whom are pending as of the date of the enactment of this Act, not later than 180 days after the date of the enactment of this Act, the Attorney General shall make a determination with respect to whether each such noncitizen veteran is an eligible veteran.</text></paragraph><paragraph id="id2E2EEF764E9949399546723D1DB61642"><enum>(2)</enum><header>Termination of proceedings</header><text>In the case of a determination under paragraph (1) that a noncitizen veteran is an eligible veteran, the Attorney General shall—</text><subparagraph id="id7F96319CEB7A4EB7BF47B27669D6E0F1"><enum>(A)</enum><text>adjust the status of the eligible veteran to that of an alien lawfully admitted for permanent residence; and</text></subparagraph><subparagraph id="id353889A40FAF4ABFACCD4F4F018B25F0"><enum>(B)</enum><text>terminate removal proceedings.</text></subparagraph></paragraph></subsection><subsection id="HBB34FACB9D1F445881B6D06A83DB93D5"><enum>(d)</enum><header>No numerical limitations</header><text>Nothing in this section or in any other provision of law may be construed to apply a numerical limitation to the number of veterans who may be eligible to receive a benefit under this section.</text></subsection><subsection id="H9C57B9E5B87A4BB1BEF2069911404BE1"><enum>(e)</enum><header>Eligibility</header><paragraph id="H9107A766F2C947039A6EC998B023C1F1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, including sections 212 and 237 of the Immigration and Nationality Act (8 U.S.C. 1182 and 1227), a noncitizen veteran shall be eligible to participate in the program established under subsection (a) or for adjustment of status under subsection (b) or (c), as applicable, if the Secretary or the Attorney General, as applicable, determines that the noncitizen veteran—</text><subparagraph id="H6DF20D86F88542AF9EA42A434FE4284B"><enum>(A)</enum><text display-inline="yes-display-inline">was not removed or ordered removed from the United States based on a conviction for—</text><clause id="H2CCA1F224D454998A6A6B44CE257F0A5"><enum>(i)</enum><text>a crime of violence; or</text></clause><clause id="H446E1C7BD35749D6B947A6AD83AC2F92"><enum>(ii)</enum><text>a crime that endangers the national security of the United States for which the noncitizen veteran has served a term of imprisonment of at least 5 years; and</text></clause></subparagraph><subparagraph id="H68B1205392C545E5825001CC47445E6E"><enum>(B)</enum><text>is not inadmissible to, or deportable from, the United States based on a conviction for a crime described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="H4AD6CFF80A764FC29C86092B3BC2F5B2"><enum>(2)</enum><header>Waiver</header><text>The Secretary may waive the application of paragraph (1)—</text><subparagraph id="id4240D87C11E94029AAE22B330C607E42"><enum>(A)</enum><text>for humanitarian purposes;</text></subparagraph><subparagraph id="idA91D8E0A4C3B47748F2532528DD5B621"><enum>(B)</enum><text>to ensure family unity;</text></subparagraph><subparagraph id="idAB8ED70C59BA4A359A70C75ACD5E454E"><enum>(C)</enum><text>based on exceptional service in the Armed Forces; or</text></subparagraph><subparagraph id="idC314232BAA3C4C09A261884166553536"><enum>(D)</enum><text>if a waiver is otherwise in the public interest.</text></subparagraph></paragraph></subsection></section><section id="HC976269025E043D0872987EF86B0DA3D"><enum>4.</enum><header>Protecting veterans and service members from removal</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, including section 237 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227</external-xref>), a noncitizen who is a veteran or service member may not be removed from the United States unless the noncitizen has been convicted for a crime of violence.</text></section><section id="H12D73C8D6C914422B4F3B3EFEADBDF47"><enum>5.</enum><header>Naturalization through service in the Armed Forces</header><subsection id="id3B8C21EC997B41DAA8F4ACD9C126DF35"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subsection (b), a noncitizen who has obtained the status of an alien lawfully admitted for permanent residence pursuant to section 3 shall be eligible for naturalization through service in the Armed Forces under sections 328 and 329 of the Immigration and Nationality Act (8 U.S.C. 1439 and 1440).</text></subsection><subsection id="id579CD042AAF34337B6DF49B20703753B"><enum>(b)</enum><header>Special rules</header><paragraph id="id422F5E8A65EF46DA9B94369B36905990"><enum>(1)</enum><header>Good moral character</header><text display-inline="yes-display-inline">In determining whether a noncitizen described in subsection (a) is a person of good moral character, the Secretary shall disregard the one or more grounds on which the noncitizen was—</text><subparagraph id="id9B6B31794BB242EAA4ED5F39681F9169"><enum>(A)</enum><text display-inline="yes-display-inline">removed or ordered removed from the United States; or</text></subparagraph><subparagraph id="id5A104CD4A010422391C77D5158922FD7"><enum>(B)</enum><text display-inline="yes-display-inline">rendered inadmissible to, or deportable from, the United States.</text></subparagraph></paragraph><paragraph id="H1BC0F913EF654531A39C98BAA261867A"><enum>(2)</enum><header>Periods of absence</header><text display-inline="yes-display-inline">The Secretary shall disregard any period of absence from the United States of a noncitizen described in subsection (a) due to the noncitizen having been removed from, or being inadmissible to, the United States if the noncitizen satisfies the applicable requirement relating to continuous residence or physical presence.</text></paragraph></subsection></section><section id="HF9F0F5328F744944BDBFAB19442D67F1"><enum>6.</enum><header>Access to military benefits</header><text display-inline="no-display-inline">A noncitizen who has obtained the status of an alien lawfully admitted for permanent residence pursuant to section 3 shall be eligible for all military and veterans benefits for which the noncitizen would have been eligible had the noncitizen not been ordered removed or removed from the United States, voluntarily departed the United States, or rendered inadmissible to, or deportable from, the United States, as applicable.</text></section><section id="H939657EAB48F46549E220C79D7AC3D09"><enum>7.</enum><header>Implementation</header><subsection id="HC2C6C06E73284CCAABA194AFB320B098"><enum>(a)</enum><header>Identification</header><text>The Secretary shall identify noncitizen service members and veterans at risk of removal from the United States by—</text><paragraph id="H6B80E959E86A4C9B9BB8D5700DFB9CD5"><enum>(1)</enum><text display-inline="yes-display-inline">before initiating a removal proceeding against a noncitizen, asking the noncitizen whether he or she is serving, or has served, as a member of—</text><subparagraph id="idF9B4CB42A92E422A9D1EF026D22A5D47"><enum>(A)</enum><text display-inline="yes-display-inline">a regular or reserve component of the Armed Forces on active duty; or</text></subparagraph><subparagraph id="id06EFAB497BB74AE8A25F1803999558E5"><enum>(B)</enum><text display-inline="yes-display-inline">a reserve component of the Armed Forces in an active status;</text></subparagraph></paragraph><paragraph id="H4781C6BF800F4ED5981986BA8F2A699B"><enum>(2)</enum><text>requiring U.S. Immigration and Customs Enforcement personnel to seek supervisory approval before initiating a removal proceeding against a service member or veteran; and</text></paragraph><paragraph id="H0C4BC5365F9B492182B40DEED8E9D33F"><enum>(3)</enum><text>keeping records of any service member or veteran who has been—</text><subparagraph id="id180FDAF26ED740D8AE08D783601EA907"><enum>(A)</enum><text>the subject of a removal proceeding;</text></subparagraph><subparagraph id="id017C14C46FE34933984BC4572EB35A3B"><enum>(B)</enum><text>detained by the Director of U.S. Immigration and Customs Enforcement; or</text></subparagraph><subparagraph id="idE42F36D4B0224E27AED58CB1B6238164"><enum>(C)</enum><text>removed from the United States.</text></subparagraph></paragraph></subsection><subsection id="H97981F7A094947D08676E0054617B896"><enum>(b)</enum><header>Record annotation</header><paragraph id="id0D2B163A9DD14AC7AF92D02BB1F83575"><enum>(1)</enum><header>In general</header><text>In the case of a noncitizen service member or veteran identified under subsection (a), the Secretary shall annotate all immigration and naturalization records of the Department of Homeland Security relating to the noncitizen—</text><subparagraph id="id1DA5F9FFE1914672A677BA0816AB363C"><enum>(A)</enum><text>to reflect that the noncitizen is a service member or veteran; and</text></subparagraph><subparagraph id="id78F8BA7DC1CB4BC59EBD7855B83E8F8F"><enum>(B)</enum><text>to afford an opportunity to track the outcomes for the noncitizen.</text></subparagraph></paragraph><paragraph id="id3A3196326DB6440B9BEA806A5EBBEA88"><enum>(2)</enum><header>Contents of annotation</header><text>Each annotation under paragraph (1) shall include—</text><subparagraph id="HB1222CD694B94E2181CEC0888E2767AC"><enum>(A)</enum><text>the branch of military service in which the noncitizen is serving or has served;</text></subparagraph><subparagraph id="HD337C7E5C9E74AA78370D5B1D88B2B8C"><enum>(B)</enum><text>whether the noncitizen is serving, or has served, during a period of military hostilities described in section 329 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1440">8 U.S.C. 1440</external-xref>);</text></subparagraph><subparagraph id="HC423C2D5AAE2461397120ACBA4D8123C"><enum>(C)</enum><text>the immigration status of the noncitizen on the date of enlistment;</text></subparagraph><subparagraph id="H843CCC58E89F4D1E9A5F16A7EA58E793"><enum>(D)</enum><text>whether the noncitizen is serving honorably or was separated under honorable conditions;</text></subparagraph><subparagraph id="HD3E12209929F4014B2E5DF7B0604ACB5"><enum>(E)</enum><text>the ground on which removal of the noncitizen from the United States was sought; and</text></subparagraph><subparagraph id="id3F3EE65745E74284AA0520C4213893DF"><enum>(F)</enum><text>in the case of a noncitizen the removal proceedings of whom were initiated on the basis of a criminal conviction, the crime for which the noncitizen was convicted.</text></subparagraph></paragraph></subsection></section><section id="HB4DA308DA8B6454E85CBD3238CCB5164"><enum>8.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary shall promulgate regulations to implement this Act.</text></section></legis-body></bill>
