which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize the Native American Housing Assistance and Self-Determination Act of 1996.</official-title></form><legis-body><section id="id334B16C035BF4A03BB7BD2665DF3B224" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American Housing Assistance and Self-Determination Reauthorization Act of 2021</short-title></quote>.</text></section><section id="idE02FDBFCF1844903B34DE8822ED3A315"><enum>2.</enum><header>Consolidation of environmental review requirements</header><text display-inline="no-display-inline">Section 105 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4115">25 U.S.C. 4115</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3B523FC310FF4AF89E68526FDF7FCAC2"><subsection id="id7C554B2785E24036949926731BEA27B7"><enum>(e)</enum><header>Consolidation of environmental review requirements</header><paragraph id="idE5A5C9AE0EA945978BC20260998E75EC"><enum>(1)</enum><header>In general</header><text>In the case of a recipient of grant amounts under this Act that is carrying out a project that qualifies as an affordable housing activity under section 202, if the recipient is using 1 or more additional sources of Federal funds to carry out the project, and the grant amounts received under this Act constitute the largest single source of Federal funds that the recipient reasonably expects to commit to the project at the time of environmental review, the Indian tribe of the recipient may assume, in addition to all of the responsibilities for environmental review, decision making, and action under subsection (a), all of the additional responsibilities for environmental review, decision making, and action under provisions of law that would apply to each Federal agency providing additional funding were the Federal agency to carry out the project as a Federal project.</text></paragraph><paragraph id="id93918B49A970491EBD63138BDBBF6EE9"><enum>(2)</enum><header>Discharge</header><text>The assumption by the Indian tribe of the additional responsibilities for environmental review, decision making, and action under paragraph (1) with respect to a project shall be deemed to discharge the responsibility of the applicable Federal agency for environmental review, decision making, and action with respect to the project.</text></paragraph><paragraph id="id523B18AA98D14B678B5ABDD51C25AA57"><enum>(3)</enum><header>Certification</header><text>An Indian tribe that assumes the additional responsibilities under paragraph (1), shall certify, in addition to the requirements under subsection (c)—</text><subparagraph id="id683367C91DD242E4A432C63690B3B0E9"><enum>(A)</enum><text>the additional responsibilities that the Indian tribe has fully carried out under this subsection; and</text></subparagraph><subparagraph id="id78667E94F28C493AAEB5EA8BC03420E2"><enum>(B)</enum><text>that the certifying officer consents to assume the status of a responsible Federal official under the provisions of law that would apply to each Federal agency providing additional funding under paragraph (1).</text></subparagraph></paragraph><paragraph id="id8FAB2FECCBC4422894E170FA79715E68"><enum>(4)</enum><header>Liability</header><subparagraph id="idD5FF7570ECEA43BBBB795A65D29E0387"><enum>(A)</enum><header>In general</header><text>An Indian tribe that completes an environmental review under this subsection shall assume sole liability for the content and quality of the review.</text></subparagraph><subparagraph id="id1217C3C16B514D2983FDE9B608E5975F"><enum>(B)</enum><header>Remedies and sanctions</header><text>Except as provided in subparagraph (C), if the Secretary approves a certification and release of funds to an Indian tribe for a project in accordance with subsection (b), but the Secretary or the head of another Federal agency providing funding for the project subsequently learns that the Indian tribe failed to carry out the responsibilities of the Indian tribe as described in subsection (a) or paragraph (1), as applicable, the Secretary or other head, as applicable, may impose appropriate remedies and sanctions in accordance with—</text><clause id="idC6F4E98997824125A9AECA28567A1DB6"><enum>(i)</enum><text>the regulations issued pursuant to section 106; or </text></clause><clause id="idD86728BED64545A4851852691875733E"><enum>(ii)</enum><text>such regulations as are issued by the other head.</text></clause></subparagraph><subparagraph id="id712CAA6661F94A358F5E98CFFD53B6D6"><enum>(C)</enum><header>Statutory violation waivers</header><text>If the Secretary waives the requirements under this section in accordance with subsection (d) with respect to a project for which an Indian tribe assumes additional responsibilities under paragraph (1), the waiver shall prohibit any other Federal agency providing additional funding for the project from imposing remedies or sanctions for failure to comply with requirements for environmental review, decision making, and action under provisions of law that would apply to the Federal agency.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id4CCA2D637FF44A539A08CD81976BBF06"><enum>3.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 108 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4117">25 U.S.C. 4117</external-xref>) is amended, in the first sentence, by striking <quote>2009 through 2013</quote> and inserting <quote>2022 through 2032</quote>.</text></section><section id="idF7ABF8A917D84D2F8E657E069B3FE1A5"><enum>4.</enum><header>Student housing assistance</header><text display-inline="no-display-inline">Section 202(3) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4132">25 U.S.C. 4132(3)</external-xref>) is amended by inserting <quote>including education-related stipends, college housing assistance, and other education-related assistance for low-income college students,</quote> after <quote>self-sufficiency and other services,</quote>. </text></section><section id="idA9841BA26A7C4212B62ACF1D0A7C9044"><enum>5.</enum><header>Application of rent rule only to units owned or operated by Indian tribe or tribally designated housing entity</header><text display-inline="no-display-inline">Section 203(a)(2) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4133">25 U.S.C. 4133(a)(2)</external-xref>) is amended by inserting <quote>owned or operated by a recipient and</quote> after <quote>residing in a dwelling unit</quote>.</text></section><section id="H0EA957CD863945FDA2F80BC4B93E4735"><enum>6.</enum><header>Program requirements</header><text display-inline="no-display-inline">Section 203(a) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4133">25 U.S.C. 4133(a)</external-xref>) (as amended by section 5) is amended—</text><paragraph id="HEE6A733361CC4B98B7B0992AC16DDD43"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2) and (3)</quote>;</text></paragraph><paragraph id="idF0D97FD21B3449F79F6F685E6ABE3639"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph (3);</text></paragraph><paragraph id="H55FE8F941CE74626AD408669A41481EA"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="H46CDDCDDF12046E38076C78B8771AA1D" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HF4ABFEC409D1492285730E47CCE6BA8A"><enum>(2)</enum><header>Application of tribal policies</header><text display-inline="yes-display-inline">Paragraph (3) shall not apply if—</text><subparagraph commented="no" display-inline="no-display-inline" id="id55B6C4D61F994AEA9C27EF42BA12761E"><enum>(A)</enum><text display-inline="yes-display-inline">the recipient has a written policy governing rents and homebuyer payments charged for dwelling units; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA9F2BC7AFFCD4142A4F3FFE8CE21EAE6"><enum>(B)</enum><text display-inline="yes-display-inline">that policy includes a provision governing maximum rents or homebuyer payments, including tenant protections.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id6B6667E5D1ED470B87F8E41CA7E5584A" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>in paragraph (3) (as so redesignated), by striking <quote>In the case of</quote> and inserting <quote>In the absence of a written policy governing rents and homebuyer payments, in the case of</quote>. </text></paragraph></section><section id="id4B53ABD7957C48188E0FE725216D4F84"><enum>7.</enum><header>De minimis exemption for procurement of goods and services</header><text display-inline="no-display-inline">Section 203(g) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4133">25 U.S.C. 4133(g)</external-xref>) is amended by striking <quote>$5,000</quote> and inserting <quote>$10,000</quote>. </text></section><section id="HEB409191693A4CC5B7125246B602FE99"><enum>8.</enum><header>Homeownership or lease-to-own low-income requirement and income targeting</header><text display-inline="no-display-inline">Section 205 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4135">25 U.S.C. 4135</external-xref>) is amended—</text><paragraph id="H946C5A2E2E9F40BE91B45B71993F56F5"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph id="H83560CE862454C77B7F2828C2C095A73"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="HF8DCB63AB40247C78B2451F652F2D7BE"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF59AE0D93F63462C8D66CDE133726B00" style="OLC"><subparagraph id="H1A045497A2D940208F607DFC4C12F3BD"><enum>(E)</enum><text display-inline="yes-display-inline">notwithstanding any other provision of this paragraph, in the case of rental housing that is made available to a current rental family for conversion to a homebuyer or a lease-purchase unit, that the current rental family can purchase through a contract of sale, lease-purchase agreement, or any other sales agreement, is made available for purchase only by the current rental family, if the rental family was a low-income family at the time of their initial occupancy of such unit; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8E2F338842FC48D5ADB4CC611577272E"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6AF2F1BA9A3443D492036E29F5CC65EC"><enum>(A)</enum><text>by striking <quote>The provisions</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idBBD95AB84D214D019EC0A60E5A15762D" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idF9BFA9D5855441BFA1B41DF75CCA2620"><enum>(1)</enum><header>In general</header><text>The provisions</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFECD66631ADA4D219A583C4857DCD869"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id9A34E8CF48EA4A158201387B39DD44F1" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idC4729A37CF3048EC9C7D4B2DDE2FC127"><enum>(2)</enum><header>Applicability to improvements</header><text>The provisions of subsection (a)(2) regarding binding commitments for the remaining useful life of property shall not apply to improvements of privately owned homes if the cost of the improvements do not exceed 10 percent of the maximum total development cost for the home.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="idd1f94e02-2688-4042-9595-e6bc2f90d65c"><enum>9.</enum><header>Lease requirements and tenant selection</header><text display-inline="no-display-inline">Section 207 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4137">25 U.S.C. 4137</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id673e8180-7777-47a2-9e7d-168e1fd55a66" style="OLC"><subsection id="id3d0eb521-2b09-49fe-b5ab-825c856f7ea0"><enum>(c)</enum><header>Notice of termination</header><text display-inline="yes-display-inline">The notice period described in subsection (a)(3) shall apply to projects and programs funded in part by amounts authorized under this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id55D1472DBD0540169886C6078EF40E00"><enum>10.</enum><header>Indian Health Service</header><subsection id="id1D4FFD72EBFC452FB1D7681A9E4DA099"><enum>(a)</enum><header>In general</header><text>Subtitle A of title II of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4131">25 U.S.C. 4131 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8A94C33C5E344C97985B66B249E723D3"><section id="idA8C2F6D7866F4469B6732F628B710305"><enum>211.</enum><header>IHS sanitation facilities construction</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Director of the Indian Health Service, or a recipient receiving funding for a housing construction or renovation project under this title, may use funding from the Indian Health Service for the construction of sanitation facilities under that project.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idBE133EDE4B37452FB7D3741CA824CB87"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/330">Public Law 104–330</external-xref>; 110 Stat. 4016) is amended by inserting after the item relating to section 210 the following:</text><quoted-block style="OLC" id="idDC1D11AF2E66401B95F3FE509C4192B0"><toc><toc-entry level="section">Sec. 211. IHS sanitation facilities construction.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idE4145B79EC194F0AAAFDE5FC650334D0"><enum>11.</enum><header>Statutory authority to suspend grant funds in emergencies</header><text display-inline="no-display-inline">Section 401(a)(4) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4161">25 U.S.C. 4161(a)(4)</external-xref>) is amended—</text><paragraph id="idD37E76A3DB7C4A928A1E67AE8AFF7255"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>may take an action described in paragraph (1)(C)</quote> and inserting <quote>may immediately take an action described in paragraph (1)(C)</quote>; and</text></paragraph><paragraph id="id800BC1CA1AD14B7F83E3D6840809FF67"><enum>(2)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block id="id715615E52360443F86DE4C3C5DDDC55E" display-inline="no-display-inline" style="OLC"><subparagraph id="id08EC8ABABCD34459BBC238D55F787073"><enum>(B)</enum><header>Procedural requirements</header><clause id="idA86A59303B1B4712A881DE0D3475EC65"><enum>(i)</enum><header>In general</header><text>If the Secretary takes an action described in subparagraph (A), the Secretary shall provide notice to the recipient at the time that the Secretary takes that action.</text></clause><clause id="id94D90F8AC2AC4BC587B2728D5E946841" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header>Notice requirements</header><text>The notice under clause (i) shall inform the recipient that the recipient may request a hearing by not later than 30 days after the date on which the Secretary provides the notice. </text></clause><clause commented="no" display-inline="no-display-inline" id="idA8D8BF274C234C888ACEC6087B5548B5"><enum>(iii)</enum><header>Hearing requirements</header><text>A hearing requested under clause (ii) shall be conducted—</text><subclause commented="no" display-inline="no-display-inline" id="idD91DC03B42504959BDE5762981FB783B"><enum>(I)</enum><text>in accordance with subpart A of part 26 of title 24, Code of Federal Regulations (or successor regulations); and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id975878A1484946EF8EF1022F4E0F12C9"><enum>(II)</enum><text>to the maximum extent practicable, on an expedited basis.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id0465802BACD64803A6D05B10CE484141"><enum>(iv)</enum><header>Failure to conduct a hearing</header><text>If a hearing requested under clause (ii) is not completed by the date that is 180 days after the date on which the recipient requests the hearing, the action of the Secretary to limit the availability of payments shall no longer be effective.</text></clause></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="id60fa4018-f693-4486-ac49-18bf041983d3"><enum>12.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">Section 407 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4167">25 U.S.C. 4167</external-xref>) is amended—</text><paragraph id="id34e81ecf-a1f9-40ad-b998-e35dc23b1536"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>Congress</quote> and inserting <quote>Committee on Indian Affairs and the Committee on Banking, Housing and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives</quote>; and</text></paragraph><paragraph id="idf3208720-2639-430a-b2ab-d030ecb1c24a"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id8122f6d7-fe9b-4463-aac0-b66ac09a255f" style="OLC"><subsection id="id51be8059-c24f-4166-9080-a835f0154558"><enum>(c)</enum><header>Public availability</header><text display-inline="yes-display-inline">The report described in subsection (a) shall be made publicly available, including to recipients.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idf54d7d91cd704234847509aaea25778a"><enum>13.</enum><header>99-year leasehold interest in trust or restricted lands for housing purposes</header><text display-inline="no-display-inline">Section 702 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4211">25 U.S.C. 4211</external-xref>) is amended—</text><paragraph id="idd284d2ada70f4b288e351e3f57a463b4"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text style="OLC" level="section">50-year</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="section">99-year</header-in-text></quote>;</text></paragraph><paragraph id="idaf3e6600e7fc4889bc2057fdb45a83b4"><enum>(2)</enum><text>in subsection (b), by striking <quote>50 years</quote> and inserting <quote>99 years</quote>; and</text></paragraph><paragraph id="idd4a4eeef71d342b2a88e6c01093ae8bf"><enum>(3)</enum><text>in subsection (c)(2), by striking <quote>50 years</quote> and inserting <quote>99 years</quote>.</text></paragraph></section><section id="id476bb538fcf54aad81ef139502bf2a9b"><enum>14.</enum><header>Amendments for block grants for affordable housing activities</header><text display-inline="no-display-inline">Section 802(e) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4222">25 U.S.C. 4222(e)</external-xref>) is amended by—</text><paragraph id="id4d72f2ee3a284076819fd1b8e9d78cd7"><enum>(1)</enum><text>by striking <quote>The Director</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2CCAF2A4A20B4F908E7C3E37F063BADE"><paragraph id="idE6CCF308C9384E69B43FBE46EC9D519F"><enum>(1)</enum><header>In general</header><text>The Director</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id6a76e1f6d74f4d059d685133393f4471"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide6ba0f3c97db401f9019bc11118c3a29"><paragraph id="id4fe444e74ac747d9ae641cce4d6f427b"><enum>(2)</enum><header>Subawards</header><text>Notwithstanding any other provision of law, including provisions of State law requiring competitive procurement, the Director may make subawards to subrecipients, except for for-profit entities, using amounts provided under this title to carry out affordable housing activities upon a determination by the Director that such subrecipients have adequate capacity to carry out activities in accordance with this Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idF220514F4FAB41F88687B825D7D071A4"><enum>15.</enum><header>Reauthorization of Native Hawaiian homeownership provisions</header><text display-inline="no-display-inline">Section 824 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4243">25 U.S.C. 4243</external-xref>) is amended by striking <quote>such sums as may be necessary</quote> and all that follows through the period at the end and inserting <quote>such sums as may be necessary for each of fiscal years 2022 through 2032.</quote>. </text></section><section id="ida6235aaf-ae12-4df9-b89f-5f680682e631"><enum>16.</enum><header>Total development cost maximum project cost</header><text display-inline="no-display-inline">Affordable housing (as defined in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>)) that is developed, acquired, or assisted under the block grant program established under section 101 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4111">25 U.S.C. 4111</external-xref>) shall not exceed by more than 20 percent, without prior approval of the Secretary of Housing and Urban Development, the total development cost maximum cost for all housing assisted under an affordable housing activity, including development and model activities. </text></section><section id="id67A0619CD94D46D4B32328468831C43B"><enum>17.</enum><header>Community-based development organizations</header><text display-inline="no-display-inline">Section 105 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5305">42 U.S.C. 5305</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1444419EEAF14DBD8C8E17A04BAC9C80"><subsection id="id3B8AAA7BD17147B598869EEBA83E8C18"><enum>(i)</enum><header>Indian tribes and tribally designated housing entities as community-Based development organizations</header><paragraph id="id6C8696757E574A03B2DE7DE9548A998C"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>tribally designated housing entity</term> has the meaning given the term in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></paragraph><paragraph id="id7D24575AE6894252A1A14E4AFC6ACFFF"><enum>(2)</enum><header>Qualification</header><text>An Indian tribe, a tribally designated housing entity, or a tribal organization shall qualify as a community-based development organization for purposes of carrying out new housing construction under this subsection under a grant made under section 106(a)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id44ccdc5d5a0f491fa89870f7bdad5d39"><enum>18.</enum><header>Indian tribe eligibility for hud housing counseling grants</header><text display-inline="no-display-inline">Section 106(a)(4) of the Housing and Urban Development Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701x">12 U.S.C. 1701x(a)(4)</external-xref>) is amended—</text><paragraph id="id256a093be0184ffba18ab1e4ddd0a9b8"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="id5934be16a48a430f9a615e2dae5d9550"><enum>(A)</enum><text>by striking <quote>and</quote> and inserting a comma; and</text></subparagraph><subparagraph id="ida7e99a52040a450d8b05b48e91af0380"><enum>(B)</enum><text>by inserting before the period at the end the following: <quote>, Indian tribes, and tribally designated housing entities</quote>; </text></subparagraph></paragraph><paragraph id="ida2051c40d9174650ae13aeb46c3a5926" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>in subparagraph (B), by inserting <quote>, Indian tribes, and tribally designated housing entities</quote> after <quote>organizations)</quote>;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idF061E2F63E9047418C8B669EDB684438"><enum>(3)</enum><text>by redesignating subparagraph (F) as subparagraph (G); and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id8467C11A684D431BB9B42FFF6D5929B1"><enum>(4)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" 4103</external-xref>).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id4eaac46ff0e64410bddfc08fabc747be"><enum>19.</enum><header>Section 184 Indian Home Loan Guarantee program</header><subsection id="id49B5F692DD984CD98FFFE21ECE852043"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 184(b)(4) of the Housing and Community Development Act of 1992 (12 U.S.C. 1715z–13a(b)(4)) is amended by—</text><paragraph id="id15531ea2fb4d4c32a9befcb0fb8d7c15"><enum>(1)</enum><text>redesignating subparagraphs (A) through (D) as clauses (i) through (iv), respectively, and adjusting the margins accordingly;</text></paragraph><paragraph id="idA54697401E5A4C4A942B307D5CEF983C"><enum>(2)</enum><text>by striking <quote>The loan</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id25B45F63DE19416688CE2E5994E919E2"><subparagraph id="id29575FDCFA4841EDB7F972B008659679"><enum>(A)</enum><header>In general</header><text>The loan</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idedc32f7a399841b4b626fd6253caffb0"><enum>(3)</enum><text>in subparagraph (A), as so designated, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8589f99f2d8442ceb2688b71c82613f6"><clause 4703(a)</external-xref>).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="iddcd822b881bb4411b57ad6b094db6fb0"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1115d01e1ab141178e833aa6efc07a3c"><subparagraph id="id8fdbf417c044444fbe4b4fceee829fd8"><enum>(B)</enum><header>Direct guarantee process</header><clause id="id4EC2EE5E34AD42EE98EBA3C1BE7AB5D9"><enum>(i)</enum><header>Authorization</header><text>The Secretary may authorize qualifying lenders to participate in a direct guarantee process for approving loans under this section.</text></clause><clause id="id6642CD857AAA45CC8E1124D72DA991A3"><enum>(ii)</enum><header>Indemnification</header><subclause id="idB78A9D0558D045469DE23CBCF8093C27"><enum>(I)</enum><header>In general</header><text>If the Secretary determines that a mortgage guaranteed through a direct guarantee process under this subparagraph was not originated in accordance with the requirements established by the Secretary, the Secretary may require the lender approved under this subparagraph to indemnify the Secretary for the loss, irrespective of whether the violation caused the mortgage default. </text></subclause><subclause id="idE6D47ED358CF4B8AA2D4A1A2ED2D3F75"><enum>(II)</enum><header>Fraud or misrepresentation</header><text>If fraud or misrepresentation is involved in a direct guarantee process under this subparagraph, the Secretary shall require the original lender approved under this subparagraph to indemnify the Secretary for the loss regardless of when an insurance claim is paid.</text></subclause></clause></subparagraph><subparagraph id="ida2c89164425342168fa33a416be4d506"><enum>(C)</enum><header>Review of mortgagees</header><clause id="id0D674EF8A848447CBC0BE1989AC7E4BA"><enum>(i)</enum><header>In general</header><text>The Secretary may periodically review the mortgagees originating, underwriting, or servicing single family mortgage loans under this section. </text></clause><clause id="id71FEEC74D4134CD9AF1A5955EA5CE1FB"><enum>(ii)</enum><header>Requirements</header><text>In conducting a review under clause (i), the Secretary—</text><subclause id="id5c24e5bbcb604fc492162e3ef5da8d37"><enum>(I)</enum><text>shall compare the mortgagee with other mortgagees originating or underwriting loan guarantees for Indian housing based on the rates of defaults and claims for guaranteed mortgage loans originated, underwritten, or serviced by that mortgagee;</text></subclause><subclause id="id4442d83b290c4344bfa317dc4d68272c"><enum>(II)</enum><text>may compare the mortgagee with such other mortgagees based on underwriting quality, geographic area served, or any commonly used factors the Secretary determines necessary for comparing mortgage default risk, provided that the comparison is of factors that the Secretary would expect to affect the default risk of mortgage loans guaranteed by the Secretary;</text></subclause></clause><clause id="id9607418293234762bceb19301242e6e9"><enum>(iii)</enum><text>shall implement such comparisons by regulation, notice, or mortgagee letter; and</text><subclause id="id9d5c31de81364a1b912e5aac58d554b8"><enum>(I)</enum><text>may terminate the approval of a mortgagee to originate, underwrite, or service loan guarantees for housing under this section if the Secretary determines that the mortgage loans originated, underwritten, or serviced by the mortgagee present an unacceptable risk to the Indian Housing Loan Guarantee Fund established under subsection (i)—</text><item id="idBAB3266A822D49C3803869032E511DE4"><enum>(aa)</enum><text>based on a comparison of any of the factors set forth in this subparagraph; or</text></item><item id="id37EE60ABDEA8407FA899F37192CBD3C0"><enum>(bb)</enum><text>by a determination that the mortgagee engaged in fraud or misrepresentation.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H954D80D03FEB492FBF6B874FF6B10776"><enum>(b)</enum><header>Loan guarantees for Indian housing</header><text display-inline="yes-display-inline">Section 184(i)(5) of the Housing and Community Development Act of 1992 (12 U.S.C. 1715z–13a(i)(5)) is amended—</text><paragraph id="H3AB9FEB819FE41B997DB6BC670E088A5"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting after the first sentence the following: <quote>There are authorized to be appropriated for those costs such sums as may be necessary for each of fiscal years 2022 through 2032.</quote>; and</text></paragraph><paragraph id="HCA085B92DBEB402196722660AF0B2E40" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>2008 through 2012</quote> and inserting <quote>2022 through 2032</quote>.</text></paragraph></subsection></section><section id="id6fd89f118e734058a12cdfec68f2f3f8"><enum>20.</enum><header>Loan guarantees for Native Hawaiian housing</header><text display-inline="no-display-inline">Section 184A of the Housing and Community Development Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-13b">12 U.S.C. 1715z–13b</external-xref>) is amended—</text><paragraph id="idb925368a3540424ca744c6560bbbc907"><enum>(1)</enum><text>in subsection (c)(4)(B)—</text><subparagraph id="id9de1e8bcaa5a44da9b813b9d073f5d22"><enum>(A)</enum><text>by redesignating clause (iv) as clause (v); and</text></subparagraph><subparagraph id="idd9e19f370a6a46968f67521183798511"><enum>(B)</enum><text>by adding after clause (iii) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd22bf1c82b2940ccbd110fb671b1f2cd"><clause id="ida549d0535c90443ab0d378c50b8f9974"><enum>(iv)</enum><text>Any entity certified as a community development 2032.</quote>.</text></paragraph></section><section id="idde6716e05bd44145ad1981be8f9b6249"><enum>21.</enum><header>Assistant secretary for Indian housing</header><text display-inline="no-display-inline">The Department of Housing and Urban Development Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3531">42 U.S.C. 3531 et seq.</external-xref>) is amended—</text><paragraph id="id9826928801CA4F9F8F13BCAF6DC433BA"><enum>(1)</enum><text display-inline="yes-display-inline">in section 4 (<external-xref legal-doc="usc" parsable-cite="usc/42/3533">42 U.S.C. 3533</external-xref>)—</text><subparagraph id="id711884d950f34274a0a01f503a585127"><enum>(A)</enum><text>in subsection (a)(1), by striking <quote>7</quote> and inserting <quote>8</quote>; and</text></subparagraph><subparagraph id="idfa4da4765918406ea85e52d4f3e8ae12"><enum>(B)</enum><text>in subsection (e)—</text><clause id="id93C59E29545E4AF5ACECEB6A42C49344"><enum>(i)</enum><text>by redesignating paragraph (2) as paragraph (4); and</text></clause><clause id="id764624AE5B9B48A7A4590D0C7B943DE9"><enum>(ii)</enum><text>by striking <quote>(e)(1)(A) There</quote> and all that follows through the end of paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id74B30EC382134A28BA4AD4BC10847965"><subsection id="id1F9928FE6CEB417D803752348B65FE05"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id19CC71BBF6C649EFB3B2D039ABA9DA56"><enum>(1)</enum><text>There is established within the Department the Office of Native American Programs (in this subsection referred to as the <quote>Office</quote>) to be headed by an Assistant Secretary for Native American Programs (in this subsection referred to as the <quote>Assistant Secretary</quote>), who shall be 1 of the Assistant Secretaries in subsection (a)(1). </text></paragraph><paragraph indent="up1" id="id57FF2886FCCE475A90414E3DE9B006D0"><enum>(2)</enum><text>The Assistant Secretary shall be responsible for—</text><subparagraph id="id23A3B56FD64B4F71A568247C2E848C4D"><enum>(A)</enum><text>administering, in coordination with the relevant office in the Department, the provision of housing assistance to Indian tribes or Indian housing authorities under each program of the Department that provides for such assistance;</text></subparagraph><subparagraph id="idEFCEFAEE41F54014BA133D7B857F30D4"><enum>(B)</enum><text>administering the community development block grant program for Indian tribes under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>) and the provision of assistance to Indian tribes under such Act;</text></subparagraph><subparagraph id="id91C59B17CFE84760AD8DE87E9628430B"><enum>(C)</enum><text>directing, coordinating, and assisting in managing any regional offices of the Department that administer Indian programs to the extent of such programs; and</text></subparagraph><subparagraph id="id7FEA81E35A3E4A15B223749D1FAC1A23"><enum>(D)</enum><text>coordinating all programs of the Department relating to Indian and Alaska Native housing and community development.</text></subparagraph></paragraph><paragraph indent="up1" id="idE1C42902AC92459097F58AEE94CC18AE"><enum>(3)</enum><text>The Secretary shall include in the annual report under section 8 a description of the extent of the housing needs for Indian families and community development needs of Indian tribes in the United States and the activities of the Department, and extent of such activities, in meeting such needs.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idBBA961FCF3D4456CB8065CE365A85CCA"><enum>(2)</enum><text>in section 8 (<external-xref legal-doc="usc" parsable-cite="usc/42/3536">42 U.S.C. 3536</external-xref>), by striking <quote>section 4(e)(2)</quote> and inserting <quote>section 4(e)(4)</quote>.</text></paragraph></section><section id="id5732337bbbda41ba8d72773f4775fa31"><enum>22.</enum><header>Drug elimination program</header><subsection id="id5462e5657157482b9add45534533369b"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id23714203e60c481f96b12346b4d12012"><enum>(1)</enum><header>Controlled substance</header><text>The term <term>controlled substance</term> has the meaning given the term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph><paragraph id="id60fe8e63e16a41c7a8d6bdff0320cb0f"><enum>(2)</enum><header>Drug-related crime</header><text>The term <term>drug-related crime</term> means the illegal manufacture, sale, distribution, use, or possession with intent to manufacture, sell, distribute, or use a controlled substance.</text></paragraph><paragraph id="id959c8f8367724d8692a8ae0f071f13f3"><enum>(3)</enum><header>Recipient</header><text>The term <term>recipient</term>—</text><subparagraph id="idC4E649F152D847E39ECD91164FD9CCD4"><enum>(A)</enum><text>has the meaning given the term in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>); and</text></subparagraph><subparagraph id="idAA1FE381D9874827850DE8C622C1DA74"><enum>(B)</enum><text>includes a recipient of funds under title VIII of that Act (<external-xref legal-doc="usc" parsable-cite="usc/25/4221">25 U.S.C. 4221 et seq.</external-xref>). </text></subparagraph></paragraph><paragraph id="id57d805f7ac274e80bb00aa5ddaae6a3b"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></subsection><subsection id="idD1536950A5684A9ABE773B1FB4B54449"><enum>(b)</enum><header>Establishment</header><text>The Secretary may make grants under this section to recipients of assistance under the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>) for use in eliminating drug-related and violent crime. </text></subsection><subsection id="id8315ba57487c4adfbfb9deb39d9a52dd"><enum>(c)</enum><header>Eligible activities</header><text>Grants under this section may be used for—</text><paragraph id="id5c2fe195329d4df1b96a45379eb49226"><enum>(1)</enum><text>the employment of security personnel;</text></paragraph><paragraph id="id4a53abcc2c1844a0b83c4eb200146788"><enum>(2)</enum><text>reimbursement of State, local, Tribal, or Bureau of Indian Affairs law enforcement agencies for additional security and protective services;</text></paragraph><paragraph id="id3166eb03237d4b4caebb56898f78b426"><enum>(3)</enum><text>physical improvements which are specifically designed to enhance security;</text></paragraph><paragraph id="iddb77c438b3594cf9a0e04f9fa53395dd"><enum>(4)</enum><text>the employment of 1 or more individuals—</text><subparagraph id="id48b87f0569944fde9e809c16a197dde3"><enum>(A)</enum><text>to investigate drug-related or violent crime in and around the real property comprising housing assisted under the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id7ff737978dad41d0b22cdebfc0718d2a"><enum>(B)</enum><text>to provide evidence relating to such crime in any administrative or judicial proceeding;</text></subparagraph></paragraph><paragraph id="id7a0bea170fc44288aa586cd80cfa2280"><enum>(5)</enum><text>the provision of training, communications equipment, and other related equipment for use by voluntary tenant patrols acting in cooperation with law enforcement officials;</text></paragraph><paragraph id="id0f127e80f8c340b7b49e46379ec3b09c"><enum>(6)</enum><text>programs designed to reduce use of drugs in and around housing communities funded under the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>), including drug-abuse prevention, intervention, referral, and treatment programs;</text></paragraph><paragraph id="id324bd6bddef44272888e99d0a46706a4"><enum>(7)</enum><text>providing funding to nonprofit resident management corporations and resident councils to develop security and drug abuse prevention programs involving site residents;</text></paragraph><paragraph id="id325f2acd8f174684bc330c5ff7f05769"><enum>(8)</enum><text>sports programs and sports activities that serve primarily youths from housing communities funded through and are operated in conjunction with, or in furtherance of, an organized program or plan designed to reduce or eliminate drugs and drug-related problems in and around those communities; and</text></paragraph><paragraph id="id37D81E8FECF04AF1B713B5AC40F7CB60"><enum>(9)</enum><text>other programs for youth in school settings that address drug prevention and positive alternatives for youth, including education and activities related to science, technology, engineering, and math.</text></paragraph></subsection><subsection id="id33bfe65cafc84c85a40f950ee4dcaf09"><enum>(d)</enum><header>Applications</header><paragraph id="id653b5fea698344b39e7f519b31c1b613"><enum>(1)</enum><header>In general</header><text>To receive a grant under this subsection, an eligible applicant shall submit an application to the Secretary, at such time, in such manner, and accompanied by—</text><subparagraph id="idCA7FD8C15E2747E0971DF5E141AF8F86"><enum>(A)</enum><text>a plan for addressing the problem of drug-related or violent crime in and around of the housing administered or owned by the applicant for which the application is being submitted; and</text></subparagraph><subparagraph id="id09CC13A622F3463683E4AD5F7F813A31"><enum>(B)</enum><text>such additional information as the Secretary may reasonably require. </text></subparagraph></paragraph><paragraph id="id735adc61669448f99ff2aa20d5e466c3"><enum>(2)</enum><header>Criteria</header><text>The Secretary shall approve applications submitted under paragraph (1) on the basis of thresholds or criteria such as—</text><subparagraph id="id86db934f50314a13a757ba8e48e1db81"><enum>(A)</enum><text>the extent of the drug-related or violent crime problem in and around the housing or projects proposed for assistance;</text></subparagraph><subparagraph id="id5b04cdabd44743e1a83e7e4362b3bc25"><enum>(B)</enum><text>the quality of the plan to address the crime problem in the housing or projects proposed for assistance, including the extent to which the plan includes initiatives that can be sustained over a period of several years;</text></subparagraph><subparagraph id="id99c8ec7dc0ce439ab7600b52245c27a1"><enum>(C)</enum><text>the capability of the applicant to carry out the plan; and</text></subparagraph><subparagraph id="id82e4e67891314294aeca16fe8f48ab19"><enum>(D)</enum><text>the extent to which tenants, the Tribal government, and the Tribal community support and participate in the design and implementation of the activities proposed to be funded under the application.</text></subparagraph></paragraph></subsection><subsection id="idf9b9ee3a4b154860845ad0207b3a1f19"><enum>(e)</enum><header>High intensity drug trafficking areas</header><text>In evaluating the extent of the drug-related crime problem pursuant to subsection (d)(2), the Secretary may consider whether housing or projects proposed for assistance are located in a high intensity drug trafficking area designated pursuant to section 707(b) of the Office of National Drug Control Policy Reauthorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1706">21 U.S.C. 1706(b)</external-xref>).</text></subsection><subsection id="idce8a7b2bf02948dea851d0410529a866"><enum>(f)</enum><header>Reports</header><paragraph id="id96F2184F1FAE4C5B929AC66177D44181"><enum>(1)</enum><header>Grantee reports</header><text>The Secretary shall require grantees under this section to provide periodic reports that include the obligation and expenditure of grant funds, the progress made by the grantee in implementing the plan described in subsection (d)(1)(A), and any change in the incidence of drug-related crime in projects assisted under section.</text></paragraph><paragraph id="id195ed8ce852046d0bd24e290f8ef3102"><enum>(2)</enum><header>HUD reports</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a report describing the system used to distribute funding to grantees under this section, which shall include descriptions of—</text><subparagraph id="id9d2d544a556d4ea1abb9e658cc518e2a"><enum>(A)</enum><text>the methodology used to distribute amounts made available under this section; and</text></subparagraph><subparagraph id="id20839984f5254a59a28ca7a3e4722e53"><enum>(B)</enum><text>actions taken by the Secretary to ensure that amounts made available under section are not used to fund baseline local government services, as described in subsection (h)(2).</text></subparagraph></paragraph></subsection><subsection id="id26daa4edd1324f5e8a404a770578dbde"><enum>(g)</enum><header>Notice of funding awards</header><text>The Secretary shall publish on the website of the Department a notice of all grant awards made pursuant to section, which shall identify the grantees and the amount of the grants. </text></subsection><subsection id="id1ada6bc5920d43a0ad1563ec9713030f"><enum>(h)</enum><header>Monitoring</header><paragraph id="id76b6037707684ed6b2709b4a74f0327f"><enum>(1)</enum><header>In general</header><text>The Secretary shall audit and monitor the program funded under this subsection to ensure that assistance provided under this subsection is administered in accordance with the provisions of section.</text></paragraph><paragraph id="idb7b22d186e0d492eb523c45c05ace38d"><enum>(2)</enum><header>Prohibition of funding baseline services</header><subparagraph id="idf6ed15ad29c64ca2b71046f64ad6d33a"><enum>(A)</enum><header>In general</header><text>Amounts provided under this section may not be used to reimburse or support any local law enforcement agency or unit of general local government for the provision of services that are included in the baseline of services required to be provided by any such entity pursuant to a local cooperative agreement pursuant under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>) or any provision of an annual contributions contract for payments in lieu of taxation with the Bureau of Indian Affairs.</text></subparagraph><subparagraph id="idcd6c77a062c64945b8b9c34bd86870ff"><enum>(B)</enum><header>Description</header><text>Each grantee under this section shall describe, in the report under subsection (f)(1), such baseline of services for the unit of Tribal government in which the jurisdiction of the grantee is located.</text></subparagraph></paragraph><paragraph id="iddd946ec36b534cb69db06b3ceaf5ad06"><enum>(3)</enum><header>Enforcement</header><text>The Secretary shall provide for the effective enforcement of this section, as specified in the program requirements published in a notice by the Secretary, which may include—</text><subparagraph id="id2B695B6B8A944C9A82FA394FB01747E9"><enum>(A)</enum><text>the use of on-site monitoring, independent public audit requirements, certification by Tribal or Federal law enforcement or Tribal government officials regarding the performance of baseline services referred to in paragraph (2);</text></subparagraph><subparagraph id="idF892B585D94A4B0E832EFE7EAC01DECA"><enum>(B)</enum><text>entering into agreements with the Attorney General to achieve compliance, and verification of compliance, with the provisions of this section; and </text></subparagraph><subparagraph id="id0B820258691B427CA9148F85E2AEE17A"><enum>(C)</enum><text>adopting enforcement authority that is substantially similar to the authority provided to the Secretary under the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>) </text></subparagraph></paragraph></subsection><subsection id="id82c3f114c9074833bdcfb89a2d81c724"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary for each fiscal years 2022 through 2032 to carry out this section. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id68a701e1-369d-4c6b-b206-c398fd9bf9e4"><enum>23.</enum><header display-inline="yes-display-inline">Rental assistance for homeless or at-risk Indian veterans</header><text display-inline="no-display-inline">Section 8(o)(19) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(19)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id2afb66e3-eb26-49e3-8792-8139cfbc4629" display-inline="no-display-inline" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="id860deef4-2520-46c9-8213-a31f8ef6614d"><enum>(E)</enum><header display-inline="yes-display-inline">Indian veterans housing rental assistance program</header><clause commented="no" display-inline="no-display-inline" id="idf9c9e1c7-a2ae-43e4-87fb-933a48e912c1"><enum>(i)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subparagraph:</text><subclause commented="no" display-inline="no-display-inline" id="id6d8a2acf-7084-4051-897e-93a4c99f36d0"><enum>(I)</enum><header display-inline="yes-display-inline">Eligible Indian veteran</header><text display-inline="yes-display-inline">The term <term>eligible Indian veteran</term> means an Indian veteran who is—</text><item commented="no" display-inline="no-display-inline" id="id97b712c2-8a89-46c7-844b-c6ac8b503c9d"><enum>(aa)</enum><text display-inline="yes-display-inline">homeless or at risk of homelessness; and</text></item><item commented="no" display-inline="no-display-inline" id="id74207ea0-aa81-4832-b4ab-bf7f3bfa43a3"><enum>(bb)</enum><text display-inline="yes-display-inline">living—</text><subitem commented="no" display-inline="no-display-inline" id="id7AD27A9035314E9FABECA1565CBDFE0D"><enum>(AA)</enum><text display-inline="yes-display-inline">on or near a reservation; or</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id6E9BA4E576B14FA5A1DB10F525CD0894"><enum>(BB)</enum><text display-inline="yes-display-inline">in or near any other Indian area.</text></subitem></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id035aa6f9-5949-4d5f-9783-f5e9b80c6c13"><enum>(II)</enum><header display-inline="yes-display-inline">Eligible recipient</header><text display-inline="yes-display-inline">The term <term>eligible recipient</term> means a recipient eligible to receive a grant under section 101 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4111">25 U.S.C. 4111</external-xref>).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0b814e21-ad9b-48d7-ac61-064386280a2c"><enum>(III)</enum><header display-inline="yes-display-inline">Indian; Indian area</header><text display-inline="yes-display-inline">The terms <term>Indian</term> and <term>Indian area</term> have the meanings given those terms in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida086dfd4-b69a-44d6-89a8-9e5ba40a5d4e"><enum>(IV)</enum><header display-inline="yes-display-inline">Indian veteran</header><text display-inline="yes-display-inline">The term <term>Indian veteran</term> means an Indian who is a veteran.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idD95ACFBBE3FF43CD876C97683D02E62C"><enum>(V)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <term>Program</term> means the Tribal HUD–VASH program carried out under clause (ii).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2352bff5-a031-42f5-a222-a05948a532e5"><enum>(VI)</enum><header display-inline="yes-display-inline">Tribal organization</header><text display-inline="yes-display-inline">The term <term>tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idd8906a6f-ca32-4621-915f-7ab2c72e78fd"><enum>(ii)</enum><header display-inline="yes-display-inline">Program specifications</header><text display-inline="yes-display-inline">The Secretary shall use not less than 5 percent of the amounts made available for rental assistance under this paragraph to carry out a rental assistance and supported housing program, to be known as the <quote>Tribal HUD–VASH program</quote>, in conjunction with the Secretary of Veterans Affairs, by awarding grants for the benefit of eligible Indian veterans.</text></clause><clause commented="no" display-inline="no-display-inline" id="id5e77f9e6-8345-4253-b41b-2f3d3742b78e"><enum>(iii)</enum><header display-inline="yes-display-inline">Model</header><subclause commented="no" display-inline="no-display-inline" id="id0417d178-4bb5-4b5d-91ff-5f00b1e00a1d"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subclause (II), the Secretary shall model the Program on the rental assistance and supported housing program authorized under subparagraph (A) and applicable appropriations Acts, including administration in conjunction with the Secretary of Veterans Affairs.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5a1d1946-ae26-4f87-ae38-d6c808e848dc"><enum>(II)</enum><header display-inline="yes-display-inline">Exceptions</header><item commented="no" display-inline="no-display-inline" id="id96f53df6-077d-4e85-a89b-fbe2f960b89d"><enum>(aa)</enum><header display-inline="yes-display-inline">Secretary of Housing and Urban Development</header><text display-inline="yes-display-inline">After consultation with Indian tribes, eligible recipients, and any other appropriate tribal organizations, the Secretary may make necessary and appropriate modifications to facilitate the use of the Program by eligible recipients to serve eligible Indian veterans.</text></item><item commented="no" display-inline="no-display-inline" id="ide42ed68e-af31-4ad0-8a53-5c7f7f9d9fa2"><enum>(bb)</enum><header display-inline="yes-display-inline">Secretary of Veterans Affairs</header><text display-inline="yes-display-inline">After consultation with Indian tribes, eligible recipients, and any other appropriate tribal organizations, the Secretary of Veterans Affairs may make necessary and appropriate modifications to facilitate the use of the Program by eligible recipients to serve eligible Indian veterans.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idc9873f91-a969-47f6-bd12-8d3c6337bb28"><enum>(iv)</enum><header display-inline="yes-display-inline">Eligible recipients</header><text display-inline="yes-display-inline">The Secretary shall make amounts for rental assistance and associated administrative costs under the Program available in the form of grants to eligible recipients.</text></clause><clause commented="no" display-inline="no-display-inline" id="id17710480-376e-42c6-b1b6-714d03ba8371"><enum>(v)</enum><header display-inline="yes-display-inline">Funding criteria</header><text display-inline="yes-display-inline">The Secretary shall award grants under the Program based on—</text><subclause commented="no" display-inline="no-display-inline" id="id861ed95b-68fa-41c3-aa55-a4a9d294f50e"><enum>(I)</enum><text display-inline="yes-display-inline">need;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5f8c5b91-2b7f-4093-be6d-25e9c544de39"><enum>(II)</enum><text display-inline="yes-display-inline">administrative capacity; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="iddfbbbb64-8dcc-442e-89cf-d48bbfa8aa40"><enum>(III)</enum><text display-inline="yes-display-inline">any other funding criteria established by the Secretary in a notice published in the Federal Register after consulting with the Secretary of Veterans Affairs.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idbece8add-93c0-4e24-88bc-eb01ed18bdc6"><enum>(vi)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">Grants awarded under the Program shall be administered in accordance with the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>), except that recipients shall—</text><subclause commented="no" display-inline="no-display-inline" id="id9724dacb-0060-4497-96c6-f17010d09dd1"><enum>(I)</enum><text display-inline="yes-display-inline">submit to the Secretary, in a manner prescribed by the Secretary, reports on the utilization of rental assistance provided under the Program; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9a7efbf2-6195-4056-b68b-e9be00ecc0b9"><enum>(II)</enum><text display-inline="yes-display-inline">provide to the Secretary information specified by the Secretary to assess the effectiveness of the Program in serving eligible Indian veterans.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idaf4d3c1b-acfa-476d-8121-77c7f550f7db"><enum>(vii)</enum><header display-inline="yes-display-inline">Consultation</header><subclause commented="no" display-inline="no-display-inline" id="idc3f7da00-4b96-43d2-b99c-43b4140321da"><enum>(I)</enum><header display-inline="yes-display-inline">Grant recipients; tribal organizations</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Secretary of Veterans Affairs, shall consult with eligible recipients and any other appropriate tribal organization on the design of the Program to ensure the effective delivery of rental assistance and supportive services to eligible Indian veterans under the Program.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id79b59ed0-cb55-4c0d-9924-f901ed8564b0"><enum>(II)</enum><header display-inline="yes-display-inline">Indian Health Service</header><text display-inline="yes-display-inline">The Director of the Indian Health Service shall provide any assistance requested by the Secretary or the Secretary of Veterans Affairs in carrying out the Program.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf346957a-5701-4eb7-a555-5f7ba999cf6b"><enum>(viii)</enum><header display-inline="yes-display-inline">Waiver</header><subclause commented="no" display-inline="no-display-inline" id="id620036a3-a141-4b65-8496-a92ccb60f3d5"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subclause (II), the Secretary may waive or specify alternative requirements for any provision of law (including regulations) that the Secretary administers in connection with the use of rental assistance made available under the Program if the Secretary finds that the waiver or alternative requirement is necessary for the effective delivery and administration of rental assistance under the Program to eligible Indian veterans.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2ca1b93f-60b2-4d28-9eed-c4d4460cf44a"><enum>(II)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The Secretary may not waive or specify alternative requirements under subclause (I) for any provision of law (including regulations) relating to labor standards or the environment.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idc698671f05d74712bee695af41066128"><enum>(ix)</enum><header display-inline="yes-display-inline">Renewal grants</header><text display-inline="yes-display-inline">The Secretary may—</text><subclause commented="no" display-inline="no-display-inline" id="idBF8EB68E9B834EEF95F5AA5A65D05207"><enum>(I)</enum><text display-inline="yes-display-inline">set aside, from amounts made available for tenant-based rental assistance under this subsection and without regard to the amounts used for new grants under clause (ii), such amounts as may be necessary to award renewal grants to eligible recipients that received a grant under the Program in a previous year; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2820041807D549D6BC2CDB773CF5D846"><enum>(II)</enum><text display-inline="yes-display-inline">specify criteria that an eligible recipient must satisfy to receive a renewal grant under subclause (I), including providing data on how the eligible recipient used the amounts of any grant previously received under the Program.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id12214f73-1d22-420d-8ba4-babe52aaf2e2"><enum>(x)</enum><header display-inline="yes-display-inline">Reporting</header><subclause commented="no" display-inline="no-display-inline" id="id85338C033BAF46FC8E1A78959F17B55C"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this subparagraph, and every 5 years thereafter, the Secretary, in coordination with the Secretary of Veterans Affairs and the Director of the Indian Health Service, shall—</text><item commented="no" display-inline="no-display-inline" id="idc700f6a6-562b-466e-be4b-f220b4d0e243"><enum>(aa)</enum><text display-inline="yes-display-inline">conduct a review of the implementation of the Program, including any factors that may have limited its success; and</text></item><item commented="no" display-inline="no-display-inline" id="idc92e52a6-3410-4bdc-92c0-00fbebe4987a"><enum>(bb)</enum><text display-inline="yes-display-inline">submit a report describing the results of the review under item (aa) to—</text><subitem commented="no" display-inline="no-display-inline" id="idfb364b9d-9990-4782-8998-979ee17133f0"><enum>(AA)</enum><text display-inline="yes-display-inline">the Committee on Indian Affairs, the Committee on Banking, Housing, and Urban Affairs, the Committee on Veterans' Affairs, and the Committee on Appropriations of the Senate; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id74b94b7a-dfcd-44b6-810a-b1deb4a5c66c"><enum>(BB)</enum><text display-inline="yes-display-inline">the Subcommittee on Indian, Insular and Alaska Native Affairs of the Committee on Natural Resources, the Committee on Financial Services, the Committee on Veterans' Affairs, and the Committee on Appropriations of the House of Representatives.</text></subitem></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id076e6964a7044e2ba68dc52337be6231"><enum>(II)</enum><header display-inline="yes-display-inline">Analysis of housing stock limitation</header><text display-inline="yes-display-inline">The Secretary shall include in the initial report submitted under subclause (I) a description of—</text><item commented="no" display-inline="no-display-inline" id="ida7a84d7fa64a4f8caea79afa5724114b"><enum>(aa)</enum><text display-inline="yes-display-inline">any regulations governing the use of formula current assisted stock (as defined in section 1000.314 of title 24, Code of Federal Regulations (or any successor regulation)) within the Program;</text></item><item commented="no" display-inline="no-display-inline" id="id6375ef37f4a84c09b12dfd2b28ae6ffd"><enum>(bb)</enum><text display-inline="yes-display-inline">the number of recipients of grants under the Program that have reported the regulations described in item (aa) as a barrier to implementation of the Program; and</text></item><item id="id1f71832a3ae14cb1921ca27d3a0da681" commented="no" display-inline="no-display-inline"><enum>(cc)</enum><text display-inline="yes-display-inline">proposed alternative legislation or regulations developed by the Secretary in consultation with recipients of grants under the Program to allow the use of formula current assisted stock within the Program.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id6aa346c1a0254cc39fc4b074db0c3397" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>24.</enum><header>Leveraging</header><text display-inline="no-display-inline">All funds provided under a grant made pursuant to this division or the amendments made by this division may be used for purposes of meeting matching or cost participation requirements under any other Federal or non-Federal program, provided that such grants made pursuant to the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>) are spent in accordance with that Act.</text></section></legis-body></bill>
