which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a separate criminal offense for targeting an individual based on their status as law enforcement officer.</official-title></form><legis-body><section id="id0878EBB5742D4A778E9BAEE0EF723DBD" section-type="section-one"><enum>1.</enum><header>Protecting law enforcement officers from targeting</header><subsection id="id8b81dab6898840ae8e3c66134cdc1104"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">Chapter 7</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="ida582abfbea954e2c8124d4a4cde3980c"><section id="id7F2D1E50E95141E6814DB00FD2EFA3A4"><enum>120.</enum><header>Crimes targeting law enforcement officers</header><subsection id="id4213cd6e70b14c59912ffad54f810cf4"><enum>(a)</enum><header>Offense</header><text>Whoever, in any circumstance described in subsection (b), knowingly causes bodily injury to any person, or attempts to do so, because of the actual or perceived status of the person as a law enforcement officer—</text><paragraph id="id0a100c07dd9b4beeaeb7432f2bfb29c7"><enum>(1)</enum><text>shall be imprisoned not more than 20 years, fined in accordance with this title, or both; and</text></paragraph><paragraph id="id4aa522dfa37f4c4d96fc990018ca582b"><enum>(2)</enum><text>shall be imprisoned for any term of years or for life, fined in accordance with this title, or both, if—</text><subparagraph id="id1b6b69586d3f415d8b896c9fe151b736"><enum>(A)</enum><text>death results from the offense; or</text></subparagraph><subparagraph id="id72f3673bde0742bfbf8176825ec4388c"><enum>(B)</enum><text>the offense includes kidnapping or an attempt to kidnap, or an attempt to kill.</text></subparagraph></paragraph></subsection><subsection id="idb134a59bc13a4c0c856e6336ed703d91"><enum>(b)</enum><header>Circumstances described</header><text>For purposes of subsection (a), the circumstances described in this subsection are that—</text><paragraph id="id8cc5f232c12c402f84d35e5745de6528"><enum>(1)</enum><text>the conduct described in subsection (a) occurs during the course of, or as the result of, the travel of the defendant or the victim—</text><subparagraph id="id49c3bd3e8937458692c34649ba8e3a4b"><enum>(A)</enum><text>across a State line or national border; or</text></subparagraph><subparagraph id="id17e47d5b0d2443ba96c9107f1e4a556a"><enum>(B)</enum><text>using a channel, facility, or instrumentality of interstate or foreign commerce;</text></subparagraph></paragraph><paragraph id="iddb07ee0536ff44e184caaf8906548743"><enum>(2)</enum><text>the defendant uses a channel, facility, or instrumentality of interstate or foreign commerce in connection with the conduct described in subsection (a);</text></paragraph><paragraph id="idab6fb79082a84b64a626238f1744ce9d"><enum>(3)</enum><text>in connection with the conduct described in subsection (a), the defendant employs a firearm, dangerous weapon, explosive or incendiary device, or other weapon that has traveled in interstate or foreign commerce; or</text></paragraph><paragraph id="id2c15b5f88d2e40e185da1f0111e5b28c"><enum>(4)</enum><text>the conduct described in subsection (a)—</text><subparagraph id="id5080254c619f45d99d605c212fc80480"><enum>(A)</enum><text>interferes with commercial or other economic activity in which the victim is engaged at the time of the conduct; or</text></subparagraph><subparagraph id="id27e26543211148d0b39fbcc2eec9f023"><enum>(B)</enum><text>otherwise affects interstate or foreign commerce.</text></subparagraph></paragraph></subsection><subsection id="id1d62f4eafb5149e1a2b6376843bbf80f"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idecc58b948a224740af4848f4d1e2ec73"><enum>(1)</enum><header>Law enforcement officer</header><text>The term <term>law enforcement officer</term> means an employee of a governmental or public agency who is authorized by law—</text><subparagraph id="id4d24367f3b2c4d22894c0ffb47425457"><enum>(A)</enum><text>to engage in or supervise the prevention, detention, investigation, or the incarceration of any person for any criminal violation of law; and</text></subparagraph><subparagraph id="ide62a25432f924f6f8986b63a22a851ce"><enum>(B)</enum><text>to apprehend or arrest a person for any criminal violation of law.</text></subparagraph></paragraph><paragraph id="idadc3ac9836fe4e55b699882e8de99645"><enum>(2)</enum><header>State</header><text>The term <term>State</term> includes the District of Columbia, Puerto Rico, and any other territory or possession of the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ide8f14523ccf64edbb61bd4c5c3d6f076"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">chapter 7</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="idbb41c53e-1049-4fc3-a6e8-cf24e657f560"><toc><toc-entry level="section" idref="id7F2D1E50E95141E6814DB00FD2EFA3A4">120.
