<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2249</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210624">June 24, 2021</action-date><action-desc><sponsor name-id="S399">Mr. Hawley</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase the penalties for damage to Federal courthouses and unauthorized access to areas where Federal judges work, reside, or visit.</official-title></form><legis-body><section id="id76CBADF6A96E4BE1865BBF49C8ED76E7" section-type="section-one"><enum>1.</enum><header>Protecting Federal courthouses and judges</header><subsection id="idDE30D42920AE4F47AE4BA242A06D8766"><enum>(a)</enum><header>Government property or contracts</header><text>Section 1361 of title 18, United States Code, is amended—</text><paragraph id="id29D4D4659F0D4FA3B463CCF80404D171"><enum>(1)</enum><text>in the second undesignated subsection by striking <quote>both.</quote> and inserting the following: <quote>both; if the damage or attempted damage is to a Federal courthouse, by a fine under this title or imprisonment for not more than 25 years, or both</quote>; and</text></paragraph><paragraph id="idE820BB31F66D440FA8ABEFDAED9F51F9"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA938EB4E463C40168FC0C08CA2061265"><subsection id="idE9DFD9432C71413899EECDDD93DD597C"><enum/><text>For purposes of this section, defacing, painting, spraying, applying graffiti to, or drawing on Federal property, including Federal building and monuments located on Federal land, shall be presumed to result in damage exceeding the sum of $1,000.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id45C1B1AE7BAE4F7CBFBB88088C433AEE"><enum>(b)</enum><header>Restrict buildings or grounds</header><text>Section 1752(c)(1) of title 18, United States Code, is amended—</text><paragraph id="idB41CD08F2E92410FBAE84CD3D8BAC8DF"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>or</quote> at the end; </text></paragraph><paragraph id="id2F8DD4C372134C1D918C46907D6663B4"><enum>(2)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end; and</text></paragraph><paragraph id="idC6A252082693463DB636DA83DBC1E59B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id027BF0F456BB4ADFBB9CFCFCAAE680A3"><subparagraph id="id90CB9315DB7B4CF29CAC2FC5AEDCF54F"><enum>(D)</enum><text>of a Federal courthouse or Federal building containing offices of Federal judges; or </text></subparagraph><subparagraph id="idB622BF019794423CA152FADF6106C772"><enum>(E)</enum><text>of a building or grounds where a Federal judge or other Federal official protected by the United States Marshals Service resides, is temporarily visiting, or will be temporarily visiting; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
