which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Office to Enforce and Protect Against Child Sexual Exploitation.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Invest in Child Safety Act</short-title></quote>.</text></section><section id="id6dddb956afd34532b0f6487104e34a17"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id853a2e5b5db84cec8696ae99f8df4667"><enum>(1)</enum><header>Child sexual exploitation</header><text>The term <term>child sexual exploitation</term> has the meaning given the term <term>child exploitation</term> in section 2 of the PROTECT Our Children Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/34/21101">34 U.S.C. 21101</external-xref>).</text></paragraph><paragraph id="id0532db839f9e4683818a1b0cd8744c7a"><enum>(2)</enum><header>Covered program or agency</header><text>The term <term>covered program or agency</term> means—</text><subparagraph id="id4882F2530D064658B57F74A3E160CF5B"><enum>(A)</enum><text>each Federal program or Executive agency involved in—</text><clause id="id3733A332F4EC4628A8CDCC973C1664F4"><enum>(i)</enum><text>the prevention, treatment of victims, investigation, or prosecution of child sexual exploitation; or </text></clause><clause id="id61102D8D44DC49D89D5BB1252563A952"><enum>(ii)</enum><text>other activities relating to addressing child sexual exploitation; or</text></clause></subparagraph><subparagraph id="id5376730F8F9742E4B415933E725C9F62"><enum>(B)</enum><text>any other Federal program, agency, or activity designated by the Director. </text></subparagraph></paragraph><paragraph id="idae4b35983f874243911da64be508b0eb"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office appointed under section 3(b)(1).</text></paragraph><paragraph id="id0F5F6AC4476D4A69900B21B702676641"><enum>(4)</enum><header>Enforcement and protection strategy</header><text>The term <term>enforcement and protection strategy</term> means the enforcement and protection strategy required under section 3(c)(4).</text></paragraph><paragraph id="id5b7335e567f243f9948deac376bd7d09"><enum>(5)</enum><header>Executive agency</header><text>The term <term>Executive agency</term> has the meaning given that term in section 105 of title 5, United States Code.</text></paragraph><paragraph id="id891201DE09BB4874A8DA5A2CA819A9A2"><enum>(6)</enum><header>Fund</header><text>The term <term>Fund</term> means the Child Sexual Exploitation Treatment, Support, and Prevention Fund established under section 4(c)(1).</text></paragraph><paragraph id="idF79E0D18FC1544848D3F8B1EA460F8E1"><enum>(7)</enum><header>High-level representative</header><text>The term <term>high-level representative</term> means an individual who is—</text><subparagraph id="id14D2BCCEF97B45ECBC05F6721BC51C8A"><enum>(A)</enum><text>appointed by the President, by and with the advice and consent of the Senate;</text></subparagraph><subparagraph id="id39AACA7F1E594D7DB55511BB47E83E7D"><enum>(B)</enum><text>in a Senior Executive Service position (as defined in section 3132(a) of title 5, United States Code); or</text></subparagraph><subparagraph id="id76E941A2EC6B4356A4F998A8E2B0EE75"><enum>(C)</enum><text>for an entity that is not an Executive agency, serving in a leadership or other senior position in the entity.</text></subparagraph></paragraph><paragraph id="id9B7DA5D36F4B4C54AB753A1BAC8FA270"><enum>(8)</enum><header>Indian Tribe</header><text>The term <quote>Indian Tribe</quote> has the meaning given the term <term>Indian tribe</term> in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text></paragraph><paragraph id="id4B99DD23D24F49CBAD23603EFA484670"><enum>(9)</enum><header>Office</header><text>The term <term>Office</term> means the Office to Enforce and Protect Against Child Sexual Exploitation established under section 3(a).</text></paragraph></section><section id="id511CFA5C664B4420AAC70378EB65C1D4"><enum>3.</enum><header>Office to Enforce and Protect Against Child Sexual Exploitation</header><subsection id="id15b1b8eaf06b4a3c81628de7cd576885"><enum>(a)</enum><header>Establishment</header><text>There is established in the Executive Office of the President an Office to Enforce and Protect Against Child Sexual Exploitation.</text></subsection><subsection id="id39aed8911e354c10ada8e983ece79e09"><enum>(b)</enum><header>Director</header><paragraph id="id9F57B1DD128D4B798A6A1F13180F2B1C"><enum>(1)</enum><header>Appointment</header><text>The Office shall be headed by a Director who shall be appointed by the President, by and with the advice and consent of the Senate.</text></paragraph><paragraph id="id313B139AB7EF4C31A0290B6C0A60FDBA"><enum>(2)</enum><header>Term</header><subparagraph id="idBC6C2F4AA0864C038C9A8B2941CAD5F7"><enum>(A)</enum><header>In general</header><text>The Director shall be appointed for a term of 5 years.</text></subparagraph><subparagraph id="idAF1445B2449B482DACBD62D7C86F47D4"><enum>(B)</enum><header>Limitation</header><text>An individual may not serve more than 2 terms as the Director.</text></subparagraph></paragraph><paragraph id="id64844e90ca844401b34b973aec535f61"><enum>(3)</enum><header>Qualifications</header><text>The individual appointed as the Director shall have—</text><subparagraph id="iddda4c4bc2a6243f79d536400ad272472"><enum>(A)</enum><text>a demonstrated ability in managing large organizations and coordinating offices;</text></subparagraph><subparagraph id="id10cb371b6d6f44569613324f4db243ba"><enum>(B)</enum><text>experience prosecuting Federal child sexual exploitation crimes; and</text></subparagraph><subparagraph id="idf3051096878b4c8e81484c64f8792480"><enum>(C)</enum><text>proficiency in investigating crimes that have a technological or cyber component.</text></subparagraph></paragraph><paragraph id="id9A39F39C264D42889DF4EB61E3DDA513"><enum>(4)</enum><header>Coordination of activities</header><text>The Director shall coordinate the activities of the Office with the Attorney General, the Director of the Federal Bureau of Investigation, the Secretary of Defense, the Secretary of Health and Human Services, the Secretary of Homeland Security, the Secretary of Education, the Chairman of the Interagency Task Force to Monitor and Combat Trafficking in Persons established under section 105 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103</external-xref>), and the President of the National Center for Missing and Exploited Children.</text></paragraph></subsection><subsection id="id75671ab9b75941ba8df20c236801d5a6"><enum>(c)</enum><header>Duties</header><text>The Director shall—</text><paragraph id="id38c858f80a2b471e8dbd4401ff38b125"><enum>(1)</enum><text>coordinate the activities of covered programs and agencies; </text></paragraph><paragraph id="idf10a45f78dbc4087b8e0a7e3f2e9f336"><enum>(2)</enum><text>cooperate, as appropriate, with foreign law enforcement agencies, including through— </text><subparagraph id="idBE70C22B58E142EB9EF37C9C7F4AB0D5"><enum>(A)</enum><text>information sharing and providing technical assistance; and</text></subparagraph><subparagraph id="idC9B068EB8D314CD9ADF4D0651CD85311"><enum>(B)</enum><text>detailing employees of the Office to high priority countries that are the source of visual depictions of child sexual exploitation; </text></subparagraph></paragraph><paragraph id="idC7CF9B5326084A3888D0C8432E36BB74"><enum>(3)</enum><text>not less than 3 times per year, convene a meeting of high-level representatives of the Department of Justice, the Federal Bureau of Investigation, the Department of Defense, the Department of Health and Human Services, the Department of Homeland Security, the Department of Education, the Interagency Task Force to Monitor and Combat Trafficking in Persons established under section 105 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103</external-xref>), and the National Center for Missing and Exploited Children, to ensure success of the enforcement and protection strategy; </text></paragraph><paragraph id="idcd5d17c0cc1e426c8d45c988183a2199"><enum>(4)</enum><text>not later than 180 days after the date on which each Director is first appointed to the position of Director, submit to Congress an enforcement and protection strategy for— </text><subparagraph id="id5EEEB9A97D4F4972996E3D4948A00929"><enum>(A)</enum><text>the prevention, investigation, or prosecution of child sexual exploitation by Executive agencies; </text></subparagraph><subparagraph id="idC5193D4D12934AAE8486CB5CD99F62EC"><enum>(B)</enum><text>the treatment of and services provided to victims of child sexual exploitation by Executive agencies; and </text></subparagraph><subparagraph id="id03F3954B6EEA4C1FAF4A0E362CC288E2"><enum>(C)</enum><text>other activities of Executive agencies relating to addressing child sexual exploitation;</text></subparagraph></paragraph><paragraph id="id50eac3f4f5f24ab5a9b600583a5a9ece"><enum>(5)</enum><text>during the 60-day period beginning on the date on which each Director is first appointed to the position of Director, solicit comments from the public on the enforcement and protection strategy; </text></paragraph><paragraph id="ide2643b2110e443f0a6cc2eeb587261b9"><enum>(6)</enum><text>not later than 180 days after the date on which each Director is first appointed to the position of Director, submit to Congress a spending plan, which shall be developed in consultation with the head of covered programs and agencies and the Director of the Office of Management and Budget; </text></paragraph><paragraph id="ide0dcaf7b574548b9bfaa41394546a542"><enum>(7)</enum><text>with respect to each fiscal year, for not less than a period of 30 days before the start of such fiscal year, seek public comment on the funding priorities of the Office and covered programs and agencies for such fiscal year, including funding transfers and grants to be made from the Fund during such fiscal year; </text></paragraph><paragraph id="id82626EC0A898411AA353E73DF1A5442C"><enum>(8)</enum><text>not later than March 1 of each year, submit to Congress an annual report—</text><subparagraph id="idC5DFF0EE3EAB4D10A85FDC0C4971F311"><enum>(A)</enum><text>detailing the work of the Office and each covered program or agency during the previous fiscal year and evaluating the efficacy of the use of funds by the Office and covered programs and agencies during the previous fiscal year, which shall include, with respect to such previous fiscal year—</text><clause id="id9d4d1ef7ac784f2881531f36e54b7273"><enum>(i)</enum><text>the number and nature of reports to the CyberTipline of the National Center for Missing and Exploited Children, or any successor to such CyberTipline operated by the National Center for Missing and Exploited Children;</text></clause><clause id="ided8aa939a23942a787afa59b97f6d5dc"><enum>(ii)</enum><text>the number and nature of investigations conducted relating to child sexual exploitation;</text></clause><clause id="id54de02595bf74fa18d5e5ff12448c77c"><enum>(iii)</enum><text>the number and nature of arrests relating to child sexual exploitation;</text></clause><clause id="ida543474221df4075b4ad02122a02e3fa"><enum>(iv)</enum><text>the number and nature of ongoing prosecutions of offenses involving child sexual exploitation;</text></clause><clause id="iddeb91e5b548948a4a0311bb398cec418"><enum>(v)</enum><text>the number of prosecutions of offenses involving child sexual exploitation by judicial district;</text></clause><clause id="id5a7b8085511c4e90915cfdfe6778513f"><enum>(vi)</enum><text>the number of convictions of offenses involving child sexual exploitation;</text></clause><clause id="idf1fb861d828a49d3816edf5fadbaf42a"><enum>(vii)</enum><text>the number of convictions of offenses involving child sexual exploitation by judicial district; </text></clause><clause id="id8cd04cd7b7034e34a63f15f196b7ea40"><enum>(viii)</enum><text>the number of referrals of offenses involving child sexual exploitation to non-Federal entities, including foreign law enforcement agencies, broken down by jurisdiction and entity; </text></clause><clause id="ida3064bdd56784997bc6d9694d652af0f"><enum>(ix)</enum><text>a summary of all transfers and grants made from the Fund; and </text></clause><clause id="ida684e7bbc65b4245ac26db79efaf84a6"><enum>(x)</enum><text>a summary of any unobligated funds from transfers and grants made for a previous fiscal year from the Fund; and</text></clause></subparagraph><subparagraph id="idD09958D1BEF9450C90CD5C2978BED764"><enum>(B)</enum><text>discussing the funding priorities of the Office and covered programs and agencies for the current fiscal year, which shall include—</text><clause id="idcbd8c3d4674748b0a8035a05eaf577e2"><enum>(i)</enum><text>an outline of planned funding transfers and grants to be made from the Fund during the current fiscal year; and</text></clause><clause id="id938b8832259b455783091f83b9952412"><enum>(ii)</enum><text>a summary of public comments on such funding priorities received under paragraph (7); and</text></clause></subparagraph></paragraph><paragraph id="id3E2F2E0586AD4B8FAB9A6EF645D2A36B"><enum>(9)</enum><text>not later than May 1 of each year, appear before the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives to discuss the enforcement and protection strategy, including any updates. </text></paragraph></subsection><subsection id="id8D96B25758694A47BC39C85D78CCBBF1"><enum>(d)</enum><header>Notice of changes by covered programs and agencies</header><paragraph id="idD01E714228404CDC9199292AECF6CB4A"><enum>(1)</enum><header>In general</header><text>The head of each covered program or agency shall notify the Director in writing of any proposed policy change relating to— </text><subparagraph id="id20577B8CB9A347A29AE668E6522C0C81"><enum>(A)</enum><text>the prevention, investigation, or prosecution of child sexual exploitation; </text></subparagraph><subparagraph id="id8D1B94BBF0C64B3DACF6AB941FF6FE6E"><enum>(B)</enum><text>the treatment of victims of child sexual exploitation; or </text></subparagraph><subparagraph id="id98DA769DB165466EA7F0747F04A47EDC"><enum>(C)</enum><text>other activities relating to addressing child sexual exploitation.</text></subparagraph></paragraph><paragraph id="id3B1FC85F729346F6A49090905A25B49E"><enum>(2)</enum><header>Response</header><text>The Director shall respond promptly to any notice under paragraph (1), which shall include the determination of the Director regarding whether the proposed policy change is consistent with the enforcement and protection strategy. </text></paragraph></subsection></section><section id="id9474d203935f446bb681cf62376ac957"><enum>4.</enum><header>Increased funding, treatment, and support for victims of child sexual exploitation and programs and services to prevent child sexual exploitation</header><subsection id="id0696e4a697a043a483ca157ca98220be"><enum>(a)</enum><header>Programs</header><paragraph id="id2AF7D2DEF0A64A2ABF71582629A1D867"><enum>(1)</enum><header>In general</header><text>For each of fiscal years 2021 through 2030, the Director shall make the following transfers from the Fund:</text><subparagraph id="id45cc7c0cc5824f6cb1079c7d5ce2c354"><enum>(A)</enum><header>United States attorneys offices</header><text>To the Department of Justice, $100,000,000 for child sexual exploitation prosecutions by offices of the United States attorney.</text></subparagraph><subparagraph id="idba2cdfb9545a41e0ad3b7c19bfa16fa3"><enum>(B)</enum><header>Child Exploitation and Obscenity Section</header><text>To the Department of Justice, such sums as are necessary to ensure that there are not fewer than 120 prosecutors and agents employed in the Child Exploitation and Obscenity Section of the Criminal Division.</text></subparagraph><subparagraph id="id8d8e270b4b0f4f03bef0569746dd6708"><enum>(C)</enum><header>Federal Bureau of Investigation</header><text>To the Federal Bureau of Investigation, such sums as are necessary to ensure that the total number of case agents and investigators employed in the Innocent Images National Initiative, the Crimes Against Children Unit, the Child Abduction Rapid Deployment Teams, and the Child Exploitation and Human Trafficking Task Forces of the Federal Bureau of Investigation is not less than 100 more than the total number of such case agents and investigators on the date of enactment of this Act.</text></subparagraph><subparagraph id="idc90cdfcbedf14c7a8f80d166e5687978"><enum>(D)</enum><header>National Center for Missing and Exploited Children</header><text>To the Department of Justice, $15,000,000 for a grant by the Office of Juvenile Justice and Delinquency Prevention to the National Center for Missing and Exploited Children to— </text><clause id="id5DFD8263674A4196A283812BA603EFD9"><enum>(i)</enum><text>ensure that the total number of analysts, engineers, and other employees at the National Center for Missing and Exploited Children supporting, evaluating, and processing child sexual abuse material tips from technology companies is not less than 65 more than the number of such analysts, engineers, and other employees on the date of enactment of this Act; and</text></clause><clause id="id5A755465E632443EA043F7EA7F38DB13"><enum>(ii)</enum><text>upgrade and maintain technology infrastructure and methods.</text></clause></subparagraph><subparagraph id="id1d0729195e4c4152b7d38e73a86bbb09"><enum>(E)</enum><header>Internet Crimes Against Children Task Forces</header><text>To the Department of Justice, $60,000,000 for grants to States for activities relating to Internet Crimes Against Children Task Forces.</text></subparagraph><subparagraph id="id0f6e794209cb4a948ed58365a2bad396"><enum>(F)</enum><header>National Criminal Justice Training Center</header><text>To the Department of Justice, $5,000,000 for a grant to the National Criminal Justice Training Center.</text></subparagraph><subparagraph id="idedc16eb80ae14fc183c9aac4107bf1c5"><enum>(G)</enum><header>Children’s advocacy programs</header><text>To the agency head designated under section 201(b) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11111">34 U.S.C. 11111(b)</external-xref>), $27,000,000 for grants to local children’s advocacy centers under section 214 of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/20304">34 U.S.C. 20304</external-xref>). </text></subparagraph><subparagraph id="id4b7b617d028e454abbd297587afa4014"><enum>(H)</enum><header>Street Outreach Program</header><text>To the Department of Health and Human Services, $16,000,000 for the Street Outreach Program of the Family and Youth Services Bureau.</text></subparagraph></paragraph></subsection><subsection id="id05ED24A2D79F4D6AA9871B3B786461D1"><enum>(b)</enum><header>Grants and transfers to agencies, programs, and services</header><paragraph id="id658B3037DC2E4CE2A4BDC818592EA4B5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Using amounts in the Fund, the Director may make grants and transfer funds to Executive agencies for treatment and support for victims of child sexual exploitation and evidence-based programs and services to prevent child sexual exploitation. </text></paragraph><paragraph id="id3119A0CC0F594D269D438E0B8C5AA40A"><enum>(2)</enum><header>Included services and programs</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Director may—</text><subparagraph id="id2480ffa273b24e7fa132d9258e40034b"><enum>(A)</enum><text>transfer funds to the Street Outreach Program of the Department of Health and Human Services; </text></subparagraph><subparagraph id="id739450ef4ffb43cc89a8737840cad315"><enum>(B)</enum><text>make grants to local governments and Indian Tribes for hiring mental health services providers, including school-based mental health services providers to work at public elementary schools and secondary schools; </text></subparagraph><subparagraph id="id14338442d01649a8a03e0d94efb8c131"><enum>(C)</enum><text>make grants to non-Federal entities or transfer funds to Executive agencies to provide training to mental health services providers, including school-based mental health services providers to detect cases of child sexual exploitation and to treat victims of child sexual exploitation; </text></subparagraph><subparagraph id="id5bd091a9010b46ee8f2621de191c0a15"><enum>(D)</enum><text>transfer funds to the Internet Crimes Against Children Task Force program, the Victim Identification program, and the Child Exploitation Investigations Unit of U.S. Immigration and Customs Enforcement; </text></subparagraph><subparagraph id="id97e66ef238174ed6947c3250da3a1062"><enum>(E)</enum><text>make grants to the National Center for Missing and Exploited Children; </text></subparagraph><subparagraph id="id3fd881cf017a43d180df6b343132356b"><enum>(F)</enum><text>make grants to non-Federal entities or transfer funds to Executive agencies to provide community education relating to the detection, prevention, and treatment of victims of child sexual exploitation; </text></subparagraph><subparagraph id="id540fff4dff334154847f469667cd99c8"><enum>(G)</enum><text>make grants to non-Federal entities or transfer funds to Executive agencies to provide information and training to individuals and organizations providing assistance to victims of child sexual exploitation; </text></subparagraph><subparagraph id="id1adef3f361a2439e9c78bea68aad3500"><enum>(H)</enum><text>transfer funds to the agency head designated under section 201(b) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11111">34 U.S.C. 11111(b)</external-xref>) for grants to local children’s advocacy centers under section 214 of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/20304">34 U.S.C. 20304</external-xref>); </text></subparagraph><subparagraph id="id3b02e524dd8b46d5ba2833e2933bf8c4"><enum>(I)</enum><text>transfer funds to the Innocent Images National Initiative, the Crimes Against Children Unit, the Child Abduction Rapid Deployment Teams, and the Child Exploitation and Human Trafficking Task Forces of the Federal Bureau of Investigation;</text></subparagraph><subparagraph id="id740ae944061c4dda8b5b1b1ee5d38688"><enum>(J)</enum><text>transfer funds to the Child Exploitation and Obscenity Section of the Criminal Division of the Department of Justice; </text></subparagraph><subparagraph id="idabd1848a814f446b9401f4ef8a82a1aa"><enum>(K)</enum><text>make grants to nonprofit private agencies for the purpose of providing street-based services to runaway and homeless, and street youth, who have been subjected to, or are at risk of being subjected to, sexual abuse, prostitution, sexual exploitation, severe forms of trafficking in persons (as defined in section 103(11) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(11)</external-xref>)), or sex trafficking (as defined in section 103(12) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(12)</external-xref>)); </text></subparagraph><subparagraph id="id658971f36c8840239da037ab6ebab6fc"><enum>(L)</enum><text>make grants to the National Criminal Justice Training Center; and</text></subparagraph><subparagraph id="idfacbce5e1a5d4c6eaf05699372fbbec0"><enum>(M)</enum><text>make grants or transfer funds to any other covered program or agency for programs or activities directed at addressing child sexual exploitation. </text></subparagraph></paragraph></subsection><subsection id="id5596b7742fd84a758eabf906bafe68f9"><enum>(c)</enum><header>Funding</header><paragraph id="idC3206680FBDA42E9A49B148406E94E9F"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury a fund to be known as the <quote>Child Sexual Exploitation Treatment, Support, and Prevention Fund</quote>, consisting of amounts transferred under paragraph (2). </text></paragraph><paragraph id="id2F48D3263D8F49BFBF6E86D21675DB14"><enum>(2)</enum><header>Transfer</header><text>The Secretary of the Treasury shall transfer to the Fund, from the general fund of the Treasury, $5,000,000,000 for fiscal year 2021, to remain available through September 30, 2030.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC01FE2BA69A844EF9BFE90ECA829C982"><enum>(3)</enum><header>Use of funds</header><subparagraph commented="no" display-inline="no-display-inline" id="idE025D43D50D6424DB4A566509826E241"><enum>(A)</enum><header>In general</header><text>The Director may use amounts in the Fund, without further appropriation, to carry out this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA48B6832ABEF4E4BB03D902D8B78DBDE"><enum>(B)</enum><header>Supplement not supplant</header><text>Amounts made available to agencies, programs, and services from the Fund shall supplement, but not supplant, regular appropriations for such agencies, programs, and services.</text></subparagraph></paragraph><paragraph id="ide1e22d47e70d468cb36e30c228935e0c"><enum>(4)</enum><header>Customs user fees</header><subparagraph id="idea2365b75b2d447aa7c97c2a946e460e"><enum>(A)</enum><header>In general</header><text>Section 13031(j)(3) of the Consolidated Omnibus Budget Reconciliation Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/19/58c">19 U.S.C. 58c(j)(3)</external-xref>) is amended—</text><clause id="id7b422adfb7fa4bc083313d88798535f9"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>October 21, 2029</quote> and inserting <quote>August 31, 2030</quote>; and</text></clause><clause id="idc7bc94808b4848959f4f4d356ffa339f"><enum>(ii)</enum><text>in subparagraph (B)(i), by striking <quote>October 21, 2029</quote> and inserting <quote>August 31, 2030</quote>.</text></clause></subparagraph><subparagraph id="idbf8c6bc481704ca78989edc8382de77e"><enum>(B)</enum><header>Rate for merchandise processing fees</header><text>Section 503 of the United States-Korea Free Trade Agreement Implementation Act (<external-xref legal-doc="public-law" parsable-cite="pl/112/41">Public Law 112–41</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/19/3805">19 U.S.C. 3805</external-xref> note) is amended in the matter preceding paragraph (1) by striking <quote>October 21, 2029</quote> and inserting <quote>August 31, 2030</quote>. </text></subparagraph></paragraph></subsection></section><section commented="no" id="id659ab9c527bd4bca82c88f6b51f09c37"><enum>5.</enum><header>Evaluation of prevention programs</header><text display-inline="no-display-inline">The Director, in coordination with the Director of the National Institute of Justice, shall enter into an agreement with the Deputy Assistant Secretary for Planning, Research, and Evaluation of the Department of Health and Human Services under which the Deputy Assistant Secretary shall conduct a study and, not later than 6 years after the date of enactment of this Act, publicly issue a report—</text><paragraph commented="no" id="id81a77e81db714798b7bb232208865d34"><enum>(1)</enum><text>identifying risk factors that may make certain individuals more vulnerable to child sexual exploitation;</text></paragraph><paragraph commented="no" id="id1ec32dff1f64483eb9ecb039ab4b1056"><enum>(2)</enum><text>identifying the programs with the greatest potential for preventing child sexual exploitation; and</text></paragraph><paragraph commented="no" id="id6ce167e0e05c4b02847b5a5a10b19eab"><enum>(3)</enum><text>evaluating promising programs being developed in the field of child sexual exploitation prevention.</text></paragraph></section><section commented="no" id="idec7188a0a3ab41189b1a7a3547d9d0d4"><enum>6.</enum><header>GAO study</header><text display-inline="no-display-inline">The Comptroller General of the United States, in consultation with the Director, shall study and publicly issue a report documenting all Federal funding (including grants to States, local governments, Indian Tribes, nonprofit entities, and other entities) for the prevention, detection, enforcement, and treatment of child sexual exploitation, which shall separately report on activities relating to child sexual abuse material. </text></section><section id="id7640cfa4973e44388137dae5986fae1b"><enum>7.</enum><header>Modernizing the CyberTipline</header><subsection id="idC7CBEF6D38754004A2998A0B680008EA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended—</text><paragraph id="idBBD4983BE24F494494FC74278B70AE37"><enum>(1)</enum><text>in section 2258A—</text><subparagraph id="id755205A25D3145E1BA6918D7F563F9F7"><enum>(A)</enum><text>in subsection (a)—</text><clause id="idA04A9E0536554B1EB73044782B14664A"><enum>(i)</enum><text>in paragraph (1)(B)(ii), by inserting after <quote>facts or circumstances</quote> the following: <quote>, including any available facts or circumstances sufficient to identify and locate each involved individual,</quote>; and</text></clause><clause id="id109F96287EDF4178B69A36EDD2D1A02F"><enum>(ii)</enum><text> in paragraph (2)(A)—</text><subclause id="idB8FAA1E011444E6B8EB5CC8C9BF645A3"><enum>(I)</enum><text>by inserting <quote>1591 (if the violation involves a minor),</quote> before <quote>2251,</quote>; and</text></subclause><subclause id="id69C7FF377BB040C78D673C8230717630"><enum>(II)</enum><text> by striking <quote>or 2260</quote> and inserting <quote>2260, or 2422(b)</quote>;</text></subclause></clause></subparagraph><subparagraph id="id798E6B972B864F5C821D75596FE79F74"><enum>(B)</enum><text>in subsection (b)—</text><clause id="id7B06C5C230884DEDBEFFA70E7999DE34"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="idE08D2A7A46284161AD4E7AEBC2C90050"><enum>(I)</enum><text>by inserting <quote>or location</quote> after <quote>identity</quote>; and</text></subclause><subclause id="id792EBE1AC29D4CB4A5BB78EE4044BE08"><enum>(II)</enum><text>by striking <quote>other identifying information,</quote> and inserting <quote>other information which may identify or locate the involved individual,</quote>; and</text></subclause></clause><clause id="id8C9D35CAC35C4559AE50C37A86F4BFD6"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC1D63B732E1844B59A89EF1EE8645A7F"><paragraph id="id5d60d957da264f02815d71e3aae1fc8b"><enum>(6)</enum><header>Formatting of reports</header><text>When in its discretion a provider voluntarily includes any content described in this subsection in a report to the CyberTipline, the provider shall use best efforts to ensure that the report conforms with the structure of the CyberTipline.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id5B5C91C2765545B78E4149302A2694B8"><enum>(C)</enum><text>in subsection (d)(5)(B)—</text><clause id="id51207AE6BDE749588ED39FB02E8472C1"><enum>(i)</enum><text>in clause (i), by striking <quote>forwarded</quote> and inserting <quote>made available</quote>; and</text></clause><clause id="id3F9E3571E35D4A25ADC8542EE81AA030"><enum>(ii)</enum><text>in clause (ii), by striking <quote>forwarded</quote> and inserting <quote>made available</quote>; and</text></clause></subparagraph><subparagraph id="id57936904C8F04F6C8DA00F60BD3C3B42"><enum>(D)</enum><text>in subsection (h)—</text><clause id="id7DB0282C9A54407E81ABC08B9BCD06F1"><enum>(i)</enum><text>in paragraph (1), by striking <quote>90 days</quote> and inserting <quote>180 days</quote>; and</text></clause><clause id="idbf3cd799d3fa45f6a83d8acea4ea39d3"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb9b4e536aa0e43d2bdc510ae66bf50ba"><paragraph id="idb8a8938e591945ef9be1769bf52c9dac"><enum>(5)</enum><header>Extension of preservation</header><text>A provider of a report to the CyberTipline may voluntarily preserve the contents provided in the report (including any commingled content described in paragraph (2)) for longer than 180 days after the submission to the CyberTipline for the purpose of reducing the proliferation of online child sexual exploitation or preventing the online sexual exploitation of children.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id49AAC21366DD4EA8BD17FE345C8B0501"><enum>(6)</enum><header>Method of preservation</header><text>A provider of a report to the CyberTipline shall preserve material under this subsection in a manner that complies with the cybersecurity standards for the protection of data under the cybersecurity framework established by the National Institute of Standards and Technology.</text></paragraph><after-quoted-block>; and</text></subclause><subclause id="id137B049F647C4874B3B09229CF9DF9E3"><enum>(III)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB32A878EAF9B4D8DBF4A3CFE3FD87E18"><subparagraph id="id763FAC51CB2841B7875FB3A0D22AFF13"><enum>(B)</enum><header>Provision to non-profit entities</header><text>NCMEC may provide hash values or similar technical identifiers associated with visual depictions provided in a CyberTipline report or submission to the child victim identification program described in section 404(b)(1)(K)(ii) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11293">34 U.S.C. 11293(b)(1)(K)(ii)</external-xref>) to a non-profit entity for the sole and exclusive purpose of preventing and curtailing the online sexual exploitation of children.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause id="id818D5B919F37485FA1F937CE87E2EBF1"><enum>(ii)</enum><text>in paragraph (2)—</text><subclause id="id1FAE793CCAC24B11BA8D6BFAEBE55B86"><enum>(I)</enum><text>by inserting <quote>(A)</quote> after <quote>(1)</quote>;</text></subclause><subclause id="idC7B6AAC656C24BF28F71503D10C46AE8"><enum>(II)</enum><text>by inserting <quote>or submission to the child victim identification program described in section 404(b)(1)(K)(ii) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11293">34 U.S.C. 11293(b)(1)(K)(ii)</external-xref>)</quote> after <quote>CyberTipline report</quote>; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id97FBA9DA653749E7A2B8FAA81C5B8764"><enum>(C)</enum><text>in subsection (d), by inserting <quote>or to the child victim identification program described in section 404(b)(1)(K)(ii) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11293">34 U.S.C. 11293(b)(1)(K)(ii)</external-xref>)</quote> after <quote>CyberTipline</quote>. </text></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id049622D92E9744D5B2EFA8F5E34650AC"><enum>(b)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code, is amended by striking the item relating to section 2258C and inserting the following: </text><quoted-block style="OLC" id="ida998cf55-dc33-4c82-9c20-bd3a394bffd6"><toc><toc-entry level="section">2258C.
