Authorization of appropriations.</toc-entry></toc></section><section id="idDF40ADA386A145D2815AC464E3B4EAA3"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idB6BF1EF169634426B69B5BE761EEAB1F"><enum>(1)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means—</text><subparagraph id="idF530D2B3469642B19D7BE89EE28307E2"><enum>(A)</enum><text>a public 2-year institution of higher education; or </text></subparagraph><subparagraph id="idF27087F1F8024DDD87297ED1A067D63B"><enum>(B)</enum><text>a partnership between—</text><clause id="id163FF81BB41144D3A9812F51F46A6614"><enum>(i)</enum><text>a public 2-year institution of higher education; and </text></clause><clause id="id20D71C3155914587BB2F65FDAA3D1763"><enum>(ii)</enum><text>a nonprofit organization identified as an evidence-based comprehensive student success program by the Department of Education.</text></clause></subparagraph></paragraph><paragraph id="id33FFF85A822D471CAB75326D3C717A49"><enum>(2)</enum><header>Evidence-based comprehensive student success program</header><text>The term <term>evidence-based comprehensive student success program</term> means a program that uses a comprehensive approach to student success and meets the criteria for receiving an expansion grant from the Education Innovation and Research program, as determined by the Department of Education. </text></paragraph><paragraph id="idFE49B53D0E98404D921FD82CAC7940FF"><enum>(3)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term under section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="id611FAB45A5C4474FA9749FAFD61DD91F"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text></paragraph><paragraph id="id46C3539AEFE7455D9E35AD14D8959AF0"><enum>(5)</enum><header>Transfer rate</header><text>The term <term>transfer rate</term>, when used with respect to students enrolled in a program of study at an eligible institution, means that rate at which such students transfer to a 4-year institution of higher education.</text></paragraph></section><title id="idC1158324D7274E97857C8BC3512BF018" style="OLC"><enum>I</enum><header>Community college student success program</header><section id="HCBBA8E9058B3495B84E9558FF17A1197"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H9FF5AB36B7B3406B9C267C79D81BD6CD"><enum>(1)</enum><header>Community college student success program</header><text display-inline="yes-display-inline">The term <term>community college student success program</term> means a program carried out by an eligible institution under which the institution carries out the following:</text><subparagraph id="H80598C2C670B48D281EE7B56ABBF02D3"><enum>(A)</enum><text>Provides eligible students participating in such program with an amount that covers the cost of tuition and fees that are not covered by any Federal, State, or institutional financial assistance received by the student.</text></subparagraph><subparagraph display-inline="no-display-inline" id="H8197B749C27544159E6F61901A82C913"><enum>(B)</enum><text>Requires eligible students participating in such program to—</text><clause commented="no" id="H8518B21D4524476D96771C03DA8DC7EC"><enum>(i)</enum><text>be enrolled in the eligible institution and carry a full-time academic workload during each fall and spring semester (or equivalent terms) during which the student participates in such program;</text></clause><clause id="HBABE8CD9AED24432B6C1982032A90C1A"><enum>(ii)</enum><text display-inline="yes-display-inline">if the eligible student is referred to remedial courses or on academic probation, meet, on at least a weekly basis or under an alternate schedule, as determined by the institution, with a tutor, except that in the case of an eligible student who is academically struggling, but who is not referred to remedial courses or on academic probation, the student may meet with a tutor at least as often as the program advisor for such student requires or under an alternate schedule, as determined by the institution;</text></clause><clause id="H59897537C8B14E3AAFD3C3C0945033B9"><enum>(iii)</enum><text display-inline="yes-display-inline">meet with a program advisor—</text><subclause id="H8E2E91A4286B40ACA3004BFC86B94931"><enum>(I)</enum><text display-inline="yes-display-inline">twice each month during the first semester (or equivalent term) of participation in such program; and</text></subclause><subclause id="H241A682390CC48D099369EBF16206AAC"><enum>(II)</enum><text display-inline="yes-display-inline">as directed by the program advisor in subsequent semesters (or equivalent terms) under subparagraph (C)(ii); and</text></subclause></clause><clause id="HF64800A741D4426B9C57C728C292AB2B"><enum>(iv)</enum><text display-inline="yes-display-inline">meet with an on-campus career advisor or participate in a career services event or program once each semester (or equivalent term) or under an alternate schedule, as determined by the institution.</text></clause></subparagraph><subparagraph id="H53D636BE673C45F6B254843DC8FC2CF7"><enum>(C)</enum><text>Provides a program advisor to each eligible student participating in such program who—</text><clause id="H1569390D0BA84AD58F825BC92082F84E"><enum>(i)</enum><text>provides comprehensive academic and personal advising to the eligible student, including—</text><subclause id="idcb1241e944f54880b5657f8c3650318b"><enum>(I)</enum><text>the creation and implementation of an academic plan for the student to graduate from a program of study at the eligible institution within 150 percent of the normal time for graduation from such program;</text></subclause><subclause id="idaf951ede0d3949e9a20cc8d7f44840b9"><enum>(II)</enum><text>taking steps to enable an eligible student referred to remedial courses to complete college mathematics and English in their first year; and </text></subclause><subclause id="idae8ff0f3ccdb47f59983e7280de88bb4"><enum>(III)</enum><text>assisting the eligible student with developing and achieving academic goals, including creating strong transfer pathways (including articulation agreements that guarantee admission), that demonstrate programmatic transfer for students interested in transferring to a 4-year institution of higher education;</text></subclause></clause><clause id="H85A858C56BB5441D8312C42A6C2C0037"><enum>(ii)</enum><text display-inline="yes-display-inline">after the eligible student participating in such program completes a semester (or equivalent term), creates for the eligible student a needs-based advising schedule that indicates, based on the eligible student’s academic performance, the frequency with which such eligible student shall be required to meet with a program advisor for each subsequent semester (or equivalent term) of program participation;</text></clause><clause id="HC59CD5C32EFA4519B864E8B1EE0FB188"><enum>(iii)</enum><text>has a caseload of not more than 125 eligible students;</text></clause><clause commented="no" id="HFA680FB155454030B2FDB702A5E462CF"><enum>(iv)</enum><text>tracks the attendance of the eligible student at the meetings described in clauses (ii), (iii), and (iv) of subparagraph (B);</text></clause><clause id="HA18AAA87BD0D4051A0E0A493E5B045DE"><enum>(v)</enum><text>monitors the academic progress of the eligible student; and</text></clause><clause commented="no" id="H6F37ADC2185A455AAD3F232D8D1EA743"><enum>(vi)</enum><text>provides each eligible student who meets the requirements of subparagraph (B), on at least a monthly basis, with financial incentives support that will enhance student success.</text></clause></subparagraph><subparagraph commented="no" id="H2DA59965E505472AACE32DA6D67754F3"><enum>(D)</enum><text display-inline="yes-display-inline">Provides tutoring, academic support, and career services at no cost to eligible students participating in such program, and may reserve places in select courses for such eligible students in order to create community within cohorts of eligible students.</text></subparagraph><subparagraph commented="no" id="HCDC64499A91148AAB8BB7CC1E33051D4"><enum>(E)</enum><text display-inline="yes-display-inline">Provides information to eligible students participating in such program about the eligibility of such students for assistance under the supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) and the program of block grants for States for temporary assistance for needy families established under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="H39326B2B43984B65ABD8A8EE449C3D41"><enum>(2)</enum><header>Eligible student</header><text display-inline="yes-display-inline">The term <term>eligible student</term> means a student enrolled at an eligible institution who—</text><subparagraph id="HCDAB7642265C4C50B607CE19BC8836C1"><enum>(A)</enum><text>on the date such eligible student would begin participation in a community college student success program at such eligible institution—</text><clause id="idb177a540fc574ed08626f21e16a27a64"><enum>(i)</enum><text>is enrolled in a program of study leading to an associate degree that prepares students to transfer to a 4-year institution of higher education or advance in the labor market;</text></clause><clause id="id5d9a2b1b54d5419f81000671e0f8a75d"><enum>(ii)</enum><text>is carrying a full-time academic workload during each Fall and Spring semester (or equivalent terms) during which the student participates in such program;</text></clause><clause id="id3733eb0c9139468b8d98cf703a19200e"><enum>(iii)</enum><text>takes at least 20 degree-applicable, non-remedial credits in a given academic year; and</text></clause><clause id="id4b0ec5457c334a6493be2c7878037b48"><enum>(iv)</enum><text>is—</text><subclause id="idda3b7376c76345e7a4ce519b846da126"><enum>(I)</enum><text>a first-time undergraduate student; or</text></subclause><subclause id="id659a75c1c93f4a2abd6c129e2dc9d655"><enum>(II)</enum><text>a continuing or transfer student with not more than 24 credits and a minimum grade point average of 2.0 (or its equivalent);</text></subclause></clause></subparagraph><subparagraph commented="no" id="H228B2E711ED9459083C73109187C6C40"><enum>(B)</enum><text>if the student is eligible for financial aid under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>)—</text><clause commented="no" id="id52CD80246EA346DFA925306BCCC77630"><enum>(i)</enum><text>has completed the Free Application for Federal Student Aid or other common financial reporting form under section 483(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090(a)</external-xref>); or </text></clause><clause commented="no" id="id53A7167133634ECC99B3EA4B75B7CC60"><enum>(ii)</enum><text>demonstrates eligibility for a Federal Pell Grant through institutional financial aid eligibility forms or State financial aid eligibility forms; and</text></clause></subparagraph><subparagraph id="H8A7D1ED0DD5D4EBB9379E46599BAE5BD"><enum>(C)</enum><text>meets any other requirements established by the institution.</text></subparagraph></paragraph><paragraph id="idEF9D2B233EFB4B289F442C754BC1F82C"><enum>(3)</enum><header>Full-time academic workload</header><text>The term <term>full-time academic workload</term>, when used with respect to a semester or equivalent term, means at least 12 credits (or the equivalent).</text></paragraph></section><section id="HBDCF28146C5740889915E9A4B280875D"><enum>102.</enum><header>Community College Student Success Grant Program authorized</header><text display-inline="no-display-inline">From the amounts appropriated under section 110, the Secretary of Education shall establish and carry out the community college student success grant program to award grants under sections 103 and 104, on a competitive basis, to eligible institutions to plan and implement community college student success programs or to improve or expand evidence-based comprehensive student success programs designed to increase—</text><paragraph id="H01B7A44C75CA471BB16808FA454922AE"><enum>(1)</enum><text>the rate at which program participants from a program of study at such eligible institution graduate within 150 percent of the normal time for graduation;</text></paragraph><paragraph id="HB8101799D60248FBA600A0FF84E232ED"><enum>(2)</enum><text>transfer rates of program participants to 4-year institutions; and</text></paragraph><paragraph id="idB8A9D0E0861D40DCBF6A369AE3858738"><enum>(3)</enum><text>the number of credits that a program participant takes that can be applied to a degree in the participant's desired major.</text></paragraph></section><section section-type="subsequent-section" id="H0CC995506EC24ECC80A29A7DEEB19373"><enum>103.</enum><header>Grants to plan community college student success programs</header><subsection id="H120F2B32EC2E4CA386D6F5B19D0C9317"><enum>(a)</enum><header>Planning grants authorized</header><text display-inline="yes-display-inline">From the amounts appropriated to carry out this section under section 109 for a fiscal year, the Secretary shall award planning grants for such fiscal year, on a competitive basis, to eligible institutions to develop plans for community college student success programs.</text></subsection><subsection id="HDC60830B5F1540B1997CDD642547C10E"><enum>(b)</enum><header>Duration</header><text>A grant awarded under this section shall be for a 1-year period.</text></subsection><subsection commented="no" id="H59E69B4E8F4B4B47BC2F4B9B36197C0A"><enum>(c)</enum><header>Peer review process; priority</header><text>In awarding grants under this section for a fiscal year, the Secretary shall—</text><paragraph commented="no" id="H2F184D5A32BE477799310117DEC2A2F7"><enum>(1)</enum><text>carry out a peer review process that—</text><subparagraph id="H083D2EE3EFA746BE86F3D19C975AC863"><enum>(A)</enum><text>requires that each application submitted under subsection (d) be peer reviewed by a panel of readers composed of individuals selected by the Secretary, which shall include—</text><clause commented="no" id="H5E96A9D911464312AEB92BC37CAEEBAB"><enum>(i)</enum><text>not less than 50 percent of readers—</text><subclause id="HF0ADB31875AD4146BA8062AF265D648A"><enum>(I)</enum><text>who are not employees of the Federal Government; and</text></subclause><subclause id="H108A57FD24314A159972282E6B1B4D7F"><enum>(II)</enum><text>who have relevant research or practical experience with respect to student support programs designed to increase graduation rates and transfer rates at public 2-year institutions of higher education; and</text></subclause></clause><clause id="id595b80b734924ecead1d119469458c66"><enum>(ii)</enum><text>to the maximum extent practicable, individuals who are members of groups underrepresented in higher education, including African Americans, Hispanics, Native Americans (including American Indians, Alaska Natives, and Native Hawaiians), Asian Americans, Pacific Islanders, and individuals with disabilities in a manner that reflects the national, State, or local population demographics; and</text></clause></subparagraph><subparagraph commented="no" id="HB20D9B771CA248A78AF129BC32388F51"><enum>(B)</enum><text display-inline="yes-display-inline">ensures that no individual assigned under subparagraph (A) to review an application has any conflict of interest with regard to that application that may make the individual unable to impartially conduct such review; and</text></subparagraph></paragraph><paragraph commented="no" id="HF5CCFA6C187A4C44AA9CE00DB36E0920"><enum>(2)</enum><text>give priority to eligible institutions that are eligible to receive funding under title III or V of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1051">20 U.S.C. 1051 et seq.</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/20/1101">20 U.S.C. 1101 et seq.</external-xref>).</text></paragraph></subsection><subsection id="H94985BE2DEC54BAE8174846ADA4B85AE"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible institution desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, which shall include—</text><paragraph id="idb38d19593af949dbb478d1357352f003"><enum>(1)</enum><text>the graduation rate, the number of credits completed (disaggregated by remedial credits and college-level credits for each program of study), the retention rate, and the transfer rate for the most recent academic year for which data are available for eligible students and all students, disaggregated by race, income, and gender, respectively;</text></paragraph><paragraph id="id7428e50bb7c442a0acddd9f65752b262"><enum>(2)</enum><text>an analysis of how implementing a community college student success program may improve the graduation rate or transfer rate for eligible students; and</text></paragraph><paragraph id="id3b1c2ea6869b4ddcb64b98bae70f2273"><enum>(3)</enum><text>a description of the methods the eligible institution has previously used to improve the graduation rate or transfer rate with respect to eligible students and all students, respectively.</text></paragraph></subsection><subsection id="HEFA299FD11FD4F25AC349C7646F12B10"><enum>(e)</enum><header>Use of funds</header><text>An eligible institution that receives a grant under this section shall use the grant to develop a plan to implement a community college student success program at the eligible institution.</text></subsection><subsection id="H6BAA5948C4B0475D856D3716B3FDBDD2"><enum>(f)</enum><header>Report</header><text>Not later than 1 year after the date on which an eligible institution receives a grant under this section, such eligible institution shall submit to the Secretary a report that includes—</text><paragraph id="H882E717CF5AB475C966DF5CB2BFB6B9E"><enum>(1)</enum><text>a plan for implementing a community college student success program at the eligible institution, including—</text><subparagraph id="idb28337b51c2d4e20b87903bf290817c3"><enum>(A)</enum><text>the sufficiently ambitious outcome goals for achieving significant improvements in graduation rates, retention rates, and transfer rates for program participants and all students, disaggregated by race, income, and gender, respectively, before the end of the grant period;</text></subparagraph><subparagraph commented="no" id="H1581DC577DC545FC828D5F6D792AF9C8"><enum>(B)</enum><text>the number of such eligible students who will participate in such program in relation to the amount of funding provided, including—</text><clause commented="no" id="id9494D01E41B74A0B967F6225DD9DDE8B"><enum>(i)</enum><text>how such eligible students will be identified, referred, and selected in cases where the interest in the program is larger than the budget for the program; </text></clause><clause commented="no" id="idBD8610D9925243D8ABC7C0065EEA765B"><enum>(ii)</enum><text>a plan to ensure that the program is racially and ethnically representative; and </text></clause><clause commented="no" id="idF7A8F1E20CBA4B1D99775C979C4D5246"><enum>(iii)</enum><text>a plan to ensure that economically disadvantaged students receive priority;</text></clause></subparagraph><subparagraph id="idb21d15d661224b5b919bf34fccea996c"><enum>(C)</enum><text>based on the most recent academic year for which data are available, disaggregated by eligible students and all students—</text><clause id="idf3c62344013c4937b52078869caeeeea"><enum>(i)</enum><text>graduation rates;</text></clause><clause id="ida1637940e8a8465ca1566d55277fc093"><enum>(ii)</enum><text>retention rates;</text></clause><clause id="idd37368afdc51466ca1e6afe6e1a810e5"><enum>(iii)</enum><text>transfer rates; and</text></clause><clause id="id26a41572f36244bb818f0674f12d6818"><enum>(iv)</enum><text>average number of credits earned, including remedial and college-level credits, by associate degree earners;</text></clause></subparagraph><subparagraph id="id09bff1cd6f24420b961e819212365235"><enum>(D)</enum><text>an analysis of the financial needs of eligible students based on the Free Application for Federal Student Aid;</text></subparagraph><subparagraph id="id15325E461476450F8E01B8D0CEEE3353" commented="no"><enum>(E)</enum><text>a description of how the eligible institution will—</text><clause commented="no" id="idB1D33CB3F8E74BF3B643E8C33C722CB1"><enum>(i)</enum><text>recruit and serve eligible students for the community college student success program in a manner that reflects the local or State population; or </text></clause><clause commented="no" id="id17FE3451A82C48D68F26A700C9C3A814"><enum>(ii)</enum><text>develop and implement a plan to recruit and serve eligible students for such program in a manner that reflects the local or State population and demographics; </text></clause></subparagraph><subparagraph id="idd191e9d486b94bb3b99e39a30175dad2" commented="no"><enum>(F)</enum><text>a description of how the eligible institution will—</text><clause id="idCA35C794B4AB466495344DF96035777E" commented="no"><enum>(i)</enum><text>effectively staff a community college student success program in a manner that reflects the student population; or </text></clause><clause id="id737B9E1B04D74924B2BF1F256F6700AA" commented="no"><enum>(ii)</enum><text>develop and implement a plan to effectively staff a community college student success program in a manner that reflects the local or State population and demographics; and</text></clause></subparagraph><subparagraph id="H1AC9CBF42899488696829DC1E26AD3C8"><enum>(G)</enum><text>a timeline for the implementation of such program;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H22F815A17E1443AE801DBED30C2EB9AD"><enum>(2)</enum><text>a budgetary analysis that includes—</text><subparagraph commented="no" id="HAFA61D9BC901446F99124FE959B355FC"><enum>(A)</enum><text>a description of how the eligible institution will provide non-Federal funds for such program under section 104(d); and</text></subparagraph><subparagraph commented="no" id="HFA32EF6104874D0D8065800EA6871C92"><enum>(B)</enum><text>a description of how the eligible institution will continue to fund such program after the end of the grant period for the grant awarded to the institution under section 104; and</text></subparagraph></paragraph><paragraph id="id5fb45bfe877d4120a951e1afcc929cde"><enum>(3)</enum><text>such other information as the Secretary may require. </text></paragraph></subsection></section><section id="HA0AAC35CF71E4E4BAAF0645F3DA94155"><enum>104.</enum><header>Grants to implement, improve, or expand community college student success programs</header><subsection id="H6315326DED5A4DFDB962C1B31A289299"><enum>(a)</enum><header>Implementation, improvement, and expansion grants authorized</header><paragraph id="H5579A4FC86F04E689D2363AA5EC1CF76"><enum>(1)</enum><header>In general</header><text>From the amounts appropriated to carry out this section under section 109 for a fiscal year, the Secretary shall award grants for such fiscal year, on a competitive basis—</text><subparagraph id="idF8DFC2A77C7647E699F8A6C6E6317E47"><enum>(A)</enum><text>to eligible institutions awarded a grant under section 103 to implement community college student success programs; or</text></subparagraph><subparagraph id="idDB8D1CB04A0B4E01A67DACF0BF777F49"><enum>(B)</enum><text>to eligible institutions to improve or expand an evidence-based comprehensive student success program.</text></subparagraph></paragraph><paragraph commented="no" id="HD09D3F74FA7C4DAD92AD3AC58220B3A9"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In awarding grants under this section for a fiscal year, the Secretary shall consult with the independent evaluator before finalizing which eligible institutions will receive such a grant for such fiscal year.</text></paragraph></subsection><subsection id="H831B3537D67F444CA8F1A5C4DC9FD466"><enum>(b)</enum><header>Requirements for selection</header><text>To be eligible to receive a grant under this section, an eligible institution shall meet the following requirements:</text><paragraph id="H26125E0E6C744B6089CBE2DE00B44C46"><enum>(1)</enum><text>The eligible institution—</text><subparagraph id="idDA33FE8203CD412A9990ADA43F8CB436"><enum>(A)</enum><text>was awarded a grant under section 103 at least 1 year before such eligible institution submits an application under subsection (e); or</text></subparagraph><subparagraph id="id911b542087d64585998c33225044c60b"><enum>(B)</enum><text>the eligible institution, at the time of application, implements an evidence-based comprehensive student success program. </text></subparagraph></paragraph><paragraph id="H5127F016D57D426B8BADD53ADEA023A6"><enum>(2)</enum><text>The eligible institution submits an application under subsection (e).</text></paragraph><paragraph commented="no" id="H53F000F5245E49F39D8CE8C6DE991270"><enum>(3)</enum><text>The eligible institution demonstrates, on the date of the application described in subsection (e), the availability of non-Federal funding for the matching funds required under subparagraphs (A), (B), and (C) of subsection (d)(1).</text></paragraph></subsection><subsection id="HFF5E433F28794B018B540EEFE677AD20"><enum>(c)</enum><header>Duration</header><text>A grant awarded under this section shall be for a 5-year period.</text></subsection><subsection commented="no" id="H6EAF44CE7F1C44F3919569849BDF4515"><enum>(d)</enum><header>Non-Federal contribution</header><paragraph id="H19A2A001B2E040548E06342453E987EA"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), an eligible institution awarded a grant under this section shall contribute in cash from non-Federal sources, the following:</text><subparagraph id="HB3E945EF2E47406BBFF1B248F0A25C2D"><enum>(A)</enum><text>For the second year of the grant period, an amount equal to 10 percent of the cost of carrying out the community college student success program or the cost to improve or expand the evidence-based comprehensive student success program (as applicable) at the institution for such year.</text></subparagraph><subparagraph id="H1376D88257D042E99C3B7CA44CFB5F02"><enum>(B)</enum><text>For each of the third through fifth years of the grant period, an amount equal to 20 percent of the cost of carrying out the community college student success program or the cost to improve or expand the evidence-based comprehensive student success program (as applicable) for the applicable year.</text></subparagraph></paragraph><paragraph id="HFF4F485986134C62A247FFDEAF90FF5F"><enum>(2)</enum><header>Exception</header><subparagraph id="H286ADDD7FC6C43959984EF083DAFB8CA"><enum>(A)</enum><header>In general</header><text>Notwithstanding paragraph (1), with respect to an exempt institution awarded a grant under this section, for each year of the grant period beginning with the second year through the fifth year, the Secretary shall not require the institution to make a cash contribution from non-Federal sources in an amount that is greater than the amount equal to 5 percent of the cost at the institution for such year of carrying out—</text><clause id="idC207FA0465D448E9A5D074A54C93CF1E"><enum>(i)</enum><text>the community college student success program; or</text></clause><clause id="idD620509DE8834B53B0098DCC8FDAEC82"><enum>(ii)</enum><text>the evidence-based comprehensive student success program.</text></clause></subparagraph><subparagraph id="HB2A2C29791D24ED99E863FDA697A163A"><enum>(B)</enum><header>Definitions</header><text>For purposes of this paragraph:</text><clause id="H5AA9C9D5FD9E47A7B0ABBAD971F8E465"><enum>(i)</enum><header>Exempt institution</header><text>The term <term>exempt institution</term> means an eligible institution that is—</text><subclause id="HD85C10D4E95F41B78B54D4AA3C4BE702"><enum>(I)</enum><text>a Tribal college or university; or</text></subclause><subclause id="H57B0CE0FD1AC4914A19B72C1ED6A478F"><enum>(II)</enum><text display-inline="yes-display-inline">an institution located in the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, the Commonwealth of the Northern Mariana Islands, the Republic of the Marshall Islands, the Federated States of Micronesia, or the Republic of Palau.</text></subclause></clause><clause id="H03F81C9D2FFA476C8489F8FCF5C2BE58"><enum>(ii)</enum><header>Tribal college or university</header><text>The term <term>Tribal college or university</term> has the meaning given the term in section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>).</text></clause></subparagraph></paragraph></subsection><subsection id="HB225E21A6AE5438492FD84D27BFC067E"><enum>(e)</enum><header>Application</header><text>An eligible institution desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including—</text><paragraph id="id38E929A4C41C44B09543CDFC770F6366"><enum>(1)</enum><text>in the case of a community college student success program, a copy of the report described in section 103(f); and</text></paragraph><paragraph id="idcc788302af0e46f4acd497e52e63ea47"><enum>(2)</enum><text>in the case of an evidence-based comprehensive student success program, a demonstration that the program meets the criteria for receiving an expansion grant from the Education Innovation and Research program, as determined by the Department of Education. </text></paragraph></subsection><subsection id="H1F985BED8F8C46998342ECB9491E51DD"><enum>(f)</enum><header>Required use of funds</header><text display-inline="yes-display-inline">An eligible institution that receives a grant under this section shall use the grant funds to—</text><paragraph id="H7DC8728DE3E24D98B6D95E1E9AE64BBD"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idAFFB7411C32340FCA1B18195BDC6A729"><enum>(A)</enum><text display-inline="yes-display-inline">implement a community college student success program; or</text></subparagraph><subparagraph indent="up1" id="id7A5A9681D33144CDA1AF612BD1D9402E"><enum>(B)</enum><text>improve or expand an evidence-based comprehensive student success program; and</text></subparagraph></paragraph><paragraph id="HD797809E472A4130BDF5FCA55309DEE4"><enum>(2)</enum><text>regularly review—</text><subparagraph id="H941A22D7A110475D97FBB1DE405E5198"><enum>(A)</enum><text>data to monitor the academic progress of eligible students participating in the program; and</text></subparagraph><subparagraph id="H8A293BCE1DDB49C383135C68A07B204E"><enum>(B)</enum><text>in the case of a community college student success program, the meeting and program participation requirements described in section 101(1).</text></subparagraph></paragraph></subsection><subsection id="HB19DC026E4984B1BB7FB87A1BC6CEBD2"><enum>(g)</enum><header>Permissible use of funds</header><text display-inline="yes-display-inline">An eligible institution that receives a grant under this section may use the grant to—</text><paragraph id="H562388D9F9CC4F6B8581EF45B6E024CE"><enum>(1)</enum><text>establish or expand a data tracking system that includes early alerts to complete the regular reviews required under subsection (f)(2);</text></paragraph><paragraph id="H45637AFDFAAF4815841D8B66AC0F8F92" commented="no"><enum>(2)</enum><text>provide eligible students participating in the program for which the grant is awarded with financial assistance to cover wraparound support services to meet the whole cost of attendance, including books, supplies, miscellaneous personal expenses, technology, transportation, or room and board costs and childcare in accordance with section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>);</text></paragraph><paragraph commented="no" id="H1D11AD4EFFB64A1C91242C4268F992F9"><enum>(3)</enum><text>establish or expand career development services for such students, such as career workshops or career counseling;</text></paragraph><paragraph id="HF371BB17E07049509151CCE77CE94EB1"><enum>(4)</enum><text>establish or expand tutoring and academic support services for such students; </text></paragraph><paragraph id="id1e1580314d864857aed6a4c9781367c2"><enum>(5)</enum><text>cover the costs of employment of administrators for the program whose sole job shall be to administer the program, without regard to whether the employment is full-time or less than full-time; or</text></paragraph><paragraph id="id2deec6fddd0546919d39c75c41ce8d78"><enum>(6)</enum><text>provide financial support for eligible students participating in such program to enroll in courses offered during enrollment periods that are outside the fall and spring semesters (or equivalent terms).</text></paragraph></subsection><subsection commented="no" id="H63A1432DC6DB45CE93FAE5A3F1306358"><enum>(h)</enum><header>Reports</header><paragraph commented="no" id="idC22088A31F0E4603BD7FD3AD281B72EF"><enum>(1)</enum><header>In General</header><text>Using the postsecondary student data system established under section 132(1) or a successor system (whichever includes the most recent data) to streamline reporting requirements and minimize reporting burdens, and in coordination with the National Center for Education Statistics, the Secretary shall, on at least an annual basis, collect data with respect to each community college student success program and evidence-based comprehensive student success program receiving funding under this section, including the data described in paragraph (2).</text></paragraph><paragraph commented="no" id="idB7A0DE8F2ACC4125B9AAF0CF2F1DCCB3"><enum>(2)</enum><header>Data submitted by eligible institutions</header><text>Each eligible institution that receives a grant under this title shall provide the following to the Secretary:</text><subparagraph commented="no" id="id2c02fdc143634bb7963abd344fd35e75"><enum>(A)</enum><text>On an annual basis, such information as may be necessary for the Secretary to collect data about—</text><clause id="ide2bd20ee98364451ac07876d2fa89b73"><enum>(i)</enum><text>the demographic characteristics of the eligible students participating in the program and how these demographics compare to State or local populations and efforts to bridge equity gaps;</text></clause><clause id="id2f7ff8ca027b4c4ea046b9a305f7abb7"><enum>(ii)</enum><text>the average number of credits attempted and average number of credits earned, rate of retention, rate of degree completion, and transfer rates of such eligible students, disaggregated by race, income, and gender;</text></clause><clause id="idec68a13c4dfa4d13b48896c67e515064"><enum>(iii)</enum><text>the graduation rate of such eligible students; and</text></clause><clause id="idf407ed1e586f4644918bd958e919094b"><enum>(iv)</enum><text>post-graduate outcomes, such as employment and earnings.</text></clause></subparagraph><subparagraph commented="no" id="ida16802e35a5c4a05baca43f0a60e202b"><enum>(B)</enum><text>An annual performance report for each year of the grant period that includes—</text><clause commented="no" id="H0B36D16396024E0DAB453B582A3BED59"><enum>(i)</enum><text>an analysis of the implementation and progress of such program based on the ambitious outcome goals described in the report submitted by the institution under section 103(f)(1)(A), including challenges to and changes made to such program;</text></clause><clause commented="no" id="H430A57B78C69457A829FE4283CE79F40"><enum>(ii)</enum><text>if according to the analysis under subparagraph (A), the program is not on track to meet such ambitious outcome goals, a description of the plans to adjust the program to improve the performance of the program;</text></clause><clause commented="no" id="H9A685030F62049A8B06952ADC92C7353"><enum>(iii)</enum><text>the participation of such eligible students in tutoring, academic support, career services, and meetings with program advisors; and</text></clause><clause commented="no" id="id09281a41b975416babb375292e848a88"><enum>(iv)</enum><text>when data is available, information that will allow for a comparison of the data collected for such year under this subparagraph with such data collected for each of the 2 years preceding the date on which the grant was awarded. </text></clause></subparagraph><subparagraph commented="no" id="H2C2C9E0196104A95B0096567633E91ED"><enum>(C)</enum><text display-inline="yes-display-inline">Not later than 6 years after the date on which the eligible institution received such grant, a final report to the Secretary that includes an analysis of—</text><clause commented="no" id="H4918CC38ADD845978ADCE6BB92F50492"><enum>(i)</enum><text display-inline="yes-display-inline">the factors that contributed to the success or failure of the program in meeting the ambitious outcome goals described in the report submitted by the institution under section 103(f)(1)(A), as applicable;</text></clause><clause commented="no" id="HF01209F08E3B46F583897855038A53B6"><enum>(ii)</enum><text>the challenges faced in attempting to implement such program;</text></clause><clause commented="no" id="H718C5911C1634D4ABE175A7581286724"><enum>(iii)</enum><text>information on how to improve such program;</text></clause><clause commented="no" id="HD6AC0B9A01974C7BBDB25A6B8D6D9038"><enum>(iv)</enum><text>whether the program has created an institution-wide reform with respect to graduate rates and transfer rates for all students, and if so, how such reform was created; and</text></clause><clause commented="no" id="HF1B6E90D21D346899CF49389CA021F7A"><enum>(v)</enum><text>how the eligible institution will continue to fund such program after the end of the grant period.</text></clause></subparagraph></paragraph></subsection></section><section commented="no" id="H1C860AA41D1B4DC493D713B0098A5F4D"><enum>105.</enum><header>Evaluations</header><subsection commented="no" id="H9C47FBADC5A347608C4DCD209CBA5B51"><enum>(a)</enum><header>Independent evaluations</header><text display-inline="yes-display-inline">Before finalizing which eligible institutions will receive grants under section 104 for a fiscal year, the Secretary, acting through the Director of the Institute of Education Sciences, shall enter into a contract with an independent evaluator—</text><paragraph id="H478356EBF0E744D0A54175041D9CAC63"><enum>(1)</enum><text>to consult with the Secretary on which eligible institutions should receive the grants; and</text></paragraph><paragraph id="H9196388E14F64927A4C50F64A72B9CDF"><enum>(2)</enum><text>to use the What Works Clearinghouse Standards (without reservations) to evaluate, throughout the duration of the grant period of such grants—</text><subparagraph id="H14593230E75C40559CC78CF19DFA590A"><enum>(A)</enum><text>each program for which such grant is awarded, including whether the program met its ambitious outcome goals described in the report submitted by the institution under section 103(f)(1)(A), as applicable;</text></subparagraph><subparagraph commented="no" id="H002EFC5613E246E4A315DC61A4B6D34E"><enum>(B)</enum><text display-inline="yes-display-inline">the average impact of those programs on graduation rates, the average number of credits per associate degree awarded, and transfer rates for eligible students;</text></subparagraph><subparagraph id="H97D18369B198483F854DFF9DB50FEDD2"><enum>(C)</enum><text>the variation in program impacts across eligible institutions with respect to such rates; and</text></subparagraph><subparagraph commented="no" id="HB04C2B03FB104150A2A4199C6CE00924"><enum>(D)</enum><text>whether those programs are cost effective in creating higher graduation rates and transfer rates of participating eligible students compared with such rates among students who did not participate in programs at eligible institutions.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H2AA2E822E31C46659E7605D3724DE08A"><enum>(b)</enum><header>Results of evaluations</header><text display-inline="yes-display-inline">The results of the evaluations under subsection (a) shall be made publicly available on the website of the Department of Education.</text></subsection><subsection commented="no" id="HA5933F5AB2D64182AC2AE8BEF65E9C15"><enum>(c)</enum><header>Funding for evaluations</header><text>The Secretary may reserve not more than 15 percent of the funds appropriated under section 109 for a fiscal year to carry out this section for such fiscal year.</text></subsection></section><section id="H8DB7F0B545664E0AA966E3031767E519"><enum>106.</enum><header>Outreach and technical assistance</header><subsection id="H3A3EF97EE950437B85739A79A4EFCE35"><enum>(a)</enum><header>Outreach</header><text display-inline="yes-display-inline">The Secretary shall conduct outreach activities to notify eligible institutions of the availability of grants under this title.</text></subsection><subsection id="H4AFCEE0680DA40389D5B35C61EACBDF4"><enum>(b)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary shall provide technical assistance—</text><paragraph id="H3D00176A070A48BEAD467A042634F521"><enum>(1)</enum><text>to eligible institutions that may be interested in applying for grants under this title, including assistance with applications for such grants; and</text></paragraph><paragraph id="H49F08DAC7F7547158E93BDDACE9265EF"><enum>(2)</enum><text>to eligible institutions awarded grants under this title, including assistance with—</text><subparagraph id="HF776FA78EB15462585A9CAF176D53209"><enum>(A)</enum><text>establishing ambitious outcome goals described in section 103(f)(1)(A), as applicable; </text></subparagraph><subparagraph id="idfbc44e08ff474503943eaa33f0a210be"><enum>(B)</enum><text>disaggregating data and goals by race, income, and gender; and</text></subparagraph><subparagraph id="id9599cf2ed32343bab791a60b17623d40"><enum>(C)</enum><text>the design and implementation of a program, including the use of real-time data to track student progress.</text></subparagraph></paragraph></subsection><subsection id="idfffe9b71d87a4ceeaf4e3b79620e3d8b"><enum>(c)</enum><header>Consultation</header><text>The Secretary may consult with institutions of higher education or nonprofit organizations that operate evidence-based comprehensive student success programs to provide technical assistance to eligible institutions.</text></subsection><subsection id="idA3AB09D9B03F4DC99FB1911F02519D86"><enum>(d)</enum><header>Publicly available information</header><text>The Secretary shall compile and make publicly available information about research, best practices, and strategies relating to programs under this title. </text></subsection><subsection id="H790C390281964AA29B0077B2E8B7FE62"><enum>(e)</enum><header>Funding for technical assistance for evaluations</header><text display-inline="yes-display-inline">The Secretary may reserve not more than 7 percent of the funds appropriated under section 109 for a fiscal year for technical assistance under this section for such fiscal year.</text></subsection></section><section id="HD537045E567C49BF921D46D8BAE19D3B"><enum>107.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 1 year after the date on which the Secretary receives the final evaluation results under section 105 for eligible institutions that were awarded grants under section 104 for the same fiscal year, the Secretary shall submit to Congress a report that includes—</text><paragraph id="HBD91E2CA802B4C45A6EB442FC20BCD8D"><enum>(1)</enum><text>the number of grants awarded under section 104 for such fiscal year, and the amount of such grants;</text></paragraph><paragraph commented="no" id="HBC4D17410A7247E4A86E554F9BEC4278"><enum>(2)</enum><text>the number of grants awarded under section 103 to eligible institutions that received or would have been eligible for the grants described in paragraph (1), and the amount of such grants; </text></paragraph><paragraph commented="no" id="id4d85bf15fa924ca3873945012c70aadb"><enum>(3)</enum><text>the number of grants awarded under section 103 to eligible institutions that would have been eligible, but did not receive the grants described in paragraph (1); </text></paragraph><paragraph id="HCCF212C4F2A840B7B6F96A7756966A77"><enum>(4)</enum><text>such final evaluation results; and</text></paragraph><paragraph id="id262b3b7195ce4f0396f84fb9c424c490"><enum>(5)</enum><text>any other information the Secretary may determine is relevant. </text></paragraph></section><section id="H6C6DF1F57FD441808B5338A4347012DF"><enum>108.</enum><header>Relationship to other student financial assistance</header><subsection id="idb2636a5c255f40dba4d507927df405d8"><enum>(a)</enum><header>Student financial assistance</header><text>Any funds received under this title by an eligible institution that are distributed to a student—</text><paragraph id="idE6606D7296C14F86A1DA324A2E90BB74"><enum>(1)</enum><text>shall be credited to student's account only after all other Federal, State, and institutional grants for which that student is eligible are credited to that student's account; and</text></paragraph><paragraph id="id4304A0DC91DD456CBC666C69C9D07D59"><enum>(2)</enum><text>shall not affect a student's eligibility for other Federal grants for which the student is eligible. </text></paragraph></subsection><subsection id="idb88e8355651d424e81ade5843d1dc660"><enum>(b)</enum><header>Cost of attendance limit</header><text>An eligible institution receiving funds under this title shall ensure that in distributing any such funds to a student, the amount of such funding does not exceed the cost of attendance as described in section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>).</text></subsection></section><section id="id88A6A0074FB04160AEBE9C085DCECCD9"><enum>109.</enum><header>Supplement not supplant</header><text display-inline="no-display-inline">Funds made available under this title shall be used to supplement and not supplant other Federal, State, and local funds available to the institution for carrying out the activities described in this title.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H532085E15AF34C749B7FE8AEF4D1D960"><enum>110.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this title $10,000,000,000 for fiscal years 2022 through 2032, to be available until expended.</text></section></title><title commented="no" id="idB652AE09D4BD4B85B4DF9D27214CB2F9" style="OLC"><enum>II</enum><header>Part time community college student success program</header><section id="H776448AF23F34E6BB739C57C7CF9C8AB"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="HE4342C7B1831419EB962234B540352AF"><enum>(1)</enum><header>Part time community college student success program</header><text display-inline="yes-display-inline">The term <term>part time community college student success program</term> means a program carried out by an eligible institution under which the eligible institution carries out the following:</text><subparagraph id="HE5BBF921ED4B4FC794E55E04905B3F4F"><enum>(A)</enum><text>Provides students participating in such program with an amount that covers the cost of tuition and fees that are not covered by any Federal, State, or institutional financial assistance received by the student.</text></subparagraph><subparagraph display-inline="no-display-inline" id="H4BFE39EFCE154CA887AA89D6E84A120E"><enum>(B)</enum><text>Requires students participating in such program to—</text><clause commented="no" id="H6408E2333FC4490FB328EA3630F55F42"><enum>(i)</enum><text>be enrolled in not less than 9 credits and not more than 12 credits at the eligible institution as a degree-seeking student during each fall and spring semester (or equivalent terms) during which the student participates in such program;</text></clause><clause id="H4BFCAD03BDB042C1A0FA8145957C4533"><enum>(ii)</enum><text>if the student is referred to remedial or corequisite courses or on academic probation, meet, not less than on a weekly basis, with a tutor or appropriate academic support, except that in the case of a student who is academically struggling, but who is not referred to remedial courses or on academic probation, the student may meet with a tutor as often as the program advisor for such student requires;</text></clause><clause id="HA717DDCCE5D94AC199B648E9F7CF63D0"><enum>(iii)</enum><text display-inline="yes-display-inline">meet with a program advisor—</text><subclause id="H6D340786CFE74C158F37B7CBBE117954"><enum>(I)</enum><text>twice each month during the first semester (or equivalent term) of participation in such program; and</text></subclause><subclause id="H378F742DEF8849588F078940FE06677F"><enum>(II)</enum><text>as directed by the program advisor in subsequent semesters (or equivalent terms) under subparagraph (C)(ii); and</text></subclause></clause><clause id="HDBF336A723604280BE92163D73095009"><enum>(iv)</enum><text>meet with a career advisor or participate in a career services event not less than once each semester (or equivalent term).</text></clause></subparagraph><subparagraph id="H2FE38AE0479F448EAD930F404B203CDF"><enum>(C)</enum><text>Provides a program advisor to each student participating in such program who—</text><clause id="H6B3887B2D7BA46BFAF129B358E16ED66"><enum>(i)</enum><text>provides comprehensive academic, career, and personal advising to the student, such as—</text><subclause id="HE4FE252EE1A14AEA84444C2FEF70E3F7"><enum>(I)</enum><text display-inline="yes-display-inline">the creation and implementation of an academic plan for the student to graduate from a program of study at the eligible institution within 150 percent of the normal time for graduation from such program;</text></subclause><subclause commented="no" id="HE430042275C54F29980E0C514C641852"><enum>(II)</enum><text>if an eligible student is referred to remedial or corequisite courses, taking steps to enable the student to complete college mathematics and English within the first 30 credit hours; and</text></subclause><subclause id="H09CB891DAEAD4EADA11822B0C31C8014"><enum>(III)</enum><text>assisting the student with developing and achieving academic goals, including creating strong transfer pathways that demonstrate programmatic transfer for students interested in transferring to a 4-year institution of higher education;</text></subclause></clause><clause id="HD22ECBEB0EC34A8E8C276F28BD3C87FC"><enum>(ii)</enum><text>after the student participating in such program completes a semester (or equivalent term), creates for the student a needs-based advising schedule that indicates, based on the student’s academic performance, the frequency with which such student shall be required to meet with a program advisor for each subsequent semester (or equivalent term) of program participation;</text></clause><clause id="H4D5D8B425BBA4C63811649A1EDA32D27"><enum>(iii)</enum><text>has a caseload of not more than 125 students;</text></clause><clause commented="no" id="H7DF2E3CD8ACF496FAF8A776412AFD93C"><enum>(iv)</enum><text>tracks the attendance of the student at the meetings described in clauses (ii), (iii), and (iv) of subparagraph (B);</text></clause><clause id="H62847A10CCCF4E9BB14C8D6F6B9D75D3"><enum>(v)</enum><text>monitors the academic progress of the student; and</text></clause><clause commented="no" id="HB4CA47CB99374E20B1DBF9884B0D859E"><enum>(vi)</enum><text>provides each student who meets the requirements of subparagraph (B), on not more than a monthly basis, with financial incentives support that will enhance student success.</text></clause></subparagraph><subparagraph commented="no" id="HA3B173EFCEF648BFBDCF63664ABFABA1"><enum>(D)</enum><text display-inline="yes-display-inline">Provides tutoring, academic support, and career services at no cost to students participating in such program, and may reserve places in select courses for such students in order to create community within cohorts of students.</text></subparagraph><subparagraph id="id5c58898c9cdb4f22b364f2ac89e2cda4"><enum>(E)</enum><text>Provides information to eligible students participating in such program about the eligibility of such students for assistance under the supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) and the program of block grants for States for temporary assistance for needy families established under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>). </text></subparagraph></paragraph><paragraph id="H997B9D50F0954E818B91F72627B7902C"><enum>(2)</enum><header>Eligible student</header><text display-inline="yes-display-inline">The term <term>eligible student</term> means a student enrolled at an eligible institution who—</text><subparagraph id="HA832C90314704CD881D1DF2D561B0398"><enum>(A)</enum><text>on the date such eligible student would begin participation in a part time community college student success program at such eligible institution—</text><clause id="H3975DC39F36E4A3DA6566A16A5EC7B7E"><enum>(i)</enum><text>is enrolled in a program of study leading to an associate degree that prepares students to transfer to a 4-year institution of higher education or advance in the labor market; and</text></clause><clause id="idDE75822F00B043389C1577DE3B35AA6A"><enum>(ii)</enum><text>is—</text><subclause id="id6A9B14632ACC4B01AB5798D1E1518F3B"><enum>(I)</enum><text>a first-time undergraduate student; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idC5D7F75EB1E44B4DB865E8A61EE259F0"><enum>(II)</enum><text>a continuing or transfer student with not more than 24 credits and a minimum grade point average of 2.0 (or its equivalent);</text></subclause></clause></subparagraph><subparagraph id="idb12bfc4250fd410bbe0a1cee7a1a9972"><enum>(B)</enum><text>completes not less than 24 credits, at least 20 of which must be degree-applicable, at the eligible institution as a degree-seeking student during each academic year during which the student participates in the part time community college student success program;</text></subparagraph><subparagraph commented="no" id="id12A668BEE6C24FC3AAB1AACF817827CC"><enum>(C)</enum><text>if the student is eligible for financial aid under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>)—</text><clause commented="no" id="idFEF6643DA71C4764962FE851302C9D88"><enum>(i)</enum><text>has completed the Free Application for Federal Student Aid or other common financial reporting form under section 483(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090(a)</external-xref>); or </text></clause><clause commented="no" id="id0A9227AB381F4BFAA66D6331FB2B59C5"><enum>(ii)</enum><text>demonstrates eligibility for a Federal Pell Grant through institutional financial aid eligibility forms or State financial aid eligibility forms; and </text></clause></subparagraph><subparagraph id="H0B8B570BE5AF4F008D6AD89B1BCD13F3"><enum>(D)</enum><text>meets any other requirements established by the institution.</text></subparagraph></paragraph><paragraph id="id501231A6133E4F53BBDD9CBEF2E0DA88"><enum>(3)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means an institution described in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></paragraph></section><section id="H137AA2BF9EB44887A74D86EE4FDB67DD"><enum>202.</enum><header>Part time community College Student Success Grant Program authorized</header><text display-inline="no-display-inline">From the amounts appropriated under section 209, the Secretary of Education shall establish and carry out the part time community college student success grant program to award grants under sections 203 and 204, on a competitive basis, to eligible institutions to plan and implement part time community college student success programs and to improve or expand part-time evidence-based comprehensive student success programs for eligible students that are designed to increase—</text><paragraph id="H29C843F95D7241308E656979BC62ADFB"><enum>(1)</enum><text>the rate at which program participants graduate from a program of study at such eligible institution within 150 percent of the normal time for graduation;</text></paragraph><paragraph id="HE6E07A795D5D4641B4C415D4DF1C39B1"><enum>(2)</enum><text>transfer rates of program participants; and</text></paragraph><paragraph id="id55CA50F576C649A1B7DB0919437083F8"><enum>(3)</enum><text>the number of credits that a program participant takes that apply to a degree in the participant's desired major.</text></paragraph></section><section section-type="subsequent-section" id="H149CC7F818134944A6BD402E8D919E0A"><enum>203.</enum><header>Grants to plan part time community college student success programs</header><subsection id="HC6BE4A54BEE54D23873C0A928FF87A74"><enum>(a)</enum><header>Planning grants authorized</header><text display-inline="yes-display-inline">From the amounts appropriated to carry out this section under section 209 for a fiscal year, the Secretary shall award planning grants for such fiscal year, on a competitive basis, to eligible institutions to develop plans for part time community college student success programs.</text></subsection><subsection id="H7E1EA97029B1430285E07F5E34F3756B"><enum>(b)</enum><header>Duration</header><text>A grant awarded under this section shall be for a 1-year period.</text></subsection><subsection commented="no" id="H983BB6AE0A454F0DA9E37171A1672F12"><enum>(c)</enum><header>Peer review process; priority</header><text>In awarding grants under this section for a fiscal year, the Secretary shall—</text><paragraph commented="no" id="H87AF8AA700F04DAE89796EF4812A30DA"><enum>(1)</enum><text>carry out a peer review process that—</text><subparagraph id="H80CB643D08E64E51BEC9F2EA758B3E6F"><enum>(A)</enum><text>requires that each application submitted under subsection (d) be peer reviewed by a panel of readers composed of individuals selected by the Secretary, which shall include—</text><clause commented="no" id="H86B168C86DBE4A8F95CA7ED5A06724E6"><enum>(i)</enum><text>not less than 50 percent of readers—</text><subclause id="H60D59947EEEC40FCB1EB567D1937BEF1"><enum>(I)</enum><text>who are not employees of the Federal Government; and</text></subclause><subclause id="H4644CC9D403547348DD9FCDCE95D953F"><enum>(II)</enum><text>who have relevant research or practical experience with respect to student support programs designed to increase graduation rates and transfer rates at public 2-year institutions of higher education; and</text></subclause></clause><clause id="id79ef1590bafe4e35b04e72a213dc336c"><enum>(ii)</enum><text>to the maximum extent practicable, individuals who are members of groups underrepresented in higher education, including African Americans, Hispanics, Native Americans (including American Indians, Alaska Natives, and Native Hawaiians), Asian Americans, Pacific Islanders, and individuals with disabilities; and</text></clause></subparagraph><subparagraph commented="no" id="H8B382B7B21EB40F382A86EE406B90E76"><enum>(B)</enum><text display-inline="yes-display-inline">ensures that no individual assigned under subparagraph (A) to review an application has any conflict of interest with regard to that application that may make the individual unable to impartially conduct such review; and</text></subparagraph></paragraph><paragraph commented="no" id="HAE177F1669804940910A4BBED16C600F"><enum>(2)</enum><text>give priority to eligible institutions that are eligible to receive funding under title III or V of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1051">20 U.S.C. 1051 et seq.</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/20/1101">20 U.S.C. 1101 et seq.</external-xref>).</text></paragraph></subsection><subsection id="H57E041BB103A452892A41C965AA23762"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible institution desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, which shall include—</text><paragraph id="idfb1a383ac5a6483cb8723def8ff13db2"><enum>(1)</enum><text>the graduation rate, the number of credits completed (disaggregated by remedial credits and college-level credits for each program of study), and the transfer rate for the most recent academic year for which data are available for eligible students and all students, respectively;</text></paragraph><paragraph id="idc9fc28504218431babd95dbdbae4e3c8"><enum>(2)</enum><text>an analysis of how implementing a community college student success program may improve the graduation rate or transfer rate for eligible students; and</text></paragraph><paragraph id="id11c1b307c76c46a8b026ced9819303eb"><enum>(3)</enum><text>a description of the methods the eligible institution has previously used to improve the graduation rate or transfer rate with respect to eligible students and all students, respectively. </text></paragraph></subsection><subsection id="HFF4B2439A8614FD2941048A4BEDDB1FC"><enum>(e)</enum><header>Use of funds</header><text>An eligible institution that receives a grant under this section shall use the grant to develop a plan to implement a part time community college student success program at the eligible institution for eligible students.</text></subsection><subsection id="id2ad8216329e64a0590371cf449f1c111"><enum>(f)</enum><header>Report</header><text>Not later than 1 year after the date on which an eligible institution receives a grant under this section, such eligible institution shall submit to the Secretary a report that includes—</text><paragraph id="id1db94f3fbaab4282b930cb36b4f2bd61"><enum>(1)</enum><text>a plan for implementing a community college student success program at the eligible institution, including—</text><subparagraph id="ideeeff3073b144e98b094096efa1e9eab"><enum>(A)</enum><text>the sufficiently ambitious outcome goals for achieving significant improvements in graduation rates and transfer rates for program participants and all students, respectively, as such rates are defined by the eligible institution, in consultation with the Secretary, before the end of the grant period;</text></subparagraph><subparagraph id="id70b2f3ec0c2b4b359197c7517964b1d3"><enum>(B)</enum><text>the number of such eligible students who will participate in such program, including—</text><clause id="id5DD9148670E047EE985701617D06B512"><enum>(i)</enum><text>how such eligible students will be identified, referred, and selected, in cases where the interest in the program is larger than the budget for the program; and</text></clause><clause id="id9BD1450DF08246919F01BF46B52EF64B"><enum>(ii)</enum><text>a plan to ensure that economically disadvantaged students receive priority;</text></clause></subparagraph><subparagraph id="id89ffb17ad7f2474d9bc41fb0c6579cb1"><enum>(C)</enum><text>based on the most recent academic year for which data are available, disaggregated by eligible students and all students—</text><clause id="id005d30f5c8e949f7b8d6eabfeac0c343"><enum>(i)</enum><text>graduation rates;</text></clause><clause id="id6bb5e89ca2c5433790275050feab9ba9"><enum>(ii)</enum><text>transfer rates; and </text></clause><clause id="idF08B82FEDE6E46559F0E2CFEB3318A49"><enum>(iii)</enum><text>average number of credits earned, including remedial and college-level credits, by associate degree earners;</text></clause></subparagraph><subparagraph id="idee20f71b9765439582c6c0eeb608d497"><enum>(D)</enum><text>an analysis of the financial needs of eligible students based on the Free Application for Federal Student Aid;</text></subparagraph><subparagraph id="ida4cb8c6621fd452cbdc7008822157bdf" commented="no"><enum>(E)</enum><text>a description of how the eligible institution will—</text><clause commented="no" id="id0967F617B3AD4C2280E90E8D35C74C5C"><enum>(i)</enum><text>recruit and serve eligible students for the community college student success program in a manner that reflects the local or State population; or </text></clause><clause commented="no" id="idA06A3652583D437FA589384191D0CE95"><enum>(ii)</enum><text>develop and implement a plan to recruit and serve eligible students for such program in a manner that reflects the local or State population and demographics; </text></clause></subparagraph><subparagraph id="idBA72148829064A15836722DBDEE13BDE" commented="no"><enum>(F)</enum><text>a description of how the eligible institution will—</text><clause id="id350E12AD690E46928FC1F0CD582E7C9F" commented="no"><enum>(i)</enum><text>effectively staff a community college student success program in a manner that reflects the student population; or </text></clause><clause id="idE3FDB5CE6CE047D0B533D48193960035" commented="no"><enum>(ii)</enum><text>develop and implement a plan to effectively staff a community college student success program in a manner that reflects the local or State population and demographics; and </text></clause></subparagraph><subparagraph id="id8a5d993738654782bb4e552115927d65"><enum>(G)</enum><text>a timeline for the implementation of such program;</text></subparagraph></paragraph><paragraph id="id893c9ec9efe6400b86974e6394502aee"><enum>(2)</enum><text>a budgetary analysis that includes—</text><subparagraph id="id70884dc3ed1c44be8493cef90cca48c1"><enum>(A)</enum><text>a description of how the eligible institution will provide non-Federal funds for such program under section 204(d); and</text></subparagraph><subparagraph id="id02472c2c669c45269db922a0a4eaa567"><enum>(B)</enum><text>a description of how the eligible institution will continue to fund such program after the end of the grant period for the grant awarded to the institution under section 204; and</text></subparagraph></paragraph><paragraph id="idcbc844048fb749108fdf7e23139a94b0"><enum>(3)</enum><text>such other information as the Secretary may require. </text></paragraph></subsection></section><section id="H26E1F464176A441F81726204403F5046"><enum>204.</enum><header>Grants to implement, improve, or expand part time community college student success programs</header><subsection id="H0386C10B45EC432986B38A959A13A14E"><enum>(a)</enum><header>Implementation, improvement, and expansion grants authorized</header><paragraph id="id25FFF4C3E6BF4442963A43BED8E062A3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts appropriated to carry out this section under section 209 for a fiscal year, the Secretary shall award grants for such fiscal year, on a competitive basis—</text><subparagraph id="id6055F08BBB584C36BFD26C6C282B8F9E"><enum>(A)</enum><text display-inline="yes-display-inline">to eligible institutions awarded a grant under section 203 to implement part time community college student success programs; or</text></subparagraph><subparagraph id="id8248b81f1fa6470bb65b12815695b5ce"><enum>(B)</enum><text>to eligible institutions to improve or expand a part time evidence-based comprehensive student success program. </text></subparagraph></paragraph><paragraph commented="no" id="H08BD86E96F964932A8BA17EBC404E410"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In awarding grants under this section for a fiscal year, the Secretary shall consult with the independent evaluator described in section 205(a) before finalizing which eligible institutions will receive such a grant for such fiscal year.</text></paragraph></subsection><subsection id="HADCF36C13AB64B9EBE95B5207015CC6F"><enum>(b)</enum><header>Requirements for selection</header><text>To be eligible to receive a grant under this section, an eligible institution shall meet the following requirements:</text><paragraph id="H482FE1546C054BA8A72A88CD8EA0827F"><enum>(1)</enum><text>The eligible institution—</text><subparagraph id="id9A740682A37748EE937E8FD8C4F46BFD"><enum>(A)</enum><text>was awarded a grant under section 203 not less than 1 year before such eligible institution submits an application under subsection (e); or</text></subparagraph><subparagraph id="id1cb4dc799cf44b9dba25a410ec46144c"><enum>(B)</enum><text>the eligible institution, at the time of application, implements a part time evidence-based comprehensive student success program. </text></subparagraph></paragraph><paragraph id="H015FD3421AB84EADAEB1C501F5F15D62"><enum>(2)</enum><text>The eligible institution submits an application under subsection (e).</text></paragraph><paragraph commented="no" id="HB57FB5C6C327402296C9F5D66B308FB8"><enum>(3)</enum><text>The eligible institution demonstrates, on the date of the application described in subsection (e), the availability of non-Federal funding for the matching funds required under subparagraphs (A), (B), and (C) of subsection (d)(1).</text></paragraph></subsection><subsection id="HF335002FB31A4256A37A1799BEB9ADC2"><enum>(c)</enum><header>Duration</header><text>A grant awarded under this section shall be for a 5-year period.</text></subsection><subsection commented="no" id="H9473BEBBAF0C4BE3B63B292B4F210BF4"><enum>(d)</enum><header>Non-Federal contribution</header><paragraph commented="no" id="H540F8526B9054C13BB336A2132ABBBCD"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), an eligible institution awarded a grant under this section shall contribute in cash from non-Federal sources the following:</text><subparagraph commented="no" id="H43DFB30E54A445CBB6D8DEB890628ABC"><enum>(A)</enum><text>For the second year of the grant period, an amount equal to 10 percent of the cost of carrying out the part time community college student success program or the cost to improve or expand the part time evidence-based comprehensive student success program (as applicable) for eligible students at the institution for such year.</text></subparagraph><subparagraph commented="no" id="H2873AAEDFB7143E1BDCA5CE36221A5B1"><enum>(B)</enum><text>For each of the third year through fifth years of the grant period, an amount equal to 20 percent of the cost of carrying out the community college student success program or the cost to improve or expand the part time evidence-based comprehensive student success program (as applicable) for the applicable year.</text></subparagraph></paragraph><paragraph id="HC96CC482ADC14F42A2A56AA5BDE912DE"><enum>(2)</enum><header>Exception</header><subparagraph id="HFF857C3F40BA458DB6F07EF693CE1D5D"><enum>(A)</enum><header>In general</header><text>Notwithstanding (1), with respect to an exempt institution awarded a grant under this section, for each year of the grant period beginning with the second year through the fifth year, the Secretary shall not require the institution to make a cash contribution from non-Federal sources in an amount that is greater than the amount equal to 5 percent of the cost at the institution for such year of carrying out—</text><clause id="id92E6923804894D4AAE3F8C3024AF5D20"><enum>(i)</enum><text>the part time community college student success program; or</text></clause><clause id="idAC4FFDAB4FB44AC685472961C331B28C"><enum>(ii)</enum><text>the part time evidence-based comprehensive student success program.</text></clause></subparagraph><subparagraph id="H10DBFCFAD6FF44BA95D75A2FC43E2DD0"><enum>(B)</enum><header>Definitions</header><text>For purposes of this paragraph:</text><clause id="HF8363EAF3D704AEAB690D75269B67A68"><enum>(i)</enum><header>Exempt institution</header><text>The term <term>exempt institution</term> means an eligible institution that is—</text><subclause id="H324475885AB54C50BBBDAC36F5CAB61B"><enum>(I)</enum><text>a Tribal College or University; or</text></subclause><subclause id="HB992C47127EE4B19BBE0C253AB2D1704"><enum>(II)</enum><text display-inline="yes-display-inline">an institution located in the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, the Commonwealth of the Northern Mariana Islands, the Republic of the Marshall Islands, the Federated States of Micronesia, or the Republic of Palau.</text></subclause></clause><clause id="H1834326C31174E4897187D4200B994CA"><enum>(ii)</enum><header>Tribal College or University</header><text>The term <term>Tribal College or University</term> has the meaning given the term in section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>).</text></clause></subparagraph></paragraph></subsection><subsection id="HF3B0F82CC24442BB945B08F6598648E5"><enum>(e)</enum><header>Application</header><text>An eligible institution desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including—</text><paragraph id="id9BDCAE72F368452D81E4DF542B005A0D"><enum>(1)</enum><text>in the case of a part time community college student success program, a copy of the report described in section 203(f); and</text></paragraph><paragraph id="id57b2e1b9baa74497b3037b552843e3dc"><enum>(2)</enum><text>in the case of a part time evidence-based comprehensive student success program, a demonstration that the program meets the criteria for receiving an expansion grant from the Education Innovation and Research program, as determined by the Department of Education. </text></paragraph></subsection><subsection id="H79922FF35EC044D387D65E21D5B200D9"><enum>(f)</enum><header>Required use of funds</header><text display-inline="yes-display-inline">An eligible institution that receives a grant under this section shall use the grant funds to—</text><paragraph id="HEC0D3FE032684F2D9C0F209AB66714A5"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id679F098A63C740B4A1ECE19ADFCC171B"><enum>(A)</enum><text display-inline="yes-display-inline">implement a part time community college student success program; or</text></subparagraph><subparagraph indent="up1" id="id388CC77B84494841994F82D50BDACDAC"><enum>(B)</enum><text>improve or expand a part time evidence-based comprehensive student success program; and</text></subparagraph></paragraph><paragraph id="H71CD25C682D548BEAB8CEC9D358373B7"><enum>(2)</enum><text>regularly review—</text><subparagraph id="H312C514EAC7C42178E994DC7047799BF"><enum>(A)</enum><text>data to monitor the academic progress of eligible students participating in such program; and</text></subparagraph><subparagraph id="HD93FD70C302E4B608C80CD127E33DB71"><enum>(B)</enum><text>the meeting and program participation requirements described in section 201(1), as applicable.</text></subparagraph></paragraph></subsection><subsection id="HA1E1A8F2079847CCA4219094117E028C"><enum>(g)</enum><header>Permissible use of funds</header><text display-inline="yes-display-inline">An eligible institution that receives a grant under this section may use the grant to—</text><paragraph id="HD96BC8EF9B2F45799101817B3B4163A7"><enum>(1)</enum><text>establish or expand a data tracking system that includes early alerts to complete the regular reviews required under subsection (f)(2), as applicable;</text></paragraph><paragraph id="H1AC0DA5F7A25408DA2955CE2EEFCE7F5"><enum>(2)</enum><text>provide eligible students participating in the part time program for which the grant is awarded with financial assistance to cover the costs described in paragraph (2), (3), or (8) of section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>);</text></paragraph><paragraph commented="no" id="H107F8578E88140A191F4668CB410D2B0"><enum>(3)</enum><text>establish or expand career development services for such eligible students, such as career workshops or career counseling;</text></paragraph><paragraph id="H153E756056604EB1A6FF059FF37794F9"><enum>(4)</enum><text>establish or expand tutoring and academic support services for such eligible students; </text></paragraph><paragraph id="ida3cd38f0c7a74de38c946494fa0a4106"><enum>(5)</enum><text>cover the costs of employment of administrators for the program whose sole job shall be to administer the program, without regard to whether the employment is full-time or less than full-time; and </text></paragraph><paragraph commented="no" id="HE6BECE3A0E884DF2AA2B56C0E853608A"><enum>(6)</enum><text>provide financial support for such eligible students participating in such program to enroll in courses offered during enrollment periods that are outside the fall and spring semesters (or equivalent terms).</text></paragraph></subsection><subsection commented="no" id="idAEF8C3B98AB64043AB370E357B3499EE"><enum>(h)</enum><header>Reports</header><paragraph commented="no" id="idDE1B5ACACDED4C2D821E23A6B874C400"><enum>(1)</enum><header>In General</header><text>Using the postsecondary student data system established under section 132(1) or a successor system (whichever includes the most recent data) to streamline reporting requirements and minimize reporting burdens, and in coordination with the National Center for Education Statistics, the Secretary shall, on at least an annual basis, collect data with respect to each part time community college student success program and each part time evidence-based comprehensive student success program, including the data described in paragraph (2).</text></paragraph><paragraph commented="no" id="id1D569184DFAA463785B4ECA2F81BB7EB"><enum>(2)</enum><header>Data submitted by eligible institutions</header><text>Each eligible institution that receives a grant under this title shall provide the following to the Secretary:</text><subparagraph commented="no" id="idF333385A230C42C5BF889948B80C2F23"><enum>(A)</enum><text>On an annual basis, such information as may be necessary for the Secretary to collect data about—</text><clause commented="no" id="id28A27055C3BB4DA5B9F570BEC57C8F45"><enum>(i)</enum><text>the demographic characteristics of the eligible students participating in the part time program;</text></clause><clause commented="no" id="idE15453BB96A44946A6FD6F2CD4C310F8"><enum>(ii)</enum><text>the average number of credits attempted and average number of credits earned, rate of retention, rate of degree completion, and transfer rates of such eligible students; and</text></clause><clause commented="no" id="id7402CEE32EEF4ECEA89239850CB93063"><enum>(iii)</enum><text>the graduation rate of such eligible students. </text></clause></subparagraph><subparagraph commented="no" id="id463F5905402147E5A3A4C1CD58FB5695"><enum>(B)</enum><text>An annual performance report for each year of the grant period that includes—</text><clause commented="no" id="id9C61492C9F1A4D718EC7BE4F774177F0"><enum>(i)</enum><text>an analysis of the implementation and progress of such program based on the ambitious outcome goals described in the report submitted by the institution under section 203(f)(1)(A), as applicable, including challenges to and changes made to such program;</text></clause><clause commented="no" id="id921F92CF13C3473BAB25DA6E320BBC84"><enum>(ii)</enum><text>if according to the analysis under subparagraph (A), the program is not on track to meet such ambitious outcome goals, a description of the plans to adjust the program to improve the performance of the program;</text></clause><clause commented="no" id="id8363733EA300411FB4229F809769F0CC"><enum>(iii)</enum><text>the participation of such eligible students in tutoring, academic support, career services, and meetings with program advisors; and</text></clause><clause commented="no" id="id4EA98702739C4B0B90D6BBACBCD6D9E5"><enum>(iv)</enum><text>when data is available, information that will allow for a comparison of the data collected for such year under this subparagraph with such data collected for each of the 2 years preceding the date on which the grant was awarded. </text></clause></subparagraph><subparagraph commented="no" id="id9839A65F494F4D49B554B779F6157D15"><enum>(C)</enum><text display-inline="yes-display-inline">Not later than 6 years after the date on which the eligible institution received such grant, a final report to the Secretary that includes an analysis of—</text><clause commented="no" id="id512A7C337CA7400795D2525CC0B2B5FD"><enum>(i)</enum><text display-inline="yes-display-inline">the factors that contributed to the success or failure of the program in meeting the ambitious outcome goals described in the report submitted by the institution under section 203(f)(1)(A), as applicable;</text></clause><clause commented="no" id="id5E392FBFDC0B4ABF9F3C6045198880CE"><enum>(ii)</enum><text>the challenges faced in attempting to implement such program;</text></clause><clause commented="no" id="id50FA20B990E84FE480498D0E19C385DC"><enum>(iii)</enum><text>information on how to improve such program;</text></clause><clause commented="no" id="id23EDEDD9A84F4AED8A05CD2774C05AC1"><enum>(iv)</enum><text>whether the program has created an institution-wide reform with respect to graduate rates and transfer rates for all students, and if so, how such reform was created; and</text></clause><clause commented="no" id="idF4332D919178455FA089487D53BA3101"><enum>(v)</enum><text>how the eligible institution will continue to fund such program after the end of the grant period. </text></clause></subparagraph></paragraph></subsection></section><section commented="no" id="H00E58B5DFDC34F0C9ABB360592A827D8"><enum>205.</enum><header>Evaluations</header><subsection commented="no" id="H99268179B45B4CD2910FC019A26D1491"><enum>(a)</enum><header>Independent evaluations</header><text display-inline="yes-display-inline">Before finalizing which eligible institutions will receive grants under section 204 for a fiscal year, the Secretary, acting through the Director of the Institute of Education Sciences, shall enter into a contract with an independent evaluator—</text><paragraph id="H874DD4F8DF6D48679BCEA3D63D1700DB"><enum>(1)</enum><text>to consult with the Secretary on which eligible institutions should receive the grants; and</text></paragraph><paragraph id="H04F1580371C94A0AA422CF718F7E1475"><enum>(2)</enum><text>to use the What Works Clearinghouse Standards (without reservations) to evaluate, throughout the duration of the grant period of such grants—</text><subparagraph id="H95C029FBF7E048559EBE7E885835E9C7"><enum>(A)</enum><text>each part time program for eligible students for which such grant is awarded, including whether the program met its ambitious outcome goals described in the report submitted by the institution under section 203(f)(1)(A), as applicable;</text></subparagraph><subparagraph commented="no" id="HCB8205DCF5F54F04A5C99AEF5D23F493"><enum>(B)</enum><text display-inline="yes-display-inline">the average impact of part time programs on graduation rates, the average number of credits per associate degree awarded, and transfer rates for eligible students;</text></subparagraph><subparagraph id="HAC788198405F4EC1B3533A8155C8EA8E"><enum>(C)</enum><text>the variation in program impacts across eligible institutions with respect to such rates; and</text></subparagraph><subparagraph commented="no" id="H6E5849A949234895B2C59E434D707485"><enum>(D)</enum><text>whether such programs lead to higher graduation rates and transfer rates of eligible students per dollar spent for such students by such institutions compared with such rates among students who did not participate in part time programs at eligible institutions.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H2ECE670B3DA7461EB70D9FC85DC583F9"><enum>(b)</enum><header>Results of evaluations</header><text display-inline="yes-display-inline">The results of the evaluations under subsection (a) shall be made publicly available on the website of the Department of Education.</text></subsection><subsection commented="no" id="H393BD1F0F2254E05B388D201F6D73A1F"><enum>(c)</enum><header>Funding for evaluations</header><text>The Secretary may reserve not more than 15 percent of the funds appropriated under section 209 for a fiscal year to carry out this section for such fiscal year.</text></subsection></section><section id="HD861D7A0E10F4B4FBBA6455CCC04F2CB"><enum>206.</enum><header>Outreach and technical assistance</header><subsection id="H07EDB341ED1C4A3F8DB4E5AC1608DDE1"><enum>(a)</enum><header>Outreach</header><text display-inline="yes-display-inline">The Secretary shall conduct outreach activities to notify eligible institutions of the availability of grants under this title.</text></subsection><subsection id="H828FE75073C04E8D9C8EA6888C5719A5"><enum>(b)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary shall provide technical assistance—</text><paragraph id="HEB41177FBB6B4A8D81B8C863315B7CCD"><enum>(1)</enum><text>to eligible institutions that may be interested in applying for grants under this title, including assistance with applications for such grants; and</text></paragraph><paragraph id="HC6CC3E339C8F4879961082EBFABBFF36"><enum>(2)</enum><text>to eligible institutions awarded grants under this title, including assistance with—</text><subparagraph id="HC8BDE622C2A74D65B68DD2284EC6B0D0"><enum>(A)</enum><text>establishing ambitious outcome goals described in section 203(f)(1)(A); and</text></subparagraph><subparagraph id="H7503838AAA11484E8654366948572205"><enum>(B)</enum><text>the design and implementation of a part time community college student success program, including the use of real-time data to track student progress.</text></subparagraph></paragraph></subsection><subsection id="idbb3f44010e834e439ed90d90e0fb5f08"><enum>(c)</enum><header>Consultation</header><text>The Secretary may consult with institutions of higher education or nonprofit organizations that operate part time evidence-based comprehensive student success programs to provide technical assistance to eligible institutions.</text></subsection><subsection id="id50a0019cf0e649a78a43f6993117ecf6"><enum>(d)</enum><header>Publicly available information</header><text>The Secretary shall compile and make publicly available information about research, best practices, and strategies relating to part time programs under this title. </text></subsection><subsection id="HE9FE793863BD4169B8FE5810209AC897"><enum>(e)</enum><header>Funding for technical assistance for evaluations</header><text display-inline="yes-display-inline">The Secretary may reserve not more than 7 percent of the funds appropriated under section 209 for a fiscal year for technical assistance under this section for such fiscal year.</text></subsection></section><section id="H968F4394DA1A46D89173F7FE61A42D07"><enum>207.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 1 year after the date on which the Secretary receives the final evaluation results under section 205 for eligible institutions that were awarded grants under section 204 for the same fiscal year, the Secretary shall submit to Congress a report that includes—</text><paragraph id="idbc8e528677b940cd94882c50e607ca05"><enum>(1)</enum><text>the number of grants awarded under section 204 for such fiscal year, and the amount of such grants;</text></paragraph><paragraph commented="no" id="id6f24f14972b6468ca0729df2b18da035"><enum>(2)</enum><text>the number of grants awarded under section 203 to eligible institutions that received or would have been eligible for the grants described in paragraph (1), and the amount of such grants;</text></paragraph><paragraph commented="no" id="id17a856996d694d8d85c6d36ed0978fb5"><enum>(3)</enum><text>the number of grants awarded under section 203 to eligible institutions that would have been eligible but did not receive the grants described in paragraph (1);</text></paragraph><paragraph commented="no" id="id5610d1836eff48d7bce05a06f6d223c0"><enum>(4)</enum><text>such final evaluation results; and</text></paragraph><paragraph commented="no" id="idd37a4f9b39b3423fa849495ea6d7345a"><enum>(5)</enum><text>any other information the Secretary may determine is relevant.</text></paragraph></section><section id="H66E59F8672EC403492FA7F8A3479BEF5"><enum>208.</enum><header>Supplement, not supplant</header><text display-inline="no-display-inline">Funds awarded to an eligible institution under this title shall be used only to supplement the amount of funds that would, in the absence of the Federal funds provided under this title, be made available from non-Federal sources or other Federal sources to carry out the activities under this title, and not to supplant such funds.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H931D0B207D3D41608AA2A6472D07EC8A"><enum>209.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this title $5,000,000,000 for fiscal years 2022 through 2032, to be available until expended.</text></section></title></legis-body></bill>
