Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Controlled Substances Act to require physicians and other prescribers of controlled substances to complete training on treating and managing patients with opioid and other substance use disorders, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H4126978AE09C4FFB8E0FD1235478C0DA"><section section-type="section-one" id="H191699546CF44A759E409B0B01CF0880"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medication Access and Training Expansion Act of 2021</short-title></quote> or the <quote><short-title>MATE Act of 2021</short-title></quote>.</text></section><section id="H1AFD0F08174441B1892B646899B1C171"><enum>2.</enum><header>Requiring prescribers of controlled substances to complete training on treating and managing patients with opioid and other substance use disorders</header><text display-inline="no-display-inline">Section 303 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA6E3FF0E5AC14D4CA41D0A572EF25704"><subsection id="HEC67A5067C004651BF16CCB71FE05A8A"><enum>(l)</enum><header>Required training for prescribers on treating and managing patients with opioid and other substance use disorders</header><paragraph id="H46D15E4CCD9C4B6A979D785202EAB286"><enum>(1)</enum><header>Applicability</header><text>This subsection applies—</text><subparagraph id="HD958AB8C4CBC459BABFCB6354CEC5019"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to any practitioner who is licensed under State law to prescribe controlled substances and is not a veterinarian; and</text></subparagraph><subparagraph id="H789C905095EB4F20991430EB869231D4"><enum>(B)</enum><text display-inline="yes-display-inline">beginning with the first registration or renewal of registration by the practitioner under this section occurring not less than 180 days after the date of enactment of the <short-title>Medication Access and Training Expansion Act of 2021</short-title>.</text></subparagraph></paragraph><paragraph id="HABA502317EC6448DB407893BFFBCF7D6"><enum>(2)</enum><header>Training required</header><text>As a condition on registration under this section to dispense controlled substances in schedule II, III, IV, or V, the Attorney General shall require any practitioner described in paragraph (1)(A) to meet the following:</text><subparagraph id="H3C9A791D538843249EA6334655A3FD09"><enum>(A)</enum><text>If the practitioner is a physician, the practitioner shall meet 1 or more of the following conditions:</text><clause id="H3C0EA34356B1429AB6D6C2F231DE787B"><enum>(i)</enum><text>The physician holds a board certification in addiction psychiatry or addiction medicine from the American Board of Medical Specialties.</text></clause><clause id="HDD13B7A36F0542708E21E0B20E206371"><enum>(ii)</enum><text>The physician holds a board certification from the American Board of Addiction Medicine.</text></clause><clause id="H74E45C7230544DE9AD814B915B2FB251"><enum>(iii)</enum><text>The physician holds a board certification in addiction medicine from the American Osteopathic Association.</text></clause><clause id="H7669B1C322C342A89706B060531A4FAC"><enum>(iv)</enum><text display-inline="yes-display-inline">With respect to the treatment and management of patients with opioid and other substance use disorders, including the appropriate clinical use of any drug approved or authorized by the Food and Drug Administration for the treatment of a substance use disorder, the physician has completed not less than 8 hours of training (through classroom situations, seminars at professional society meetings, electronic communications, or otherwise) that is provided by—</text><subclause id="H1241F745AC94459EB49B78207E90B7E3"><enum>(I)</enum><text>the American Society of Addiction Medicine, the American Academy of Addiction Psychiatry, the American Medical Association, the American Osteopathic Association, the American Psychiatric Association, the American Academy of Hospice and Palliative Medicine, the American Academy of Pain Medicine, or any other organization accredited by the Accreditation Council for Continuing Medical Education (referred to in this subsection as the <quote>ACCME</quote>);</text></subclause><subclause id="H28E71619F1644D1EB283C881806832DC"><enum>(II)</enum><text display-inline="yes-display-inline">any organization accredited by a State medical society accreditor recognized by the ACCME; or</text></subclause><subclause id="HAB5C0ED951D443BCAA3F5A4F6F5DDF3B"><enum>(III)</enum><text display-inline="yes-display-inline">any organization accredited by the American Osteopathic Association to provide continuing medical education.</text></subclause></clause><clause id="H94C89E6A59DB46E0A8E723761CC6944C"><enum>(v)</enum><text>The physician graduated in good standing from an accredited school of allopathic medicine or osteopathic medicine in the United States during the 5-year period immediately preceding the date on which the physician first registers or renews under this section and has successfully completed a comprehensive allopathic or osteopathic medicine curriculum or accredited medical residency that included not less than 8 hours of training on treating and managing patients with opioid and other substance use disorders, including the appropriate clinical use of all drugs approved or authorized by the Food and Drug Administration for the treatment of a substance use disorder.</text></clause></subparagraph><subparagraph id="HFE5073AA538947A4823AEFE5FAEEEC0E"><enum>(B)</enum><text>If the practitioner is not a physician, the practitioner shall meet 1 or more of the following conditions:</text><clause id="H4478BAE8C76D4A289032C0AD80DCF8AC"><enum>(i)</enum><text display-inline="yes-display-inline">The practitioner has completed not less than 8 hours of training with respect to the treatment and medication management of patients with opioid and other substance use disorders (through classroom situations, seminars at professional society meetings, electronic communications, or otherwise) provided by the American Society of Addiction Medicine, the American Academy of Addiction Psychiatry, the American Medical Association, the American Osteopathic Association, the American Nurses Credentialing Center, the American Psychiatric Association, the American Association of Nurse Practitioners, the American Academy of Physician Assistants, the American Academy of Hospice and Palliative Medicine, the American Academy of Pain Medicine, the American Dental Association, or any other organization that the Secretary determines is appropriate for purposes of this clause.</text></clause><clause id="H191A69B4347A44BE875BA401104E3C0E"><enum>(ii)</enum><text display-inline="yes-display-inline">The practitioner graduated in good standing from an accredited physician assistant school, an accredited school of advanced practice nursing, or an accredited dental school in the United States during the 5-year period immediately preceding the date on which the practitioner first registers or renews under this section and has successfully completed a comprehensive physician assistant, advanced practice nursing, or dental curriculum that included not less than 8 hours of training on treating and managing patients with opioid and other substance use disorders, including the appropriate clinical use of all drugs approved or authorized by the Food and Drug Administration for the treatment of a substance use disorder.</text></clause></subparagraph></paragraph><paragraph id="HA8799EB9D0B24B6691434B7A678C643C"><enum>(3)</enum><header>One-time training</header><text display-inline="yes-display-inline">The Attorney General shall not require any practitioner to complete the training described in clause (iv) or (v) of paragraph (2)(A) or clause (i) or (ii) of paragraph (2)(B) more than once.</text></paragraph><paragraph id="H69AD0F12AF4B4A0E81210B79E881037F"><enum>(4)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to prevent a practitioner from using the same training to satisfy the training requirement under this subsection and for another purpose, such as satisfying State licensing requirements.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H7032570942C34B80AD517713331326C8"><enum>3.</enum><header>Practitioner education grant program</header><text display-inline="no-display-inline">Title V of the Public Health Service Act is amended by inserting after section 509 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-2">42 U.S.C. 290bb–2</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H744165C898504E60AC6917B6DE4EB353"><section id="HA11E1CA1C60347B18EDCEF132F9D674C"><enum>510.</enum><header>Practitioner education grant program</header><subsection id="HCE5F86B9759D4BCEB43632B87E9CF0C5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall carry out a program to award grants to eligible entities to expand the integration of substance use disorder education, including training on treatment and medication management, into the standard curriculum of relevant health care and health services education programs, thereby expanding the number of practitioners who deliver high-quality, evidence-based substance use disorder treatment.</text></subsection><subsection id="H88C8FFAB100E413A8353EEA0854309D2"><enum>(b)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under this section, an entity shall be—</text><paragraph id="HC348663F31EB4E63A644F403769B5879"><enum>(1)</enum><text>a private nonprofit or public professional association representing health care professionals in the field of medicine, physician assistants, nursing, dentistry, pharmacy, social work, psychology, marriage and family therapy, or health services administration; or</text></paragraph><paragraph id="H136B873ABB2A4A95876B9F7DFEFE0DAC"><enum>(2)</enum><text>a private nonprofit or public entity that is a university, college, or other professional school.</text></paragraph></subsection><subsection id="H98F5E26F96134054BFD82A57B6E9D665"><enum>(c)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated such sums as may be necessary for each of fiscal years 2022 through 2027.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
