<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2232</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210624">June 24, 2021</action-date><action-desc><sponsor name-id="S409">Mr. Luján</sponsor> (for himself, <cosponsor name-id="S413">Mr. Padilla</cosponsor>, and <cosponsor name-id="S253">Mr. Durbin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Energy to fund projects to restore and modernize National Laboratories, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restore and Modernize Our National Laboratories Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="id2A4C698FD33140FA89BC7D64115495C5"><enum>2.</enum><header>National Laboratories restoration and modernization</header><subsection id="id442e7ca6f84d47d9bdc4b022d46ee39e"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id8457FAFCF6344685B0562CAFCA5B91F3"><enum>(1)</enum><header>National Laboratory</header><text>The term <term>National Laboratory</term> has the meaning given the term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>).</text></paragraph><paragraph id="id84BBFE053329433ABA76E8154710E41A"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></subsection><subsection id="id10765288561245E3BE6E7AC2BA2450FD"><enum>(b)</enum><header>Restoration and modernization projects</header><text>The Secretary shall fund projects described in subsection (c) as needed to address the deferred maintenance, critical infrastructure needs, and modernization of National Laboratories.</text></subsection><subsection id="id36e17b21db1b4d4993437b8805545d7d"><enum>(c)</enum><header>Projects described</header><text>The projects referred to in subsection (b) are, as determined by the Secretary—</text><paragraph id="ide67e6e483d0d4422a914b581ad2cf12d"><enum>(1)</enum><text>priority deferred maintenance projects at National Laboratories, including facilities sustainment for, upgrade of, and construction of research laboratories, administrative and support buildings, utilities, roads, power plants, and any other critical infrastructure; and </text></paragraph><paragraph id="id8a27e6fb4cb446dfa7fbd507ec06e23b"><enum>(2)</enum><text>lab modernization projects at National Laboratories, including lab modernization projects relating to core infrastructure needed—</text><subparagraph id="id1CFE0DC2F182451291108ECC8145B6B4"><enum>(A)</enum><text>to support existing and emerging science missions with new and specialized requirements for world-leading scientific user facilities and computing capabilities; and </text></subparagraph><subparagraph id="id5F4B001777DB45C7B12E4C443CFACA10"><enum>(B)</enum><text>to maintain safe, efficient, reliable, and environmentally responsible operations.</text></subparagraph></paragraph></subsection><subsection id="id7F53A110A98E4C8C9EF0BC3C01704150"><enum>(d)</enum><header>Submission to Congress</header><text>For each fiscal year through fiscal year 2025, at the same time as the annual budget submission of the President, the Secretary shall submit to the Committees on Appropriations and Energy and Natural Resources of the Senate and the Committees on Appropriations and Science, Space, and Technology of the House of Representatives a list of projects for which the Secretary will provide funding under this section, including a description of each project and the funding profile for the project. </text></subsection><subsection id="id81d7c698a00e4606bc0b5873c3a42cf2"><enum>(e)</enum><header>Authorization of appropriations</header><paragraph id="id5245AFD2F95246CF845223BAFCDA9374"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary to carry out this section $6,100,000,000 for each of fiscal years 2022 through 2025. </text></paragraph><paragraph id="idBD8326230EA0437E97955EDF0BF02263"><enum>(2)</enum><header>Office of Science</header><text>Not less than <fraction>1/6</fraction> of the amounts made available to carry out this section each fiscal year shall be managed by the Office of Science of the Department of Energy.</text></paragraph></subsection></section></legis-body></bill>
