<section id="H0D131AF78D2B4E5F84D0D852583EDE1C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this title—</text> <paragraph id="HE1100230635F425DBB14877518FD6B90"><enum>(1)</enum><header>American Opportunity Fund</header><text display-inline="yes-display-inline">The term <term>American Opportunity Fund</term> means the fund established under section 3.</text></paragraph>
<paragraph id="H141E8F27796D4A2B982A250480B51269"><enum>(2)</enum><header>AO account</header><text>The term <term>AO account</term> means an American opportunity account established under section 4.</text></paragraph> <paragraph id="HA7FC89F991CA4B179355F4C65F33ADAD"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Treasury or the Secretary’s delegate.</text></paragraph>
<paragraph id="H2CFE9DE3485A445D932C4D21BD32733E"><enum>(4)</enum><header>American Opportunity Fund Board</header><text>The term <term>American Opportunity Fund Board</term> means the board established pursuant to section 7.</text></paragraph> <paragraph id="HEB76D3145542424ABF4F24C2FDF536AD"><enum>(5)</enum><header>Executive Director</header><text>The term <term>Executive Director</term> means the executive director appointed pursuant to section 7.</text></paragraph></section>
<section id="HFA267C97F8F44FC78698156D282AE776"><enum>3.</enum><header>American Opportunity Fund</header>
<subsection id="H84059E6DEC72412CA3D13A005BBEE8B4"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>American Opportunity Fund</quote>.</text></subsection> <subsection id="H4106236B6A4D4DC1B5A9218BEC962C6E"><enum>(b)</enum><header>Amounts held by Fund</header><text>The American Opportunity Fund consists of the sum of all amounts paid into the Fund under this title, increased by the total net earnings from investments of sums held in the Fund or reduced by the total net losses from investments of sums held in the Fund, and reduced by the total amount of payments made from the Fund (including payments for administrative expenses).</text></subsection>
<subsection id="H6873A6840B2042B38E5A67E5954848A5"><enum>(c)</enum><header>Use of Fund</header>
<paragraph id="H2296E9CC3FE241F18145415D107AF2C2"><enum>(1)</enum><header>In general</header><text>The sums in the American Opportunity Fund are appropriated and shall remain available without fiscal year limitation—</text> <subparagraph id="H8634E044B92B49DC880BA84FD5B27C83"><enum>(A)</enum><text>to make contributions to AO accounts;</text></subparagraph>
<subparagraph id="H70B79A2049474119A96CB76AB7220355"><enum>(B)</enum><text>to invest under section 6;</text></subparagraph> <subparagraph id="HD19BF0C32E1941F1AE23D00FE399A73D"><enum>(C)</enum><text>to make distributions in accordance with this title;</text></subparagraph>
<subparagraph id="H78D2755EDC1E4D3CBC4E7B337B63D9BD"><enum>(D)</enum><text>to pay the administrative expenses of carrying out this title; and</text></subparagraph> <subparagraph commented="no" id="H6A406D25706649C9929CE77C3B46CF3B"><enum>(E)</enum><text>to purchase insurance as provided in section 8(c)(2).</text></subparagraph></paragraph>
<paragraph id="HC5187477AD944D8FA060223ACD4C3C16"><enum>(2)</enum><header>Exclusive purposes</header><text>The sums in the American Opportunity Fund shall not be appropriated for any purpose other than the purposes specified in this section and may not be used for any other purpose.</text></paragraph></subsection> <subsection id="H3B301528EDB64B36BB8F909449C6630C"><enum>(d)</enum><header>Transfers to American Opportunity Fund</header><text>The Secretary shall make transfers from the general fund of the Treasury to the American Opportunity Fund as follows:</text>
<paragraph commented="no" id="H85AD03B4AE274EE9A179B1C220D7EAE5"><enum>(1)</enum><header>Initial contribution for eligible individuals born after December 31, 2021</header><text>Upon receipt of a certification under section 4(b)(2) with respect to an individual born after December 31, 2021, the Secretary shall transfer $1,000 to the AO account of the individual.</text></paragraph> <paragraph id="H3F4FCDA2CBC74D5986EE1A203B334E13"><enum>(2)</enum><header>Annual contributions</header> <subparagraph id="id90A850B8A22942AFA98A20E3DB581150"><enum>(A)</enum><header>In general</header><text>Each year which occurs after the year in which an AO account is established for an eligible individual and before the year the eligible individual attains the age of 18, the Secretary shall transfer the annual contribution amount to the AO account of the individual.</text></subparagraph>

<clause id="idF9D7727661D542D1B03A3EB6F647D74A"><enum>(i)</enum><header>Applicable household income</header><text>The term <term>applicable household income</term> means household income (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B(d)</external-xref> of the Internal Revenue Code of 1986), except that—</text> <subclause id="idC789671976D84DE6B5E630263367BB87"><enum>(I)</enum><text>with respect to any calendar year, the Secretary shall use the income of the second calendar year preceding the calendar year for which the contribution relates; and</text></subclause>
<subclause id="id82A8AEA04B53449288269BC263C1513F"><enum>(II)</enum><text>in determining household income the Secretary shall aggregate the income of married individuals filing separate tax returns.</text></subclause></clause> <clause id="idA01DFEF4AEF04F9FBB0B323EF571FF20"><enum>(ii)</enum><header>Special rule for individuals not filing returns</header> <subclause id="idD31D16FF73A54C919CB3F608DFDC40B0"><enum>(I)</enum><header>In general</header><text>In the case of any taxpayer who was not required to file a return of tax for the tax imposed by section 1 for the taxable year described in clause (i)(I) or for whom the information described in clause (i) is not available for such year, such taxpayer shall be treated as a taxpayer with a household income which is less than 100 percent of the poverty line.</text></subclause>
<subclause id="id092426F4D7014CDE9307D0CD25184E07"><enum>(II)</enum><header>Use of other data</header><text>Subclause (I) shall not apply if the Secretary determines, based on such other information from any agency of the United States as the Secretary determines is reliable, that the taxpayer's household income for such year is 100 percent of the poverty line or greater.</text></subclause></clause> <clause id="id05DF782A83A246D6A478CBDFCFA2AE38"><enum>(iii)</enum><header>Poverty line</header><text>The term <term>poverty line</term> has the meaning given such term under <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B(d)</external-xref> of the Internal Revenue Code of 1986.</text></clause></subparagraph>
<subparagraph id="id94C85B2E105345268B42F972E9A1E9AC"><enum>(D)</enum><header>Authority to provide tax information</header>
<clause id="id50211A8111D7448A813A68CF1084D908"><enum>(i)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6103">Section 6103(l)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idECEB3AD9E9D241D1979878525685FCEE"> <paragraph id="id4eb1abbee9124434b0dddd45298a4593"><enum>(23)</enum><header>Disclosure of return information to carry out eligibility requirements for certain programs</header> <subparagraph id="idb4003316cf74465491d88a997614b64a"><enum>(A)</enum><header>In general</header><text>The Secretary shall disclose to officers and employees of the Department of the Treasury or the American Opportunity Fund Board return information of any taxpayer whose income is relevant in determining any annual contribution to an American Opportunity Account under section 3 of the <short-title>American Opportunity Accounts Act</short-title>. Such return information shall be limited to—</text>
<clause id="id477c75951bc2470a990a175382e75932"><enum>(i)</enum><text>taxpayer identity information with respect to such taxpayer,</text></clause> <clause id="ida193948708dc42b18f846fe12d2110b5"><enum>(ii)</enum><text>the filing status of such taxpayer,</text></clause>
<clause id="id4dfd7e35bb3d4d0a9e167442556855c0"><enum>(iii)</enum><text>the number of individuals for whom a deduction is allowed under section 151 with respect to the taxpayer (including the taxpayer and the taxpayer's spouse),</text></clause> <clause id="id70cb478456ae462993ddbcd9fd360fc9"><enum>(iv)</enum><text>the modified adjusted gross income (as defined in section 36B) of such taxpayer, of any spouse of such taxpayer who filed a separate return, and of each of the other individuals included under clause (iii) who are required to file a return of tax imposed by chapter 1 for the taxable year,</text></clause>
<clause id="id9aa26ff26e73441db2857aaa8272400b"><enum>(v)</enum><text>such other information as is prescribed by the Secretary by regulation as might indicate whether the taxpayer is eligible for such an annual contribution (and the amount thereof), and</text></clause> <clause id="id5bb87f70c979499fa3de5c999d1ee1b3"><enum>(vi)</enum><text>the taxable year with respect to which the preceding information relates or, if applicable, the fact that such information is not available.</text></clause></subparagraph>
<subparagraph id="idca458575417848f49cc291855dd1aec7"><enum>(B)</enum><header>Restriction on use of disclosed information</header><text>Return information disclosed under subparagraph (A) may be used by officers and employees of the Department of the Treasury or the American Opportunity Fund Board for the purposes of, and to the extent necessary in establishing eligibility for, and verifying the appropriate amount of, any annual contribution described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause> <clause id="id6233bc138ff64a0090bd65b04a9c1c1b"><enum>(ii)</enum><header>Procedures and recordkeeping related to disclosures</header><text>Paragraph (4) of section 6103(p) of such Code is amended by striking <quote>or (22)</quote> each place it appears and inserting <quote>(22), or (23)</quote>.</text></clause></subparagraph>
<subparagraph id="id9B4DD6C89FFD436BAC7BB17348F26335"><enum>(E)</enum><header>Study on incorporation of other wealth factors</header><text>Not later than 2 years after the date of the enactment of this Act, the Comptroller General shall submit to Congress and the Secretary of the Treasury a report on the feasibility and distributive impacts of a new measure for determining the amount of the annual contribution amount under this paragraph based on family wealth, total assets, and overall net worth. Such measure may—</text> <clause id="id2FA43808BA3D4D57BC0037AC5695E29E"><enum>(i)</enum><text>include financial assets, the value of family home, retirement accounts, business and entrepreneurial ventures, potential future inheritances, and any other assets or debts; and</text></clause>
<clause id="id69B1BA3F2A0C41CA97966251AF8DED8D"><enum>(ii)</enum><text>continue to factor in current or past income to the extent such information is useful in estimating overall household wealth.</text></clause></subparagraph></paragraph> <paragraph commented="no" id="HDAA5DEC3F2D1492585CA2B7375EEEA7F"><enum>(3)</enum><header>Adjustment for inflation</header> <subparagraph commented="no" id="H18D03D3A5E694AAFAB16D7E74B59D811"><enum>(A)</enum><header>In general</header><text>For each calendar year beginning after 2022, each of the dollar amounts under paragraphs (1) and (2)(B)(i) shall be increased by such dollar amount multiplied by the cost-of-living adjustment determined under <external-xref legal-doc="usc" parsable-cite="usc/26/1">section 1(f)(3)</external-xref> of the Internal Revenue Code of 1986 determined by substituting <quote>calendar year 2021</quote> for <quote>calendar year 2016</quote> in subparagraph (A)(ii) thereof.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4DC93B82D1144A14B88E5385C203BD01"><enum>(B)</enum><header>Rounding</header><text>If any amount adjusted under paragraph (1) is not a multiple of $50, such amount shall be rounded to the next lowest multiple of $50.</text></subparagraph></paragraph></subsection> <subsection id="H20C58593EF74493A81619766783B89E7"><enum>(e)</enum><header>Prohibition on Use of Payroll Taxes To Fund AO accounts</header><text display-inline="yes-display-inline">The American Opportunity Fund and AO accounts are wholly separate and unique from the Social Security system. No amount from any tax on employment may be contributed to the American Opportunity Fund or AO accounts.</text></subsection></section>
<section id="H615489D4FB7548399AC8A283D56E7DEF"><enum>4.</enum><header>AO accounts</header>
<subsection id="H437FB9C743F145F1A92B33F9A52EBD06"><enum>(a)</enum><header>In general</header>
<paragraph id="H78761F2FF1334F9EA2B32F05DDFC35AE"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Executive Director shall establish in the American Opportunity Fund an account (to be known as an <quote>American Opportunity account</quote> or an <quote>AO account</quote>) for each eligible individual certified under subsection (b). Each such account shall be identified to its account holder by means of a unique personal identifier currently recognized by the Internal Revenue Service and shall remain in the American Opportunity Fund.</text></paragraph> <paragraph id="H3EED3521851E4A068D62CCF3C3561D12"><enum>(2)</enum><header>Account balance</header><text>The balance in an account holder’s AO account at any time is the excess of—</text>
<subparagraph id="H7F3B37506C94493F9300003744449328"><enum>(A)</enum><text>the sum of—</text> <clause id="HE0657EEE2DD2410EAE3B881F24D7525F"><enum>(i)</enum><text>all deposits made into the American Opportunity Fund and credited to the account under paragraph (3); and</text></clause>
<clause id="H90A4BE06DBFB43A3ABFE8048C45E0E1A"><enum>(ii)</enum><text>the total amount of allocations made to and reductions made in the account pursuant to paragraph (4); over</text></clause></subparagraph> <subparagraph id="HC42FE5B8E3154692975E12CD40F44B47"><enum>(B)</enum><text>the amounts paid out of the account with respect to such individual under subsection (c).</text></subparagraph></paragraph>
<paragraph id="H441FF28DB34B49019E1AAE2DD02C5564"><enum>(3)</enum><header>Crediting of contributions</header><text>Pursuant to regulations which shall be prescribed by the Executive Director, the Executive Director shall credit to each AO account the amounts paid into the American Opportunity Fund under section 3(d) which are attributable to the account holder of such account.</text></paragraph> <paragraph id="H22A9CF5493BE4EC1B0DC78E199CB7663"><enum>(4)</enum><header>Allocation of earnings and losses</header><text>The Executive Director shall allocate to each AO account an amount equal to the net earnings and net losses from each investment of sums in the American Opportunity Fund which are attributable, on a pro rata basis, to sums credited to such account, reduced by an appropriate share of the administrative expenses paid out of the net earnings, as determined by the Executive Director.</text></paragraph></subsection>
<subsection commented="no" id="H9D8993BEFA084761872A570DD96954C9"><enum>(b)</enum><header>Eligible individual</header><text>For purposes of this title—</text> <paragraph commented="no" id="H254F58770B884A6F97112C5CE22B5933"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>eligible individual</term> means any individual who—</text>
<subparagraph commented="no" id="H5CBD9710D18043BB8D4861E9B5DE228D"><enum>(A)</enum><text>was born after December 31, 2005;</text></subparagraph> <subparagraph commented="no" id="HD78C7B3D9B86490CB69FA7215B5C6A07"><enum>(B)</enum><text>has not yet attained the age of 18 years; and</text></subparagraph>
<subparagraph commented="no" id="H14A24BC5E2C645CAB86149B281D38DBC"><enum>(C)</enum><text>has a valid, unique, Federal Government issued identification number recognized by the Internal Revenue Service.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id4F97698CFBFB4218B2B88B91EB09809A"><enum>(2)</enum><header display-inline="yes-display-inline">Certification of account holders</header> <subparagraph commented="no" display-inline="no-display-inline" id="id88156754194A4CC286BBE204CC42604B"><enum>(A)</enum><header>Automatic certification for certain individuals born after December 31, 2021</header><text display-inline="yes-display-inline">On any date after December 31, 2021, on which an eligible individual is issued a social security account number under section 203(c)(2) of the Social Security Act, the Commissioner of Social Security shall certify to the Executive Director and the Secretary of the Treasury the name of, and social security number issued to, such eligible individual.</text></subparagraph>
<subparagraph commented="no" id="id96a92d14144d490899951bac8be3ab2a"><enum>(B)</enum><header>Other individuals</header><text>In the case of an eligible individual who is not certified under subparagraph (A), such individual may request the establishment an AO account under this subparagraph by application to the Executive Director, and the Executive Director shall certify such individual under this subparagraph.</text></subparagraph></paragraph></subsection> <subsection id="H6BD3D96840E84B0B9E3E25BDD572C0AD"><enum>(c)</enum><header>Restrictions on distributions</header> <paragraph id="H0486DB518F31450DAB6B94845503AE71"><enum>(1)</enum><header>Age-related restrictions</header> <subparagraph id="id9F3C7DBA6F3B405A8AF54891D107B1E8"><enum>(A)</enum><header>In general</header><text>Except as otherwise provided in this paragraph, no amount may be distributed from an AO account before the date on which the account holder attains the age of 18.</text></subparagraph>
<subparagraph id="H7903FCD866C849BEA2D906027B191395"><enum>(B)</enum><header>Higher education expenses</header><text>Subparagraph (A) shall not apply to amounts paid for qualified tuition and related expenses (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/25A">section 25A(f)(1)</external-xref> of the Internal Revenue Code of 1986) of the account holder if the account holder is an eligible student (as defined in section 25A(b)(3) of such Code) with respect to such expenses.</text></subparagraph> <subparagraph id="id7B177E6E56BB4460A8E9C41141C07F12"><enum>(C)</enum><header>Authority to provide higher age limit for certain distributions</header><text>The Secretary, in consultation with the American Opportunity Fund Advisory Board, may by regulations provide for a higher age limitation with respect to distributions relating to certain categories of qualified expenses if the Secretary determines that such higher age limitation is appropriate.</text></subparagraph></paragraph>
<paragraph id="id13703DE2D72A4993AB2612FCEA7179E0"><enum>(2)</enum><header>Use-related restrictions</header>
<subparagraph id="id0D517A53D21F43B9B4D064CC058C5925"><enum>(A)</enum><header>In general</header><text>No amount may be distributed from an AO account unless the account holder establishes, under rules established by the Executive Director in consultation with the American Opportunity Fund Advisory Board, that such amount shall be used for a qualified expense.</text></subparagraph> <subparagraph id="id555730EB366E48F5BEB0176C89639E49"><enum>(B)</enum><header>Qualified expense</header><text>For purposes of this subsection—</text>
<clause id="id5F92021D30C74F87A072839EBE09BCC7"><enum>(i)</enum><header>In general</header><text>The term <term>qualified expense</term> means expenses for any of the following:</text> <subclause commented="no" display-inline="no-display-inline" id="id7CD1295D8C004D56AD5F2909A92CF5D0"><enum>(I)</enum><text display-inline="yes-display-inline">Education of the account holder at—</text>
<item id="id8bc57b82e29e4f90bd983b21c20ee0e2"><enum>(aa)</enum><text>an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)); or</text></item> <item id="id5a74de3b4aa1417f82df80c89ac81d14"><enum>(bb)</enum><text>an area career and technical education school (as defined in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>)). </text></item></subclause>
<subclause id="id16CA37549B104A61B5FB5C9FA2BCE555"><enum>(II)</enum><text>Ownership of a home by the account holder.</text></subclause> <subclause id="idB9D04C49DF0C4845B5C46D0250CC88DE"><enum>(III)</enum><text>Any expenses paid or incurred on or after the date on which the account holder attains age 59½.</text></subclause>
<subclause id="id3E6433AF231B4795A5A399F948970ED7"><enum>(IV)</enum><text>Any other investment in financial assets or personal capital that provides long-term gains to wages and wealth, as established under regulations promulgated by the Secretary, in consultation with the Executive Director and the American Opportunity Fund Advisory Board.</text></subclause></clause> <clause id="id506675E13BC742C28E3FC9C9EA4781E5"><enum>(ii)</enum><header>Exception</header><text>Such term shall not include any expense described in clause (i) which is paid to a person who does not meet such standards as are prescribed by the Secretary, in consultation with the Executive Director and the American Opportunity Fund Advisory Board.</text></clause></subparagraph></paragraph>
<paragraph id="id087B9504F21647349A755AA8CC6BB955"><enum>(3)</enum><header>American Opportunity Account Advisory Board</header><text>For purposes of this subsection, the term <term>American Opportunity Fund Advisory Board</term> means an advisory board established by the Secretary consisting of individuals with expertise in savings and asset-building, home financing, education financing, consumer financial protection, and such other areas as the Secretary may determine appropriate.</text></paragraph></subsection></section> <section id="H89F63A37FD5D484BB9CEA88DCF0D04E6"><enum>5.</enum><header>Assignment, alienation, and treatment of deceased individuals</header> <subsection id="H5921015C79D245A98764F3FDE6190E9E"><enum>(a)</enum><header>Assignment and alienation</header><text>Under regulations which shall be prescribed by the Executive Director, rules relating to assignment and alienation applicable under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, with respect to amounts held in accounts in the Thrift Savings Fund shall apply with respect to amounts held in AO accounts in the American Opportunity Fund.</text></subsection>
<subsection id="id838a2f4a0fb9458e89ba4a30af12353b"><enum>(b)</enum><header>Treatment of accounts of deceased individuals</header><text>In the case of a deceased account holder of an AO account which has an account balance greater than zero, upon receipt of notification of such individual’s death, the Executive Director shall close the account and shall transfer the balance in such account to the AO account of such account holder’s surviving spouse or, if there is no such account of a surviving spouse, to the duly appointed legal representative of the estate of the deceased account holder, or if there is no such representative, to the person or persons determined to be entitled thereto under the laws of the domicile of the deceased account holder.</text></subsection></section> <section id="H9A3CDA77D3014F81973700FF322DAFD2"><enum>6.</enum><header>Rules governing AO accounts relating to investment, accounting, and reporting</header> <subsection id="id45E0DE31851A48AF93FFCF14D9390A61"><enum>(a)</enum><header>Investment program</header> <paragraph id="idC931231E2F7B4270A0BE5ACDACA9A46A"><enum>(1)</enum><header>In general</header><text>The American Opportunity Fund Board shall invest amounts in the American Opportunity Fund in securities of the United States Government issued as provided in paragraph (2).</text></paragraph>
<paragraph id="id25C8DAA480FC4409B56048598D93FD37"><enum>(2)</enum><header>Securities</header>
<subparagraph id="id7C91D931B5964BF7A1C665A2ABBF59C6"><enum>(A)</enum><header>In general</header><text>The Secretary of the Treasury is authorized to issue special interest-bearing obligations of the United States for purchase by the American Opportunity Fund. </text></subparagraph> <subparagraph id="idDC02B70D335D4DA9A90D103BAB3AFD77"><enum>(B)</enum><header>Investment</header> <clause id="idF47672D59A454AA195806DFBE288C816"><enum>(i)</enum><text>Obligations issued for the purpose of this paragraph shall have maturities fixed with due regard to the needs of the American Opportunity Fund as determined by the Executive Director, and shall bear interest at a rate equal to the average market yield (computed by the Secretary of the Treasury on the basis of market quotations as of the end of the calendar month next preceding the date of issue of such obligations) on all marketable interest-bearing obligations of the United States then forming a part of the public debt which are not due or callable earlier than 10 years after the end of such calendar month.</text></clause>
<clause commented="no" display-inline="no-display-inline" id="idCAC70F6B462F4327A43C233508C64DB8"><enum>(ii)</enum><text>Any average market yield computed under clause (i) which is not a multiple of one-eighth of 1 percent, shall be rounded to the nearest multiple of one-eighth of 1 percent.</text></clause></subparagraph></paragraph></subsection> <subsection id="H7BACD082408B456C978F4681B5B46A1E"><enum>(b)</enum><header>Independent public accountant</header> <paragraph id="H80CD7701BE51448B9193762A89D064DB"><enum>(1)</enum><header>In general</header><text>Under regulations which shall be prescribed by the Executive Director, and subject to the provisions of this title, section 8439(b) of title 5, United States Code (relating to engagement of independent qualified public accountant), shall apply with respect to the American Opportunity Fund and accounts maintained in such Fund in the same manner and to the same extent as such section relates to the Thrift Savings Fund and the accounts maintained in the Thrift Savings Fund.</text></paragraph>
<paragraph id="H5049E0B1E1B14ABB83A4B711E250475F"><enum>(2)</enum><header>Application rules</header><text>For purposes of paragraph (1), references in such section 8439(b) to an employee, Member, former employee, or former Member shall be deemed references to an account holder of an AO account in the American Opportunity Fund.</text></paragraph></subsection> <subsection id="H667ABF1019274001B2009053794DBB91"><enum>(c)</enum><header>Confidentiality and disclosure</header> <paragraph id="H1E860BDE36D444B9BB2074B1A8F819EC"><enum>(1)</enum><header>In general</header><text>Except as otherwise authorized by Federal law, the American Opportunity Fund Board, the Executive Director, and any employee of the American Opportunity Fund Board shall not disclose information with respect to the American Opportunity Fund or any account maintained in such Fund.</text></paragraph>
<paragraph id="H02989576ABB44F5581189B9CCD3A4134"><enum>(2)</enum><header>Disclosure to designee of beneficiary</header><text>The Executive Director may, subject to such requirements and conditions as he may prescribe by regulations, disclose such information with respect to the AO account of the beneficiary to such person or persons as the beneficiary may designate in a request for or consent to such disclosure, or to any other person at the beneficiary’s request to the extent necessary to comply with a request for information or assistance made by the beneficiary to such other person.</text></paragraph></subsection></section> <section id="H07EAE57F632649A2AF64F8D0A18EF66F"><enum>7.</enum><header>American Opportunity Fund Board</header> <subsection id="H8EF025950624403EB4779E5A361C650E"><enum>(a)</enum><header>In general</header><text>There is established in the executive branch of the Government an American Opportunity Fund Board.</text></subsection>
<subsection id="H14B744B706E34162A8217393D5E048BC"><enum>(b)</enum><header>Composition, duties, and responsibilities</header><text>Subject to the provisions of this title, the following provisions shall apply with respect to the American Opportunity Fund Board in the same manner and to the same extent as such provisions relate to the Federal Retirement Thrift Investment Board:</text> <paragraph id="H5960CC8178254152922E90D1F3961DFC"><enum>(1)</enum><text>Section 8472 of title 5, United States Code (relating to composition of Federal Retirement Thrift Investment Board).</text></paragraph>
<paragraph id="H03F26A7C6A6D4E4FBD438C96A911C3F8"><enum>(2)</enum><text>Section 8474 of such title (relating to Executive Director).</text></paragraph> <paragraph id="H8BCF2E299B784B67B805D248459CB012"><enum>(3)</enum><text>Section 8476 of such title (relating to administrative provisions).</text></paragraph></subsection></section>
<section id="H46FC51F252C64E408668CE8D0923E9A3"><enum>8.</enum><header>Fiduciary responsibilities</header>
<subsection id="H78A2B2461FCD464891EE7E283E389387"><enum>(a)</enum><header>In general</header><text>Under regulations of the Secretary of Labor, the provisions of sections 8477 and 8478 of title 5, United States Code, shall apply in connection with the American Opportunity Fund and the accounts maintained in such Fund in the same manner and to the same extent as such provisions apply in connection with the Thrift Savings Fund and the accounts maintained in the Thrift Savings Fund.</text></subsection> <subsection id="H717B9052F0EA4E9E9D61D01CC63F57AB"><enum>(b)</enum><header>Investigative authority</header><text>Any authority available to the Secretary of Labor under section 504 of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/29/1134">29 U.S.C. 1134</external-xref>) is hereby made available to the Secretary of Labor, and any officer designated by the Secretary of Labor, to determine whether any person has violated, or is about to violate, any provision applicable under subsection (a).</text></subsection>
<subsection id="HF5B6FCE12A924C2AB6175662A7DC0A75"><enum>(c)</enum><header>Exculpatory provisions; insurance</header>
<paragraph id="HA4DCD1387A1E4F38BEC99869F05C243A"><enum>(1)</enum><header>In general</header><text>Any provision in an agreement or instrument which purports to relieve a fiduciary from responsibility or liability for any responsibility, obligation, or duty under this title shall be void.</text></paragraph> <paragraph id="H55120631BF5740258F17C60EEF3506E0"><enum>(2)</enum><header>Insurance</header><text>Amounts in the American Opportunity Fund available for administrative expenses shall be available and may be used at the discretion of the Executive Director to purchase insurance to cover potential liability of persons who serve in a fiduciary capacity with respect to the Fund and accounts maintained therein, without regard to whether a policy of insurance permits recourse by the insurer against the fiduciary in the case of a breach of a fiduciary obligation.</text></paragraph></subsection></section>
<section id="H7405F887F60F47179F86278DF52BCC90"><enum>9.</enum><header>Accounts disregarded in determining eligibility for Federal benefits</header><text display-inline="no-display-inline">Amounts in any AO account shall not be taken into account in determining any individual’s or household’s financial eligibility for, or amount of, any benefit or service, paid for in whole or in part with Federal funds, including student financial aid.</text></section> <section id="H99FB5F420F0646E49B5B0007A8B3258B"><enum>10.</enum><header>Reports</header> <subsection id="H5E740B4A247046D09BC27E0F299A81B3"><enum>(a)</enum><header>Reports to Congress</header><text display-inline="yes-display-inline">The Executive Director, in consultation with the Secretary, shall annually transmit a written report to the Congress. Such report shall include—</text>
<paragraph id="H03F97C882F944371B88F6CB7DFC1FB4C"><enum>(1)</enum><text>a detailed description of the status and operation of the American Opportunity Fund and the management of the AO accounts; and</text></paragraph> <paragraph id="H380E157B0F6E4282BCC1544FB94939B1"><enum>(2)</enum><text>a detailed accounting of the administrative expenses in carrying out this title, including the ratio of such administrative expenses to the balance of the American Opportunity Fund and the methodology adopted by the Executive Director for allocating such expenses among the AO accounts.</text></paragraph></subsection>
<subsection id="H803B013BED6E46EC9E83D2AA02FFFA2F"><enum>(b)</enum><header>Reports to account holders</header><text display-inline="yes-display-inline">The American Opportunity Fund Board shall prescribe regulations under which each individual for whom an AO account is maintained shall be furnished with an annual statement relating to the individual’s account, which shall include—</text> <paragraph id="HE554793359CE4DB3ABF69B9F96625149"><enum>(1)</enum><text>a statement of the balance of individual’s AO account;</text></paragraph>
<paragraph id="HD26B7B2285DE4CAD89E1DA466DB4F4A7"><enum>(2)</enum><text>a projection of the account’s growth by the time the individual attains the age of 18; and</text></paragraph> <paragraph id="H8ABF4E4BF07B44B884450F4E3EFA6E2E"><enum>(3)</enum><text>such other information as the Secretary deems relevant.</text></paragraph></subsection></section>
<section id="id6fd0527aea7540a4bb72c277a6a6aa75"><enum>11.</enum><header>Programs for promoting financial capability</header><text display-inline="no-display-inline">The Secretary of the Treasury, in coordination with the Financial Literacy and Education Commission, shall develop programs to promote the financial capability of account holders of AO accounts.</text></section> <section commented="no" id="HCD03C839FD2144F9BED891E57AB14E0D"><enum>12.</enum><header>Tax treatment</header> <subsection commented="no" id="id86E20E27F0CC47C7A7FC441E6AB223FC"><enum>(a)</enum><header>Contributions and distributions</header><text>Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 139H the following new section:</text>

<section commented="no" id="id9B837F694D1E4F1D9038322EB9C97B84"><enum>139I.</enum><header>Contributions to and distributions from AO accounts</header><text display-inline="no-display-inline">Gross income shall not include—</text> <paragraph commented="no" id="id114AD2B5A3914D789383011E4EA16DB3"><enum>(1)</enum><text display-inline="yes-display-inline">any contribution credited to the AO account of the taxpayer under section 4(a)(3) of the <short-title>American Opportunity Accounts Act</short-title>, and</text></paragraph>
<paragraph commented="no" id="idBB55B64BBF0D4EECBC2909E129A2B33A"><enum>(2)</enum><text display-inline="yes-display-inline">any distribution from such an AO account.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" id="H39A3144848A542CA943BA7074178B8B9"><enum>(b)</enum><header>Tax treatment of earnings and distributions</header><text>Subchapter F of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new part:</text>

<subsection commented="no" id="HA4AEA1FD152C4EE48D7900788CD4B003"><enum>(a)</enum><header>General rule</header><text display-inline="yes-display-inline">The American Opportunity Fund and AO accounts shall be exempt from taxation under this subtitle. Notwithstanding the preceding sentence, a AO account shall be subject to the taxes imposed by section 511 (relating to imposition of tax on unrelated business income of charitable organizations).</text></subsection> <subsection commented="no" id="H7C0B4422ACB04193ACF2CCD8232C7FBF"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section, the terms <term>American Opportunity Fund</term> and <term>AO account</term> have the meanings given such terms under the <short-title>American Opportunity Accounts Act</short-title>.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection commented="no" id="idF519525776D84CD49DF84ADA236524E6"><enum>(c)</enum><header>Conforming amendments</header>
<paragraph commented="no" id="id61D3AE6FAC2346B2A34376B8F73ED3DF"><enum>(1)</enum><text>The table of sections for part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after the item related to section 139H the following new item:</text> <quoted-block style="OLC" id="idad7969a9-662c-42b0-88ea-45e6a4d538ff"> <toc> <toc-entry idref="id9B837F694D1E4F1D9038322EB9C97B84" level="section">Sec. 139I.
